RULE C: STORMWATER MANAGEMENT Standards ➢ Proposed discharge rates for the 2-, 10-, and 100-year events shall not exceed existing rates. ➢ Developments and redevelopments must reduce runoff volumes in the amount equivalent to an inch of runoff from the impervious areas of the site.

➢ Stormwater must be pretreated before discharging to infiltration areas to maintain the long-term viability of the infiltration area. ➢ Developments and redevelopments must incorporate effective non-point source pollution reduction BMPs to achieve 90% total suspended solid removal.

Findings 1. A hydrograph method based on sound hydrologic theory is used to analyze runoff for the design or analysis of flows and water levels.

2. Runoff rates for the proposed activity do not exceed existing runoff rates for the 2-, 10-, and 100-year critical storm events. Stormwater leaving the project area is discharged into a well-defined receiving channel or pipe and routed to a public drainage system.

3. Stormwater runoff volume retention is achieved onsite in the amount equivalent to the runoff generated from 1.1-inch of rainfall over the impervious surfaces of the development. a. The amount of proposed impervious is 36,879 square feet. b. 6. A recordable executed maintenance agreement has been submitted. Adequate maintenance access is provided for the underground system. Maintenance agreement includes a site-specific plan, schedule, and narrative for maintenance of the proposed stormwater management practices.

RULE D: FLOOD CONTROL Standards ➢ Compensatory storage shall be provided for fill placed within the 100-year floodplain. ➢ All habitable buildings, roads, and parking structures on or adjacent to a project site shall comply with District freeboard requirements.

Findings 1. There is no floodplain on the property according to FEMA. 2. All habitable buildings, roads, and parking structures on or adjacent to the project site comply with CRWD freeboard requirements.

RULE E: WETLAND MANAGEMENT Standard ➢ Wetlands shall not be drained, filled (wholly or in part), excavated, or have sustaining hydrology impacted such that there will be a decrease in the inherent (existing) functions and values of the wetland. ➢ A minimum buffer of 25 feet of permanent nonimpacted vegetative ground cover abutting and surrounding a wetland is required.

Findings 1. There are no known wetlands located on the property.

RULE F: EROSION AND SEDIMENT CONTROL Standards ➢ A plan shall demonstrate that appropriate erosion and sediment control measures protect downstream water bodies from the effects of a landdisturbing activity. ➢ Erosion Control Plans must adhere to the MPCA Protecting Water Quality in Urban Areas Manual.

Findings 1. Erosion and sediment control measures are consistent with best management practices, as demonstrated in the MPCA manual Protecting Water Quality in Urban Areas.

2. Adjacent properties are protected from sediment transport/deposition.

3. Wetlands, waterbodies and water conveyance systems are protected from erosion/sediment transport/deposition.

4. Disturbed area is greater than 1 acre; an NPDES permit is required. A SWPPP has been submitted, and satisfies NPDES requirements.

RULE G: ILLICIT DISCHARGE AND CONNECTION

Standard ➢ Stormwater management and utility plans shall indicate all existing and proposed connections from developed and undeveloped lands for all water that drains to the District MS4.

Findings 1. New direct connections or replacement of existing connections are not proposed.

2. Prohibited discharges are not proposed.

Recommendation: Approve with 5 Conditions Conditions: 1. Receipt of $4,200 surety and documentation of maintenance agreement recorded with Ramsey County.

2. Provide plans signed by a professional engineer per the Minnesota Board of AELSLAGID. 3. Provide a copy of the NPDES permit.

4. Revise plans to include the following: a. Specify that the invert for the ADS StormTech pipe will be at an elevation of 895.75’ on Sheet C6.01 or in Detail 9 on Sheet C9.02. Currently the plan only lists the elevation of the bottom of the rock for the system and that the pipe must be a minimum of 9” above the bottom of the rock. b. Clarify the elevation for the 12” primary outlet for OCS 400. Sheet C6.01 in the plans and the HydroCAD list the elevation of the 12” primary outlet at 895.0’, but Detail 10 on sheet C9.02 lists the elevation of the outlet at 897.6’. If any changes are made to the HydroCAD, ensure the 100-year peak water level of the infiltration basin remains below 899.0’.

5. Revise HydroCAD to include the following changes to the outlet for Pond P2 (Surface Infiltration): a. Model the primary outlet as the 61’ long 12” HDPE pipe between STMH 500 and existing catch basin to south. b. Model the pipe between OCS 400 and STMH 500 and the pipe between OCS 300 and STMH 500 as devices draining to the primary outlet. c. Model the 8” orifice in OCS 400 as a device draining to the 23’ long 12” HDPE pipe between OCS 400 and STMH 500. d. If 100-year high water level in infiltration basin exceeds 899.5, include an additional device to model the 48” weir at an elevation of 899.5 that drains to the 23’ long 12” HDPE pipe between OCS 400 and STMH 500.

August 31, 2017 CRWD Board of Managers Anna Eleria and Forrest Kelley Snelling-Midway Redevelopment Site – Stormwater Management Update

Background For the past year and half, the City of Saint Paul and CRWD staff have been involved in stormwater management planning for the 35-acre Snelling-Midway Redevelopment site. The first phase of redevelopment includes construction of the MN United FC soccer stadium and associated infrastructure and open space over an 18-acre area. The remainder of the site will be redeveloped in future phases based on market interest. The City and CRWD have sought design of a site-wide, innovative stormwater management system that would be built as part of soccer stadium project.

This past spring, CRWD approved a permit to MN United FC for a base stormwater management plan, and issued an erosion control permit (soccer site only) so the team could begin construction while the design of a comprehensive (site-wide) system could be prepared and evaluated.

Issues MN United FC started project construction in late spring and final design of the stormwater management system is nearing completion. The soccer team has designed a comprehensive stormwater management system that includes two cisterns for capturing roof runoff from the entire 35-acre site including the soccer stadium roof and tree trenches for treating runoff from the new street and sidewalk grid. The captured rainwater will be filtered and treated with UV light for irrigating the 1.0-acre Great Lawn north of the stadium and other greenspaces for a total area of approximately 2.5 acres. The attached utility plan includes the reuse tanks, tree trenches, temporary surface basins and underground sand filters.

Staff have reviewed numerous iterations of the stormwater management plans as the comprehensive approach has evolved and additional details have been provided. The proposed plan would result in an estimated annual volume reduction from stormwater reuse of 45,000 cubic feet, in addition to 28,000 cubic feet of filtration and infiltration from traditional stormwater BMPs. Staff expect to bring a permit amendment to the Board once the comprehensive stormwater management plans are finalized.

PUBLIC HEARING – CAPITOL REGION WATERSHED DISTRICT 2018 Budget and Levy

President Collins requested that communication of the public hearing be included in the record. Notice of the Public Hearing was announced in two legal postings in the Pioneer Press. Information of the Public Hearing and proposed budget was also posted on CRWD’s website. The proposed 2018 budget was reviewed by the Citizen Advisory Committee on August 9, 2017. President Collins attended the CAC meeting and reviewed concerns addressed by members of the CAC. Members of the CAC were concerned about the increase in the levy. Ms. Cavanaugh from the CAC shared that the Committee voted to recommend the budget but the CAC expressed, concerns that the budget would not be enough to cover all the expected projects.

Administrator Doneux reviewed the proposed budget by sharing that most of the capital improvement budget of $8 million is planned for renovations of the new office. The operations budget totals $3.8 million. CRWD is anticipating a grant from Met Council. A bond has not been issued. Administrator Doneux reviewed the budget schedule. The public comment period will remain open until September 6th. The final budget will be presented

for approval on December 20th. President Collins asked for any other comments. Administrator Doneux replied that there were no comments.

Motion 17-172: Close the Public Hearing for the Proposed 2018 Budget and Levy of the Capitol Region Watershed District.

Permit Applications and Program Updates A) Permit #17-013 Great River School (Kelley)

Mr. Kelley reviewed permit #17-013 Great River School. The applicant, Great River School is planning a building expansion. The applicable rules are Stormwater Management (Rule C), Flood Control (Rule D), and Erosion and Sediment Control (Rule F). The disturbed area of this project is 1.2 acres with .78 acres impervious surface.

Motion 17-173: Approve permit #17-013 Great River School with three conditions: 1. Receipt of $3,600 surety and documentation of maintenance agreement recorded with Ramsey County.

2. Provide a copy of the NPDES permit.

3. Revise plans/HydroCAD to correspond: a. Pond 9 emergency overflow is 228.8 on Sheet C1 and 229.1 in HydroCAD. b. Plan sheets indicate pipes draining HydroCAD Ponds 7P, 8P, 9P, and 9 are 8” diameter.

HydroCAD indicates the pipe diameters are 6”.

Sheets C2 and C3 indicate the infiltration basin outlet structure consists of a 4” orifice and internal weir routed to a 12” outlet pipe. HydroCAD indicates the only control is a 4” culvert.

Reider/Texer Unanimously Approved B) Permit #15-017 Kellogg Bridges Reconstruction - Closure (Hosch) Mr. Kelley shared in place of Ms. Hosch that this permit was issued for the reconstruction of the Kellogg Blvd. bridges between market and Wabasha in St. Paul. Stormwater is treated in via volume bank debit. The project is complete, the site is stable, and no surety was collected. The adjacent Ramsey County demolition project continues.

Motion 17-174: Approve Certificate of Completion for permit #15-017 Kellogg Bridges Reconstruction.

Reider/Jones Unanimously Approved C) Permit #15-031 MetConcil Sanitary Realignment. – Closure (Hosch) Mr. Kelley in place of Ms. Hosch reviewed permit #15-031 MetCouncil Sanitary Realignment. The permit was issued for the abandoning a sanitary pipe within the East Branch of Trout Brook Interceptor and constructing a new alignment north of the 35E crossing at Maryland in St. Paul. The project did not require stormwater treatment as no impervious surface was impacted or created. The project is complete and the site is stable. No surety was collected.

Mr. Kelley explained how the pipe has been filled with a flowable concrete.

Motion 17-175: Approve Certificate of Completion for permit #16-001 University Avenue.

Approve Draft Watershed Management Plan Amendment (Eleria)

Ms. Eleria, shared that the estimated cost of the new office exceeds the anticipated amount in the ten-year plan.

Ms. Eleria reviewed the 2010 Watershed Management Plan (WMP), construction of a new office was identified as a capital improvement project under Fund No. 450 - Innovation and Future Trends. The estimated 10-year total expenditure was $2,985,000. In February 2017, CRWD purchased a building at 595 Aldine Street. The schematic design of renovations was completed in July. The updated, estimated cost of the new office space is $10,088,498, which includes the property acquisition, brownfield cleanup, design, and construction expenses. CRWD anticipates funding most of the building costs via bonding. CRWD’s bond counsel has instructed staff to obtain

an amendment to the 2010 Watershed Management Plan due to the significant budgetary changes. Ms. Eleria added that a 30-day review period will begin with a public meeting to be held on Sept 20th.

Manager Jones asked if an amendment has ever been done before. Administrator Doneux replied that yes in 2006 or 2007 and it was presented in front of Ramsey County Board, CRWD now has a different bond counsel.

Motion 17-178: Approve draft amendment to CRWD’s 2010 Watershed Management Plan and a public hearing date on September 20, 2017.

AR: Approve Lease Amendment (Doneux)

Administrator Doneux reviewed with the Managers that the current lease period ends on December 31, 2017 with an option to extend the lease to March 31, 2018. It is unlikely that renovations and construction will be complete at the 595 Aldine property by March 31, 2018. Administrator Doneux recommends that CRWD agree to a lease extension till June 30, 2017. The monthly lease rate for 2018 would be unchanged at $4,842.33 plus common area operating costs of $4,000/month.

Motion 17-179: Approve 6th lease amendment with 1400-1410 Energy Park Drive, LLC for the term of Janury 1, 2018 to June 30, 2018.

Unfinished Business A) McCarrons AIS update (Sellner)

Mr. Fossum shared a review of some of the work that has happened at Lake McCarrons. Mr. Sellner provided an update on the public meeting held on July 20th. Manager Texer attended the public meeting as well. At the public meeting the health of Lake McCarrons, aquatic invasive species, and plan update were reviewed with residents. Mr. Sellner reviewed the tasks of the AIS plan. Task one is to identify concerns, threat levels, species and extent, management option and recommendations. Task two is to meet with partners such as: DNR, City of Roseville, Ramsey Conservation District. Task three is to identify infestation and response to infestations. Task four is to create a plan to present to the board this fall and to determine stakeholder roles and involvement.

Manager Texer explained that when meeting with neighbors that it is important to make it very clear that this is the plan for this issue. Mr. Fossum noted that the neighbors care about lake, and their questions and discussions would quickly get off track. Mr. Sellner shared feedback from the public meeting, and reviewed that new species are being introduced at boat launch. Manager Texer suggested some educational signage to help residents identify invasive species. Manager Reider recommended partnering with Ramsey Conservation, to have residents trained to help with identifying invasive species at the boat launch area. Mr. Sellner replied that there are programs available for identifying invasive species. President Collins recommended information be available on the web site as a guide for people to identify. Mr. Fossum expressed that he would share the recommendations with the Educational and Outreach staff.

B) 2017 Watershed Steward Awards Update (Bromelkamp) Our Mission is to protect, manage and improve the water resources of Capitol Region Watershed District

Administrator Doneux reviewed for Ms. Bromelkamp that the event has been delegated to the CAC. The date of the event has been moved to January. The CAC has approved guidelines for the committee to categorize the awards. Some of the new categories include: Watershed Citizen Award, Watershed Partner Award, Watershed Outreach Program Award, Young Watershed Steward Award, Watershed Project Award and Lifetime Stewardship Award. The CAC anticipates that the guidelines will help in reaching new audiences, treating a large amount of stormwater, and furthering CRWD’s mission in new or innovative ways in stormwater management. Manager Reider suggest a grid table format for summarizing the nominations for reviewing applicants.

C) CRWD New Website Update (Bromelkamp) Administrator Doneux provided an update for Ms. Bromelkamp. The Website Committee is currently reviewing quotes and will be interviewing firms this week. The committee will be done in August and be able to make recommendations for work to begin in September.

D) Willow Reserve Restoration Project Update (Zwonitzer) Mr. Zwonitzer will be providing a tour of the Willow Reserve on Tuesday, August 22. The focus of the project has been to enhance diversity of native plants and animals, restore the ecological integrity, and allow for animal and human access. About 35% of the project is complete. In the habitat areas, there has been tree removal, debris removal, and trail installation. Very difficult invasive species such as buck thorn and Japanese bamboo plants are being removed. In 2018, seedlings and plantings of native species will be installed and possibly some planting yet this fall. Some of the native species are rebounding.

E) Como Senior High School Project Update (Zwonitzer) Mr. Zwonitzer provided a review of the Como Senior High School Project. The project is a partnership with the City of St. Paul. The City of St. Paul will own and maintain the system. Mr. Zwonitzer shared some the challenges of the project including the restrictions of the size and area. Another challenge has been the size of the location and that the running track cannot be patched. Accommodations were made so that vehicles could be driven over the track without causing damage. Ramsey County Attorney Mogen has negotiated the terms of the agreement with a quick turnaround time. The next steps include coordinating signage, report to BWSR for Targeted Watershed Grant, Maintenance. The Managers thank Mr. Zwonitzer for his work on this project.

F) Research Program Update (Fossum) Mr. Fossum provided an update on the MN Stormwater Research Council Program with the University of Minnesota. Mr. Fossum shared how the board approved $25,000 to help with funding the pilot project to be used for research. Mr. Fossum explained how project is working on alternatives to iron enhanced sand filtration.

Taconite is a less expensive alternative than adding iron to sand.

G) Ford Site Update (Fossum) Mr. Fossum provided an update on the Ford site. Mr. Fossum reviewed a part of the Ford site that is known as “Area C” that had been used for dumping by Ford Motor Company for numerous years. This area is under an investigation. The area is located within the 100-year flood plain. The contents of waste materials are just under 100 feet in depth. An investigation report stated that there is no threat from the waste materials. Mr. Fossum shared a letter that he wrote stating that the tests performed and results were inconclusive. Mr. Fossum stated that now is the time to deal with these issues. Manager Jones asked about how long clean up would take. Mr. Fossum replied that it could potentially take several years. place just to investigate what is in the waste materials and for how will it affect human and aquatic life. The investigation itself may take several years. Manager Texer asked if the material in this area could have a negative impact further down the stream. Mr. Fossum replied that yes, it could impact the river and is a water quality issue. Ms. Cavanaugh asked if anyone knows just how old the dumping is. Mr. Fossum replied that the industrial waste portion is from 1940’s – 1960’s. Mr. Fossum expressed that cleanup of this area is a large project and would need the assistance of partners such as: City of St. Paul, Ramsey County, National Park Service, and possibly federal funding. Mr. Fossum summarized that he will continue to track progress and provide the managers with updates.

Background Partner Grants support organizations who share in the District’s mission to protect, manage and improve our water resources. Eligible costs include both personnel and materials. Any organization or community group serving residents within CRWD’s boundaries is eligible to apply. Projects funded in 2018 must be completed with a final report submitted by December 31, 2018. Grants are funded on a reimbursement basis and liability insurance is required for all grantees. Partner Grants are given to organizations, schools, businesses and other entities for clean water education and outreach projects. Grant awards range from $2,000-$20,000.

Issues Staff will distribute the 2018 Partner Grant solicitation to the attached list and any additional community organizations, cities or agencies suggested by the Board of Managers. The distribution list includes previous grant recipients and organizations that represent new audiences for CRWD. The 2018 budget for Partner Grants is $75,000.

Background In 2016 CRWD was awarded a $1.76 million grant through BWSR’s Targeted Watershed Program (TWP) for work in the Como and McCarrons subwatersheds. One of the potential projects identified in the grant application was a regional BMP at Parkview Center School located at the intersection of County Road B and Dale Street in Roseville. In May, the CRWD Board approved SRF as the consultant to conduct a feasibility study of BMP options for $22,697. The feasibility study is eligible for funding through the TWP grant.

Issues Staff are requesting approval of an amendment (enclosed) to SRF’s contract to extend the project deadline and cover costs related to soil investigations and additional analysis. Soil borings conducted at Parkview Center School encountered groundwater between 9-12 feet below the surface which will impact the BMP design. To better understand the seasonal groundwater fluctuations, SRF recommends installing a piezometer to regularly track the groundwater elevations for one year. The installation will also provide an opportunity to collect additional information on the soils. The additional cost for the installation and analysis is $6,088.

Initial cost estimates prepared by SRF for BMP configurations to treat a 1.1” rainfall exceeded what staff thought might be feasible. Staff requested that SRF do the same analysis with BMP configurations sized for a 0.5” rainfall to reduce costs and aid in determining the most cost-effective size for the BMP. The additional cost for this analysis is $1,412. Finally, due to weather delays related to the soil borings and the added complexity of designing a BMP near groundwater, the project schedule will need to be extended.

Staff are requesting the Board approve a $7,500 increase to SRF’s budget and a project deadline extension to December 31, 2017 for the reasons outlined above.

Background CRWD and RCD have provided technical assistance and design services for JGM Properties towards the development of a rain garden project at 1410 Energy Park Drive. The proposed design includes three rain gardens with pre-treatment devices and underdrains, and is sized appropriately to capture and infiltrate 1.1” rain events from large sections of parking lot. CRWD and RCD have both proposed funding for this project based upon results from our Stewardship Grant Calculator. CRWD will cover 49% of the project cost and RCD will cover 46% of estimated cost. The property owner JGM Properties will be responsible for 5%.

Issues The property owner has reviewed and accepted a bid for the project totaling $53,250 from the contractor Ecoscapes Sustainable Landscapes. The estimated cost for signage is $950, bringing the project total to $54,200. CRWD’s cost share for the project would be $26,570. The RCD grant would be $24,920. The property owner JGM Properties is responsible for the remaining balance of $2,710.

Background The Board has discussed and reviewed the preliminary 2018 Budget and Tax Levy during meetings and workshops this summer. The Board of Managers held a special workshop on July 26, 2017 to review the draft budget and levy. The Citizen’s Advisory Committee reviewed and recommended approval on the proposed 2018 budget and levy at their August 9th meeting. A duly noticed Public Hearing was held on August 16th to collect public comment on the proposed 2017 budget and levy. The Board of Managers must adopt a Preliminary 2018 Budget and Levy Certification before the initial September 15, 2017 deadline.

Issues I am recommending that the Board adopt the preliminary budget and levy as presented. The District has not received any comments as of August 31st. If the Board were to consider a change in the budget or levy, I would recommend doing that at the December, Final Levy Certification to allow for better estimating of fund balance as well as external budget requests.

Staff is recommending the preliminary budget of $ 376,744 for Administration, $ 2,701,271 for Programs, $ 868,465 for Projects for a total Operations Budget of $ 3,946,480 and $ 8,787,084 for Capital Improvement Projects. This results in a total Preliminary 2018 Budget of $12,733,564. This is an increase of $313,653 from 2017. The proposed 2018 tax levy is $6,530,480. This includes $6,162,140 for the operations and capital levy and $368,340 for debt. This levy is $1,614,808 higher than 2017.

WHEREAS, A Board workshop was held July 26, 2017 to review the detailed Operations Budget, CIP and Project Financing Plans and WHEREAS, at the CRWD Board of Managers meeting on August 2, 2017 the Preliminary 2018 Budget and Levy was reviewed and approved for distribution for Public Review and Comment, and WHEREAS, on August 9, 2017 the Citizens’ Advisory Committee reviewed and recommended adoption of the budget and levy as presented; and WHEREAS, a duly noticed Public Hearing was held on August 16, 2017 at 6:00 PM at the CRWD Offices, 1410 Energy Park Drive, Suite 4 with no members of the public present commenting on the budget, and THEREFORE BE IT RESOLVED, that the CRWD Board of Managers approves and adopts the 20188 Preliminary Operations Budget of $3,946,480 and a Capital Improvement Budget of $8,787,084 for a total budget of $12,733,564.

BE IT FURTHER RESOLVED, the proposed 2018 tax levy is $6,530,480. This levy includes $6,162,140 for the general levy and $368,340 for debt.

Background The programming, design and construction of public buildings require the coordinated efforts of the owner, architect, construction manager and contractors. Critical to the successful delivery of a building project is effectively guiding these different parties into a productive and responsive force that represents the interests of CRWD. Issues CRWD must begin the process of selecting a project delivery method and begin to implement that approach for the new office project. Five primary project delivery systems have evolved to organize the design and construction work: 1. Design-Bid-Build, 2. Construction Management–Agent, 3. Construction Management–Contractor or Construction Manager at Risk, 4. Design-Build and 5. Contractor PreSelection.

Staff believe that Design-Bid-Build (#1), Design Build (#4) and Contractor Pre-Selection (#5) from our suite of Project Deliver options are not well suited to our project. The Design-Bid-Build is the method currently used for all our capital improvement projects. This method for our building is not desirable because construction phases are sequential and may require more time, CRWD is at risk for final construction and the lowest bid contractor would be selected rather than the most qualified to build out our office. We are currently too far along in the process for Design-Build and there is concern about hidden reductions in quality for such a unique one off building such as our office. Contractor Pre-Selection has many of the same disadvantages of the Design Build approach.

Of the two remaining options, Construction Management–Agent or Construction Manager at Risk, staff believe that the Construction Manager at Risk is the best option for this project. The benefits to this approach are that the Architect still acts as agent protecting owner’s interest and architect’s early involvement with owner addresses building quality and function. Early cost commitment gives owner project cost security. At Risk entity is responsible for managing construction process and has more clout with subcontractors. CM-Contractor can reduce owner’s burden in management of large or complicated projects. CM-Contractor reviews project for constructability, cost and schedule, potentially reducing change orders and delays. Fast-tracking and multiple prime contracts may speed construction.

Understanding Project Delivery for the Design and Construction of Public Buildings

he programming, design and construction of important public buildings require the coordinated efforts of a large number of professionals and organizations.

Critical to the successful delivery of a complex building project is effectively guiding these diverse parties into a productive and responsive force that represents the interests of public agencies, institutions and taxpayers. Five primary project delivery systems have evolved to organize the design and construction work: 1. Design-Bid-Build 2. Construction Management–Agent 3. Construction Management– Contractor or Construction Manager at Risk 4. Design-Build 5. Contractor Pre-Selection The first two delivery systems utilize an open, competitive bidding process and are therefore generally available for public sector projects under current law.

Design-Build, Construction ManagerContractor and Contractor Pre-Selection do not include competitive bidding and therefore require special legislation.

Each of these systems has a unique decision-making structure with distinct advantages and disadvantages.

Identifying the optimum delivery method for public projects depends on how public institutions value their own input; project cost and schedule; overall project quality; short-and long-term goals; and the accountability of the project participants.

Contractual Relationship Agent-Vendor When evaluating the opportunities and constraints of each delivery method, it’s important to identify how a project benefits from an agent-contractual relationship or from a vendor-contractual relationship.

Agents, by definition, act in the owner’s interest, providing professional services for compensation. They typically have special expertise and are expected to adhere to a professional standard of performance - that is, to exercise reasonable care in their services. In selecting an agent, the owner normally considers qualifications, experience and integrity as most important. Architects, engineers and construction managers put their professional expertise to work on behalf of their clients. As agents, they take responsibility for overseeing that the owner’s needs and intentions are fully identified, defined and accommodated.

Opportunities and Constraints of Project Delivery Methods Vendors, by definition, supply a specified product for a fixed price. Vendors are expected to adhere to a standard of performance established in the construction documents. When selecting a vendor, the owner usually considers the cost of the product being supplied, its delivery, warranty and, only in cases of disqualification, the experience and reputation of the vendor. A contractor who is constructing a building for a specific price determined through an open bidding process is acting as a vendor.

If specifications are met and drawings adhered to, the contract is satisfied.

Design-Bid-Build In this traditional method of project delivery, a design team of architects and engineers is hired to work with an owner to develop plans for a building to fit the goals, budget and aspirations of the owner. Based on completed construction plans, a contractor is selected through a bidding process to build the building for a set price. During the construction period, the architect works to see that the

contractor builds according to the plans and specifications, and that the owner meets financial and other obligations to the contractor.

Design-Bid-Build is an effective projectdelivery system that, for many years, has helped public owners achieve quality in the design and construction of public projects. The architect is typically selected at the onset of the project based on qualifications and experience, and represents the owner’s interests during both design and construction, delivering professional service as the owner’s “agent”. The building contractor that is successful in bidding will then contract with the owner as a “vendor” to construct the specified design for the lowest responsible price.

Advantages of Design-Bid-Build

1. Contractors bid competitively, based on complete design documents to maximize the built product for the price.

2. The owner selects the architect on the basis of qualifications or ability. The architect’s role is that of owner’s advocate.

3. The architect is active in construction administration so design intentions are followed.

4. Design and construction roles are clearly defined, and responsibilities and liabilities clear.

5. Owner is an active participant in design process.

Disadvantages of Design-Bid-Build

1. Design-Bid-Build construction phases are sequential and may require more time.

2. Owner is at risk for final construction cost. Actual construction costs are not known until design and bidding are complete.

Construction Management Some owners or public agencies planning construction of complex projects may not have resources in-house to manage planning, design and construction of a major building project. To support this need, Construction Management services can be provided in two different ways to an owner.

In one form of Construction Management, the owner contracts separately with an architect, a Construction Manager as Agent (CM-Agent) and—through a competitive bid process—one or more prime contractors. The CM-Agent provides early cost estimating, scheduling and assistance to the owner throughout the bidding and construction phases of the project. Additional cost control and condensed scheduling are the two main benefits of this method. The CM-Agent approach can be beneficial for large, complex projects where construction alternatives and solutions can positively impact the overall budget. The Construction Manager-Agent performs as an additional representative of the owner’s interests.

In the second form of Construction Management, the owner contracts separately with an architect and a Construction Manager at Risk or Construction Manager as Contractor (CM-Contractor). In this vendor form, the construction manager is “at risk” since he provides both contractor services and construction management services for the project. Construction Contractor services are provided to the owner based on a guaranteed maximum price, fixed price, cost plus or other means of defining a contract. This creates a major conflict of interest since the CM is no longer acting as an agent providing professional services to the owner, but now is a vendor delivering a contractually defined product to the owner for a price.

Advantages of Construction Manager-Agent

Advantages of Construction Manager as Contractor (vendor)

1. CM-Agent with construction expertise gives the owner an agent, in addition to the architect, to supervise the project, reducing the owner’s management burden in large or complicated projects.

2. CM-Agent’s project scheduling and capability to competitively fast track some items may speed process and save owner money.

3. CM-Agent’s cost estimating and construction expertise at design phase assists in monitoring construction costs.

Disadvantages of Construction Manager-Agent

1. CM-Agent is added cost. Owner is at risk for final construction cost; actual construction costs are not known until design is complete.

4. CM-Agent typically has less clout to resolve design-construction issues than a general contractor and serves only as a mediator.

Opportunities and Constraints of Project Delivery Methods Design-Build In the Design-Build delivery approach, the owner contracts with a single entity for both design and construction. The owner has one contract assigning singlepoint responsibility for the project. The Design-Build entity may be a single organization with both architectural and construction staffs, or a construction organization that hires or affiliates with an architect as part of a Design-Build team.

The design-build entity usually proposes the design and construction price simultaneously, and the construction commitment is made. Design and construction may or may not be fast-tracked.

In a Design-Build delivery system, the architect is part of the Design-Build entity and not the agent of the owner.

Thus, uniquely in the Design-Build system, there is no one in an agency relationship with the owner who is obligated to work in the owner’s best interests. The design-build team is placed in a vendor relationship with the ultimate end user groups and public owner. When dealing with public sector building projects where much involvement, interaction and

negotiation between agencies, officials and constituent communities is expected or required, a vendor led project delivery process may minimize the opportunities for user involvement. The design-build entity is focused on the delivery of a contractually defined product. Since single point responsibility leaves no independent agent representing the owner’s interests, the owner will often be required to engage an administrative architect to assist in defining the building program, writing performance requirements, selecting the design-build entity and administering the design-build contract for the owner. The owner will often also hire a separate construction management entity to monitor its interests. Without early additional program/ design/specification development, the owner is likely to get less building for the price.

Advantages of Design-Build

1. Generally fastest project delivery system.

2. Single entity responsible for design and construction.

3. Early cost and scheduling commitment.

4. Conflicts between project professionals internalized; may not involve owner.

Disadvantages of Design-Build

1. Design-Builder may provide less building than a bid approach to protect margin of profit. Construction costs are non-competitive.

2. Involvement of owner is generally limited to early stages of project.

3. Hidden reductions in quality are possible when cost-savings and design changes are determined by designbuilder. Short-term construction savings may outweigh life-cycle costs.

4. Construction documents not complete when cost commitment made.

Disagreements about quality and design intentions may arise later.

5. Major conflict of interest with role as designer and contractor.

6. No objective agent to represent owner’s interests.

Contractor Pre-Selection

Disadvantages of Contractor Pre-Selection

Contractor Pre-Selection has evolved from Design-Build in order to obtain the benefits of an independent designer, shortened schedule and early cost commitment. The owner holds separate contracts with the architect, who functions as an independent owner’s agent, and with the contractor, with whom he negotiates a construction price. Final construction cost may be negotiated to provide for bids from subcontractors, with cost savings going partially to the owner. The owner/user is involved in programming and design decisions. A construction manager may be added to the team if required.

1. Without competitive bidding from the contractor, owner may not obtain lowest construction price, but this can be mitigated by mandatory subcontractor bidding.

Advantages of Contractor Pre-Selection

1. Provides early cost and scheduling benefits and saves time.

2. Architect acts as agent protecting owner’s interest.

3. Architect’s involvement with owner addresses building quality and function.

Balancing Cost, Time, Quality and Accountability When evaluating the ideal project delivery system, a building owner should prioritize project cost, time, quality and accountability. Design-Build and Contractor Pre-Selection can overlap design and construction to address a tight time schedule. Straightforward projects with known requirements are often suited to Design-Build project delivery. DesignBuild schedules require participants to make decisions quickly. Changes to plans become increasingly difficult and expensive as work rapidly progresses. And there is a limit to the amount of time that may be squeezed out of a project, no matter how many people are working at the task or which approach is used.

If the proposed building is programmatically complex or of a monumental quality, it may require additional design effort and input from many stakeholders.

The traditional Design-Bid-Build project delivery system encourages a thorough and interactive design process. Public entities are also directly accountable to their constituents and may favor approaches where construction is competitively bid in an open market as with Design-Bid-Build or Construction Management.

Design and construction of public buildings, like most complicated human endeavors, requires thoughtful review and consideration of how they will best function and endure to provide valuable service over many, many years. If public architecture is seen as the handwriting of a civilization, then it must be the best it can be because it is truly the people’s architecture.

Often the most challenging task, when large cost and complexity of construction is involved, is having enough information available, in a timely manner, for key decision makers to reach the best decision. Some Terms Defined

Bid • A signed proposal to do the work for the amount stipulated.

Construction Administration • Administration of the owner’s contract for construction during construction period until final payment to the contractor is due.

Construction Cost • The cost of the construction work to the contractor and their subcontractors. Does not include other costs referred to in the Project Cost (compare with project costs).

Construction Documents • Drawings and specifications detailing the requirements for the construction of a project.

Construction Management • This is a broad term covering a variety of project delivery systems in which a construction manager is added to the building team.

Construction Manager (CM) • Additional consultant such as an architect, contractor, engineer or developer added to project team to oversee scheduling, cost control, constructability, project management, building technology, and the bidding or negotiating of construction contracts or construction.

Contractor (general contractor) • The primary contractor who oversees and is responsible for all the work performed on the site and to whom any subcontractors on the same job are responsible.

Contractor Pre-Selection • Selecting the contractor on qualifications, not price, early in the process to team with the architect for time savings.

Cost Plus Fee • The contractor in an owner-contractor agreement is reimbursed for the direct and indirect costs of performance of the agreement and, in addition, is paid a fee for services.

Design-Bid-Build • The most common form of project delivery. Architect and contractor hold separate contracts with the owner. It is characterized by three phases: design, bidding and construction.

Design-Build • A project delivery method that offers an owner the ability to contract with a single entity to provide both design and construction services.

Design-Builder • Entity that contracts with a building owner to provide design and construction services through a single contract.

Design Development Phase • The second phase of an architect’s basic service, which includes developing structural, mechanical and electrical drawings and specifying materials and the probable cost of construction.

Fast-Tracking • Construction delivery approach which overlaps design and construction, thereby shortening project schedule.

GMP • Guaranteed maximum price.

Lump Sum • A contract in which a specific amount is set forth as the total payment for performance of the contract.

Performance Specification • Standards for product quality, construction methods or building systems to be used in a building project.

Prime Contractor • A contractor who has a direct contractual relationship with the owner for of work, as distinguished from a subcontractor whose contractual relationship is not with the owner, but with a general or prime contractor.

Program • A written statement setting forth design objectives, constraints, and criteria for a project, including space requirements and relationships, flexibility and expandability, special equipment and systems, and site requirements.

Project Costs • The total funds budgeted for the project, including construction cost, design fees, furnishings and equipment, fees and permits, and contingencies (compare with construction costs).

Project Delivery System • A formalized contractual approach which allows an owner to secure planning and design services and build a project, assuring effective management throughout.

Schematic Design Phase • The phase of the project in which the architect consults with the owner to ascertain the requirements of the project and prepares schematic design studies consisting of drawings and other documents illustrating the scale and relationship of the project components to the owner. The architect also submits to the owner a statement of probable construction cost.

Subcontractor • A person or entity who has direct contact with the contractor to perform any of the work at the site.

Value Engineering • The process of reviewing elements of the project design in terms of cost benefit. Value engineering involves substitution of less costly systems or materials without changing the function or overall appearance of the building.
