Background Construction activity is complete for permits #13-022 MSU Parking Ramp, #16-015 Como Transportation II, and #16-022 Burke Erosion Control.

Issues MSU Parking Ramp #13-022 This permit (with amendment) was issued for construction of a new parking ramp and surface lots at Metropolitan State University east of downtown St. Paul. An underground filtration system was built to treat site stormwater. The project is complete, the stormwater system is functional, and the site is stable.

No surety was collected for this public project.

Como Transportation II #16-015 This permit was issued for the construction of new garden area and driveway turnaround at the entrance to Como Zoo and Conservatory in St. Paul. The majority of stormwater treatment was accounted for in the ballfield basins reviewed during Como Transportation I, with 12 new infiltration catchbasins within the project area. The work is complete, the site is stable, and stormwater infrastructure is functional. No surety was collected for this public project.

Burke Erosion Control #16-022 This permit was issued for construction of a new single family home adjacent to Victoria-B wetland in Roseville. Only erosion control provisions were needed; no stormwater requirement. The project is complete and the site is stable. $500 surety is available for return.

Permit #17-022 Regions Birth Center (Hosch)

Ms. Hosch reviewed permit #17-022 Regions Birth Center. The applicant, Regions Facility Planning and Construction is constructing a new Birth Center building with demolition and relocation of a loading dock in multiple phases. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 2.98 acres with 2.7 acres impervious surface.

Motion 17-219: Approve permit #17-022 Regions Loading Dock Relocation with seven conditions:

MN Stormwater Manual states that sumped catchbasins are most effective when the drainage area to the inflow pipe is at least three times greater than the drainage area to the grate above. STR-189 does not have upstream drainage area. b. Label the underground storage system 100-year high water level on plans.

7. Revise HydroCAD model to address the following: a. Calculate time of concentration for each sub-watershed rather than direct entry. b. Include draintile that collects filtrate as a device in the model.

This permit was issued for construction of a new senior housing and commercial development at Dale and University in St. Paul. Stormwater treatment was accounted for through construction of an underground infiltration system. The project is complete, the stormwater treatment system is functional, and the site is stable. $6,350 is available for surety return.

Redier/Texer Unanimously Approved B) Permit #10-018 Bruce Vento site Remediation - Closure (Hosch) Ms. Hosch reviewed permit #10-018 Vento site Remediation - Closure. This permit was issued for the removal/containment of contaminated soils and site restoration at Commercial and 4th in downtown St. Paul. Only erosion and sediment control provisions were required because no impervious surface was constructed/reconstructed. The project is complete and the site is stable. No surety was collected for this public project.

Motion 17-222: Approve Certificate of Completion for permit #10-023, Beacon Bluff Parcel 6.

Reider/Texer Unanimously Approved D) Permit #16-025 Snelling-Midway Amendment (Kelley) Mr. Kelley reviewed permit #16-025 Snelling-Midway Amendment. The applicant, MN United is planning construction of a new major league soccer stadium and associated public infrastructure. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 20.02 acres with 14.65 acres impervious surface. Mr. Kelley explained that this amendment is for the comprehensive stormwater management approach.

The applicant, St. Paul Jewish Community Center is planning an additional expansion of the sourtheast entrance beyond the original plan approved 6/12/17. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.42 acres with .71 acres impervious surface.

Approve Watershed Management Plan Amendment (Eleria)

Ms. Eleria reviewed that in late August, CRWD staff distributed a draft amendment to CRWD’s 2010 Watershed Management Plan (WMP) to local, regional and state government agencies and public to reflect changes to CRWD’s new office budget. The original budget was estimated to be approximately $2.99 million in CRWD’s 2010 WMP. The updated, total estimated cost of the new office is $10,088,498. According to CRWD’s bond counsel, the increase in project budget warrants an amendment to CRWD’s 2010 WMP. On September 20th, CRWD’s Board of Managers held a public meeting for the draft WMP amendment and no comments were received. No comments were received in writing. Several government agencies including City of Lauderdale, DNR, and Metropolitan Council, notified CRWD that they had reviewed the amendment, but they had no comments. BWSR staff have reviewed the minor amendment materials and agrees that it is consistent with CRWD goals, policies and priorities in the WMP and therefore constitute a minor plan amendment.

AR: 2017 MAWD Resolution Background Information

Administrator Doneux reviewed the 2017 MAWD resolutions background information. Administrator Doneux explained that the resolution is intended to start the discussions to better integrate local watershed efforts and Clean Water, Land and Legacy funds with the One Watershed, One Plan, and WRAPS Program. Administrator Doneux has observed duplicated efforts and explained how the One Watershed, One Plan has not yet launched in the metro area. President Collins recommended discussions regarding the One Watershed, One plan with BWSR. Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

President Collins also recommended further clarification from Pollution Control Agency (PCA). Administrator Doneux expressed that resolution is intended to start discussions to minimize possible duplicate efforts.

Manager Reider noted that Rice Creek Watershed District has been working on this topic in the past.

Administrator Doneux discussed that MN Board of Water and Soil Resource (BWSR) be included in the resolution. MAWD resolutions are due on Friday.

Unfinished Business A) 2017 Watershed Steward Awards update (Bromelkamp)

An update will be made at the November meeting.

B) Snelling Midway Stormwater Management (Doneux) For the past year and half, the City of Saint Paul and CRWD staff have been involved in stormwater management planning for the 35-acre Snelling-Midway Redevelopment site. The first phase of redevelopment includes construction of the MN United FC soccer stadium and associated infrastructure and open space over an 18-acre area. The remainder of the site will be redeveloped in future phases based on market interest. The City of St. Paul and CRWD have sought design of a site-wide, innovative stormwater management system that would be built as part of the soccer stadium project.

City St. Paul and CRWD staff have been discussing the future maintenance responsibilities and requirements of the green infrastructure practices at the site. There is interest on the part of the City to contract with CRWD to operate and maintain the cistern and tree trenches for a five-year period. To better frame the discussion with the Board, staff met with the City to draft a term sheet outline. Staff believe given the District’s support for the comprehensive stormwater approach as well as grant funding for these elements, CRWD would be a good option for the City as a maintenance partner for this project.

Ms. Eleria has been working with Wes Saunders-Pearce regarding cost of maintaining BMPs. Information has been collected from the Maplewood Mall and CHS field to come up with an estimated annual maintenance costs.

Manager Reider asked if BMP maintenance services could be offered to others. Administrator Doneux remarked that the next step is to draft an agreement with the city.

C) Building Update (Eleria) In the schematic design (SD) phase of CRWD’s new office design, a fire suppression (automatic sprinkler) system was selected by CRWD as an alternate for the project. Staff have since learned that it is not required by state code.

The estimated costs for the fire suppression system has increased to approximately $120,000, which includes sprinklers and a fire pump. The original cost estimate did not include the fire pump. Staff have reached out to MN State Fire Marshal and our Safety Instructor regarding consideration for installing a fire suppression system.

Ms. Eleria asked for direction from the Board of Managers on the installation of a fire suppression system. Manager Reider felt that the cost for installing a sprinkler system was not that much considering the overall cost of the building and protecting staff. Manager Jones felt that keeping staff safe in the event of a fire was very important in addition to adding value to the property by having a system in place. will also be used for public meeting space and it would be our duty to protect guests in the building. Manager Texer gave 100% support for a sprinkler system. President Collins felt that at some time in the future a sprinkler system would be required, and it would be best to take care of this now. The Managers discussed and they all agreed that it was important to include a sprinkler system in plans for the remodeling project.

Administrator Doneux reviewed a draft comment letter on water reuse. The Managers shared strong feelings regarding the short review period provided by the MN Department of Health for the 2017 Report of the Interagency Workgroup on water reuse. Managers felt the report seemed to focus on the health of drinking water and not stormwater reuse. President Collins stressed the importance of highlighting CRWD building projects with stormwater reuse in the letter. Manager Reider felt the letter drafted by Administrator Doneux was very good. Administrator Doneux will make some adjustments to the final letter and submit to the State.

VIII.

General Information

Administrator Doneux provided an update on Metro MAWD. A discussion at the Metro MAWD meeting of water reuse lasted 1 ½ hours. Many concerns were shared at the Metro MAWD meeting regarding the 2017 Report.

Ms. Jensen conducted interviews of key Board, CAC and staff to establish a baseline of knowledge and level of cultural competency. Ms. Jensen also reviewed reports, assessments and the 2010 Watershed Management Plan to better understand CRWD’s mission, vision and values and how they relate to diversity and inclusion efforts.

Review Draft CRWD Summary & Findings and Diversity Strategic Plan

Ms. Jensen reviewed the Draft Diversity Plan and the comments from the interviews. Ms. Jensen shared population statistics and highlighted key recommendations.

A) Discussion by the Board of Managers The board discussed opportunities to engage youth in water resource learning and protection efforts. Best practices for hiring were also mentioned as well as collaborating with other metro watershed districts. Mr. Doneux shared details about a Green Infrastructure Maintenance certificate developed by WEF in partnership with the DC Water and Sewer Authority. This certification program would help meet a need, locally trained BMP maintenance professionals, and engage new audiences in water resource protection. The board was supportive of the idea and expressed an interest in learning more. Many new program ideas were discussed. Ms. Bromelkamp suggested that we also review existing programs for opportunities to be more inclusive. Lastly, the board recognized the need to build knowledge and buy-in among staff to position this work for success.

Background Metropolitan Cities are required to create Local Surface Water Management Plans to be incorporated into the their Comprehensive Plans. Prior to adoption by the cities, plans must be approved by watershed management organizations. A 60-day review period is provided to ensure consistency with Watershed Management Plans.

Issues Staff have reviewed the City of St. Paul’s Plan and drafted a letter that outlines the items that must be addressed prior to approval by CRWD. Staff will review the letter and some of critical plan deficiencies with the Board.

City of St. Paul Local Surface Water Management Plan

Dear Ms. Hatten Capitol Region Watershed District (CRWD) has received and reviewed the City’s draft Local Surface Water Management Plan. The City of St. Paul has made great advancements in stormwater management over the past decade. CRWD views St. Paul as a critical partner in protecting and improving water resources; many successful projects have been implemented through unique collaboration opportunities between our two entities. While the plan is generally consistent with CRWD’s Watershed Management Plan, the following items must be addressed prior to CRWD approval.

1)

Section 1.1, Background – The surface water drainage explanation is inaccurate and provides an incomplete list of water resources. Either remove this discussion, or revise for accuracy.

2)

Section 2, Land and Water Resources Inventory – The requirement of this section is to describe the existing and proposed physical environment and land uses. CRWD suggests removing subsections pertaining to NPDES permits, City ordinance or policy, water resource issues, or other discussion not solely focused on specific land and water resources.

3)

Section 2.6.1, Wetlands – Table 2-3 identifies two wetlands that “each watershed is responsible for” and identifies Willow Reserve as a wetland managed by CRWD. This is an inaccurate representation of the multiple layers of ownership, management, and regulation surrounding one specific wetland in CRWD. This section should provide a comprehensive inventory of the existing wetlands within the city regardless of ownership or management practices.

Section 4, Assessment of Issues – CRWD recommends removing corrective actions from this section, and shift focus to identification of the water quality issues. Specific actions to address water quality issues should be included in the implementation program section.

5)

Section 5, Goals and Policies – It is unclear how the policies identified within this section will be implemented, where the specific technical requirements are stated in code or ordinance, and what Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District.

Ms. Stephanie Hatten October 6, 2017 Page 2 internal procedures may need to be modified to ensure these policies are enforced. To ensure consistent stormwater management within the City, policies throughout this section should be revised to reduce ambiguity by replacing terms such as “encourage”, “preferred strategy” or “seek opportunity” in favor of more definitive language.

Section 5.2.2. Policies: Rate Control – References are made to updating policies to ensure rate control is met. Provide a detailed process and schedule to review existing rate control issues, standards, and potential revisions.

Section 5.2.2. Policies: Rate Control, Item 9 – Provide clarification on when easements would be obtained for stormwater management features, specifically public vs. private ownership.

Section 5.2.3. Policies: Flood Control – Where design storm frequencies are included, the intent to use Atlas-14 should be clearly stated.

Section 5.2.4. Policies: Infiltration and Volume Control – The volume control policy is generally consistent with CRWD Rules, but it is unclear where this stated in City requirements. The Chapter 52 language provided within the appendix is not the currently adopted ordinance language, and other places within the plan indicate that Chapter 52 will be updated, but a specific timeline or process is not provided. CRWD suggests continuing the comprehensive review of stormwater related City ordinances conducted in 2015, and expanding that review to internal processes for code enforcement in partnership with CRWD, RWMWMD, MWMO and LMRWMO.

Section 5.3.2. Water Quality Policies – Provide clarification on the intent of identifying lake classification systems developed by watershed organizations. No discussion is provided to determine if they are to be considered adopted policies incorporated by reference.

Water Quality Monitoring Programs Operated by Entities other than the City of St. Paul – This is an incomplete list of sites and does not fully describe the extent of monitoring conducted within St. Paul. CRWD suggests expanding the scope of the table to include monitoring conducted by St. Paul as well, and placement within the appropriate section of the plan should be reviewed.

Section 6.0 Implementation Program and Funding The District feels it is important to include a greater level of specificity on the projects listed in this section. This will improve the City’s position in terms of eligibility for future local, state and federal grants. Specifically, this section needs to be improved in the following ways: a. Each action in the implementation plan needs to have schedule, estimated cost, and funding source identified as specifically as possible. The plan generally lays out potentially funding sources for projects. This is not sufficient. Funding sources need to be specified by project. b. The implementation program should include annual budget totals. d. The implementation program should include years all the way through the year the local water plan extends, with specific actions scheduled for all years.

Background At the request of the City of Saint Paul and CRWD, MN United FC is completing final design of a ‘comprehensive stormwater management system’ for the entire 35-acre Snelling-Midway site. The comprehensive stormwater management system includes two cisterns for capturing roof runoff from the soccer stadium roof and future buildings to be constructed in later phases of site redevelopment. Tree trenches are also part of the design and will treat runoff from the new street and sidewalk grid. The captured rainwater will be filtered and treated for irrigating a total area of approximately 3.5 acres.

MN United FC is only required to construct a ‘base stormwater management system’ for the 20 acres its redeveloping for their new stadium. The cost for the base stormwater management system is $4.1 million while the cost for a comprehensive system is $5.06 million.

Issues The City of Saint Paul is requesting a $416,000 grant from CRWD to help offset the additional cost to build a comprehensive system, which will treat the entire 35-acre site. Sources of revenue for the $416,000 grant are MetCouncil Stormwater Improvement Grant, CWF East Kittsondale Stormwater Grant, which will cover approximately 75% of the total CRWD grant award, and CRWD’s required matching funds.

CRWD staff is working with City staff on a cost-share grant agreement for the comprehensive stormwater management system. See enclosed draft.

A. Project Definition and Grant Award Summary

THIS AGREEMENT is entered into this ____day of __________, 2017, by and between City of Saint Paul, hereinafter referred to as the “Grantee”, and Capitol Region Watershed District, hereinafter referred to as the “District”.

WITNESSETH: WHEREAS, the District has an approved Watershed Management Plan which includes funding for implementing Best Management Practices (BMPs) throughout the Watershed District; and WHEREAS, the District has adopted and approved the 2017 Budget and Workplan which includes funding for Snelling Midway Superblock Stormwater Management System; and WHEREAS, the District was awarded a FY 2016 Clean Water Fund grant totaling $200,000 from the Board of Water and Soil Resources, hereinafter referred to as the “State”, for stormwater BMPs in the East Kittsondale Subwatershed; and WHEREAS, the District was awarded a FY2016 Metropolitan Council Stormwater Grant totaling $200,000, hereinafter referred to as the “Council,” for innovative stormwater BMPs on the Snelling-Midway Superblock WHEREAS, the District and the Grantee have worked cooperatively to develop a project approach and design that is acceptable to both parties; and WHEREAS, the District and the Grantee have a desire to implement a comprehensive stormwater management system to improve runoff leaving Snelling Midway Superblock.

NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: 1. Project:

The Grantee shall perform the Project as defined in Exhibit A, as approved by the District.

2. Payment: The District shall make a grant to the Grantee in an amount not to exceed $416,000. The grant is limited to costs associated with items identified in Exhibit A. Payment will be in the form of reimbursement for actual costs, following receipt of documentation from the Grantee that the work has been completed satisfactorily. The District shall not be required to make payment on this agreement until such time as the funds are transferred to the District from the State.

3. Functionality: If the Project is a physical improvement, the Grantee shall ensure that the Project is fully functional and adequately maintained. The Grantee will develop an operation and maintenance plan which must be approved by the District. The Grantee shall ensure the Project is operational and maintained for a period of 25 years. Should the Grantee fail to maintain installed practices during their effective life according to the operation and maintenance plan, the Grantee may be liable to the District or 1

the State for up to one hundred fifty percent (150%) of the financial assistance received to construct, install, or otherwise establish the project.

4. Contracting and Bidding: If the Grantee must comply with the requirements of the Uniform Municipal Contracting Law, per Minn. Stat. § 471.345, including a formal notice and bidding process for the Project.

5. Project Assurances: 5.1 Technical Assistance Provider. The Grantee must provide the District with information on who will be providing technical and engineering assistance and their credentials. Technical assistance provider(s) must have appropriate credentials for practice investigation, design, and construction. Credentials can include conservation partnership Technical Approval Authority (TAA); applicable professional licensure; reputable vendor with applicable expertise and liability coverage; or other applicable credentials, training, and/or experience.

5.2 Practice Standards. The Grantee must ensure the use of appropriate practice standards for design, construction, operation, and maintenance of the Project. Applicable standards include USDA-NRCS Field Office Technical Guide, Minnesota Stormwater Manual, previous designs successfully implemented by the District, or other design standards with demonstrated success as approved by the District.

5.3 State’s Satisfaction Required. The Project must be performed to the State’s satisfaction as set forth in the approved work plan. Grantee will cooperate fully with any authorized representative of the State in determining compliance. All applicable law and regulations must be complied with, including the State’s FY2016 Clean Water Fund Competitive Grants Policy.

Grantee will not be reimbursed for any work found by the State to be unsatisfactory.

6. Publicity and Endorsement: 6.1 Publicity. Any publicity regarding the subject matter of this grant agreement must identify the District and the Board of Water and Soil Resources as the sponsoring agencies. For purposes of this provision, publicity includes notices, informational pamphlets, press releases, research, reports, signs, and similar public notices prepared by or for the Grantee individually or jointly with others, or any subcontractors, with respect to the program, publications, or services provided resulting from this grant agreement.

6.2 Endorsement. The Grantee must not claim that the State or District endorses its products or services.

7. Prevailing Wage: It is the responsibility of the Grantee or contractor to pay prevailing wages on construction projects to which State prevailing wage laws apply (Minn. Stat. 177.42 – 177.44). All laborers and mechanics employed by grant recipients and subcontractors funded in whole or in part with these funds shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality.

8. Signage: It is the responsibility of the Grantee to comply with requirements for project signage, as provided in Minnesota Laws 2010, Chapter 361, article 3, section 5 (b) for Clean Water Fund projects.

9. Intellectual Property Rights: The State owns all rights, title, and interest in all of the intellectual property rights, including copyrights, patents, trade secrets, trademarks, and service marks in the Works and Documents created and paid for under this grant. Works means all inventions, improvements, discoveries (whether or not patentable), databases, computer programs, reports, notes, studies, 2

photographs, negatives, designs, drawings, specifications, materials, tapes, and disks conceived, reduced to practice, created or originated by the Grantee, its employees, agents, and subcontractors, either individually or jointly with others in the performance of this grant. Works includes "Documents."

Documents are the originals of any databases, computer programs, reports, notes, studies, photographs, negatives, designs, drawings, specifications, materials, tapes, disks, or other materials, whether in tangible or electronic forms, prepared by the Grantee, its employees, agents, or subcontractors, in the performance of this grant. The Documents will be the exclusive property of the State and all such Documents must be immediately returned to the State by the Grantee upon completion or cancellation of this grant at the State’s request. To the extent possible, those Works eligible for copyright protection under the United States Copyright Act will be deemed to be "works made for hire." The Grantee assigns all right, title, and interest it may have in the Works and the Documents to the State. The Grantee must, at the request of the State, execute all papers and perform all other acts necessary to transfer or record the State's ownership interest in the Works and Documents.

10. Workers’ Compensation: The Grantee certifies that it is in compliance with Minn. Stat. § 176.181, subd. 2, pertaining to workers’ compensation insurance coverage. The Grantee’s employees and agents will not be considered State or District employees. Any claims that may arise under the Minnesota Workers Compensation Act on behalf of these employees and any claims made by any third party as a consequence of any act or omission on the part of these employees are in no way the State’s or District’s obligation or responsibility.

11. Reports: The Grantee will invite the District to key planning meetings and provide periodic updates during the design process. Reports shall provide information on project status, draft and final deliverables, project meeting summaries and other relevant work products for the project. If the project is a physical improvement, the grantee must obtain written approval for changes to the final plans and specifications, attached in Exhibit A, from the District.

12. Liability: The Grantee agrees to defend, indemnify and hold harmless the District and State against any and all claims, liability, loss, damage, or expense arising under the provisions of this Agreement, whether by the parties or by their agents, employees or contractors. Neither the District or the Grantee, if applicable, waive any immunities provided by any law or doctrine, including those of Minnesota Statutes Chapter 466. Nothing herein shall be construed to allow a claimant to obtain separate judgments or separate liability limits from the individual parties.

13. Termination: The District may immediately terminate this Agreement if it does not obtain funding from the State, or other funding source; or if funding cannot be continued at a level sufficient to allow for the payment of the services covered here. The District is not obligated to pay for any services that are provided after notice and effective date of termination. However, the Grantee will be entitled to payment, determined on a pro rata basis, for services satisfactorily performed, to the extent that funds are available.

The District will not be assessed any penalty if this Agreement is terminated because of the decision of the State, or other funding source, not to distribute funds.

14. Modification: It is understood and agreed by the parties hereto that this agreement shall not be modified or amended except in writing duly signed by each of the parties.

This agreement shall remain in full force and effect until 12/31/2018, unless terminated earlier by mutual agreement of the Grantee and the District.

Background The design development (DD) phase of CRWD’s new office is nearing completion and an updated 50% DD cost estimate was provided by MSR in mid-October. The final design phase, construction documents (CD), will commence in late November.

Issues Enclosed is an updated new building budget table. The updated 50% DD cost estimate for the entire building project is $10.32 million, which is a 2.3% increase from the earlier schematic design cost estimate of $10.09 million. Within the table, we have also identified the project items that are eligible for taxexempt bonding (ineligible items include Thomas parcel expenses) and two bonding scenarios for the Board to consider.

CRWD staff met with our financial advisor and bond counsel and outlined a bonding schedule that includes Board action on Dec. 6th for authorizing pre-sale of the bonds, Board award of bonds on Jan. 17th, and closing and wiring of funds to CRWD in early to mid-February 2018.

Also CRWD received proposals for the Construction Manager At Risk services from two firms: JE Dunn and Wenck Associates. CRWD design team staff and Managers Collins and Texer will review and interview the two firms and recommend one for Board approval on November 15th.

CRWD staff will discuss in further detail these three building items at the Board meeting.

RE: CRWD Comments on “Advancing Safe and Sustainable Water Reuse in Minnesota: 2017 Report of the Interagency Workgroup on Water Reuse” Dear Ms. Anderson: This letter summarizes Capitol Region Watershed District’s (CRWD) comments on the draft 2017 Report of the Interagency Workgroup on Water Reuse dated September 16, 2017. Watershed districts play a unique and critical role in water resource management. We serve as a key source of technical and financial resources to design and install projects that protect local water resources. We also successfully foster partnerships and leverage funding across municipal/political boundaries to meet collective water resource protection goals such as TMDLs. This puts watershed districts in a leadership role in implementing water reuse projects, especially as they relate to rainwater and stormwater.

CRWD has already demonstrated its leadership and commitment to the practice with significant investment and involvement in reuse projects at CHS Field, Upper Villa Park (B-Dale Club) and Great River School. CRWD also partnered with Freshwater Society to coordinate the Water Reuse Workshop held at CHS Field on May 2, 2016.

Major Comments Below are major comments on the report and process. Detailed comments on specific text of the report are in the following section.

1. Include Watershed Districts in the Planning Process: Given the fact that water reuse projects can provide water quality benefit and watershed districts have been involved in some of the state’s first reuse projects, it was disappointing that watershed districts were not included early in the planning and development of the report. As the workgroup moves forward with implementing the recommendations outlined in the report, it is essential that watershed districts are at the table from the beginning. Future decisions on guidance and regulation will have a significant impact on the ability of watershed districts and others to promote and implement reuse projects. Including watershed districts in future discussions will ensure benefits to water resources are properly considered.

2. Pathogen Reduction Target Approach is not workable for stormwater reuse: CRWD echoes the concerns expressed during the October 2nd stakeholder meeting regarding the pathogen reduction target approach (Table 5 in the report). The approach is difficult to understand and would be even more difficult to implement with a non-technical partner interested in pursuing a reuse project. The approach also differs from the water quality standards approach recently added to the plumbing code, and it is unclear whether the pathogen reduction target approach would replace them. In cases such as using a stormwater pond for irrigation, it is difficult to understand how the reduction target approach would influence the treatment system needed or add costs that may prohibit implementation. It is recommended that further consideration be given to an approach for determining treatment levels that is easy to understand and implement, and does not place undue burden on projects with a low-risk to public health.

3. Research should drive the guidance for stormwater reuse: Using rainwater or stormwater for irrigation has the greatest potential to provide water resource protection by both reducing the volume of polluted runoff that reaches local waterbodies and reducing the demand on our drinking water supplies. Though the report seems to imply the practice is generally low-risk, it still suggests some level of treatment may be required for unrestricted irrigation or when irrigating public spaces. This could add unreasonable cost and maintenance requirements resulting in fewer beneficial projects being installed. There is a need for additional scientific research to determine whether irrigating with rainwater or stormwater increases risk and warrants additional regulation. We suggest that additional/ongoing research (recommendation #8) be made a top priority so the risks can be identified and quantified and potential standards can be properly balanced with the benefits to water resources. Watershed districts and the Minnesota Stormwater Research Council are ideal potential partners as they already have stormwater and BMP monitoring programs in place.

Specific Comments 1. Page 12: Risk Categories a. Describe differences in risk between “landscape irrigation” and “residential irrigation on house lots and common areas” as well as athletic fields mentioned elsewhere in the report.

2. Page 13: “Explore options for clarifying and simplifying the regulatory path (including permitting) implementers have to navigate.” a. We recommend including a simple variance or alternative approval process to allow for easy approval of innovative/emerging technologies, especially those considered as low risk.

3. Page 14: “It could be beneficial for all Minnesota agencies, academic researchers, and stakeholders researching water reuse to work together to prioritize future research needs.” a. Additional research is critical to advancing reuse and should be emphasized more in this recommendation and throughout the report.

4. Pages 22-23: Table 3: Reuse Regulation or Guidance by Water Source a. It is likely that educational water features (fountains etc.) will be included in future reuse projects.

It should be clarified where they may fit in the regulatory system.

This is mentioned several times throughout the report and is a major obstacle in providing adequate supply for a reuse system. This report and future guidance should promote changes to code and approval processes to more readily allow for stormwater to be used indoors.

Relying on variances to allow stormwater reuse indoors creates too much uncertainty for project designers and owners. If there is an example of a variance for stormwater reuse indoors, please include it in the list.

Include a step that evaluates the water resource benefits of reuse projects (conservation, water quality improvement/protection) and impacts to project implementation (increased cost, maintenance, complexity) if a pathogen reduction target approach is adopted.

Factual points which provide background to, or a basis for, the issue addressed by Resolution: One Watershed, One Plan was developed by the Local Government Water Roundtable (Association of Minnesota Counties, and the Minnesota Associations of Watershed Districts and Soil and Water Conservation Districts) which recommended that local governments charged with water management responsibilities should organize and develop focused implementation plans on a watershed scale.

The vision of One Watershed, One Plan is to align local water planning on major watershed boundaries with local strategies towards prioritized, targeted and measurable implementation plans.

Based upon the above facts, what is the proposed solution to the problem discussed above: The Minnesota Association of Watershed Districts pursue legislation requiring state Clean Water Land and Legacy Funds for One Watershed, One Plan and the WRAPS programs to provide a direct linkage and alignment with each other as well as local watershed plan implementation.

Resolution State Watershed Program Coordination and Integration with Local Watershed Implementation Whereas, Minnesota has a long history of water management by local government units; and Whereas, the Minnesota Legislature authorized the creation of watershed districts in 1955, through the Watershed Act, with the idea that water management policies should be developed on a watershed basis, because water does not follow political boundaries; and Whereas, the statutory purposes of watershed districts are to conserve the natural resources of the state by land use planning, flood control, and other conservation projects by using sound scientific principles for the protection of public health and welfare and the provident use of natural resources; and Whereas, the specific duties of Watershed Districts vary across the state -- some focus mainly on flood damage reduction, while others have a broad range of programs and services to protect and improve water quality; and Whereas, One Watershed, One Plan was developed by the Local Government Water Roundtable (Association of Minnesota Counties, and the Minnesota Associations of Watershed Districts and Soil and Water Conservation Districts) which recommended that local governments charged with water management responsibilities should organize and develop focused implementation plans on a watershed scale; and Whereas, the vision of One Watershed, One Plan is to align local water planning on major watershed boundaries with local strategies towards prioritized, targeted and measurable implementation plans; and Whereas, BWSR’s vision for One Watershed, One Plan is that plans developed through this approach will address the need for focused watershed-based implementation plans that will be prioritized, targeted, and measurable; and Whereas, the MPCA is charged with the State adopted “watershed approach” to address the state’s 81 “major” watersheds to develop Watershed Restoration and Protection Strategies (WRAPS); and Whereas, current implementation of the both the One Watershed, One Plan and the WRAPS program needs to be better integrated into local watershed implementation efforts; and Whereas, Clean Water Funds should not be expended on state efforts that duplicate or do not advance local watershed implementation; Therefore, be it resolved that the Minnesota Association of Watershed Districts pursue legislation requiring state Clean Water Land and Legacy Funds for One Watershed, One Plan and the WRAPS programs to provide a direct linkage and alignment with each other as well as local watershed plan implementation; and Be It Further Resolved that Clean Water Land and Legacy funds for One Watershed, One Plan and the WRAPS programs do not duplicate local efforts and are focused towards local watershed implementation.
