MILE HIGH SELECT QUARTER HORSE & PAINT HORSE SALE INFORMATION PAGE
Bidders must have a buyers number to bid. To register and receive a number you will need to fill out a buyers form in either the RMQHA or RMPHA Sales Office prior to the sale. You must present a current drivers license and provide banking information in order to register for a number. Upon receiving your bidder’s number you are eligible to pay for your purchases with a personal check. Examine horses before bidding. If you have any particular concerns about conformation, defects, performance, etc., check these concerns before you bid. Listen for announcements from the veterinarian provided by sale management, who may make announcements about a particular horse as it comes into the ring or you may want to have your own veterinarian inspect a cataloged horse you may be interested in. This inspection would be at your expense. All buyers must pay for purchases prior to getting a release to leave the National Western Stock Show grounds. This will include releases for both brand and health and a purchase contract/trucking release from sale management company(s). Purchases of Quarter Horses will be finalized at the RMQHA(Quarter Horse) table, purchase of Paint Horses will be finalized at the RMPHA (Paint Horse) table. All horses must be settled for and removed from the sale area stalling no later than 10:00 AM on January 8, 2012. Bring more than one check if you plan on purchasing both quarter horses and paints. Also please bring your APHA and AQHA ID numbers which we will use for transfer of horses. BROODMARES HAVE BEEN PREGNANCY CHECKED WITHIN 10 DAYS OF SALE. ANY PURCHASER OF A BROODMARE SOLD IN THIS SALE MAY HAVE HER RE-EXAMINED WITHIN 24 HOURS AFTER THE FALL OF THE HAMMER, AND PRIOR TO THE REMOVAL FROM SALES PREMISES, BY A VETERINARIAN ACCEPTABLE TO THE UNDERSIGNED. Any broodmare so examined whose pregnancy status is found not to be as represented at the time of sale may be returned to consignor as unsold, and consignor shall pay the veterinarian's fee for examination. There is no guarantee as to the breeding soundness of any filly or mare sold unless such animal be specifically designated as a broodmare prospect. UNLESS WAIVED BY ANNOUNCEMENT, THERE SHALL BE AN UPSET PRICE OF $500 ON ANY HORSES OFFERED. IF AN OPENING BID OF THE UPSET PRICE IS NOT IMMEDIATELY FORTHCOMING TO THE AUCTIONEER’S CALL, THE HORSE SHALL BE LED OUT UNSOLD. CONSIGNORS TO THIS SALE HAVE THE RIGHT TO PLACE A RESERVE MINIMUM ON ANY HORSE THEY HAVE CONSIGNED PRIOR TO THE START OF THE SALE. A HORSE OFFERED WITH RESERVE BID WHICH IS NOT MET WILL BE RETAINED BY CONSIGNOR AS UNSOLD, WITH APPROPRIATE COMMISSION TO BE PAID BY CONSIGNOR. FOURTH - BIDDING DISPUTES: SHOULD ANY DISPUTE ARISE BETWEEN OR AMONG TWO OR MORE BIDDERS, THE AUCTIONEER SHALL FORTHWITH ADJUDICATE THE DISPUTE, AND HIS DECISION SHALL BE ABSOLUTE, FINAL, AND BINDING ON ALL PARTIES. BIDS TENDERED AFTER FALL OF HAMMER ARE NOT GROUNDS FOR DISPUTE. BIDS RECEIVED BY PERSONNEL EMPLOYED BY THE AUCTIONEER HAVE THE SAME STATURE AS BIDS RECEIVED BY AUCTIONEER. ADVANCE BIDDING SHALL BE RESTRICTED TO THE DISPUTING PARTIES UNLESS THE BID IS REDUCED BELOW THE LEVEL OF THE RECOGNIZED BID AT COMMENCEMENT OF DISPUTE, IN WHICH CASE BIDDING IS REOPENED TO ALL. FIFTH - TITLE AND DELIVERY: TITLE PASSES TO BUYER AT THE FALL OF THE HAMMER. ALL RISK OF INJURY TO THE HORSE BECOMES BUYER’S RISK AT PASSING OF TITLE. BUYER OR HIS REPRESENTATIVE SHALL ASSUME CARE, CUSTODY, AND CONTROL OF THE HORSE IMMEDIATELY AT THE FALL OF THE HAMMER. BUYER SHALL IMMEDIATELY PRESENT HIMSELF/HERSELF OR IN CASE OF A CORPORATION, A DULY AUTHORIZED REPRESENTATIVE, TO MAKE SETTLEMENT BUT, IN ANY CASE, SHALL SO PRESENT HIMSELF/HERSELF WITHIN THIRTY (30) MINUTES OF CONCLUSION OF THE SALE. UPON SETTLEMENT BY BUYER, HORSE WILL BE DELIVERED PURSUANT TO A BILL OF SALE AND RELEASE PROVIDED BY RMPHARMQHA TO BUYER OR HIS/HER REPRESENTATIVE. BUYER OR HIS/HER REPRESENTATIVE SHALL PRESENT RELEASE TO DESIGNEE OF THE RMPHA/RMQHA TO REMOVE HORSE FROM SALE PRESMISES AFTER TAKING POSSESSION, BUT, IN ANY CASE, TAKING POSSESSION OF THE HORSE BY BUYER OR HIS/HER REPRESENTATIVE SHALL CONSTITUTE DELIVERY. UPON DELIVERY, BUYER SHALL CAUSE HORSE TO BE REMOVED PROMPLTLY FROM THE SALE PREMISES OR SHALL BE SUBJECT TO STABLE CHARGES AS DETERMINED BY THE RMPHA/RMQHA. IN ADDITION, SHOULD BUYER FAIL TO CAUSE HORSE TO BE REMOVED PROMPTLY, THE RMPHA/RMQHA MAY CAUSE HORSE TO BE REMOVED FROM SALE PRESMISES AT BUYER’S RISK AND EXPENSE. COGGINS AND BRAND CERTIFICATE WILL BE GIVEN TO BUYER AT TIME OF SALE, AND THE REGISTRATION PAPERS WILL BE SENT TO BUYER AFTER THE CHECK HAS CLEARED. PLEASE ALLOW TWENTY-ONE (21) BANK BUSINESS DAYS FOR CHECK TO CLEAR. SIXTH - TERMS FOR SETTLEMENT: BUYER SHALL MAKE SETTLEMENT WITH THE CASHIER OF THE RMPHA/RMQHA. PAYMENT TO OTHERS, INCLUDING CONSIGNORS OR THEIR REPRESENTATIVES, DOES NOT CONSTITUTE SETTLEMENT. BUYER SHALL PRESENT HIMSELF/HERSELF TO MAKE SETTLEMENT, AS PROVIDED IN THE FIFTH CONDITION ABOVE, FOR THE FULL PRICE, SUCH SETTLEMENT TO BE IN THE FORM OF U.S. CURRENCY OR EQUIVALENT ACCEPTABLE TO CASHIER OF THE RMPHA. SEVENTH - DEFAULTERS: IF ANY PERSON SHALL PURCHASE A HORSE AND FAIL TO PAY FOR IT WITHIN THE TERMS AS SET FORTH IN THE FIFTH AND SIXTH CONDITIONS ABOVE, NOTHING CONTAINED HEREIN SHALL PREVENT THE RMPHA/RMQHA OR CONSIGNOR FROM FILING SUIT TO COMPEL SUCH PERSON TO PAY FOR IT. THE RMPHA OR CONSIGNOR SHALL ALSO HAVE THE OPTION TO RETRIEVE THE HORSE FROM BUYER, AT BUYERS EXPENSE, AND RESELL AT PUBLIC OR PRIVATE SALE WITHOUT NOTICE. COSTS, INCLUDING ATTORNEYS FEES, OF SUCH SUIT OR RESALE SHALL BE BORNE BY BUYER. SHOULD SUCH RESALE FAIL TO SATISY THE DEFAULTING BUYERS ACCOUNT IN FULL, DEFAULTER SHALL BE LIABLE FOR THE AMOUNT OWING, INCLUDING ALL COSTS OF COLLECTION AND ATTORNEYS FEES. FURTHER UPON DEFAULT, THE BUYER IN DEFAULT SHALL BE LIABLE FOR A DELINQUENCY OR LATE CHARGE AT THE RATE OF 1 Ω % PER MONTH ON THE UNPAID PURCHASE PRICE FOR THE DATE OF SALE UNTIL PAID. EIGHTH - WARRANTIES AS TO SOUNDNESS: UNLESS EXPRESSLY ANNOUNCED FROM THE AUCTION BOX OR BY OFFICIAL PUBLICATION OF THE RMPHA/RMQHA, THERE IS NO WARRANTY OR GUARANTEE OF ANY KIND AS TO THE SOUNDNESS OR CONDITION OR OTHER QUALITY OF ANY HORSE SOLD IN THIS SALE. IF YOU HAVE QUESTIONS, PLEASE CONTACT THE SALE VETERNINARIAN PRIOR TO THE SALE, ALTHOUGH EVERY HORSE WILL BE EXAMINED BY A SALE VETERINARIAN PRIOR TO THE SALE THIS IS BY NO MEANS A “PRE-PURCHASE EXAM” AND SHOULD NOT BE RELIED UPON AS SUCH BY A PROSPECTIVE BUYER. BUYERS SHOULD EXAMINE HORSES PRIOR TO PURCHASING. VETERINARY ASSISTANCE IS AVAILABLE AT BIDDER’S EXPENSE UPON REQUEST TO SALE OFFICIALS, OR POTENTIAL BUYERS MAY HAVE THEIR OWN INDEPENDENT VETERINARIAN CONDUCT A FULL’“PRE-PURCHASE EXAM” AT BUYER’S EXPENSE AND MUST BE DONE PRIOR TO SALE. ALL HORSES BECOME THE PROPERTY OF THE HIGHEST BIDDER AT THE FALL OF THE GAVEL WITHOUT RECOURSE AND WITH NO RIGHT OF RETURN. IN THE EVENT CONSIGNOR AGREEES TO THE RETURN OF ANY HORSE GOING THROUGH SALE RING BY THE BUYER, FOR ANY REASON WHATSOEVER, CONSIGNOR SHALL BE LIABLE FOR THE COMMISION AS IF SOLD. SUCH AN AGREEMENT IS BETWEEN CONSIGNOR AND BUYER AND SHALL NOT INVOLVE THE RMPHA/RMQHA IN ANY WAY WHATSOEVER. TENTH– CATALOG AND ANNOUNCEMENTS: –THE ACCURACY OF ALL INFORMATION OF THE SALE CATALOG PAGE(S) IS THE SOLE RESPONSIBILITY OF THE CONSIGNOR. CONSIGNOR SHALL HAVE THE AFFIRMATIVE DUTY TO EXAMINE THE CATALOG PAGE (S) ON WHICH HORSES CONSIGNED BY HIM APPEAR, PRIOR TO THE SALE, REPORT ANY INACCURACIES TO AUCTIONEER AND RMPHA/RMQHA SO THAT IT MAY MAKE APPROPRIATE ANNOUNCEMENT AT THE TIME OF SALE. WHILE CERTAIN INFORMATION MAY HAVE BEEN PROCURED BY AUCTIONEER OR RMPHA/RMQHA FROM THIRD PARTIES ON BEHALF OF CONSIGNOR, IT IS NONETHELESS SOLELY THE RESPONSIBILITY OF CONSIGNOR TO VERIFY THE ACCURACY OF SUCH INFORMATION AND TO NOTIFY THE AUCTIONEER AND RMPHA/RMQHA OF ANY CORRECTIONS PRIOR TO THE SALE. SALES ENGAGEMENTS, PRODUCE RECORDS AND ALL OTHER INFORMATION SO LISTED AS REPRESENTED BY THE CONSIGNOR, TO WHOM ONLY THE BUYER SHALL LOOK FOR REDRESS IN CASE OF ERRORS OF OMMISSIONS. ELEVENTH – ARBITRATION: 1) ANY CONTROVERSY ARISING OUT OF A CLAIM AS TO SOUNDNESS OR BREEDING ABILITY SHALL BE SETTLED BY ARBITRATION BETWEEN THE BUYER AND THE CONSIGNOR PURSUANT TO THE FOLLOWING PROCEDURE. UPON THE RMPHA/RMQHA’S DETERMINATION THAT A CLAIM UNDER SUCH CONDITIONS OF SALE HAS BEEN TIMELY AND PROPERLY PRESENTED BY THE BUYER PURSUANT TO THESE CONDITIONS OF SALE AND UPON NOTICE FROM THE RMPHA/RMQHA, THE BUYER AND THE CONSIGNOR SHALL EACH SELECT A LICENCED VETERINARIAN ACCEPTABLE TO THE RMPHA/RMQHA. IF SUCH VETERINARIANS FAIL TO AGREE PROMPTLY AS TO THE VALIDITY OF THE CLAIM, THEY OR THE BUYER AND THE CONSIGNOR INVOLVED IN THE CONTROVERSY, SHALL AGREE UPON A THIRD LICENSED VETERNARIAN. IF TWO SUCH VETERINARIANS OR THE BUYER AND THE CONSIGNOR ARE UNABLE TO AGREE PROMPTLY UPON THE THIRD VETERINARIAN, THE RMPHA/RMQHA SHALL APPOINT THE THIRD VETERINARIAN. THE THIRD VETERINARIAN’S FEE, EXPENSES, COSTS, AND SALES COMMISSION SHALL BE PAID BY THE PARTY WHOSE PROPERTY THE HORSE IS DETERMINED TO BE. THE PANEL OF THREE VETERINARIANS SHALL CONDUCT ANY TESTS, INVESTIGATION OR EXAMINATIONS DEEMED NECESSARY, AND MAY, IN THEIR DISCRETION, CONDUCT A HEARING BY NOTIFYING THE RMPHA/RMQHA TO ARRANGE FOR THE HEARING AND SHALL, BY MAJORITY VOTE, DETERMINE THE VALIDITY OF THE CLAIM. THE RMPHA/RMQHA SHALL DETERMINE THE AMOUNT OF REIMBURSEMENT DUE TO A BUYER WHOSE CLAIM IS DETERMINED TO BE VALID AND MAY, IN ITS SOLE DESCRETION, CONDUCT A HEARING TO AID IN MAKING SUCH A DETERMINATION, AND SUCH DETERMINATION SHALL BE INCORPORATED IN THE AWARD. 2) ANY OTHER CONTROVERSY BETWEEN OR AMONG THE BUYER, CONSIGNOR, AND THE RMPHA/RMQHA, OR ANY TWO OF THEM, ARISING OUT OF A CLAIM MADE UNDER THESE CONDITOINS OF SALE OR CONSIGNOR’S CONTRACT, MAY BE SETTLED BY ARBITRATION AMONG THE PARTIES, AT RMPHA/RMQHA’S SOLE OPTION, IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION.
3) ARIBRATION UNDER 1 OR 2 ABOVE SHALL TAKE PLACE IN THE STATE OF COLORADO IN THE CITY AS DESIGNATED BY THE RMPHA/RMQHA. JUDGEMENT UPON ANY AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. THE RMPHA/RMQHA WILL BE ENTITLED TO REIMBURSEMENT FROM THE PARTY WHOSE PROPERTY THE HORSE IS DETERMINED TO BE FOR REASONABLE ATTORNEY’S FEES AND OTHER COSTS INCURRED BY THE RMPHA/RMQHA IN THE ARBITRATION AND ANY RELATED COURT PROCEEDINGS. ANY SUCH CONTROVERSY, CLAIM, DEFENSE OR DISPUTE SHALL NOT IN ANY WAY AFFECT THE ABSOLUTE OBLIGATION OF THE BUYER TO PAY THE FULL PURCHASE PRICE TO THE RMPHARMQHA OR THE OBLIGATION OF THE CONSIGNOR TO PAY THE COMMISSION AS IF SOLD.
