Expanding the city dump may be an alter native to closing the landfill, which is nearly full. Increasing the size of the landfill is one of two options recommended by a consultant in a report to the regional district’s Solid Waste Management Plan Advisory Committee. The report, which the committee has been waiting on for a year, looked at seven different scenarios for dealing with the region’s waste. Options ranged from closing the Campbell River landfill and expanding the Cumberland facility, to closing all existing landfills and building one new facility somewhere in between Campbell River and Courtenay. “The preliminary report indicates the most effective option is either expansion of the Cumberland site (Pigeon Lake) or expansion of the Campbell River site, in terms of waste energy, cost and production of greenhouse gas emissions,” Coun. This results in an acidic (low pH) soil, which is not conducive to healthy lawns. Grass grows best at a pH of 6.5 and is OK up to pH 7.0. Below pH 6.5, soil is too acidic for grass and you will need to add lime. Enlist a professional lawn care provider or buy a do it yourself kit to test the pH (acidity or alkalinity) of your soil. Or, you can just take it or granted that your soil will be acidic and lime on an annual basis, in spring or fall. It won’t hurt your lawn…. or you! Lime is a general term for calcium-containing, inorganic material that is available in bags from garden stores. It has come a long way from the powdery, dusty stuff that blew all over the place. Dolopril lime is perhaps one of the best limes available today. It’s granular for easy application. You can spread it in much the same way as fertilizer, following the instructions and precautions on the bag. Water use triples in summer time and most of this increase is due to inefficient lawn watering. Increased use at peak periods compromises City of CR fire-fighting ability and increases operating and capital costs. Just last year he was fit and healthy, but last December, while riding his bicycle on Dogwood street, Unick accidentally swerved into the path of a truck and was hit. He suffered two fractured hips, back and spine injuries, which cause him pain every day. Ironically, Unick’s bike, and his only mode of transportation, had barely a scratch. “There was not a ‘bruise’ on it when I picked it up,” said Unick. “Just the chain had come off, but I can’t ride it anymore anyway.” Unick attempts to take his bike downtown from his home in the Little Rock RV Park on the Island Highway, to do grocery shopping and pick up other essentials but by the time he makes it back home, he’s pushing his bike and can barely move. “I sit here and I watch him go out and he comes back and can barely put one foot in front of the other, it’s unreal,” said neighbour Jean Bowerman who lives beside Unick. “It’s so blatant the pain on his face, I see his

whole body screaming in pain. I just can’t stand to watch him come home on that bike anymore.” Which is why Bowerman, along with help from RV park manager,

BC Fer ries isn’ t allowed to use revenue from its busy routes to prevent steeper increases on the smaller island and northern runs. That is one of the regulations imposed by the B.C. government in 2003 that is being reviewed by Gordon Macatee, the new B.C. Ferry Commissioner. Another is the mandate to move toward a user-pay system, which
has resulted in fuel surcharges along with higher fares on BC Ferries’ 25 salt-water routes. Transportation Minister Blair Lekstrom said he has heard loud and clear from ferry users that they’ve had enough of big increases, and he wants “a primary focus on affordability” to consider tourism and other business as well as residents. BC Fer ries CEO David Hahn has said the mandate of the
quasi-independent Crown cor poration and its current public subsidy could result in a doubling of rates for some routes in the coming years, and substantial increases across the fleet. Lekstrom said he doesn’t accept that, but he wouldn’t comment on the possibility of increasing the provincial subsidy. BC Ferries is returning to fuel surcharges in June as fuel prices h ave s o a re d , a n d has requested rate
increases for next spring. Lekstrom said the fuel surcharges will go ahead. BC Ferries is seeking rate increases of about four per cent on major routes and eight per cent on others to take effect next year. Lekstrom said he is considering legislation to allow temporary relief before the spring legislative session ends June 2. Macatee’s review is to be complete at the end of September.

Unick, who was found at-fault in the accident and is a senior living off a pension, has no money to buy a scooter himself, and hasn’t asked for one either. Bowerman has taken up the crusade on her own and has donation jars at Campbell River Electric Wheels (1841 Island Hwy.) and Spokes (13th Ave.) and
will also take donations where she works at the Husky gas station on the Island Highway. Bower man has already shopped around and knows Unick needs a fourwheel scooter. It also needs a good battery so he can get to town and back, and it has to travel at least seven miles per hour in order to get up the steep hill on the highway near
Hidden Harbour. Those type of scooters cost around $2,500 but Bowerman would also be happy with a secondhand scooter, even if it needs work to get it up to par. “We don’t care if it’s secondhand. If someone has one they would like to lend that would be great,” said Bowerman. “If someone has one, we could still supply the batteries and

Dave Rennie is best known in Campbell River for his great sense of humour. But on the weekend he became a household name across the country when he won $35.7 million in Friday’s Lotto Max draw. Rennie, of course, laughed all the way to the lottery office to pick up his prize Tuesday. “I won a free play! That’s kind of neat,” joked Rennie as he spoke to CTV News. Rennie, his wife Sandra Morgan and son Kyle, 18, spent Tuesday night at Rogers Centre, cheering on the Vancouver Canucks to make it to the
Stanley Cup final. The former forestry worker told media he will likely retire from his steel job at AJ Forsyth. His wife shows quarter horses, so a future ranch is likely, as well as a new home for his parents, and Kyle expects his university tuition to be paid for. When Rennie went to check his ticket, he heard the familiar “winner’s tune” but didn’t immediately realize the extent of his newfound riches. “Yeah, I won a dollar!” Rennie told CTV, sporting an ear-to-ear grin.

Court sides with West Coast natives to sell fish The B.C. Court of Appeal has unanimously affirmed the right of five Nuu-chahnulth First Nations to harvest and sell any species of fish in their territories with the exception of geoduck clams. The Court of Appeal recently upheld a November 2009 decision of the B.C. Supreme Court that recognized the Nuuchah-nulth as having these rights, based on the central importance of fishing and trading fish throughout their history. After reviewing the various sources of evidence, the three Court of Appeal Justices unanimously concluded that “all tend to be supportive of the judge’s finding that there was significant intertribal trade in early times at and before contact in fisheries products on the coast and across Vancouver Island by the ancestors of the respondents.” The court divided on the precise definition of the right to sell fish. The majority affirmed the trial judge’s characterization that the Nuu-chah-nulth have a right to sell fish into the commercial marketplace, with the precise scale to be negotiated with Canada. The dissenting justice found
that the right should be characterized as being for a “moderate livelihood” only. The court also agreed with the trial judge that Canada’s management of the fisheries has not respected Nuuchah-nulth’s aboriginal rights; the court provided the parties one year to design a fishery that recognizes these rights. The federal government appealed the original decision, disputing the trial judge’s findings that enough evidence exists to support the claim that Nuu-chahnulth Nations have an aboriginal right to fish and sell fish commercially. Canada also argued that the trial judge did not accurately apply the test previously set out by the Supreme Court of Canada for determining aboriginal rights.
The Court of Appeal did not allow the government’s appeal, finding instead that there was ample evidence to support the trial judge’s findings, and that she did accurately apply the Supreme Court test. “It was neither possible nor desirable for the trial judge to articulate the precise content of the Aboriginal rights at issue at the outset of her analysis. The respondents were entitled to plead their claim broadly. The judge properly placed primary focus on evidence about the pre-contact practice,” wrote Justice Hall for the Court of Appeal decision. The court did agree with one part of Canada’s argument by not extending the aboriginal right to the modern geoduck fishery. T he case, which
spanned much of the last decade, began in 2003 when Nuu-chah-
claims were based on aboriginal rights to harvest and sell sea
resources, aboriginal title to fishing territories and fishing sites.

Court credibility an issue after bail The law is an integral part of any society. It can also be awfully confusing, downright frustrating and, for the family and friends of John Ruffolo, absolutely infuriating. The latter sentiment was produced last week, after B.C. Court of Appeal Madam Justice Mary Newbury allowed the appeal of Ruffolo’s convicted killer, Ruby Ann Ruffolo, and set her free on $100,000 bail. In her decision, Justice Newbury voiced a fear that granting bail would undermine public confidence in the justice system. Yet she granted it anyway, convinced that Ruffolo posed no flight risk, having stuck around town during the six years it took for her to be tried for
the crime of murdering her husband in 2003. Disgusted with that reasoning, John Ruffolo’s sister, Mena Westhaver, said it best when she wrote the News to ask whether B.C. has a “first murder free” act. Paul Pearson, Victoria-based chair of the criminal justice section of the Canadian Bar Association’s B.C. branch, acknowledged that granting bail in such situations is rare, but it does happen on occasion. We tend to side with Westhaver. How does someone who has gone through the criminal justice system and been not only convicted, but given the longest jail sentence possible, warrant being released on bail? It just doesn’t make sense, regardless of the law as
it is written. The decision sends a confusing message that, as Justice Newbury feared, will without question cast public doubt upon the justice system. Regardless of Ruffolo’s record of keeping her nose clean during the trial period – her reputation was far from clean leading up to her husband’s death – it can do nothing but damage the public’s perception that it is being kept safe. And what of the victim’s family? They fought an emotional battle for years to have his killer convicted and taken off the streets. The B.C. court system needs to better explain its judgments if it wants to maintain any level of credibility. – Victoria News/Black Press
Good point: Lawns Regarding the editorial “Here’s to a less toxic environment” (Mirror, May 18). There’s nothing cosmetic about pesticides that are used on lawns and gardens as tools designed to address specific pest problems infesting valuable landscapes. Unfortunately, a recent editorial portrayed common misconceptions about these products that should be addressed. Pesticides help control threats to human health (such as rats and mosquitoes), they protect private and public properties from insect, weed and disease infestations and they help ensure that Canadians have a safe and affordable supply of food thereby contributing to healthier communities and greater well-being and prosperity. Furthermore, only a handful of provinces have instituted unscientific, arbitrary bans and the negative consequences are starting to show, including illegal pesticide use, loss of green space, increased municipal maintenance costs, and homeowner frustration. When it comes to health and safety, readers should know that before any pesticide can be sold in Canada it must undergo a rigorous scientific review and risk assessment by Health Canada. In addition to a comprehensive set of over 200 tests, Health Canada also reviews all additional scientifically credible studies that exist. My feedback on the harmonized sales tax debate is running hotter as taxpayers await Premier Christy Clark’s “bold” changes to the tax, due to be revealed any day. In response to several angry readers, I will restate what I had hoped was obvious by now. All but the poorest consumers (myself included) are paying more tax under the HST than they were under the old provincial sales tax. The richest pay by far the most. The “embedded” PST has been removed from many products, but evidence isn’t yet clear that this is being passed on to consumers, as economists predict. What is clear is that businesses are
benefiting. What is still in dispute is what businesses are helped most. Doug Donaldson, the NDP MLA for Stikine, objected to my statement last week that he was wrong about the HST beneficiaries being “Liberal donor corporations.” So again I will state the obvious, that forest, mining and other resource companies donate to the B.C. Liberals. (The NDP is on record as wanting to increase corporate income and capital taxes.) Donaldson goes wrong when he specifies “corporations” rather than small business. Consider the forest industry. Over the past 20 years the entire B.C. industry contracted out its har-
vesting operations, based on the welltested principle that independent contractors are more efficient than inflexible, strike-prone major forest operators. That has been a painful process, not just economically, but in terms of worker safety. But it’s exactly the kind of global-market shift that is being imposed on B.C. As mentioned last week, you may not like that, but you shouldn’t believe those who try to pretend it’s not happening. And those big “corporations” had their major machinery and equipment exempted from sales tax long before the HST. It’s the small contractors who are now getting the benefit.
NDP finance critic Bruce Ralston notes that anyone can incorporate for tax purposes. It’s common for doctors, dentists and lawyers such as Ralston. But is it practical to expect the owner-operator of a logging truck to do that? The independent truck drivers I’ve met are more concerned about paying their next fuel bill than hiring a lawyer to incorporate them. Increasingly it is immigrants who drive trucks, out-working the resident population to get ahead as immigrants have always had to do. Speaking of immigrants, the situation in Vancouver real estate is worth noting. Continued on Page 11

One of the things HST was supposed to severely depress was high-end new housing, now subject to the seven-per-cent provincial portion of HST once the prices exceed $525,000. What has happened? Offshore buyers are
pushing costs out of the reach of B.C. residents who aspire to an ocean view. In many cases these are “satellite families,” taking advantage of our clean, stable, safe jurisdiction on the Pacific Rim. Mum may drive the kids to private school in a Range Rover, but the family reports
little or no Canadian income. The only way these residents will pay a share is through consumption taxes. I have also argued that mig ration of retirees will dominate B.C.’s population growth in the coming years. This is another group that reports less income but has signifi-
cant consumption. A recent BC Stats study shows that I overstated the impact of retirees. Since 1961, only seven per cent of migrants to B.C. have been 65 or older. Younger people are coming here to work, and increasingly they will be self-employed or in small business.

6 halibut steaks salt and pepper 3 tbsp. (45 ml) butter – melted lemon wedges – for garnish For the mustard sauce 4 tbsp. (60 ml) dijon mustard ½ pt. (300 ml) whip cream ½ tsp. (2 ml) icing sugar 1 tbsp. (15 ml) lemon juice Preheat the grill and lightly oil. Season the halibut with salt and pepper. Arrange the fish on the grill and brush with the melted butter. Grill for 4 – 5 min., then turn over and brush with more melted butter. Cook until fish flakes easily with a fork. Meanwhile, combine the sauce ingredients in a saucepan and bring to a boil, whisking constantly. Reduce the heat to a simmer and whisk until the sauce thickens. Remove from the heat and keep warm. Environmental Assessment of the Proposed Raven Underground Coal Mine Project 7x14
Public Meetings — Reminder Compliance Coal Corporation, doing business as Comox Joint Venture, (the Proponent) is proposing to develop the Raven Underground Coal Mine Project (the proposed Project) approximately 20 kilometres south of Courtenay on eastern Vancouver Island, in British Columbia (BC). The Proponent proposes to transport coal from the mine by truck on existing highways 80 kilometres to the port of Port Alberni. Port upgrading work at Port Alberni is proposed by the Proponent to enable shipment of coal offshore. The proposed Project is subject to review under the Canadian Environmental Assessment Act and BC’s Environmental Assessment Act. The Canadian Environmental Assessment Agency (CEA Agency) and the BC Environmental Assessment Office (EAO) are inviting the public to attend public meetings as part of the public comment period on the draft Application Information Requirements/ Environmental Impact Statement Guidelines document (draft AIR/EIS Guidelines document), which specifies the studies to be conducted and information to be provided by the Proponent in its Environmental Impact Statement and application for a provincial Environmental Assessment Certificate.
Public Comment Period If you are unable to attend a public meeting, you may still wish to make a written submission. Written submissions will continue to be accepted until June 21, 2011. Submissions sent by mail must be postmarked no later than June 21, 2011. All comments received during this comment period will be considered. After taking public comments into consideration, and ensuring that the Proponent’s responses are adequate, the CEA Agency and the EAO will finalize the AIR/EIS Guidelines document and issue it to the Proponent. Summer reading returns to library Reading is like all skills – a little practice goes a long way, and the old “use it or lose it” adage applies equally well to reading, especially for children who don’t keep up these important skills during their summer vacation. Nobody knows this better than teachers who believe that some children can lose as much as 60 per cent of their acquired skills ove r t h e s u m m e r break. A minimum of 10 minutes a day is all it takes for primary school children to keep up their reading skills and speed.
“Research shows that students who don’t read a minimum of 10 books at their current reading level will actually regress over the summer and be further behind, compared to where they were at the start of their summer vacation, and then they’ll have to play catch-up in September,” says library manager Timothy Skye at the Vancouver Island Regional Library. He suggests that parents encourage daily reading activities during the summer by signing their kids up for reading programs as a great way to keep

children and parents motivated. The library offers three levels of summer reading programs: Summer Reading Club is for Kindergarten to Grade 7; Read to Me is for pre-schoolers and those who cannot yet read independently; and the Teen Reading Club is an online club for readers 13 and up at www.teenrc.ca The Summer Reading Club provides elementary school children with incentives to make reading an integral part of their holiday and encourages them to practice and improve their reading
skills while school is out. “It’s so important to make sure children have choices and can select books they’re interested in, instead of just telling them what to read,” says Skye. One way parents can model the importance of reading is by reading themselves. “After all, if parents don’t read, why should their children?” he asks. Children who sign up will receive a fun registration package with a bookmark, stickers, trinkets, and a reading record book in which

Former local teacher to open art exhibit at gallery Meet artist and former Campbell River resident Marilyn Chapman on Thursday for the opening of her exhibit “Fragile Entanglement” at the Campbell River Art Gallery. Chapman now lives in Victoria and taught in School District 72
for many years. The exhibit was inspired by the extraordinary landscape of Vancouver Island landscape. She sees the scrolls of rainforest foliage, weathered driftwood beaches, swirls of sea patterns and repetitive raindrops, and expresses the inner life

More than 30 artists and 25 studios to see on Quadra Itâ&#x20AC;&#x2122;s Studio Tour time again on Quadra Island. June 4-5 are the dates for the 9th annual event which features 35 artists showing their work at 25 island studios and the Quadra Community Centre where a group â&#x20AC;&#x153;samplerâ&#x20AC;? exhibition provides an overview of what the various studios have to offer. While youâ&#x20AC;&#x2122;re at the community centre, stop for a delicious lunch or snack at the Gallery Bistro, featuring local seafood, desserts and refreshments. steps inside the landscape to record and represent nature, her journey reveals intricacies rarely acknowledged by the naked eye. Her contemplations unveil an elaborate convergence of organisms and forces and each piece reveals a dynamic, high-density whole. Chapmanâ&#x20AC;&#x2122;s art studies took place in Manitoba before she left the prairies for the West Coast. She has exhibited extensively in Vancouver and Victoria in
numerous shows and tours, as well as in Studio Vogue in Toronto. Chapman will also be working with local pupils once more â&#x20AC;&#x201C; this time leading three school tours at the gallery to discuss her exhibition and take students through a printmaking exercise that will become part of a larger mural or sculptural installation in their schools aimed at increasing environmental awareness. Junior Ravens remain undefeated Coming off a win last weekend, the Saratoga Ventures Junior B Ravens were hungry for more as they turned their focus to the Nanaimo Timbermen. The Timber men travelled to Campbell River for a Sunday afternoon game at Rod Brind’Amour Arena. The game started off as a back and forth affair and by the 12 minute mark, shots on goal were close to even with five shots for the Ravens and six for the
Timbermen. After some penalty trouble on both sides, it was the Timbermen who found the back of the net first, after many great saves by Ravens goalie Logan Down. The defence checked hard but Nanaimo would score one more at 4:30 to take a 2-0 lead after the first. Monster trucks take over Speedway Saratoga Speedway hosted another great double header weekend. A total of 64 cars hit the track on Saturday and Sunday, one of the best car counts in years. California Kid and Rockstar put on an amazing show, d e s t roy i n g m o t o r homes, buses and getting some amazing air. Wet conditions once again affected qualifying on Saturday. Fast time in the Roadrunner class went to Andrew Buchanan, setting a time of 24.518. Buchanan carried over his winning ways from opening night, taking the lead early in the heat race and eventually taking the win. The 15 lap main saw Derrik Senft take the lead early, holding on to it for most of the race until lap nine when Buchanan passed Senft on the back stretch taking away the lead and the eventual win. Second place went to Senft and third to James Moore, who was filling in for Weston Lane on the night. A very impressive field of 14 Bomber Cars also took to the track on Saturday. Fast time went to Kerry Steen with a time of 22.443. The B heat went to Darren Larson, and the A to Brandon Steen. The 30 lap main saw Travis Stevenson take the lead on lap one. Stevenson would be pressured by Steen for the whole race but was too much for Steen, leading all 30 laps. Second went to Steen and third to his dad Kerry Steen. Fifteen Crash to Pass cars filled the pits on Saturday. Fast time went to Glenn Pinto with a time of 24.244. The B heat went to Brandon Young and the A to Troy Tarbuck. The 20 lap main saw “Mr. Ugly” Gregg Sagmoen dominate the field, leading every lap and hitting everything in his sight. On lap eight, the first roll over of the year happened; “Smokin” Joe Libatore took a hard hit in the back stretch which sent him airborne. “Smokin” Joe came out unharmed
but his car needed many repairs. The Hor net cars made their second appearance of the year on Saturday; fast time went to Jason Fraser with a time of 21.790. The D heat went to Ted Dimitrov, the C to Kyle Fallowfield, the B to Daryn Cahill, and finally the A to Kevin Lawrenuk. The B main saw William Boyes move up from last to first in
two laps, eventually taking the win. Second went to James Nesbitt, and third to Tristin Gait. The 30 lap A main saw Gord Fraser take the lead on lap four; Fraser held this lead until lap 16 when Corey Sanderson took the lead and he never looked back. Fraser would finish second and Kevin Lawrenuk took him third. Dry conditions made
for some great racing on Sunday. Fast time in the Roadrunner class once again went to Buchanan with a time of 19.047. Buchanan would also go on to win the heat. The 15 lap main saw Weston Lane take the lead on lap one and never look back, winning his first race of the year. Second went to Buchanan and third to Andrew Cannon.
A field of nine Bomber cars hit the track Sunday night. Fast time went to Charlie Acker man with a time of 18.030. Some drama occurred in the heat race – Darren Larson had been leading the race up until the last lap when Ackerman was challenging on the outside. Larson didn’t want to give up the lead, causing him to cut off
Ackerman, leading to a black flag for Larson, giving Ackerman the win. The 30 lap main saw Ackerman dominate the field, lapping all but five cars. Second went to Darren Larson and third to Darrell Larson. Fourteen crash cars hit the track on Sunday. Fast time went to Troy Tarbuck with a time of 18.520. The B heat went to Cody Young and the
A to Tom Dunn. The 20 lap feature saw Gregg Sagmoen once again lead the pack and eventually take the win. The monster trucks will return on July 30 and 31, with a projected four trucks coming.
