HISTORY & CONSIDERATIONS: None RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is not used to analyze runoff for the design or analysis of flows and water levels.

2. Expected reduction in impervious area suggests that runoff rates for the proposed activity will not exceed existing runoff rates for the 2-, 10-, and 100year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from one inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious onsite is 72,310 square feet. b. Volume retention: 72,310 ft2 x 1.1inches x 1ft/12 inches = Volume Retention Required (cu. ft.) Volume Retention Provided (cu. ft.)

4. Alternative compliance sequencing has been requested due to poor soils, utilities, and space constraints a. The applicant did not partially comply with the volume retention standard onsite. b. The applicant proposes to comply with the volume retention standard at an offsite location through the use of qualified banking credits. c. The applicant has not submitted money to be contributed to the Stormwater Impact Fund.

d. The project is linear, and the cost cap has not been reached.

5. Best management practices do not achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A recordable executed maintenance agreement is not required.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. It is unknown if all habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

However, adequate conveyance has been provided to prevent flooding.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are not consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are not protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is greater than 1 acre; an NPDES permit is required.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard ďƒ˜ Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Permit Applications and Program Updates A)

Permit #11-008 Total Tool – Environmental Covenant Consent & Subordination (Kelley)

Mr. Kelley reviewed Permit #11-008 Total Tool. The property has historically been used for a battery manufacturing facility. Site improvements include a remediation plan to remove and/or cover lead impacted soils under the MPCA Voluntary Investigation and Cleanup (VIC) Program. An Environmental Covenant is required to be recorded with the property in favor of MPCA that restricts certain activities (mainly excavation in contaminated areas). Because a Declaration for Maintenance of Stormwater Facilities has been recorded with the property in favor of CRWD, the District must consent to this covenant. Staff have worked with the owner’s legal counsel to ensure the language within the covenant does not restrict any potential future maintenance of Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

the underground infiltration system. An area 2 feet on either side of the infiltration pipes, and the soils below the system have been specifically excluded from the restricted area. Attorney Mogen has reviewed the document.

Motion 15-153: Authorize Board President to Execute the Consent and Subordination Form for the Environmental Covenant Required by the MPCA for Permit 11-008 Total Tool.

Special Reports A) Willow Reserve Update (Eleria) 1) History Report

Ms. Eleria reviewed that the Bluestem Heritage Group was hired by CRWD to prepare a formal history report for Willow Reserve, a bird and wildlife reserve located in District 6 of Saint Paul. Historic findings from the report may help inform the upcoming development of goals and objectives for the Willow Reserve Restoration Plan.

Ms. Eleria introduced Ms. Nancy O’Brien Wagner with the Bluestem Heritage Group. Ms. O’Brien Wagner led the research and presented the history report for the Willow Reserve. The report includes significant eras of history for the property including its natural history, Dakota presence, 19th century settlement, early 20th century truck farming, establishment of Willow Reserve as a City park reserve and stormwater pond, and recent studies and activities in the Reserve. Ms. O’Brien Wagner shared numerous maps showing how the land use in the surrounding area transitioned from farming to home sites being built in the 1950’s. In the 1970’s neighbors wanted an open space preserved. St. Paul’s Planning Board adopted an amendment to designate 13 acres as “open space”. The Managers enjoyed the information shared. CRWD staff will distribute the report to City of Saint Paul staff for their review and comment.

Motion 15-154: Accept the Willow Reserve History Report subject to revisions based on comments from CRWD and City of Saint Paul staff Jones/Texer Unanimously approved 2) Restoration Plan Ms. Eleria announce that there will be a kick off meeting next week with key project partners for the development of the restoration. A public meeting will be held to hear concerns, considerations and goals for the restoration plan. No date has been set yet for the public meeting. Ms. Eleria will notify the Board of Managers when a date is set.

3) Maryland Avenue Development Administrator Doneux and Ms. Eleria met with the City of St. Paul PED staff and Habitat for Humanity to talk about the 3 acre parcel being redeveloped into single family homes.

B) 2010 Watershed Management Plan Mid-Term Review, Fossum On September 1, 2010, the Board of Managers adopted the District’s Watershed Management Plan (WMP). The plan covers the term from 2010—2020. At the May 12th Board workshop the Managers reviewed the draft Summary of Progress Toward Addressing Issues document. Mr. Pat Conrad from EOR has worked with Mr. Fossum to develop a draft list of recommendations for the remainder of the WMP period 2016-2020. These recommendations were reviewed at the June 10th CAC meeting. The CAC supports the recommendations with some suggested changes. Mr. Fossum stated that there are no recommendations to make changes to the ten year plan. The purpose is to propose adjustments to use as a guide to focus efforts. President Collins really liked how the introduction paragraph was written. It is a well-rounded summary of the progress CRWD had made. The Managers discussed adjusting the recommendation #1 and #2 to spend more wisely to reach more diverse groups and to include more creative resources. Manager Texer wanted to know when planning for the next ten year plan would start. Mr. Fossum said he plans to start planning for the next ten year plan in 2018. Mr. Fossum will review any changes in August.

Administrator Doneux reviewed that each year the Board of Managers must establish a plan of work for the upcoming year, establish a budget based upon the work plan and establish a levy for the budget. Administrator Doneux presented and reviewed the proposed 2016 work plan and budget. The Managers discussed meeting on Monday, July 27th for a budget workshop.

Lease Amendment

Administrator Doneux reviewed with the Board of Managers, the fourth lease amendment to expand the office into suite #6. An architect was brought into visit the space and help determine if additional work would be needed to park vehicles inside. It has been determined that a carbon monoxide detector, air exchanger and waste trap would be required in the expanded space. The additional work would cost the District $12,454.08. The landlord has agreed to pay the additional cost of the waste trap. The other improvements would be added on to the monthly rent as separate line item for sixteen months. Administrator Donuex recommended the amendment.

Motion 15-157: Amend the fourth lease agreement to include sixteen payments of $778.38 for a total additional cost of $12,454.08 to install required equipment to park vehicles inside. Subject to the review of Ramsey County Attorney.

Unfinished Business A) 2015 Lake McCarrons Aquatic Plant Harvesting (Zwonitzer) Administrator Doneux reviewed that the first round of Lake McCarrons plant harvesting was completed in one day on June 23rd. A new contractor was used this year. The residents were very pleased. The second round is schedule for early August.

B) Ford Site Update (Fossum) Mr. Fossum shared an update on the presentation given by the City of St. Paul. Managers Reider and Texer attended the presentation along with Administrator Doneux and Mr. Fossum. The City of St. Paul presented potential water features that include public art and history honoring the site. The purpose of the meeting was to share information, identify choices, clarify expectation, seek input, refine priorities and inform the zoning and public realm plan. President Collins asked what were the thoughts from the public? Mr. Fossum said the feedback was very positive. Manager Texer replied that the people were very interested and engaged. Mr. Fossum said the next meeting will be phase two, how to implement a plan.

VII.

General Information A) Administrator’s Report

1) Maintenance, Research and Monitoring June precipitation was near normal at 4.26 inches which is just above the .25 average. Work was completed on the set up and installation of monitoring stations for the Trout Brook Nature Sanctuary (TBNS). When not in the field this busy spring season staff have been working on the stormwater reports as well as enhancing the analysis and reporting aspects of the WISKI database.

2) Education and Outreach June continued to be an active period for planning and attending events. June events included the Landscape Revival that set another attendance record, Bugs Night Out, Minnesota Green Roofs Council annual bike tour of Green Roofs, the Frogtown Neighborhood Annual meeting as well as the start of the weekly PASpider event at the Western Sculpture Park. Staff are currently working on July events that will include the Frogtown Garden Tour, Como Lake Land and Water Clean Up, Montana Greenbrier and Montreal SPSVP maintenance meet ups and more PASpider events every Tuesday at the Western Sculpture Park. Please see the details for these events below. Staff have continued discussions with Freshwater Society staff about the feasibility of participating in the Master Water Steward program. CRWD hosted a large group meeting to discuss the pros and cons of adopting and implementing a Master Water Steward program. Currently staff are in detailed discussions with Ramsey Washington Metro and Rice Creek Watershed District for a possible collaboration with this program. On-boarding continued for our Strategic Communications consultant, Fourth Sector.

3) Regulatory Program There are currently 26 permits active for 2015 which is ahead of pace for 2014 which had a total of 41 permits. Standing weekly inspections include the Cayuga bridge project (12-017), MN Pass/35E (13-003) and Kellogg Boulevard (15-017). Staff are working with Met Council to insure the performance of the Green Line Tree Trench System. A joint MPCA and CRWD compliance inspection was conducted on the MNPASS and Cayuga projects. Updates were made to the WIKI version of the MPCA Stormwater Manual Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

that included the Calculator and specific BMPs. Erosion control inspections continue during the decommissioning of the Ford site.

4) Capital Improvements and Projects The major work on capital improvements in June was the contracting for the Upper Villa Project. The Notice of Award was issued to New Look Contracting on June 16th. Punch list items are being completed on the Highland Ravine and Curtiss Pond projects. The Opti RTC system at Curtiss Pond was installed and commissioned in June. One round of harvesting was completed for the 2015 Lake McCarron’s Aquatic Plant harvesting on June 23rd.

5) Studies and Plans Work is complete on the Willow Reserve History Report being conducted by Blue Stem Heritage Group.

This is going to be an update to the History report that District 6 completed about a year ago. Applied Ecological Services was selected for developing the Willow Reserve Restoration Plan. Work was completed on the Como Lake TMDL report. This report documented that 30 BMPs have been constructed that achieve over 50% of the waste load reduction. Discussions are ongoing with the landowner of the Lafayette Park Campus and MPCA to address concerns about liability as it relates to soil investigation and possible construction of BMPs. Significant time and effort continues on planning work for the Ford Site.

The work culminated with the June 23 Public meeting on stormwater, public realm and parks. Work continues on the Watershed Management Plan Mid-Term Review. CRWD continues to be a technical advisory committee member for two Saint Paul bikeway initiatives, Grand Round, North Loop and Downtown Loop, and have participated in a number of meetings offering recommendations for incorporating stormwater management into these future bikeway projects.

6) Grant Programs The Steward Grant Program has had 60 site visits and applications resulting in 17 Clean Water Plans. Staff are working with Councilmember Brendmoen’s office and St. Paul Public Works to construct a large rain garden at the southwest corner of Rice and Maryland Avenue. Green Line Maintenance inspections also occurred in June.

7) Support Programs (GIS, Safety, BMP Database) Staff are working with our consultant Houston Engineering to wrap up phase II refinements to the BMP Database. These improvements will provide a user friendly public interface as well as many more searchable fields for staff queries of the data.

8) Administration Staff are continuing to add reports and improvements to the SAGE accounting system to provide better and up to date information for our project managers. Staff continue to negotiate the final details of our fourth lease amendment for the former Roof to Deck space. The Building Committee also conducted one potential office site tour in May. A significant amount of time was spent on site visits and evaluation the 270 Larpenteur site. Staff prepared detailed budget estimates for all of their projects. These detailed budgets were tabulated into the “Project List” that will be discussed at the July 8th Board meeting. The 2014 audit is nearly complete and the final paperwork on the 2014 fire damage insurance claim is being submitted.

Background In 2012, the Freshwater Society (FWS) and Minnehaha Creek Watershed District (MCWD) received a Clean Water Land and Legacy grant to create the Master Water Stewards program, which is modeled after University of Minnesota Extension’s Master Gardener certification program. The program trains, certifies and supports community leaders to install pollution prevention projects that educate community members and reduce polluted runoff.

Issues Since 2013, 80 Stewards in MCWD have successfully completed a twelve-week course that includes a capstone project in which Stewards work in pairs to complete an installation through the watershed district’s Stewardship Grant program. Capstone projects include best management practices such as rain gardens, rain barrels, permeable pavement or cisterns, each with an accompanying outreach campaign to spread the word to neighbors and other community members about how and why to participate in stormwater pollution prevention practices.

Since May 2015, staff from several metro watershed districts including CRWD have met with FWS staff to negotiate expanding the program to our organizations. CRWD staff hopes to work with Master Water Stewards to fill existing programming gaps such as follow-up and mentoring of Stewardship Grant recipients, developing a maintenance education program with Inspiring Communities Program homeowners, building relationships with new target audiences, citizen science monitoring and IDDE reporting and education program delivery.

CRWD will assist FWS in developing meaningful volunteer opportunities for Stewards and recruit a minimum of eight candidates for the 2016 program year at a cost of $2,500 per Steward. FWS will organize the classes, hire instructors, assist with recruitment of potential Stewards, track and report Stewards’ activities and provide ongoing continuing education opportunities for Stewards.

Request Action Approve a partnership with Freshwater Society to carry out the Master Water Stewards program in CRWD in 2016 at a cost of $2,500.00 per Steward and authorize staff to execute an agreement with Freshwater Society.

Participation Agreement Freshwater Society (FWS) and Capitol Region Watershed District (CRWD) agree to enter into a collaborative relationship for the Master Water Stewards Program for program year 2016.

The Master Water Stewards program trains, certifies and supports community leaders to promote the installation of pollution prevention projects, educate community members, reduce urban runoff pollution and allow more water to soak into the ground before running into storm drain systems.

Partner responsibilities: Freshwater Society FWS will develop the curriculum, provide the technology platform, organize the classes, hire the class facilitators, host information sessions in locations throughout the metropolitan area as part of recruiting candidates, provide Stewards with the education and support they need to develop a capstone project, provide a certification to Stewards that successfully complete the program and track and report Stewards’ volunteer hours through the Master Water Stewards website. In collaboration with CRWD, FWS will assist in developing meaningful volunteer opportunities for Stewards. At the end of the 2016 program year, FWS will report the volunteer efforts of CRWD Stewards including number of volunteer service hours, number of stormwater projects installed, pollution reduction estimates and the number of community members reached by Stewards’ education efforts. FWS will also develop ongoing activities to build and support Stewards as a community, including offering continuing education opportunities.

CRWD CRWD will recruit candidates for the Master Water Stewards Program for the 2016 program year at a cost of $2,500.00 per Steward. Failure to recruit at least four candidates will result in the option to terminate this agreement by either party. CRWD will provide meeting space, organize and facilitate a watershed tour, provide subject matter experts during the training period and provide volunteer management support after Stewards are certified. CRWD will also provide funding for each Steward’s capstone project to be completed within CRWD. Capstone projects will meet the terms of existing grant programs and be developed in collaboration with CRWD staff to meet the District’s stormwater outreach management priorities.
