RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.

ďƒ˜ Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1 inch of rainfall over the impervious surfaces of the development. a. RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted and satisfies NPDES requirements.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard ďƒ˜ Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

The Board of Managers established a plan of work for the upcoming year, established a budget based upon the work plan, and established a levy for the budget.

Administrator Doneux reviewed the draft budget with the Board of Managers. Administrator Doneux also reviewed the expenditure, revenue and levy summary. The Board must also approve the budget for public comment and set the public hearing for 6:00 PM on August 17th.

President Joe Collins opened the meeting at 6:00 p.m. and asked for any additions or changes to the agenda. Mr. Fossum requested the addition of Action Item E to Authorize the Administrator to contract for the due diligence of 595 Aldine St. and 1736 Thomas Avenue not to exceed $50,000.

Ms. Wasley shared with the Board of Managers that the Ramsey Conservation District will be having their annual tour on September 7th from 1:00-3:00. Please watch your email for details.

Permit Applications and Program Updates A)

16-016 Willow Reserve Development 60-day Renewal Request (Hosch)

Mr. Kelley reviewed that the applicant has requested the review period be extended. Plan adjustments and remodeling are taking longer than anticipated.

Motion 16-190: Approve the 60-day review period extension for permit 16-016 Willow Reserve Development to expire October 7, 2016.

16-017 Rivoli Bluff Redevelopment (Kelley)

Mr. Kelley reviewed permit #16-017 Rivoli Bluff Redevelopment. The applicant, Daytons Bluff Neighborhood Housing, plan to develop seven single family residential homes. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D) and Erosion and Sediment Control (Rule F).

The disturbed area of this project is 1 acre with 0.36 acres impervious surface.

Motion 16-191: Approve the variance of freeboard requirements of Flood Control Rude D. Thienes/Reider Unanimously approved Motion 16-192: Approve the permit with 3 conditions: 1. Provide soil borings at the location and extending at least five feet below the bottom elevation of each rain garden.

2. Demonstrate maintenance access for stormwater practices.

3. Revise the HydroCAD model or plans to correspond. Re-route Subwatershed 10S. The subwatershed is routed to Link 5L, but should be routed to Pond 13P. Thienes/Reider Unanimously approved Manager Texer asked who would be liable for basement flooding for this development. Mr. Kelley replied it would most likely be the Engineer of the development, and felt that would be a good question for legal counsel to review.

IV.

Special Reports – Ford Site Sustainable Stormwater Analysis, Bob Fossum

Mr. Fossum reviewed that at the March 2, 2016 Board meeting, the Managers approved the Phase 3 for $36,000. At the February 3, 2016 Board meeting the Managers reviewed a first draft of the Ford Site Sustainable Stormwater Analysis The Ford Site Sustainable Stormwater analysis evaluates the costs and benefits associated with two stormwater management scenarios to inform decision making relative to the City of St. Paul’s Public Realm and Infrastructure Plan for the Ford Site. The two stormwater management scenarios to be analyzed are: 1. Baseline or conventional; and 2. Centralized or Hidden Falls Headwaters. A key component of the analysis was to monetize ALL of the costs and benefits of each scenario. Barr Engineering has completed a final draft of the report based on previous review and input from all stakeholders. Mr. Fossum reviewed the draft report with the Managers and recommend approval.

Authorize Grant Application for Eustis Street/Lauderdale Project (Eleria)

Mr. Fossum shared with the Board of Managers that starting in late 2014, CRWD, in partnership with City of Lauderdale and Ramsey County, evaluated opportunities for managing stormwater runoff in a portion of the City of Lauderdale. Originally the focus of the project was to evaluate the feasibility of implementing green infrastructure practices along Eustis Street south of Larpenteur Avenue and within an adjacent County-held drainage easement.

Based on further discussions with project partners and the private property owner during that evaluation, localized flooding concerns were raised and the project scope was expanded to include a regional subwatershed analysis of the hydrologic and water quality concerns within approximately 150 acres and identification of potential flood mitigation and water quality improvement solutions. The results of this study were presented at a Board meeting this past spring. Upon request, staff can provide the subwatershed analysis report.

CRWD staff seek to submit a Clean Water Fund grant application for modifications to Seminary Pond in Lauderdale. Improvements to the pond include converting it from a dry pond to a wet pond by regrading and raising its berm and installing an iron-enhanced sand filter. These changes are estimated to provide flood control up to 10-year storm event and increase sediment and phosphorus removal by approximately 54% and 41%, respectively. In addition, a boulevard rain garden would be included in the grant application to treat an area that does not drain to Seminary Pond. The conceptual level estimated cost of these BMPs is $530,000, which includes engineering, construction and 30% contingency.

Motion 16-195: Authorize staff to submit a FY 2017 Clean Water Fund grant application for Lauderdale Stormwater Improvement Project.

Authorize Request for Proposals for Lake McCarrons AIS Plan (Fossum)

“Our mission is to protect, manage, and improve the water resources of the Capitol Region Watershed District.�

In 2014 and 2015, the District participated aquatic plant harvesting in Lake McCarrons. The harvesting was focused on the west end of the lake and was primarily done to provide access lanes from docks to open water. In 2016, the District decided not to participate in harvesting.

During the District’s work on harvesting aquatic plants it became apparent that aquatic invasive species (AIS) are an important consideration when considering active management of all biota in the lake.

Aquatic invasive species continue to be a concern and potential threat to all lakes in CRWD. As the only lake with a public boat launch, Lake McCarrons is likely the most prone to introduction of aquatic invasive species. President Collins asked Manager Thienes if neighbors of Lake McCarron’s are aware. Manager Thienes replied that neighbors have shared concerns regarding the weed control in Lake McCarron.

Approve Como In-Lake Analysis Work Plan (Fossum)

Mr. Fossum reviewed that at the June 1, 2016 Board meeting the Managers authorized distribution of a Request for Qualifications (RFQ) for the Como Lake Data Analysis Project. In June 2016, staff solicited and reviewed Statements of Qualifications (SOQs) from 3 firms relative to in-lake management experience.

At the July 6th Board meeting the Managers approved the selection of LimnoTech for the Como Lake Water Quality Drivers Analysis Project and authorize staff to negotiate a detailed scope and budget with LimnoTech for subsequent contract approval by the Board of Managers Staff have worked with LimnoTech staff to develop a scope of work, budget, and schedule for the Como Lake Water Quality Drivers Analysis Project.

Motion 16-197: Approve scope of work and budget for the Como Lake In-Lake Analysis Project; and authorize Administrator to execute a consultant services agreement with LimnoTech for an amount not to exceed $82,000.

Mr. Fossom in place of Administrator Doneux shared with the Board of Managers that at the July 20th meeting, the Board of Managers approved of purchase of 595 Aldine St. and 1736 Thomas Ave. and authorize Board President to execute purchase agreement.

The Purchase Agreement allows for a 120-day due diligence period. Closing must occur within 60 days following the end of the due diligence period. On July 27th Administrator Doneux received a variety of documents relating to the properties. Given the tight time frame of 120 days, Administrator Doneux is seeking authorization to engage the necessary consultants, contractors, inspectors etc. to ensure a thorough and timely review of the property. Administrator Doneux is also seeking authorization to distribute a request for qualifications for architectural services. Administrator Doneux will ask the Building Committee to review the architectural services submittals and make a recommendation to the full board in the future.

Unfinished Business A) FI: McMurray Field Stormwater Diversion Project Update

Mr. Kelley provided the Board of Managers with an update on the McMurray Field Stormwater Diversion and BMP Feasibility Study. The St. Paul Parks Department plans to reconstruct the roads surrounding the McMurray Athletic Fields complex. Staff met with Parks design staff multiple times to discuss the project, and the potential to combine the street reconstruction with a regional stormwater BMP to protect Como Lake as identified in the Como-3 Subwatershed study. It was determined that the timing of the two projects would not allow concurrent construction, but that design of some infrastructure elements should be pursued for construction with the street project. CRWD retained SRF Consulting to complete a feasibility study and final design for the diversion.

Plans and specifications for a diversion structure and associated piping to bring stormwater runoff from the 48” pipe beneath Lexington Parkway to a future BMP below the softball fields were incorporated in the City’s plans as an addendum to bidders. Bids were opened July 20th, and Carl Bolander and Sons was the apparent low bidder. The bid costs associated with the diversion total $80,605.80 The diversion infrastructure is above and beyond the scope St. Paul Parks and Recreation’s project, and a letter has been submitted requesting reimbursement for the construction costs. Staff support the request and would seek to work with St. Paul Parks and Recreation to create a cooperative construction agreement to lay out the details if this cost share. Contribution of all partner funding will be tracked for future determination of potential stormwater credits for the completed stormwater project.

Background In June, CRWD’s Board of Managers authorized solicitation of bids for the TBI Repair Project from Station 0+00 to 28+49. The repair project will address the missing mortar between the limestone blocks as well as other defects in the tunnel. In the first 2,000 feet of TBI, the gaps between the limestone blocks will be filled in with mortar. A 12-inch thick reinforced concrete liner will be installed in 200 feet of TBI located beneath the railroad tracks. For the last 300 feet of TBI, mortar replacement or 2-inch thick concrete liner repairs were being considered. The engineer’s estimate for construction costs ranged from $1.1 – $1.3 million.

Issues Bidding for the project extended over a three-week period from July 12 to August 4, 2016. CRWD received base bids from three contractors: 1) PCI Roads - $1,679,300; 2) Lametti & Sons, Inc. - $2,100,750; and 3) ECI $1,195,375. CRWD also sought quotes for an alternative repair for the last 300 feet of TBI - 2-inch thick concrete liner in lieu of mortar repair. ECI’s estimated cost of the alternative repair is $25,430. The mortar repair will restore the original integrity of the TBI joints while the liner repair may improve the structural integrity of this section of TBI. See the attached letter from Barr regarding the review of TBI bids.

Based on the lowest bid from ECI and their successful tunnel repair projects in the Twin Cities, CRWD staff recommends the Board award the project to ECI and select the bid alternate item (2-inch concrete liner) for the last 300 feet of TBI. The total bid amount is $1,220,805.

Action Requested 1) Order the TBI repairs from Station 0+00 to 28+49.

2) Authorize the Board President and Administrator to execute a Notice of Award and an Agreement with ECI for the Trout Brook Repair Project Station 0+00 to 28+49 subject to the review and approval of the Ramsey County Attorney; and authorize the Administrator to execute change orders in an amount not to exceed $61,000. enc:

Background In 2014, the Citizen Advisory Committee (CAC) adopted the CRWD Watershed Steward Award Program to recognize residents and partners of the District for exemplary stewardship activities and projects. The committee developed five award categories including the Watershed Citizen, Watershed Partner, Young Watershed Steward, Watershed Project, and Lifetime Stewardship Awards. The program was promoted by CRWD staff, Board and CAC members. Staff received 15 nominations in 2015. Awards were presented at the 2015 Annual Meeting on December 16, 2015.

Issues At the August 10 CAC meeting the committee supported the continuation of the Watershed Steward Award Program in 2016. Below is a proposed timeline for review and comment.

Capitol Region Watershed Steward Award Program Overview The Watershed Steward Award Program honors individuals and organizations that exemplify watershed stewardship through activities or projects that demonstrate a commitment to CRWD’s mission to “protect, manage and improve water resources of Capitol Region Watershed District.”

The awards are given annually through an open process during the fall. Nominees may be anyone who lives or works within CRWD’s boundaries. Recipients are selected by a committee of CRWD Board Managers, Citizen Advisory Committee (CAC) members, and staff. Final recommendations are endorsed by the CAC in October and sent to the Board for approval in November. Awards are presented at the CRWD Annual Meeting which is usually held in December.

Lifetime Stewardship Award: Given to an individual who has, during his or her lifetime, played a significant leadership role in the stewardship of CRWD’s water resources.

The following guidelines apply: 1. No more than one award will be given annually in each category.

2. Awards will only be granted when eligible nominations are received.

3. Awards will not be given to nominees that are simply complying with CRWD requirements.

4. Current members of the CAC, Board or staff are not eligible to receive awards.

5. Award winners will receive a plaque or framed certificate that includes their name, CRWD’s logo and the award category.

Background In September 2014, the CRWD Board approved a Memorandum of Understanding (MOU) with the City of St. Paul Parks and Public Works Departments to develop a stormwater management master plan for Como Regional Park. The MOU outlined shared goals of intentional management of stormwater as a resource, and protection of the water resources within Como Park. Subjects that must be addressed include an inventory of existing conditions, and development of a 10-20 year stormwater plan. In January 2016, the stormwater inventory was completed by Houston Engineering. CRWD and the City are now prepared to begin developing the stormwater plan.

Issues A stormwater master plan for Como Park will result in identifying cost-effective BMP implementation strategies within the park. The plan will assess future treatment needs within the park based on planned projects and City/CRWD rules, and establish goals for stormwater treatment that achieve TMDL load reduction requirements. The plan will also Priority areas for treatment within the park will be established, and potential project sequencing scenarios will be analyzed to assist with implementation planning.

Because sequencing of park improvements and BMPs to treat them could present regulatory challenges, the plan will develop policies that addresses stormwater treatment requirements and the need for strategic project implementation.

Houston Engineering has prepared the enclosed proposal for developing the stormwater master plan, which is estimated to cost $47,110. CRWD and City staff have reviewed this proposal and recommend approval. The 2016 budget for this project is $49,240 from fund #305 â&#x20AC;&#x201C; Como Lake Subwatershed.

Requested Action Approve consultant services agreement with Houston Engineering for the Como Regional Park Stormwater Management Plan for an amount not to exceed $47,110, and authorize the Administrator to execute the agreement and change orders not to exceed $5,000. enc:

Background The Willow Reserve Ecological Restoration Project involves work on property owned by City of Saint Paul’s Parks and Recreation and Public Works departments.

Issues Using the Highland Ravine Project license agreement with the City, CRWD staff have prepared a draft license agreement for access and implementation of the Willow Reserve Ecological Restoration Project on City parkland. The agreement has also been reviewed by the Ramsey County Attorney. The agreement grants CRWD the rights to access the property to manage invasive species, remove undesirable trees, and restore native vegetation as outlined in the Willow Reserve Restoration Plan. It allows for restoration activities to occur through the end of 2019. The draft agreement has been sent to the City for review.

LICENSE AGREEMENT

This License Agreement is entered into this _____ day of ___________, 2016 between the City of Saint Paul, a municipal corporation, through its Departments of Parks and Recreation and Public Works, 400 City Hall Annex, 25 W. Fourth Street, Saint Paul, Minnesota, 55102 (“Licensor”) and Capitol Region Watershed District, 1410 Energy Park Dr, St Paul, MN 55108 (“Licensee”).

WITNESSETH:

WHEREAS, the Licensee wishes to perform work on land which is owned by the City of Saint Paul Departments of Parks and Recreation and Public Works, which will consist of tree removal, invasive species management, and native plant establishment, and needs to enter onto said park property for access purposes.

WHEREAS, the Licensor is willing to grant access to the park property and to allow the proposed work to be done under the terms and conditions set forth herein.

Now, therefore, in consideration of the mutual covenants and promises herein, Licensor and Licensee agree as follows: 1.

Premises described: The Licensor grants access to the property described as Willow Reserve, as set forth on Exhibit A, attached hereto and incorporated herein by reference.

2.

Term of License: Licensee may have access to the property from September 1, 2016 until December 31, 2019, unless extended by mutual agreement for a defined period, with written confirmation signed by both parties.

3.

Use of Premises: Licensee will access the premises for the purpose of performing ecological restoration. CRWD will remove select, undesirable trees, eradicate invasive vegetation such as reed canary grass and hybrid cattails, and establish new native vegetation. The planned work may include the use of heavy equipment as needed to perform said work. Storage of equipment, machinery, materials and supplies is permitted overnight. No other use of the premises is permitted

Licensee must provide plans of the proposed work for approval by the Department of Parks and Recreation before performing any work under this License.

Payment: The Licensor shall bear all costs related to the planning and implementation of tree removal activities associated with stormwater and sanitary sewer infrastructure. The Licensee shall bear all other costs associated with the Permitted Use, which shall include 1

all work performed to conduct the ecological restoration, and any other associated costs of the requirement of this License.

5.

Assignment/Subleasing: Licensee shall not transfer nor assign its rights hereunder or sublet any interest in the Licensed premises.

6.

Indemnification: Licensee shall protect, indemnify and hold harmless the Licensor and its employees, officers and agents, from and against any and all claims, demands and causes of action whatsoever for injury to or death of person, or loss or damage to property occurring on the premises or in any manner resulting from the Licensee’s use and occupancy of the premises.

7.

Insurance: Licensee shall provide or shall ensure that any contractors accessing the site under this License shall provide proof of comprehensive general liability insurance, including blanket contractual liability coverage and personal injury liability coverage with a combined single limit of not less than $1,500,000 aggregate, or $1,000,000 per occurrence. Such insurance shall name the Licensor as “additional insured.”

8.

Security: Licensee shall provide all security necessary pursuant to this License, including that necessary for Licensee’s vehicles, machinery, equipment, sets, facilities and supplies and Licensor shall have no liability for any injury, loss or damage arising out of Licensee’s failure to properly provide such security.

9.

Restoration of Premises: Licensee shall be responsible for the restoration of the premises at the end of the License term. This shall include removal of any temporary fencing around the area used to prevent public access to the site, restoration of vegetation, as well as any other restoration of damages caused by Licensee.

10.

Access for Subsequent Activities: Licensee may require periodic and long-term access to the site at various times in the future for maintenance and other activities. This Agreement does not provide that access, however, Licensor agrees that approval for that access will not be unreasonably withheld, and that provision for future access is necessary to approve the decision to proceed with the immediate project.

11.
