Are You Ready For Shared Parental Leave

T

he impact of Shared Parental Leave (SPL), which came into force in December 2014, is just beginning for small businesses, as parents of children with an expected week of childbirth (EWC) from 5th April 2015 can now take advantage of the new rules. Where an employee has adopted a child, EWC is replaced with week of matching.

What are the new rules? Broadly, employees who qualify can convert maternity leave and pay into shared parental leave and pay which can be taken by either parent. SPL provides a lot more flexibility about how the leave can be taken after a birth or adoption. It also does not have to be taken in a single continuous period of time enabling periods of a week or multiple weeks to be taken and can be taken at the same time as the other parent who may be on SPL, maternity of adoption leave. Employees are allowed to make up to 3 requests for SPL but the employer can allow more requests if it wishes to. SPL can be taken for any number of children but any period of SPL must be taken before the child’s first birthday or the first anniversary of placement for adoption. It is also given in addition to unpaid parental leave.

What are the qualifying criteria? Employment and Earnings Test The other parent must have been in employment or selfemployment for at least 26 weeks in the 66 weeks before the child’s EWC and have a period of 13 weeks of minimum earnings of £30 a week. Continuity of Employment Test If the employment and earnings test is satisfied, the employee then has to meet each of the following conditions for SPL: • 26 weeks’ continuous employment at the 15th week before the EWC and remain in that employment. • Must have the main responsibility for the child’s care with the other parent. • The mother must have cut short her maternity leave period, or her maternity pay period where she qualifies for SMP or maternity allowance but is not entitled to maternity leave. ust give the relevant notifications to their employer •M at least eight weeks before the first period of leave and provide any evidence required by the employer.

How much leave and pay is available? Leave The period of SPL that is available is calculated by working out the number of weeks’ maternity or adoption leave that has or will be taken and deducting this number from 52. Pay The period of SPL pay that is available is calculated by working out the number of weeks’ SMP, SAP or maternity allowance that the mother has or will receive and deducting this number from 39.

For example, if a woman who was on maternity leave and was receiving SMP committed to bringing her leave to and end after 20 weeks, the remaining 32 weeks of maternity leave could be converted into SPL and the remaining 19 weeks of SMP could be converted into SPL pay and the SPL leave and pay could be split between the parents if they both qualified.

What additional protection do employees have in respect of SPL? Employees are protected against detrimental treatment, unfair dismissal and sex discrimination.

What should you be thinking about in your business? •R esearch indicates that many small businesses have not taken in action in respect of the new rules and will only do so when they get a request from an employee. Consistent treatment of staff is very important so we recommend getting a policy in place as soon as possible so that you are ready for any request. •Y ou may believe that your male staff are unlikely to request the new SPL and you don’t want to encourage it? Be careful not to create a culture where male staff are worried about asking for SPL as this could inadvertently create inconsistent treatment. •R emember that although you may see male staff taking up the new SPL and this having an impact on resources, on the flip side the new rules will also see the early return of your female staff after their leave! •W e know that many small business owners are worried about the practical implications of the new SPL rules, particularly managing workloads and the cost of covering gaps in resource. A general flexible working policy for everyone is usually well received by staff and can help to get buy in from them to support periods when the company is operating with a reduced team, perhaps as a result of SPL. Flexible working can also have other benefits to the company. SPL has arrived and is here to stay. It is only a matter of time before businesses begin to receive requests for SPL. One Small Step for Magistrates, But a Giant Leap for Criminal Fines

A

relatively unnoticed, but potentially quite expensive, legislative change came into effect on 12th March 2015 seems to have slipped many an employers’ notice. It is however something businesses regardless of size need to be aware of, should they find themselves falling foul of the law after that date. Until now, there has been a limit to the level of fines imposed upon conviction by a Magistrates’ Court following a breach of legislation. The maximum fines available were dependant on the seriousness of the offence, but in general the penalty for offences committed under the Health and Safety at Work etc Act 1974 or related regulations ranged from £5,000 for a minor offence up to a maximum of £20,000 for a more serious violation. If the Magistrate felt the punishment should be above these levels then the case would have to be referred to the Crown Court.

There has been a significant increase in fines for Health and Safety breaches in recent years, and these legislation changes mean we are likely to see the trend continue. Consultation on the new sentencing guidelines for Health and Safety has been completed and, with the guidance expected later this year, the power to impose larger fines will become even more relevant. Of course, the best way of avoiding fines is by avoiding Health and Safety breaches and complying with legislation.

The legislation change, which is included within Section 85 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012, has effectively removed all the limits on fines made by a Magistrate and an uncapped fine can therefore now be imposed. The changes apply across all sectors and affect a very wide range of legislation aside from Health and Safety offences. These include financial services, competition, sale of alcohol to minors, a breach of some of the Care Quality Commission’s Fundamental Standards and environmental legislation. It is expected that the changes will encourage greater use of fines in the Magistrates’ Courts enabling them to impose more proportionate fines on wealthy and corporate

Strategic Cost Management - What It Means For Your Business

s we look to the future, with a growing economy, many companies are looking for ways to boost sales and increase profits; the most efficient way of funding these growth strategies is to free-up costs and capital and re-invest these funds into the most promising opportunities. Auditel recently conducted a survey with Management Today magazine and some of the results of that survey make fascinating reading. When asked what the main purpose of a cost management exercise was, the readers responded with the following: • 22.5% of respondents stated that they saw a cost management programme as being a key element to ensure the financial survival of the business; •4 7.3% of respondents saw an effective cost management programme as a means of improving the efficiency and effectiveness of the organisation; • 11.6% saw a cost management programme as being a means to accelerate the performance of a business; and • 1 8.8% of respondents to the survey saw cost management as a means to gain competitive advantage; Now I am sure that most of you reading this would like all four of those elements in your business, I know I certainly would. With all the potential benefits of an effective cost management programme, why isn’t everybody doing this? The survey showed that only 67% of respondents were actively engaged in cost management. KPMG recently estimated however that 95% of all costs taken out of businesses during the last recession will return in the short to medium term. This amounts to £90bn of costs coming back into the profit and loss accounts of UK businesses, suggesting that the cost management programmes currently being undertaken are failing. So why? The reason for this is simple, the ma jority of so called cost management exercises being undertaken by UK businesses are simple cost reduction programmes, knee jerk reactions, rather than strategic cost management programmes. Indeed the survey with Management Today showed that 70% of respondents did not have a strategic approach to cost management. Companies do not have the TIME, PEOPLE or MONEY to undertake such a project effectively.

News From Around The County Southend United’s play off victory: A day that will live long in the memory Phil Brown’s side had more than 20,000 fans roaring them on at the home of English football but it initially seemed set to be a day of desperate disappointment as a series of fortuitous breaks went Wycombe’s way. An extra time last minute equaliser took the tie to penalties and, with Shrimpers fans sprinting back into the stadium to watch the spot-kicks, it was Blues who eventually came out on top in what seemed to be a never-ending shoot-out. Fifteen different penalties were taken before Wycombe’s Sam Wood had his effort impressively pushed on to the right post by Bentley to spark wild celebrations among both players and fans. The scenes that followed were perhaps the best in the club’s history and will live long in the memory for everyone connected with the Southend United as a season of twists and turns ended in one of their most famous ever triumphs. The manner of the win again proved Southend never do anything the easy way but it also showed the club are back on the up. New heroes have been born, an old one has returned and, after a difficult few years, a feel-good factor has returned around Roots Hall. I have owned a franchise, Practical car & van rental, which I built up to double the budgeted turn-over in the first 2 years winning their marketing award as well as an industry wide achievement award. I was a founder member and first chapter director of BNI Thurrock & Lakeside which I help to grow to 35 members creating referrals amounting to £1.5m in the first 18 months, I also worked as an area director for BNI. I have now moved on to Nexus Networking Group where I am helping build the group and facilitate the member training program.
