The Charlottesville Area Association of REALTORS® (CAAR) supports the National Association of REALTORS® (NAR) defense of the Department of Labor’s Association Health Plan (AHP) rule. NAR recently submitted an amicus brief in the ongoing federal litigation of the AHP rule. Amicus briefs are legal documents filed in appellate court cases by nonlitigants that have a strong interest in the subject matter in question. Earlier this year, a federal court ruled that provisions of the DOL’s rule were unlawful, a ruling that adversely impacts REALTORS® seeking more cost effective and comprehensive health insurance solutions through AHP options. “Passage of the Patient Protection and Affordable Care Act resulted in significant regulatory changes to the individual insurance market, some of which have benefited REALTORS®,” the brief reads. “However, ACA changes have also resulted in significant increases in health care costs, leaving many individuals to forgo coverage, which jeopardizes the health, safety and financial stability of their families and others.” CAAR, along with a number of other state and local associations, is vocalizing its strong support of efforts to protect AHPs, which have been the subject of litigation since shortly after the rule was finalized in June of 2018. Five state and local associations are currently offering AHPs to members, including the Baldwin County Association of REALTORS® in Alabama, the Greater Las Vegas Association of REALTORS®, the Kansas City Regional Association of REALTORS®, the Nevada REALTORS®, and the Tennessee REALTORS®. To date, over 3,000 REALTORS® and their families have found cost-effective health insurance solutions through these five association health plans. Many more REALTOR® associations are also exploring AHP options but have been delayed due to this lit-
igation uncertainty. “The wellbeing of our members—the hardworking men and women who go to work every day to put food on their family’s table and put roofs over other families’ heads— remains our focus throughout these negotiations,” said CAAR 2019 President Tele Jenifer. “Supporting the Department of Labor’s rulemaking will continue to help safeguard self-employed individuals’ ability to join association health plans, protecting affordable, quality health care options for our members and their loved ones,” Jenifer continued. “Ensuring the freedom to choose from a variety of insurance providers offering quality coverage plans with enough premium support is key to cultivating a deep participant pool and strong marketplace, and CAAR will continue to support the DOL’s efforts to expand these options in Virginia and across the nation.” NAR’s defense of the AHP rule highlights DOL’s lawful authority to expand access to AHPs by interpreting the working owner provisions to promote flexibility while not conflicting with existing statutes. NAR also describes the comprehensiveness of AHP coverage and the multiple successful plans already in place delivering significant savings and benefits to many working owners. If the court’s final ruling is adverse and pending any appeals, independent contractors may lose the ability to access insurance coverage through an AHP, sacrificing valuable savings on premiums and broader network access with more comprehensive benefits. Overall, AHP plans have proven to have lower cost options and better overall coverage, leading countless sole proprietors and small employers alike to purchase association health plans over the past year. “While NAR continues to explore and tackle barriers to a national AHP insurance option, we are learning from the many successes being implemented by state and local REALTOR® associations,” NAR President John Smaby, a second-generation REALTOR® from Edina, Minnesota, said. “These initial programs are helping us ensure our members and their families can secure these effective, affordable health insurance options moving forward. We must

Landis advises parents to do this so their kids don’t have to. “It is a gift to your children not to have to disposition a house full of goods, complete with garage, basement, attic, books, china, silver, CDs and personal effects. They will have enough to deal with; don’t burden them with this, too.” MaryAnn Long and Helen Plaisance, organizers of Cville Village, agree. “For seniors who’ve lived in one place for a long time, even without the sentimental attachments, the sheer volume of stuff can be daunting. But once it’s gone, you can make room for living safely and happily, with whatever supports are needed to age in place.” It’s a great strategy to begin disposing of unwanted things sooner rather than later. Without the pressures of a pending house sale or death of a loved one, the process is less stressful. Michael Guthrie, CEO and Principal Broker of Roy Wheeler Realty Company, knows this personally. He and his wife are not planning a move now but decided to “just take care of their basement.” Looking at the amount of stuff stored there was “paralyzing.” When they realized this was going to be a bigger job than first imagined, they called AskLandis.

Minimalists and Millennials

Trash—check. Consignment—check. Now that he’s been through at least part of the purging process, Guthrie is a fan. He says that you can never start too soon. “It’s overwhelming to have such an arduous task hanging over your head. It stalls every other decision you might want to make—about staying, moving, remodeling, downsizing.”
And based on his experience in the real estate profession, Guthrie has some additional advice on right sizing. “If you are moving to a new area, try a step-down strategy. Rent for a year to see if you can tolerate the smaller size, both in square footage and number of rooms. How important is a basement? A garage? A guest suite?” He has seen his share of “buyer’s remorse” and bounce back transactions, where someone relocates to a whole new environment and then realizes how much they miss the old one. So they move back. Renting for a year
But right sizing isn’t just about seniors downsizing. Many buyers today are looking for something more—or actually, less—than the typical McMansion and the manicured lawn that goes with it. There is a whole culture out there that isn’t interested in spending time and money collecting, storing and caring for stuff. Whether it’s for environmental, financial, ethical or just practical reasons, that culture is making popular tiny homes and modest-sized homes that may seem short on storage space but rich in features. Their perspective is: if I live close to a park, do I need a lawn and swing set for the kids? Because I don’t have lawn care equipment, I don’t need that storage space. Since I use the library and music and movie streaming services, there’s no need for space to store or display books, CDs, DVDs and the gadgets that go with them. Besides, is there really anyone left that wants to spend their weekends or downtime taking care of a lawn? Gardening, yes; but an endless expanse of grass or high maintenance landscaping just doesn’t make sense to too many people anymore. This may be especial-

Move, Renovate or Both For the minimalist, Millennial, senior or anyone else looking to right size their living space, the most basic choices may be to move, to stay and renovate, or move and renovate. If the market isn’t offering a home that has the features you want, in the location you want, renovating your existing home or buying and renovating might be the best strategy. Dawn Cromer, REALTOR® with Nest Realty, helps her clients explore all the options to find the one that will work best for them for the long term. Sometimes a good match just isn’t available. One of her clients relocating to Charlottesville spent a year looking for the right combination of small size, features and location. t’s too big to ignore if you’re considering a move to Central Virginia. The Blue Ridge casts a long shadow and looms large no matter where in our area you decide to live. And the mountains serve as a magnet to both people and businesses that are relocating. According to Josh Palumbo, Forest Management Coordinator with the Nature Foundation at Wintergreen, the Blue Ridge Mountains attract not only people to their slopes and foothills, but businesses as well. In the past ten years, with the ability to set up shop almost anywhere, the mountains draw businesses and with them come the employees that work there. “It really is the Blue Ridge that brings people to the area. Yes, for the views and the air and environmental quality, but also for the close proximity to get out into the woods.” And Palumbo says the Blue Ridge is likely to continue to be that draw for years to come because much of the land in our region falls under some sort of protected status.
Lots of Options The Blue Ridge Mountains and surrounding public and private lands provide an incredible array of hiking options for anyone looking for a short walk in the woods or the trek of a lifetime. Trails range from the urban Rivanna Trail that encircles the City of Charlottesville to the Appalachian Trail (AT) that traverses the Blue Ridge
from one end of Virginia to the other, and beyond. Shenandoah National Park, straddling the Blue Ridge with its more than 500 miles of hiking trails, may be the initial impetus that brings people to this area. But newcomers are quick to learn that they don’t have to drive to the National Park to get their trail fix. Other big attractions include Humpback Rocks, Crabtree Falls (the highest cascading falls east of the Mississippi), Spy Rock with 360-degree views and the accessible Saunders-Monticello Trail. On nice weekends, you’ll see throngs of people enjoying these trails with noteworthy views, climbs, waterfalls or accessibility. If you’ve hiked those and want a change of pace or just want to stay off the beaten path, the region has a wealth of state and county parks and local trail systems that make it easy to live where you hike. Track down and enjoy a few of these less traveled trail systems. The Trails at Pleasant Grove in Fluvanna County offer twenty-two miles of hikes, including the ADA accessible Julie King Sandy Beach Trail that leads to the scenic Rivanna River. Less than a mile from Palmyra, this trail system has something for everyone. Montpelier’s Trail System in Orange County might be one of the region’s best kept secrets. Even people who visit James Madison’s historic home may be unaware that eight miles of well-kept trails traverse the grounds. These walk-
ing trails don’t include huge changes in elevation, but rather a variety of meadows and pastures, vistas of the Blue Ridge and Montpelier, and Civil War history. Hike through the Old-Growth Landmark Forest under canopies of 150-year-old white oak and tulip trees. Ivy Creek Natural Area, in Albemarle County, is located six miles north of Charlottesville and offers seven miles of hiking in diverse habitats that include two miles of shoreline along the South Fork Rivanna Reservoir, as well as upland woods, pine stands and open fields. When you’re in the mood for more than a walk in a natural habitat, plenty of educational programs attract young and old alike. Maureen Kelley, Director of Nelson County Economic Development and Tourism, tells people “Live where you hike.” And it’s especially easy to do that in Nelson County.
In addition to some big-name hikes, Nelson County boasts three designated “Kids in Parks TRACK Trails.” These help families get outdoors and unplugged and enjoy a temporary reprieve from today’s hectic lifestyles. Another option is Fortune’s Cove Preserve, which offers rare views of plants suited for life in rocky glades. It’s hard to pick a Nelson County favorite trail, but don’t miss the swinging wooden bridge on the hike to the Appalachian Trail from State Route 56 to Harper’s Creek. Also in Nelson County, the Wintergreen Trail System has thirty-five miles of valley and mountain trails to satisfy those out for a leisurely stroll as well as experienced hikers looking for a challenge. There is even a section of the Old Appalachian Trail and access to the current AT. Hikers can access maps and videos of each trail in this extensive network at twnf.org. Last, but not least, is The Priest, reportedly the highest elevation gain of any hike in Virginia at 3,100 feet. Start at the trailhead at the Tye River in The Priest Wilderness area and end up at the 4,063 foot summit. But don’t be intimidated. Switchbacks make for a constant gradual climb and, except for one rocky section, the trail is mercifully smooth and kind to aging knees on the descent!
