LAST WEEK, GOV. ANDREW CUOMO distributed a poster with a “Ship of State” sailing on “The Sea of Division,” navigating between “The Reefs of Greed” and “The Squalls of Hate” while facing monstrous threats, such as an octopus labeled “Intolerance,” a squid of “Government Incompetence” and a sea monster of “Bigotry.” The illustration, with Cuomo at the top as New York’s progressive champion, was modeled on a campaign poster from William Jennings Bryan’s 1900 presidential campaign. Apart from bringing back an old-fashioned artistic style, Cuomo may have wanted to evoke Bryan’s status as a progressive leader – but a more apt analogy can be drawn with another politician of that era: Theodore Roosevelt. Like Cuomo, Roosevelt cultivated an image as a rugged, can-do individual. Both New Yorkers coined self-serving slogans, from Roosevelt’s “Square Deal” to Cuomo’s “Making Progress Happen.” Both had progressive rivals and, arguably, shifted leftward over time. What’s more, Roosevelt is widely considered the first modern president, in part due to his innovative use of the “bully pulpit” to shape public opinion and manage the media – a practice that’s commonplace today. In this week’s magazine, we examine Cuomo’s spin that New York is No. 1 and highlight the state’s top professionals in political public relations – a field that got its start with Roosevelt.

Several top Democratic leaders opened the door to making changes to the state’s new bail reform law, which has come under scrutiny in the wake of a string of anti-Semitic attacks. Cuomo said that the law is a “work in progress,” while state Attorney General Letitia James called on legislators to revise the law. State Senate Majority Leader
Andrea Stewart-Cousins didn’t go quite as far, but in a notable shift, she opened the door to revisiting and potentially revising the law, which eliminated bail in some cases. She later said that her conference is aware the law may need some “tweaks.” Assembly Speaker Carl Heastie, on the other hand, said that he had no intention of changing bail or any other criminal justice reform approved last year. He
even allegedly disinvited New York City Mayor Bill de Blasio from a State of the State reception because de Blasio had called for more judicial discretion. Heastie denied that allegation.

WEINSTEIN FACES RECKONING Since 2017, disgraced Hollywood producer Harvey Weinstein has seen a mountain of blowback in response to dozens of sexual harassment and assault allegations. Weinstein began his legal reckoning last week in Manhattan, where District Attorney Cyrus Vance Jr. came under scrutiny for not prosecuting him in 2015. On its Tuesday cover, the Daily News featured Weinstein limping into the courthouse, referring to the ex-producer as a “pig in a poke.”

while drunk on New Year’s Eve, his fellow Republicans chose a new leader: William Barclay. Kolb left the post open right as lawmakers were preparing to head back to Albany. So the day before the start of the legislative session, Assembly Republicans sat down and made sure their conference had someone in charge. They decided on Barclay, the former deputy minority leader, to fill the role. It’s an abrupt change after more than 10 years with Kolb at the helm. Barclay said that a week ago, he would have never expected to be where he is today.
THE LONG ISLAND TWO?
Republican state Sen. Kenneth LaValle announced that he won’t seek reelection, bringing the elder statesman’s 44 years in Albany to a close at the end of the year. LaValle’s retirement opens up one of just three remaining GOP state Senate seats on Long Island, where the party used to have a stronghold referred to as the Long Island Nine. Republicans lost two seats and became the Long Island Seven in 2016. Then in 2018, Democrats won four more seats, unofficially becoming the Long Island Six. Several Democrats had previously announced runs against LaValle, and no Republican has publicly expressed interest in the seat or been tapped as a successor.

HELPING RESCUERS BRING A FAMILY OUT OF A FLOODED AREA
LIKE A MODERN-DAY HERCULES, Gov. Andrew Cuomo helped pull a passenger from a car wreck on the Brooklyn-Queens Expressway last week – along with several other emergency responders. As Cuomo was heading down the highway, he spotted a van tipped over and decided to pull over and channel his inner He-Man. While multiple trained professionals showed up at the scene of the accident, in which no one was harmed, Cuomo decided to burnish his reputation as a man of action. But this isn’t the first time the governor has flexed his “heroic” abilities. Cuomo has a knack for ending up in the right place at the right time when it comes to minor accidents and emergencies – and if there’s no camera nearby, his aides have one on their phones. Here are just a few previous examples of the governor coming to the rescue. Sort of.
HELPING A DRIVER OUT OF A SNOWBANK
After a powerful storm in Dolgeville resulted in flooding in November, one family was nearly dragged away by the stormwater. Luckily, a team of rescuers were able to pull them to safety – with Cuomo offering some minor assistance, in a noble yet unnecessary move.
In 2017, Cuomo came upon a driver stranded in a snowbank on the Sprain Brook Parkway. The governor took it upon himself to hook a cable to the car to pull it out. We’d like to mock this incident – and his affection for crisp khaki slacks – but the former tow truck driver actually proved to be quite helpful in this particular instance.

A Q&A with Assembly Minority Leader William Barclay
NEW YEAR’S PROMOTION Assembly Republicans knew they were going to need a new leader in 2020 after Assemblyman Brian Kolb allegedly drove his state-issued SUV into a ditch on New Year’s Eve. Fellow upstate Assemblyman William Barclay presented himself as a candidate for the role. After a frantic weekend of phone calls and underthe-radar politicking, Barclay emerged as the new leader for a GOP minority conference that has struggled to translate its political messaging into legislative achievement in the Democratic-dominated chamber. Whether Barclay can change that dynamic – while also keeping up with his job at the family law practice – remains to be seen.
So what’s it like to become minority leader? I never knew I would become leader. I had some interest in it and I don’t think that’s a secret, but it wasn’t the way I envisioned becoming leader. It’s been such a short time span. It’s been very busy and it had to be because of the State of the State. How did you position yourself to take the helm? As soon as Kolb announced he stepped down, I started reaching out to various members of the conference. I really wanted to see if there was any level of support for me to become leader. Then once it became clear that people were going
to be supportive, I started reaching out to all 42 members. What does it say about the Assembly GOP conference that Kolb was arrested and ended up resigning his leadership post? I think people wanted to give him the benefit of doubt, at least initially, because he served for 10 years. The long and short of it was that Kolb reached the understanding in his own head that he wasn’t going to be able to be an effective leader with that type of thing hanging over his head.
Assembly, considering that the Democrats have such an overwhelming majority? It’s a question of if we can get everybody to cover our messaging, because sometimes it’s a challenge to get our message out. Obviously, we’re more successful on some issues than we are on others. I think the biggest thing is bail reform. That’s the No. 1 thing that I think we’re getting some traction on.

into this position. Frankly, it was the governor – with the help of the majorities in both houses. The one thing I will tell you that we don’t want to do is raise taxes. We don’t have a revenue problem. We have a spending problem, and Medicaid is the biggest budget item. The governor is talking about assembling a new Medicaid Redesign Team like the one he used in 2011. Is that the answer? It might be, but I’m going to withhold judgement. The problem is the devil’s always in the details. He’s going to come out with his budget address in, what, two weeks? And we’ll see what he has to suggest.

OV. ANDREW CUOMO was not scheduled to present a budget proposal along with his 2020 State of the State address in Albany. But in his own way, the legislative proposals that the three-term governor announced on Wednesday signaled how he wants to pay for his policy proposals – announced with the theme “Making Progress Happen” – in a year when the state faces a $6 billion budget deficit. The massive shortfall limits the governor’s options for the coming year, even if it does not necessarily limit his ability to get things done on his own terms. While the governor did not offer his spending plan alongside his State of the State – a departure from recent years – he did hint that his intended methods would include shifting costs to local governments and public authorities, borrowing money through a $3 billion state bond issuance and convening various groups of experts to study a wide variety of issues. Their potential price tags would presumably accompany proposals implemented in later years. Raising taxes, he suggested, would not make the cut.
“We didn’t raise taxes, and in fact, we have cut tax rates for every New Yorker,” Cuomo said of his record as governor. “We reduced middle-class taxes to the lowest level since 1947, we have the lowest corporate tax rate since 1968 and we managed the government to a 2% growth rate – lower than past Republican administrations – by running a smarter, more efficient, more effective government.” Much of Cuomo’s speech consisted of highlighting the accomplishments of past years, from tackling the state’s financial difficulties early on to building various infrastructure projects and implementing social justice policies in later years. “We face a $6 billion gap attributable largely to our Medicaid state costs,” he said. “Now, thanks to our good work, 95% of the citizens of New York have health care coverage and that is a remarkable achievement. And it’s a standard that previous generations could have only dreamed of reaching.” Then Cuomo offered his biggest signal yet of how he planned to solve it. “Six years ago, we froze the cost of Medicaid to local governments,” he said. “This year alone, we will spend $4 billion in covering the increase in the local government share.” Of that total, Cuomo said $2 billion goes to
New York City alone, stoking fears of that city and other localities across the state that the state will simply shift the costs to them. Additionally, the state has already signaled that it will move $2.2 billion in Medicaid spending from the current fiscal year into the next year, which begins after the April 1 state budget deadline. The tactic could presumably be used again moving forward, given how many years he has performed similar budget tricks, according to the Empire Center for Public Policy. Besides shifting billions in Medicaid spending onto local governments like New York City, Westchester County and Erie County, the governor also suggested that a new Medicaid Redesign Team could tackle the topic of limiting health care spending like the one he convened in 2011. “The situation is unsustainable,” Cuomo said. “We have restructured Medicaid before with our MRT program, and we are going to have to do it again this year, and we will and we can.” Cuomo also made efforts throughout the State of the State to present other proposals as revenue neutral – at least when it comes to the state budget that he is aiming to pass by April 1. A case in point is the $3 billion in new environmental spending he wants to use to restore natural areas like forests, wetlands and streams across the state. He is

proposing to pay for it through a bond act that would appear on the 2020 ballot. Details of the bond act have yet to be released, but this approach would keep the spending out of the state budget. New Yorkers in some form or another would presumably foot the bill through user fees down the road or other indirect expenses. Cuomo also has ambitions to expand the adoption of electric cars for both public transportation and state fleets, which would largely be done by employing public authorities that have their own revenue streams. Upstate and suburban transit authorities would have to fully electrify their fleets by 2040. Electrical utilities would develop the infrastructure necessary for a grid of electric vehicle charging stations with the help of an “initial investment” by the New York Power Authority. Outside the environmental arena, Cuomo is also mobilizing help from public authorities like the Olympic Regional Development Authority, which will oversee a $14 million plan to rebuild a ski lodge in the North Country. His idea to make permanent a state law requiring American-made steel for road and bridge projects would affect the Metropolitan Transportation Authority, the Thruway Authority and the Dormitory Authority of
the State of New York, and state agencies like the Department of Transportation. The Battery Park City Authority, meanwhile, is playing a key role in the public education efforts that Cuomo is proposing to battle hate crimes. “We must increase our cultural understanding,” he said after announcing that he would direct the authority to develop plans to expand the Museum of Jewish Heritage in lower Manhattan. “To know the history of the Jewish people is to know our mutual love and connection.” This was just one among a litany of goals that Cuomo proposed that had minimal fiscal implications. He wants to pass a state Equal Rights Amendment in the state constitution that would protect people by sex and gender identity. He’s aiming to “encourage employers to offer fertility coverage,” according to a budget handbook distributed by his office. Cuomo said experts would tackle diverse issues like high-speed rail and cannabis research as part of his new proposals to improve state infrastructure and legalize recreational marijuana. The point of all of this appears to be to get as much done – or at least give the appearance of progress – without breaking the bank. Ultimately, the strategies that Cuomo will use to overcome the deficit will only become
known once he releases his executive budget proposal at a time and date to be determined. Only then will he make clear his plans for local governments or how exactly a plan to cut small business taxes might help companies pay for a new paid sick leave program for their employees. He’s even promising to expand a college tuition assistance program that has a mixed record. Once state lawmakers have a look at his fiscal plans, their own proposals to solve the deficit can be taken into account. Assembly Speaker Carl Heastie suggested to reporters after Cuomo’s speech that raising taxes was still a possibility, although state Senate Majority Leader Andrea Stewart-Cousins emphasized limiting taxes in her own remarks to her colleagues. The governor’s comments about education spending offered one last hint at how he intended on dealing with an issue particularly important to lawmakers in both chambers. “Don’t play politics with education money,” Cuomo suggested in apparent reference to efforts to increase the Foundation Aid for public schools. Much remains uncertain at this point in the budget season, but the governor has already given everybody a heads-up about where he’s headed.

EEKS BEFORE this year’s State of the State address, Gov. Andrew Cuomo was doubling down on his claim that New York is the best – from a progressive perspective at least. “Last year we laid out the most aggressive agenda in modern political history, and we got it done,” he boasted in mid-December. “We’re going to set the bar even higher, making progress happen for the people of this great state and sending a signal to a weary country to follow New York as we lead the way upwards.” Cuomo isn’t alone in insisting the Empire State is living up to its motto, Excelsior! State
Senate Majority Leader Andrea Stewart-Cousins regularly refers to New York as the nation’s “progressive beacon” for “hope and justice.” Assembly Speaker Carl Heastie has made similar claims. “New York State has always been a national leader in progressive policies that build up all our citizens,” he said ahead of the 2019 legislative session. “I am proud that the Assembly has long been at the forefront.” Whether the topic at hand is touting the economic power of New York City or bragging about how upstate Americans are living their best lives, average New Yorkers like to think they’re exceptional. The state has the nation’s most populous city, the third-largest economy and the fourth-highest population. It’s no surprise then that Cuomo likes to appeal to home state pride when pushing his legislative priorities. “That is the New York way,” Cuomo said in 2015. “We’ve always been different. We’ve always been first. We’ve always been the most progressive.” In fact, New York hasn’t always been first. Control of state government has shifted between Republicans and Democrats plenty of times over the years, with policymaking swinging in both conservative and liberal directions. In Cuomo’s first two terms, Democrats passed some progressive measures, such as legalizing same-sex marriage, while also working with Republicans to limit taxes and state spending. Now in his third term, Cuomo and the Democratic majorities in both houses of the state Legislature can do what they want without worrying too much about GOP opposition – whether it’s strengthening tenant protections, better protecting individuals accused of crimes or allowing undocumented immigrants to obtain driver’s licenses. Even with the Democrats’ newfound political dominance in Albany, however, the state doesn’t own the mantle of na-
tional progressive leader. Even Cuomo’s favored claims are a bit more complicated than he lets on. He led a 2011 effort to make New York the first big state to legalize same-sex marriage through legislative means – but the sixth one to do it overall. A $15 minimum wage was passed by state lawmakers in 2016, but it remains to be seen which state will become the first to fully implement the idea. That year, New York also passed what has been called “the most generous paid family leave law in the country” – but it was approved more than a decade after California enacted its own plan. Other states have beaten New York to the legislative punch in banning assault rifles, extending waiting periods for gun purchases and passing a “red flag” law that allows judges to order weapons be seized from dangerous people. Yet to be fair, New York is recognized for having the strictest gun laws in the country. Cuomo even (kind of) got free college tuition for students from middle-class families – but there were strings attached. “It depends on the prism through which you view it,” said Democratic consultant Bruce Gyory. “If you view

Other states have moved faster than New York on a variety of issues over the years. Democrats have had to play catch-up ever since they took full control of the state Legislature after the 2018 election – but they’ve broken some new progressive ground at the same time.
Massachusetts became the first state to legalize same-sex marriage following a 2003 court ruling. Vermont became the first state to do so through legislative action in 2009.

The state Senate has already approved legislation this year to implement automatic voter registration in the next two years, but it’s unclear when the Assembly will take up the issue.

New York through the prism of accomplishment, it is high up on the list (but) you can never do enough to satisfy the advocacy groups because they always want more.” Since Democrats gained control of the state Senate after the 2018 election, they have been trying to make up for lost time. For example, before this year, New York was just one of the few states that did not guarantee criminal defendants could see the evidence against them before a trial began, one of several systemic factors that tilted cases in favor of prosecutors. “New York was way at the bottom of the barrel,” said Donna Lieberman, executive director of the New York Civil Liberties Union. “But we leapfrogged over just about everybody with that discovery reform package.” Democrats have similarly upped their progressive game in other ways. Women now have more reproductive rights enshrined in state law. Transgender people have stronger civil rights protections. The use of cash bail has been greatly reduced. Undocumented immigrants are getting driver’s licenses and are eligible for state college financial aid programs. The state now has the most aggressive climate change goals of any state. Top progressive dog or not, the argument in New York’s favor has gained some real teeth. However, activists and lawmakers on the political left are not always happy with the re-
sults of Cuomo’s brand of progressivism. The newly adopted plan for publicly financing political campaigns has not exactly inspired awe among the party faithful. Recreational marijuana is still illegal. New limits on solitary confinement fell short of what Colorado passed years ago. “New York passed several important and overdue reforms this year, but they left many people behind,” said Victor Pate, a formerly incarcerated person who is now the statewide organizer of a campaign seeking new limits on solitary confinement. “Our state can only be a real national progressive leader if policymakers take further action.” Presidents Franklin Roosevelt, Lyndon Johnson and Barack Obama all let leftists down at times despite their accomplishments, which means analysis of Cuomo’s progressive legacy must also be kept in perspective, according to Gyory. “When history looks back at the record,” he said, “New York under this governor and this legislative leadership ranks very high on the progressive scale.” Historically, there’s a case to be made for New York as well. Gov. DeWitt Clinton opened up the Midwest to commerce by leading efforts to construct the Erie Canal, a massive feat for the early 19th century. Liberal governors like Al Smith and Franklin Roosevelt helped make the state an incubator of social
innovations like worker protections and social welfare programs after the original Progressive Era. But by the mid-20th century, the state was losing its grip on the title of America’s top state. California, a perennial rival, was growing in population. Upstate New York’s industries declined. Years of Republican control of the governorship and the state Senate blocked Democrats from moving the state further to the left in the early 21st century. Other states took the lead on legalizing recreational marijuana, expanding voting rights or boosting protections for undocumented immigrants. “New York is one of the leading states,” said Joshua Freeman, a professor of history at the CUNY School of Labor and Urban Studies. “But I’m not so sure to the same extent it was 80 years ago.” Even when New York is the first to pass progressive legislation, there aren’t always a lot of followers. “If you stood up on the floor of the Illinois General Assembly and said, ‘This is a piece of legislation that New York has passed and we must do it too,’ that wouldn’t buy you beans,” said Christopher Mooney, a political science professor at the University of Illinois at Chicago who researches how state legislators in different states make public policy. In other words, there are better ways to woo a Midwestern lawmaker. “We don’t want to be Louisiana,” Mooney said. “So
when you sit up on the floor and say this: ‘You know, we’re 49th in the country on this’ – that gets people’s attention.” And only so many states are competing to be a national leader – at least when it comes to progressivism. The Sunshine State has made moves to lure a new “Florida Man” or two at the expense of New York’s tax base. Texas has a big ego, no doubt. But neither of them is vying for the progressive mantle – at least not yet. While Gov. Gavin Newsom of California is “swinging at every pitch” progressives throw, states tend to compete with their neighbors, according to Florida State University professor Carol Weissert. “Florida doesn’t pay much attention to New York’s innovations,” said Weissert, who researches state lawmakers in different states. “One big reason for that is that states tend to emulate states with regional or demographic similarities.” So if there really is a national competition to be the most progressive state, not that many states are actually playing. Only about a third of the 50 states have governments controlled by Democrats. New York is competing against the likes of California, Massachusetts, Connecticut, Oregon, Washington and Hawaii. Even if the Empire State has an uncertain claim as the progressive leader of them all, at least Cuomo can tell New Yorkers he’s looking out for No. 1.
