Background Construction activity is complete for permits #13-023, Dew Drop Pond and #13-033, Fairview-Bohland.

Issues Dew Drop Pond #13-023 This permit was issued for removal of accumulated sediment and invasive cattails from the Dew Drop Pond on the campus of St. Catherine University. No stormwater treatment was required; only erosion/sediment control and wetland (no-loss to an incidental wetland). The project is complete and the site is stable. No surety was collected.

Fairview-Bohland #13-033 This permit was issued for street reconstruction in the vicinity of Fairview and Bohland in St. Paul.

Stormwater treatment was met by withdrawal from the St. Paul Public Works volume bank. The project is complete and the site is stable. No surety was collected.

Action Requested Approve Certificate of Completion for permit #13-023, Dew Drop Pond.

HISTORY & CONSIDERATIONS: Project site is adjacent to previous permit 15-022 The Good Acre. Proposed project results in the removal of a rain garden (Basin 4) covered under the 15-022 permit, reducing volume retention from 5,645 to 5,507 cf (138 cf), which is still greater than the required 4,140 cf.

RULE C: STORMWATER MANAGEMENT Standards ďƒ˜ Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates. ďƒ˜ Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.

ďƒ˜ Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area. ďƒ˜ Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 44,644 square feet. This area includes the impervious surface from permit 15-022 draining to the removed Basin 4. b. Volume retention required: 44,644 ft2 x 1.1 inches x 1 ft/12 inches = 4,092 ft3 Table 1. Proposed volume retention through abstraction (i.e. infiltration, reuse).

4. Alternative compliance sequencing has not been requested.

5. Best management practices achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A maintenance agreement recorded with Ramsey County has not been submitted.

Adequate maintenance access is provided for surface and/or underground system.

Maintenance agreement includes a site-specific plan, schedule, and narrative for maintenance of the proposed stormwater management practices.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Disturbed area is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted and is sufficient.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 3 Conditions Conditions: 1. Receipt of documentation of maintenance agreement recorded with Ramsey County.

HISTORY & CONSIDERATIONS: Applicant proposes to design stormwater management facilities implemented in Phase 1 to meet CRWD’s rate and volume control standards for both Phases 1 and 2. However, since Phase 2 plans are in preliminary design stages at time of submission, this permit will only cover Phase

1. Additional review will be conducted when Phase 2 plans are finalized, amending this permit if necessary.

RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. It is unknown if runoff rates for the proposed activity exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 59,964 square feet, accounting for both Phases 1 and 2. b. Volume retention required: 59,964 ft2 x 1.1 inches x 1 ft/12 inches = 5,497 ft3 Table 1. 4. Alternative compliance sequencing has not been requested.

5. Best management practices achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A memorandum of agreement for maintenance of stormwater facilities exists between the City of St. Paul and the CRWD. Adequate maintenance access is provided for underground systems.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Disturbed area is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted and is sufficient.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 4 Conditions Conditions: 1. Provide a copy of the NPDES permit.

2. Revise plans to address the following: a. Detail 5 on C503 refers to chamber control structure in Detail 2 on Sheet C503.

This shall refer to Detail 1 on Sheet C503. b. Detail 5 on C503 refers to manhole structure in Detail 2 on Sheet C503. This shall refer to Detail 7 on Sheet C503.

3. Revise HydroCAD to address the following: a. Use a rainfall depth of 2.81” for the 2-year, 24-hour precipitation event. Current HydroCAD uses 2.45” which corresponds to the 1-year, 24-hour event. b. Justify the use of sheet flow lengths over 100' for existing subcatchment Pre and proposed subcatchment 2S. The Minnesota Stormwater Manual recommends a maximum sheet flow length of 100' due to the tendency for flow to channelize beyond 100'. c. Change exfiltration rate from proposed pond 2P (Additional Storage Chambers) to 0.625 in/hr. Soil boring B-11 indicates SP-SM soil in this area, which corresponds to a design infiltration rate of 0.625 in/hr. d. Justify that the flow split in post-development HydroCAD is modeled correctly.

The weir is set at the proper elevation to achieve CRWD volume control, but it is not clear if the 24” flat pipe will limit flow such that the weir will be overtopped before filling the east underground system. For example, CRWD calculates the 18” pipe entering the flow split has a capacity of 16 cfs; conversely, the 24” flat pipe has a capacity of 12 cfs, assuming inlet control and 1.8 feet of head. Show that this reduced capacity does not “short-circuit” the east underground system.

4. Revise HydroCAD or plans to correspond for the following: a. HydroCAD models underground infiltration section “B” as 13 rows of 16 chambers inside a 63.25’ x 119’ rock prismatoid. Plans indicate 10 rows of 9 volume chambers and 5 isolator rows inside a 73’ x 77’ rock prismatoid. Plan layout can be justified by submitting shop drawings or adding the following note to Detail 5 on Sheet C503: “System must provide 14,122 cf of storage below low outlet.”

Ms. Hosch reviewed permit #14-005 Hazelden Redevelopment. The permit was issued for the demolition and reconstruction on the Hazelden campus at Stewart and Drake in St. Paul. Stormwater treatment was met through

construction of one surface filtration basin and one surface infiltration basin that have been confirmed functional.

The project is complete, and the site is stable. $13,900 surety is available to return.

Motion 18-056: Approve $13,900 surety return and Certificate of Completion for permit #14-005, Hazelden Redevelopment.

Ms. Hosch reviewed permit #18-007 Woodlawn Jefferson. The applicant, City of St. Paul is reconstructing the following streets: Jefferson from Cretin to Mississippi River Blvd, Woodlawn and Mt. Curve from Jefferson to Randolph, Edgecumbe from Field to Wordsworth. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 3.2 acres with 3.2 acres impervious surface.

Motion 18-057: Public Works Bank.

Special Reports – McCarrons AIS Plan Update, Joe Sellner

Mr. Sellner provided a review of the McCarrons AIS Plan for the Board of Managers. In 2014 and 2015, the District participated in aquatic plant harvesting at Lake McCarrons. The goal was to treat when and where it was feasible, document, determine threats, develop an outline of general prevention, and develop a rapid response process.

Mr. Fossum shared that the plan is to react to species that we might not be aware of. Practices are evolving, and early detection is critical. Manager Jones asked about new species infesting lakes. Mr. Sellner replied that zebra mussels are currently an issue. Mr. Fossum added that Lake McCarrons just doesn’t have the ideal conditions for zebra mussels. Manager Sanders inquired about a public meeting. Mr. Sellner replied that the dates are currently not set.

Mr. Sellner reviewed some issues with the plan. Aquatic invasive species continue to be a concern and potential threat to all lakes in CRWD. As the only lake with a public boat launch, Lake McCarrons is likely the most prone to introduction of aquatic invasive species. Mr. Sellner shared that inspections are done on weekends during peak hours at the public boat launches. Manager Texer asked about the number of boat launches available on Lake McCarrons. Mr. Sellner replied that here is just one boat launch and it does not have a washing station. District staff have worked with Wenck Associates and District partners to develop a draft Lake McCarrons AIS plan.

Manager Reider asked if CRWD has an AIS plan for each lake. Mr. Fossum replied no and explained the conditions of each lake. A public meeting will be held in May, and a presentation will be made to the CAC in May to gather input.

No action was taken. The Board thanked Mr. Sellner for his work.

Approve Monetary Limits of Municipal Tort Liability (Doneux)

Administrator Doneux reviewed that historically the Board has decided to NOT waive the tort liability limits.

Administrator Doneux met with Mark Lenz, the District’s Insurance agent. Mr. Lenz reviewed the options regarding whether or not to waive tort liability limits, as the District has done in the past. Administrator Doneux recommend that the District NOT waive the monetary limits on municipal tort liability. The District will continue to purchase an insurance rider for accident coverage for volunteers.

Motion 18-062: Accept the LMCIT liability coverage and NOT Waive the Monetary Limits on municipal tort liability.

AR: Approve 2017 CRWD Annual Report (Bromelkamp)

Administrator Doneux reviewed that all metropolitan watershed management organizations are required by Minnesota Statute 103.B to submit an annual Activity Report, Financial Report and Financial Audit to the Minnesota Board of Water and Soil Resources (BWSR).

Administrator Doneux reviewed the draft of the 2017 Annual Report. The final 2017 Annual Report will be submitted on April 27, 2017. CRWD’s 2017 Financial Statement, Audit and the Stormwater Pollution Prevention Program Annual Report will be sent upon completion later this year.

The Annual Report has been presented to the CAC. Recommended Changes from CAC included future trends and more information regarding the Diversity plan.

Managers were very pleased with the report and felt it looked great. Administrator Doneux stated that the 2017 audit is complete, the report will be updated with the completed audit report.

AR: Approve 2018 Quality Assurance Program Plan (Belden)

Ms. Belden reviewed that in 2016, CRWD staff developed and implemented a Quality Assurance and Program Plan (QAPP) to guide the CRWD monitoring program.

The contents of a QAPP ensure that quality assurance objectives and regulatory needs are being met. Monitoring data collected using an approved QAPP have strong credibility with outside parties and allow the District to confidently utilize the data to make regulatory decisions.

The first version of the CRWD QAPP was presented at the September 7, 2016 meeting and accepted by the Board of Managers. The QAPP is updated annually to reflect any changes that have been made to the CRWD monitoring program as it relates to staffing, monitoring stations, monitoring procedures, and laboratory protocols.

Ms. Belden reviewed changes that have been made to the monitoring program since the last update of the QAPP in 2017. CRWD staff are requesting acceptance of 2018 QAPP by the Board of Managers to formally endorse its use in the Monitoring Program.

Approve Professional Services Agreement with Limnotech for Como Lake Management Plan

Mr. Fossum reviewed that at the January 17, 2018 Board meeting the Managers authorized distribution of a Request for Qualifications (RFQ) for the 2018 Como Lake Management Plan. In February 2018, staff solicited and reviewed Statements of Qualifications (SOQs) from four firms relative to lake management plan development experience.

At the February 21, 2018 Board meeting the Managers approved the selection of LimnoTech for the 2018 Como Lake Management Plan and authorized staff to negotiate a detailed scope and budget with LimnoTech for subsequent contract approval by the Board of Managers.

Staff have worked with LimnoTech staff to develop a scope of work, budget, and schedule for the 2018 Como Lake Management Plan. Staff will review the scope of work with the Managers and recommend approval.

Manager Texer stated that she was disappointed with the amount of outsourcing from LimnoTech and felt there was a lack of progress. Mr. Fossum reviewed the work of meeting with citizens and explained the expectations to the public.

Manager Jones inquired about spending the money on a staff member to focus on these roles. Administrator Doneux replied that it is something to look at with the 2019 budget. Currently, the office does not have the work space and consistent work load available for additional staff.

Motion 18-063: Approve the Como Lake Management Plan scope of work, budget, and schedule; and authorize the Administrator to execute a professional services agreement with LimnoTech for an amount not to exceed $131,860.00 and any amendments to the agreement up to $20,000.

Approve Contract Amendment with Barr Engineering for Office Remediation (Kelley)

Mr. Kelley reviewed that CRWD has been contracting with Barr Engineering since September 2016 to conduct environmental site assessments for the purchase and redevelopment of the 595 Aldine and 1736 Thomas properties.

Barr completed review of the previously conducted Phase I Environmental Site Assessment (ESA), created a Phase II ESA, and a Response Action Plan (RAP) that identifies the potential pollutants of concern on the site, and the precautions and procedures that will be followed during construction to ensure proper screening and handling of potentially contaminated materials.

The original contract with Barr was for $33,100 to complete the Phase II ESA that identified the extent of the contamination inside and outside of the buildings. Since completion of the Phase II report, CRWD has included Barr staff as part of the team of consultants working to design CRWD’s new office space, and the CRWD administrator has authorized four contract amendments with Barr Engineering.

Staff requested Board approval for Contract Amendment #5 with Barr Engineering for the final phase of the project. This work includes construction observation during critical times to ensure potential contaminated soils are correctly handled, and that the sub-slab vapor mitigation system installed and tested per plan. The scope also includes groundwater sampling and monitoring and creating a report that summarizes implementation of the RAP as required by the MPCA. The CRWD New Office Budget includes $250,000 for Brownfield Engineering and Abatement.

Motion 18-064: Approve Contract Amendment #5 with Barr Engineering in the amount of $94,500 for RAP Implementation, Construction Observation, and Groundwater Monitoring

Approve Professional Services Agreement for TBI Easement Acquisition Project (Eleria)

Ms. Eleria reviewed that CRWD needs the assistance of an independent appraisal consultant and an acquisition agent for the documentation and acquisition of easements for the Trout Brook Storm Sewer Interceptor. The appraisal consultant will analyze approximately 50 priority parcels for its fair market value, compensation and any damage issues. The acquisition agent will represent CRWD in the discussions and negotiations of easements with the property owners.

CRWD solicited statement of qualifications (SOQs) from three firms for each service area, which were recommended by the Ramsey County Attorney’s Office. The three appraisal consultants are: 1) Hosch Appraisal Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

and Consulting, 2) Integra Realty Resources, and 3) Kelly Lindstrom. The three acquisition agents are: 1) Henning Professional Services, 2) SRF Consulting Group, and 3) WSB. CRWD and Ramsey County Attorney’s Office staff interviewed all six firms and evaluated the qualifications, relevant experience, and project and cost approach of each firm. Staff is recommending Hosch Appraisal and Consulting as the appraisal consultant and SRF Consulting Group as the acquisition agent.

Motion 18-065: Approve Hosch Appraisal and Consulting as the TBI easement appraisal consultant and SRF Consulting Group as the TBI easement acquisition agent and direct staff to prepare A professional consultant services agreement including a scope of work and budget with each firm.

Unfinished Business A) Building Update (Doneux)

Administrator Doneux shared that the site plan has been approved. Demolition of the interior of the building has started. All the interior office space in the building has been removed. Asbestos has been removed. On April 30th the outdoor shed is scheduled to be removed. A site visit is scheduled on April 26th at 3:30 p.m. for the Board, CAC, and Staff. Park and enter by the Thomas building.

B) Snelling Midway Update (Eleria) Ms. Eleria, shared that art at the Snelling Midway site is moving forward with an artist. A letter was received from the Director of DED requesting financial assistance. The letter identified and outlines phases. Ms. Eleria shared that a water feature is still of interest. Ms. Eleria will return to the Board with updates.

Background In 2004, Sunde Land Surveying utilized GIS data, survey data of TBI manhole locations, and existing easement documents to create a map of the TBI system and identify approximate locations of easement areas. These maps have been useful in CRWD’s preliminary evaluation of easement area needs.

Issues For the TBI Easement Project, legal descriptions and site plans of desired easement areas need to be prepared to survey industry standards for inclusion in easement agreements with affected property owners.

Because of Sunde’s familiarity with the TBI system and initial survey and easement documentation work, CRWD staff requested a proposal (enclosed) from Sunde for legal description and site plan development work anticipated for 2018.

The site plan and legal description scope of work involves two phases. The first phase includes development of a base map of the entire TBI system that is of survey quality and some field work to verify property positions. The second phase involves preparation of site plans and legal description of easements for 20 parcels targeted for acquisition in 2018. The total estimated cost for the project is $37,994. Scope of Work for the Trout Brook Storm Sewer System – St. Paul, MN

Dear Anna: This letter/proposal is in response to a request for a cost estimate to perform a Scope of Work in accordance with the instructions received. It is our proposal to perform the work as outlined and requested as follows:

PHASE I 1. DUE DILIGENCE AND FILE SET-UP A. This would include researching the parcels that are affected by the Trout Brook Sewer System.

B. Review the documents and research previously performed by Sunde Land Surveying against the files and project prepared by Barr Engineering.

C.

Set-up files in the computer for each parcel affected or touched by the Storm Sewer System as the previously prepared for Trout Brook survey was to determine ownership and basic location. Not all work as done at survey grade but just to basic mapping quality to portray the information. This computer work needs to be tightened up to survey grade and some fieldwork will be required for certain parcels. The extent won’t be known until we get further into the title work.

Files to be stored: A. Provided owner’s reports from the title company B. Based on Barr Engineering’s recommendations in their report – determine if the following is needed: a. Easement for sewer b. Widening of existing easement c.

Additional location work

d. Create a parcel map that would include the existing PIN numbers

PHASE II 2. SKETCHES AND EASEMENT DESCRIPTIONS A. A list was provided for the first 20 +/- properties to start this project.

B. Start creating sketches and descriptions based on prior and need.

C. Create drawings and descriptions for each parcel showing the existing easements and proposed widening or purchased land.

D. Create a parcel map that would include the existing PIN numbers.

Each parcel will be a subfolder which could contain the existing information from the files, owner’s reports, existing and proposed acquisitions.

These rates are based on our Professional Fee Schedule (attached) and are ESTIMATED COSTS as field variables and site conditions are continually changing. The actual costs may be lower than stated and the cost listed will not be exceeded by more than 5% without authorization.

Background CRWD has sponsored three classes of Master Water Stewards and currently has 17 active stewards. The Master Water Stewards program is modeled after University of Minnesota Extension’s Master Gardener certification program started in 2012 as a partnership between the Freshwater Society and Minnehaha Creek Watershed District (MCWD) with funding through a Clean Water Land and Legacy grant. The program trains, certifies and supports community leaders to install pollution prevention projects that educate community members and reduce polluted runoff. After a three-year pilot at MCWD, in 2015 Freshwater Society developed a plan to expanded the program to other Metro-area partners.

Update The District sponsored seven Master Water Stewards in the 2017 class. Staff and Stewards will provide the Board with a summary of the work they have completed as CRWD Master Water Stewards. This class has completed or is working on five BMP projects and four education projects.
