IF YOU THOUGHT 2021 would start off on a positive note, think again. President Donald Trump made sure that the new year would not diverge from the issue at hand: His unfounded, incredible allegation that the election was stolen from him. The evidence suggested otherwise, and most of America had already moved on. City & State joined many other news organizations in pointing out that this president is a liar, a desperate opportunist holding on to power as it started to slip away from his fingertips. Trump told supporters to make their grievances over a bogus, stolen election known to congressional leaders, as they affirmed President-elect Joe Biden’s Electoral College victory to make him the next president of the United States. Congress extended its session into early Thursday due to the delay caused by rioters who stormed the U.S. Capitol with an unclear purpose, except to say that they did what they did, because they could. Seriously? It makes a person wonder. Ultimately, our republic survived. What a great relief. It will take months, if not years, to heal from this exercise in democracy. But it was worth it. City & State’s latest issue introduces our newest state lawmakers, many of whom are going to make their mark in this post-Trump era. Despite the unrest, it’s a time for fresh ideas and we have newbies who believe they have the answer, offering hope that New York and our country have a better future ahead.

The nation watched in shock as pro-Trump rioters stormed the U.S. Capitol, interrupting Congress’ electoral count.
TRUMP MOB STORMS CAPITOL
As members of Congress convened on Jan. 6 to certify the election of President-elect Joe Biden, a band of Trump supporters broke into the U.S. Capitol and forced senators and members of Congress to evacuate and hide, delaying the final vote for hours. It left at least five people dead, including a U.S. Capitol Police officer. Thousands of Trump supporters, including at least some displaying Nazi
symbolism, Confederate flags and other white supremicist iconography, came to Washington to protest the certification of the election based on false claims of voter fraud perpetuated by Trump and other elected officials. Trump issued two initial responses to the violence that were riddled with lies and equivocations that not only failed to call out the extremists for their criminal acts but deeply sympathized with them, saying “we love you” to the insurrectionists.
Twitter and Facebook later removed both messages for violating their rules and temporarily banned Trump’s accounts. The attempted coup drew widespread condemnation of the president by those who observed that his rhetoric led to the violence at the Capitol. Several top administration officials and staffers have since resigned. And Democratic lawmakers are calling for Trump’s immediate removal from office. Both House Speaker Nancy Pelosi and U.S. Senate Minority Leader Charles Schumer called on Vice President Mike Pence to invoke the 25th Amendment to remove Trump from office immediately. Democratic House members have also drawn up new articles of impeachment, which Pelosi said could be voted on in the coming days.

After the Capitol was secured, members of Congress returned to finish certifying Biden as the next president. Several Republican lawmakers who had previously

planned to object to electors in battleground states that Trump lost reversed course in light of the violence. In the end, lawmakers only voted on objections to Arizona’s electors – which was objected to prior to the insurrection – and Pennsylvania’s electors. A large number of Republicans still voted against certification, including the majority of the House GOP conference. Among them were New York Reps. Elise Stefanik, Lee Zeldin, Nicole Malliotakis and Chris Jacobs. Despite the chaos just wrought by the dangerous and false narrative Trump has been pushing about the integrity of the election, all four stuck with their objections, defending the decision by continuing to parrot debunked claims of voter fraud and the need to restore faith in the electoral process. They were condemned by many of their Democratic colleagues in the House as well as in editorials in local papers. Only Republican Rep. John Katko, who did not object to any states, has publicly condemned Trump for inciting violence. He even suggested that he is open to the idea of impeachment.

first case of the new, more transmissible coronavirus variant wreaking havoc in the U.K. Health officials discovered the variant in upstate Saratoga Springs in a man who had not recently traveled from the U.K., although Gov. Andrew Cuomo later suggested that contact tracing revealed a potential U.K. connection. Cuomo, as well as public health officials, warned that the variant is probably much more widespread than we know.
VACCINE ROLLOUT CONFUSION CONTINUES
The state’s COVID-19 vaccine rollout continues to be painstakingly slow, with Cuomo announcing plans for unions to administer the shot to their members and New York City Mayor Bill de Blasio opening new pop-up vaccination sites. The governor also announced that next phase of the rollout begins Monday, which opens the shot up to transit workers, teachers, police, firefighters and people over 75. Cuomo focused his criticism on shortcomings

by hospitals and local leaders to get vaccines in people’s arms. He said that if hospitals don’t pick up the pace, they will have to send back their vaccine supply. The governor is focusing much of his attention on New York City and its public hospital system. De Blasio and members of his administration, meanwhile, laid the blame on Cuomo, asserting that the strict guidelines about who can get vaccinated in the first phase is preventing them from moving more quickly with unused doses. Confusion ensued after de Blasio said that the state would allow certain members of the NYPD to get vaccinated, only to have Cuomo contradict that statement. Eventually, he relented and allowed localities to begin vaccinating a larger pool of people. County leaders are also criticizing the state, saying that their long-standing mass vaccination plans are being ignored to the detriment of their citizens. After weeks of criticism, the Cuomo administration told county officials that they will play a larger role in the rollout moving forward.

What an ascendant Schumer means for New York U.S. Sen. Charles Schumer is poised to become the most powerful person in the Senate now that Democrats won two runoff elections in Georgia. “For too long, much-needed help has been stalled or diluted by a Republican-led Senate and President Trump,” Schumer said Wednesday. “That will change with a Democratic Senate, Democratic House and a Democratic president.” The ascendance of Schumer to majority leader could mean billions of dollars in new federal aid to address the economic damage wrought by the pandemic. It also provides a dose of political energy for state Democrats as they convene for the 2021 state legislative session. “It’s really feeling like this country is about to get a fresh start,” first-term state Sen. Samra Brouk tweeted. “Buckle up,” Schumer added Wednesday morning, when he spoke with House Speaker Nancy Pelosi. The 2021 legislative session looks likely to be a contentious one for the governor and New York’s legislative leaders. The state faces a multibillion-dollar budget deficit. Millions of people are hurting from the struggling economy. Vital infrastructure like the New York City subway system seemingly is either on the brink of historic decay or revival. The governor has argued that negotiating tax increases should wait until after it becomes clear whether additional

aid is coming from a Democratically controlled Washington. More federal money would also mean less new revenue would be needed to close the budget deficit while funding political priorities like public schools and health care. Cuomo has said he would push off unveiling his budget plans for a week. “I have to rewrite the State of the State,” Cuomo said Wednesday, with just a few days to ponder how the Georgia results will affect his ability to address the deficit. Dealing with a fellow Democrat undoubtedly beats working with Senate Majority Leader Mitch McConnell, who Cuomo has accused of waging economic war on the Empire State. “It’s been devastating for the state,” Cuomo said Wednesday. “They have used New York as a political piñata.” Yet Schumer has been a longtime rival of the governor’s for the political spotlight. “Gonna need a live shot of Andrew Cuomo realizing he’s going to have to treat Chuck Schumer with reverence,” Ben Max of Gotham Gazette tweeted. New power also means expectations are higher than ever for what Schumer should be able to get done. “We get to say goodbye to Mitch because we won Georgia,” state Senate Majority Leader Andrea Stewart-Cousins said in her opening remarks of the 2021 session. “Chuck, we need you.” – Zach Williams

KEVIN RILEY
What are your thoughts on the reduction to the NYPD budget approved last June? Would you have voted “yes” on that budget? I think a little bit more could have been taken away from the NYPD to reallocate within our other city agencies. And I possibly would not have voted “yes” for that budget. But this is going to be my first time doing the budget this year. So I do have to find out how the process goes, and see how my voice could bring back more resources to my community.
You won the special election for Council District 12 in the Bronx to replace Andy King on Dec. 22 and were sworn in Wednesday morning, but you’re up for reelection this year already. Do you expect to have a serious challenge? Of course. We have so many amazing people in our community that want the position to advocate and bring resources back to our community. So I’m pretty sure that we’re going to have some dope people wanting to be candidates and run against me, which I have no problem with. This is a democracy and we all have the best interest of our community at heart.
Do you have any bills you want to introduce? I want to focus on a resolution that encourages the Department of Health and the state to educate communities, especially communities of color, on vaccination. We do want
kind of scared because they feel like they aren’t properly staffed, they don’t have proper (personal protective equipment). Also legislation to focus on education. I am a remote educator now. My fiancee, who’s an essential worker, has to go to work every day. So I’ve been home educating my daughters and running my campaign at the same time. And it’s very challenging for the students, mentally, and it’s very challenging for the parents, mentally. So I want to put in a mental health aspect in finding out how the remote learning and this pandemic is going to interfere with our children and our families.

THIS IS WHAT HAPPENS New York Republicans lied. Then they were surprised the rioters believed them. By Ben Adler

OR TWO MONTHS, New York Republicans have lied to the American people: Without evidence that would hold up in any court of law, not even one with a partisan GOP judge, they claimed that some sort of fraud had been perpetrated in the recent election that President-elect Joe Biden won by more than 7 million votes. And then, Wednesday, when their misinformed followers stormed the U.S. Capitol build-
ing, shattering windows, firing weapons and attempting to take control of the federal government by force, they acted surprised. Reps. Nicole Malliotakis, Elise Stefanik, Chris Jacobs and Lee Zeldin said they would object to certifying electors in key states Trump lost, but then issued statements opposing the riot. Long Island Rep. Andrew Garbarino was too cowardly even to say how he would vote. Reps. Tom Reed and John Katko were the only Republicans in the state who

Insurrection might be appropriate if the election were stolen, but Republicans aren’t defending it, because they know it wasn’t.
said they would vote to certify the election without any objection. President Donald Trump, who has been attempting to get the election result overturned by every other means at his disposal, posted a video simultaneously saying that the election result was fraudulent and that the protesters should go home. These are somewhat contradictory claims, and no one who encouraged this attempted coup should be allowed to pretend that they didn’t.
If the election really were stolen, armed insurrection might actually be an appropriate response – a defense of democracy, rather than its downfall. So why aren’t Jacobs, Malliotakis, Zeldin, Stefanik, Trump and his henchman-lawyer, former New York City Mayor Rudy Giuliani, defending the violent coup attempt? Because they know the election wasn’t really stolen. They have stoked their base’s anger, its resentment at being outvoted by a more diverse
America, for their own political advantage and, in some cases, personal profit. They did so on the assumption that no one would actually be so foolish as to act on the clear implication of their own words. Well, some people did, and it’s the responsibility of those who led them to this point. Truth be told, it’s the responsibility of every Republican who indulged Trump all along. Those who voted against impeachment sent the message to Trump that there would never

be any consequences for his unpatriotic and anti-democratic behavior. Stefanik rose to national prominence as a manager of Trump’s impeachment defense. What sort of American defends the president for attempting to extort foreign interference in an election on his behalf? That too was an assault on American democracy, even if it took place without chaos at the Capitol. As disturbing as Wednesday’s events are, they are really no different from what Trump and his supporters already have done. Trying to retain power after losing an election through nonviolent means, whether it’s frivolous lawsuits or bullying state officials to alter the result through the threat of extortion, is also an attempted coup. When Reps. Stefanik and Zeldin signed on to Texas’ suit asking the U.S. Supreme Court to throw out the votes in decisive swing states – even ones in which local Republican officials affirmed there was no fraud – they were attacking their fellow citizens’ voting rights. Trump lost 61 of 62 lawsuits, winning only one to limit the number of days after the election that an absentee ballot could be counted in Pennsylvania. He lost every recount. Every independent authority that assessed his claims of election irregularities found them to be baseless. And yet he and his minions kept refusing to admit the truth. If you tell your supporters that Trump really got more votes, why wouldn’t you expect them to act accordingly? Wednesday morning, at a rally in Washington, D.C., Giuliani endorsed “trial by combat” and Manhattan native Donald Trump Jr. told members of Congress who didn’t sign on to his father’s attempt to seize power: “We’re coming for you.” These people are as guilty of sedition as the marks for their con; as guilty as the mob boss who orders the hit and as much a threat to the republic as any since the Confederacy.

EMOCRATS CAN CLAIM MANY firsts among the newly elected members of the state Legislature. Jabari Brisport of Brooklyn is the first openly gay Black man elected to the state Senate. Zohran Mamdani and Jenifer Rajkumar, both of Queens, are the first South Asian Americans elected to the Assembly. Fellow freshman Khaleel Anderson of Queens, 24, is the first member of Generation Z to serve in either chamber. Two other Democratic firsts also loom large following the 2020 elections. State Sen. Samra Brouk of Rochester, who now holds the seat vacated by retiring GOP state Sen. Rich Funke, is the first Black female state senator elected upstate. Voters in an adjoining district chose state Sen. Jeremy Cooney, who now holds the seat formerly occupied by retiring GOP state Sen. Joseph Robach, as the first Asian American state senator from north of New York City. Brouk and Cooney represent progressives’ new dominance in some areas of the state that historically sent Republican white men to Albany. These newly elected legislators are part of the supermajorities – now in both chambers, with Democratic pickups in the state Senate – that could allow Democratic legislative leaders to override gubernatorial vetoes

in the future. Women and people of color now make up a one-person majority in the 63-member state Senate and exactly half of the 150 members of the Assembly – a notable change from recent years when white men made up clear majorities of both chambers. A City & State questionnaire sent to all 44 new members of the state Legislature offers some insight into who comprises the new class of state lawmakers at a time when the state has been ravaged by a deadly pandemic and its economic effects. They each bring qualities and experiences that add something to the legislative mix. The legislative lineups highlight the demographic differences between the two parties. All of the Black, Latino and Asian American state senators are part of the 43-member state Senate Democratic majority. All of the Assembly members of color are also Democrats, while the all-white 43-member Republican delegation reflects the predominantly white rural and suburban parts of the state from which they mostly come. Losing five upstate Senate seats to the Democrats in 2020 leaves the GOP with fewer suburban and urban areas of the state to represent a little more than two years after the Democrats won the chamber for the first time in a decade. The new members vary in political experience. Some among them, like newly elected state Sens. Sean Ryan of Buffalo and Dan Stec of the North Country, have previously served in the Assembly. Others previously worked as staffers to elected officials. Assembly Member Sarah Clark of Rochester has worked for U.S. Sen. Kirsten Gillibrand and Elijah Reichlin-Melnick of Rockland County most recently served as a staffer to state Sen. James Skoufis, who represents an adjacent district in the Hudson Valley. Republican Assembly Member Michael Lawler of Rockland County has served as a deputy town supervisor. His new Democratic colleague, Kenny Burgos of the Bronx, was the budget director for the New York City Council. The legislative process often reflects the policy expertise that legislators bring from their past careers. Incoming legislators include attorneys, military veterans, entrepreneurs, nonprofit executives, public school teachers, activists and former law enforcement officers, including some pretty unique combinations of professional and personal experiences among their ranks. Republican Assembly Member Joe Angelino of Central New York is a former police chief, fire chief and U.S. Marine, all in one. His new Assembly GOP colleague Jeff Gallahan of the Finger Lakes once worked as a trained machinist. The new Democrats across the aisle include the Ugandan-born
Mamdani, whose résumé includes stints as a foreclosure prevention counselor and as a hip-hop performer named Mr. Cardamom. Republican state Sen. Peter Oberacker of Central New York – a businessman and former town board member who learned charcuterie from his German-born father – is likely the first modern-day legislator with firsthand knowledge of how sausage is literally made. New members also come from across the political spectrum. This includes a half-dozen new members of the Assembly who want to push the chamber further to the left than the liberal white men they beat during the Democratic primaries. Jessica González-Rojas of Queens and Emily Gallagher of Brooklyn are two examples of left-leaning first-term legislators who support raising taxes on the wealthy over the objections of the governor. Some swing-district Democrats who flipped historically Republican seats in 2018 and 2020, however, are urging a much more conservative approach to plugging the multibillion-dollar budget hole facing the state. The new Democratic supermajorities guarantee that Assembly Speaker Carl Heastie and state Senate Majority Leader Andrea Stewart-Cousins (the first Black man and Black woman to lead their respective chambers) will be calling the shots in the state Legislature this year, but they will be challenged by their own intraparty divisions: Moderates from the New York City suburbs and parts of the outer boroughs now have to contend with an increasing number of democratic socialists and other left-wing lawmakers. New members from upstate also add a new geographic dimension to the tension between New York City and suburban Democrats in the state Senate. A multibillion-dollar deficit, a deadly pandemic and a three-term governor pushing his own vision for the state will challenge the majority conferences in the coming months. While it remains to be seen how the new state lawmakers will respond legislatively to these dynamics, the 2020 elections suggest a variety of new voices will try to be heard. And they all have the same amount of time to show their constituents what they can do in office before the campaigning begins anew in 2022. That will give Democrats like Brouk plenty of time to prove what a difference they can make in the halls of state power. “I am focused on ensuring that all voices are heard and represented,” Brouk told City & State of her top priority in office. “That means consistently reaching out and building trust across the vast district, in urban, suburban and rural communities.”

It’s the beginning of the month, and the Bills are due … for their first playoff win since 1995! Gov. Andrew Cuomo has a fever … football fever! So pandemic be damned, he’s moving heaven and earth to help people watch Buffalo’s NFL team in-person, even if thousands of fans don’t want Cuomo to be there with them. Check back this week to see if the Bills end up winners or losers – and then in another two weeks to see if anybody caught COVID-19 at the game.

2020 was a dumpster fire of a year, but state lawmakers got together one last time to give tenants some good news on the tail end. After weeks of negotiations, the Legislature held a special session to pass their eviction moratorium law, lauded as one of the strongest eviction protections in the entire country.

Off to the virtual races: Cuomo is finally going all-in on mobile sports betting – a big win for these lawmakers, who have sponsored bills to legalize online wagering.
You might have thought that nine months into a devastating pandemic, the vaccine would get an efficient rollout. You’d be wrong. Only a fraction of doses available in New York have been used. And Cuomo is blaming everybody but himself.

While Northwell Health was vaccinating New Yorkers against COVID-19, the health system was also sucking their blood, as the only major hospital chain still suing patients over unpaid bills during the pandemic. After the Times called them out, President Michael Dowling – a Cuomo confidant – publicly reversed course.
