Background The City of Saint Paul Parks and Recreation Department, in partnership with the Trust for Public Land, plans on constructing a new park in the Midway neighborhood of Saint Paul in the summer of 2019.

Known as Midway Peace Park, the approximately 5-acre park is located on Griggs Street between Saint Anthony Avenue and University Avenue. The park will serve a diverse neighborhood including residents of Skyline Towers and students and faculty of Gordon Parks High School, High School of Recording Arts and Concordia College.

Issues Early in the design process, CRWD staff has worked with Parks and Recreation staff to design innovative green infrastructure practices that go above and beyond regulatory requirements. The proposed design calls for reduction of impervious area by 0.77 acres and two infiltration basins to manage and treat runoff from the park as well as 50% of the 2-acre former Central Medical Building parking lot. The City is not required to treat runoff from the south parking lot because improvements to the lot are primarily resurfacing through mill and overlay. In addition to treatment of parking lot runoff, the City is going above and above stormwater requirements by utilizing captured rainwater for a small, cascading runnel water feature in the park that will also be recirculated to provide constant flow in the runnel during daylight hours. The estimated total stormwater cost including permitted and above and beyond elements is approximately $233,000.

The City has applied for a CRWD permit and is requesting a $180,000 grant for the above and beyond stormwater aspects of the project. The 2019 budget for Midway Peace Park is $180,000 (Project #43019890). City of Saint Paul and CRWD staff will review Midway Peace Park design, CRWD stormwater requirements, the above and beyond stormwater features and grant request.

Actions Requested 1. Approve CRWD permit 19-05 Midway Peace Park with four conditions as outlined in the report 2. Approve a $180,000 grant for Midway Peace Park and authorize Board President and Administrator to execute a grant agreement subject to the review and approval by the Ramsey County Attorney. enc.

RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2‐, 10‐, and 100‐year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long‐term viability of the infiltration area.  Developments and redevelopments must incorporate effective non‐point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2‐, 10‐, and 100‐year critical storm events. Stormwater leaving the project area is not discharged into a well‐defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1‐inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 42,269 square feet. b. Volume retention required: 42,269 ft2 x 1.1 inches x 1 ft/12 inches = 3,875 ft3

6. A memorandum of agreement for maintenance of stormwater facilities exists between the City of St. Paul and the CRWD. Adequate maintenance access is provided for the infiltration basins.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100‐year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT

Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land‐disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Disturbed area is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted but is not sufficient.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 4 Conditions Conditions: 1. Provide a copy of the NPDES permit.

2. Revise plans to address the following: a. Revise erosion control plan to include specific erosion control on the perimeter of the south infiltration basin. The erosion control should limit construction activity on top of the basin to prevent sediment deposition and compaction of subsoils. b. Revise SWPPP to include the following: i. Infiltration perimeter control and erosion control practices shall remain in place until the final completion of the project or vegetation has been established (whichever is later). ii. Installation of infiltration/filtration practices shall be done during periods of dry weather and completed before a rainfall event.

Placement of engineered soils shall be on dry native soil only. iii. Excavation of infiltration areas shall be completed using a backhoe with a toothed bucket. iv. Native soils in infiltration areas shall be de‐compacted to a minimum depth of 18 inches. v. The bottom excavation surface of infiltration areas shall be level without dips or swales. vi. During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment. vii. Engineered soil shall remain uncontaminated (not mixed with other soil) before and during installation. c. Revise infiltration basin HWL on Sheets C3‐1 and C4‐1 to match HydroCAD. d. Add note to infiltration basin cross‐section detail on Sheet C8‐2 in plans stating that fabric shall be excluded from the bottom of the infiltration practice. CRWD understands that no fabric is currently shown, but the note requested shall be added for additional clarification for the contractor. e. Add note to infiltration basin cross‐section detail on Sheet C8‐2 in plans stating the proposed volume in each basin below the low outlet. Loucks response to watershed comments on 2/18/19 indicate that volumes were added to the plans, but volumes were not identified on Sheet C8‐2. f. The sump depth shall be four times larger than the outlet pipe per EPA guidance.

The outlet pipe between STMH 5 and FES A is 18”, which would require a 6’ sump.

Current plan proposes a 4’ sump in STMH 5. g. Include a landscape plan that includes the following: i. Specify potted plants or plugs to vegetate infiltration areas. Basin seeding should be avoided. ii. Specify deep rooted, salt tolerant, native plants according to Plants for Stormwater Design (Shaw and Schmidt, 2003). iii. Provide signage on south side of south infiltration basin that deters snow management from using the infiltration basin for snow storage. h. Increase the diameter of the low orifice in OCS A to at least 4” to prevent clogging.

Proposed orifice diameter is 3” on Sheet C8‐2. i. Revise EOF design for north infiltration basin. CRWD recommends that the EOF elevation contain the 100‐yr HWL and the EOF elevation be at least 0.5’ below the top of berm.

Planning, Projects & Grants Division Manager Capitol Region Watershed District 595 Aldine Street Saint Paul, MN 55104 February 21, 2019 Re: Midway Peace Park – Above and Beyond Grant Funding Request Dear Ms. Eleria, The City of St. Paul Department of Parks and Recreation hereby requests construction grant funding for an above and beyond stormwater project at Midway Peace Park (416 Griggs Street North, St. Paul, MN).

The City has set a budget of $1.96M for the entire park construction. This project will transform two vacant lots and a portion of an existing parking lot into a wonderful open space amenity for the HamlineMidway and Union Park Neighborhood.

The City of St. Paul Department of Parks and Recreation will receive bids in March 2019 which will include infrastructure for a stormwater system. A summary of cost estimates for the system infrastructure is outlined below.

The costs for a baseline system (one which meets but does not exceed requirements) are not included in the sum above. There is an attachment for the baseline costs in the attached packet of materials for this project. Based on the total cost of stormwater improvements and the documentation of our efforts to exceed CWRD’s permitting requirements, we request a grant of $180,000 toward this project.

Please review these costs and the attached permit materials, and contact me with any questions. The City is aware these funds are granted with the expectation they are reimbursements for construction expenses, and we will proceed accordingly.

Permit Applications and Program Updates A) Permit 19-001 Fairview Ave 2019 (Hosch)

Mr. Kelley reviewed permit #19-001 Fairview Ave 2019. The applicant, St. Paul Public Works is reconstructing Fairview Avenue from Shields to University. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.25 acres with 1.13 acres’ impervious surface.

Provide plans signed by a professional engineer per the Minnesota Board of AELSLAGID. Provide a copy of the NPDES permit.

Revise plans to address items a.-d. in the 1-21-19 permit report.

Provide additional soil boring information to support the proposed design or plan notes to investigate during construction.

President Collins commented about water seepage located near the top of the hill in this permitting area.

Mr. Kelley replied that the applicant has cut into hillside, the area does have shallow ground water levels.

Manager Reider asked about any work being done by City of St. Paul to correct this problem. Mr. Kelley replied that he is not aware of any work planned by the City of St. Paul at this time.

Reider/Texer Unanimously approved Special Reports – 2020 WMP Stakeholder Engagement Plan (Eleria)

Ms. Eleria reviewed that in December 2018, CRWD’s Board of Managers approved a consultant services agreement with Barr Engineering for updating CRWD’s Watershed Management Plan. The plan is being drafted into three phases. One of the first tasks of the Plan is to develop a stakeholder engagement plan that defines the goals of our engagement, our stakeholders, target groups, engagement strategies, methods, and schedule. Ms. Eleria described the consideration of stakeholder input as an important step in establishing the priorities of the plan. Attention will be given to reaching areas that are underrepresented in the district. The recommended engagement process includes strategies to obtain meaningful and representative input form a diverse group of stakeholders. Manager Texer and Manager Jones each shared concern that some of the underrepresented areas of the district, not having internet access and having options available for a survey to be completed without the use of internet service.

Ms. Eleria added that CRWD will make sure to reach out to schools where relationships have been built with in the past.

No action was taken. Managers shared ideas of locations to reach stakeholders such as: churches, schools, neighborhood websites, and local newspapers.

In 2010, CRWD’s Board of Managers developed the following diversity statement.

“The Capitol Region Watershed District embraces and values diversity and seeks to recruit, promote and retain employees that reflect the community we serve. We believe that a diverse mix of employees enrich the workplace and enhance the quality of our service. The capitol Region Watershed district encourage all qualified to apply for open positions.”

As part of the 2019 Best Hiring Practices staff requested a review of the current job description. Dana Mitchell Assistant Ramsey County Attorney reviewed and revised the diversity statement as part of her review. Ms. Mitchell made the following suggestions: “Capitol Region Watershed District embraces and values diversity and inclusion. CRWD seeks to recruit, promote and retain employees that reflect the community we serve. We believe that diversity enriches the workplace and enhances the quality of our service. We are committed to a team that represents a variety of backgrounds, perspectives, and skills. Capitol Region Watershed District encourages anyone who is interested and qualified to apply for open positions.

Nothing was eliminated from the original diversity statement, only additions.

Approve 2019 Lake Monitoring Agreement with Ramsey County (Wein)

Ms. Wein reviewed that the Ramsey County Public Works (RCPW) has been conducting in-lake water quality testing on all Ramsey County lakes, including CRWD’s five District Lakes (Como, Crosby, Little Crosby, Loeb, McCarrons). At each lake, water quality data is collected twice monthly from MaySeptember. The data collected includes chemical, physical, and biological parameters that are measured along a depth profile at set sampling locations on each lake. The data is provided by RCPW to CRWD for analysis and reporting. CRWD has provided financial support to RCPW for lake sampling services since 2005.

Following recommendations outlined in the 2014 Monitoring Program Review and the Como Lake Water Quality Drivers Analysis Study, CRWD has worked with RCPW to increase monthly monitoring of District lakes to include April and October sampling. This extension of the sampling season is intended to capture early- and late-season water chemistry fluctuations, which helps to inform in-lake processes.

Ms. Wein shared that with assistance from the Ramsey County Attorney, RCPW has developed an annual cooperative agreement for all services related to CRWD Lake monitoring. This annual contract from RCPW is being proposed for all 2019 lake water quality sampling.

Unfinished Business A) 2018 Rules Revisions (Kelley)

Mr. Kelley reviewed that the Joint Rules Technical Advisory Committee (TAC) met on September 19, 2018. CRWD and RWMWMD distributed document to the TAC on January 23rd and requested preliminary comment on the draft rule revisions by February 6th. Mr. Kelley shared that the TAC meeting was well attended.

President Collins inquired about the cost cap, and shared that he was unclear if the city was excepting the change. Mr. Kelley replied that the City was actually surprised that changes were not adopted sooner. The impact will take place in 2020 since 2019 budgets have already been planned. Manager Reider asked for clarification that the changes in cost caps will take place in 2020. Mr. Kelley confirmed the cost caps to begin in 2020.

No action was requested, Mr. Kelley provided information as an update.

B) Watershed Steward Awards (Bromelkamp) Ms. Bromelkamp reviewed the Watershed Stewards Awards. The Managers were very pleased with the event and shared reflections of how well the new spaced worked for the event. Managers thanked Ms. Bromelkamp for her work.

C) 2018 Lakes Update (Wein) Ms. Wein provided an update to the Board of Mangers on the lake monitoring. Ms. Wein added that no fish monitoring was conducted in 2018. The late snow melt in 2018 resulted in sample grabs in April of 2018. The ice out on Como Lake in 2018 was recorded April 30th. This is the longest number of days with ice recorded. The longer number of days with ice on the lakes gives weeds such as curly leaf more time to grow and delays the growth period for native plants.

Ms. Wein shared with the Board of Managers that a canoe was purchased from Urban Boat Builders.

The new canoe allows staff to reach additional monitoring locations. In 2017 staff installed a new Aqua Troll data logger in Como Lake. The logger measures when points of no oxygen occur.

In 2018, CRWD, in partnership with RCPW and the Ramsey County Soil and Water Conservation Division, collected chemical, physical, and biological data from all five District lakes. Data collected included: dissolved oxygen, total phosphorus, chlorophyll-a, temperature, Secchi depth, phytoplankton, zooplankton, macrophyte samples, biovolume surveys of vegetation, and continuous water level data.

All of the lakes data collected in 2018 have been analyzed and summarized. Historical lake data and summer average total phosphorus, chlorophyll-a, and Secchi depth calculations are also available online via the CRWD Water Data Portal.

No action was taken. Information shared with the Board of Managers as an update.

D) Master Water Stewards (Schwantes) Ms. Schwantes provided an update for the Board of Managers of the Master Water Stewards and reviewed a map of volunteers distributed thru the district. Ms. Schwantes introduced Anthony Swichtenberg and Sean Campbell who worked together on building a raingarden at 32 South Dunlap Street. Mr. Swichtenberg and Mr. Campbell provided a review of their project. Ms. Schwantes introduced Julie Marckel and Cara Donavan. Ms. Marckel and Ms. Donavon provided a review of their project providing education and outeach and installing two rain gardens at 1099 Pleasant. Ms. Marckel works with Science Meuseum to train trainers in a program called “Ground Water”. The models show students how ground water and polluted water seep into lakes & rivers. President Collins shared that he was grateful that the stewards are working with students. Manager Reider thanked the Stewards for making the commitment and making connections. Manager Reider asked the Stewards how they felt about time commitment. Ms. Marckel shared that she felt time commitment was doable. Ms. Donavan replied that she enjoyed the amount of time and meeting similar minded people. Manager Jones asked the Stewards what brought them to be a steward. Mr. Swichtenberg replied that a neighbor told him about the program. Mr. Campbell replied that he is new to the area and found the program online and that he was interested in meeting people. Ms. Donavan replied that she just moved to the area. Ms. Marckel replied that she was involved with the Central School planning and was looking for a way to get involved and give back.

Ms. Schwantes also shared that the Stewards have been trained to complete Boulevard inspections. The Managers thanked Ms. Schwantes and the Stewards for their work.

E) Building Update (Eleria) Ms. Eleria provided a building update for the Board of Managers. Staff are seeing less contractors in the building as they are wrapping up punch list items. Ms. Eleria reviewed plans for the pocket park.

Concerns were shared about the stream being a tripping hazard. The design includes a trench grate over part of the stream. Ms. Eleria also shared the lighting plan for the park which will provide adequate and even brightness through the park and help guide the walking path thru the pocket park. President Collins shared concerns regarding the depth of the shallow pond and concerns about kids playing in the basin unsupervised. Ms. Eleria stated that the pond has been designed to be as shallow as possible and still demonstrate a pond. Manager Jones suggested seeing a working model of the design. Attorney recommended that staff contact CRWD’s insurance company. Ms. Eleria will talk to designer and insurance regarding President Collins concerns. Manager Reider felt the location of the pocket park is vulnerable to accidents. Ms. Eleria agreed to additional discussions at the next board meeting.

Background The design of CRWD’s pocket park represents a small-scale, urban watershed utilizing rainwater as a resource in three distinct areas – an interactive exhibit, stream, and shallow pond. The pond and other elements of the park help CRWD achieve its 2010 Watershed Management Goal of “Bringing Water Back” to the community.

Issues CRWD’s Board of Managers have raised safety and liability concerns regarding the shallow pond in the pocket park. CRWD staff have evaluated these concerns and are providing some design changes to address the Board’s concerns (See enclosed plans). According to the landscape architect, a minimum depth of six inches is required for proper function and aesthetic of the pond. Staff has also spoken with CRWD’s insurance company and has confirmed that its general liability policy offers coverage for any incidents that might occur in the pocket park. Enclosed is a staff memo that provides further information for the Board to consider. The $200,000 estimated cost for the pocket park is partially in the original JE Dunn construction bid as well as the 2019 budget.

At the February 27th meeting, CRWD staff will discuss the pocket park design, steps to address Board concerns related to the shallow pond, and present 3-D visuals to appropriately convey the design intent of the pocket park.

In response to CRWD Board of Managers’ safety and liability concerns regarding the proposed CRWD pocket park, below is information on the design of the pocket park including features and design changes to alleviate concerns, existing CRWD infrastructure with potential risks, precedent water features, and CRWD insurance policy.

Design • The NE pocket park represents a mini-urban watershed that utilize rainwater as an asset in three distinct areas - an interactive exhibit, stream and shallow pond,. First the interactive exhibit shows five main concepts, divert, slow, distribute, soak and recharge, by allowing the visitor to move the rainwater from clouds and paved surfaces to plants, soil, roots and groundwater. From the exhibit, the cleansed water flows across the park in a narrow channel and discharges into a shallow pond. The shallow pond is surrounded by native vegetation that represents a restored and natural ecosystem.

• The pond helps CRWD in achieving its 2010 WMP goal of “Bringing Water Back.”

• The 250 square foot (15’ x 20’) pond design calls for 6” water depth. The designer does not recommend anything less than 6 inches of water depth in order to sustain vegetation, manage temperature and algae, and ensure proper function of the pumps and filters.

• The planting palette around the pond calls for native plant species ranging in height from 12” – 36.” At maturity, the vegetation will be dense and will not provide a pathway for visitors to walk right up to the pond.

• Stepping stones will not be installed immediately adjacent to and within the pond.

• Lighting across the entire pocket park exceeds standards for lighting called for adjacent to sidewalks.

• If desired, signage about the pond and/or channel can be included in the park.

Infrastructure, Water Features and Potential Risks • CRWD owns, funds, operates, and/or maintains infrastructure that receives, collects, and temporarily or permanently holds water.

• CRWD has been involved in the construction of hundreds of boulevard raingardens, some with water depths greater than 6” that are located within right of way and residential areas.

• CRWD’s 100+ year old TBI that has continual water fluctuating from low to high levels, flows and volumes. Unauthorized access into TBI occurs periodically. Structural failure of TBI, which is located beneath City streets, private property and railroad right of way, could impact property and citizens.

CRWD has partnered with the City of Saint Paul in the construction of water features including stormwater ponds and a stream in Trout Brook Nature Sanctuary. We are also encouraging access to existing water features such as the Willow Reserve project, which has a temporary walking path constructed by CRWD. Other projects in the planning/design phase that have a water feature include Victoria Park, Ford redevelopment project, and Midway Peace Park.

The City owns and maintains other water features including Mears Park, Como Lake Pavilion, Phalen Lake waterfall, Iris Park, Swede Hollow, and TBI stormwater ponds.

Insurance • CRWD’s general liability insurance provides coverage for any incidents that might occur in the pocket park. There is no exclusion on the policy for water features. It is considered property in the open.
