Welcome to this edition of Inhouse. At this stage we are getting closer to our 19th Annual Conference & Expo and the regions are having their AGM’s. This year, with the new board structure, we made a decision to have one of our four board members attend these AGM’s. Our regional committee’s and their presidents are the heart and soul of our Association and I am encouraged by the passion and dedication that these people show voluntarily, particularly striving to get more members to attend these meetings and become engaged. One thing I have noticed is the number of members now selling the Halo Guarantee to other members, which is very encouraging to see. It’s great to see so many of you now posting questions & answers on the NZCB FaceBook page. If you have not been on the page or don’t know much about FaceBook I would certainly encourage you to make the effort to find out. This will help you so much with your business, from finding staff to sharing product issues out there. The best one recently was a bidding war for a builder moving to Auckland!! As we approach our annual Conference & Expo at the end of May, I would like to take this opportunity to

encourage those that are thinking about it, or who have not yet registered, to go for it! What a great opportunity to get away from work for a few days, with your partner, to learn, network with others in the industry and have fun, all paid for by your business. The National Support Office make the event better and better each year, listening to what its members want to cover and what the industry and our customers demand in our ever changing ‘construction’ world. Plus, don’t miss out on the Saturday Night Awards Dinner, a time to unwind from all your learning, with both old and new friends. So, on that note I look forward to seeing you all there.

Message from Operations Determining Like for Like Opinion Piece The role of this Schedule is a practical one, it allows certain work to be performed which if a consent was required, the cost would outweigh the cost and/or benefit of the work to be undertaken. The issue facing most builders and Consenting Authorities is the interpretation which must be applied in determining if work falls inside the parameters of Schedule One. Replacing like for like or “comparable materials” as it’s referred to in the Schedule, is just one test builders often apply when giving advice or establishing replacement. However, there is another test I would like to clarify before I further explain comparable materials. New Zealand Building Code - Durability If the material to be replaced has failed the Building Code, e.g. a window did not meet its 15-year durability requirement, there is a possibility that a “system” failure has occurred. There is no benefit in replacing a failed system with another similar system i.e. comparable material. However, if the product has in fact exceeded its durability requirement under the code e.g. the roof has passed its 15-year durability requirement and has begun rusting out, then it is expected that this product or system has come to the end of its useful life, and can now be replaced without a building consent using comparable material. Establishing comparable materials It would appear this is less about the system and more about the material. Let me explain through a determination issued by MBIE [Determination 2017/004]. The determination had
to establish if the existing asbestos fibre sheets which had come to the end of their serviceable life, could be replaced with plywood and fall under the definition of comparable materials. • The plywood sheets would be used in the same position and in the same configurations as the asbestos sheets, both perform the same function • Both sheet types are readily comparable in size and thickness and use similar installation methods • Plywood is a commonly used cladding material • The asbestos cement sheets and plywood would have comparable in-service condition when assessed under B2/VM1 1.3.2 • The cladding does not contribute to bracing of the dwelling Given these considerations, it was determined the plywood was in fact a comparable material and could be installed without a building consent, even if it meant recladding the entire dwelling. Even though no consent was required, it must still perform to the building code meaning it must be weathertight and durable. To achieve this would require a skilled person i.e. someone who can produce quality without a set of plans and a building inspector checking the work. Protecting New Zealand Inc Schedule One falls outside the Licensed Building Practitioner scheme meaning that anyone who can swing a hammer can have a crack at this work.

The Building Act 2004 acknowledges building work which can be done without a building consent, it’s called Schedule One. • Yes it is critical work • Yes the plywood flashing system can get complicated • Yes weathertightness is considered critical work under the LBP scheme, referred to as Restricted Building Work It is always advisable to check the Council’s interpretation of Schedule One, they have scope to issue a wavier or modification when those marginal calls must be made. This is best applied for before work starts rather than seeking forgiveness and forcing a determination through MBIE. The risk of a complicated regulatory system is when these laws crossover each other at which point law often appears confusing. This determination is an example where best intensions have become outdated and now pose a risk to New Zealand Inc. It’s time to review Schedule One and the LBP Scheme in unison to see how we can better protect our housing stock, and at the same time acknowledge and reward LBP’s who hold the appropriate skills.

Over 295,000 NZ kiwi kids live in hardship through no fault of their own. KidsCan provides food at school, clothing and basic health/ hygiene products to keep these kids clean and cared for.

Build-it Expo
We had a record number of stands consisting of building products and associated info, services and know how! It was a bonus to have thousands of dollars’ worth of many great prizes to be won.
Western Bay of Plenty Certified Builders The Western Bay of Plenty Certified Builders committee has just celebrated its’ 4th annual Build-it Expo! It was our biggest event yet, held at Classic Flyers on the 23rd February. Thanks to all our suppliers and sponsors for turning up and help make it happen. A special thank you to all our committee members, regional coordinator and NZCB support staff, who all went out of their way to make this Expo as successful as it was. I was personally blown away with the attendance this year and the Classic Flyers staff were most helpful.

We had fun with Kennard’s Hire and their challenging digger competition which involved a small excavator, road cones and balls with a bucket for the balls to end up in (some of the time!). It was great to see the serious and some not so serious operators having a crack at it! There certainly were some bizarre facial expressions going on and those expressions carried on at the Noel Leeming stand for those giving their hot lap competition a go! Towards the end of the evening, after a few refreshments, the loot of prizes were given out to some lucky recipients and we managed to present a $1200 cheque to Homes of Hope. We hope that goes some way towards their worthy cause and wish them all the best for their future.

Shane Ririnui Business Development Manager – North Island The NZCB Regional Apprentice Challenges have taken place around the country and I look forward to meeting the successful finalists at the National Carpentry Apprenticeship Challenge Final to be held concurrently with the National Conference in Auckland, 26th – 27th May. I would also like to Mihi (express thanks and acknowledge), ITM for their support and hosting most of the regional challenges at their yards, the ITP’s involved and last and most importantly my South Island counterpart, Nick Matthews.
Haere Ra (farewell) to another successful ToolBox Seminar Series and Haere Mai (greetings) to the upcoming NZCB National Conference & Expo which is to be held in Auckland. This ToolBox Seminar Series (Pre-Contract phase) from my point of view, has been a good topic to deliver and share with NZCB Members and others who attended. Even though some may have thought, “I already know all this” or “we have covered off on this”, the audience did constantly ask questions during and after the seminar and partook in open forum discussions on relevant key points and personal experiences. In all, I believe the majority who attended gained real value from this topic, whether it be learning something new or brushing up on what they already knew. There was re-assurance that they’re moving in the right direction.
I hope everyone is or will be intending to, attend Conference in Auckland on the 26th – 27th May. It’s going to be a great weekend of education, networking, fun and more fun! Be sure to get along and support the apprentices while they partake in the Challenge and Mitre10 Great Apprentice Race. If its anything like last years, you will enjoy it! Membership on the up! Membership with NZCB continues to increase. New membership for both Business and Individual categories have risen from this time last year and is in no small part due to the Halo 10-year Residential Guarantee Insurance product as well as other great services we offer our members. Having just completed the first NZCB ToolBox Seminar Series for the South Island, conversations held around Halo, its benefits and the sleep easy cover provided were well received by attendees. Many NZCB members joined in and endorsed Halo, which was great as those potential members who came along to the Seminar could see and hear about the definite advantages it offers to their business and clients alike. I base the amount of Membership applications being uplifted by attendees at the end of a Seminar as a gauge, recently the holder has been cleaned out and I’m having to re-stock my supply after every session. While this isn’t very scientific, it does show the interest in NZCB and the support and services we offer to our members, is in demand. During the Tasman leg of my travels, NZCB Chief Executive, Grant Florence joined me on the road, which was great! Both Grant and I attended the Nelson AGM & ToolBox Seminar which was well patronised by local members. Over the following few days we took the

opportunity to call in and visit NZCB members in the Tasman region, conducted some ITAB work with the local Polytechnic (NMIT) and hosted a TBS in Motueka and Takaka. Now that the first TBS Series has come to a close, regional AGM’s held and appointments to office finalised, it’s time to look forward to the 19th Annual National Conference & Expo in Auckland on 25 – 27 May 2017. This is shaping up to be a great event with plenty of learning and professional development for all who attend. Look forward to seeing you there!

NZCB Toolbox Seminars Our first round of Seminars (Pre-Contract phase) generated some good discussion points, here are a few common questions from the floor. “Is it ok to include my Disclosure Statement with my quote?” Quote time is a good opportunity; the builder can explain the contents of the quote along with the Disclosure Statement, which should also read as a value proposition to the project. It’s also prime time to remind the client there are still cowboys operating who choose to avoid the checklist and disclosure requirements. “I’m not so hot with submitting my LBP points online, is there an alternative?” Yes, practitioners can still submit points via a paper based system, do this at the time of paying the annual fee. To find links to both the paper based and online system navigate to the Licensing tab within the Member’s ToolShed.
“How do we formally capture the fact that the Checklist and Disclosure Statement have been handed on to the client?” The Association’s suite of building contracts capture this. By virtue of signing the contract the client declares the builder has supplied, and that the client has received, the Checklist and Disclosure as a condition of Part 4A of the Building Act. What you need to know about notifiable incidents and near misses The definition of “notifiable event” in the Health and Safety at Work Act 2015 (HSWA) includes “notifiable incidents”. A notifiable incident is defined in the HSWA as an unplanned or uncontrolled incident in relation to a workplace that exposes a worker or any other person to a serious risk to that person’s health or safety arising from an immediate or imminent exposure to:
• an escape, a spillage, or a leakage of a substance; or • an implosion, explosion, or fire; or • an escape of gas or steam; or • an escape of a pressurised substance; or • an electric shock; or • the fall or release from a height of any plant, substance, or thing; or • the collapse, overturning, failure, or malfunction of, or damage to, any plant that is required to be authorised for use in accordance with regulations; or • the collapse or partial collapse of a structure; or • the collapse or failure of an excavation or any shoring supporting an excavation; or • the inrush of water, mud, or gas in workings in an underground excavation or tunnel; or

• the interruption of the main system of ventilation in an underground excavation or tunnel; or • a collision between 2 vessels, a vessel capsize, or the inrush of water into a vessel; or • any other incident declared by regulations to be a notifiable incident for the purposes of this section.

So what’s different to before, you may be asking. The difference is “serious harm” is no longer required - if the incident exposes the worker to “serious risk” to their health and safety arising from the incidents listed above, then it will be notifiable. Take a construction site, for example. A worker is working at height, and accidentally knocks his or her hammer off the scaffolding just as another worker is walking past. The hammer hits the ground just in front of the worker. Or, in the case of a digger worker digging trenches and accidentally rips into a gas pipe or an underground power line. In both scenarios, no serious harm is done to the worker or those around him. But the driver and the worker walking past the scaffolding have both been exposed to the risk of serious harm, and therefore both are notifiable incidents. Many incidents that may have been considered “near misses” under the old legislation will now be considered notifiable events under the HSWA. As case law develops, we will have greater clarity of what does and does not constitute a notifiable incident. Because the duty to notify WorkSafe is mandatory and failing to do so is therefore a criminal offence, if you are unsure whether to report a notifiable incident or not, our best advice is to report it. Frequently Asked Questions Q. W hat is the limit on the Halo Guarantee? A. Cover prior to Completion of the Works (i.e. loss of deposit/ non-completion cover) is limited to a maximum of 20% of the Provisional Sum Insured or $500,000 whichever is the lesser. Cover after Completion of the Works (Defects Insurance Period) is based on the final price at the completion of the works unlike many other Residential Guarantee policies which are capped at $1,000,000. Q. I s the Halo Guarantee transferrable? A. Yes, the Halo Guarantee is automatically transferable. The definition of the Building Owner in the Halo policy includes any subsequent owners of the property provided they are registered on the Certificate of Title to the property. Therefore, the Guarantee automatically transfers to any subsequent

homeowners; irrespective of how many times the property changes hands during its 10-year period of cover. The automatic transfer gives the homeowner a great selling point when they put their property on the market as they can promote the fact that their home comes with the balance of the Halo 10 Year Residential Guarantee! It also means that the builder’s Sleep Easy Indemnity Cover carries over for the full 10 years. However, if the new owner or their bank/solicitor wants the policy to be in the name of the new owner, this can be done by requesting that BWRS endorse the policy. Note: there is a transfer administration fee. Q. W hen do I apply for the Halo Guarantee? A. It is important that the application is completed and submitted as soon as possible – ideally before a deposit is taken

or at the same time that the building contract is being signed. The builder is responsible for completing the application (the homeowner will still need to sign it) and sending to halo@bwrs.co.nz. Please pay the premium to BWRS within 14 days of receiving the invoice. The Halo cover does not start until the premium has been paid and late applications may not be accepted. Q. I s the Halo Guarantee mandatory? A. Yes, the Board of New Zealand Certified Builders has adopted a policy that requires all Business Members of NZCB to take out the Halo 10 Year Residential Guarantee on all residential projects that are $30,000 (incl GST) or over. This includes new builds, additions and alterations, labour only contracts and spec builds.
IMPORTANT REMINDER: Please remember to return your Certificate of Practical Completion – this is important because it captures the final contract price which will include any variations to the contract. If the CPC form isn’t returned, the sum insured may be insufficient.

“Slump in orders hits building industry hard” Could we see news headlines like this in just a few years? Hard to believe with the current state of the construction industry, but we all know it is a cyclical business and for every upswing, there is an inevitable downswing. Now is a good time to be thinking about banking some extra profits, investing in improved systems and processes, and building a more proactive marketing system. There is a habit of many business owners in the trades to just take what the market dishes up and accept their fate. “The market is the market”. And as far as promotion is concerned: “I get all my work from wordof-mouth”. That’s great when WoM is working, but what if it isn’t? What’s the back-up plan? Usually there is none. This is particularly true when the market is stronger and the perceived need to generate leads is less. But as the title of this post suggest, how will you handle the next downswing? Putting a pro-active marketing plan in place will help smooth out the usual ups and downs of the construction industry. It may not eliminate them all together, but it will help. It will also improve the QUALITY of lead. Rather than just taking whatever is dished up, by deciding on the ideal work you want and laser-targeting your marketing to that sector, you will be surprised what you will achieve. Alongside a more proactive marketing plan the next area of improvement in your business should be around becoming more efficient in the field. Looking to increase the Gross Profit rate that you achieve from your projects so you can be more competitive in the marketplace, WITHOUT having to just cut your prices.

New Certified Plan Build Underway in Gisborne Character Building are well underway with the construction of the Pūkeko house plan. They have used a rib raft concrete floor foundation which is their preferred floor system and the sandstone roof, fascia and spouting is all in place with the linea rab board taking shape. The aluminium joinery is due to be delivered in the next week which will make it all water tight. Once this home is completed it will become Phill and Penelope’s family home and they intend to use it to show potential clients fixtures and finishing’s to help them sell more Certified Plans in the Gisborne market.

The Perils of Building Inspection Work Over the years, most builders get asked to do inspection work on their friends or colleagues prospective house purchase. Sometimes this is done for ‘’mates rates’’, or for a box of beer, this being the usual currency. Other builders will charge a fee for this service, usually feeling it’s money for jam.

We hear many stories of inspections gone wrong during the course of our daily routine, and here are some of the pitfalls you might encounter if you engage in this type of work. While all builders have the necessary skills to complete house inspection work, most have no idea of what is actually required. For a start, inspections are supposed to be completed to NZS 4306, this being the current standard for building inspection work in New Zealand. The standard outlines the manner in which building inspection work is required to be carried out and what should be included in the inspection. One (true) story that comes to mind is the one where the elderly dad/ex chippy completed a free house inspection on a prospective purchase for his daughter and son-in-law. Dad was getting a little bit long in the tooth so he didn’t bother climbing up on the roof and missed the fact that it was made of corrugated asbestos material and needed replacing. After their new purchase, they realised the roof was leaking and required $25k of professional removal/ replacement. The father was very embarrassed and they all felt terrible. Obviously because they were related, no recourse was taken.

The situation would have easily been avoided by hiring a professional Building Inspector with suitable qualifications to undertake the inspection. In another case (true story), a Licensed Builder completed an inspection for a friend who subsequently went ahead with the purchase. It was later found that the floor was approximately 60mm out of level, and the whole house had sunk on its foundations, requiring major remedial work to correct. In that case the friend took the builder (his now previous friend!), to arbitration and won his case based on the written report the Licensed Builder had provided saying that the foundations were in good condition. As you can see, the arbitrators will have no sympathy for you if you’ve written an incorrect report and provided poor information to a prospective buyer. The builder had charged $650 for the written report, which was subsequently attacked in arbitration as being very poorly prepared. This is another case, which sadly, lead to the end of a long friendship and could have easily been avoided. Hopefully you will now have a small insight into what goes on in the inspection world. What use is a Certificate of Practical Completion? Certificates of Practical completion serve a useful function because they are written confirmation that the builder has reached that particular stage in the project, and has qualified for another progress payment, plus the release of any retentions that are due at that time. For the purposes of the Halo guarantee, it also signals the point in time when the guarantee changes from being a completion guarantee to a 10 year defects guarantee. And it marks the start of the one year period after which the underwriter’s “waiver of subrogation” kicks in (ie. the insurer can’t go after the builder any more). In commercial projects, they are usually signed by the engineer to the project – the expert appointed by the Owner to review the builder’s payment claims and either approve them for payment, or dispute various aspects of them. The engineer to the project is supposed to act fairly and impartially, and the builder usually follows his directions. It is logical that certificates of practical completion be signed by the engineer, because the certificate is simply a confirmation by him that the builder has achieved that particular milestone and has qualified for another progress payment plus the release of any retentions that are due at that time.
Often the final sign-off by the Council is used as the de facto date for practical completion. However, whether you have in fact reached practical completion of a project is a matter of judgment, because it depends on the definition of “practical completion”. In our NZCB contracts, it is defined as “both the point in time, and the stage in the progression of the Building Work, when the Building Work is so far advanced that the Building can effectively be used by the Owner for its intended purpose, notwithstanding that certain non-critical or aesthetic features are yet to be completed or minor omissions or defects are yet to be rectified.”
It is not quite so straightforward in residential projects where typically there is no engineer to the project. Instead, the builder simply submits his progress claim to the Owner, and the Owner either approves them for payment, or disputes various aspects of them. There is no neutral third party who serves as a referee between the two of them Consequently there is more scope for argument, particularly since residential owners typically don’t have any expertise in project management, and are much more emotionally involved.
The date of practical completion is, of course, different from the date when the Code Compliance Certificate is issued. On rare occasions the CCC might be issued before practical completion, but usually it is after. In some projects it can be a long time after, for example where the builder has done all of his work but the owner or the owner’s direct contractors still have to complete some work which is required before the CCC will issue, like exterior painting, landscaping or paving. That is why the NZCB contracts say that final payment is due on practical completion, not on issue of the CCC. The date of practical completion is important to the builder because under the NZCB contracts he is then entitled to payment of the final progress payment, and it starts the clock ticking down towards the expiry of his 12 month period of exposure under the guarantee. It is also important to the Owner because he/she is then entitled to possession of the building (in the case of a new build) or possession of the renovated part of the building (in the case of a renovation). It also marks the point in time when the defects notification period commences. So there are incentives for both the builder and the owner to agree that practical completion has occurred. The

IN THE KNOW — certificate of practical completion is useful because it resolves any uncertainty as to when that date might have been, and therefore avoids arguments later. That is all very well where the project has not been controversial and the Owner and the Builder still have a cordial relationship. The Owner will generally be prepared to part with all the money and take the risk that the Builder will promptly finish off the non-critical or aesthetic features and rectify all minor omissions or defects. The situation is quite different, however, when the relationship has deteriorated and a dispute has emerged. In that situation the owner will be determined to hold some money back, and will find a way of taking possession of the building (or the renovated portion), for example by getting the locks changed and physically moving in. Consequently the Owner will have no incentive to sign the certificate of practical completion at all. In fact, from the point of view of the Halo guarantee, he/she would be better off delaying the date of practical completion for as long as possible, because he/she is still covered by the completion guarantee, and it simply pushes out the expiry date of the 10 year defects guarantee.
But it is important to remember that that does not mean that practical completion never happens. Practical completion happens when the building contract says so - in other words when the definition of “practical completion” in the building contract is satisfied. If the parties can’t agree on when that was, then an independent third party such as a judge, arbitrator, adjudicator or Disputes Tribunal referee can give a ruling, based on the available evidence. If a certificate of practical completion gets signed, that is just a record of when practical completion occurred. If one doesn’t get signed, then the ruling issued by the judge, arbitrator, adjudicator or Disputes Tribunal referee becomes the written record instead. Sometimes, the parties never sign a certificate and never get a ruling either. That simply means that practical completion still occurred, it’s just that the precise date will always remain uncertain. The guarantee company doesn’t like that uncertainty, but if there is no certificate and no ruling, there is not a lot the company can do about it other than to choose an arbitrary date, as best it can. It is for those reasons that it is always preferable to get a certificate signed, but life still goes on if you don’t.
In those situations, the certificate of practical completion isn’t going to get signed, probably ever.

Employment Law Strengthening of Employer Compliance Requirements The amendments to the Employment Relations • The new concept of “minimum entitlement provisions” was also introduced. This term is defined in the Act as Act 2000 (“the Act”) on meaning: 1 April 2016 included the introduction of additional provisions relating to the enforcement • the minimum entitlements and payment for those under the Holidays Act 2003; of the new concept of “employment standards”. This term is defined in the Act as meaning any • the minimum entitlements under the Minimum Wage Act 1983; of the following (in summary): • the requirements to: retain a copy of an individual employment agreement or intended agreement; to ensure appropriate facilities and breaks are provided for any employee who wishes to breastfeed in the workplace; to provide a reasonable opportunity for rest and meal breaks; and to keep wages and time records; • the provisions of the Equal Pay Act 1972; • the minimum entitlements and payment for those, and the keeping of holiday and leave records under the Holidays Act 2003; • the minimum entitlements under the Minimum Wage Act 1983; • The provisions of the Wages Protection Act 2983 (re deductions from wages).
• the provisions of the Wages Protection Act 1983. • In essence, the new provisions were introduced to provide for additional enforcement measures to promote the more effective enforcement of employment standards against employers, especially the minimum entitlement provisions. Labour Inspectors now have powers to apply to Employment Court for a declaration, a monetary penalty, or a compensation order for serious breaches of minimum entitlement provisions; and for a banning order in certain circumstances, including where there has been a persistent breach of employment standards. Any person involved in a breach of employment standards can also be liable (for example, a company director, or anyone in a position to exercise significant influence over the management of the entity in breach). It is now unlawful to have insurance for monetary penalties. • Given the much stronger enforcement measures that are now in place, all employers therefore need to ensure that they are complying with the employment standards. It is not uncommon for us to come across situations where an employer has not got around to having an employment agreement, or has not retained a copy of the employment agreement, or has not kept comprehensive and accurate time/wage and holiday/ leave records. All of those examples will now create additional risk for the employer concerned.

This year’s NZCB Apprentice Challenge saw 70 apprentices battle it out against each other and the clock over an 8 hour period, for the right to represent their region at the National Final in Auckland held concurrently with the NZCB National Conference & Expo. The addition of regional events in Central Otago and Taranaki meant more competitors than previous years, which was boosted by Waikato and Hawkes Bay coming back to the Challenge, having not been represented in recent years.

2017 Regional Finalists Northland The Northland regional event was held in the Bay of Islands at the local branch of ITM. Taking out the event was Damian Thompson who works for NPM Construction Ltd. Damian says an apprentice should be honest, punctual and hardworking.
Auckland – North The North Auckland regional event was held at Unitec in Mt Albert and was supported by Dayle ITM. The winner of the event was Matthew Morton who works for TWB Contractors Ltd. Matthew thinks good self-management and the right attitude is what’s needed by an apprentice.
Auckland – Central The Central Auckland regional event was held at Unitec in Mt Alert and was supported by Dayle ITM. The winner of the event was Damian Bouterey who works for Twin Solutions Ltd. Damian believes enthusiasm is the key to an apprentice’s success and that building is a great career!
Waikato The Waikato regional event was held in Hamilton at Thomsons ITM. The winner of the event was Regen Denton who works for M & T Steel Homes Ltd. Regen says an apprentice should have common sense, determination, loyalty and drive towards being an all-round tradie.

Central Plateau The Central Plateau regional event was held at Roberts St Reserve on Taupo’s waterfront and was supported by ITM Taupo. The winner of the Taupo regional event was Tory Hona who works for Building Central Ltd. Tory believes an apprentice should be “keen as a bean” and willing to work overtime when needed.
Hawkes Bay The Hawkes Bay regional event was held at Tumu ITM in Napier. The winner of the event was Dave Wallace who works for Steve Candy Building in Gisborne. Dave thinks an apprentice should have good initiative, be able to listen and possess a strong work ethic.
Taranaki The Taranaki regional event was held at New Plymouth ITM. Taking out the event was Tom Ferguson who works for Adan Larsen Builders. Tom says an apprentice should listen, ask questions if unsure and show up on time. Tom competed in last year’s Manawatu regional event and won it!

2017 Regional Finalists Wellington The Wellington regional event was held at Weltec Trades Campus and was supported by Crighton ITM Seaview. This year’s Wellington winner was Alexander Cholewa who works for Ray Watkins Building Contractors Ltd. Alexander believes an apprentice should be diligent, hardworking and able to find solutions to a challenge.
Nelson The Nelson regional event was held at ITM Nelson. The winner of the event was Andy Wells who works for Tasman Homes Ltd. Andy says an apprentice needs to have a keen attitude to learn, be fit, have a sense of humour and be polite.
Canterbury The Canterbury regional event was held at ITM Dyers Rd in Christchurch. The winner was Sam Scoon who works for Scott Johnson Builders Ltd. Sam believes an apprentice should be able to follow instructions, show up on time and put in a hard day’s work.
West Coast The West Coast regional event was cancelled due to having only one entry, however Alex Hooper who works for Clint Jarvis Contracting in Fox Glacier travelled to Cromwell to compete in the Central Otago event. Alex thinks an apprentice should be able to learn from their mistakes and improve their trade skills over time in the industry.

Central Otago The Central Otago regional event was held at Southern Lakes ITM in Cromwell. Winning the event was Mark Templeton who works for The Builders.co.nz Ltd. Mark says an apprentice should be willing to give everything a go, even if they get it wrong sometimes. Mark competed in last year’s Southland regional event and won it!
Otago The Otago regional event was held at Otago Polytechnic in Dunedin and was supported by ITM Mosgiel. The winner of the event was Chris McLean who works for Just Build It Ltd. Chris thinks an apprentice should do jobs without complaining, be honest when completing their timesheet and have high standards of workmanship.
Southland The Southland regional event was held at E H Ball ITM in Invercargill. The winner was Frederick Michael who works for Kennedy Brothers Building Ltd. Frederick believes an apprentice must be patient, willing to learn and remain positive.

Young builders get to test their skills locally Taranaki building apprentices have been given the power to prove their skills in a new event. The New Zealand Certified Builders (NZCB) Apprentice Challenge saw more than 70 apprentices nationwide demonstrate their skills by constructing a high-spec outdoor table and bench seating within a set timeframe. Apprentices nationwide picked up tools in 14 events held simultaneously in different regions on Saturday. This was the first year Taranaki held the competition. Adan Larsen, NZCB Taranaki regional president, said competitors from his region typically travelled to Manawatu for the event, and was happy to see the competition held in Taranaki. ‘‘I was just lucky to find three apprentices that were willing to put their names down,’’ he said. Contestant Tom Ferguson nailed first place against fellow apprentices Adrian Wyrill and Ethan Bloeman, who placed second and third respectively. Entrants were given eight hours to complete the table design, which included carpentry joints not typically found on basic outdoor furniture sets sold from retailers. The outdoor furniture had to be 1 metre wide and 1.8m in length. It also needed to be made for ‘‘entertaining guests of all ages’’. ‘‘I think this event gives a good confidence boost to our apprentices,’’ Larsen said. Competing could help show apprentices ‘‘where they stand against their peers’’, said Larsen. The three entrants put hammer to nail about 8am Saturday and final judging was completed at 4.30pm. The tables and bench seating will be auctioned and proceeds would be donated to local com-

munity groups, Larsen said. The winners from each region competition go through to the NZCB Apprentice Challenge Final, held at the NZCB Annual Conference in Auckland. The challenge is run by NZCB in association with the Industry Training Association Building (ITAB).

Top apprentice in final A BELFAST apprentice has added another notch to his tool belt after winning the regional section of the New Zealand Certified Builders Apprentice Challenge. Sam Scoon, along with seven other apprentices from across the region, donned their tool belts and safety gear for the test to build an outdoor table and bench seating. Mr Scoon, 20, worked under a fixed timeframe and the final product was judged on workmanship, skill and time management. The challenge tested the apprentices’ attention to detail with carpentry joints not typically included in an outdoor furniture set.

A life changing experience Winning the NZCB Carpentry Apprentice Challenge 2016 was a memorable, humbling and formative experience for me. On top of the recognition from professionals of the building industry, I received amazing prizes including an Outward Bound experience. Prior to this I had never heard of Outward Bound and therefore knew very little about what was involved. After a quick Google search, I learned a little about the history of Outward Bound: it was founded in Wales during the Second World War with the aim to instil values of initiative, tenacity and compassion into young British sailors during the war. Since then over forty Outward Bound schools have been established in more than twenty-five countries and Outward Bound New Zealand has been running courses in Anakiwa since 1962. I would spend twenty-one days doing some outdoor activities in the middle of the Marlborough Sounds. At first I thought, “I’m pretty fit and I do physical work for a living. No sweat, right?” A few short hours after disembarking the water-taxi in Anakiwa, I was covered with mud and on the edge of a cliff, overlooking the Queen Charlotte Sounds. After a cold plunge, I was rewarded with an even colder shower; ‘Hillary Watch’ (as my group was known) were informed this would be our only shower of the day. During my Outward Bound experience I ran, hiked, climbed and sailed in beautiful, majestic surroundings. Our penultimate challenge was a thirteen-hour trek in the Richmond Ranges and we ended our three weeks with a half-marathon along the Queen Charlotte Track. The opportunities to test my limits and form lifelong friendships was worth the physical, and sometimes mental, strain. Outward Bound was a chance for me to challenge and learn about more myself. It was a real break - a time to disconnect to reconnect. I came back a stronger man, more focused on the things that are really important to me. I can tell today that Outward Bound is a school of life and I deeply encourage anyone to take up the challenge. During my time in Anakiwa, I heard a quote from William Shedo that I found very inspirational: “A ship in harbour is safe, but that is not what ships are built for.” I am willing to try new experiences even if I have to get out of my comfort zone, even if I fail - I tried and would have learnt something during the process. I would like to thank New Zealand Certified Builders Association that allowed me to have this experience, one that will be with me for a very long time.

Tom Walsh - Brand Ambassador You may recall from previous editions of InHouse and if you’re a Facebook user who subscribes to the ITAB page, that Shot Put Champion & Olympic Medal winning athlete, Tom Walsh recently became our ITAB Brand Ambassador! Tom, a former ITAB apprentice himself was happy to lend his name and growing public profile to increasing the awareness of the ITAB Apprentice Training Programme to employers and apprentices, as an alternative pathway to obtaining a National Qualification in Carpentry. Recently in Christchurch on a building site supplied by NZCB member, Pat Coughlan of Coughlan Construction, Tom met with our Creative Agency, WAVE to capture some imagery of him “training on site”. It was a good day out (away from my desk) with the end result being three awesome images of Tom to be used for promoting ITAB. Future of the economy Trying to get a read on the future of the economy is about as easy as interpreting the weather forecast sometimes – in two articles from one publication this week I read of firstly an anticipated drop-off in construction activity, yet secondly a forecast need for 100,000 more homes in Auckland in the next 10 years. It would seem that even taking into account the odd dip in economic activity, there’s plenty of work ahead in this very rewarding industry. The major focus for ITPs and the regional NZCB committees recently has been the 2017 NZCB Carpentry Apprentice Challenge. This year, for the first time all the events around the country were held on the same day, and as a key sponsor of the event the AST took a keen interest in goings-on. ITM has joined the event as a key partner and sponsor, and if you’d visited one of the many locations around the country on 8th April you would have seen apprentices battling for top honours. A record number of entries were received this year, and we will see the 15 regional winners compete at the National Final on 26th - 27th May in Auckland.

The National Final is held as part of the NZCB Annual Conference & Expo, allowing the finalists an opportunity to be part of the conference, and delegates to see the industry leaders of the future perform on a national stage. Future of the economy New rules for protecting retention money came into effect on the 31st of March 2017. These require developers and head contractors to hold “on trust” any retention money they’ve withheld from their subcontractors. This on trust obligation, which only applies to commercial contracts, means the head contractor must hold that retention money in the form of cash or other readily convertible liquid assets, making it easier, in theory, for subbies to reclaim this money if the head contractor goes bust. However, the legislation was not clear about whether these obligations only applied to new contracts entered into on or after 31st March, or in fact applied to any contract in place at that time. A new amendment is now working its way through Parliament to clarify that only contracts entered into (or renewed) on or after 31st March will have to comply with these new on trust rules.

The select committee also recommended an additional amendment to the Construction Contracts Act. This amendment will allow developers and head contractors to obtain an insurance-backed bond to cover the retention money they hold. So, if the head contractor failed to pay back retentions the subcontractor could claim them directly from the insurer. This benefits the subcontractor because they have a guarantee from a third party (the insurer or a bank) that they will get their money. It also benefits the head contractors because it means they don’t need to hold the retention money on trust, so they can use it and account for it within their business however they wish (as long as their insurance bond is enough to cover all the outstanding retentions they hold at any given time).

There is also another option, which is that the head contractor doesn’t demand retentions in the first place, or accepts a bond in lieu of retentions (a retention bond) from the subcontractor instead. This benefits the subcontractor because no retentions are withheld in the first place, so there is no danger of losing them, and they get paid in full. However, a premium would be payable on each bond. It also benefits the head contractor because they have no on trust obligations. The drawback for them is that they can’t use retentions as a form of revenue to cashflow their business (which is not good practice anyway). Retentions bonds are available now and readily accepted as part of most major construction contracts. Finally, the Act says MBIE can set regulations specifying the minimum amount of retentions to which on trust obligations will apply. They have decided that there will be no minimum, so main contractors must hold all retentions on trust, no matter how small an amount it is.
In a nutshell If you’re a subcontractor that has retentions withheld, for any new contracts from 31st of March your head contractor must hold these retentions on trust, which means they have to account for them in cash or other readily convertible form. If proposed changes pass, the head contractor could insure the retentions they hold instead of holding them on trust. A subcontractor can provide a retention bond instead of having cash retentions withheld in the first place, so they get paid in full and there’s no risk of losing their retentions.

From the Chief Executive Our 2017 AGM and Annual Conference is looming upon us very fast. If you have not yet registered I would urge you to do this, as we have a great line up of speakers and educational workshops. As 2017 is election year we have also had indicative positive responses from the Leaders of our key political parties to join us at the Conference. It will be interesting to hear what they have to say (and promise?) about our industry going forward into the next 4 years. Progress continues with our new home in Tauranga, being the new office for National Support Office. The team at Hawes Building Solutions (local Western BOP NZCB Members) – who we appointed as Head Contractors for the project, are making excellent progress and we are still on track for completion late June. We will feature the office in InHouse (and online) once it is complete. As always, if ever you are in Tauranga (on business or pleasure) please drop in to see the new offices and meet the team at National Support Office, you are always welcome.
A quick plug for the new Health Insurance scheme we have arranged with nib and Advice Financial. This scheme has a number of very unique benefits for our members, their families and employees. We all have different views on insurances, but in times of acute shortages of skilled trades and the need to build and receive staff loyalty, this scheme has a range of different ways that you can reward your employees, thus building on other loyalty measures you may have. We have had outstanding support from a range of material suppliers and we will feature these suppliers at Conference and also as we celebrate the completion of the project. It will be great to thank them publicly for their support of the Association and our members.
Following on from last year’s nil increase in fees, the Board of NZCB decided to have a small increase in membership and ad levy fees this year, by an overall 5%. We have also taken the opportunity to rearrange some of the membership bands and the fee relativities between them this year. I sincerely still believe this is great value for money and I encourage all members to use the services that are available.
Our drive to increase the take up of Halo - the 10 year residential guarantee insurance (including the significant real direct benefits for our members) and for our members to adopt our new branding continues. The former is to consolidate the Boards decision to make this mandatory for all members to have a Halo guarantee on all residential jobs (new and alterations) over $30,000 and now that the launch of our brand is more than 12 months old we are now actively encouraging our members to move to the new branding on signs, business documents and vehicles etc. The sooner we all are looking as one, the quicker the brand will gain greater strength.
