The SPCA’s 2012 Critter Ball raised more than $210,000 largely due to its Celebrity Dance Competition. This annual SPCA Ball consists of a dinner, silent and live auction and the Celebrity Dance Competition modeled after ABC’s Dancing with the Stars. he Charlottesville Area Association of REALTORS® supports the proposed amendment to Virginia’s constitution in order to protect citizens’ property rights. This amendment will constitutionally ensure a citizen’s land cannot be taken and given to another private owner, and that all eminent domain takings are for a true public use.

Property rights form the backbone of not only our community but our nation as a whole. Government takings of property must be limited to true public uses such as roadways, schools or municipal water systems. As stated in our Code of Public Policy, “CAAR is dedicated to protecting the right of individuals to own real property.” Question 1 on the November 6th Ballot will read: “Shall Section 11 of

Article I (Bill of Rights) of the Constitution of Virginia be amended (i) to require that eminent domain only be exercised where the property taken or damaged is for public use and, except for utilities or the elimination of a public nuisance, not where the primary use is for private gain, private benefit, private increasing jobs, increasing tax revenue, or economic development; (ii) to define what is included in just compensation for such

taking or damaging of property; and (iii) to prohibit the taking or damaging of more private property than is necessary for the public use?” Voters will be asked to choose “Yes” or “No.” CAAR does not take changing the Virginia Constitution lightly but neither does the Virginia state code. To qualify for the ballot, any proposed amendment must pass both houses of the General Assembly with an election separating the two votes. If a majority of Virginia voters approve the proposed amendment, then the state constitution will be changed to incorporate the new language. Legislation has already passed defining “lost profits” and “lost access” per the language in the amendment. If voters approve the amendment, “Lost profits” and “lost access” will be added as elements in determining just compensation for eminent domain takings beginning Jan. 1, 2013. We encourage you to VOTE YES ON QUESTION ONE to help protect Virginians from eminent domain abuse.

Of course we also have a ready supply of people moving to the area, but, said McVay, “Often they want to take their time and get to know the area before they buy.” The good news, then, is that there are plenty of prospective tenants for landlords to choose from. Hock Hockensmith, also with Roy Wheeler Realty, is a commercial property specialist. “It’s always a good idea to invest in real estate,” he said, “but now is an especially good time. Prices are low, which means there are a lot of good buys out there.” For example, shopping centers are slowly coming back, Hockensmith said. The weakest tenants have long since moved out, either going out of business or downsizing to situations which require less cash to survive. So while it is a good time to buy, Hockensmith advises that the decline in demand for space means rents are

The university’s staff, students and faculty are a continuing source of demand for housing, and the natural beauty of the area attracts many who want an amenity rich and scenic place to retire and who need a place to rent, if only until they find a permanent home. This regular influx of population also supports apartments, strip centers and other commercial activity, making these properties attractive to investors as well. In recent years, however, investing in real estate has been challenging as financing dried up with the de-

pressed market. Similarly, the slow market made it harder for those who wanted to buy, renovate and resell. Today, there are signs of change. Some banks are starting to lend again, and investors are taking advantage of foreclosures and trustee sales to find property which they can either rent, or renovate and flip.

Real Estate Still a Good Investment There are many reasons why investors continue to buy real estate. A big one is that while the market shows signs of recovery, prices remain relatively low as do interest rates. “Consequently,” said Anthony McGhee with Assist2Sell – First Rate Realty, Inc., “investors who are buying to hold and lease can enjoy a positive cash flow.”

McGhee cautioned, however, that “the time to take advantage of these market conditions is now,” as he believes that prices may have finally bottomed out. “There are not as many foreclosures and the inventory of homes is shrinking,” he said. What is the demand for rental properties? Are there prospective tenants in the marketplace? The answer is yes. “Rents are stable and the number of prospective tenants is increasing,” said Jim McVay, REALTOR® with Roy Wheeler Realty. There are many reasons for this increase in demand, he continued. “There are people in the marketplace with credit issues, some who have lost their homes to foreclosure, and others who can’t manage the down payment required for purchase.”

to keep your price low to be competitive. “However, the good news is that property is starting to move. We are seeing little increases in prices but the biggest improvement is that properties are selling more quickly.” One more reason to buy now.

Financing Your Purchase Investors with a lot of cash will have the easiest time in this market because they don’t have to contend with banks and financing. However, there is money available for qualifying investors who need a mortgage in order to purchase. Amato explained that in her experience banks are starting to feel more comfortable about making loans again as they recognize that the market is less risky than it once was....and of course interest rates are very low. Hockensmith agrees that the loan process may be easing a bit stating that today there are loans available whereas a few years ago there was virtually no money at all for investors. If you plan to buy a property to rent (whether it is a single family home or a strip center), expect to put down at least 25 percent, and (depending on other variables) possibly even more. Entrepreneurs who purchase property to house their business have an advantage in that they

may be able to obtain a small business loan to finance part of their purchase, thereby reducing the amount of cash they need to have. Patience is definitely a virtue if you want to be a real estate investor. While financing is available, it takes a lot longer to work through all of the paperwork and requirements than it once did. “Where once it might have taken just a month to get loan approval, today it may require two to three months to accomplish the same thing,” Amato said. Banks may be easing some, but they are still leery of getting stuck with a property they have to sell at auction. McGhee agrees that it is harder to get a mortgage loan today today than in the recent past. The relaxed standards of a few years ago are gone and you need to be prepared to demonstrate good credit and a stable job, he explained. Also, he said, expect to provide tax returns and if your bank account has a recent addition of a lump sum of money, be ready to document where it came from. The lender will be looking for evidence that you have the ability to carry the mortgage, taking into consideration a reasonable vacancy factor. While this process is a bit arduous, McGhee added “it’s where it should be.”

Savvy Investors Make Money by Renovating and Reselling In the old days when the market was brisk, it was possible to find a deal and make quick money by putting the home back on the market after some renovations and upgrades. However, the slow market increased the risk that a home would stay on the market for an extended time. This, plus the scarcity of mortgage money, made it much more challenging to buy, renovate, resell and still make a profit. Today, however, some investors are once again making good money buying and flipping properties. Many of the homes they purchase are foreclosures and trustee sales, McGhee said. “Often these properties are not in great shape and since the average buyer doesn’t want to rehab a property before they move in, these homes present an opportunity for the right kind of investor.” While this is not a formula for everyone, the sophisticated investor can do very well with this strategy, McGhee said, who added that to be successful investors need to be “diligent and stay on top of the market.” Many make their purchases with cash so that when they find the right situation they are ready and able to act quickly.

Who are the Investors? Most of the people who buy investment real estate have a lot of cash. They are people who want to diversify their portfolios and who see the benefits of real estate compared to other types of investments. “We see a lot of professionals such as attorneys or doctors,” McGhee said. “We’re seeing a different kind of investor today than in the past,” Amato said in reference to commercial real estate.. She explained that it used to be that investors were people with lots of disposable income who felt comfortable with real estate as an investment. Today these same people may not view it as quite as safe a place to put their money. Instead the investors are more likely to be people with a good long track record in investment real estate. First time investors may have an easier time getting started if they choose residential property. A good option is to make offers on foreclosures, McVay advised. Negotiating a good price assures a good positive cash flow, and if the investor holds it long enough, this initial discount increases their chances for some nice appreciation. Meanwhile the tenants pay down the mortgage allowing the owner to build equity that way as well.

McVay added that when looking for possible investment opportunities it helps to work with a REALTOR® who is familiar with the market. The REALTOR® can search for homes that have been withdrawn from the market in the last several months and contact the seller’s agent to see if the owners rented the property rather than let it sit empty. If so they may be a good prospect for selling to an investor who has the advantage of buying a home that already has a tenant.

Property Management Property management requires experience and expertise, which many investors neither possess, nor have time for. Bill Howard, a REALTOR® with Real Estate III Commercial Properties, does some property management as part of his job. He explained that many investors with money, such as doctors, lawyers, CEOs and CFOs, do better focusing on what they do best and letting a professional manage their property for them. Many of the management companies have their own crews on payroll who can do repairs and upkeep for a lot less than an individual would have to pay if they hired contractors. And there is a lot of upkeep, especially on larger

properties, everything from solving ongoing maintenance issues, such as wood rot and faulty plumbing, to maintenance such as landscaping, or snow removal. Managers may also play a role in such activities as policing the parking lots. Another management job is keeping properties leased. This can involve screening prospective tenants, checking their credit, assuring compliance with regulations regarding deposits, and enforcing the provisions of the lease. Howard explained that many property owners rely on a REALTOR® to do this part of the job, as well as to assume responsibility for ongoing maintenance. Of course there are exceptions. Investors who are mechanically inclined and who have sufficient time may enjoy maintaining a small number of properties on their own. Similarly, an investor with a lot of experience, who is possibly also a REALTOR®, may choose to manage their own properties.

If you’re worried that the demand for bamboo flooring is taking food out of the mouths of pandas, never fear! Of the more than a thousand varieties of bamboo, only a few are used for flooring, and happily, they’re not the ones that pandas eat. Bamboo has the look, feel and durability of wood. It is a rapidly renewable resource that can be harvested in four to six years (compared with decades for most trees used for wood floors). Bamboo is available with three distinct patterns: horizontal (or flat) grain, vertical grain, and strand (or woven). It’s available in two shades: natural (blond) and a caramel achieved by steaming the bamboo before drying it. Strand bamboo is harder than horizontal or vertical grain. The caramel-colored material

If you’re thinking of replacing your flooring and you want to “go green,” here are a few tips on what to look for in eco-friendly flooring.

Linoleum I don’t know if you’re like me, but the moment I hear the word “linoleum” I think of my grandmother’s kitchen! When it comes to ecofriendly flooring, linoleum may not come to mind because most people think of vinyl flooring when they hear the word “linoleum.” Environmentally speaking, the two couldn’t be further apart. Vinyl flooring is a petrochemicalbased product while linoleum is made from renewable, biodegradable materials including linseed oil and cork and produces no harmful vapors. Linoleum comes in dozens of patterns and colors. It is cushioned, so it’s comfortable to walk on, and it stands up well to traffic. It is durable, easy to keep clean, and biodegradable. It also has antibacterial properties, which makes it popular for healthcare facilities.

Cork Cork is a sustainable flooring product. Originally made from scrap

left over from wine-cork manufacturing, today many floors are now made with cork harvested specifically for flooring. It comes from the outer bark of the cork oak, a tree indigenous to Spain and Portugal. Workers strip off the outer bark, which grows back and can be harvested again in about ten years. Harvesting practices are carefully regulated to ensure future supplies, reducing environmental impact. Cork is made in 12x12-inch tiles and 1x3-foot planks, each with a distinctive grain pattern. It comes in shades of brown, as well as other colors and patterns. The surface is slightly textured and slip-resistant. Cork is resilient and slightly soft underfoot, which makes the flooring comfortable to stand on and easy on dropped dishes. But it can be dented, especially if you have heavy furniture or walk over it in stiletto heels. It is fire- and stain-resistant and has the ability to absorb sound, but it can fade if exposed to direct sunlight. While it doesn’t soak up moisture, that doesn’t mean it’s not impervious to water so it may not be the best option for your bathroom.

is nontoxic and easy to clean if the grout is sealed. If a tile ever cracks, it can be chiseled out and replaced. Just be sure to buy extra tiles initially to make replacement easy. Concrete floors are no longer associated exclusively for industrial buildings. Today they’re in the most stylish of homes. The concrete can be colored, stained or patterned for a one-of-a-kind look. The finished floors are durable, easy to clean, and compatible with radiant floor heating systems and passive solar design. However, concrete is prone to cracking so if you can’t live with cracks, then concrete isn’t for you. Stone floors are natural, but they pose an environmental problem. Digging stone out of the earth can damage wildlife habitat and mar landscapes. While the stone for floors is minimally processed, it’s a heavy and bulky material that takes a lot of energy to transport. On the flip side, however, they can last for generations. Traditionally a mix of marble or other stone in a matrix of concrete, terrazzo is making a comeback because of increased interest in recycled materials. A few companies have started making floors with a high percentage of recycled glass set in concrete or epoxy.

Concrete, Stone, Terrazzo, and Tile Ceramic and porcelain tile are made primarily from clay, an abundant although nonrenewable natural resource. The manufacturing process may be energy intensive, but the tile

buyers look under the carpet to see if there are wood floors below? If you have an older home, chances are there are wooden floors just waiting to be sanded and refinished. If not, consider using wood salvaged from old buildings or old factories and barns. Or consider virgin wood, which can be either solid or “engineered,” with a hardwood veneer glued down over plywood or fiberboard.
