Although conditions do not favor sellers as much as 180 days ago, it is still a very good time to sell!

The “Days of Supply” is the best indicator of market conditions. The reading jumped from a record low of 20 days in February up to 60 days on August 4th 2022 indicating a rapid shift from strong “Seller’s Market” conditions to a level approaching a “Balanced Market”. The graph illustrates market conditions over the last eight years. The market reaction to the elimination of the mortgage inter est deduction can be seen in Q4 2018 and Q1 2019. The immediate “CV-19 Shock” is visible in April-May 2020, followed by the Strongest Seller’s Market conditions ever seen. In Recent months the days of supply is moving toward a balance market.

The market indicators show that today’s buyers are very sensitive to mortgage rates. More buyers want to buy and more homes will sell… when rates are lower. So, the current market conditions (while they last) benefit both home buyers and sellers. The market has shifted from the super low inventory, “panic buy” conditions we saw in 2021 and early 2022. However, homes which are put on the market in reasonably good condition and priced according to recent sales will find a buyer!

A couple weeks ago we saw mortgage rates fall below 5% for the first time since March, and the total inventory of avail able Orange County homes has increased 61% from the ridiculously low number of homes for sale last year at this time. So, with mortgage rates falling from about 6% to below 5%, it is no big surprise that the Orange County housing market responded with an increase Pending Escrows in the last few weeks.

More houses in Orange County went under contract than were newly listed in recent weeks, so the Days of Supply trended in the direction of a Seller’s Market for the first time since February.

Conclusion: A Structured Installment Sale can be an attractive way for homeowners (or real estate investors) with sub stantial capital gains to defer and potentially reduce their tax liability when selling. By spreading the payments through multiple years via a Structured Installment Sale, capital gains taxes as well as net investment income taxes could be deferred and potentially reduced, while providing the seller with dependable monthly income from the sale. Unlike a seller carry back loan, the payments are reliably made by an A+ Rated Life Insurance Company, and there is no risk of an early payoff (triggering large capital gains taxes).

The sale of a significantly appreciated personal residence often requires the payment of capital gains tax on the profits exceeding the $250,000 per spouse threshold. Some long-term homeowners are fortunate enough to have much more appreciation: $1 to $5 million is certainly not uncommon in Coastal Orange County. Understandably, there is little ap petite for such long term homeowners to sell… especially when capital gains taxes can take 40+ percent of the profit. One strategy for the long term homeowner to defer and potentially lower their capital gains taxes is to break up the cash flows from the sale over several years using a “Structured Installment Sale” with payments made by *A+ Rated Life Insurance Company.
