Coalition Filings Could Halt Fracked Gas Pipeline Construction Advocates for Clean Air and Water Seek Stay on Atlantic Coast Pipeline Pending Court Decision Today, a coalition of environmental advocates filed two requests to stop construction of the controversial fracked gas Atlantic Coast Pipeline (ACP) in the US Court of Appeals for the 4th Circuit. The first is a motion to stay construction pending the court’s decision on the merits in an existing case for which the Federal Energy Regulatory Commission (FERC) has challenged the court’s jurisdiction. The second is a petition for relief under the All Writs Act, asking the court to halt construction pursuant to the FERC Certificate pending FERC’s resolution of the coalition’s request for rehearing, which FERC contends is still pending despite the fact that the agency is allowing construction of the ACP to proceed pursuant to the challenged Certificate. The second is filed in the alternative to the first and asks that the court act on it only if it agrees with FERC that the court does not have jurisdiction over the petition for review. These filings challenge FERC’s failure to demonstrate that the pipeline is actually needed by the public. The groups contend that the overwhelming evidence shows the true purpose of the ACP is to provide profits for the shareholders of the pipeline’s financial backers, Duke and Dominion, at the expense of those utilities’ ratepayers. The effect of the filings would be a halt to the construction of the ACP until the court considers the coalition’s existing challenges to the FERC certificate that authorizes construction. FERC and ACP have ten days to respond. Attorneys with Appalachian Mountain Advocates filed the litigation on behalf of the Sierra Club, Appalachian Voices, the Chesapeake Climate Action Network, and Wild Virginia. Region Ten and Local Partners Join National Movement Towards Trauma-Informed Approach In a recent 60 Minutes segment, Oprah Winfrey highlighted a national movement to address childhood trauma through trauma informed care. Whether trauma stems from neglect
or abuse, from stressors of poverty and unsafe neighborhoods, or from a community event like a school shooting, the impact can create long-term health and mental health consequences. Trauma-informed care, which Oprah Winfrey calls game-changing, has become a new standard of practice to address trauma, and Region Ten and other local organizations are committed to promoting this as a community-wide approach. While trauma-informed care is not new to Region Ten, the organization is offering a new training, called ACE Interface, for community members wanting to learn more about the impact of childhood trauma or Adverse Childhood Experiences (ACE). In one of the largest research projects on childhood trauma, the Center for Disease Control and Kaiser Permanente’s ACE study found that nearly two-thirds of adults have experienced at least one or more ACE, such as abuse, neglect or living in a household with domestic violence or mental illness. These traumas flood children’s brains and bodies with toxic stress hormones and create long term health and mental health challenges. Trauma-informed care focuses on building resiliency through a foundation of safety and connectedness for those impacted by traumatic events. Region Ten’s new ACE Interface training explains the ACE study, how childhood trauma impacts brain development, and offers strategies for organizations and caregivers to promote individual and community resilience. The free training can be adapted in length and format to meet an organization’s needs. Community members can schedule a training by contacting Emily Warren at Emily.warren@regionten.org. The ACE Interface training is just one of many local initiatives to promote trauma-informed care. The Trauma-Informed Community Network is a group of local organizations and partners with a mission to improve trauma-informed care by educating professionals and the community on the impacts of trauma and by advocating for trauma-informed systems of care. He explained that most of the interest is in the under $1 million price point, with increasing numbers of sales closer to Charlottesville. While the over $1 million market is less active, he is seeing “signs of improvement.” Ann Hay Hardy with Frank Hardy Sotheby’s International Realty said she is very encouraged about the farms and estates market where she is seeing some “really good activity.” Of special note, she said, is increased sales of higher end properties—those with over 100 acres and more than a $3 million price tag. The farms and estates market is “waking up,” said Jane Fogelman with Roy Wheeler Realty Co. She is happy about an increase in activity in large acreage properties—ones with 500 or more acres.
“Proximity to town is huge,” Matheson said. There are some “great pieces of land” that are more than 20 minutes from town and buyers often lament they would purchase one of them if only they were ten minutes closer. John Ince with Nest Realty Group agrees describing properties within 20 minutes of town as “golden.” He adds that “buyers looking for country properties tend to be more focused on being close to town than in years past.” However, “improvement in the real estate market over the past three years has impacted Charlottesville and Albemarle dramatically resulting in a very low inventory of available homes [and has] put more pressure on neighboring counties like Orange and Greene, especially those areas within 30 minutes of

Matheson noted that many of his buyers are still working and often they purchase a farm or estate as a secondary residence. They may be individuals who travel a lot and look forward to enjoying the opportunity to relax in a beautiful and very private setting when they are able to make time to be here. When you buy a large property, you need to be willing and able to look after the upkeep, Fogelman said. For this reason, she believes that a preference for rural living is in part “generational,” as, in her experience, younger buyers are less interested in these kinds of responsibilities. Our recent year end market report suggests that resale properties in the over $500 thousand price range, may be a good place for estate buyers to start their search. While nearly 100 more homes in this price range sold in 2017 compared to 2016, “almost 50 percent of them were new construction,” said Michael Guthrie, CEO of Roy Wheeler Realty, Inc. Buyers in this price range who desire a contemporary home may prefer to custom build on their own land and to their exact specs while taking advantage of the most current green building practices and functional, up-to-date floor plans. All of this means existing estate properties can offer a good deal for buyers who want a more contemporary home but don’t want to take the time and trouble to build a new one. On the other hand, for other buyers, living in an historic estate is a big part of why they are in the market, Wiley said. He explained that these people like the features of older homes such as established trees, traditional wood work, or heart of pine floors. And sometimes what is attractive is living in a home where an historic event happened.
The Gift of Conservation Easements Large farms and estates lend themselves to conservation easements, legally binding agreements that continue at the sale or inheritance of the property. Their purpose is to conserve the land and protect resources such as migration routes or sources of water. “Virginia’s Piedmont often attracts aspiring land owners who have conservation and land stewardship in mind,” Ince said. “Conservation Easements (that restrict, by right, development) are a well used tool to preserve undeveloped land while providing incentives to land owners at tax time.” He added that the easements are a wonderful gift property owners can give to the public. Fogelman, who is native to Albemarle County, believes conservation easements are “incredibly important, [because they] preserve the physical look, the ambiance and the quality of life in Albemarle County.” There are certain individuals who have gone out of their way to preserve huge tracts of land in Albemarle, Fogelman said, adding that they are “a wonderful reward for all concerned.” Because these easements support the rural way of life she loves, she “pushes them to everyone.”

Low-growing plants make nice ground cover, particularly varieties of thyme whose fragrant leaves can be used fresh or dried. The flowers are small, but the greenery is appealing. Verbena comes in a number of shades and is also an excellent groundcover. Pachysandra, which stays green all year, is another perennial favorite. While the blossoms are inconspicuous, once established, pachysandra is very hardy. You can easily start more plants by placing cuttings in water until they root, then planting in your yard. This is an excellent way to gradually reduce the size of your lawn.

any people are coming to realize that expansive lawns and exotic gardens are expensive in terms of taking up big chunks of their free time. Then they must add the cost of higher water usage, pricey and environmentally unfriendly chemical fertilizers, pesticides and herbicides as well as care and fuel for lawn mowers, weed whackers, and leaf blowers. Short of adopting a herd of goats, the answer lies in “beneficial landscaping,” or, planning a yard that is not only low maintenance but also kind to our environment.
Minimize Lawn Area A very effective first step is to downsize your lawn. If you are landscaping from scratch, curtail the lawn area by developing vegetable, herb, and flower gardens to provide fresh blossoms for your table and the freshest food pos-
sible for your kitchen. If you already have a large yard, consider converting a section of existing lawn each year to groundcover or natural areas to save time and money down the road. Attractive alternatives include the use of groundcovers, wooded glens, or rock gardens. If you already have a lawn, leave parts of it un-mown to grow naturally into a meadow where wildflowers will eventually appear. In fact, studies show that maintaining a wildflower patch costs less than 10 percent of the same area of lawn so the slightly higher installation cost of soil preparation and buying flowers is quickly recovered. To save time every spring, rely on plantings of perennials—shrubs and flowers that reappear year after year rather than having to be planted each new season. Popular examples are butterfly bushes, azaleas, rhododendrons, daffodils, lilies, bee balm, and blackeyed Susans.
Enlist native plants wherever possible because unlike non-native varieties, they generally require less maintenance because they can fend for themselves. Already adapted to our climate, they are usually perennials—that is, they bloom year after year. They are also less susceptible to pests and require less water and fertilizer than purchased annuals. The local chapter of the Virginia Native Plant Society has a useful website at vnps.org/jefferson. The site offers an online newsletter with information about meetings, field trips, and guided hikes. Their popular annual Native Plant Sale will be on Sunday, April 29, at 1 p.m. at the barn in the Ivy Creek Natural Area. Albemarle County’s official website offers a searchable listing of suggested plants at: albemarle.org/nativeplants. You can also search for native trees, ferns, grasses, vines, and shrubs at several other regional county websites. Each listing shows ease of growing, ultimate size, resistance to deer and groundhogs, color of foliage and blossoms, blooming season, and other characteristics.

Using rocks, stone, or gravel is another good way to reduce maintenance. A strip of gravel or crushed rock can both widen a driveway and narrow a lawn. One family created a “dry creek bed” in an area that was virtually impossible to mow and was subject to runoff and erosion. A rock garden is an enhancement to any yard, especially on a hard-to-manage slope. Create shallow terraces and plant with drought-tolerant native perennials. In a few years, interesting lichens will appear on the rocks, the plants will be well rooted, and no watering will be needed except in a severe drought. A mowing strip around your gardens will speed any remaining mowing you need to do. It can be made of poured concrete, bricks, or pavers.
Water features are another excellent way to personalize a yard and reduce lawn area without substantially increasing maintenance. Fountains with recirculating pumps and small ponds are charming. Bird-

baths come in a wide range of styles from a simple basin on a pedestal to an elegant setup with a heater in winter and a water dripper in summer. (The sound of the splashing water attracts birds.) Add a feeder or two and you’ll attract lots of pest-snacking birds to help patrol your gardens and save you time and money dealing with pesticides. If you live near a wooded area, bring in the feeders at night so you won’t attract raccoons or bears. Marigolds, garlic, and horseradish are known to repel pests, so adding these to your gardens is another good idea. Spreading mulch on your plantings saves both water and your time weeding. Mulch comes in several colors and a once-a-year refreshing keeps your gardens looking nice. A little planning now can save hours and money while protecting your yard, your community, and your planet.
