Artist/Contractor Agreement

8) This contract is a confirmation of an agreement between Carpe Diem Communications (CDC) and _______________________________; herein referred to as “the client,” that appoints CDC as the client’s manager, to act exclusively on the client’s behalf for the booking throughout the world for the duration of ________________________. 9) The terms of this contract are as follows: Ÿ CDC shall represent the client’s interests, and conduct negotiations on the client’s behalf. CDC will not commit to any agreement without the pre­approval of the client and the client understands that their responsibility, while under contract, is to refer all approaches regarding their booking/appearances to Carpe Diem Communications from the time this contract commences. Ÿ CDC and the client have agreed on the said amount of, ______________, as the flat rate for the entire duration of the contract. Ÿ The fee for the contract will be divided and disbursed to CDC as follows: 50% deposit on cost of entire contract at the commencement date and the remainder 50% of the cost at the expiration of the contract. Ÿ CDC promises to deliver the agreed services within the contract term, however, if the client is not satisfied with the performance of the CDC associate then the clint will have the right to terminate the contract within the first 90 days of the contract. CDC is then obliged to return half of the deposit amount, after the deduction of incurred expenses for CDC on behalf of the client. Ÿ The booking commission is as follows: 10% on all amounts arising from any agreement made on the client’s behalf, except that on international bookings CDC’s fees are a commission of 15% Ÿ The client understands that any normal expenses in conception with offering the booking and dealing with contracts and income arising there from shall not be charged to the client. However, extraordinary expenses shall be charged to the client but these will be billed to the client directly when payments are made and received by the client for the client’s booking and scheduled appearances.
