Background Construction activity is complete for permits #16-026 St. Anthony Park Elementary and #19-001 Fairview Ave. 2019.

Issues St. Anthony Park Elementary #16-026 This permit was issued for the redesign and expansion of the elementary school entrance. Stormwater is treated via impervious disconnection and 743 cubic feet of volume bank credits (withdrawal was approved by the Board of Managers on 5/16/18). The site is stable and the impervious disconnection has been confirmed. There is no surety to return.

Action Requested Confirm withdrawal of 743 cf from the St. Paul Public Schools volume bank and approve Certificate of Completion for permit #16-026 St. Anthony Park Elementary School.

Fairview Ave. 2019 #19-001 This permit was issued for the reconstruction of Fairview Avenue between Shields and University in St. Paul. Stormwater is treated in one under-street infiltration trench that met the cost cap. The site is stable and the trench function has been confirmed. No surety was required for this public project.

Action Requested Approve Certificate of Completion for permit #19-001, Fairview Ave. 2019.

RULE C: STORMWATER MANAGEMENT Standards ďƒ˜ Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.

 Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 39,445 ft2 – 6,100 ft2 Green Roof Area = 33,345 ft2 subject to volume retention. b. Volume retention required: 33,345 ft2 x 1.1 inches x 1 ft/12 inches = 3,057 ft3 Table 1. Proposed volume retention through abstraction (i.e. infiltration, reuse).

The applicant has not submitted money to be contributed to the Stormwater Impact Fund. e. The project is not linear.

5. Best management practices achieve 90% total suspended solids removal from the runoff generated on an annual basis.

6. A maintenance agreement recorded with Ramsey County has not been submitted.

7. Adequate maintenance access is provided for subsurface system. A site-specific plan, schedule, and narrative for maintenance of the proposed stormwater management practices has been submitted.

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Total disturbed area is 1.03 acres; an NPDES permit is required. A SWPPP has been submitted.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 5 Conditions Conditions: 1. Receipt of $4,500 surety.

2. Receipt of documentation of maintenance agreement recorded with Ramsey County.

3. Provide a copy of the NPDES permit.

4. Provide detail for green roof to ensure sufficient soil depth to collect runoff.

5. Revise model or plans to correspond for the filtration basin (See HydroCAD Output Below): a. Invert for the rock is 882.77’ in the HydroCAD and 882.14’ on Sheet C702 in the plans. b. Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 77,607 ft2. b. Volume retention required: 77,607 ft2 x 1.1 inches x 1 ft/12 inches = 7,114 ft3 Table 1. RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

3. For greater than a 100-year rainfall, the infiltration system may surcharge to the surface through STRMs #11 and #14 at an elevation of 895.14’ and will discharge directly to the underground parking. Consider having an emergency overflow that will direct water away from the underground parking structure.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a land-disturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Total disturbed area is 2.1 acres; an NPDES permit is required. A SWPPP has been submitted.

Do not connect the building sump and foundation draintile to the infiltration system. CRWD understands that the perimeter drain tile will be connected to STRM #2 downstream of the weir and the trench drain will discharge to the infiltration system, but this is not clearly stated in the plans. b. Provide specification for “Select Granular Borrow” in Keyed Note 5 on Sheet C200 to be used for fill under the infiltration systems.

8. Revise HydroCAD model or plans to correspond for the 36” Infiltration System. The length of the rock prismatoid is 20 feet in HydroCAD and 17 feet on Sheet C300.

Similarly, the Row Length Adjustment is -10 feet in HydroCAD and -13 feet on Sheet C300. These related changes will decrease volume retention and increase the system HWL.

Permit Applications and Program Updates A) 19-020 Harambee Elementary Addition and Remodel – Closure (Martinkosky)

Mr. Martinkosky reviewed permit #19-020 for Harambee Elementary Addition and Remodel. This permit was issued for the construction of two building additions, reconstructed sidewalks and bituminous parking

lot, and related utilities. Stormwater is treated via one filtration basin on the north side of the school. The site is stable, and the stormwater treatment systems have been confirmed functional. There is no surety to return.

Motion 20-213: Approve Certificate of Completion for permit #19-020 Harambee Elementary Addition and Remodel.

Murphy/Sanders Unanimously Approved Special Reports – Como Lake Management Plan Implementation Update (Belden)

Ms. Belden provided an updated on the Como Lake Management Plan (CLMP) that was adopted by the Board of Managers on May 15, 2019. The CLMP presents an adaptive management plan framework for achieving water quality goals for Como Lake through in-lake, watershed, and community actions over the next 20 years.

As part of the CLMP adaptive management approach, a short-term implementation plan was developed that defines actions to be implemented over the first three years (2019-2021). The short-term implementation plan will be evaluated and revised every three years based on how the lake responds to implemented actions. An updated short-term implementation plan will be defined for the following three years (2022-2024).

Throughout 2020, staff have been working on the implementation of several actions identified in the current short-term implementation. Specifically, in the last year staff have either implemented or been in the development stages of the following actions: • • • • • • • •

Aquatic Vegetation Management Plan (February 2020) Herbicide Treatment of Curly-leaf Pondweed (April 2020) Alum Treatment (May 2020) Annual Lake Monitoring – Chemical, Physical, Biological (April-November 2020) Shoreline Assessment (September 2020) Shoreline Management Plan (In Progress, anticipated: December 2020) Fisheries Management Plan Development (In Progress, anticipated: December 2020) Community Engagement Efforts – Water Wildlife Signage/Stencils, Walking Tour, etc.

Ms. Belden reviewed lake monitoring results since 1984. The results for 2020 show a 62% decrease in phosphorus levels since the alum treatment in May. Ms. Belden shared plans for upgraded signage around the lake.

Manager Murphy inquired about native plants returning after the herbicide treatment on Como Lake. Ms. Belden replied that the condition of Como Lake was so degraded that plants have not been able to return.

Ms. Belden added the hope is that next year historical plants will be able to return.

Manager Sanders asked about the fish to be stocked in Como Lake. Ms. Belden replied that we want to be intentional about the types of fish that will be stocked to keep a healthy and natural balance in the lake.

Murphy/Sanders Unanimously approved C) AR: Approve Hazard Mitigation Grant Program Application for the TBI Flood Modeling and Mitigation Feasibility Study (Zwonitzer) Mr. Zwonitzer reviewed that CRWDâ&#x20AC;&#x2122;s 2020 and 2021 budgets include funding to conduct additional detailed modeling of Trout Brook Interceptor (TBI) and the 8,150-acre Trout Brook sub watershed. This expands on the Atlas-14 model update completed in 2018 by adding spatial resolution to the model particularly in the City of Saint Paul and includes evaluating storm sewer capacity issues, areas of flooding, and watershed pollutant loading. The results will help CRWD and its partners identify and prioritize future mitigation efforts.

Federal Hazard Mitigation Grant Program funds are available through the Minnesota Department of Public Safetyâ&#x20AC;&#x2122;s Division of Homeland Security and Emergency Management (HSEM). The grant program reallocates remaining funds from previous federal (FEMA) emergency declarations in the state for projects that prevent future emergencies. CRWD and Barr Engineering staff have been communicating with HSEM staff about the eligibility of the Trout Brook Flood Modeling and Mitigation Feasibility Study. The study includes building detailed and calibrated XP-SWMM (hydraulic) and P8 (water quality) models and updating TBI flood prioritization areas. The study also includes a more detailed flood mitigation study of one high priority flood area (Task 5). HSEM staff indicated the entire project may be eligible for 75% funding. At an estimated $500,000 to complete the project, $375,00 could be covered by the grant with $125,000 to be covered by CRWD. Finalizing the application requires a resolution establishing an authorized representative for CRWD as well as a letter of commitment for local (match) funds. If approved for funding, staff will coordinate execution of the grant agreement with the state/FEMA, refine the scope of work with project partners, and will come back to the Board for approval of a contract with Barr Engineering to complete the work. HSEM staff

indicated it may take 6-9 months for FEMA to process applications due to staffing shortages. The project is estimated to take about two years to complete.

Motion 20-216: Approve Hazard Mitigation Grant Program application and scope for the TBI Flood Modeling and Mitigation Feasibility Study and authorize the Administrator to be the CRWD Representative for grant administration.

Murphy/Sanders Unanimously approved D) AR: Authorize CRWD Annual Meeting Delegates to vote on MAWD Resolutions consistent with Resolutions Committee Recommendations (Doneux) Administrator Doneux reviewed that as part of the annual meeting of the Minnesota Association of Watershed District (MAWD), delegates are asked to consider and take action on resolutions submitted to the membership.

This year several resolutions are being considered at the annual meeting.

The MAWD Resolution committee will meet virtually at the Annual Meeting on Friday, December 4, 2020 to entertain any questions regarding their recommendations from the proposing watershed district or other member districts and review any Board of Director's Resolutions.

The Board of Managers should provide direction and recommendations to the CRWD delegates, Mary Texer and Rick Sanders on how to vote on yearâ&#x20AC;&#x2122;s slate of resolutions.

Manager Texer reviewed the recommendations submitted to the resolutions committee. There was a thorough discussion of each resolution and why it was or was not supported by the MAWD Resolution Committee. It was specifically discussed why certain resolutions, that on face value, look like good environmental policies but were not supported by Resolution Committee or by members of the CRWD Board. It was discussed that one primary reason is that the non-supported resolutions were voted down last year and were not changed or updated in any way for this year. It would take both revisions to the proposed resolution and work to build greater awareness and support from other watershed organizations by the sponsor to gain greater interest in the non-supported resolutions.

Unfinished Business A) Science Museum of Minnesota Update (Zwonitzer)

Mr. Zwonitzer provided an update on the Science Museum of Minnesota feasibility study. At the end of September two meetings were held. Design workshops were held in October. Mr. Zwonitzer will be returning to the board with draft plans later.

B) Willow Reserve Update (Zwonitzer) Mr. Zwonitzer provided a review of the Willow Reserve project. After four years of work, the project is wrapping up. The project was extended one year because 2019 was an excessively wet year. Mr. Zwonitzer provided a power point review with many before and after photos of the work that was achieved.

Manager Sullivan Janzen asked about the water quality in the Willow Reserve. Mr. Zwonitzer replied that the area is very shallow and treating runoff before going into the Villa Park.

C) Midway Peace Park Update (Eleria) Ms. Eleria provided a review of the Midway Peace Park located at 416 Griggs Street. The park is 5 acres and includes a water feature with artistically designed signage reaching out to multiple cultures. A grand opening celebration is being planned for next spring depending on COVID-19 restrictions.

D) Seminary Pond Update (Eleria) Ms. Eleria provided a brief update on the Seminary Pond project. Ms. Eleria shared a photo showing work currently being done at the site.

E) Board Bylaws and Committee Update (Doneux) Administrator Doneux reviewed that in 1999, the Board of Managers establish the first Bylaws that provide rules for governing and the conduct and procedure of business for the Board. This was one (1) year after the formation of the District and prior to hiring staff. The Bylaws were updated in 2004 and last updated 11 years ago in 2009.

In 2002, the Board first established several Board Committees to conduct business of the organization. At that time seven (7) committees were formed. Since 2002, the Board has expanded the number of committees thirteen (13). At the November 4, 2020 Board Workshop, the Bylaws and Committee assignments were discussed.

The Board supported the basic changes proposed at the workshop to the Duties of the Officers with some additional comments and changes.

The Board also reviewed and discussed a possible realignment of Board Committees. The Board agreed that reducing the number of committees would be better and generally agreed with the proposed alignment of new committees. The Board did feel that a Communications and Community Committee would be better if it were separate from the proposed Program Committee.

There was some further discussion about clarifying several descriptions of Board Officer duties. The Board asked staff to return to a future meeting with an updated draft set of Bylaws and Committees for further review and consideration. If the Board were to make changes to either the Bylaws and/or Committees, those changes should be done in time for the annual meeting to be held on December 16th.

Administrator Doneux suggested that each Manager would serve on two committees. No action was taken.

VII.

General Information A) Board of Manager’s Updates

Manager Texer gave an update on the MAWD Annual Meeting. The dates of the conference will be December 1-4.

Manager Murphy attended the CAC Meeting. The group discussed changing the name from Citizen Advisory Committee to Community Advisory Committee.

Background Bang Brewing is located in the St. Anthony Park neighborhood of Saint Paul at 2320 Capp Road. In 2016, Bang Brewing received approximately $10,000 in grant funds from CRWD and Ramsey Soil and Water Conservation Division (RCSWCD) for two rain gardens at the brewery. Last year, Bang Brewing purchased the adjacent parcel and is proposing to construct an 850 square foot rain garden that will capture 15,725 square feet of untreated parking lot and rooftop runoff.

Issues CRWD and RCSWCD have provided a watershed analysis and developed construction site plans for the proposed rain garden. The 850 square foot rain garden will include two basins sized to capture and infiltrate 0.9â&#x20AC;? rain events from Bang Brewingâ&#x20AC;&#x2122;s parking lot and the adjacent parking lot at 2325 Endicott Street owned by Deneen Pottery. Deneen Pottery is aware of the rain garden installation and has not indicated any intention of redirecting stormwater on the parking lot for the life expectancy of the stormwater best management practices (BMPs). Each basin will have an inlet with a pretreatment device. The rain garden will capture 126,325 cubic feet of stormwater per year (a 70% reduction). Total suspended solids and total phosphorus will be reduced by 70% and 69%, respectively.

The contractor estimates a project cost of $55,141. CRWD staff has determined by using the Stewardship Grant Calculator an award not to exceed $28,945. The grant award is reflective of the water quality benefit this project is designed to provide. A minimum 25% match is required for businesses.

Bang Brewing is responsible for the remaining costs of the project, which exceeds the 25% match requirement.

Action Requested Approve a grant award to Bang Brewing for an amount not to exceed $28,945 and authorize the District Administrator to execute a grant agreement.

Background In 1999, the Board of Managers establish the first Bylaws that provide rules for governing and the conduct and procedure of business for the Board. This was one (1) year after the formation of the District and prior to hiring staff. The Bylaws were updated in 2004 and last updated 11 years ago in 2009 (enclosed).

In 2002, the Board first established several Board Committees to conduct business of the organization.

At that time seven (7) committees were formed. Since 2002, the Board has expanded the number of committees thirteen (13). At the November 4, 2020 Board Workshop and November 18, 2020 Board meeting, the Bylaws and Committee assignments were discussed.

Issues At the November 28th Board meeting, several recommended changes were offered regarding the duties of the officers.

No significant changes were offered to the new committee structure except to note that “Other Appointments” would be called “Other Appointments or Assignments” and the Nominating Committee would be included in this group.

The Board asked staff to return to a future meeting with an updated draft set of Bylaws and Committees for further review and possible adoption. It is recommended that the Board make changes to the Bylaws and Committees so that those changes could be done in advance of the annual meeting to be held on December 16th.

BYLAWS OF THE CAPITOL REGION WATERSHED DISTRICT Adopted November 18, 1999 Amended September 2, 2004 Amended November 30, 2004 Amended February 18, 2009 Amended November 30, 2020

These bylaws establish rules governing the conduct and procedure of business by the Board of Managers (Board) of the Capitol Region Watershed District (District) of Ramsey County.

ARTICLE I: OFFICE Section A.

The place of business for the District and its principal office is located at 595 Aldine Street, St. Paul, MN 55104. The District’s official records will be maintained at its principal office. The Board may change the location of its principal office.

Section B.

Regular meetings will take place at the principal office. The Board may conduct District meetings at other meeting places or by other means following procedures found in Article V: MEETINGS.

ARTICLE II: DEFINITION OF TERMS Section A.

For the purposes of these bylaws, the terms defined in this section shall have the meanings given them.

Section B.

‘District’ means, the operational body created by the formation of the Capitol Region Watershed District. The Capitol Region Watershed District shall be a public agency of its Board.

Section C.

‘Board’ means the District Board of Managers {Article III (DISTRICT BOARD of MANAGERS)}.

Section D.

‘Officers’ means those persons designated to perform the duties as noted in Article IV (OFFICERS) of these bylaws.

Section E.

‘Official Business’ will include: Official Business is attending Annual, Regular, Special or emergency meetings called for the purpose of conducting District business which has been properly posted.

Official Business, also, includes the assignment of a manager to special duties or meetings which the District Board of Managers has pre-approved for reimbursement or retroactively approved by authorizing payment of -1-

meeting expenses. Official Business will include attendance at meetings of the Minnesota Association of Watershed Districts, Inc. (MAWD), Metro MAWD, and other educational opportunities which relate to or required for watershed business.

ARTICLE III: DISTRICT BOARD OF MANAGERS Section A.

The District Board of Managers shall be comprised of at least five (5) District Managers who are appointed by the Ramsey County Board of Commissioners pursuant to Minnesota Statutes (M.S.) chapter 103B.227(1), (2) and M.S. chapter 103D.311 as amended. A District Managerâ&#x20AC;&#x2122;s term continues until a successor is appointed.

Section B.

Terms, Election, Unexpired Term

1)

Terms of the Officers shall be for one (1) year, commencing on the date of the election. No manager shall hold more that one office at a time. Election of the Officers shall be held at the Districtâ&#x20AC;&#x2122;s Annual Meeting.

2)

Annually the President shall appoint a nominating Committee to solicit candidates for officer positions and committee assignments. The Officers shall be elected annually and shall not serve for a period of more than (3) successive terms, unless unanimously elected by the Board of Managers at the Annual Meeting.

3)

In the event of an unexpired term of a manager, the Board shall immediately elect from among its members an individual who will perform the duties of that officer for the unexpired portion of the term.

Manages, with the Administrator and finance committee, the boardâ&#x20AC;&#x2122;s review of and action on its financial responsibilities and ensure that financial reports are distributed to the board in advance of meetings.

ARTICLE V: MEETINGS Section A.

Regular meetings shall be held by the Board for the purpose of conducting the general business of the District. The frequency, dates and times of such meetings will be set and posted by the Board, and may be changed at any time by action of the Board. The meetings of the Board shall be open meetings.

Section B.

Special meetings of the Board are any meetings called by any Manager for the purpose of conducting certain specified business, and the Managers shall only consider such matters. Special meetings shall be conducted the same as regular meetings and public notice of the special meeting shall be posted.

Section C.

Emergency meetings can be called by any Manager on twenty four (24) hour notice whenever the life, safety or significant property of any resident within the District shall be threatened by flooding or the failure of any control structure within the jurisdiction of the District. Whenever practical, a request for such a meeting should be made in writing to the Secretary, who will notify all other Board members as quickly as possible, and public notice of the emergency meeting shall be posted.

Section D.

Annual Meeting of the Capitol Region Watershed District shall be held the last regular meeting in December or at a date and time designated by the Board. The minutes of the Annual Meeting shall be reviewed and approved at the next regular meeting of the District. The Board shall provide sufficient advance notice of the meeting to residents of the District. Whenever practical, this notice should be made at least thirty (30) days prior to the meetings.

The District Board of Managers during this meeting shall:

Elect from among its members its Officers. Election shall be by majority vote;

Appoint or reappoint for the coming year a bank or depository for funds of the District and such other professional assistance as the District may require.

Miscellaneous explanations for meetings: 1)

Quorum for the Board of five (5) managers shall be three (3). No action shall be taken or motion approved with out three managers voting in favor.

Posting of the notice of meetings other than the regular monthly meeting shall be posted in a conspicuous place at its legal place of business at least seventy two (72) hours before said meeting.

There shall be no proxy voting by Managers. All votes by Managers shall be in person.

All open and public meetings shall comply with the statutes and rules requiring open and public meetings.

5)

The conduct of all meetings of the Board shall be governed by a “Simplified Version of Robert’s Rules of Parliamentary Law”.

ARTICLE VI: COMMITTEES Section A.

The Board may appoint full committees for the purpose of assisting the Board in the performance of its duties.

Section B.

Advisory Committee shall be appointed as stated in M.S. Chapter 103D.331 and Technical Advisory Committee in M.S. Chapter 103D.337.

ARTICLE VII: FINANCIAL MATTERS Section A.

Fiscal year of the District shall be from January 1 to December 31.

Section B.

Goods and services purchased for use by the District must follow state law and the District’s purchasing guidelines approved of the Board.

Section C.

Approval of payment of every invoice, bill or any other form of indebtedness incurred by the District must have approval of the Board.

Section D.

The Board will solicit proposals or quotations for such services, according to M.S. Chapter 103B.227 subd. 5. This paragraph is not meant to be applied to any contract for a professional service which is for a specific project, the nature and scope of which requires work to be performed or services rendered over a period of more than two (2) years.

Section E.

Compensation and Reimbursement for District Managers shall be given for Official Business as defined in the Bylaws, Article II: Definition of Terms, Section E.

ARTICLE VIII: MISCELLANEOUS Section A.

The District Board of Managers shall prepare an annual report as is stated in MN Chapter 103D.351.

Section B.

Bylaws. These bylaws shall be adopted by a majority vote of the managers. These bylaws shall be required to be amended, suspended or repealed by the approval of four (4) Managers.

Background Capitol Region Watershed District is following the Minnesota Department of Health’s (MDH) guidance to slow the spread of COVID-19 and reduce impacts to health and safety as well as complying with the Governor’s declaration of a peacetime state of emergency. CRWD’s office was closed to the public starting on Tuesday, March 17, 2020. Staff have been working remotely, except for essential services, and will be available via phone or email. On April 1, 2020 the Board adopted COVID-19 Response Plan and a list of Essential Services consistent with the Governors Emergency Executive Order 20-20. The Board also affirmed that CRWD Board meetings will be conducted electronically.

Issues On November 5, 2020 Governor Tim Walz issued Emergency Executive Order 20-94 that is an update to Executive Order 20-8 Authorizing and Directing the Commissioner of Education to Require School Districts and Charter Schools to Provide a Safe and Effective Learning Environment for Minnesota’s Students during the 2020-21 School Year. On November 12, 2020, Governor Tim Walz issued Emergency Executive Order 20-97 extending the Stay at Home Order through December 15, 2020. CRWD’s Response Plan was extended to require that staff work from home unless performing essential services as approved by their supervisor or for minimum basic operations and non-critical office-based business work.

On November 18, 2020 Governor Tim Walz issued Executive Order 20-99 that Implements a Four Week Dial Back on Certain Activities to Slow the Spread of COVID-19.

Executive Orders 20-94, 20-97 and 20-99 taken together along with the determination of state government to work from home until June of 2021 and a significant increase in positive COVID-19 cases in Ramsey County has prompted me to recommend that CRWD to extend its Work from Home requirement until, at least, June 30, 2021.

In addition to this update, Appendix B- COVID-19 Positive Test/Exposure/Symptoms Response Protocol has also been updated to provide better alignment with current MN Department of Health and CDC guidance.

CRWD COVID-19 Response Plan November 30, 2020 Update This update provides direction regarding Governor Tim Walz’s Emergency Executive Orders 20-94, 20-97 and 20-99.

CRWD’s office was closed to the public on Tuesday, March 17, 2020 until further notice in response to the peacetime emergency declaration by Governor Tim Walz. Staff were encouraged to work from home via their computers, phones and email following the District’s Work Off Site Policy.

On March 25, 2020, Governor Tim Walz issued Emergency Executive Order 20-20 Directing Minnesotans to Stay at Home. CRWD updated its Response Plan to require that staff work from home unless performing essential services as approved by their supervisor.

On April 8, 2020, Governor Tim Walz issued Emergency Executive Order 20-33 extending the Stay at Home Order through May 3, 2020. CRWD’s Response Plan was extended to require that staff work from home unless performing essential services as approved by their supervisor.

On April 30, 2020, Governor Tim Walz issued Emergency Executive Order 20-48 extending the Stay at Home Order through May 18, 2020. CRWD’s Response Plan was extended to require that staff work from home unless performing essential services as approved by their supervisor or for minimum basic operations and non-critical office-based business work.

On May 13, 2020, Governor Tim Walz issued Emergency Executive Order 20-56 to safely reopen our economy by allowing even more non-critical businesses to reopen, provided that they follow guidance from Minnesota Department of Health (MDH), the Department of Employment and Economic Development (DEED), and the Department of Labor and Industry (DLI). Staff may work at the office when following CRWD’s Preparedness Plan. Appendix B was added to the CRWD Preparedness Plan to respond to positive tests, exposure and systems related to COVID-19 within the office.

On July 22, 2020 Governor Tim Walz issued Emergency Executive Order 20-81 stating that Minnesotans must wear a face covering in indoor businesses and indoor public settings.

Appendix C was added to the CRWD Preparedness Plan to respond to the requirement to wear face coverings within the office.

On July 30, 2020 Governor Tim Walz issued Emergency Executive Order 20-82 Authorizing and Directing the Commissioner of Education to Require School Districts and Charter Schools to Provide a Safe and Effective Learning Environment for Minnesota’s Students during the 2020-21 School Year. This Order prompted CRWD to extend its Work from Home requirement until, at least, December 31, 2020. Stay home if you are sick.

Cough and sneeze in your elbow, not your hands.

Work Off Site due to District closing office – The District has closed the office due to the Governor’s Emergency Orders. The District will continue to pay staff and expect staff to continue to work following the WOS Policy. The District will allow flexibility in its WOS policy. Specifically, the District will waive or be flexible on the monthly hours and/or annual WOS hours. During this time, no staff are to be in the office unless deemed necessary and essential by your supervisor. If you are to be in the office for an essential function, the exterior doors must remain locked, and the sliding glass doors at the reception area closed and locked. In the event of a delivery during your time in the office, determine if it is essential (US mail, CRWD delivery) using the lobby door intercom phones. Only open the door once you have determined that it is an essential delivery. Request the delivery be placed on a table in the vestibule. Do not greet the delivery person and do not sign for deliveries. Also, please do not have any personal deliveries made to the office and discontinue any possible future CRWD deliveries until further notice.

Work Off Site for Personal Reasons - Under unique or special circumstances caused by a peace time state of emergency and/or Shelter in Place Order, staff may request the District to be flexible with the WOS policy. Those unique or special circumstances may include: a.

In the event of unique or special circumstances the District will be flexible in both its WOS and PTO policies. The District will not be punitive of staff needing to be out of the office in the event of unique or special circumstances. Staff will utilize WOS to the extent possible. For the purposes of recording time for payroll, staff should enter 80 hours per pay period of WOS. Actual personal time off would be considered PTO.

Meetings a.

All CRWD hosted meetings will be canceled, postponed, adapted to meet CDC guidelines or done virtually. b.

Until further notice, discontinue approving external group reservation requests for CRWD meeting space c.

Staff will evaluate all existing planned meetings to determine if they should be canceled, postponed or be held electronically. d.

If two or more employees were to be in the office at the same time, implement social distancing measures in the office: a. Increase physical space between workers at the worksite by taking advantage of alternative workspaces. b. Eliminate social contact in the workplace (e.g., limit in-person meetings, meeting for lunch in the pantry, etc.).

Travel/Conferences a.

Work travel should be canceled until further notice. b.

Essential work travel to the office or to a job site will be considered on a case-bycase basis and approved by your supervisor. No personal contacts should be made if work travel was approved. Please see Essential Services list for guidance on what may require you to leave your home for work travel. c.

No future, non-essential, work travel should be scheduled at this time. d.

Employees traveling domestically or internationally for personal reasons are required to contact their supervisor prior to returning to work.

This updated policy goes into effect on November 16, 2020 and will continue until June 30, 2021. The Administrator may, at any time, adjust or modify this policy to adapt to the unique or special circumstances of our community.

CRWD COVID-19 Preparedness Plan Capitol Region Watershed District (CRWD) is committed to providing a safe and healthy workplace for all our staff. To ensure that, we have developed the following Preparedness Plan in response to the COVID-19 pandemic. Managers and staff are all responsible for implementing this plan. Our goal is to mitigate the potential for transmission of COVID-19 in our workplaces, and that requires full cooperation among staff and management. Only through this cooperative effort can we establish and maintain the safety and health of our staff and workplaces.

CRWD staff are responsible for implementing and complying with all aspects of this Preparedness Plan. CRWD’s Administrator and Division Managers are in full support of enforcing the provisions of this policy.

Our staff are our most important assets. We are serious about safety and health and keeping our staff working at CRWD. Worker involvement is essential in developing and implementing a successful COVID-19 Preparedness Plan. The Preparedness Plan was drafted by the Administrator and reviewed by Division Managers and will be updated as guidance changes. Our Preparedness Plan follows the Centers for Disease Control and Prevention (CDC) and Minnesota Department of Health (MDH) guidelines, federal OSHA standards as well as local City/County requirements related to COVID-19 and addresses: • hygiene and respiratory etiquette; • engineering and administrative controls for social distancing; • housekeeping – cleaning, disinfecting and decontaminating; • prompt identification and isolation of sick persons; • communications and training that will be provided to managers and staff; and • management and supervision necessary to ensure effective implementation of the plan.

Screening and policies for staff exhibiting signs and symptoms of COVID-19 Staff have been informed of and required to self-monitor for signs and symptoms of COVID-19.

Symptoms of COVID-19 can be found on the MN Department of Health website. The following policies and procedures are being implemented to assess staff health status prior to entering the workplace and for staff to report when they are sick or experiencing symptoms. Staff must conduct daily health checks, including taking their temperature, screen themselves for symptoms, and determine any close contact with a person who is positive for COVID-19, prior to coming to work at the office or in the field.

CRWD has developed protocols for staff who have tested positive for COVID-19, are experiencing COVID-19 symptoms and have come in contact to an individual who has tested positive for COVID-19 or is experiencing symptoms of COVID-19. See Appendix B. CRWD has implemented leave policies that promote staff staying at home when they are sick, when household members are sick, or when required by a health care provider to isolate or quarantine themselves or a member of their household. CRWD’s paid time off and employee leave policy is described in the CRWD Personnel Policy Handbook and further clarified in CRWD CRWD COVID-19 Response and Preparedness Plan

COVID-19 Response Plan - April 10, 2020 Update. Accommodations for staff with underlying medical conditions or who have household members with underlying health conditions have been implemented. These accommodations are outlined in CRWD COVID-19 Response Plan - April 10, 2020 Update.

CRWD has also implemented a policy for informing staff if they have been exposed to a person with COVID-19 at their workplace and requiring them to quarantine for the required amount of time. CRWD will, to the extent possible, inform staff if they have been exposed to a co-worker with COVID-19 and all individuals exposed along with the positive COVID-19 person must remain in quarantine for 14 days. See Appendix B for more information.

In addition, a policy has been implemented to protect the privacy of staff health status and health information. All staff health status and health information will be kept confidential.

Handwashing Basic infection prevention measures are being implemented at our workplace at all times. Staff are instructed to wash their hands for at least 20 seconds with soap and water frequently throughout the day, but especially at the beginning and end of their shift, prior to any mealtimes and after using the toilet. All visitors to the facility will be required to wash their hands prior to or immediately upon entering the facility. Some workplaces may have hand-sanitizer dispensers (that use sanitizers of greater than 60% alcohol) that can be used for hand hygiene in place of soap and water if hands are not visibly soiled.

Staff will have access to restrooms that will provide soap, water and both paper towels and electric hand dryers for handwashing. Hand sanitizer is also available in the office as well as CRWD vehicles which can be used in place of soap and water. Staff are strongly encouraged to wash or sanitize their hands regularly. Sanitizing supplies will be available in key locations around the office (i.e. entrances/exits).

Respiratory etiquette: Cover your cough or sneeze Staff are being instructed to cover their mouth and nose with their sleeve or a tissue when coughing or sneezing and to avoid touching their face, their mouth, nose and eyes, with their hands. They should dispose of tissues in the trash and wash or sanitize their hands immediately afterward.

Respiratory etiquette will be demonstrated in policies and supported by making tissues and trash receptacles available to all staff. All staff will be informed, in writing, of the respiratory etiquette described above. Staff should wear a mask from home if they are sneezing frequently.

Social distancing Social distancing is being implemented in the workplace through administrative controls. Staff shall continue to work from home if their job duties allow them to work remotely. All staff must maintain social distancing when in the workplace. This means, maintaining at least a six-foot distance from all staff at all times. In the event staff cannot maintain the minimum six-foot distance, masks must be worn.

If staff work in the office, they must schedule time in the office and inform their supervisor and the Administrator. Staff must add â&#x20AC;&#x153;in-officeâ&#x20AC;? to their Outlook Calendar. Staff must work from their CRWD COVID-19 Response and Preparedness Plan

workstation and comply with social distancing requirements. No public or partner meetings are allowed in the building. The building is always to remain locked. No common/public spaces may be used, specifically, pantry, and conference rooms. The Mississippi River Room, focus rooms, cafĂŠ (Willow Reserve), collaboration island and patio may be used to support social distancing when multiple staff are in the office. These spaces must be disinfected immediately after use.

Focus rooms must sit empty with the door open for 24 hours before they can be used again. If you use a Focus Room, you must note the date and time on the door (form provided) 24 hours after your use. This will be the next time the room is available.

When at workstations, staff may only work together when sitting diagonally or adjacent to one another and not across. If working adjacently, staff must refrain from using common/shared worksurface. Staff on the west side of the office must enter and leave ONLY through the west staff service door. Staff working on the east side of the office must enter and leave through the lobby. The sliding glass doors and glass staff lobby door will be open during this period. Staff on the east side must use the lobby restrooms, one at a time, while staff on the west side must use the in-office staff restrooms. Whenever possible, open/close doors with your sleeve or elbow. Only one person at a time in the copy room or restroom.

Protocols for Vehicle Use District vehicles have been assigned to each Division. Within each Division, a primary driver will be designated for each vehicle. Vehicle use within a Division will be coordinated with staff in each Division. If staff would like to use a vehicle assigned to another Division, it must be approved in advance by the Division Manager. Staff not assigned to a vehicle may use a District vehicle after it has been disinfected and has sat unused for a minimum of 24 hours. Disinfection requires wiping down or cleaning all common or public surfaces that a staff member comes in contact with during its use. Per health and safety guidelines, it is recommended that you drive with the windows down weather permitting and windows should remain down when parked inside the garage.

tools and equipment. Protocols for working in the field, including monitoring, construction site inspections, BMP inspections and maintenance, are defined in Appendix A. Housekeeping Regular housekeeping practices are being implemented, including weekly cleaning and disinfecting of work surfaces, equipment, tools and machinery, and areas in the work environment, including restrooms, the pantry, and meeting rooms. Frequent cleaning and disinfecting will be conducted by the District in high-touch areas, such as I-phones, touch screens, controls, door handles, railings, copy machines, etc. Any commonly used or high touch surfaces, including restrooms, wellness room, copier, exterior doors, security systems, lights/blinds, trash receptacles, public spaces, will be cleaned weekly with disinfectant spray or wipes by the District. Last one out on each side of the building will wipe down all respective door handles.

Communications and training CRWDâ&#x20AC;&#x2122;s COVID-19 Response and Preparedness Plan was communicated via email to all staff on April 30, 2020 and necessary training was provided. Additional communication and training will be ongoing including weekly emails to all staff and provided to all staff who did not receive the initial training. Managers and supervisors are to monitor how effective the program has been implemented by staff. This will be communicated during weekly Division Manager meetings.

Management and staff are to implement this new program together and update the training, as necessary. This Preparedness Plan has been certified by CRWD management and was posted throughout the workplace on June 29, 2020. It will be updated, as necessary.

Appendix A CRWD Staff Protocols for 2020 Shop, Garage, Equipment, Vehicle and Field Work Minnesota Department of Health (MDH) guidelines for preventing the transmission of COVID19 in workplaces are: CRWD field staff will work in the shop, garage, and field under the following protocols: • Limit the number of staff to the minimum needed to complete work.

• Enter the office through the garage to reduce contact with any other employees in the main office area.

• Stay in the shop/garage area for duration of work, only leaving to utilize the restroom area closest to the shop • Carry out tasks while maintaining 6’ from one another by communicating specifics of movement and work locations within the shop/garage.

• Use a mask if a task requires staff members to be temporarily less than 6’ from one another.

• Divide tasks to reduce touching of equipment by more than one staff member.

• If equipment needs to be touched/used by more than one staff member, equipment will be disinfected prior to a second staff member touching/using it.

• Disinfect all work areas at the end of the work period, including door handles, tables, tools, and equipment.

Staff will make all attempts to maintain a distance of 6 feet between one another. If a distance of 6 feet cannot be maintained, staff will wear a mask.

Staff will wear gloves at all times in the field, be they nitrile or work gloves depending on the situation.

Staff members will be assigned the same truck to drive for the duration of the COVID-19 protocols so that they are the only one in contact with that vehicle and the equipment in it.

Travel to and from the office and field sites will be done alone in either their personal vehicle or the District vehicle assigned to them for the duration of the COVID-19 protocols.

Stations requiring confined space entry will not be installed while COVID-19 protocols are in place. Confined space entry cannot be performed safely with social distancing practices.

While out in the field where washing hands is not possible, staff should make use of hand sanitizer frequently, especially after touching common surfaces or tools. Hand sanitizer is stocked in all District vehicles.

Equipment and surfaces used will be disinfected using Bleach wipes at the end of each day at a minimum, and more frequently at the discretion of staff.

• All unique equipment needed for an individual station should be stored in one truck so that each staff member can complete all work involving the equipment in their own truck to minimize contact with surfaces and equipment in the other truck and walking near the other staff member on site. For example, the tripod and scope for surveys will be kept in one truck and the stadia rod in the other.

Sondes: • One staff member will operate the boat/canoe while the other staff member calibrates, programs, and deploys the equipment.

• Staff will always be at opposite ends of the boat to maintain a distance of at least 6 feet.

Protocols for Site Inspections Staff must maintain social distancing when making site inspections in the field. Staff must only use their own PPE, i.e. hardhats, vests, gloves, boots etc. during site inspections to avoid cross contamination. When possible, communicate your expected arrival to a site via phone or email.

Do not enter job trailers or other buildings. Conduct inspection using social distance guidelines. If site personnel desire a joint walk through, maintain 6 feet of separation at all times and wear a mask. Review inspection findings with site personnel via phone. When leaving a site, sanitize hands prior to entering vehicle, and wipe down mobile inspection device and other equipment as needed. Inspection reports should be completed and sent while working from home.

Appendix B CRWD COVID-19 Positive Test/Exposure/Symptoms Response Protocol The purpose of the protocols are to define the steps employees should take if they test positive for COVID-19, are exposed to a person who tests positive for COVID-19, or are experiencing COVID-19 symptoms but have not been tested. Several terms are used throughout the protocol and are defined below. Please note that the protocols and terms are based on the latest guidance and are subject to change.

Symptoms of COVID-19 can include cough, shortness of breath, fever, chills, headache, muscle pain, sore throat, or loss of taste or smell. Other less common symptoms include gastrointestinal symptoms like nausea, vomiting, or diarrhea. These symptoms may appear 2-14 days after you are exposed to the virus that causes COVID-19. Not everyone with COVID-19 has all of these symptoms, and some people may not have any symptoms.

Close contact is defined as interacting within 6 feet of the positive COVID-19 person for at least 15 minutes throughout a 24-hour period.

Quarantine separates and restricts the movement of people who were exposed to a contagious disease to see if they become sick.

Scenario #1 - An employee has tested positive for COVID-19 A) Employee Response— 1) Immediately report the positive test and the date symptoms first appeared to your supervisor so that the District can identify close work contacts.

2) Self-quarantine at home until all three of the following criteria are met: a. Employee feels better. Cough, shortness of breath or other symptoms are better. b. It has been 10 days since employee first felt sick. c. Employee has no fever for the last 24 hours, without using medicine that lowers fevers.

B) District Response— 1) Notify all staff of a positive COVID-19 test in the office.

2) Identify and notify close contacts of the person who tests positive for COVID-19, beginning two days before the person who tests positive developed symptoms or if the person has no symptoms, two days before they were tested.

3) Track the number of days that employees with a positive COVID-19 test stay home to make sure they do not come back to work too soon. Employees who are at home because of a positive COVID-19 test should stay home until all three criteria listed above are true.

4) Screen returning employee who had positive COVID-19 test to make sure they do not have symptoms and are OK to come back to work. No medical examination, testing, or official letter is needed to return to work.

5) If necessary, immediately close and sanitize the office per MN Department of Health and CDC guidelines.

Scenario #2 – An employee who has had close contact with someone who has tested positive for COVID-19 A) Employee Response— 1) Immediately report the positive test and the date of your exposure to your supervisor so that the District can identify any close work contacts.

3) If employee develops symptoms, get tested and stay home to wait for test results.

4) If employee tests positive for COVID-19, follow protocol listed in Scenario #1 above.

5) If employee receives a negative test result prior to the end of the 14-day quarantine period, remain in quarantine until the 14-day period is over.

6) If the employee does not develop symptoms, they may return to work on day 15 without any restrictions.

2) Track the number of days that exposed employees stay home to make sure they do not come back to work too soon.

Scenario #3 - An employee or close contact of employee is sick with COVID-19 symptoms but has NOT been tested for COVID-19 A) Employee Response— 1) Immediately report the symptoms and the date it first appeared to your supervisor so that the District can track potential COVID-19 cases 2) Obtain a COVID-19 test or consult your medical provider to determine if you need to get a COVID-19 test.

3) If you do not need a COVID test as determined by your medical provider, stay home until you feel better and you are fever-free for 24 hours without medication.

4) If you are directed to obtain a COVID-19 test, get tested immediately.

5) Stay home as you await COVID-19 test results.

6) If an employee tests positive, follow protocol of Situation #1 listed above.

7) If an employee tests negative, stay home until you feel better and you are fever-free for 24 hours without medication.

The District will continue to expect staff to follow the Work Off Site Policy. It is contemplated that working off site (Work from Home) and remote Board meetings will continue through June 30, 2021.

Issues In 2006, the District authorized a Cell Phone Allowance Policy that paid staff an allowance of $24/month for official use of a personal cell phone. The allowance approach was implemented due to the extreme difficulty in determining appropriate business versus personal use costs in monthly cell phone bills.

Currently, we have a similar situation where we have directed staff to work from home and they are incurring costs that are directly related to conducting official business at their home. Actual costs could include computer equipment like a keyboard, monitor or mouse, or furniture like a chair or desk. Others have inquired about reimbursement for improved home internet service. A Work and Meeting Off Site Allowance Policy is recommended to provide an allowance for employees and Board Managers to offset costs associated with working and meeting off site work. Similar to cell phone bills, work and meeting off site expenses would be highly variable and the administrative burden of determining eligibility of these expenses and reimbursements would be an additional burden on staff already working predominantly from home.

An analysis of 2019 versus 2020 office operating costs indicated that the District is spending somewhere between $1,500-$2,000 less per month since the work from home order began. This proposal could cost the District approximately $1,200 per month if all employees and Board members request the allowance.

Two questions remain. The first question is if our liability is increased by offering an allowance and the second question is if the allowance will be considered taxable or non-taxable. These are being researched and will be discussed at the meeting on the 30th.

Work and Meeting Off Site Allowance Policy 1.

PURPOSE

November 30, 2020

A Work and Meeting Off Site Allowance Policy is recommended to provide an allowance for employees and Board Managers to offset costs associated with working and meeting off site and to ensure that use of this policy is consistent with the best interests of CRWD. 2.

ALLOWANCE BASED WORK OFF SITE POLICY

The Board of Managers has determined that it is in the best interest of the District to provide a Work and Meeting Off Site Allowance. This determination is due to the likelihood that work and meeting off site expenses would be highly variable and the administrative burden of determining eligibility of these expenses and reimbursements would be an additional burden on staff already working predominantly from home.

Board Managers, full-time and seasonal employees may be eligible for the Work and Meeting Off Site Allowance. Board Managers and employees may be paid a monthly allowance for the use of their personal property such as home office, home office equipment, computer equipment, cellular and internet service, utilities, furniture and other related property and expenses for official work use.

Employees receiving the benefit of the allowance must be accessible consistent with the Work Off Site Policy. Board Managers must attend at least one monthly authorized meeting to be eligible. Further, it is the individualâ&#x20AC;&#x2122;s responsibility to purchase or pay for personal property such as home office, home office equipment, cellular and internet service, utilities, and furniture. Allowance-based purchases are the property of the Board Manager or employee.

ALLOWANCE PAYMENTS

The Work and Meeting Off Site Allowance will be paid to Board Managers and employees at the following rates: Board Managers - $25/month and employees - $50/month.

EFFECTIVE DATE

The effective date of Work Off Site Allowance payments will be retroactive to March 17, 2020. Payments will be paid at 50% for the month of March 2020. This policy will remain in effect until June 30, 2021 unless extended or rescinded by the Board of Managers.
