Background Construction activity is complete for permit #15-025 Stewart Street extension and #17-012 Nova Soccer Field.

Issues Stewart Street extension #15-025 This permit was issued for a new parking lot and street extension into Victoria Park in St. Paul.

Stormwater requirements were met with one surface filtration basin in the center island of the parking lot. The site is stable and the stormwater treatment practice has been confirmed functional. No surety was required for this public project.

Nova Soccer Field #17-012 This permit was issued for construction of a new soccer field at Madison and Kay in St. Paul.

Stormwater requirements were met with a permeable turf filtration system and underground detention.

The site is stable and all temporary BMPs have been removed. Some small areas of boulevard do remain for full vegetation establishment, but they have been temporarily stabilized and the school has committed to maintenance work to support full growth. $4,100 surety is available to return.

Permit #09-009 Victoria Street - Closure (Hosch) Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

Ms. Hosch reviewed permit #09-009 Victoria Street. This permit was issued for the reconstruction of Victoria Street between Arlington and Como in St. Paul. Stormwater requirements were met with two surface infiltration basins at the Como/Wheelock/Victoria intersection. After reaching the cost-cap, the project will deposit the planned 1,991 cubic feet of excess volume into the St. Paul Public Works volume bank. The site is stable, and the infiltration systems have been confirmed functional. No surety was required for this public project.

Manager Reider asked about the calculations for the volume control. Ms. Hosch explained how the project went above the permit requirements.

Motion 18-194: Approve deposit of 1,991 cubic feet into the St. Paul Public Works volume bank for permit #09009 Victoria Street.

Permit #15-037 MnDOT Pedestrian Bridges – Closure (Hosch)

Ms. Hosch reviewed permit #15-037 MnDOT Pedestrian Bridges. This permit was issued for construction of two new pedestrian bridges over 94 at Grotto and Mackubin in St. Paul. Stormwater requirements were met by withdrawal from the MnDOT volume bank and construction of a SAFL baffle for onsite gross pollutant removal. The site is stable and all temporary BMPs have been removed. No surety was required for this public project.

Permit #16-004 Xcel Pipeline – Closure (Hosch)

Ms. Hosch reviewed permit #16-004 Xcel Pipeline. This permit was issued for construction of a new regulator station and two miles of gas line in two sections on the south side of St. Paul. The applicant received a variance from stormwater requirements for the gas line work and a small raingarden now treats stormwater from the regulator station. The site is stable, temporary protections have been removed, and the raingarden is functional.

The $9,000 surety collected for this project was relinquished by Xcel to be used towards the Highland Ravine icing repair work that happened in 2017. No surety is left to return.

Special Reports.

Ms. Belden reviewed how the development of the Como Lake Management Plan has been underway since April. As part of the Community Engagement Plan, two key stakeholder groups were established in addition to the CRWD Board of Managers and the Citizen Advisory Committee to inform the development of the Como Lake Management Plan—the Agency Advisory Group (AAG) and the Public Advisory Group (PAG). The AAG consists of city, county, and state personnel to represent an agency perspective and provide technical review. The PAG is comprised of members of the public (residents, businesses, concerned citizens).

Understanding and including both agency and public stakeholder perspectives on issues, goals, and expectations in the planning process is viewed as critical for ensuring the success of the final Como Lake Management Plan.

The first meetings for both the AAG and the PAG were held in this past summer 2018 and were focused on gathering input on Como Lake issues and goals.

Staff have been working with LimnoTech to develop issues and goals statements for the Como Lake Management Plan that combine stakeholder input gathered at the first AAG and PAG meetings. These issues and goals statements include measurable objectives for meeting the stated goals. The statements will be used to guide the selection of specific watershed and in-lake actions as part of the overall implementation of the Como Lake Management Plan.

Ms. Belden provided a recap of the September 19th meeting with a draft of issues and goals. There were over 800 comments to develop five goals to address issues of Como Lake. The first goal is to manage Como Lake as a healthy, shallow lake. The second goal is maintaining a healthy shoreline and riparian area that can support a variety of wildlife and contribute to the health of Como Lake. The third goal is to maintain mixed-use recreational opportunities that are available throughout the year that are appropriate for a shallow urban lake.

The fourth goal is to achieve a strong sustained community stewardship to improve and protect Como Lake.

The fifth goad is to ensure resources for management of Como Lake are used most effectively and efficiently.

Manager Sanders recommended a communication plan for neighbors. Manager Jones suggested signage explaining why the lake is not suitable for swimming. Ms. Belden explained that all the lake signage needs updating to include explanations. Manager Sanders added that signage regarding nesting areas, and an explanation of why the lake is more of a wetland than a swimming lake would be useful to residents.

Approve MAWD Delegates (Doneux)

Administrator Doneux reviewed that each year watershed districts are asked to appoint and certify two delegates and one alternate for the Minnesota Association of Watershed District (MAWD) annual meeting Motion 18-200: Appoint President Collins and Manager Texer as the delegates for the Minnesota Association of Watershed District and appoint Manager Sanders as the alternate delegate for the Annual Meeting.

Approve 595 Aldine Redevelopment Project Budget Amendment (Doneux)

Administrator Doneux provided an update for the managers of recent progress. The windows are currently boarded up until the glass is ready for installation. The anticipated date of completion is still on schedule for November 26th. Administrator Doneux reminded the Board of Managers that an Overall Project Budget and Financing Plan of $10,777,428 was presented on December 6, 2017 for the 595 Aldine Redevelopment Project.

On March 6, 2018 the Board approved a Guaranteed Maximum Price (GMP) of $7,310,000 for Construction Manager at Risk services provided by JE Dunn. After several alternates were accepted, the final executed GMP became $7,344,846 but was not ratified by the Board of Managers.

As the construction has progressed, several unforeseen issues have arisen that will require a budget amendment.

Specific items that have been encountered include: impacted soils, an underground fuel oil storage tank, roof decking replacement, parapet repair, adding footings at the garage doors, additional fencing, additional structural supports, adding the operable wall, glass etching at the west entry and low voltage/power coordination with IT and AV equipment. All these items and other smaller issues have brought our contingency from $200,000 to an estimated $325,461. In addition, non-JE Dunn related expenses have been added or increased including technology, signage, optimized cistern controllers, owner inspections and unresolved change orders. There have been some 2018 cost reductions as well. The Kidzibitz display and pocket park work will be funded in 2019 through existing budget line items. The furniture budget decreased.

The 595 Aldine Redevelopment Project budget needs to be amended from $10,777,428 to $11,077,428. This is a $300,000 increase which is 2.8% greater than the original budget. Managers were very pleased with the project update. Administrator Doneux shared that JE Dunn has been very fair and have been working on the project with care.

Motion 18-201: Approve the final JE Dunn GMP of $7,344,846 and approve a budget amendment of $300,000 to bring the Overall Project Budget to $11,077,428.

Approve Additional Design Services for Seminary Pond Improvement Project (Eleria)

Ms. Eleria reviewed that in spring 2017, CRWD’s Board of Managers approved design and engineering work for improving flood control and pollutant removal of Seminary Pond, a regional stormwater pond in Lauderdale. The proposed improvements include converting Seminary Pond from a dry pond to a wet pond by deepening the pond and raising the berm and installation of an iron-enhanced sand filter along the pond edge to removed dissolved phosphorus. The approved budget for design/engineering work by Barr Engineering is $78,990. A contract amendment for additional survey and soil borings for $4,007 was approved in summer 2017.

Over the past year, CRWD and the City of Lauderdale have worked closely to advance the project, which has included extensive field work, regular project coordination and communication with stakeholders and preparation of 90% plans. As part of the field work, the upstream ravine area, which includes storm sewer outlet pipes (north and east), were investigated and erosion and destabilized slopes were observed below the north and east outlet pipes, which are contributing sediment to the pond. CRWD staff has had conversations with Lauderdale, owner of the north outlet pipe, and Falcon Heights, owner of the east outlet pipe, to gauge their interest in addressing these issues. Both cities have expressed interest in repairing these areas as part of the Seminary Pond Stormwater Improvement Project. Besides Lauderdale and Falcon Heights, Ramsey County has also expressed their interest in participating in the project.

With confirmation from most of the stakeholders that they are interested in the project, CRWD staff instructed Barr Engineering to prepare a proposal for ravine stabilization design as well as for final, bid ready plans and specifications for the entire project. The estimated additional design/engineering cost is $38,055. The 2018 budget for Lauderdale Stormwater Project (#430-16886) is $60,050. As of late September 2018, approximately $18,000 has been expended.

Motion 18-203: Approve additional design services for the Seminary Pond Stormwater Improvement Project and authorize the Administrator to execute an amendment to the Agreement with Barr Engineering for an amount not to exceed $38,055 and additional amendments not to exceed $5,000.

Background The District has purchased a health benefit package from Health Partners through the Bearance Management Group since 2012. Each year the District must renew and enroll employees into benefit plans.

Issues Staff has obtained benefit quotes from the Bearance Management Group for health, dental and insurance coverage. Bearance Management Group obtains quotes from at least three vendors when soliciting benefit quotes. Rates increased 5-18% for medical and were virtually unchanged for Dental.

Open enrollment will begin on November 8th and end on November 19th. There will be a employee benefits informational meeting on Tuesday, November 4th.

The Personnel Committee met on Friday, October 19th and recommends approval of the attached plan for 2019.

2019 Capitol Region Watershed District Employee Benefit Program November 7, 2018 Open Enrollment CRWD will again be offering medical, dental and ancillary insurance benefits to staff in 2019. Open enrollment will begin on November 8th and end on November 19th.

Plan Summary Medical The District will require a monthly employee contribution of $55.00, and $40.00 for single, $135.00, and $85.00 for single plus one and $190.00, and $140.00 for Family health insurance for the renewal plan, Alternate 1 (Health Partners SE Open Access Platinum) and Alternate 2 Health Partners SE Open Access HSA Gold) respectively. Rates effective January 1, 2019. These rates represent a $5, $10 and $15 increase for Single, Single Plus 1 and Family coverage respectively compared to 2018.

The District will contribute to a HSA plan for employees that select Alternative 2. First time enrollees will receive $1,000 for single, $2,000 for single plus one and $2,000 for family. Employees that start mid-year will receive a prorated contribution based on effective date of benefits. Contributions will be paid out at ½ by January 1, 2019 and ½ paid out by June 30, 2019. Renewing employees of Alternative 2 will receive $500 for single, $1,000 for single plus one and $1,000 for family.

The District provide payroll deductions and employee contributions to Health Care Flexible Spending Accounts, Health Savings Accounts, and Dependent Care Spending Accounts.

Dental The District will require a monthly employee contribution of $10.00 for single, $20.00 for Single Plus One and $40.00 for Family dental insurance, effective January 1, 2019. These rates are the same as 2018.

Insurance Coverage The District will continue to provide ancillary employee benefits including life, short term disability and long-term disability insurance. These programs and the employee/District contributions will be consistent to those offered in 2018. The District will continue to provide Life Insurance and Long-Term Disability coverage consistent with the CRWD 2018 Program and allow employees to purchase additional coverage at their cost. In 2019, staff will have the ability to choose between seven (7) different elimination period options. The elimination period is the time from the event until coverage begins. Staff will also have the option to purchase accident insurance coverage.

Background In 2013 the District established the Monitoring, Research and Maintenance Division and appointed Bob Fossum to be its Division Manager. In 2016 the District established the Regulatory and Planning, Projects and Grants Divisions and appointed Forrest Kelley and Anna Eleria to be the respective Division Managers. Establishing a Program Manager within the Districtâ&#x20AC;&#x2122;s staff structure recognizes the benefit for both staff and the District to provide professional advancement for staff to strengthen the organization, reduce turnover and maintain high employee satisfaction.

PRIMARY OBJECTIVE: Perform skilled to highly skilled duties providing communications and engagement in support of District projects and programs as it relates to the implementation of District’s Watershed Management Plan and annual work plan.

POSITION OBJECTIVE: The Program Manager coordinates the implementation of their Division’s area of responsibility within the District’s Watershed Management Plan. The Program Manager is responsible for the development and implementation of District communications and engagement programs. The Program Manager is responsible for implementing program work and projects that address standalone engagement efforts as well as inter-Division projects. This position will coordinate communications and engagement activities involving other local units of government, City Departments, agencies, private and non-profit sectors in the Watershed and the public.

MAJOR AREAS OF ACCOUNTABILITY/ESSENTIAL JOB FUNCTIONS Program and Project Management: Engages the Division’ direct reports in the portions of the comprehensive Watershed Management Plan and the area’s Annual Program Work Plan.

Develops corresponding budgets, secures Administrator’s approval for, and oversees the implementation of, the above plans. Identifies goals and corresponding strategies to address the watershed plan content areas and annual work plans. Ensures that the plans reflect best practices and fulfill all requirements as outlined in MN Statute 103B. Ensures their Division’s compliance with the District’s practices and policies.

Fiscal Management: Involves direct reports in contributing data to be considered for inclusion in the budget. Formalizes final budgets for their Division. Obtains Administrator and/or Board approval.

Tracks program expenditures and monitors activities against budget. Secures Administrator and/or Board approval for expenditures outside of established budgets.

Identifies, provides corresponding rationale, and advocates for appropriate staffing levels, material resources and professional development for direct reports to perform their jobs.

Complies with all financial reporting requirements, as documented in the CRWD Policies and Procedures Manual.

Manages the hiring process and decisions related to the selection, promotion, and transfer of assigned personnel. Provides regular formal performance reviews. Responsible for making salary adjustments based on Policies and subject to the approval of the Administrator.

Contract Management: Manages the selection of contractors, creation of contract documents, and management of contracted services and personnel consistent with District policies, subject to the approval of the Administrator and/or Board of Managers.

Orients contracted personnel to the organization’s policies and procedures. Communicates, both verbally and in writing, performance specifications and expectations.

Monitors the work performance of contracted personnel on a continual basis, provides timely feedback, and if applicable, takes corrective action.

Administers the organization’s policies and procedures as related to contractor selection, payment, contract deliverables and corresponding schedule, applicable amendments, and closeout.

ADDITIONAL FUNCTIONS: 1. Provides communications and engagement support to District programs.

2. Represents the District on special committees.

3. Effectively represents water and watershed issues at meetings, conferences, before the media, and to other local units of government, City Departments, the Board of Managers, partner organizations and the public.

4. Coordinates watershed-related activities in the District, and activities involving other governmental agencies and private and non-profit entities.

Background The Joint Rules Technical Advisory Committee met on September 19, 2018. Including watershed district staff, twenty-five individuals attended the meeting.

Issues CRWD and RWMWD staff presented the attached slideshow to review potential rule amendments. The topic that created the most discussion was proposed increases to the Cost Cap for linear projects and Stormwater Impact Fund contribution to $75,000 per acre and $100,000 per acre respectively. The attached memo from Wenck summarizes the data compiled from past linear projects that met the cost cap.

RWMWD staff provided cost share data for nearly 70 surface stormwater BMPs to determine an average construction cost of approximately $108,000 per acre.

A copy of the draft meeting notes is attached, and staff will review any questions regarding the proposed amendments and surrounding discussion.

Staff intend to provide a draft copy of the revised rules for informal review this fall, prior to going out for official 60-day review period this winter.

Watershed district staff presented the attached power point outlining the potential rule amendments and clarifications being considered: Flood Control and Freeboard Barb: • City Streets are designed for the 5-year event. Floodproofing underground storage systems to the 100-year HWL is an added expense.

Wes: • Consider better distinguishing Local WD flood rule from FEMA to minimize confusion.

Forrest clarified new definition is based on FEMA’s. Upon further review and discussion, general agreement with proposed changes. Nothing further.

Joe: • How many variances have been approved? CRWD Database indicates 6 variances approved from freeboard requirements.

Increase maximum runoff depth for BMP sizing from 2” to 2.5” • Minimal Discussion Cost Cap and Stormwater Impact Fund Analysis – Increase from $30,000 to $75,000/impervious acre and $40,000 to $100,000/impervious acre, respectively.

Barb/Pat: • Cost cap increase has a big impact on budgeting, 2019 funds have been allocated. Can it be increased incrementally? Forrest indicated the increase would not go into effect until 2020.

• Consider including gross pollutant removal in the costs attributed to the cost cap.

• University Ave project – St. Paul spent $95k on gross pollutant removal and still had to withdraw from bank. Seems unfair to require both.

Wes: • Are private roads eligible for cost cap? Forrest noted that private linear projects are rare, but that the rules do not differentiate between public and private, but it the cost cap has generally not been “advertised” in conversations on private linear projects.

Mark: • Costs are increasing, and the cap has stayed the same, resulting in less treatment, In addition to increasing the cap, new cost effective designs should be explored to achieve more treatment, more cost effectively.

Regional Compliance Language.

• Minimal Discussion Other Administrative Clarifications Steve: • Is there any guidance on the definition of ‘additional engineering’ when it comes to infiltration restrictions, in DWSMAs for example? Guidance and recommendations are provided in the MN Stormwater Manual from MDH and MPCA. Sidewalk Impervious Exemption Request Barb: • Green Infrastructure on streets was a frequent topic a few years ago. St. Paul is now moving towards being more pedestrian-friendly, bicycle friendly, which means more sidewalks and bike lanes. Many competing interests.

• Having to treat stormwater for sidewalk impervious increases costs. The 3’ sidewalk exemption in the current rules would not be approved for ADA. The boulevards are so compacted from people walking on them that they are practically impervious already.

Forrest: • Watershed Districts have reviewed some trail and sidewalk projects as being disconnected impervious through the guidance within the MN Stormwater Manual Steve: • Is there a variance for treatment (including rate control) for stand-alone sidewalk projects? It’s difficult to achieve if the roads aren’t being torn up.

Forrest:

CRWD has issued 5 variances for rate control on small linear projects that increased impervious surface, but utilized banked credits for volume.

Request to amend Filtration Credit Paige: • Extensive review of existing data on filtration practice effectiveness was completed as part of the 2015 amendments. No changes proposed at this time.

Additional Considerations Beth: • Mn/DOT does not recommend collecting surety from contractors on public projects.

They have performance bonds that can be used to enforce contract requirements.

Jesse: • Roseville collects sureties and deducts for non-compliance Wes: • Acknowledged the amount of work put into ensuring compliance on construction sites, and closing permits out.

• Consider implementing a requirement that stormwater O&M plans be signed by the property owner and/or acknowledged receipt

Subject: Research for Potential 2018 Permit Cost Cap Changes Capitol Region Watershed District (CRWD) and Ramsey Washington Metro Watershed District staff met on December 18, 2017 to discuss potential changes to their permit program rules. Staff tasked Wenck with researching and providing information regarding cost cap adjustment. Our research and recommendations are presented below.

Determine if Cost Cap Adjustment is Necessary and, if so, by How Much.

1. Issue a. Cost cap has not been adjusted since March 2008. b. Should the cap amount be adjusted?

2. The oldest project with the $30,000 cost cap is 10-003 (CCLRT).

3. Four projects were excluded: one because it resulted in extremely high $175/cf and three that provided bank credits, which resulted in 195%, 325%, and 1,925% of required volume.

4. Volumes used in charts/calculations below reflect “equivalent” volumes.
