HISTORY & CONSIDERATIONS: Design shows that space available for stormwater management is disproportionately found in RWMWD as the Downtown, Mounds Boulevard, and Dayton’s Bluff areas have physical and space constraints. As such, the applicant has requested a variance for a portion of the stormwater treatment to be provided across watershed district boundaries but within the same resource drainage area (Mississippi River).

RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 500,069 ft2 (11.48 acres). b. Volume retention required: 500,069 ft2 x 1.1 inches x 1 ft/12 inches = 45,840 ft3

The applicant has not submitted money to be contributed to the Stormwater Impact Fund. e. The project is linear, but cost cap information has not been submitted.

5. Best management practices do not achieve 90% total suspended solids removal from the runoff generated on an annual basis. However, the applicant is meeting the pollutant removal requirement at an offsite location.

6. A maintenance agreement recorded with Ramsey County has not been submitted.

7. Adequate maintenance access is provided for underground systems. A site-specific plan, schedule, and narrative for maintenance of the proposed stormwater management practices has been submitted.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is floodplain on the property according to FEMA. 2. The total floodplain impact within CRWD is 0 cubic feet.

3. Compensatory storage is not needed.

4. It is unknown if all habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements. However, adequate conveyance has been provided to prevent flooding.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property within the CRWD jurisdiction.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies, and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Total disturbed area is 16.3 acres; an NPDES permit is required. A SWPPP has been submitted.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

RULE I: VARIANCES Standard  The Board of Managers shall have the power to grant variances from these Rules where they find that extraordinary and unnecessary hardships may result from strict compliance with these Rules; provided that such variances will not have the effect of nullifying the intent and purpose of these Rules and the overall plan of the District as adopted.

1. A variance has been requested from Rule C section 3.C.3.ii to use stormwater treatment provided in the Ramsey-Washington Metro Watershed District to satisfy the overall treatment requirement. a. The applicant has submitted a written request for a variance stating the exceptional conditions of the site. b. The project is linear, and spans the jurisdictional boundaries of CRWD and RWMWD c. Site constraints (limited space available in the fully urbanized downtown area, high bedrock, and utility conflicts) are not self-imposed and are beyond the applicant’s control. d. The applicant proposes to expend resources and meet the full treatment requirement. Economic consideration do not dominate the variance request. e. The variance request aligns with the intent of CRWD Rules, as treatment is still provided in full between the two watershed districts and within the same Mississippi River drainage area. f. The Ramsey-Washington Metro Watershed District and CRWD have the same Rule C stormwater requirements to verify equivalent treatments.

g. RWMWD is in agreement with this variance request and is accepting of the use of credits across district boundaries.

Remove sharp-crested weir outlet. ii. Include a 15-inch vertical orifice at an elevation of 866.79’ to correspond with the downstream invert elevation shown on Sheet 1492 in the plans. This orifice shall be routed to the 15-inch round culvert. c. Pond 28P i. Sharp-crested weir outlet shall be primary routing since it discharges concurrently with the 15-inch outlet. ii. Revise 21-inch pipe to a 15-inch vertical orifice at an elevation of 864.56’ to correspond with the downstream invert elevation shown on Sheet 1492 in the plans. d. Pond 34P i. Remove sharp-crested weir outlet. ii. Include a 15-inch vertical orifice at an elevation of 863.14’ to correspond with the downstream invert elevation shown on Sheet 1492 in the plans. This orifice shall be routed to the 21-inch round culvert.

16-027, RiverEast School – Closure (Hosch)

Ms. Hosch reviewed permit #16-027 for RiverEast School. This permit was issued for a new school building and grounds at 1055 Mackubin south of Jessamine, in St. Paul. Stormwater treatment is provided onsite with one underground infiltration system. Work is complete and the site is stable. No surety was collected for this project. St. Paul Public Schools has also requested banking of 9,668 cf of additional stormwater volume credits provided at this site, above the required 8,739 cf of volume.

President Collins asked for any questions or comments. No comments were made.

AR: Approve Preliminary 2022 Budget and Levy for Public Comment (Doneux)

Administrator Doneux stated that the Finance Committee of the Board met on June 9th to review the proposed 2022 budget and levy. The Board of Managers reviewed and discussed the 2022 budget and levy at the June 16th and July 7th Board meetings. The Board of Managers must establish a plan of work for the upcoming year, establish a budget based upon the work plan, and establish a levy for the budget.

Administrator Doneux provided a review of the expenditure, revenue, and levy summary. Administrator Doneux made note of the following changes made to the 2022 budget and levy: 1) Detailed budget worksheets were developed for each project. Several project budgets increased after the development of detailed budgets, while some decreased. These changes, in total, resulted in a net decrease in the overall budget by $283,570.

2) The 2007 Bond Repayment of $750,000 was removed from the 2022 budget.

3) Estimated 2021 expenses were adjusted based on the June 2021 Budget Report.

4) The overall tax levy was increased to 3.94% to ensure compliance with Fund Balance Policy.

Administrator Doneux provided a review of how the tax levy is calculated. President Collins provided a review of the Finance Committee’s discussions of paying off the 2007 bond. The Finance Committee proposed 6% increase in the levy pending board approval. President Collins requested Administrator Doneux provide more detail on shared/partner projects. Administrator Doneux reviewed projects totaling about 1.5 million dollars and added that about 1/3 of the capitol funds are going to other entities such as the City of Saint Paul, or the City of Roseville for water quality projects. Manager Murphy addressed concerns of the average home value rate seeming low. Discussion occurred. Manager Murphy indicated there was no levy increase for the 2021 budget. The Board must approve the budget for public comment and set the public hearing for 6:00 PM on August 18, 2021. Administrator Doneux restated approving the preliminary 2022 budget and levy with the 6% levy increase as proposed by the Finance Committee.

Unfinished Business A) Snelling Midway O & M (Kelley)

Mr. Kelley shared a review of the Allianz Field Rainwater Reuse System. The facility opened in 2019.

The building site was formerly owned by Metro Transit. The site had complications including multiple landowners, long-term leaseholders, and soil contamination. Mr. Kelley provided a review of site plans showing the comprehensive stormwater approach. Mr. Kelley provided a review of issues identified during operation of the system in 2020. Mr. Kelley also provided a review of 2021 issues. President Collins inquired about where the sediment is coming from. Mr. Kelley replied that construction is still taking place surrounding the stadium, and dust is gathering on the roof. Discussion occurred. Manager

Sullivan Janzen inquired about the costs for taking on the management. Mr. Kelley replied that CRWD has been reimbursed by the City of Saint Paul for all costs incurred by CRWD. Mr. Kelley added that the system has been running smoothly for June and July. Manager Sullivan Janzen inquired about the costs of using city water versus the reuse water. Discussion occurred.

The Board thanked Mr. Kelley for his presentation. No action was taken.

A) Board of Managers’ Updates President Collins shared he will be absent from the August 4th meeting. Administrator Doneux will also be absent. Mr. Kelley will be filling in for Administrator Doneux. Vice President Texer shared that Former MAWD Board Member Craig Leiser passed away. Mr. Leiser was the Treasurer of Brown’s Creek Watershed District, and Rotary. MAWD awarded Mr. Leiser with the Lifetime Achievement Award.

B) Administrator’s Update Administrator Doneux will be out of the office on August 4, 2021. Mr. Kelley will be filling in for Administrator Doneux at the August 4th Board Meeting. The CAC meeting will be virtual on August 11th. The annual CAC tour is being planned for Wednesday, September 8, 2021. Administrator Doneux added that the WEF Board will be touring the office on Thursday, July 22nd.

VIII. Next Meetings A) Wednesday, August 4, 2021, at 6:00 PM – Regular Board Meeting, VP Texer will lead, no workshop will be held, President Collins will be absent.

B) Wednesday, August 11, 2021, at 7:00 PM – CAC Meeting to be held virtually, President Collins and Manager Sanders both plan to attend.
