 Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from one inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious onsite is 66,498 square feet. b. Volume retention: Volume Retention Required (cu. ft.) Volume Retention Provided (cu. ft.)

5. Best management practices achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A recordable executed maintenance agreement has not been submitted.

Adequate maintenance access is provided for the underground system.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA.

2. Compensatory storage is not needed.

3. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted and satisfies NPDES requirements.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

HISTORY & CONSIDERATIONS: This project is located within the Mississippi River Floodplain and will likely cause a net increase in flood storage. The applicant anticipates future development that will return the site to the existing flood storage level.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. The Mississippi River 1% annual chance flood elevation is at 708.3 feet according to the Ramsey County Flood Insurance Study Floodway Data Tables.

2. The total floodplain impact is 155,509 cubic feet.

3. Compensatory storage of 220,414 cubic feet is provided. The applicant anticipates future development returning the flood storage to the existing condition.

4. It is not known if all habitable buildings, roads, and parking structures adjacent to the project site comply with CRWD freeboard requirements.

However, adequate conveyance of stormwater has been provided and no new buildings are proposed on site.

Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is submitted to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. . Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system. The applicant has requested a variance from the rate control requirements. Variance Request Findings: a. There are existing flooding issues on private property that necessitate increased pipe sizes. b. There is drainage directed through private property that will be routed through the public drainage system. c. The downstream pipe system and wetland system is capable of safely conveying the increased rates without erosion concerns.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from one inch of rainfall over the impervious surfaces of the development. a. f. Stormwater runoff is pretreated to remove solids before discharging to infiltration areas.

4. Alternative compliance sequencing has not been requested.

5. Best management practices achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. CRWD has a memorandum of understanding with the City of Roseville concerning stormwater maintenance. Adequate maintenance access is provided for all surface and underground systems.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. It is unknown if all habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

However, adequate conveyance has been provided.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. The project intersects a wetland that is approximately 35.5 acres.

2. It is not known if wetland boundaries have been delineated and approved by CRWD staff.

3. Approximately 2,080 square feet of wetland impact are proposed.

4. WCA sequencing has not been adequately addressed. The applicant submitted plans to impact wetlands without presenting actions taken to avoid and minimize impacts.

5. Mitigation of wetland impact is proposed by replacing impacted wetland area at a ratio of 2:1 in an area immediately adjacent to the existing wetland.

6. A minimum buffer of 25 feet has not been provided.

7. A separate permit application will be submitted for Wetland Management Rule E. RULE F: EROSION AND SEDIMENT CONTROL

Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted and does not satisfy NPDES requirements.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Sheet 23 - Indicate what material will be used to permanently stabilize the overflow structure on the proposed sedimentation pond. e. Sheet 24 - Clarify intent for the existing storm sewer flowing north from CB-8A. It appears that the project will bulkhead the existing pipe to direct flow to the underground infiltration trench but it is not explicit. f. Sheet 25 - Indicate/provide a permanently stabilized overflow structure for the rain garden. Indicate what material will be used.

6. Revise SWPPP to include the following: a. Infiltration perimeter control and erosion control practices shall remain in place until the final completion of the project or vegetation has been established (whichever is later). b. Installation of infiltration practices shall be done during periods of dry weather and completed before a rainfall event. Placement of engineered soils shall be on dry native soil only. c. The bottom surface of excavation shall be level without dips or swales. d. Engineered soil shall remain uncontaminated (not mixed with other soil) when installed. e. During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment.

7. Provide a landscaping plan to vegetate the rain garden. Basin seeding should be avoided.

Permit Applications and Program Updates A)

Public Hearing for Proposed Rule Revisions (Kelley)

President Collins stated that a public hearing is being held for CRWD’s proposed rule revisions. The Technical Advisory Committee (TAC) meeting was held on January 29, 2015 and the committee discussed revisions that were approved by the Board of Managers. A 45-day review and comment period began on February 6, 2015 and ends on March 23, 2015. The public hearing is intended to provide a chance for stakeholders to present issues, concerns or other discussion items pertaining to the proposed rule amendments.

Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

Mr. Kelley reviewed the two major amendments to the rules. The current volume reduction standard is 0.9 inches of runoff over impervious surfaces. The staff is recommending 1.1 inch volume reduction standard without using an initial abstraction. Most other watersheds have a 1-inch standard (or do not have a standard).

The second major amendment is regarding infiltration. The current rule states if you cannot infiltrate then filter runoff for a 70% credit towards volume reduction. Studies show that filtering may not be as effective as previously thought. By adding iron to the filter it would remove more of the dissolved phosphorous so an 85% credit would be provided. Only a 55% credit would be given for regular filtration.

Mr. Kelley reviewed Permit #14-037 YMCA. The applicant, YMCA Twin Cities, is constructing an infiltration pond and one underground perforated pipe system. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.33 acres with 1.01 acres of impervious surface.

Motion 15-048: Approve permit #14-037 YMCA with 3 conditions: 1. Receipt of $5,000 surety and documentation of recorded maintenance agreement with Ramsey County.

2. Provide a copy of the NPDES permit.

3. Increase catch basin CB J sump depth to a minimum of 3 feet on sheet C300. The Minnesota Stormwater Manual recommends a minimum sump depth of 3 feet for pretreatment sumps.

Mr. Kelley reviewed Permit #15-002, 2700 University, who is the applicant requesting the review period be extended. The site soil conditions are currently being evaluated by staff for contamination from past uses. It is anticipated the permit will be up for review by the Board of Managers Meeting on March 18th.

Motion 15-049: Approve a 60-day extension of the review period for Permit #15-002 to expire on May 12, 2015.

Permit #15-005 Murray Middle School (Kelley)

Mr. Kelley reviewed Permit #15-005. The applicant St. Paul Public Schools is reconstructing the school parking lot with an underground infiltration system. The applicable rules are Stormwater Management (Rule C), Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.07 acres with 0.77 acres of impervious surface.

Motion 15-050: Approve permit #15-005 Murray Middle School with 6 conditions: 1. Provide a copy of the NPDES permit.

2. Revise Plans to be consistent. On sheet C-200, the MH 111 note states that the pipe to the north is an 8 inch PVC. The note for this pipe on sheet C-200 states it is 24 inches. The note on sheet C-503 states it is 24 inches.

3. Provide a cross section or typical detail of the surface basin that includes the following: a. Planting media shall be 80% sand, 20% compost b. Basin bottom elevation. c. Specify sod to vegetate the detention basin. Basin seeding should be avoided.

4. Revise plans to include the following: a. Note that, “poor soils shall be excavated to soils conducive to infiltration and backfilled with clean washed sand.� b. Provide grading plans for the detention basin consistent with the XPSWMM model. c. Update the orifice diameter in the proposed CB 105 to 12 inches to be consistent with the XPSWMM model. d. Extend the silt fence perimeter control along the east edge of the property. It appears that runoff may leave the site at several locations along this border. e. Specify additional inspection ports for the underground system approximately 20 feet from the south end of the system. Adequate maintenance access is needed to ensure the longevity of the system. f. Specify and show a permanently stabilized emergency overflow for the surface basin.

5. Revise SWPPP to include the following: a. A temporary construction entrance at all locations construction access will take place. b. Infiltration perimeter control and erosion control practices shall remain in place until the final completion of the project or vegetation has been established (whichever is later). c. Installation of infiltration practices shall be done during periods of dry weather and completed before a rainfall event. Placement of engineered soils shall be on dry native soil only. d. Excavation of infiltration areas shall be completed using a backhoe with a toothed bucket. e. Native soils in infiltration areas shall be de-compacted to a minimum depth of 18 inches prior to placing engineered soil. f. The bottom excavation surface of infiltration/filtration areas shall be level without dips or swales. g. Engineered soil shall remain uncontaminated (not mixed with other soil) when installed. h. During construction, stormwater must be routed around infiltration areas until all construction activity has ceased and tributary surfaces are cleaned of sediment.

6. Provide a site specific plan, schedule and narrative for maintenance of the proposed stormwater management practices.

Mr. Kelley reviewed Permit #15-006. The applicant, Xcel Energy is replacing a natural gas distribution pipeline. The applicant has requested a variance from the requirements of Rule C. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 4.85 Acres with 4.45 Acres of impervious surface.

Motion 15-052: Approve permit #15-006 Xcel Gas Phase III with 4 conditions: 1. Receipt of $22,250 surety 2. Provide a copy of the NPDES permit.

3. Provide erosion control between any work areas and the basin located south of Sycamore and north of the railroad.

Motion 15-054: Approve Certificate of Completion for permit #09-015 A-1 Auto Jones/Texer Unanimously approved Ms. Hosch reviewed Permit #09-026 Brookfield Renewable Power. The final inspection was conducted to confirm flood wall and erosion repair work in late 2009, early 2010. No stormwater treatment was required for this work. Submitted surety is available for return in the amount of $500.00.

The final inspection has been conducted confirming complete construction and final stabilization for trail rehabilitation and erosion repair along the Villa Park sediment pond. No stormwater treatment or surety were required for this work.

Special Reports – 2014 Trout Brook Storm Sewer Interceptor Inspection Report, Barr Engineering

Ms. Eleria reviewed that in summer of 2014, CRWD’s Board of Managers authorized Barr Engineering to conduct a full system inspection of the conditions within the Trout Brook Storm Sewer Interceptor (TBI). The last inspection of TBI was conducted in June 2007. Some sections of the tunnel are 100 years old. About six miles (31,000 feet) of the TBI system was visually inspected from July 2014 to November 2014.

Ms. Eleria introduced Nathan Campeau from Barr Engineering. Mr. Campeau reviewed the draft report prepared by Barr summarizing the inspection findings, highlight changes in tunnel conditions from previous inspections, rating the condition of TBI sections and recommendations for future repairs. The interior of the tunnel was inspected for invert integrity, settlement, sediment, cracks, voids and other defects. The entire inspection took eleven days to complete. Mr. Campeau reviewed the method for grading the condition of the tunnel on a scale of 0-5. Grade ratings of 4 noted areas that were in poor condition. Grade ratings of 5 noted areas that were in urgent need of repairs. Mr. Campeau reviewed the areas that were rated with 4 and 5.

Recommendations were made for these areas.

Ms. Eleria reviewed the findings of the one-year warranty inspection for the realigned TBI sections near 35ECayuga and adjacent older sections that was conducted last year. New cracks were found in the haunches and crown of the new sections and expansion of existing fractures were observed in the older sections. It was determined that CRWD’s contractor, Veit, was not responsible for these defects. CRWD and Barr staff suspected MnDOT construction activities could have impacted TBI. Staff met with MnDOT to discuss concerns. MnDot is assuming responsibility for cracks in the new tunnel caused by their soil overloading. of drafting an agreement to address the damage and remedy the repairs. No Action was requested. The Board of Managers thanked Mr. Campeau and Ms. Eleria for their work on this project.

Approve Work Plan and Budget for Ford Site Stormwater Evaluation (Fossum)

Mr. Fossum reviewed that the former Ford Assembly Plant will be redeveloped in the coming years on more than 135 acres of land situated along the Mississippi River. The City of St. Paul’s vision for the site is that it will be a livable, mixed-use neighborhood that looks to the future with clean technologies and high quality design for energy, buildings and infrastructure. This site will support walking, biking, transit, provide services, jobs and activities that every generation can enjoy.

The City of St. Paul has requested assistance in planning for stormwater management, green infrastructure, and water feature development on the former Ford Site. In 2009 the City of St. Paul contracted with Barr Engineering Co. to complete preliminary evaluations of stormwater management alternatives at the Ford site. District and City staff have worked with Barr Engineering to develop a scope of work for additional analysis to inform planning efforts.

Motion 15-058: Approve budget and work for Phase One of the Ford Site Stormwater Evaluation; and authorize Administrator to execute a consultant services agreement with Barr Engineering Co. for an amount not to exceed $35,000.

Reider/Texer Unanimously approved C) AR: Approve Cooperative Construction Agreement with the City of Roseville and Authorize Bidding for the Upper Villa Park Stormwater Improvement Project (Kelley) Mr. Kelley reviewed that the District was awarded a $275,000 Clean Water Partnership grant in 2012 for the identification, design, and construction of volume reduction practices in the Lake McCarrons subwatershed. In January 2014, the District was awarded $360,000 Clean Water Fund Grant towards construction of the combined infiltration/harvest and reuse BMP underneath the upper Villa Park softball field.

SRF Consulting Group has completed 90% plans. CRWD and Roseville staff have reviewed the plans and provided comments to be incorporated into the final plan set. Project specifications are nearing finalization for review by the Ramsey County Attorney.

Mr. Kelley said that the City of Roseville staff anticipates approval of the Joint Powers Agreement at the March 9th City Council Meeting. Construction for the project is anticipated to begin in late October 2015.

2015 Lake McCarrons Aquatic Plant Harvesting (Zwonitzer)

Mr. Zwonitzer reviewed that in 2013, the Lake McCarrons Homeowner Association requested funding from CRWD to facilitate vegetation management on the west end of the lake. In 2014, CRWD coordinated permitting and two rounds of harvesting for 31 homeowners. The total project cost was $27,150 (not including staff time), and $2,055 was paid by homeowners. At the time, CRWD was clear with homeowners that 2014 was a trial year and the CRWD Board would be reevaluating its involvement in harvesting activities for 2015. Mr. Zwonitzer reviewed there are three reasons to pursue vegetation harvesting; invasive species control, water quality improvement, or recreational/aesthetic improvements.

It appears that vegetation harvesting on Lake McCarrons is not needed for invasive species control, is not a costeffective means of improving water quality, and has very limited benefit to the general public. St. Paul coordinates harvesting for Lake Como and Lake Phalen to control EWM and improve lake-wide recreational access. In most cases, near-shore harvesting is managed by individual homeowners or a lake association.

Mr. Zwonitzer requested feedback from the Board of Managers to help determine the best approach for harvesting on Lake McCarrons in 2015. Manager Thienes has met with Mr. Zwonitzer and Administrator Doneux and they agree that weed harvesting should only be conducted in the channels this year and this year will be a transition year of shifting the cost to the homeowners. The Managers agreed that option two, one round of weed harvesting in the channels should be the approach for this year. The homeowners would be able to harvest additional rounds at their own expense. Option two would help reduce the amount of staff time. The Managers agreed that weed harvesting is not a cost effective way to improve the water quality of Lake McCarrons.

Motion 15-061: Authorize staff to proceed with option two weed harvesting on Lake McCarrons for 2015.

Unfinished Business A) Eustis Street Stormwater Improvement Project Update (Eleria)

Ms. Eleria reviewed that in late July 2014, CRWD’s Board of Managers approved Barr Engineering as the consultant for the Eustis Street Stormwater Improvement Feasibility Study in Lauderdale, MN. The goals of the study are to identify opportunities for implementing green infrastructure practices in both public and private property along Eustis Street. Ramsey County street work will include mill and overlay and construction of a new, 5-foot sidewalk on the east side of Eustis Street. The feasibility study began without the involvement of the property owner of the former Luther Seminary property because the real estate transaction extended through fall 2014.

Barr Engineering has completed its site analysis and developed preliminary green infrastructure concepts along Eustis Street. These concepts were presented to the study partners including the new owner of the former Luther Seminary property, Aspen Waste Systems, in early February. The partners are currently reviewing the concepts and will be providing feedback in March.

The information was reviewed to update the Managers. No action was requested.

C) Cottage Wetland (Doneux) Manager Texer reviewed that Barr Engineering presented the District 6 Natural Resource Inventory at the January 21, 2015 Board of Managers meeting. In the NW corner of parcel 1, an area of land was identified available for sale. This area of land is adjacent to existing wetlands. At the January 21, 2015 meeting the managers agreed that this area is important to protect. Administrator Doneux has talked to Gaughan Companies, the listing agent of the property. The site is being marketed for up to 50 units of apartment use or senior housing. Nothing is currently built on the site. Administrator Doneux recommended an appraisal be obtained and discuss with Attorney Mogen.

Motion 15-062: Authorize Administrator Doneux to obtain an appraisal of the area of land near the Cottage Wetlands for informational purposes.

Administrator Doneux announced that two abstracts were accepted for StormCon conference in Austin, Texas in August. The Lowertown Ballpark and Curtis Pond were both selected. The Managers agreed to send partners to co-present, Wes Saunders-Pearce with the City of St. Paul and Kristine Giga with the City of Roseville.

Request for proposals have been distributed to four consultants for the Lafayette Park Campus. Proposals are due back by March 18th. Administrator Doneux requested that one or two Managers serve on the review committee. President Collins and Manager Reider will assist with the review and Manager Thienes will serve as an alternative if needed.

Administrator Doneux requested a meeting with the Building Committee, Managers Thienes and Texer.

They will meet March 16th at 4:30 with March 18th as an alternative date.

The MAWD Legislative Reception Day at the Capitol is scheduled for March 11th. President Collin will be attending.

Administrator Doneux announced that he will be out of the office the week of March 9th. Ms. Eleria will be the acting Administrator in his absence.

Administrator Doneux asked the Board of Managers for feedback on cutting back on the printing of packets for the meetings. During the meeting, Manager Reider tested viewing the packet with the use of an iPad. The Managers agreed to try reducing printing by excluding maps and attachments with the Board’s printed packet.

Issues The District Accountant Redpath has been in the process of changing the accounting software to Sage 100. The new software will enable staff to view project budgets with real time expenses. Because most staff are salaried and now entering their time directly into Sage, payroll expenses are going directly to a job cost using a burdened hourly rate that includes all benefits per employee. Because of the burdened hourly rate and the timing of when invoices are entered into the new software, the amount of the accountants payable will not match the budget report.

Background Each year the District has a contract with the State of Minnesota – Office of the State Auditor to conduct our annual audit.

Issues The District annually executes a Letter of Understanding with the Office of the State Auditor. The 2014 audit will begin around April 1, 2015 and is expected to be completed in mid-May 2015. The results of the 2014 audit and copies of the financial statements are included in our annual report.

Background For the past year CRWD has been actively using a web-based BMP database to track projects in its permit, grant, and capital improvement project programs. The database allows access to project information from anywhere that has an internet connection. It is used to track project progress, summarize CRWD activities and associated environmental benefits, and helps make information accessible to the public and other partners through an online mapping tool.

Issues After a year of use CRWD staff are finding new ways to use the database, as well as many opportunities for improvements. There are currently 1,114 BMPs entered in the database and staff are getting close to completing data entry for all historic projects. The database is hosted and maintained by Houston Engineering Inc. who were also the developers. Staff have identified many opportunities to advance the database that will improve work flow and allow for more detailed analysis. Some of the improvements include:  Advanced data searching, sorting, and exporting  Improved mapping capabilities with additional tools  Database outputs including detailed summaries of projects, mailings, inspection reports etc.  Variety of organizational and formatting improvements A detailed scope of the maintenance and improvements items is enclosed. The estimated cost for making improvements is $17,563, and hosting and maintenance is a flat fee of $4,300 for a total of $21,863 in 2015. Funding for these improvements will come from fund #225-15303 (BMP Database maintenance/updates). Though there will always be opportunities to improve the functionality of the database, staff anticipate the annual cost for improvements will be significantly less in future years as fewer improvements will be needed.

(“Engineer”) and the Capitol Region Watershed District (“Owner”) for this project.

The Scope of Services under this agreement includes the proposed tasks HEI agrees to complete. The compensation for this agreement is listed by task below. I believe this Agreement accurately sets forth our understanding. CRWD 2015 Web Hosting and Technical Support Agreement

Exhibit A – Scope of Services Task 1: GIS Viewers Web Hosting This agreement authorizes HEI to host the Capitol Region Watershed District (CRWD) GIS map viewer and Am I in the Watershed applications. Web hosting will be charged at $25/month. This agreement is for the web hosting from January 1, 2015 thru December 31, 2015.

Deliverables 

HEI will provide a URL to the GIS map viewer and Am I in the Watershed application that will be hosted on HEI’s managed web servers.

Assumptions 

CRWD is responsible for updating GIS data unless requested for HEI to perform the task under our current fee schedule.



Any bugs fixes, technical support or enhancement requests will be invoiced at the current fee schedule under Task 3.



While HEI strives for the best server uptime possible, HEI does not guarantee 100% uptime on web server due to unforeseen circumstances.

Task 2: MS4Front Annual Maintenance and Custom Modules Hosting HEI will provide web hosting for MS4Front and the custom modules for $4,000 from January 1, 2015 thru December 31, 2015. General bug fixes and defects for MS4Front and MS4Front mobile application are covered under the annual maintenance subscription fee and follow the MS4Front subscription agreement.

MS4Front software strives to continuously improve to meet our customers’ needs to managing the MS4 permit requirements. Currently HEI has no plans to enhance the custom modules for permit, grant and capital project tracking. If CRWD requests enhancements or modifications to those modules the costs would need to be including in task 3. Any bug fixes for the new custom modules are also supported under the MS4Front annual maintenance. MS4Front and the mobile application are to remain consistent across all users.

Task 3: General Technical Support and Maintenance HEI will provide technical support and maintenance services as requested on a time and materials basis by the CRWD from January 1, 2015 thru December 31, 2015. These services typically include GIS support in the form of answering questions, education, map creation, data creation or GIS analysis. These services may also include programming for bug fixes, feature enhancements, configuration changes and data updates for the GIS viewers, Am I in the watershed application. Technical support may also include data importing, revisions, feature enhancements, configuration changes.

HEI will only complete requests as authorized by the CRWD. Nate Zwonitzer will be designated as the authorized individual to approve technical support requests. CRWD will supply an email or Assembla ticket as authorization to complete a technical support or maintenance request. HEI will provide an estimate of the amount of time to complete the request, if requested by the CRWD. These services will be billed as time and materials in ¼ hour increments. The requests will be billed for time beginning at the start of the request. For 2015, technical support will be billed as time and materials using the 2015 HEI Fee schedule below. We assume most of the requests can be handled by a GIS Developer unless it involves new enhancements or design work. The request will generally be handled via web meetings, phone, or email. If onsite meetings are requested, then the travel time and mileage will be billed.

The report could contain basic summary information used in annual reports, newsletters, board updates etc. In order to add this functionality, we need to determine what information we want summarized. I’m thinking there will be 4 reports with information similar to what is on the dashboards. In the case of reports, assume you will be able to select a timeframe to summarize (start date and end date), but not limit it to a specific geography (city, subwatershed etc.). Background The suite adjacent to CRWD’s existing office, Suite #6, is unoccupied and available for leasing. Suite #6 has a total area of 2,168 square foot (sf) that is broken down to 1,301 sf of office space and 867 sf of warehouse space. CRWD is interested in leasing Suite #6 for additional meeting rooms, storage space and shop space and have been negotiating the terms of a potential lease amendment with the owner, JGM Properties/1400-1410 Energy Park Drive, LLC. Issues CRWD currently pays $3,137.33 per month or $6.50/sf/yr for its current office space in Suite #4. The owner is offering to lease Suite #6 for $1,047.92 per month or $5.80/sf/yr for the first year. The Suite #6 monthly rate is based on a $4.00/sf/yr rate for the warehouse space and $7.00/sf/yr rate for the office space. The office space rate is a one dollar discount from its typical $8.00/sf/yr rate.

Combining Suites #4 and #6, the total area for the new space is 7,960 sf and the monthly base rent would be $4,185.25 ($6.31/sf/yr) from April 1, 2015 to March 31, 2016. For the second year, the rate per square foot per year would increase by $0.25 to $6.56/sf/yr. See the enclosed Fourth Amendment to the Lease. The table below provides a breakdown of lease costs for the first year.

FOURTH AMENDMENT TO LEASE

This Fourth Amendment to Lease (“Fourth Amendment”) is made as of this ______ day of March, 2015 (the “Fourth Amendment Effective Date”), by and between 1400‐1410 Energy Park Drive, LLC , a Minnesota limited liability company and Assignee of Slate Energy Park Holdings, LLC (“Landlord”) and Capitol Region Watershed District (“Tenant”).

RECITALS WHEREAS, Landlord’s predecessor‐in‐interest and Tenant executed a Lease Agreement dated June 3, 2004 (“Original Lease”) for certain premises located at the Plaza Tech Center consisting of 3,586 rentable square feet at the building commonly known as “Energy Park Plaza Tech” located at 1410 Energy Park Drive, Saint Paul, Minnesota 55108 (“Building”); WHEREAS, Landlord’s predecessor‐in‐interest and Tenant executed a First Lease Amendment dated September 15, 2006 (“First Amendment’) which expanded the space to approximately 5,792 square feet (“Premises”), extended the Original Lease Term and modified certain other terms of the Original Lease; WHEREAS, Landlord and Tenant executed a Second Lease Amendment dated March 30, 2012 (“Second Amendment”) which again extended the Term and modified certain other terms of the Original Lease and First Amendment; WHEREAS, Landlord and Tenant executed a Third Lease Amendment dated September 8, 2014 (“Third Amendment”) which extended the Term to March 31, 2016, provide for an Option to Renew and modified certain other terms of the Lease. The Original Lease, First Amendment, Second Amendment, and Third Amendment are collectively referred to herein as the “Lease”; WHEREAS, Landlord and Tenant desire to modify and supplement the Lease by extending the Lease Term, expanding the Premises, providing for improvements to the expanded space and modifying certain other terms of the Lease;

NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. Interpretation of Amendment. The Lease is hereby modified and supplemented as of the Fourth Amendment Effective Date. Wherever there exists a conflict between this Fourth Amendment and the Lease, the provisions of this Fourth Amendment shall control. Unless otherwise indicated, defined terms shall have the definitions set forth in the Lease. Except as modified and supplemented herein, the Lease is in full force and effect.

2. Extension of the Lease Term. Landlord and Tenant agree to extend the Lease Term for an additional period of twelve (12) months commencing April 1, 2016 (the “Fourth Amendment Commencement Date”) and continuing through and including March 31, 2017 (the “Fourth Amendment Expiration Date”). The period commencing on the Fourth Amendment 1

Commencement Date and continuing through the Fourth Amendment Expiration Date is hereinafter referred to as the “New Term”.

3. Premises Expansion. Landlord and Tenant agree that the Premises shall be expanded by adding 2,168 rentable square feet (RSF) [1,301 RSF/office and 867 RSF /warehouse] for a new space total of 7,960 RSF (“New Premises”).

4. Base Rent. Base Rent payable for the New Premises shall be as follows: Monthly Base Rent

5. Operating Costs. In addition to the Base Rent payments outlined above, Tenant will continue to pay its pro rata share of “Operating Costs” for the New Premises. Estimated Operating Costs currently are $ 6.03 RSF. Landlord continues to reserves the right to reallocate any Operating Costs that are occupancy dependent.

6. Improvements to the Expansion Space. Landlord agrees to make improvements (Build‐out) to the expansion space pursuant to attached Exhibit A (drawings dated February 12, 2015) and Exhibit B. If Tenant determines to park its vehicles in the warehouse space installation of a flammable waste trap will be required before any parking can take place. At Tenant’s option, Landlord will have the flammable waste trap installed subject to Tenant paying 75% of any and all costs associated with said installation, which costs Landlord would agree to amortize over the first twelve (12) months of the New Term and be paid by Tenant as additional Rent. All other improvements shall be at the expense of Tenant. Any and all alterations, additions and/or improvements upon the New Premises, at the termination of the Lease, shall be surrendered with the New Premises as a part thereof. Landlord shall not be held responsible for delays beyond its control due to changes ordered in the work, labor disputes, unavoidable casualties and material shortages or delays in transportation thereof.

7. Option to Renew. Tenant is granted the right to extend the New Term for one (1) successive option period of twelve (12) months pursuant to the following terms. To exercise the option, Tenant shall notify Landlord in writing no later than December 31, 2016. Tenant’s option to renew the term stall automatically terminate upon the following: (1) the failure of Tenant to timely give its written notice to exercise of the option; (2) the termination of the Lease ; or (3) the assignment of the Lease or the sublease of all or a part of the New Premises. In the event Tenant properly exercises its option as provided herein, all terms and conditions of the Lease and this Fourth Amendment shall apply during the option period, 2

subject to the following: (1) the option to renew shall no longer be available; (2) Tenant agrees to accept the New Premises in its then existing condition on an “as‐is” basis; and (3) Base Rent shall be as set forth below:

8. Notices. 10. Entire Agreement. This Fourth Amendment sets forth the entire agreement with respect to the matters set forth herein. No modification, supplementation or amendment to the Lease or this Fourth Amendment shall be effective unless made by written agreement between the Landlord and Tenant.

11. Counterparts. This Fourth Amendment may be executed in any number of counterparts, any one of which shall be an original, but all of which together shall be one and the same instrument.

1) Administrator Approved or Executed Agreements a) Amendment No. 1 to Consultant Services Agreement with Geosyntec Consultants Inc. for additional services and OptiRTC review for the Upper Villa Park Project increases budget by $5,191 with a total not to exceed $72,234. b) Memorandum of Understanding between CRWD, MWMO and RWMWD with Fourth Sector Consulting, LLC for Strategic Communications Partnership with a total not to exceed $39,725.

2) Board Approved or Executed Agreements a) Agreement with Muska Electric Co. for the installation of power supply to Trout Brook East Branch and Trout Brook West Branch monitoring sites with a total not to exceed $18,860.00 3) General updates including recent and upcoming meetings and events a) CRWD staff presented at the Roseville Home and Garden Fair on February 21, 2015. The title of the presentation was “Rooting Out Pollution: Using Rain Gardens and Other Practices to Protect the Mississippi River”. b) “The High Price of Cheap Groundwater: Are We Flushing Our Future Downstream?” hosted by FMR is Thursday, March 26 at 7:00 pm at the Science Museum of Minnesota.
