HISTORY & CONSIDERATIONS: At this time, Apex Auto is only redeveloping the west portion of the site which is less than 1.0 acres. However, the design also allows for further development of the east portion of the property in the future which constitutes a “common scheme of development” and would exceed 1.0 acres of land disturbance. A CRWD permit will be necessary for the future east portion of the site.

Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from one inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious for the west portion of the site is 38,806 square feet. The amount of proposed impervious for the east portion of the site is 22,239 square feet. b. RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is not greater than 1 acre; an NPDES permit is not required.

Dear Mr. Guevin: On December 31, 2013 CRWD received a plan submittal for the Capitol Parking Ramp at Rice Street and Fuller Avenue. While the Department of Administration is not required to obtain a permit from CRWD, the project has been designed to meet the stormwater standards within District Rules. Staff have reviewed the proposed plans and have the following recommendations: 1. Clarify dimensions on Detail 2 on Sheet 211.DT. The distance from the top of the clean, washed fine filter aggregate to a distance inside the 72 inch CMP (not the invert, as is typical) is labeled as both 6 inches and 1.0 foot.

2. Revise HydroCAD model to include 12 inch pipe at 161.2 upstream of the 6� orifice.

If the State of Minnesota desires a certificate of compliance and letter indicating the project fully meets all standards in District rules, please submit revisions addressing the above conditions. Background CRWD permitting staff review applications for compliance with District Rules, and present recommendations to the Board of Managers for review and approval. Per MN Statute 15.99, the District must approve or deny permit applications within 60 days of receipt. Failure to deny a permit within the 60-day review period is the same as approving the permit.

Discussion Since 2007, permit applications received by the required submittal deadlines have been presented to the Board at the following scheduled meeting regardless of the staff recommendation. If there are items that significantly affect the design of the proposed stormwater practices, or the number of issues to address is large, staff typically recommend the application be “Tabled with Conditions”. Presenting a permit for the Board to Table is not required by statute, and is not considered an action to approve or deny. Staff feel that the time expended to create Board Packet materials for a permit that will be tabled would be better spent coordinating with the applicant and engineer to address the items of concern in order to ensure a staff recommendation of “Approve” at a subsequent meeting.

Staff will continue to track the dates that applications are received, and ensure that 60-day review period extensions are requested and presented to the Board prior to expiration. The new BMP database will also assist with this tracking. Staff will also work ensure permit conditions are clear and concise in order to reduce the potential for different interpretations of approval conditions.

A draft updated copy of the CRWD Permit Application Process and Submittal Deadline form that is provided on the website has been provided for review.

Requested Action No Formal Action Required. Provide Review and Comment on Permit Review Process, and Direct Staff to Initiate Policy to Present Applications for Board Action Upon Receiving a Recommendation to Approve with Conditions.

Special Reports – Office Facility Update, Michelle McGuire, CB Richard Ellis

Administrator Doneux introduced Michelle McGuire with CB Richard Ellis. CBRE has completed the preliminary Needs Assessment as well as a review of existing facilities. Ms. McGuire presented the findings of preliminary Market Analysis including a financial analysis of three office facility options. Those options include build, buy and lease. Ms. McGuire reviewed the financial comparisons of the options. In her presentation she showed four possible properties for sale. After much discussion the board agreed to continue pursing both the build and buy options. Ms. McGuire stressed the importance to find a property quickly. The current building lease expires in 2015 and time will be needed for building or remodeling. The Board also agreed that the purchase of a building larger than our expected needs would give the option to lease space yet have it available for future expansions. Ms. McGuire will be conducting a site tour of six to eight properties the week of January 27th. The Board requested a list of the properties that will be visited. Ms. McGuire will return with an update each month for the next three months.

AR: Approve Financial Policies Update (Sylvander)

Ms. Sylvander reviewed that during the 2012 audit process a number of financial policies and procedures were reviewed and discussed. It was the recommendation of the Minnesota State Auditors that District management update its policies and procedures manual to document the significant internal controls that have been implement or are in the process of being implemented. Monitoring activities should also be documented to show the results of the review, any changes required, and who performed the work.

The response to the 2012 State Audit included that the District management was in the process of updating policies and procedures for: Accounts Payable, Payroll Approval, and the usage of the district credit card. The Board discussed Ms. Reider asked for clarifications on the credit cards policy. After much discussion edits will be made to Scetion III. Credit Cards item C (Conditions of Credit Card Use) and item E (Cardholder Responsibilities).

AR: Approve Change Order No. 2 for the TBI Realignment Project (Eleria)

Administrator Doneux reviewed the TBI Realignment Project at Station 53+08.5 to Station 60+48.6 was fully completed in early November 2013. Construction work was completed under two phases: Phase I from August to October 2012 and Phase II from August to November 2013. Major construction accomplishments include installation of box culvert beneath BNSF railroad tracks within 30-hour work window, installation of an additional 636 feet of box culvert outside of BNSF ROW, constructing transition sections between the existing and new TBI, and abandoning the old TBI alignment.

Over the course of the Phase II construction period, CRWD’s contractor, Veit & Company, conducted additional work items that were necessary because of conflicts with MnDOT’s 35E reconstruction project or different site conditions than originally anticipated. These work items were either outside the original scope of work or outside the original budget of the project. The eight additional work items included: 1) relocating the south rail monitoring equipment; 2) relocating the north rail monitoring equipment; 3) installing additional safety fence; 4) working around an unmarked BNSF utility line; 5) additional railroad insurance coverage; 6) additional rental time for dewatering equipment; 7) installing dewatering pipe trenches and moving materials for MnDOT work; and 8) additional helical pile sections.

Barr Engineering staff has reviewed and is recommending payment of Change Order No. 2. MnDOT’s Office of Agreements and Contracts has agreed to reimburse CRWD for all eight work items, however, they have informed CRWD staff that this project will be subject to an audit and MnDOT’s Audit Office could overturn any approved change order items.

Motion 14-006: Approve Change Order No. 2 for the TBI Realignment Project in an amount not to exceed $86,068.

Staff has been interviewing candidates for the Water Resource Technician position with a scheduled start date in January.

The office experienced a computer system crash. The current contractor will be reviewed for replacement.

Administrator Doneux attended and discussed a meeting called by Anne Hunt regarding winter street maintenance by the City of St. Paul.

Background In September 2013 the Board of Managers awarded $510,000 in Special Grant funds. Withdrawal of one project returned $65,000 of those funds to the program. Currently there is $80,000 remaining as contingency funds. To provide needed match funds for a CWF grant application for Central High School, $30,000 was allocated to the project. Central High School was not on the BWSR staff recommendation list and will likely not receive funding which results in the $30,000 being returned to the Special Grant program. A total of $110,000 is available for allocation.

The City of St. Paul was awarded $225,000 through the Special Grant program for stormwater elements at Lowertown Ballpark (see table at right). These funds can only be used for stormwater elements that treat runoff above and beyond what is required by CRWD rules. Staff will continue to work with the ballpark design team to document that our rules are met without the use of grant funds.

Issues As the ballpark design progressed, staff determined that the below ground filtration would be required

by CRWD permit and therefore would be ineligible for grant funds. It is recommended that those funds be made available to other aspects of the project. Additionally, a unique opportunity to treat a portion of the adjacent Green Line Operation and Maintenance Facility (OMF) roof through rainwater harvesting and reuse was identified. Experts in the area of rainwater reuse developed a feasibility analysis, modeling, and cost estimates. Three opportunities are presented in the enclosed material. Option A incorporates reuse for toilet flushing only using runoff from the ballpark, Option B allows for irrigation only and captures a portion of the OMF roof, and Option C includes flushing and irrigation using runoff from OMF. The findings reveal Option C treats the most water, and would be one of the first projects of its kind in the country. Due to the evolving nature of this project, high visibility, large treatment potential, and unique project opportunities, staff recommend funding flexibility and additional funds for this project.

Staff Recommendation Staff recommend supporting Option C: rainwater reuse for toilet flushing and ballfield irrigation with the following conditions: 1. Allow the originally awarded $90,000 designated for two 3,000 gallons cisterns and the $56,500 for below ground filtration to be used to incorporate rainwater reuse in the project.

Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District.

2. Award an additional $100,000 in Special Grant funds to be used to pursue Option C: rainwater reuse for toilet flushing and ballfield irrigation. Total grant funding is not to exceed $325,000.

3. Funding is contingent on visible cisterns or two interactive kiosks in high traffic locations if cisterns are not visible. Kiosks will educate public on the reuse projects and be designed in cooperation with CRWD. LOWERTOWN BALLPARK: RAIN HARVERSTING COST EVALUATION CRWD Board Meeting – January 2014 Prepared by Solution Blue Inc. 01/15/2014

BACKGROUND The Lowertown Ballpark will be constructed on the site of the former Diamond Products building. As it exists today, the site is largely comprised of a 600,000+ SF industrial warehouse, segments of 5th Street and John Street, approximately 300 spaces of surface parking and a dog park. Most of the rainwater is currently flowing offsite untreated.

The Ballpark is a uniquely located in the Capital city of the state of 10,000 lakes and just a few hundred feet from America’s greatest river. The Ballpark will have a capacity of 7,000 spectators and will host approximately 400,000 visitors annually and be used for a number of sporting and non-sporting events. For all these reasons the Lowertown Ballpark presents the City of Saint Paul with unprecedented opportunities to demonstrate sustainable water management techniques that will reduce environmental impacts and reduce potable water consumption.

The current design for the Ballpark uses stormwater best management practices to dramatically reduce the rate of runoff and improve the quality of the water that leaves the site, but more can be done to further reduce the Lowertown Ballpark’s water footprint.

Lowertown Ballpark project partners Capitol Region Watershed District and Metropolitan Council are partnering with the City of Saint Paul with grant funds to pursue rainwater harvesting at the Lowertown ballpark to the fullest extent possible. There are currently few professional sport facilities in the country that consider, let alone use, captured rainwater to irrigate the playing field or flush toilet fixtures. Implementing such a strategy would make this ballpark one of the first of its kind nationally and certainly within Minnesota.

POTENTIAL RAIN HARVERSTING PROJECTS With the available grant funding budget, three rain harvesting projects have been identified for further cost exploration by Solution Blue (SBI), Schadegg Mechanical and Rain Management Systems (RMS). Total construction costs for each project are listed below.

OPTION A – TOILET FLUSHING FROM BALLPARK ROOFS This option utilizes harvested rainwater to flush toilets in two primary bathroom banks on the concourse level.

Nearly 25% of the total ballpark toilet fixtures would be serviced (34 out of 150). Approximately 17,000 square feet of ballpark roof top going to two (2) 5,000 gal underground tanks will be used to meet this need.

Approximately 32,000ft2 of OMF roof top directed to two (2) 27,000 gallon tanks would be used to meet approximately 20% of the field irrigation demand.

Approximately 32,000ft2 of OMF roof top directed to two (2) 27,000 gallon tanks would be used to meet approximately 15-20% of the field irrigation demand and service 10% of the total ballpark toilet fixtures (13 out of 150).

General updates including recent and upcoming meetings and events Sarah Wein will be starting on Tuesday, January 21, 2014 as the new Water Resource Technician Students from Macalester College completed a report for CRWD synthesizing focus group data and information from a literature review of current thinking about educational displays. The report makes recommendations for future displays and initiatives to inform community members of clean water actions and can be found on our website under CRWD Reports.

CRWD Staff, Corey Poland and Lindsay VanPatten will begin the Watershed Specialist Training program through the University of Minnesota.

Lindsay VanPatten will be tabling and attending ‘Our Water in a Changing World – Climate Change and the Urban Watershed’ on February 13, 2014 from 7:00 – 8:30 PM at the Science Museum of Minnesota. The event is organized by FMR. The event is free. To register visit www.fmr.org 1)
