Who Really Owns YOUR Credit Card Miles & Points? BY getpeyd.com

A

s we mentioned in one of our previous columns, one of the great perks about using credit cards is the ability to earn miles and points whenever they are used for purchases. This earning potential is so significant that there are actually many forums, blogs, groups and even a ‘university’ dedicated to helping consumers understand the myriad of benefits and rewards programs available to them by the credit card companies and how to maximize on these opportunities. Many consumers have taken advantage of these options and turned their spending habits into significant side income earning ventures. An additional way to earn value is through frequent flyer programs that reward travelers by giving them miles and points based either upon the length of miles traveled or the price of the ticket purchased. But the ability to earn miles and points comes with a significant catch, namely, the fact that the miles and points one accrues from purchases and traveling doesn’t really belong to the individual and in fact really, never belongs to them in the first place. And if this dynamic sounds strange, unfair, and perhaps even illegal to you, well, you are not alone.

In a widely publicized case that occurred in 2013, a rabbi sued Southwest airlines claiming the airline dealt unfairly with him when they forfeited his frequent flyer status and hundreds of thousands of miles he accrued. The case was fought in court at various levels, and finally heard by the Supreme Court which rendered a decision against the rabbi. To provide some background to the case, in 1978 the Airline Deregulation Act was passed which limits the types of lawsuits flyers may file against airlines as well as the laws states may pass relating to airlines’ operations. The rabbi argued that the airline did not act in good faith in the way its frequent flyer programs were structured and thus was subject to state contract laws governing good faith business practices. In its defense, the airline stated the rabbi complained 24 times in a 7-month period, and that before forfeited his account and kicked him out of the program, it awarded him $1,925 in travel credit vouchers, 78,500 bonus miles, a voucher for his son and $491 in cash reimbursements With a unanimous vote, the Supreme Court ruled the Rabbi could not pursue his claims against the airline because the federal Airline

Deregulation Act barred his lawsuit. In its decision the court didn’t address the rabbi’s claim that the restrictions placed on his mileage account violated good faith business practices, but rather ruled that Southwest’s frequent flyer program was included in the price, route or service the airlines provide which the regulation laws were intended to protect and thus his lawsuit could not go forward. Although the Supreme Court ultimately ruled the lawsuit could not go forward, it seems that the prior decision by the 9th U.S. Circuit Court of Appeals allowing the ‘good faith’ portion of the suit to go forward, opens the door to a lawsuit against credit card companies whose practices aren’t related by and have no impact on the airline regulation law. If you think about it, restricting the rights to miles and points’ one earns through purchasing and credit card usage doesn’t seem to be a good faith business practice. If one was to open a bank account which offered an interest rate, the interest money earned doesn’t belong to the bank, it belongs to account holder. And with credit cards that offer cash-back rewards, once the cash is earned, the credit card company cannot restrict the way you use the cash and claim it

belongs to them. The Federal Government has chosen to keep out of the credit card reward industry. The only regulated portion of the rewards industry pertains to the status of the miles and points one earns in relation to filing taxes. In 2002, the IRS announced that it would not pursue the question of whether frequent flyer miles, and rewards and other promotional discounts awarded by credit card companies to cardholders are considered taxable income. More recently, the IRS clarified its position and stated that if individuals received their credit card rewards after a purchase, the rewards are considered rebates on whatever was spent to earn those rewards and do not represent a gain on income or wealth and are thus not taxable. However, if no transaction is required to earn the rewards, then the IRS considers these rewards as income and individuals would be required to disclose them on their tax returns.

The bottom line is as follows; until the Federal Government regulates the rewards industry and until the courts determine whether the restrictions placed on rewards violate good faith business practices, (which in fact may be the conduit where the Federal Government to take a closer look at the rewards industry and regulates

the market), the miles and points you earn can be restricted. The airlines and credit card companies can determine when, how and if you can use them, what their value is, and restrict them indefinitely because, when-all-is-said-and-done, at the end of the day, they never belonged to you in the first place!

I usually recommend starting with taking 250 mg’s 3 times a day, and observe to see if your symptoms improve. You can take up to 1250 mg’s per day. The only side effect to be concerned with magnesium is loose bowels. I use this how much magnesium your body can tolerate. So if you are taking magnesium and develop diarrhea, pull back on the dosage and you’ll be fine. You can take it as a stand alone supplement, or together with calcium and potassium. Also, the best form is magnesium citrate since it is easily absorbed. I found a calcium citrate/magnesium citrate in a ration of 1:1 and is produced by a company called: Solaray. Chazan/Singer Shimon Kugel OB’M

T

hree days after his sudden passing, friends and relatives remember Shimon Kugel, a gifted Singer & chazan who used his musical abilities to bring people closer to yiddishkeit. The levaya for Kugel, who passed away two weeks ago on a Thursday night, took place on Friday afternoon in Borough Park, with kevura taking place thereafter in Israel. Known both for his warmth and his sweet personality, Kugel was close with Shlomo Carlebach and his music, including his original compositions, reflected Carlebach’s distinctive style. “He became an important supplement to the work of Shlomo Carlebach,” Jewish music personality Nachum Segal told VIN News. “Even

in his lifetime, Reb Shlomo couldn’t be everywhere and Shimon Kugel would transmit his musical message to the masses. After Carlebach passed away 20 years ago, he carried on that mantle. His voice, his demeanor and even his looks were very much like Carlebach and he had a strong perspective on what people who were searching were looking for.” “I always looked up to his hartzidige music,” added singer Srully Williger. “Reb Shlomo said quite a few times in his life that Shimon had a beautiful voice.” Born in South Africa, Kugel spent time in England and Israel while traveling all over the world to perform before making his way eventually to the United States,

where he established himself as both a singer and a chazan. Kugel proved early on in his career that while music was his passion, yiddishkeit was his life, turning down a shot at stardom offered by Brian Epstein, manager of The Beatles, who hoped to launch Kugel’s career on a similar trajectory in the 1960’s. “He said, “You are going to be the next big thing in England and in the world,’” recalled Kugel’s son Shlomo at the levaya. Epstein arranged for Kugel to represent England in Eurovision, a prestigious annual European song competition watched by millions of people in Europe. The two collaborated on a single to be performed at the annual event, but

when Kugel realized that the main rehearsal was to be held on Shabbos, he told Epstein that he couldn’t take part in the competition. The moment proved to be a turning point in his life and his own observance of Yiddishkeit. “Right after that he decided to commit his life to only to Jewish music, only to sing Chasidishe music, to be mikarev the oylam in Yiddishkeit and he succeeded in that,” said Shlomo Kugel. The song that Kugel had recorded for Eurovision was instead sung by another artist who went on to win that competition and a very successful music career. “My father became even bigger because he chose the right way,” observed Shimon Kugel. “He chose Yiddishkeit. He chose Torah. He chose to bring up a family with the right values of Torah and Yiddishkeit.” Benyomin Kugel recalled that his father never compromised on the standards he had set for himself. “Even when times were tough, he would never give up his frumkeit, would never sell his soul for money.” Chazan Benny Rogosnitzky remembered Kugel as a welcoming presence during his early days in New York. ´:KHQ , ÀUVW FDPH WR $PHULFD DQG became a chazan on the West Side, KH ZDV WKH ÀUVW FKD]DQ WR EHIULHQG me,” said Rogosnitzky. “He came over and he sat next to me. He had a great soul that was colored with a beautiful sweet warm voice. He really lit up a room when he walked in and he was a singer, not just in music but in life as well.” Rogosnitzky recalled the last time he saw Kugel perform at a concert in honor of Shlomo Carlebach’s 20th yahrtzeit which took place last November at the Young Israel of Bethel. “I was standing in the back and you almost felt like Shlomo came back,” observed Rogosnitzky. “There were people in the audience that he knew and he made a point to mention them, to make them feel good. s we usher in the month of Adar we turn our thoughts to preparations for the joyous holiday of Purim. Ideas for themes, costumes and Mishloach Manos offerings are abuzz.

The festive meal of Purim is central to the celebrations. As the happiest day of the year with numerous mitzvahs to perform, we would do well to prepare the bulk of our meal in advance so that we free up time for performing all the mitzvahs of the day -- reading the Megillah, distributing charity, and giving gifts of food. This menu was created with food selections that mostly freeze well – so just warm them up in time for the festive meal – or are easy to assemble after a hectic day of running around!

Fat free Slishkes (gnocchi) This easy to follow recipe is sure to get rave reviews. They might take some time to perfect but they are well worth the effort! Ingredients: 2 lbs baking potatoes 1 cup whole wheat pastry flour or any flour ½ tsp salt 1 clove garlic Vegetable oil spray ½ cup whole wheat breadcrumbs. Directions: Peel and boil the potatoes in salt water with a clove of garlic, until tender. Drain most of the liquid and mash while hot until smooth then

allow the potatoes to cool down for easy handling. Add the flour and salt to taste. Knead on a lightly floured board until smooth. Shape into 1 inch smooth strands. Cut into ¾ inch sections. Bring a large pot of lightly salted water to a boil. Add the gnocchi and boil until they rise to the top, about 20 minutes. Drain and place in a warm bowl. Spray vegetable oil in a non stick frying pan, stir in bread crumbs and cook until slightly brown, add the slishkelech and mix until thoroughly coated. Some people enjoy savoring them with salt while others prefer them sweet. Enjoy! Preparation 30 minutes Serves 6

Delicate Salmon Steaks Poached in Lemon Wine This fish can be prepared in advance and left to marinate. Cook while your guests are assembling to the dining room, or prepare it early in the morning and just reheat before the meal. It takes minutes. Ingredients: Juice from 2 large lemons 1/2 cup water 1/2 cup cooking wine ½ tsp salt 6 salmon steaks or fillets

Place 1st four ingredients in medium saucepan. Add raw salmon steaks with cover. Marinade salmon in this sauce for 1 hour. Bring fish to a slow boil over medium-low heat. Reduce heat slightly, cover, and simmer 5 minutes. Flip salmon over, cover, and continue to simmer 5 more minutes or until salmon is cooked throughout. Preparation: 10 minutes Serves: 6

Thick and Rich Pea soup This soup is definitely our family’s all time favorite. We serve it at special occasions, or any occasion we want to make special. Ingredients: 1 cup yellow split peas, 1 cup green split peas, ½ cup navy beans, ½ cup barley (optional), 4 cloves garlic diced 2 large carrots grated 2 bay leaves, Salt to taste.

Directions: Soak all legumes overnight. In the morning drain the water from the container, place in an 8 quart pot and cover with water. Cook until legumes are tender about 1 ½ hours. Add spices. Meanwhile In a different pot sauté garlic in 2 tablespoons of oil until translucent. Add grated carrots to sautéed garlic and cook for 10 minutes. Add sautéed vegetables to the soup, and continue simmering for another 20 minutes. If soup is too thick add water to obtain desired texture. Preparation: 30 minutes Serves 12.

Traditional sweet and sour stuffed cabbage In most homes it is customary to serve stuffed cabbage on Purim. Hungarian or people from Polish descent serve stuffed cabbage on Purim but they prepare it differently. The Hungarians call it kaposta and serve it salty /sour while the Polish call it holobshes and make it sweet. Whichever version you prefer, adjust it to your liking and enjoy! We eat cabbage that has meat “hidden” to symbolize the hidden miracles that Hashem performed for us on Purim. Preparing nice little cabbage rolls is an acquired art. It takes a few hours to prepare and cook the cabbage; allow plenty of time when undertaking this task. Read instructions carefully before starting, get acquainted with all the steps for perfect cabbage all the time! Ingredients: 1 large head cabbage 1/2 cup rice Salt and pepper to taste 1 med. onion, chopped fine 2 cloves garlic crushed 2 Tbs oil 2 lb lean ground meat 2 eggs 1 or 2 Tbs. ketchup (optional) 1 jar sauerkraut Sugar to taste 1 large 46 oz. can tomato juice ½ cup brown sugar if you like it sweet. Directions:

Core cabbage and scald in boiling water. Remove leaves one at a time as they wilt. Cool before using. Make sure to remove leaves slowly so as to keep them whole. Plunge cabbage head back into the boiling pot to facilitate the separation of leaves. Put cabbage in microwave for a few minutes and take off as many leaves as you can, repeat the process until all leaves separate. I did not find this method too effective. The method that works best is to freeze the cabbage for a full week. Defrost it the night before you plan to put this dish together so it will be wilted and easiest to handle. Separate leaves gingerly making sure that leaves stay whole. Cut away the hard rib of each leaf for easier handling! Wash and check each leaf for bugs. Your leaves are ready to be filled. In a heavy 8 quart pot, put tomato juice and the same amount of water; add sauerkraut. Bring to a boil. In a different bowl put in meat, washed rice, minced onion, crushed garlic, eggs, ketchup, oil, salt and pepper, mix well until well combined. Take each leaf into your hand. Fill cool cabbage leaves with mixture. Roll leaf over meat tucking the sides into the rolled up side and place each roll gingerly into the pot with the boiling liquid. Do not overfill. Cook for 2 to 4 hours on medium flame. Alternatively, this can also be placed in a deep baking dish (9 x 13x 5 inches deep). Cook covered for two hours at 325 degrees. Baste occasionally with juices. Serve with mashed potatoes and a tossed salad or with shlishkes a Hungarian delicacy borrowed from the Italian gnocchi!
