Background Demolition is complete for permit #12-023 Ford Site Demo.

Issues Ford Site Demo #12-023 This permit was issued demolition and site restoration at the Ford Assembly Plant in St. Paul. No permanent stormwater treatment was required for this project, as no impervious surface was being added or reconstructed. The site is currently undergoing mass grading activity through CRWD Permit #20-009 and the demo permit is outdated. Final site stabilization will be ensured through permit #20-009. The $134,000 surety was replaced by the current owner, Ryan Companies, and will be held to meet requirements under #20-009. The original surety from Ford was returned in January 2020.

Background Ryan Companies recently purchased the 122 acre Ford Site property in St. Paul. Permit 12-023 Ford Site Demolition was recently transferred from Ford Motor Company to Ryan, and 30% design plans were reviewed by CRWD in January. Sixty percent design drawings were submitted on January 21st, 2020. Final stormwater design plans are currently under review, and CRWD staff expect to issue Rule C. permits at the July 8th Board Meeting.

Issues The scale, complexity and duration of the project necessitate a modified approach to issuing permits for stormwater management and erosion and sediment control. Coordination with City department review, approval, inspection and close out will be critical to minimize potential conflicts and duplication.

CRWD staff propose the following process be used to break the 122 acre site into 10 individual permits to increase flexibility.

Erosion Control: Permit 12-023 Ford Site Demolition. Transferred to Ryan on 1/17/2020 and provides for surface demolition, stockpiling of materials, and minor grading for retaining wall removal. $134,000 surety check was received from Ryan, and a surety return check was issued back to Ford for the same amount. This was based on 67 acres of land disturbance. Does not include approval for site mass grading or utility installation work. Permit closeout requested by staff 06/17/2020 Permit 20-009 Ford Site Mass Grading. Issued 05/01/2020 for mass grading of the site in preparation for utilities, right of way improvements, and building sites. Additional surety of $110,000 ($244,000 total) was submitted by Ryan Companies for the expanded land disturbance beyond the original 67 acres for plant demolition. Erosion control sureties can be returned in phases consistent with the Stormwater Management permits described in the section below. All work within permitted drainage areas must be complete for this surety to be returned.

Stormwater Management: Permits 20-013A through 20-013H. Stormwater Management permits will be broken into 8 smaller areas based on drainage boundaries to site BMPs as shown in the attached exhibit. These permits will be issued concurrently, but closeout will be phased based on completion of each area. Surety will be collected at $5,000/acre of the impervious surfaces within the public Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District.

Right of Way, Parks, and privately owned civic spaces. Surety will be returned upon completion of all Parks and ROW, and a combination of all private parcels achieving temporary stabilization, and/or gaining coverage under a new permit for which a separate surety has been collected.

Permit 2X-0XX. Individual stormwater and erosion control permits for private development parcels will be applied for, reviewed, and approved following the standard permit application process. Surety will be collected at $5,000/impervious acre impervious, and returned upon confirmation of completion and BMP function.

Wetland Management Permit Permit 20-015 Ford Site Redevelopment Wetlands. Approved at the 06/03/2020 Board Meeting, this permit covers wetland impacts and the required 2:1 mitigation. A surety of $37,986 will be collected as part of the financial assurances required by WCA and the City when wetland impacts are proposed to occur prior to beginning construction on wetland replacement. Surety will be returned upon completion of the required monitoring period documenting successful establishment of wetland hydrology and vegetation.

Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is not used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not significantly exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 91,040 ft2 (2.09 ac). b. Volume retention required: 91,040 ft2 x 1.1 inches x 1 ft/12 inches = 8,345 ft3 Table 1. Proposed volume retention through abstraction (i.e. infiltration, reuse).

Alternative compliance has been requested due to limited Right of Way, poor soils, and high groundwater. a. The applicant did not partially comply with the volume retention standard.

Multiple treatment BMP alternatives were considered to meet stormwater management requirements onsite including an underground treatment trench, infiltration/filtration tree boxes, and boulevard infiltration swales.

However, given the limited available Right of Way, poor soils, high groundwater, limitations due to existing storm sewer, and high maintenance effort, these options were ruled infeasible. b. The applicant has requested compliance with the volume retention standard through the use of qualified banking credits. c. The applicant has not submitted money to be contributed to the Stormwater Impact Fund. d. The project is linear, cost cap has is not being considered.

5. Best management practices do not achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A memorandum of agreement for maintenance of stormwater facilities exists between the City of St. Paul and the CRWD. RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. It is unknown if all habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements. However, adequate conveyance has been provided to prevent flooding.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Total disturbed area is 3.75 acres; an NPDES permit is required. A SWPPP has been submitted.

Review of 2020 and Preliminary 2021 Budget (Mark Doneux)

Administrator Doneux reviewed that each year the Board of Managers must develop a work plan for the upcoming year and establish a budget and levy to accommodate it. At the May 20, 2020 Board Meeting, staff provided an update to the Board about how capital improvement project expenditures and revenue may be adjusted based on current projections. The 2021 budget process will be unique in that we are transitioning from our 2010 Watershed Management Plan (WMP) approach and budgeting to the new 2020 WMP. Administrator Doneux added that we also will be tracking the impacts of the COVID-19 Pandemic on our budget and revenue. The focus of the workshop should be to: 1) Understand and review our current 2020 budget, 2) The format for the new budget to reflect the WMP format, 3) Identify Board priorities for 2021, and 4) Set goals or targets for the overall 2021 budget and levy.

To support the start of the 2021 budget process, Administrator Doneux drafted documents that compares the current 2020 adopted budget with the items identified in our new WMP for 2021. The actual 2021 budget will be based on the items from WMP for 2021 but adjusted to reflect what programs and projects that are expected to be implemented next year. Administrator Doneux asked the managers for their thoughts regarding the budget. Manager Sanders suggested keeping the 2021 tax levy the same as 2020 with no increase and no decrease. Manger Jones asked about how much of an increase would be needed to maintain the same actual levy due to a likely decrease in property tax payments caused the COVID-19 pandemic and recent property damage. Administrator Doneux stated that a 1-2 percent increase may be necessary to achieve the actual planned levy revenue. President Collins and Manager Jones shared concerns about property values and property tax deductions on larger commercial properties. Managers shared questions regarding paying off the bond early and the savings. Administrator Doneux shared that paying off the bond early would save $30,000 - $50,000. Mangers agreed that they are comfortable with no increase in the tax levy. Manager Jones and Manager Sanders both felt that a 2-3 percent increase would be acceptable to protect the fund balance if necessary. Manager Texer suggested a 1-2% increase just to protect the budget from dropping property values resulting in less revenue. President Collins asked the managers how they felt about a 1-2% increase. Managers agreed that an increase may be needed.

Manager Texer shared concerns for partners future needs and CRWD having the funding available to help.

Administrator Doneux stated that staff will begin drafting the 2021 budget and levy based on Manager input and thanked the Managers for the thoughts and perspectives on the budget.

Permit Applications and Program Updates A) 20-015 Ford Site Wetland (Martinkosky)

Mr. Martinkosky reviewed permit #20-015 for Ford Site Wetland. The applicant, Ryan Companies is applying for a wetland replacement plan that impacts the Ford Site Redevelopment project. The applicable district rule is E. The disturbed area of this project is 123 acres with 91 acres impervious surface.

Approve variance of up to 25 feet from the required wetland buffer for the western and southern boundary of Wetland A (<1 to 10-foot buffer) and 15 feet from the required wetland buffer for the western boundary of Wetland C (~10-foot buffer) along the western wetland boundary. Attorney Mogen asked for clarification of the variance. Manager Texer asked if there was anything that could be done to improve wet land A. Mr. Martinkosky responded that it is not required in the permit.

Motion 20-100: Approve variance for permit #20-015 Ford Site Wetland.

Murphy/Sanders Unanimously Approved Motion 20-101: Approve permit #20-015 Ford Site Redevelopment Wetland Permit with 5 Conditions: 1. Receipt of $37,986 surety.

2. Revise the Wetland Replacement Success Criteria to address the following: a. Wetland hydrology monitoring must occur for 5 years or until 2 consecutive years with normal precipitation meet the Hydrology Criteria. b. Upland buffer vegetation criteria shall include a minimum of 80 percent relative cover of native, non-invasive species.

3. Provide planned location of monitoring well(s) in the figures and provide justification for the planned number of monitoring wells.

4. Revise structural components monitoring such that corrective action is taken if there is an elevation change of 0.2 feet or greater of the control structure system.

5. Add the following notes to the Wetland B Expansion Plan: a. Specify that subsoil in the upland buffer and mitigation area shall be ripped a minimum of 12â&#x20AC;? to reduce compaction and promote long-term plant growth. b. Add one foot or less elevation markings to the wetland profiles. c. Provide spot elevation at bottom edge of upland buffer. d. Specify that erosion control blankets used in the mitigation area and upland buffer must be composed of natural (ie. non-plastic) materials.

AR: Approve Salary Structure Update (Doneux)

The Board of Managers adopted a Personnel Policy Manual in 2003. The Personnel Policy Manual provided the Board, Personnel Committee and Administrator general guidance with regards to establishing new positions, setting salary ranges and general wage and salary administration. In 2005, the Board adopted the Performance Based Salary Increase Guidelines to provide further guidance for annual salary adjustments using a performance-based system. In 2009, the District adopted a new Salary Administration Policy. The goal of the new policy was to establish a uniform salary structure for the District and provide clear steps (zones) within each grade and to adopt a clear system to allow greater professional development for staff within the District. The Salary Structure was updated in 2011 and 2016. In 2018, work was started on both the next update of the Salary Structure as well as a comprehensive update on all the position descriptions. In addition to updating the salary structure, staff have observed that there is significant salary overlap between several of the grades in the current system. It is not uncommon to move an employee up two grades to reach a comparable salary level during a promotion. To reduce this occurrence, staff evaluated if there was a possible modification that would have no Zone 2 overlap of salaries. Staff worked with the Districtâ&#x20AC;&#x2122;s HR consultant, Arthur J. Gallagher, & Co., to evaluate this approach and to recommend overall adjustments to the salaries in the Salary Structure to reflect current conditions. The updated salary structure reflects a 2% increase to adjust for the current market rates. While the work on the position descriptions has not been completed the Salary Administration Policy is being recommended for an update.

AR: Approve Establishment of Permit Program Manager (Kelley)

Mr. Kelley reviewed that since in 2013, CRWD established four new Divisions to the management and staffing structure of the District. The Regulatory Division currently includes 3 permanent staff and one seasonal employee to implement assigned program initiatives within the Watershed Plan. Over time, the daily tasks associated with processing permits have been transferred from the Division Manager to other staff. In order to more accurately reflect current work assignments, and to recognize significant efforts and additional responsibilities, Mr. Kelley requested the Board of Managers establish the Permit Program Manager position within the Regulatory Division, and recommend Elizabeth Hosch be promoted to Program Manager II to fill this position. President Collins said she was well deserving of the promotion.

In accordance with the District Salary Administration Policy, the Personnel Committee and Board of Managers must approve any change in Grade for an existing employee. The Personnel Committee has met and supports this promotion.

D)

AR: Approve Contract Amendment with Barr Engineering for Seminary Pond Project Bidding and Construction Engineering Services (Eleria)

Ms. Eleria reviewed for the past several years, CRWD and the City of Lauderdale have been working together to identify opportunities to address existing water quality and quantity issues within our shared boundaries.

Seminary Pond, a regional stormwater pond built over 20 years ago serves a 128-acre sub watershed, was determined to be the best location for mitigating stormwater runoff volumes and pollutant loads. CRWD hired Barr Engineering to assist with designing improvements to Seminary Pond and nearby eroded areas to minimize downstream flooding and reduce pollutant loading to the Mississippi River. The pond improvements include: 1) deepening and regarding the pond to convert it from a dry pond to a wet pond; 2) installing two iron-enhanced sand filter benches and pretreatment structures; and 3) stabilizing up to three slopes upstream of the pond. CRWD and Barr have completed the engineering plans and are working on the contract documents for the project. Barr’s existing agreement with CRWD has covered their engineering work through preparation of the contract documents. Staff are seeking Board approval of an amendment to Barr’s agreement for bidding and construction engineering services. The estimated cost is $73,200, which will be funded by Project #16886. This project has a 2020 budget of $500,250. Ms. Eleria added that are also seeking Board approval of the amendment to Barr’s consultant services agreement. Ms. Eleria provided the Board an update on the project design, anticipated bidding and construction schedule and draft cooperative agreement with partners. Manager Murphy asked about the drainage near the golf course. Manager Murphy also asked about a neighbor wanting the drainage changed.

Ms. Eleria has had several conversations with the family.

Motion 20-105: Approve an agreement amendment #4 with Barr Engineering for bidding and construction engineering services for the Seminary Pond Improvement Project in an amount not to exceed $73,200; and authorize the Administrator to approve additional engineering services in an amount not to exceed $10,000.

E)

AR: Authorize Notice of Award and Order Construction for Como Zoo and Golf Course Stormwater BMP Project (Kelley)

Mr. Kelley reviewed that in 2016, CRWD was awarded a $1.76 million grant through BWSR’s Targeted Watershed Program (TWP) for work in the Como and McCarrons sub watersheds. Two of the BMPs are located on the Como Park Golf Course – expansion of the existing Polar Bear Infiltration basin and installation of an underground infiltration pipe gallery at Hole 7, and an Iron-Enhanced Sand Filtration (IESF) bench along the east shoreline of the Northwest Pond between Holes 3 and 11. The bidding for the project extended over a three-week period from May 5th to May 22, 2020. CRWD received bids from six contractors. Rachel Contracting, LLC submitted the lowest bid at $1,420,890.20. A majority of the cost discrepancy is attributed to a few bid items that came in higher than expected. The golf course specialist restoration work came in $118,000 higher than estimated, and the Opti RTC system and impermeable liner for the filter were around $40,000 higher each. Rachel Contracting provided the necessary Responsible Bidder Evaluation Form and demonstrated the experience and ability to complete the required work.

CRWD has worked closely with City Parks staff, critical partners in moving this project forward, to ensure the project minimizes impacts to the golf course. As part of the Cooperative Construction Agreement, CRWD is

providing $85,000 towards the construction of the Hole 8 lift station, and $12,500 (50%) for consultant services to incorporate golf course and irrigation restoration plans into Houston’s bid plan set and for observation and oversight during construction. Work is anticipated to start this summer and be complete by the spring of 2021.

The 2020 budget for the Como Zoo and Golf Course BMPs is $940,220.

Motion 20-106: Order construction of the Como Zoo and Golf Course Stormwater BMPs and authorize the Board President and Administrator to execute a Notice of Award and an Agreement with Rachel Contracting, LLC, subject to the review and approval of the Ramsey County Attorney; and authorize the Administrator to execute change orders in an amount not to exceed $75,000.

AR: Authorize Public Comment Period for 2019 MS4 Annual Report (Funke)

Ms. Eleria reviewed that as a regulated operator of a small municipal separate storm sewer system (MS4), CRWD is required to prepare and submit an annual report of activities and accomplishments associated with its stormwater pollution prevention program (SWPPP) by June 30th to MN Pollution Control Agency (MPCA). CRWD must solicit public comment on the MS4 annual report and hold an annual public meeting to present the SWPPP activities and accomplishments made each year. CRWD staff have summarized CRWD’s stormwater management activities and accomplishments in 2019 in an MS4 Annual Report Form provided by MPCA and CRWD’s 2019 Annual Report submitted to BWSR earlier this year.

CRWD staff propose that the public comment period on CRWD’s 2019 SWPPP work commence on June 4th and end on June 28th and the public meeting for presenting this work occur at the second June Board meeting, June 17th. Announcements of the public comment period and public meeting will be published in the Saint Paul Pioneer Press and CRWD’s website. The 2019 annual report will be available on CRWD’s website. Ms. Funke will present at the June 17th meeting Motion 20-107: Authorize public comment period on CRWD’s MS4 Annual Report for 2019; and approve the June 17, 2019 Board meeting as the public meeting date for the annual report.

Background As a regulated operator of a small municipal separate storm sewer system (MS4), CRWD is required to prepare and submit an annual report of activities and accomplishments associated with its stormwater pollution prevention program (SWPPP) by June 30th to MN Pollution Control Agency (MPCA). CRWD must solicit public comment on the MS4 annual report and hold an annual public meeting to present the SWPPP activities and accomplishments made in the previous year.

Issues The June 17th Board meeting serves as CRWD’s annual public meeting for its SWPPP. CRWD staff will give a brief presentation of CRWD’s stormwater management accomplishments and accept comments from the public. Any comments received at the meeting or in writing by June 28th will be considered and if appropriate, incorporated into the annual report.

Action Requested Authorize Administrator to submit CRWD’s MS4 Annual Report for 2019 and to reasonably incorporate comments received during the public comment period. enc:

Capitol Region Watershed District partners with the City of Saint Paul (Phase I MS4) and contracts with Hamline University to implement the Adopt-A-Drain (AAD) program. The program goal is to improve water quality by empowering local community members to take visible, tangible, and meaningful action towards responsible management of water resources by “adopting a storm drain”. Actions include signing up online, collecting and removing debris from the storm drain and reporting how much was collected and removed. There are currently over 600 residents participating in the program in the City of Saint Paul / CRWD.

Background CRWD’s 11-year capital improvement plan (CIP) for TBI identifies two major CIP repairs in sections of tunnel that are in fair to poor condition. The first CIP project involves addressing areas with deteriorating concrete and exposed reinforcement, sealing holes, cracks and fractures, and removal of sediment in over 2,200 feet of tunnel near Phalen Boulevard and I-35E in Saint Paul. The estimated construction cost is $1,040,000.

Issues Barr Engineering has prepared the enclosed draft work order for designing repairs from TBI Station 28+65 to 50+72. Tasks include pre-design in-tunnel inspection to determine the estimated quantities for each type of repair, designing the tunnel repairs, estimating construction cost, preparing bidding/contract documents, and administrating the bidding process. Barr will utilize and modify where feasible existing repair details and specifications from previous TBI projects for the specific TBI profile, cross section and project conditions. The estimated engineering cost is $82,845. The 2020 budget for TBI Repairs is $566,250.

CRWD staff anticipate the following schedule for the entire project: 1) design of repairs from July – Dec. 2020; 2) bidding in late winter 2021; and 3) construction in fall 2021/winter 2022. CRWD staff will review the repairs needed and proposed engineering scope of work with the Board at the meeting.

Action Requested Approve TBI Work Order No. 14 in an amount not to exceed $82,845 and authorize Administrator to execute TBI Work Order No. 14 and amendments not to exceed $8,300.

Scope Language

CRWD requests that Barr perform the work described below in accordance with the terms of the above referenced Agreement.

The Capitol Region Watershed District (CRWD) prepared an 11-Year Capital Improvement Plan (CIP) as part of the 2019 Trout Brook Storm Sewer Interceptor Inspection Report and Capital Improvement Plan (Barr, 2020).

Barr’s 2019 inspection report (Barr, 2020) provides recommendations for repairs to maintain the integrity of the TBI. The objective of this work order is to assist the CRWD with final design of the repairs, as well as preparation of contract documents for construction. Construction is anticipated to begin during the winter of 2020-2021.

The following tasks are included in Barr’s scope of work for final design and preparation of contract documents for this project.

Task A—Preliminary Tasks

Existing drawings and the 2019 inspection report (Barr, 2020) will be utilized as a basis of preliminary design. The efforts associated with this task are described below.

1. Review Existing Information: Review reports, drawings, utility data, street information, etc.

Identify access locations and potential methods for water diversion/control.

2. Quantity Inspection: Perform in-tunnel inspection to determine the estimated quantities for each type of repair, to be used in the bidding documents. For this effort, Barr assumes one (1) day of inspection utilizing two (2) in-tunnel inspectors and one (1) surface attendant. Staff will evaluate whether this task can be performed safely in accordance to State of Minnesota, CRWD and Barr’s COVID-19 social distancing requirements prior to the inspection.

Based on the findings of the quantity inspection described in Task A, Barr will design repairs for the rehabilitation segment. The efforts associated with this task are described below.

2. Defects Tabularizing: Create tables that summarize the defects and repair types which will be utilized in the design plan and profile drawings.

3. Repair Details: Determine typical repairs and materials for the following items: a) Repair/replace manhole steps b) Crack sealing c) Repair/fill holes in tunnel wall d) Repair/fill holes in tunnel invert e) Seal/and or repair exposed rebar f) Concrete repair g) Sediment and debris removal Deliverables: Periodic communications, emails, etc.

The Bidding Documents will provide potential contractors with the necessary information to bid on the project and perform the work. This task does not include copying and distribution of Contract Documents. Budget includes incorporating one (1) round of CRWD edits.

We anticipate that bidding will occur in 2020 for 2021 construction.

Task E – Bid Administration

This task includes Barr providing bid administration services for one (1) round of bidding under this work order. The efforts associated with this task are described below.

1. Pre-Bid Meeting and Walk-Through: Barr will schedule and conduct a pre-bid meeting and prepare an attendance roster and meeting notes, as necessary. The pre-bid meeting could include a pre-bid walk-through with CRWD staff and potential bidders. Staff will evaluate whether the walk-through can be performed safely in accordance to State of Minnesota, CRWD and Barr’s COVID-19 social distancing requirements.

We will use an online bidding distribution system such as QuestCDN to distribute bidding documents and to maintain a record of prospective bidders. b) Barr will address prospective bidder questions during the bidding period. c) Barr will prepare and issue up to two (2) addenda as appropriate to interpret, clarify, or expand the bidding documents. d) Barr will schedule and conduct the bid opening, prepare bid tabulation of all bids and assist the CRWD in evaluating bids. e) Barr will assist CRWD in selecting the Successful Bidder. f) Barr will assist CRWD with assembling and awarding the contract to the Successful Bidder. We will also attend the CRWD Board meeting to discuss the bids, if desired.

Deliverables:

1. Meeting minutes and addenda.

Task Fâ&#x20AC;&#x201C;Permitting & Easement Coordination

We assume CRWD will take the lead on permitting and easement acquisition. Barr will assist CRWD with permitting services. The efforts associated with this task are described below.

1. Assistance to CRWD: a. Preparation of MDNR Protected Waters or construction dewatering permit (confirm with DNR). b. Assistance with temporary construction easement issues for contractor staging area, TBI access, etc. c. City of Saint Paul, Ramsey County, MNDOT, BNSF coordination, others (if necessary). d. National Pollutant Discharge Elimination System (NPDES) construction permit and preparation of a Storm Water Pollution Prevention Plan (SWPPP) is not anticipated unless the project includes grading over one acres of land for construction access or staging areas. e. All permit fees will be provided by CRWD. Task G â&#x20AC;&#x201C; Project Management and Meetings

Project management tasks and two (2) meetings are included in the scope so District staff and managers are well-informed of the project status. The efforts associated with this task are described below.

Compensation and Assumptions ("Service Assumptions") Upon Which compensation is based

Compensation shall be on a time and expensed basis in accordance to the referenced Agreement. The cost of the services shall not exceed $82,845 without prior approval by the CRWD. Note the following assumptions: 1. Scope does not include construction administration tasks.

2. Scope does not include preparation of documentation report.

3. Scope assumes that the front end documents for the 2020 Seminary Pond Improvements project will be used for this project.

4. Scope does not include detailed design of dewatering system if the Contractor deems this is necessary to construct the project.

5. Geotechnical or environmental borings are not anticipated and are not included in the scope.

6. The scope does not include additional survey.

7. The cost estimate is based on 2020 fee schedule and assumes work is completed during 2020.

Background The St. Paul School of Northern Lights is seeking a $28,550 grant award from CRWD toward the development of clean water practices on their site. The St. Paul School of Northern Lights is located in the West 7th Neighborhood of Saint Paul, at 426 Osceola Ave S. The proposed project includes removing five parking stalls and replacing with a 750 square foot curb-cut rain garden that will capture 21,869 square feet of parking lot runoff annually.

Issues CRWD and RCD have provided a watershed analysis and developed construction site plans for the proposed rain garden. The 750 square foot rain garden will include two curb-cuts with pretreatment devices. The rain garden is sized to capture and infiltrate 0.6â&#x20AC;? rain events from the Schoolâ&#x20AC;&#x2122;s parking lot.

The rain garden will capture 11,146 cubic feet of water per year (a 73% reduction). Total suspended solids and total phosphorus will be reduced by 72% and 73%, respectively.

The contractor estimates a project cost of $30,053.00. Using the Stewardship Grant Calculator, staff have calculated a total CRWD award not to exceed $28,550. This grant award is reflective of the water quality benefit this project would provide. CRWD also plans to provide educational signage for the rain garden. A minimum 5% match is required for non-profit grant applicants. The School will cover the remaining costs of the project.

Action Requested Approve a grant award to the St. Paul School of Northern Lights for an amount not to exceed $28,550 and authorize the District Administrator to execute the grant agreement.

All labor and material is conclusively accepted as satisfactory unless expressed in writing within 60 days of performance. All agreements are contingent upon strikes, accident or delays beyond our control.

Damage to driveways, underground structures (wires, cables, irrigation) is the responsibility of the party accepting this agreement. Measures shall be taken on the part of Outdoor Lab Landscape Design, Inc to ensure the site is prepared to prevent foreseeable damage due to weather during the installation period. Any delays or damage to landscaped area due to weather may be charged over and above this estimate.
