First Floor Living If you don’t like climbing stairs you will appreciate another big trend in new home design, which is one level living or floor plans that have a master bedroom on the first floor. While you may think this would mostly appeal to seniors, in fact it appears to be part of the larger trend of homes with design that fits different stages of life. Charlie Armstrong, Vice President of Land Development at Southern Development Homes, explained that “more and more people are buying homes and planning to stay for awhile. We are seeing younger buyers as well as seniors looking for one level living. There is an increased awareness among buyers that they are buying a home, not just a house.”
The Community is Important Too Parade visitors also ask questions about the amenities offered by the various communities. “A lot of people ask about the Home Owner Association fees and the services they provide,” said Justin Kent of Better Homes and Gardens Real Estate III and Craig Builders. He added that
this question is especially important to people looking at a maintenance free setting. This year two communities, Old Trail and Belvedere, are featured as entrants on the Parade. Both are walkable communities with a town center and homes with a variety of styles and price points. Old Trail is featuring a new neighborhood currently under construction that has more green space and interlinks with the larger community’s parks and walking trails. Requires Written Agreements With Real Estate Licensees By Pat Widhalm and Bud Kreh
A
s a result of new legislation, Virginia real estate consumers now have the opportunity to become more knowledgeable about the services they can receive from Virginia real estate licensees. For many years, Virginia licensees have been required to make what is known in the industry as “prompt disclosure” of any brokerage relationship they have with a seller or landlord when speaking about a particular property to a prospective buyer or tenant. The same is true if licensees are working for a buyer or tenant and are about to have negotiating discussions with sellers or landlords. The law defines the types of discussions that require prior disclosure as “substantive,” since they are usually engaged in to further a party’s interest in or understanding of a piece of real estate or the conditions under which it can be bought or sold. To ensure that consumers and licensees are on the same page as to what can be expected of each other, the law requires that all agreements for brokerage services be in writing, spelling out mutual expectations, terms of payment to the licensee’s firm, and an end date to the relationship. While the new law does not substantially change the way many licensees have conducted their brokerage businesses, it does require increased disclosure of services to be provided to the consumer by licensees and real estate firms. For the consumer, then, it’s really all about knowing what professional services are being purchased; and the new legislation can be understood as primarily a disclosure statute. For purposes of this article, brokerage relationships are defined as contracts in which the real estate licensee agrees to work on behalf of someone wishing to sell, buy, lease, or rent real property, in return for which the licensee will receive a fee for agreed-upon services. Brokerage relationships can also be thought of as agency or representation agreements wherein licensees commit to
working on behalf of the consumer, keeping that person’s best interests in mind. When a licensee commits to promote and protect the best interests of one or the other party in a real estate transaction, the licensee and the licensee’s firm becomes that person’s authorized real estate “agent.” The new legislation goes even further to protect both consumers and licensees by requiring timely disclosures to consumers who might enter into negotiating discussions without any representation. In fact the statute requires licensees who are contracted to work for one potential party to a transaction to make that disclosure prior to providing assistance to find or show a property to any consumer with whom they do not have a brokerage agreement. These unrepresented consumers then have the choice of continuing on with the potential transaction or seeking out other licensees to protect their own best interests. So the public should now expect a meaningful conversation regarding agency as well as the buying and selling process when they contact a real estate firm, especially when it comes to inquiring about or purchasing property. When inquiring about
properties for sale, the usual process is to call either the listing agent or their company to get information about a property being advertised for sale or rent. In this case the listing agent and the company represent the seller or landlord as a result of their written listing agreement. Since this contract means that the licensee owes his or her primary responsibilities to the seller or landlord, the listing agent is required to disclose this representation and discuss agency options when approached by members of the public under these circumstances. Whereas the law allows a licensee representing a seller to assist an unrepresented buyer in a real estate transaction, a seller’s agent is very limited in the services he or she can provide to a customer, with whom there is no written brokerage agreement. The licensee’s disclosure obligations to potential sellers and landlords are just as important when the licensee is representing a buyer or tenant. When the licensee and the firm have entered into a written agreement to represent a buyer or tenant as that party’s agent, the licensee’s duties then become pri-
marily owed to the buyer or tenant. That fact must be disclosed prior to any negotiating discussions with the “other side,” so to speak. Potential real estate consumers are generally not aware of the agency laws that real estate licensees are required to follow. The consumer’s interest is in buying or selling. It is the agent’s responsibility to explain the real estate process and to make disclosures required by law or by the REALTOR® Code of Ethics. When the public be-
gins to ask for an agent’s advice or counsel, the new law will allow the agent to provide this service only with a written brokerage agreement.
