HISTORY & CONSIDERATIONS: None.

RULE C: STORMWATER MANAGEMENT Standards  Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates.  Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.  Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area.  Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is not achieved onsite in the amount equivalent to the runoff generated from one inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious onsite is 17,028 square feet. The area of street reconstruction is 14,302 square feet. b. The applicant has requested a variance from providing stormwater management from the area of street reconstruction.

Variance Request Findings: i. This requirement cannot be met within the right-of-way as the City of Saint Paul will not allow city stormwater to be routed onto the site for treatment, ii. Nor will the city of Saint Paul allow stormwater treatment systems to be within the right-of-way. iii. The stormwater treatment facilities have been maximized to the furthest extent possible. iv. Wenck also notes treatment is provided for 0.45 acres of offsite impervious surface. c. Volume retention: Volume Retention Required (cu. ft.)

RULE D: FLOOD CONTROL Standards  Compensatory storage shall be provided for fill placed within the 100-year floodplain.  All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard  Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland.  A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards  A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity.  Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Project site is greater than 1 acre; an NPDES permit is required.

RULE G: ILLICIT DISCHARGE AND CONNECTION Standard  Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Permit #14-022 Victoria Park South Stormwater (Kelley)

Mr. Kelley reviewed Permit #14-022 Victoria Park South Stormwater. The applicant, St. Paul Planning and Economic Development, is constructing trails, storm sewer, culverts and a stormwater management basin. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), Wetland Management (Rule E) and Erosion and Sediment Control (Rule F). The disturbed area of this project is 12.4 Acres with .88 Acres of impervious surface. Discussion occurred regarding condition number 3 and the need to approve a variance to the 25 foot buffer requirement of Rule E for construction of a gravel trail between the wetland and stormwater pond.

Motion 14-204: Approve permit #14-022 Victoria Park South Stormwater with four conditions including the amendment to condition #3: 1. Provide plans signed by a professional engineer per the Minnesota Board of AELSLAGID. 2. Provide a copy of the NPDES permit.

3. Provide a wetland buffer with a minimum width of 25 feet. Approve as Amended: Provide updated plans that indicate the extent of the 25 foot wetland buffer and the proposed encroachment.

4. Submit the “turf establishment plan� referenced in the TKDA memo to CRWD dated 9/10/14. This plan sheet was not part of the submitted package.

Permit #14-029 St. Agnes School (Kelley)

Mr. Kelley reviewed Permit #14-029 St. Agnes School. The applicant, St. Agnes School is redeveloping the school to increase usable space. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.4 Acres with 1.03 Acres of impervious surface. There was discussion regarding the 48 hour drawdown requirement and the volume of infiltration for the project and Mr. Kelley explained that the project exceeds Stormwater Management Rule C requirements infiltration, and therefore some water would remain in the pipe after the 48 hours has elapsed.

Motion 14-206: Approve permit #14-029 St. Agnes School with two conditions: 1. Receipt of $5,150 surety and documentation of recorded maintenance agreement with Ramsey County.

Mr. Kelley reviewed Permit #14-031 Seven Corners. The applicant, Opus Design Build, LLC is demolishing an existing buildings and constructing a new mixed use building. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 2.32 Acres with 2.13 Acres of impervious surface.

Motion 14-207: Approve permit #14-031 Seven Corners with seven conditions: 1. Receipt of $10,650 surety and documentation of recorded maintenance agreement with Ramsey County.

2. Provide plans signed by a professional engineer per the Minnesota Board of AELSLAGID. 3. Provide a copy of the NPDES permit.

4. Revise plans to correspond with HydroCAD. Sheet indicates that the underground system is a filtration system. The HydroCAD model indicates that the underground system is an infiltration system. The soil borings indicate sandy soils that are conducive to infiltration.

5. Demonstrate that the proposed stormwater management reduces TSS loads by 90% for the entire site.

This shall be calculated using a weighted average. Areas not directed to the underground system receive 0% removal.

6. Provide low floor elevations and flood proof the wall adjacent to the underground system if necessary.

7. Provide a hood in CB1 to retain floatable materials in the catch basin.

It appears that silt fence is called for, but it is not labeled. If silt fence has not been proposed, provide erosion and sediment control to prevent sediment transport from the site. d. Provide erosion and sediment control around infiltration areas. These areas are hatched, but there is no corresponding legend.

Permit #12-009 East Side Family Clinic – Permit Close Out (Kelley)

Mr. Kelley reviewed Permit #12-009 East Side Family Clinic. Construction activity is complete for permit 12009 East Side Family Health Clinic. Multiple final site inspections have been conducted. All bare soil is stabilized, and stormwater practices built are functioning as designed. Permit 12-009 is ready to be closed, and staff recommend returning the full $12,300 surety.

Permit #14-026 Pleasant Ridge Extension Request

Mr. Kelley reviewed permit number 14-026 Pleasant Ridge. The 60-day review period will expire prior to the October 15th Board of Managers meeting. Mr. Kelley and staff have been working with the applicant to address the conditions submitted to the project engineer. Mr. Kelley reviewed that the project includes street reconstruction and that the applicant does not have control of the entire right of way and therefore requiring them to oversize treatment for the entire impervious area would be unreasonable. Mr. Kelley indicated that they are working through the best way to address the issue.

Motion 14-210: Approve a 60-day extension for permit number 14-026 Pleasant Ridge.

Draft Rule Revisions (Kelley)

Mr. Kelley reviewed that the Joint Rules Technical Advisory Committee met in February of 2014, and that he and staff reviewed the topics with the Board in April. Mr. Kelley clarified some of the outstanding questions pertaining to how the Minnesota Stormwater Manual and MIDS Calculator grants pollutant removal credits and explained that it is designed to mimic native hydrologic processes. He also explained that the proposed rule revisions increase the volume reduction requirement from the current .9 inch to 1.1 inch. RWMWD and CRWD staff have worked to incorporate this new information into District rules. Mr. Kelley reviewed select pages with edits to the rules, along with a memo from Barr Engineering that summarizes the methodologies to support changes to filtration credits. Mr. Kelley and staff plan to distribute the proposed draft revisions to the TAC for informal review, and convene a meeting as necessary to discuss comments received and adjustments made prior to requesting formal comment during the official 45-day review period.

Authorize Distribution of 2015 Partner Grant RFP (Van Patten)

Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

Ms. Van Patten reviewed that in 2013, CRWD hired HDR, Inc. to develop the 2014-2015 Education Plan which was presented to the Board at the September 4, 2013 meeting. Staff have used this plan to evaluate 2014 Partner Grant applications.

Staff have developed a draft solicitation list for the 2015 Partner Grant RFP based on the goals and target audiences identified in the updated 2014-2015 Education Plan. The draft list includes some previous grant recipients and new community organizations that work with our target audiences. Partner Grants are made to organizations, schools, businesses and other entities and range from $2,000 to $20,000 for clean water education and outreach projects. The 2015 budget for Partner Grants is $75,000.

Timeline for 2015 CRWD Partner Grants:  October 2, 2014 – Distribute grant application to solicitation list, District planning councils, CRWD media list and email list.  November 7, 2014 – Grant proposals due.  Week of November 17, 2014 – Grant committee meets to discuss proposals and make recommendations to CRWD Board.  December 3, 2014 – CRWD Board approves committee recommendations.  December 4, 2014 – Staff notifies successful grantees and sends grant agreement.

Ms. Van Patten requested the Board of Managers review 2015 CRWD Partner Grant Distribution Contact List and authorize staff to distribute the CRWD 2015 Partner Grant application and proceed with the grant approval process according to the proposed timeline. Board Mangers requested that the following contacts be added to the solicitation list:  Lake McCarrons Neighborhood Association  Hamline University  Macalester College  Luther Seminary  Cretin Durham Hall  University of Minnesota Motion 14-213: Authorize staff to distribute the CRWD 2015 Partner Grant applications to the updated solicitation list and proceed with the grant approval process according to the timeline.

Ms. Eleria reviewed the Special Grants in place of Mr. Zwonitzer. For the past several years the District has budgeted funds for budget fund 440 Special Projects and Grants. The District typically sets a preliminary budget amount and then solicits applications for projects to fund. Applications for 2015 Special Grant funds are due October 10, 2014.

Grant applications will need to be reviewed by staff and Board members. Additionally, staff recommend including the CAC in the review process. Two review meetings will be scheduled. The first meeting will take place in mid-late October and will be an initial review of applications. This review will provide an opportunity to begin ranking applications and identify questions about specific proposals. Staff will then work with the grant applicants to respond to those questions. We will review responses to questions and develop a funding recommendation at the second review meeting in early November. It is anticipated that the Board will take action on Special Grant funding at the November 19th Board meeting.

Unfinished Business A)

FI: Highland Ravine Stabilization project Update (Eleria)

Ms. Eleria provided an update on the Highland Ravine Stabilization. Ms. Eleria reviewed a slide presentation of the progress taking place. The project has a number of challenging conditions. The weather has caused some delays for the project. The contractor has been using logs and branches to help with stabilization. The completion date is scheduled for October 15th. Due to a number of delays the staff have requested an updated work schedule from the contractor.

B)

FI: Eustis Street Stormwater Improvement Project Update (Eleria)

Ms. Eleria provided an update on the Eustis Street Stormwater Improvement Project. Soil samples are being collected. Barr is preparing concepts plans for this project. Additional information will be available in November.

C)

FI: Curtiss Pond Improvement Project Update (Fossum)

Mr. Fossum gave an update on the Curtiss Pond Improvement Project. In the northeast corner some questionable soil was found. The soil is being tested to determine the proper way to handle it. A utility line was also found in the pond and caused a slight delay.

Stewardship Grant Agreement for the construction of one rain garden at 5 Edgcumbe Place – not to exceed $1,397.45.

2) Board Approved or Executed Agreements a. Consultant Services Agreement with Computer Revolution for IT Infrastructure updates - $7,680.86.

3) General updates including recent and upcoming meetings and events a) Elizabeth Hosch was hired as the new BMP Inspector. Her first day at CRWD will be October 13, 2014. b) CRWD and the CAC co-sponsored the Moos Family Speaker Series, “Dwindling Groundwater Reserves as Viewed from Space” with Dr. Jay Famiglietti on September 18, 2014 with 185 attendees. c) Staff participated in the Water Festival as part of Saint Paul Open Streets on September 21, 2014. d) CRWD Staff participated in a mobile workshop of Green Line Green Infrastructure during the RailVolution Conference, September 23, 2014 from 1-4pm. e) Mark Doneux, Nate Zwonitzer and Bob Fossum will be attending WEFTEC in New Orleans, Louisiana from September 27 – October 1.

4) CRWD events and meetings a) Next CAC meeting is Wednesday, October 8, 2014 from 7:00 – 9:00 pm. b) Next Board meeting is Wednesday, October 15, 2014 from 6:00 – 8:00 pm. Shirley Reider will attend this meeting. c) The next Metro MAWD meeting will be Tuesday October 21, 2014 from 7:00 – 9:00 pm at CRWD. 5) Project and Program Updates a.) Curtiss Pond Project: Construction is underway. b.) Highland Ravine Project: Construction is underway. c.) Watershed Partners Partner & CGEE Grant: Hamline University (CGEE/Watershed Partners) was awarded a 2014 Partner Grant to carry out the Adopt-a-Drain program in partnership with City of Saint Paul Public Works – Sewers. The website adopt-a-drain.org will be live next week and doorhangers will go out to the 800-home pilot area in Como neighborhood. Participants sign up through the website, committing to keep the storm drain nearest their house free of debris and report their activity.

Background At the April 16th, 2014 Board meeting, the Managers approved the Monitoring Program Review and 2014-2016 Recommendations, including Recommendation 8: Install AC power and remote data access at baseline sites.

Also at the April 16th, 2014 Board meeting, the Managers reviewed the Monitoring Station Power and Communication Improvement Plan, where the project cost was estimated at $12,300.

Issues Staff have worked with Wenck Associates to develop a draft plan set and a draft request for quotations (RFQ) to be distributed to three electrical contractors. The draft plan set and RFQ include details for the construction and materials required to complete AC power installation at the three Trout Brook monitoring site locations (Trout Brook-East Branch, Trout Brook-West Branch, and Trout Brook Outlet). The estimated cost for this work (as estimated by Wenck) is $29,840.

Staff are requesting authorization of the RFQ for an electrical contractor so we can determine an actual cost for the project. Staff will review the project plans and the RFQ with the managers. Staff will review options that will consider increased project funding options from the 2014 and 2015 budgets and/or a reduced project scope.

Requested Action Authorize request for quotations for AC power installation to the Trout Brook monitoring stations, subject to the review and approval of the Ramsey County Attorney.

Background As part of the annual meeting of the Minnesota Association of Watershed District (MAWD), delegates are asked to consider and take action resolutions submitted to the membership. This year three resolutions are being considered at the annual meeting. Enclosed is the 2014 Resolution packet for the MAWD Annual Meeting.

Issues The MAWD Policy/Resolutions Committee will work under the following process for the upcoming 2014 Annual Meeting. Resolutions passed by the membership at Annual Meetings will remain MAWD policy from year to year unless MAWD members, the Board of Directors, or the Policy/Resolutions Committee brings that policy back to the full membership during the resolutions process for updating and discussion at any regular annual meeting. That team consisted of Mary Peterson, Board Conservationist; Brad Wozney, Clean Water Specialist; Gwen Steel, Land and Water Specialist; and myself.

Ramsey County was one of the nine counties that we selected for verification in 2013-2014, based on our Grants Monitoring, Reconciliation and Verification Policy, adopted by the BWSR Board in June 2011. The Capitol Region Watershed District was selected for verification because it was one of the LGUs in Ramsey County that received a BWSR grant in the fiscal year—2012—being verified. In the words of our Grants Administration Manual, a financial reconciliation “accounts for a grant recipient’s spending by comparing its request or receipt for payment for a given period with supporting documentation for that request, such as purchase orders, receipts, and payroll records.” A grant verification—which begins with a site visit—“encompasses not only financial reconciliation, but also checks whether the terms of grant payments have been complied with.” As you know, we examined the Watershed District’s Fiscal Year 2012 Clean Water Assistance Grant. We verified both the receipt of grant revenue from BWSR, and the Watershed District’s records of expenditures on this grant, comparing the amounts claimed to the documentation that you presented to support them. Finally, we compared the Watershed District’s documentation of actual expenditures with the amounts that you reported in eLINK, BWSR’s electronic reporting system.

Attached is the Grant Verification Results form. There were no findings from the verification. The documentation reviewed was organized and detailed. The eLINK reports could be linked to actual expenditures on grant activities, and project files were complete.
