PEOPLE WATCHING AT MÉDANO BEACH – No visit to Cabo San Lucas would be complete without taking in the sights along this sun-swept stretch of beautiful sand and inviting waters. Stretching for miles and lined with glamorous resorts, restaurants and luxury beach clubs, Médano Beach (“The Dune”) is the place to see and be seen. Beach vendors stroll the sands enthusiastically oﬀering trinkets or hair braiding. In the distance, parasails ﬂoat on the ocean breezes, jet skis zip along and cruise ships anchor in the bay. SNORKEL AT SANTA MARIA OR CHILENO BAY – The Sea of Cortez is home to an amazingly abundant variety of colorful sea life. On the Tourist Corridor, Santa Maria Bay (near km. 13) and Chileno Bay (near km. 14) there are two picturesque protected bays which are ideal for snorkeling. With calm, clear waters these bays are also great for kayaking and swimming. At Chileno Bay, beautiful 7-bedroom Villa Cielito overlooks the beach, oﬀering a unique setting for a group getaway or special event. Snorkel cruises are available to take you from the marina in Cabo San Lucas to these breathtaking bays.

CATCH A WAVE AT COSTA AZUL – Surfers of all experience levels can enjoy the world-famous waves of Los Cabos. At Costa Azul (near Km. 28), several breaks attract surfers, including the celebrated Zipper’s break. But, newbies can try out the surf as well. High Tide Los Cabos and Baja Outback are two providers oﬀering lessons at Costa Azul. Even kids can get in on the fun. If you’d rather kick back with a cold beer and admire the views of surfers gracefully carving the waves, there’s a bar and grill at Zipper’s that’s the perfect spot.

Pacific Beaches: Lining the Pacific Ocean shores of Cabo San Lucas, you’ll find long stretches of sand at Solmar, Pedregal and beyond. While swimming here is not advised due to dangerous surf conditions, these beaches are perfect for long, leisurely strolls and unforgettable sunsets. PLEASE NOTE: Most beaches are unsupervised. Resort beaches use a flag system to indicate the safety of surf conditions, with green meaning it’s safe to swim, yellow indicating caution and red meaning the water is dangerous for entry. Terms and Conditions Earth, Sea & Sky Vacations Inc. (ESSV), at 567 Auto Center Drive, Watsonville, CA 95076, arranges the vacations advertised in this vacation guide. ESSV is registered by the State of California, Florida and Washington as a Seller of Travel, Registration Numbers 2060094-40, ST37411 and UBI 602870637. Note: Registration as a Seller of Travel does not constitute approval by the States of California, Florida or Washington.

RESERVATIONS AND DEPOSITS Reservations are accepted with a valid credit card as a guarantee. MasterCard, VISA, American Express and Discover cards are accepted. Reservation deposit is required (and automatically charged) within 24 hours of making a reservation. When you provide a check as payment, you authorize ESSV to use information from your check to make a one-time electronic fund transfer from your account or to process the payment as a check transaction. Final payment is due 45 days prior to arrival date. For holiday periods, final payment is due 90 days prior to arrival date. A refundable security deposit and accidental rental damage insurance policy is required for privately owned villa and condominium reservations.

RATES Price ranges advertised in the ESSV Vacation Guide are based on season, room type and number of guests. Rates are per night and do not include taxes or hotel service charges if applicable. Each reservation is for a specified number of guests and/or rooms. ESSV reserves the right to charge for additional guests and/or rooms. Do not exceed the maximum sleeping capacity of your reserved property.

CANCELLATION AND CHANGE WAIVER For a fee of $49 per adult (18 years or older), you may obtain a Waiver for changes or cancellation of any part of your reservation up to the day of arrival. This prevents you from having to pay normally assessed change and cancellation fees. There is no fee for accompanying children under 18. The Waiver must be purchased when the reservation is made. It does not include privately owned villas or condominiums and is not available for holiday reservations from 12/17 - 1/4. It includes hotel and resort property accommodations, tours, activities, special services and ground transportation purchased from ESSV prior to departure. A written cancellation notice must be received by ESSV 24 hours or more prior to the scheduled vacation departure date. Changes in occupancy for shared accommodations are not covered, nor are no-shows. This Waiver is non-refundable and is not considered insurance.

NOT INCLUDED IN PRICES Prices do not cover expenses or services not mentioned, including but not limited to air transportation, gratuities, meals, beverages, parking fees, insurance, resort fees, HOA fees, telephone fees, internet fees, laundry service, cleaning and other items of personal nature.

BAGGAGE Neither ESSV nor selling agent shall be responsible for the loss, damage or delay of customer baggage.

PHYSICAL DISABILITIES

CONFIRMATION DOCUMENTS

Mexico does not conform to U.S. American Disabilities Act standards, therefore accommodations and facilities for disabled persons are extremely limited in Mexico.

Confirmation documents are normally shipped 21 days prior to trip arrival date. These documents will not be released until final deposit and the required signed forms are received. Confirmation documents may be delayed and sent by e-mail due to late payment and/or non-receipt of required signed forms.

PROOF OF CITIZENSHIP AND PASSPORT

All prices, services and amenities are subject to change without notice. ESSV reserves the right to substitute similar services, accommodations or amenities if they become unavailable due to circumstances beyond our control or if a price, service or amenity was shown or quoted incorrectly. All prices are in U.S. Dollars ($USD).

To enter Mexico, you must have a valid passport. It is the passenger’s responsibility to provide these documents. No refunds will be made to passengers affected by their failure to possess proper documents. All U.S. citizens must also carry a Mexican Tourist Card, which is supplied by the carrier. Children under 18 years of age must travel with the consent of both parents. If a minor is traveling with only one parent, that parent must hold a notarized letter of consent from the absent legal parent, or a copy of the death certificate is necessary. Failure to comply may result in denied boarding by the carrier. Non-U.S. Citizens should contact the Mexican Consulate for specific entry and visa requirements.

AGE REQUIREMENTS

RESPONSIBILITY

Most hotels have a minimum age requirement of 21; requirements vary from hotel to hotel. You must be a minimum age of 25 to rent a privately owned villa or condominium through ESSV. You must be a minimum age of 21 to rent a car and have a major credit card. Surcharges may apply for drivers ages 21-24.

The property owners and suppliers which provide in-destination services such as concierge, hosting, meet and greet, accommodations, activities, tours and transportation for ESSV are independent contractors and are not agents or employees of ESSV. Each guest acknowledges that accommodations, activities, tours, services, roads, traffic laws, transportation, sanitation (water and food), building standards, insurance practices, and medical care are not as highly regulated as those in the United States. Guests may encounter the following risks: slippery floors and stairs, especially when wet, precipitous drop-offs at or around some of the residences, unfenced pools, poorly designed or faulty electrical, plumbing and gas systems, dangerous driving conditions, poorly maintained or equipped vehicles, and dangerous stairs or pathways. Some activities that guests engage in are especially dangerous, and include motorized off-road vehicles such as jeeps, hummers, buggies and other four-wheel ATV’s, motorcycle, scooter, and, horseback riding, hiking, climbing, rappelling, jet skiing, kayaking, para-sailing, zip lines, bungee jumping, sky diving, SCUBA diving, snorkeling, ultra-lite flying, sailing, ocean cruises, fishing, golfing, pool and ocean swimming, and surfing. The above list is not all-inclusive, and simply points out some of the hazards of vacationing in Mexico. Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property.

RATES AND ACCOMMODATION SUBSTITUTION

PRIVATELY OWNED VILLAS AND CONDOMINIUMS Cancellations: Payments are non-refundable and non-transferable, unless ESSV is able to re-rent the same property for the same rate and period of time, subject to a $200 cancellation fee. Rescheduling: You may reschedule 45 days or more prior to your arrival date, with the same property and number of nights, for travel within one year of the original check-out date, subject to a $100 rescheduling fee. Rescheduled reservations are subject to availability and price increases, and the nightly rate is based on the new reservation dates. Note: Holiday and Limited Offer reservations may not be rescheduled. Holiday reservations are subject to surcharges.

HOTELS AND RESORTS Changes: Once reservation is under deposit, a $25 per person fee applies to name changes and changes in travel arrangements. Cancellations: Once reservation is under deposit, a fee of $100 per person applies. Reservations are non-refundable when cancelled 14 days or less prior to arrival date. Holidays: During the holiday period of 12/17 to 1/4, cancellation fees are as follows: Once reservation is under deposit, a fee is $200/person applies. Cancellations made 60 days or less prior to arrival are non-refundable. Note: Additional change and cancellation fees may be charged by hotels and resorts and these fees are assessed in addition to ESSV fees.

LIMITATION OF LIABILITY

Any unused portion of accommodation, service or activity is non-refundable. All refund requests must be submitted in writing within 30 days of cancellation or no-show. Reservations made for travel during the holiday period (12/17 - 1/4) are subject to a surcharge, and cancellation fees may be up to 100% of payments.

ESSV reserves the right to refuse business to any person(s) for any reason. By booking one of these vacations, you acknowledge that, in all events, ESSV shall not be liable for any consequential damages, and that the sole extent of ESSV liability shall never exceed the amount actually paid by you to ESSV. Each guest agrees on behalf of himself/herself (and your personal representatives, heirs, executors, administrators, agents and assigns) to release and discharge ESSV, its employees, agents, officers, directors and shareholders, from any and all claims or causes of action (known or unknown) arising out of the negligence of ESSV. This includes, without limitation, injuries or damages arising from ESSV’s negligence which may occur in or around the accommodations, any activity engaged in by the guest, including but not limited to all activities listed above, and any negligent inspection, supervision, instruction, and/or maintenance by ESSV, defect in vehicles, breakdown in equipment, loss of utilities (including but not limited to water, electricity, propane, phone and internet service), accident, sickness, acts of God, strikes, terrorism, war, theft, delays, inconvenience, construction, cancellations, or changes in itineraries or schedules.

TRAVEL INSURANCE

VENUE IN CASE OF DISPUTE

We recommend all travelers purchase travel insurance in the event of unforeseen circumstances. ESSV offers travel insurance provided by Travel Guard International. Travel insurance can be added up to 30 days prior to the arrival date, or up to the date of final payment, whichever comes first. Accidental Rental Damage Insurance (ARDI) is required for all private villa and condo reservations. The fee for ARDI insurance is $49 per reservation and covers up to $3,000 of accidental damages. Any claims for damages must be reported to our office no later than the check-out date.

By booking a Mexico vacation with ESSV, you acknowledge and agree that the proper venue for any dispute or claim that you make regarding your vacation arrangements by ESSV shall be made in Mexico.

SERVICES AND ACTIVITIES Changes: Once reservation is under deposit, a $50 per reservation fee applies to changes in travel arrangement. Cancellations: Once reservation is under deposit, a fee of $50 per reservation applies. Reservations are non-refundable if cancellation is made 14 days or less prior to arrival.
