Findings 1. A hydrograph method based on sound hydrologic theory is not used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 158,566 square feet. b. Volume retention required: 158,566 ft2 x 1.1 inches x 1 ft/12 inches = 14,535 ft3 Table 1. The applicant did not partially comply with the volume retention standard at an offsite location or through the use of qualified banking credits. c. The applicant has not submitted money to be contributed to the Stormwater Impact Fund. d. The project is linear, and the cost cap has been reached (3.64 ac * $30,000/ac = $109,200). The anticipated cost of the proposed infiltration trench is $117,522.

5. Best management practices do not achieve 90% total suspended solids removal from the runoff generated on an annual basis. However, the project is linear, and the cost cap has been reached. The project site does not achieve gross pollutant removal.

6. A memorandum of agreement for maintenance of stormwater facilities exists between the City of St. Paul and the CRWD. Adequate maintenance access is provided for the underground system.

RULE D: FLOOD CONTROL Standards ➢ Compensatory storage shall be provided for fill placed within the 100-year floodplain. ➢ All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. It is unknown if all habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements. However, adequate conveyance has been provided to prevent flooding.

RULE E: WETLAND MANAGEMENT Standard ➢ Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland. ➢ A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards ➢ A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity. ➢ Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard ➢ Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 4 Conditions Conditions: 1. Provide plans signed by a professional engineer per the Minnesota Board of AELSLAGID. 2. Provide a copy of the NPDES permit.

3. Revise SWPPP or erosion and sediment control plan to include the following notes: a. Infiltration perimeter control and erosion control practices shall remain in place until the final completion of the project or vegetation has been established (whichever is later). b. Installation of infiltration practices shall be done during periods of dry weather and completed before a rainfall event. Placement of engineered soils shall be on dry native soil only. c. Excavation of infiltration areas shall be completed using a backhoe with a toothed bucket. d. Native soils in infiltration areas shall be de-compacted to a minimum depth of 18 inches. e. The bottom excavation surface of infiltration areas shall be level without dips or swales. f. During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment. g. Engineered soil shall remain uncontaminated (not mixed with other soil) before and during installation.

Background In April 2017, Bluestem Heritage Group was hired by CRWD to prepare a formal history report for the 595 Aldine Street property. The report is based on research and interviews conducted by Bluestem.

Historic findings from the report may help inform the upcoming outreach and development objectives for the 595 Aldine Renovation project.

Issues Bluestem Heritage Group has completed the draft history report for 595 Aldine Street property. The report describes the significant eras of history for the property including its natural history, 19 th century settlement, early 20th century establishment recent activities at the site in in the Midway Area.

CRWD and Bluestem Heritage Group staff will present and seek comments on the enclosed draft report from the Board.

Due to its length and number of color graphics, only an electronic copy will be provided to the Board.

Earliest Settlers Before the arrival of European settlers in the late 1830s, St. Paul and the surrounding area were home to the Dakota, with frequent visits by the Ojibwe and other local Native Americans. The Dakota village of Kaposia was centered near where downtown St. Paul is, and trails stretched out from this village to other villages, spiritual locations, trading centers, and resource areas. The Falls of St. Anthony (known as Owámniyomni), was considered a sacred place to the Dakota, and was a significant cultural and natural resource.1 Between what are now the downtowns of St. Paul and Minneapolis, the Native Americans established a major trail. This east-west route offered the most direct route between Kaposia and the Falls of St. Anthony. A slight ridge in the landscape, which runs north/ south approximately where Snelling Avenue is, created a rise. Native Americans ran the trail through a modest break in the ridge – near where I-94 and University Avenue now lie.2 This road became known as the Red River Trail, as it eventually extended to the fur-rich northwest Red River Valley.

In 1837, the first major treaty exchange for land in this region was made between the Dakota, Ojibwe, and the United States government, and the land east of the Mississippi (where St. Paul sits) was transferred to the U.S. Government. Soon after, the first wave of settlers began to arrive in the region, establishing villages near existing posts and along previously established trade routes. Before the land was even surveyed or the Dakota had yet moved, eager settlers began to stake claims. Land alongside pre-existing trails was often the first to be claimed. When the area was surveyed in 1847, the cartographers noted where some of the new farmers had begun to live.

Métis, people of native and European heritage, used the Red River Trails to drive ox carts full of furs to and between the commercial centers of St. Anthony and St. Paul. The purpose and location of these trails are echoed today in University Avenue, the Great Northern rail line, Interstate 94, and the Green Line light rail. (Minnesota Historical Society)

Settlement In 1849, Minnesota became a U.S. Territory, and in 1852, another major treaty with the Dakota was signed. As land became available for purchase, new arrivals rushed to establish legal claim to these lands. On August 1, 1853, a settler named William H. Townsend became the first to legally own an 80-acre parcel alongside the Red River Trail.3 This parcel includes what became 595 Aldine.4 Townsend may have used the land himself, but more likely he was among the many active speculators buying and selling land during this era. Among those early speculators was Daniel Hopkins, a son of a local early trader. He and his wife Elisabeth (Elisa) initially lived in downtown St. Paul along with their two children, James Mortimer and Minnesota Rose. Elisa wrote home to New Hampshire around 1849 to describe the land that Daniel had bought around that time— possibly the parcel that included 595 Aldine:

“ Daniel has already purchased 120 acres of land. Twenty acres of meadow grass on it. Grass stands to one’s head – good as a full meadow.”

Other of her letters describe the rich natural resources and wildlife on the Hopkin’s land: timber, ducks, prairie chickens, and deer. There were wolves and bear nearby, too. Daniel’s purchase was savvy not only because of the abundant natural resources, but because of its location along the main Red River Road.

Unfortunately, Elisa did not get to enjoy this land long. She died in 1857. Soon after, Daniel married Annette Bagsted, a recent immigrant from Norway. Together, along with a German immigrant farmhand named Theadore Heslter, they were farming the land by 1857.6 By 1860, Annette had given birth to two sons.7 Another six children would eventually be born to the couple. They remained on the property through 1867, but it appears they had moved by 1870. By 1875, the family had moved to Oakdale.8 One mystery is associated with the property: when Daniel’s father lay dying in 1852, he revealed that he had buried some treasure, and began to describe where it was buried.

Daniel discouraged his father from giving the instructions – he did not want to distress his father by confirming that he was mortally ill. The father died without completing the story.

Might the treasure have been buried on his son’s farm? The mystery endures.9

Industrial Growth About a decade after the first settlers began to farm in the area, railroads arrived and dramatically reshaped the Midway neighborhood. In the summer of 1862, the St. Paul and Pacific Railroad cut ten miles of track between St. Paul and St. Anthony, about a mile north of the Hopkins property. This was the first railroad line in Minnesota. Though the Civil War stalled the expansion of the railroad system for much of that decade, the significance and importance of the transportation method was obvious to many.

The William Crooks was the first locomotive to operate in Minnesota. Starting in 1862, it provided regular passenger service between St. Paul and St. Anthony on the St. Paul and Pacific Railroad line, which ran along the northern edge of the Midway neighborhood. (Minnesota Historical Society)

Located “mid-way” between the cities of St. Paul and Minneapolis, the Midway area was easily accessible to people in the cities, and the availability of large, flat pieces of open and affordable land led to a variety of large-scale uses.

As additional railroad lines came through the area, railroad shops and rail yards began to sprout up. Within the Midway district, an area called the Minnesota Transfer Neighborhood developed around a large rail yard about a half mile west of the 595 Aldine property. By 1888, this was a bustling area. Local author Frank C. Bliss described it this way: “The transfer company is composed of eight great railroad corporations. The grounds cover about 200 acres occupied by the tracks buildings and stockyard of the company. The immense business done by the company is the transferring of freights from the cars of one road to another. An army of men are employed here and the business is constantly increasing.”10 January 22, 2018

Associated industries, such as stockyards, factories, and warehouses soon followed. During the 1870s and 1880s, a small stockyard and two small slaughterhouses were located on the Transfer property. The Union Stock Yards were well located with access to many rail lines, including St. Paul and Northern Pacific lines, as well as the St. Paul, Minnesota, and Manitoba lines.11 The stoockyards were used primarily to provide water and rest for livestock on their way to Chicago. The slaughterhouses served local demand for meat. When livestock ranchers requested and expansion of the stockyards, the owner declined. In 1886, the ranchers moved their cattle to the recently established South St. Paul stockyards, and the Midway stockyard closed sometime after 1892.12

The open land was attractive for more erudite purposes, too. In the early 1870s, Hamline University made the decision to move from Red Wing to St. Paul. As a history of the institution notes, “A major reason for the University’s otherwise inexplicably bleak and barren location were the short line tracks of James J. Hill’s St. Paul, Minneapolis, and Manitoba Railroad. One mile to the south … lay the Chicago, Milwaukee, and St. Paul Railroad.” The first building on the new campus was constructed in 1880, though it burned down in 1883.13 Old Main, the oldest surviving building on campus, was constructed in 1884.14 The open land also drew pleasure-seekers. In 1880, soon after the short line opened, an amusement park was opened near the corner of University and Lynnhurst Avenue. Called “Union Park,” the park included a bowling alley, bandstand, dance hall, carousel, and even a small zoo. Ambitious visitors could climb up a tower to observe the growing area.15 The following year, in 1881, fur trader, entrepreneur, railroad magnate, and onetime mayor of St. Paul, Norman Kittson built a stables and a racetrack on the land he owned bordered by University, Snelling, Pascal, and St. Anthony.16 The current Turf Club restaurant takes its name from this venture.

During the 1880s, development began to push into the area. Streetcars carried people around town. Early cars were horse-drawn, but by the late 1880s, electric streetcars were running up and down University and other avenues. In 1885, the area was incorporated into the City of St. Paul.17 In 1889, University Avenue was first paved with a combination of lumber, cement, and asphalt.18 In 1890, Minneapolis and St. Paul combined their separate transit companies to form the Twin City Rapid Transit Company (TCRT). The TCRT operated

streetcars and buses in St. Paul and Minneapolis and had a manufacturing facility — called the Snelling Shops — on the southeast corner of Snelling and University by 1906. The company also acquired and operated several bus lines during WWI.19 By 1892 the area bounded

by Fairview, Thomas, Aldine, and University (including the property at 595 Aldine) was owned by the Dickerman Investment Company, run by brothers Charles K. and Gilbert The Dickerman property in 1916. (1916 Hopkins Atlas, University of Minnesota) Dickerman.20 An 1892 atlas shows the area was platted, but no homes were constructed on the land, though there were residences on the western side of Fairview. In 1906, the land was re-platted by Dickerman.21 In 1908, development had still not occurred in the Dickerman lots, but that was soon to change.22

In 1911, Griggs, Cooper & Company began construction of its Sanitary Food Manufacturing Plant on one of these parcels at 1821 University Avenue – the northeast corner of Fairview and University. The building was reportedly the world’s largest canning factory when it was constructed. Candy and cracker manufacturing was added, and warehouse wing additions were made in 1921 and 1925.23 Aerial photos show that train lines curved to the building, allowing for easy transportation of goods. The main building was converted to office use in 1955 when Griggs, Cooper closed its manufacturing operations.24 In 1912, the Dickerman Investment Company and Griggs, Cooper & Company re-platted the two southern blocks fronting University Avenue, creating a 160-foot strip along University that was “dedicated for a parkway.”25 This parcel is now known as Dickerman Park. For decades, the park was neglected and under-appreciated, and adjoining businesses even began to encroach with parking lots. Around 2002, the neighborhood and City began efforts to re-claim the park. In 2006, descendants of the Dickermans donated $46,000 towards the efforts to re-vitalize the park.26 These plans are slowly unfolding.

In 1928, the parcel at 571 Aldine was owned by the Anchor Block Company.27 Workers fired concrete blocks in the kilns and likely transferred them via the rail spur that curved along its western edge.28 The northeast corner of University and Wheeler was home to a variety of businesses: Brown-Blodget, Worchester Cigar Company, and Cities Service Oil Company.

Residences continued to fill in around the area, though there were only a few on the northern side of Thomas Avenue.

1935 Cummins car

In 1949, the property at 595 Aldine Street was owned by Cummins Diesel Sales Corporation, which constructed a building that year.29 Cummins Diesel Sales was founded in 1919 by Clessie Cummins in Columbus, Indiana, as the Cummins Engine Company. Cummins was a self-taught mechanic and inventor, and was among the first to see the commercial potential of the engine technology invented by Rudolph Diesel in the 1890s. On Christmas Day, 1929, Cummins mounted a diesel engine into a used Packard limousine and went for a ride— creating what was likely America’s first diesel-powered automobile.30 In the early 1960s, Lyle Jensen purchased the Cummins Distributorship in Minnesota and North Dakota, and oversaw a surge of growth in the company. At the 595 Aldine property, Cummins workers serviced a wide variety of trucks and road-building vehicles. The timing for this expansion was good, as a recent history of the Cummins company explained, “By the 1950s, America had embarked on a massive interstate highway construction program, with Cummins engines powering much of the equipment that built the roads and thousands of the trucks that began to roll down them.”31 Around 1950, the property just west of 595 Aldine at 1736 Thomas32, became the Liquid Carbonic Corporation, which sold dry ice and supplies for soda fountains. Later, this building became a small grocery store.33 The property just west of that, at 1750 Thomas, was a warehouse for Buick automobiles owned by General Motors. As a result, the area became known as “Buick Hill” to local kids.34 As University Avenue developed with commercial businesses and factories, residences began to fill in on the side streets. While many of the homes in the broader area were built as working class homes between 1900 and 1930, there were few residential properties on Thomas.35 The first – and, until the late 1950s, only – house constructed in the area was a white house on the corner of Aldine and Thomas. Mark Voerding, who grew up in the Midway area, recalls that the half block to the north along Thomas Avenue was primarily vacant until the 1950s. It served as a playground for neighborhood children, who would build forts and play games on what they referred to it as “the woods” or “the vacant lot.”36

As the neighborhood developed, occassional friction between the industrial and residential uses occurred. A Cummmins employee recalled that when the apartment buildings at 565 Aldine were constructed in 1968 – on what had been the Anchor Block property – the apartment windows were directly across from where Cummins mechanics tested vehicles in an open-air dynometer room. The testing - which measured engine power - required revving engines to their maximum. “Cummins also did run a night shift. So you can imagine the noise some old tractor with a V8-265 engine, screaming its heart out at 10pm on the dyno would sound like, and also vibrate those apartment rooms!!!” Responding to complaints, Cummins enclosed the area within a year.37 The Midway neighborhood was known for decades for the many automobile dealerships that lined nearby University Avenue. Other automotive-related businesses such as repair shops and automotive supply stores sprung up nearby. Cummins Diesel Sales served larger industrial vehicles. Like Cummins, the next tenant of 595 Aldine would be automotiverelated.

With the post-WWII rise of the automobile, streetcar use declined, and in 1953, the streetcar system in St. Paul was decommissioned and replaced with buses.38 Cars and freeways were transforming our cities. In the 1940s, planners began to study the possibility of creating a freeway between the two cities. As the Dakota and the railroad engineers had previously discovered, the most direct route followed closely along the University Avenue route.

Though a more northern route paralleling the Northern Pacific rail line was considered, leaders chose to plat the freeway through the southern option and through the historically black Rondo neighborhood.39 This development displaced the residents and weakened the economic stability and vitality of the area.

In the 1950s and 1960s, University Avenue was a popular place to race cars and was referred to as “Route 66 of the Twin Cities.” Catering to this car culture, a number of drive-in restaurants opened along the corridor. One of the most popular of these was Porky’s. Melvin Carter, Jr., remembers this culture:

“ Back in the 50s and 60s … there’d be a lot of drag racing up and down there. … So people would go up there sometimes and watch, get some hamburgers and go up there and park … and watch some of the drag racing.”

Drag racing declined in popularity in the 1970s as police cracked down. To help keep that era alive, the Minnesota Street Rod Association organized the first “Back to the 50s” classic car show in 1973 in the parking lot of Midway Shopping Center. The show moved to Fairgrounds a few years later, and today is largest show of its kind in the world.41 By the end of the 1960s, the Cummins Corporation had expanded its sales and service network to 2,500 dealers in 98 countries and sales were around $13 million a year. A Cummins employee recalled the energy there when he was hired in June 1969. He was originally from Nebraska and had been recently honorably discharged from the Army after serving in Vietnam. After casually stopping by Cummins (CDSI) to inquire about any openings, he was directed by the front office receptionist to the Service Manager, who officed up some stairs in the “tower” in the shop area. After reviewing his documents, the manager said “you know, you look like a good kid. Tell you what, if you can pass the physical exam we require, you’re hired. We can always use another body around here.” The man passed the exam and remained an employee for 36 years. During his days at the 595 Aldine property, he attended training sessions in the rebuild room area where “each tech gathering a ‘bolt bucket’ to sit on if the better sitting spots were already taken.” Lunch breaks were taken on the grassy area to the east side of the building, beside the front offices.

On October 12, 1969, Cummins employees moved out of the building to their new location at 2690 Cleveland Avenue in Roseville. Remembering his time at 595 Aldine, the employee said “They were fine people. There was a brotherhood of such amongst us that was similar to the military. If you were a CDSI man, you had friends who were there for you. And that meant something to me being a young guy from another state.”42 The property was purchased by MacQueen Equipment in October 1969. MacQueen Equipment, Inc. was born in 1961 when Jack MacQueen, a St. Louis County engineer, acquired the Elgin product line and began selling its street sweepers. William J. Seivert and Harold J. Garber purchased the company from MacQueen in 1967. When MacQueen Equipment, Inc. opened for business it consisted of a staff of three: one salesman, one mechanic, and a receptionist. MacQueen remained active on the company’s sales force, while Seivert served as its president and Garber its secretary-treasurer. MacQueen provided service for two products – Elgin Street Sweepers and Leach Rubbish Packers.

In April 1970, MacQueen held an open house in its new St. Paul location at 595 Aldine.

Reports about the open house proclaimed that the 15,000-square-foot facility “provided ample space for the turnout of 400 guests to inspect the building and product line in the truck and equipment field.”43 According to local resident Mark Voerding, the MacQueen building was pretty much off-limits to neighborhood kids, but they would sometimes watch employees work on trucks outside. Just inside the small door on the north side of the building was a water cooler that was well known to neighborhood kids who would sneak in for a quick drink of the coldest, best-tasting water around.

Until the late 1970s, MacQueen shared 595 Aldine with Mid-America Pipe Cleaning. A review of building and electrical permits shows that MacQueen made improvements to the building in 1973 and 1979. A secondary structure along the southern edge of the property was built in 1978.44 The MacQueen company worked closely with the City of St. Paul to supply the dozens of snow plows, street sweepers, sewer cleaners, and garbage trucks needed to maintain city streets. One company brochure testified that “St. Paul has the largest fleet of Elgin Sweepers, Vactor Sewer Cleaners, and Schmidt Snow Plows in Minnesota.”45 MacQueen prided itself on being a locally oriented company where “the territory managers … live in the territories they serve, which enables them to be on hand for their customers and to have a full understanding of the demands and needs of the communities in which they live and work.”46 16

The Latest Chapter By the 2000s, the Midway area was home to a mix of businesses. Efforts to re-develop and revitalize the area began in earnest during this time. In 2007, Menards opened a new store on part of the old Transfer property. Goodwill opened a new outlet at 553 Fairview Avenue around the same time. In anticipation of a new light rail line, developers began to eye the area. Light rail construction began in 2010, greatly disrupting parking and causing many smaller businesses to suffer.

In 2014, the 11-mile light-rail passenger Green Line was finally completed, linking downtown St. Paul to downtown Minneapolis via University Avenue. Once again, transportation modes follow the pre-existing paths, and once again they are changing the neighborhood. The new light rail has revitalized stretches of University Avenue. New apartment complexes, restaurants, and shops have opened since its completion, including a new YMCA Midway in 2016.

The Midway neighborhood is about to witness another major transformation. In August 2017, plans for a $200 million, 20,000 seat soccer stadium were announced. This new field, which will be known as Allianz Field, echoes historic uses such Kittson’s racetrack and Union Park. The Minnesota United soccer team will play there, and the stadium will be part of a planned 35-acre urban village including retail, office, residential, and public open space uses.

The housing in the immediate neighborhood was primarily built in the 1940s-1960s period, and included many single-family detached homes and apartment buildings. The affordability of this housing has attracted many younger individuals and families, as well as recent migrants. The diversity of the neighborhood generally reflects the broader pattern of St. Paul, as a 2015 report documents. Around 14% of residents report as black or African-American, around 6% as Hispanic, and around 5% as Asian.47 Hamline-Midway’s median household income during that same period was $50,750, compared with $51,405 for St. Paul as a whole.48 A recent influx of immigrants from East Africa have revitalized businesses in the area.49

As the broader economy improved, so did MacQueen’s business. By the 2010s, MacQueen had around thirty-five staff working on site, including 5-6 office staff, 5-6 sales staff, and around 20-23 in parts and service. Space was too tight to support the growing business.

“We would have stayed longer if there was more room,” commented Curt Steffen. “It was hard decision to leave.” “We are a family. Everyone knows every one here. People stay here 40 years - we are a close-knit company. The building treated us well, I’m sure it will do well for Capitol Region, too.”50 In 2016, MacQueen Equipment moved into a 40,000-square-foot facility in the Beacon Bluff Industrial Park on St. Paul’s East Side. That same year, Capitol Region Watershed District purchased the 595 Aldine property. Capitol Region Watershed is renovating the building and using the opportunity to demonstrate best practices for storm-water management and other green building techniques. When the new offices open in 2018, they will become the latest caretaker of this land in the center of a prosperous American city.

An Environmental Covenant is required to be recorded with the property in favor of MPCA that restricts certain activities (mainly excavation in contaminated areas). Because a Declaration for Maintenance of Stormwater Facilities has been recorded with the property in favor of CRWD, the District must consent to this covenant. Staff have worked with the owner’s legal counsel to ensure the language and exhibits within the covenant do not unreasonably restrict any potential future maintenance of the underground infiltration system. Documents have been reviewed by Attorney Mogen.

Motion 18-038: Approve permit #18-004 Como Paving with two conditions: 1. Provide a copy of the NPDES permit 2. Revise SWPPP or erosion and sediment control plan to include the following notes: a. Infiltration perimeter control and erosion control practices shall remain in place until the final completion of the project or vegetation has been established (whichever is later). b. Installation of infiltration practices shall be done during periods of dry weather and completed before a rainfall event. Placement of engineered soils shall be on dry native soil only. c. Excavation of infiltration areas shall be completed using a backhoe with a toothed bucket. d. Native soils in infiltration areas shall be de-compacted to a minimum depth of 18 inches. e. The bottom excavation surface of infiltration areas shall be level without dips or swales.

f. During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment. g. Engineered soil shall remain uncontaminated (not mixed with other soil) before and during installation.

Permit #18-005 Higher Ground Academy (Hosch)

Ms. Hosch reviewed permit #18-005 Higher Ground Academy. The applicant, Higher Ground Academy is constructing a new school building, parking lot, and associated infrastructure. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.44 acres with .9 acres impervious surface.

Over excavation of clayey sand/fill (approximately 2 feet) may be necessary to reach desired soil type. b. Add energy dissipation such as riprap at STRM #14 where storm sewer daylights on grade in rain garden. c. Add RIM elevation to STRM #13 in storm sewer table on Sheet C3.0. The proposed HydroCAD models this grate at an elevation of 226.0’. d. Add RIM elevation to STRM #4 in storm sewer table on Sheet C3.0. e. Increase outlet diameter to a 4-inch minimum for the underground infiltration and rate control tanks to prevent clogging. f. Remove sump from STRM #3A and install another manhole between STRM #3A and the underground infiltration tank that has a 4’ sump. The drainage area to the inflow pipe before a sump shall be at least three times greater than the drainage area to the grate above per the Minnesota Stormwater Manual. The proposed sump in STRM #3A receives a majority of flow through above grate. g. Add elevations for each terrace contour shown in rain garden cross-section on Detail 8 on Sheet C5.0 in plans.

6. Revise HydroCAD to address the following: a. Use MSE 24-hr Storm Curve 3 rainfall distribution. b. Model exfiltration for 1P (underground infiltration system) and 2P (rain garden) at a rate of 0.8 in/hr. Soil borings ST-1 and ST-3 indicate poorly graded sand (SP) under each system, which has an associated design infiltration rate of 0.8 in/hr according to the Minnesota Stormwater Manual. c. Model rain garden storage (2P) as custom storage data to more accurately reflect the vertical terraced steps shown in Detail 8 on Sheet C5.0 in plans.

7. Revise model or plans to correspond: a. 1P (Underground Infiltration System): i. Invert elevation for 48” CMP is 221.33’ in HydroCAD and 221.5’ on Detail 9 on Sheet C5.0 in plans.

During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment. g. Engineered soil shall remain uncontaminated (not mixed with other soil) before and during installation.

Approve Application for MN GreenCorps Member (Bromelkamp)

Ms. Bromelkamp reviewed the Minnesota GreenCorps is a statewide program designed to help preserve and protect Minnesota’s environment while training a new generation of environmental professionals. This program places AmeriCorps members with local governments, educational institutions, and non-profit organizations around Minnesota, where they will serve for 11 months on focused environmental projects. The program is coordinated by the Minnesota Pollution Control Agency and funding is provided through a grant from ServeMinnesota and the Corporation for National and Community Service.

CRWD has hosted two GreenCorps members including Kat McCarthy from 2010-2011 and Steven Yang from 2017-2018. Kat designed evaluation tools for the Stop the Rain Drain program adapted in 2012, developed roof run-off calculations for small-scale residential stormwater projects and participated in a KAP study work group for Como Lake residents. Steven Yang's year of service is underway. To date, he has completed significant updates to the District’s BMP GIS Database. He also developed a survey for Stewardship Grantees to better understand their experiences and the resources needed to maintain rain garden projects. Mr. Yang is in the process of creating maintenance materials in response survey feedback. Once completed, Education and Outreach staff will work with him to identify follow-up events such as maintenance workshops or neighborhood meet-ups.

CRWD proposes to host a GreenCorps Member for 2018-2019 under the Green Infrastructure Stormwater Track.

The GreenCorps member will be involved in three key program areas: Education and Outreach and the District's Stewardship and Partner Grant Programs. The GreenCorps Member will work closely with Education and Outreach staff to develop and/or deepen relationships with diverse communities by attending cultural and community events, developing culturally appropriate resources, and engaging community organizations and schools in hands-on learning about water resource protection. As part of this work, the member will coordinate with Stewardship Grant Program staff and community organizations to identify potential locations for stormwater Best Management Practices. These projects will serve as demonstration sites for the larger community. Partner Grantees represent environmental, arts and other community organizations working with diverse populations to raise awareness about the importance of protecting our lakes and rivers and how to reduce pollution flowing into them. Partnership building will begin with Partner Grantees in an effort to deepen these relationships, many of which are focused on introducing youth of color to environmental careers.

Motion 18-042: Adopt a resolution supporting a Minnesota GreenCorps Host Site Application and authorize CRWD staff to submit the application to the Minnesota Pollution Control Agency for the 2018-2019 program year.

Unfinished Business A) Building Update (Doneux)

Administrator Doneux announced that the bond proceeds are in the bank. Confirmation has been received from the Ramsey County Attorney’s office to proceed with the construction contract. At this time CRWD is still waiting for the City of St. Paul to issue the permit. the sidewalk that are related to water. Managers liked the idea of sidewalk poems. Administrator Doneux and Ms. Sylvander have met with the building owner regarding extending the lease till December 2018.

B) Trout Brook Stormdrain Update (Fossum) Mr. Fossum provided the Board with an update on the Trout Brook repairs. The work is just getting wrapped up.

Funding for this project and the timeline have been very tight. Mr. Fossum will be returning and provide the board with a review. Manager Texer suggest a grand reopening of the park to relaunch. Manager Jones added that at the City Department workshop, discussions were related to more gatherings such as a Trout Brook relaunch. Administrator Doneux suggested that CRWD should look at leading projects in the future. Managers agreed.

Background The CRWD Stewardship Grant program offers financial and technical assistance to property owners interested in implementing stormwater BMPs on their property. Funding for these projects is based on the estimated BMP performance in terms of runoff volume and pollution reduction. Since 2014, grant awards for projects have been determined by our Stewardship Grant Calculator. Beginning in January of 2018, CRWD and Ramsey Conservation District (RCD) staff have been reviewing the Stewardship Grant program to identify potential improvements.

Issues Two facets of the Stewardship Grant Program have been identified for updates including the Stewardship Grant Calculator and grant award policies.

Stewardship Grant Calculator updates include: 1. Update base award rates in the Stewardship Grant Calculator using the average cost per pound of TP and TSS for a typical curb-cut rain garden. Additionally, the base award will be adjusted based on the percent of annual rainfall treated by the BMP (currently uses percent of the 1.1” rainfall event).

2. Incorporate additional treatment practices in the grant calculator for rainwater harvesting and reuse, filtration practices and conversion of impervious areas to pervious areas. a) The rainwater harvesting and reuse grant award will include rates for water conservation ($0.50 per gallon of water saved per year) plus the water quality award per the grant calculator. b) Base awards for filtration practices will be adjusted using the filtration credit approach established in CRWD rules: 55% adjustment for standard filtration and 80% adjustment for enhanced filtration. c) A rate of $1.85 per square foot of impervious surface converted to pervious surface is recommended. This reflects the rate of treating directly connected impervious minus the rate for treating turf area. The grant award would be further adjusted by crediting the conversion with 0.25” rainfall treatment for conversion to turf and 0.4” rainfall treatment for conversion to native plantings.

The enclosed table presents previous and proposed grant calculator rates and adjustments.

The policies for Stewardship Grant awards have been updated to clarify CRWD’s approach to estimating the grant award, match requirements for grantees, and maximum grant award per applicant. See the enclosed draft revised Stewardship Grant Policies document.

Enclosure 2 Stewardship Grant Policies CRWD STEWARDSHIP GRANT PROGRAM GRANT AWARD POLICIES - DRAFT MARCH 20, 2018 Grant Award Calculation CRWD calculates grant awards for water quality improvement projects using a performance-based grant calculator.

Match Requirement A match equal to at least 5% of the amount of CRWD’s grant, and RCD’s grant if applicable, is required from homeowners, public agencies and non-profit organizations.

A match equal to at least 25% of the amount of CRWD’s grant, and RCD’s grant if applicable, is required from businesses and other for-profit organizations. [NZ6] Match can be in the form of cash (purchase of labor/materials).

Maximum Grant Award The maximum grant awarded for any Stewardship Grant Project regardless of grantee type is $40,000, unless otherwise authorized by CRWD Board of Managers. Overview

Capitol Region Watershed District (CRWD) covers areas of Saint Paul, Roseville, Falcon Heights, Lauderdale and Maplewood. The area is highly developed -- about 42% impervious surfaces like streets and parking lots – so CRWD offers financial assistance to encourage private and public landowners to install clean water projects that protect and improve the Mississippi River as well as lakes and streams within the district. This program promotes water quality improvement by focusing on the reduction of phosphorus, sediment and the overall volume of stormwater runoff leading to lakes and rivers.

Grant Eligibility

CRWD partners with Ramsey Conservation District (RCD) to provide technical assistance to landowners interested in implementing water quality improvement projects on their property. To determine if you are eligible, contact CRWD at (651) 644-8888. CRWD may provide a free site visit and develop a Clean Water Plan that identifies water quality improvement projects for your property. Project information is available to help you complete projects, and reimbursement funding may be available.

Grant Award Calculation

The Stewardship Grant Program focuses on projects that reduce the amount of phosphorus and sediment in stormwater runoff as well as reducing the overall volume of runoff. Projects will be reviewed by CRWD and RCD staff to determine grant eligibility and reimbursement amount.

Grant reimbursement rates are calculated using a performance-based model. The more runoff treated by the project, the more funding it will receive. A maximum award amount is based on the typical cost for similar projects. CRWD reserves the right to modify these rates on a case-by-case basis.

Eligible Practices and Effective Life

Project eligibility will be determined by CRWD and RCD staff. Projects required by a CRWD, City or other permit or to correct a violation of CRWD Rules are not eligible for funding.

This is only a partial list of potentially eligible BMPs. For BMPs not listed below, the effective life will be determined on a case-by-case basis in consultation between CRWD and RCD technical staff. CRWD encourages landowners to maintain publicly funded BMPs in perpetuity. However, the “Effective Life” listed below is the minimum number of years that the CRWD requires a landowner to maintain the BMP in exchange for public funding of the project.

Proposal Review Schedule

Stewardship Grant awards are allocated based on the water quality benefits provided by each Stormwater Best Management Practice (BMPs). Projects that capture runoff from streets (curb cut rain gardens), parking lots, or other larger impervious surfaces receive higher awards due to their higher water quality benefits. These projects could potentially receive up to 100% of the total project costs in addition to free design services. On the other hand, projects that have a small impact in reducing stormwater volume and pollutants receive a lower grant award, or in some cases these projects may not qualify for Stewardship Grant funds. Regardless of size or benefits of the project, CRWD provides free site visits and technical resources to all grant applicants.

Applications may be submitted year-round. Typically applicants will be notified of CRWD’s decision regarding their application within 10 business days.

Grant Agreement & Amendments

The Contract will be executed by CRWD upon approval by CRWD Administrator. Any amendment to the Contract terms shall be approved by CRWD Administrator and must be by mutual written agreement signed by all parties to the original contract.

Operation & Maintenance Agreement

To ensure that the expected operational life of a BMP is achieved, an Operation & Maintenance Agreement is incorporated into the contract specific to the practice receiving grant funds. Project maintenance is the sole responsibility of the applicant. CRWD will not accept any maintenance responsibility. By signing the contract, the applicant agrees to the terms of the maintenance agreement attached to the contract as Exhibit B.

10. Cost Estimates & Contractor Bids Agreements will be accompanied by a CRWD approved cost estimate, typically prepared by RCD. The cost estimate should be divided into materials and labor and will be used to determine a maximum grant amount. Applicants are encouraged to solicit, receive and submit at least two bids to CRWD for any contracted labor associated with the project. Aesthetic components of the project not approved by CRWD and maintenance costs are not eligible expenses for reimbursement.

11. Payment Payments are reimbursement based and applicants must have an approved and fully executed grant agreement prior to beginning work in order to be eligible for reimbursement. After project completion, applicants must submit project photos along with a CRWD Voucher and Practice Certification Summary Form and copies of paid invoices and receipts. Staff of CRWD or RCD must inspect and certify that the project was completed according to the approved design standards, specifications and pollution reduction values. All claimed expenses will be reviewed and verified by CRWD staff as eligible, practical and reasonable. CRWD reserves the right to make adjustments to the costs submitted for reimbursement based on this review.

12. Schedule

Project installation must be started and completed by the dates identified in the Grant Assistance Contract. If the starting date is not met, the contract is automatically terminated upon that date and the applicant will need to reapply for funding. Additionally, applicants must not begin project installation prior to funding approval by CRWD. Any work completed prior to CRWD approval is at the applicant’s own expense and may not be eligible for grant reimbursement. CRWD reserves the right to withdraw project funding at its discretion if the project is not completed by the date identified in the Grant Assistance Contract unless a written contract amendment to reschedule the work and funding is executed in accordance with Section 8 above.

13. Conformance to Guidelines CRWD reserves the right to withdraw funding for any project not completed in accordance with these guidelines or the terms of its executed Grant Contract. It is the applicant’s sole responsibility to acquire any/all required permits and approvals prior to commencement of their project, though CRWD may be able to assist.

14. Submitted Information Any submitted information, including but not limited to applications, conceptual designs, contractor bids, cost estimates, final designs and specifications, copies of permits and proof of expenditures becomes part of the public record.

The Minnesota Landscape Association (MNLA) Headquarters is located at 1813 Lexington Ave North, Roseville (map attached). The proposed project will provide landscape industry professionals a learning environment to experience state-of-the-art stormwater management and green infrastructure practices (Renderings attached). Industry professionals and community organizations alike will have access to the amenities of this site for hosting meetings, educational events and potential clients. Enhanced educational signage is being developed to fully illustrate all of the green infrastructure components on site. MNLA Executive Director, Cassie Larson, has stated “we see this as an excellent ongoing opportunity for partnership and education with local water quality organizations.” (MNLA Executive Director Cover Letter enclosed).

CRWD and RCD have provided watershed analysis and construction plan review of MNLA’s Raingarden and Water Reuse project for their headquarters. The enclosed project plan proposes two rain gardens with curb-cuts, pre-treatment devices and underdrains. The rain gardens are sized to capture and infiltrate 1.1” rain events from the MNLA rooftop, parking lot and the public right-of-way along Lexington Ave and Garden Street. The site plan also includes an innovative underground 6,000-gallon cistern with a reuse system designed for irrigation of the diverse demonstration plantings located throughout the proposed grounds. The reuse system will capture 48,877 gallons of water annually for a 42% reduction in potable water use for the irrigation system. It will also provide a 100% annual stormwater volume reduction from the roof since overflow will be directed to the rain gardens. The harvest and reuse system will include water-efficient components from each of four major manufacturers. The system will be fully computerized and managed using weather, communication and scheduling technology that far exceeds conventional SMART control systems. This system is designed to offer scientists, students and observers an enhanced educational experience with data analysis and cutting-edge technology.

The cost estimate for this project is $183,000. Staff have estimated a total CRWD grant of $62,000. The rainwater harvesting and reuse system would be eligible for $26,000 based on the new grant rate of $0.50 per gallon saved per year, plus awards for water quality and education/visibility. The $36,000 grant award covering the two large rain gardens was estimated using our Stewardship Grant Calculator.

September 22, 2017 Attn: Andrew Novak Captial Region Watershed District 1410 Energy Park Dr. Saint Paul, MN 55108 To the Staff and Board of the Capital Region Watershed District, The Minnesota Nursery & Landscape Association (MNLA) is requesting grant funding to assist with the improvement of the landscape around the MNLA office building located at 1813 Lexington Ave N, Roseville, MN 55113. The project will create a highly functional, inspirational, and sustainable space. The office landscape will be a destination where MNLA companies can send new or existing clients to see elements that could be incorporated into their own yard/property. It will also serve as a setting for MNLA to hold educational workshops for the industry and increase industry knowledge about horticultural/landscape topics. We see this as an excellent ongoing opportunity for partnership and education with local water quality organizations.

A key piece of this project will be incorporating stormwater infiltration and water capture and re-use and educating both green industry professionals and consumers about the importance of these practices. This project is a unique opportunity for industry to partner with the association to create both a showcase and educational space. To that end, MNLA will leverage its relationships with industry suppliers and purchase materials directly.

Those materials will be provided to the selected contractor, Margolis Co. & Landscape Renovations, who will be paid for installation services of materials provided. Likewise, Water in Motion will be installing a state of the art water harvesting and irrigation re-use system. The cost for the overall project is estimated at approximately $647,000 with $104,162.00 (including materials and labor) allocated for stormwater management In addition, there is $107,575.00 in value associated with the water harvest and re-use system. Please see the attached spreadsheets which respectively show the material costs, labor costs, as well as the total estimated cost of the water harvesting and re-use system. We are requesting the highest possible amount of grant funding to assist with this effort to offset those costs and enable the completion of this project.

Background The Board of Water and Soil Resources (BWSR) issues grants to local units of government under Minnesota Statutes 103B.3369. These appropriations primarily include General Funds and Clean Water Funds. The purpose of BWSR Biennial Budget Request (BBR) is to provide information to BWSR about the scope and scale of future funding needs from local units of government.

BWSR will use information gathered through the BBR process to: • • •

Serve as the basis for budget requests made to the Governor and Legislature, Support grant-making decisions following enactment of appropriations; Serve as the soil and water conservation district annual plan of work for program and operations grants and as the Allocation and Contribution Statement for the Natural Resources Block Grant; Encourage improved local government water quality project planning; and Improve coordination of State funds used by local governments for project and activity implementation.

Issues Staff will prepare and submit a BBR by the April 12, 2018 deadline. The BBR will include projects detailed in the District’s Watershed Management Plan as well as other planned projects beyond 2020.

The monthly lease rate for 2018 would be increased to unchanged at $5,008.17 (plus operating costs~$4,000/month).

SEVENTH AMENDMENT TO LEASE This Seventh Amendment to Lease (“Seventh Amendment”) is made as of this ______ day of April, 2018 (the “Seventh Amendment Effective Date”), by and between 1400-1410 Energy Park Drive, LLC, a Minnesota limited liability company and Assignee of Slate Energy Park Holdings, LLC (“Landlord”) and Capitol Region Watershed District (“Tenant”).

RECITALS WHEREAS, Landlord’s predecessor-in-interest and Tenant executed a Lease Agreement dated June 3, 2004 (“Original Lease”) for certain premises located at the Plaza Tech Center consisting of 3,586 rentable square feet at the building commonly known as “Energy Park Plaza Tech” located at 1410 Energy Park Drive, Saint Paul, Minnesota 55108 (“Building”); WHEREAS, Landlord’s predecessor-in-interest and Tenant executed a First Lease Amendment dated September 15, 2006 (“First Amendment’) which expanded the space to approximately 5,792 square feet (“Premises”), extended the Original Lease Term and modified certain other terms of the Original Lease; WHEREAS, Landlord and Tenant executed a Second Lease Amendment dated March 30, 2012 (“Second Amendment”) which again extended the Term and modified certain other terms of the Original Lease and First Amendment; WHEREAS, Landlord and Tenant executed a Third Lease Amendment dated September 8, 2014 (“Third Amendment”) which extended the Term to March 31, 2016, provide for an Option to Renew and modified certain other terms of the Lease. The Original Lease, First Amendment, Second Amendment, and Third Amendment are collectively referred to herein as the “Lease”; WHEREAS, Landlord and Tenant executed a Fourth Lease Amendment dated July 30th, 2015 (“Fourth Amendment”) which expanded the space to approximately 7960 square feet and extended the Term to March 31, 2017, provided for an Option to Renew and modified certain other terms of the Lease. The Original Lease, First Amendment, Second Amendment, Third Amendment and Fourth Amendment are collectively referred to herein as the “Lease”; WHEREAS, Landlord and Tenant executed a Fifth Lease Amendment dated March 30, 2016 (“Fifth Amendment”) which again extended the Term and modified certain other terms of the Original Lease, First Amendment, Second Amendment, Third Amendment and Fourth Amendment; WHEREAS, Landlord and Tenant executed a Sixth Lease Amendment dated August 16, 2017 (“Sixth Amendment”) which again extended the Term and modified certain other terms of the Original Lease, First Amendment, Second Amendment, Third Amendment, Fourth Amendment and Fifth Amendment; WHEREAS, Landlord and Tenant desire to modify and supplement the Lease by extending the Lease Term and modifying certain other terms of the Lease; NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. Interpretation of Amendment. The Lease is hereby modified and supplemented as of the Seventh Amendment Effective Date. Wherever there exists a conflict between this Seventh Amendment and the Lease, the provisions of this Seventh Amendment shall control. Unless 1

otherwise indicated, defined terms shall have the definitions set forth in the Lease. Except as modified and supplemented herein, the Lease is in full force and effect.

2. Extension of the Lease Term. Landlord and Tenant agree to extend the Lease Term for an additional period of six (6) months commencing August 1, 2018 (the “Seventh Amendment Commencement Date”) and continuing through and including December 31, 2018 (the “Seventh Amendment Expiration Date”). The period commencing on the Seventh Amendment Commencement Date and continuing through the Seventh Amendment Expiration Date is hereinafter referred to as the “New Term”.

3. Base Rent. Base Rent payable for the Premises shall be as follows: Period Monthly Base Rent July 1, 2018 – December 31, 2018 $ 5,008.17 ($7.55 RSF) 4. Operating Costs. In addition to the Base Rent payments outlined above, Tenant will continue to pay its pro rata share of “Operating Costs” for the Premises.

5. Improvements to the Space. None.

6. Option to Renew. Tenant is not granted an option to renew.

7. Brokers. Tenant represent and warrants to Landlord that it has not dealt with any broker in connection with this Seventh Amendment and hereby indemnifies and holds Landlord harmless from any and all losses, liability, costs or expenses (including attorney fees) incurred as a result of any breach of the foregoing warranty.

8. Entire Agreement. This Seventh Amendment sets forth the entire agreement with respect to the matters set forth herein. No modification, supplementation or amendment to the Lease or this Seventh Amendment shall be effective unless made by written agreement between the Landlord and Tenant.

9. Counterparts. This Seventh Amendment may be executed in any number of counterparts, any one of which shall be an original, but all of which together shall be one and the same instrument.

IN WITNESS, WHEREOF, this Seventh Amendment is executed as of the Seventh Amendment Effective Date.

Background Staff have been involved in several Metro wide watershed based initiatives. These will be topics at the April Metro MAWD meeting so it is important that staff provide and update and background to these different agency and legislative issues.

Issues Metro WRAPS - Cycle II The MPCA is working towards rolling out the second round of monitoring and WRAPS for the Metro area. This has little to no effect on CRWD but the Board should be aware of this larger MPCA effort both in the Metro and statewide.

Watershed Based Funding – Ramsey County In December of 2017 the BWSR Board approved $5.9 million for Watershed Based funding in the Metro. $442,000 has been allocated for Ramsey County. Staff will review how this pilot program is working and how the funding is proposed for Ramsey County.

Coordinated Watershed Management legislation As a follow up to the CRWD resolution to MAWD last year, legislation is moving forward to help better coordinate watershed management statewide. Staff will provide an update on the legislation and how it may affect CRWD and other watershed districts.

Water Reuse Report MAWD and CRWD were very active in reviewing and commenting on the draft Water Reuse report that was issued in 2017. The State has issued the final report and staff will review what changed in the report and how the report responded to MAWD and CRWD comments.

Master Water Stewards are encouraged to attend as support staff.

We need Master Water Stewards on hand at this event to serve as field helpers. Como neighbors will attend a rain garden workshop presentation and then walk the neighborhood scouting out potential boulevard rain garden sites around Como Lake.
