NEW YORK CITY AUCTIONED THE DECOMMISSIONED Staten Island Ferry boat John F. Kennedy to the highest bidder last week. While the names of the new owners weren’t disclosed, the New York Post reported that “Saturday Night Live” cast members and Staten Island natives Pete Davidson and Colin Jost – in partnership with Manhattan real estate broker and comedy club owner Paul Italia – made the highest bid and plunked down $280,000 for the 57-year-old vessel. The city got rid of the Kennedy, a beloved ferry for its wide-open spaces and outdoor decks, because of mechanical issues. A former Kennedy captain suggested to Gothamist that the vessel would make a cool museum. The Staten Island Advance even reported that the Kennedy is already seen as eligible for the state and the National Register of Historic Places. Meanwhile, other ferries have been converted into house boats, as was done with an old Ellis Island ferry. Italia, however, told the Post that the Kennedy will become a “live entertainment event space.” Whatever the case, buyer beware! Repurposing a multiton vessel isn’t easy. The SS United States, a 71-year-old cruise ship that holds the record for fastest trans-Atlantic crossing, has been rusting away for a quarter century in South Philadelphia. Its nonprofit owners have been paying a $60,000-a-month dock fee while struggling to find a new life for the boat. There’s also the famed Queen Mary, now a Long Beach, California, tourist attraction with bankrupt owners and in need of significant repairs costing millions. Hopefully, the Kennedy will have a brighter future. Otherwise, it may just turn into a shipwreck.

Gov. Kathy Hochul has said many things in recent months about what she wants to get done in the upcoming year. Now she has to translate that into hard numbers and legislative language that can pass the state

and state legislators alike, but the give and take of budget negotiations will likely lead to conflict, though the state constitution gives the governor enormous power to pass a spending plan over the objections of the state Senate and Assembly.

BETTING ON NEW YORK Nothing says high roller like a $216 billion budget, so it makes sense that wedged into Gov. Kathy Hochul’s executive spending proposal is a move to fast-track casinos for New York City. Hochul wants to open up a request for proposals for three new casinos and put an early end to a moratorium on building them in the city. Something has to bankroll that record-breaking budget, after all.

“As I said since I took office 147 days ago, my top priority is to confront this pandemic head on and to save lives, protect the health of New Yorkers and protect the health of our economy,” Hochul said in her budget address. “We also must pass a bold agenda that’ll do more than just help us recover from this crisis. We need to embrace this moment of possibility and use it to redefine New York’s destiny.” Hochul’s proposed budget of $216.3 billion is notable because it is several billion dollars higher than the $212 billion budget approved last year – and more than $20 billion higher than the budget her predecessor unveiled one year ago. The governor is proposing the state devote $118.8 billion to operating funds, $95.5 billion to the general fund and $18.6 billion more to the state capital budget for public works. Her budget projects spending growth of 3.1% in fiscal year 2021 and a balanced budget through 2027. Other budget highlights included $31.2 billion for school aid, including a $1.6 billion increase in Foundation Aid, as well as $2.2 billion for property tax relief, $2 billion for pandemic recovery and $1.2 billion for bonuses for front-line medical workers. receipts, which mean she will not have to make as many difficult choices as past years when the state’s finances appeared to be in disarray. It appears as if the governor wants to keep local officials happy with some of her ideas. She vowed to have the state take over billions of dollars in Medicaid spending by local governments while maintaining the current categories of funding that help school districts purchase things like textbooks and school buses – notable changes from the budgets proposed by her predecessor. State Budget Director Robert Mujica told reporters that no significant tax increases were included in the proposed budget. State lawmakers will now get ready to hold hearings and craft their formal response before Hochul releases any amendments to her proposed spending plan. “The policies I laid out two weeks ago are

The honeymoon period for Gov. Kathy Hochul and New York City Mayor Eric Adams continues. Hochul gave her first budget address, releasing a proposal that includes, among other things, a number of New York City-specific items. Some of them, like extending mayoral control of schools for four years, are likely to make the new mayor happy. In total, the budget proposal projects that state spending on New York City will increase in fiscal year 2023 to almost $20 billion in local aid programs. That figure included school aid and a takeover of some local Medicaid costs. Transit and transportation infrastructure

In her State of the State address, Gov. Kathy Hochul promised to end a controversial tax break to incentivize developers to build affordable housing in New York City. The 421-a program will expire this year, so lawmakers simply have to do nothing for it to go away. But Hochul pledged she would replace the program with something else, something she said would better use state dollars to stimulate more affordable housing construction. Hochul laid out her idea for such a replacement in her executive budget. Absent from her briefing book, she included details of the new program in the Education, Labor and Family Assistant budget bill – an unusual place for housing legislation – buried all the way at the bottom. Dubbed the Affordable Neighborhoods for New Yorkers tax incentive – or the ANNY program – the proposal would create a new 485-w section of the state property tax law, giving housing wonks a new number and letter combination to confuse laymen. Despite her promise to replace the existing tax break with something new, Hochul’s proposal serves more as a tweak to what’s already on the books. It keeps the same overall structure and conceit with a few changes to make the afford-

able units built slightly more affordable. Though applauded by some in the housing sphere, it doesn’t represent the kind of transformational change that housing advocates would like to see, with the plan considered more of the status quo in incentives for big developers. Despite the improvements, Hochul’s proposal still approaches affordable housing development the same way as 421-a, with large tax breaks for developers for their entire buildings. “It’s just more of the same,” said Cea Weaver, campaign coordinator for the Housing Justice for All coalition. “It just doesn’t really seem that significant.” She questioned how the state would enforce the permanent affordability Hochul is promising, referring to the inclusion simply as “window dressing” until advocates know more. Sam Stein, housing policy analyst at the Community Service Society, said the state could limit subsidies to just the affordable units, or abolish the tax break altogether and use what would have been lost revenue to directly finance construction of affordable housing. “But the new version doesn’t do either of these things,” Stein said. “It just adjusts the parameters of the existing program. – Rebecca C. There’s a long way to go before the governor and state Legislature hammer out a final budget, but here are some of the bigger items, affecting New York City in particular, to come out of Hochul’s $216 billion budget proposal. Mayoral control of schools Under this Bloomberg-era system, the New York City mayor is granted control over city schools – but only through the state Legislature’s decision to renew that control every couple of years. Hochul proposed extending the mayor’s authority for another four years. Despite calls to reform the mayoral control system under then-Mayor Bill de Blasio, there doesn’t seem to be much political will behind changing the system now, before the new mayor has had a chance to prove himself. Nonetheless, Hochul’s fouryear extension won’t go unappreciated by Adams.

Taking over Medicaid spending Hochul’s budget proposal has the state taking over more than $5 billion in local Medicaid growth – a measure projected to save New York City $2.6 billion. The state’s takeover of Medicaid cost increases has been phased in over the past decade, following a

State Budget Director Robert Mujica said that Hochul’s proposal doesn’t specify the new casinos being in New York City, but noted there’s interest in building there. “The three (licenses) will probably be focused in the downstate area, but there’s no restriction there,” he said. More spending on education Spending on school aid statewide would reach $31.2 billion under the budget proposal, including increased spending on Foundation Aid in New York City of $345 million. The proposal also outlined a 4.7% increase of per-pupil funding in city charter schools. Hochul detailed a series of new investments in public higher education, including a $1.5 billion investment over five years in the SUNY and CUNY systems and expanding the tuition assistance program for part-time CUNY and SUNY students.

Expanding theater production tax credit Like the tax credits that film and television productions receive for making their projects in New York, Broadway shows and other live productions in New York City – beaten down by the COVID-19 pandemic – would also be eligible for a tax credit. Hochul proposed expanding the existing New York City Musical and Theatrical Production Tax Credit, doubling the cap on the program to $200 million and extending the initial deadline to apply through June 2023. New opportunities for affordable housing Included in an overall $25 billion, five-year housing plan are several measures to expand the housing supply in New York City, including repealing a limit on the maximum density of the residential area of city buildings and making it easier to convert hotels into permanent housing. – Annie McDonough

Who are Hochul’s big donors? New York has never seen a campaign finance filing quite like Gov. Kathy Hochul’s. She started fundraising in August, days after then-Gov. Andrew Cuomo announced he would resign, and she never stopped, bringing in more than $21.6 million in a five-month period. Hochul’s campaign touted the haul as “the largest contribution total for any single filing period in New York history” in a press release that noted she nearly doubled the $12.8 million raised in 2002 by then-Gov. George Pataki. The windfall further solidified her position as the front-runner in the 2022 Democratic primary for

governor, with her biggest competitors, New York City Public Advocate Jumaane Williams and Long Island Rep. Tom Suozzi, raising $221,996 and $3.4 million, respectively, according to the public filings. Among the biggest donors were developers from Buffalo to Manhattan, entertainment execs and celebrities. Also pouring cash into Hochul’s campaign were hundreds of interest groups and labor unions. The real estate industry was especially generous, with one of the heftiest donations coming from New York City commercial landlords the Rudin family, which gave more than $226,000 between their 845 Third L.P.

corporation and five individuals, including $35,420 from Eric C. Rudin, the president of Rudin Management Co. The Haugland family, which owns the Melville-based Haugland Energy Group, gave more than $209,000 between three family members. The company was recently awarded a contract on the state’s first offshore wind farm, South Fork. Big names from sports and TV to fashion and dining also appeared on Hochul’s latest filing. Comedian Jerry Seinfeld donated $50,000. Steve Cohen, the hedge fund manager who owns the New York Mets, and his wife Alexandra Cohen, gave a combined $136,700. Tech execs were among the major donors, with LinkedIn co-founder Reid Hoffman and former Google CEO Eric Schmidt giving $69,700 each. Political action committees and labor unions were also represented, including two PACs associated with the Hotel Trades Council that

Stop Denying Farmworkers Overtime Pay!

business’s viability must not depend on the legally allowed exploitation of people which had originally been based on the color of their skin. That is morally indefensible. This is why New York needs to correct the glaring injustice in New York’s agriculture industry where farmworkers are denied overtime pay after 40 hours. Unlike most workers in the Empire State — and the rest of the country — New York’s farmworkers are currently denied overtime pay by New York law until they’ve worked 60 hours a week. This is a relic of Jim Crow-era labor laws that have historically treated farmworkers — the backbone of New York’s agriculture industry — as second-class workers. But with the proper action, that could soon change. As directed by the historic Farm Laborers Fair Labor Practices Act (which in 2019 for the first time gave the state’s farmworkers the right to organize into unions) the New York Department of Labor has convened a wage board to hold hearings and consider

changing the state’s regulations to reduce the 60-hour overtime threshold for farmworkers. The wage board needs to recognize that farmworkers — who have proven to be truly essential workers during the ongoing COVID-19 pandemic — deserve overtime after 40 hours, which has been long-established for almost every other worker in this country. Just like all businesses, farms have financial concerns. But the industry cannot use these concerns to justify laws rooted in the darkest point of our history to exploit predominantly black, brown and immigrant workers. There is virtually no evidence to support industry claims that the difference between success or failure at New York’s farms depends upon the unjust 60-hour overtime pay threshold. Even some in the agriculture business agree, including David Breeden from Sheldrake Vineyards in the Finger Lakes region. “You know what’s expensive for the coal industry, not having child labor, but we got past that,” Breeden said during one of the hearings.

Clearly, the farm industry will survive paying its workers fair overtime. The data in the nation’s largest farm state, California, shows that their 40hour overtime pay threshold has not corresponded with any negative impacts or shocks to the California farm economy or labor market. Farms in Washington state, where 40-hour overtime has also been implemented, are continuing to thrive. Last year, the RWDSU helped farmworkers at Pindar Vineyard on Long Island become the first to win union membership. These essential working men and women are predominantly fulltime New Yorkers. They have families here that they care for and they have family back home whom they also support. They want a better future for their children and work to provide a safe home for them. They take pride in their work, and they want and deserve dignity at work. This dignity can only be fully realized when these workers — whom New Yorkers depend upon every day — are treated fairly and enjoy the same rights as all other working New Yorkers. The wage board must implement a 40-hour overtime threshold for New York’s farmworkers, recognizing their contributions, and moving toward correcting the injustices they’ve suffered for decades.

I will be. And it’s a lot of pressure, now that we’re so close to it, and you think about it actually happening. You think about the millions of ex-offenders who will probably hear what’s happening, and you can either inspire these guys to change their lives around. You can inspire these guys to want more and do more. So there’s a responsibility attached to this. It’s bigger than me. I spoke to (Assembly) Speaker (Carl) Heastie today. He said, are you sure you want to do this? And I laughed when he said it. And when I got off the phone, I was like, damn, that’s a good question. It’s a lot of pressure. But that’s what kept me straight for the past – you know, this happened 35-plus years ago. Let’s get this out the way: 17 years old, was hustling. This guy attacked me. I was defending myself. I turned myself in. I didn’t hide from the police. I walked to the precinct and I turned myself in. I gave a statement right then and there. I was given three years. A plea. I think because of the remorse I was showing and mitigating circumstances, I was given that lenient sentence. But until this day, I’m very apologetic and disappointed in my actions. I make no excuses for them. But I can promise you, and I can assure you, the 17-year-old boy who made those poor decisions 35-plus years ago, that’s not the man you’re talking to today. I’m

tearing up as I talk to you, because (of) what I went through over the past 28 years trying not to get to this point, but trying to prove to people that I’m not that monster that the papers said I was. The murderer. I knew I defended myself. The courts knew I defended myself. I was hustling. I wasn’t making money. We couldn’t afford an attorney like a Murray Richman to represent me. So when the judge sends your Legal Aid attorney into your cell and says, “Hey, man, you’ve been here now 17 months, we’ve got some good news for you. The judge is offering you three years.” I was on Rikers Island for 17 months.

Do you hope to get involved in criminal justice and sentencing issues in the state Legislature? Or have you had enough of that in your life? Criminal justice reform has got to be something I focus on. I want to be part of that discussion. I’m still studying the effects of bail reform. But criminal justice is definitely on my mind. I sent

the email out to (Assembly Member) David Weprin. I know he’s the chairman of the prisons committee up here in Albany. I’m focusing on housing and seniors, but that committee, I want to put my emphasis on it. I don’t think anybody out there will have better insight than me. I’m the product of a fair criminal justice system. I’m that story of redemption. When I came home, I was trying to do everything to fit in. I did stand-up comedy for like, two years. Did a lot of shows. My stage name was Good Buddy. And this name was fitting because I am a good buddy. I didn’t want that stigma. When people come home from prison, especially with a manslaughter charge, or if you’ve been in prison five, 10 years, people form this opinion about you, that you’re tough and you’re rough and don’t bother them and they’re afraid of you. You’re intimidating. I didn’t want people to feel like that around me. I wanted to show people I was funny. I talked about prison. I talked about life. I talked about everything. Talked about becoming an ordained deacon. Because I wanted people to relax and laugh. I did that, I did acting. I did rapping. I was rapping with everybody. I’ve got to show you these videos. I did rapping with Jungle Brothers with, God bless the dead, Biggie Smalls. I rapped with Mase, I opened up for him.

You’re on the path to becoming an Assembly member. I believe you’d be the first state legislator who previously served time in prison. Is that right? Tell me about your story.

You rapped with Biggie Smalls? Yeah, yeah. I did. Me and, God bless the dead, Big L. Big L is a rapper from 139th Street. He didn’t get his break yet, but he had a good following. And he was killed at 139th and Lenox. Good friend of mine whose brother Leroy and I were locked up together for three years. And when we came home, we gravitated towards Big L, and we traveled with him. And he opened up for Biggie, and they let me do some freestyles at the show.

You said you’re still studying bail reform. What do you mean by that? Have you not made up your mind on whether the current law needs to be changed? In the community where we’re from, we see a lot. There’s no fear of going to jail anymore. Back then, people were afraid to get caught. You’re not coming home. To look into those windows – like “bail reform! The bail is too high! This guy can’t afford it!” But you’ve got to look at some of the charges. I’m critical on everybody. Who said that – don’t do the crime if you can’t pay the time? Right is right, wrong is wrong. If you’re caught up and you’re wrong, you’ve got to learn. I’ve got a lot of friends who just can’t make that transition. They’d rather be out there hustling. And, to each his own. But there’s going to be a price you have to pay.

I’M THE PRODUCT OF A FAIR CRIMINAL JUSTICE SYSTEM. I’M THAT STORY OF REDEMPTION. This seat has been held by a Latino member for almost 50 years. You’re Black, so there’s some tension around that change. How does it feel to represent this plurality Hispanic neighborhood?

I love East Harlem. Born and raised here, 54 years now. Minus the four I was gone in prison. I love El Barrio. I love the community. I love the neighbors. I love the people. And I understand why and how the Latinos would feel entitled. Prior to them gaining the seat, it was the Italians. But back then in East Harlem, it was Italians and Black. It wasn’t Latinos. I can tell you stories from my cousins and uncles who would fight Italians because – if we go across First Avenue, we’re out of territory. Italians held it down for a while, then Latinos moved in and they ran and gained the seat. Granted, I don’t think it’s a Puerto Rican seat. I just think it’s an East Harlem seat. You have a pocket of Latinos who felt the need to say that they are the old guard and the old ways said that no Black can occupy this seat. I don’t think most of the Latino community agreed with them.

“The lessons of this current pandemic are many and some of them are painful,” Manhattan Borough President Mark Levine said. “It’s pretty clear that we hollowed out public health in this country and really paid a price for it over the last two years. It’s also clear that the history of deep inequality and access to medical care has led to horrific impact on communities of color in this crisis. We have much more work to do to protect ourselves from either another wave of COVID or another pandemic.” Levine’s sentiments appear to be shared by Hochul. In her 2022-2023 budget announced on Jan. 18, she included a $10 billion plan to grow New York’s health workforce by 20% over the next five years, calling it the largest investment in health care in state history. It includes $4 billion to supplement health care and mental health worker wages and bonuses, of which $1.2 billion would be allocated for retention bonuses; $500 million for cost-of-living adjustments for human services workers; and $2.4 billion for infrastructure improvements to hospitals, nursing homes and clinics, as well as funding to increase testing capacity. Hochul had already asked the federal government for an additional 800 military medical personnel to help handle COVID-19 cases in New York City and state. “One hard lesson we learned about what happens when there’s a lack of investment is how our health care system crumbled under the stress of the pandemic, and that’s why we’re making up for lost time,” she said. In New York City earlier this month,

Adams announced that he will target the omicron variant by committing $145 million in resources to support public hospitals as well as independent hospitals and medical facilities that provide services to the uninsured and those on Medicaid. Of that funding, $111 million will go to boost staffing at New York City Health + Hospitals and the city Department of Health and Mental Hygiene. About $33 million will be added to the COVID-19 Hospital Loan Fund, which in partnership with Goldman Sachs, provides unsecured loans to independent safety net hospitals serving the uninsured and those on Medicaid. The funding will help shore up hospitals beyond the omicron surge, said Eboné Carrington, the former Harlem Hospital Center CEO who served on Adams’ transition committee. “It’s to help them get through the next couple of waves,” Carrington said. The announcements were welcome news to people like Assembly Member Richard Gottfried, who said funding increases would be a welcome departure from former Gov. Andrew Cuomo’s approach to health care spending. “In recent budgets under Gov. Cuomo, there were repeated efforts to cut that funding, and the Legislature had to work to try to find funding to restore those cuts,” said Gottfried, chair of the Assembly Health Committee. Last year, Cuomo’s original budget proposal had included $600 million in cuts to hospitals. He had also proposed cutting Medicaid costs by limiting reimbursements for prescription drugs bought by community-based health centers.

“Medicaid reimbursement rates need to be improved and we need to pay hospitals more to cover the cost of people who don’t have health coverage,” Gottfried said. “We have state funding that is designed to reimburse hospitals for what is called indigent care, but that funding is inadequate and a disproportionate share of it goes to hospitals that don’t provide a lot of indigent care.” In addition to the health care funding allocated in the proposed state budget, Bassett said, “My interest is in achieving structural solutions that will keep us from having the recurrent need for cash subsidies to struggling hospitals.” Though she’s just at the beginning of working out how to do that. But it is not just Medicaid funding and indigent care that concerns state and local health officials. Testing is also a concern. The demand for COVID-19 test-

The state had more than 30,000 new cases on Jan. 19, down from a peak of more than 90,000 cases on Jan. 8. Deaths, which have lagged behind cases, were over 250 per day in mid-January, still well below the April 2020 peak of about 1,000 deaths per day. State Health Department Commissioner Dr. Mary Bassett said she has seen “convincing data” of a downturn in hospitalizations downstate, and that she sees the trend heading toward a plateau elsewhere. “But it’s still going up in some areas upstate, so we have to keep an eye on that,” she told City & State. Earlier in the week Gov. Kathy Hochul echoed this caution, saying, “We are not out of the woods yet with this winter surge.” And that is what worries many state leaders and health officials: If New York is still in the woods, then what lurks in the shadows? And is the state prepared for the next phase of the pandemic? Those concerns are not without merit. Leaders are facing low staffing levels at hospitals, poor morale among medical front-line workers, limited availability of COVID-19 tests, continued opposition to wearing masks and getting the vaccine by some, and uncertainty over whether and how the virus might mutate again. Hochul and New York City Mayor Eric Adams have vowed to keep the government, businesses and schools open . They have said they will develop plans to deal with any future surge in COVID-19 cases while seeking a way for New Yorkers to live with the virus.

ing far outstripped the supply as schools, businesses and communities attempted to stay open safely. In late December, state and local elected leaders in Queens complained about the lack of tests. “New Yorkers should not have to wait in lines for hours, travel far, or worry their results will not be provided to them promptly,” Assembly Member Jessica González-Rojas said. Bassett said the state has ordered 64 million COVID-19 tests with 16 million being delivered so far. Levine, along with other elected leaders and public health experts, warned that years of disinvestment and neglect of our public health system must be addressed for those efforts to succeed. “The level of payment reform that’s required for the Medicaid program and for underinsured or uninsured individuals is really at the heart of this conversation,” Carrington said.

Gottfried said passing his long-standing single-payer health care bill, the New York Health Act, would help. As City & State previously reported, getting consensus on it in this session will be an uphill battle, despite significant support in both chambers. Public sector unions are among the opponents, concerned about the impact on members’ health benefits. “There are obviously interest groups that are opposed to the bill and we’re working to try to meet their concerns and overcome their opposition,” Gottfried said. Beyond bolstering the public health care system, it will take planning and cooperation between all sectors of New York life to avoid getting caught flat-footed once again by COVID-19 or another health threat. “Not only can we do more to prevent these events, but we should be better prepared to respond to them and also to recover from these threats,” said Dr. Wafaa El-Sadr of

the Columbia University Mailman School of Public Health and leader of the newly created Pandemic Response Institute. The institute, which is funded by the New York City Economic Development Corp., is a collaboration between Columbia and the CUNY Graduate School of Public Health and Health Policy, and it will partner with nonprofits like the United Way of New York City, corporations and faith-based institutions. It will focus on improving technologies to collect and share data in real time; bolster research and the technologies that will enable officials to quickly ramp up for the next public health emergency; coordinate drills within communities; and promote racial equity in the response to future health crises. “Our goal is not to replicate and duplicate

The goal of this institute is to work hand in hand with the city and other stakeholders to really identify the gaps and identify the priorities and focus on those,” El-Sadr said. One way in which New York City Council Member Carlina Rivera has been looking to identify gaps – and address racial and gender inequities – is through a bill that would create an Office of the Patient Advocate within the city health department. “It would collect patient feedback and complaints regarding health care experiences in New York City, answer general questions about insurance and access, and have an investigative and reporting team to look at troubling trends in our city health care facilities,” the former Hospitals Committee chair explained. Initially introduced in 2019, she is hoping the bill will pass in the current term. Meanwhile, the city health department said much of its work to address racial disparities in vaccine distribution and testing

have centered on the Taskforce on Racial Inclusion and Equity, led by NYCHA executive Sideya Sherman. Bassett said the state doesn’t have a program similar to the Pandemic Response Institute, but the state’s Public Health Corps fellowship program was focused on preparing for future public health emergencies. The program was created to identify and train public health professionals to work with local health departments and communities. Levine has hailed the creation of the institute, and has also told a newly created COVID-19 recovery task force in his office to help plan and advocate for better preparedness, among other responsibilities. It is chaired by Aldrin Bonilla, who is executive vice president of the Fund for the City of New York and a former Manhattan deputy borough president. While the task force is still being formed, Bonilla said it is already considering ideas that could help deal with future surges. The Manhattan Solid Waste Advisory Board, which is under the borough president office’s purview, has proposed strengthening the infrastructure around wastewater testing. Bonilla noted the growing area of research relating to detecting and tracking the presence of the coronavirus in municipal wastewater. “By looking at our wastewater, both the liquid and the solid waste, this could be a leading indicator so you can get ahead of the next wave.” Recently, Adams told MSNBC, “It’s time to live with COVID and build systems around COVID until it dissipates and leaves us.” Levine said he agreed with that approach, and added: “Let’s have systems in place so that we can immediately pivot without some of the chaos and delays that we endured over the last two years.”

FALLING BEHIND Schools are struggling to keep up with a surge in mental health and behavioral issues related to the pandemic. By Clem Richardson

The return to school buildings has revealed more about the mental health toll of the pandemic.

HE PANDEMIC CONTINUES to weigh heavily on the mental health of the city’s 1.1 million school children, their parents and especially on the teachers charged with keeping them on academic track. Deaths of friends and loved ones, new variants and the possibility of infection they bring, changes in protocols like mask wearing or isolation time after infection, and the endless debates about in-person or remote learning are just some of the issues impacting the school communities. City Council Member and former Manhattan Borough President Gale Brewer notes that even deciding how to mark a student who misses class absent can impact the student’s

future. “Maybe the parents want the child to stay home because there was an outbreak at school and they’re afraid the child will get infected and bring it home,” Brewer said. “But right now, if a student is not sick herself, being marked absent can impact their grades and academics.” Teachers must deal with these stresses and a variety of other issues, from covering for sick or absent colleagues and keeping often absent students on academic schedule, as well as the prepandemic issues found in all schools, like food insecurity in student homes and parental abuse, which can be exacerbated by at home learning in close quarters. For those and other reasons, mental health has become an even more important issue in schools.

Thousands of anxious New York City public school students walked out of class on Jan. 11 to demand that online classes be offered to those who wanted to stay at home. The students cited teacher absences and the fear of widespread infection from the omicron variant of COVID-19 among their reasons for wanting remote classes. Similar protests occurred in other cities across the nation, with some students threatening to boycott in-person classes over omicron. “Students have faced immense challenges over the course of the pandemic, and many have been impacted by the pain, stress and trauma the pandemic has caused New Yorkers,” said Department of Health and Mental Hygiene spokesperson Victoria Merlino.

In addition, some schools have been reporting higher incidences of violence and acting out since students returned to in-person classes. Other schools have reported students entering school in pajama bottoms, and children displaying behavior that is typical not of their age group, but of the last age group with which they interacted during in-person classes. Mental health is also a concern for colleges across the country, where administrators fear that isolation caused by remote learning has left many students feeling depressed and even suicidal. How New York City plans to deal with such issues is not known at this time. The Adams administration and the Department of Education did not respond to numerous emails seeking comment on how the pandemic is driving mental health issues affecting the city’s school children. But United Federation of Teachers Associate Executive Director Christine Schuch spoke to City & State about what members are seeing in the city’s community schools, schools that remain open longer than regular public schools and offer more social services. Schuch manages UFT social workers and professionals working in those schools. “In elementary schools, students are experiencing anxiety and fear,” Schuch said. “There is the stress of walking into a school and not feeling entirely safe. Then you have the students who have experienced great loss, and a lot of disruption, as we all have, but it manifests differently with children. “In middle schools and high schools, there is still stress and anxiety and trauma as well as a little uptick in violence and in suicidal thoughts. Some of the stresses are kind of leveling off now, but you add returning

to school while dealing with a new variant, and there is more stress,” she added. Teachers “are equally stressed out,” Schuch said. “They’re trying to deal with the same situations, and they or their colleagues are getting sick and they have to figure out how to cover for them.” The pandemic prompted the UFT to “put in much more social and emotional programming for the staff, so they can support the students, for the parents, so they can also support themselves and their children, and then for the teachers,” she said. That translates to more group and individual counseling sessions for students and more home calls for parents. The UFT also has 45 staff members, six of them social workers serving with DOE social workers, manning the programs in 32 schools. “Our social workers have been doing much more check-ins,” during the pandemic, she said. “They touch every kid in the building to see how they’re doing, and they’re doing a lot more groups, so you can really work one-on-one with the students in the groups.” Social workers are developing programs for parents as well, Schuch said. “Many parents just want to talk to somebody,” she said. Community schools have also increased counseling for school staff, offering the same social and emotional programming the students and families receive. “We’ve been having a lot more meetings to check in and see how the staff are doing, and make sure they get the space and time to take care of themselves,” she said. “They’re making it work because they have to,” she added.

LANGUAGE BARRIERS IMPEDE FIGHT AGAINST COVID-19 Over 200 languages are spoken in New York City, making pandemic outreach difficult. By Sara Dorn

ISINFORMATION, along with ever-changing protocols and a constant stream of new findings about COVID-19, has plagued communities in New York City across social, ethnic and economic spectrums throughout the pandemic. But in areas of the city, in which English is not the primary language for many people, the lack of reliable information has proven to be especially troublesome. A confluence of factors that existed among many non-English speaking communities long before the introduction of COVID-19 – distrust in institutional medicine, employment and housing constraints and a lack of access to technology – has exacerbated the effects of the language barriers, experts explain. Non-English speakers in New York City are often left in the dark when COVID-19 directives change or im-

portant news breaks about the virus on English-language mediums, such as televised press conferences or news stories. Information that does trickle through is sometimes lost in translation and conflicts with reports out of their home countries. Navigating websites where the public can sign up for COVID-19 vaccines, testing or to receive personal protective equipment have also been hindered by language barriers. “Among non-English speakers in a place like New York City, we are seeing some of the same issues that were always there before the pandemic, but just magnified on a greater scale,” Allison Squires, an assistant professor at NYU Rory Meyers College of Nursing, told City & State. “Much like with English speakers, there is also a ton of misinformation … and many folks, especially if they’ve immigrated recently to the country, are comparing the local information with

what they’re hearing back home, so that just adds additional layers and complexities.” Some low-income neighborhoods in New York City that are home to large immigrant communities and where English is not the predominant language, have seen higher rates of COVID-19 spread. Experts say the disparity is due to a variety of factors, including language barriers, though data on the correlation between language and COVID-19 susceptibility, along with vaccination rates, is not widely available. In East Harlem, also known as “El Barrio,” where more than 50% of the community identifies as Hispanic or Latino, according to 2010 census data, the neighborhood at one point had the highest rate of COVID-19 spread of all ZIP codes in the city. In recent months, disparities in vaccination rates between white communities and those composed of other races and ethnic-

ities – where English is often not the primary language – have closed in some cases, thanks in large part to advocacy work and outreach efforts in nonwhite neighborhoods, coupled with the political drivers of vaccine skepticism in white communities. A recent study by the Kaiser Family Foundation found that the vaccination rate among white and Latino people was virtually even and lower among the white population in 17 states, including New York. To tackle the dissemination of bad information, along with the general lack of access to reliable public health messages about COVID-19 among non-English speakers, community leaders, including grassroots activists and elected officials, have had to navigate the various mediums that are frequently used by communities with large populations of non-English speakers. This includes media in their home countries,

WhatsApp channels and Facebook. Juan Haro, director of the advocacy group Movement for Justice in El Barrio, recalled a sensationalized storyline that came out of Mexico that was repeatedly cited by East Harlem residents there who said they were skeptical about seeking coronavirus-related medical care because of it. The narrative was about a coronavirus-infected woman whose distraught family blamed hospital staff for refusing to allow them to be with her in the hospital. Haro said El Barrio residents feared this meant they would be unable to leave the hospital if they sought coronavirus-related care. “It was very alarming for folks here, because, obviously, they’re in touch with their families back home, and they would sometimes hear these stories and begin to become concerned that entering a hospital may not be safe for them, that they might not be able to leave or they might die if they go into the hospital to get tested (for COVID-19),” Haro told City & State. New York City Council Member Shahana Hanif, who represents District 39 that encompasses Brooklyn’s Kensington neighborhood and is home to one of the city’s largest enclaves of Bangladeshi immigrants, said she, along with Bengali-speaking medical experts, regularly appeared on Bengali TV programs that were broadcast on Facebook and widely watched among members of the city’s Bangladeshi community throughout the pandemic. They used the air time to disseminate general information about the virus, along with coronavirus-relief programs. “Information consistently reaches folks we want to target … last,” Hanif said. “That sort of lethargy around language access is a deep failure. It is what makes access to language services and inclusive services life or death.” In addition to the language barrier, job constraints can also fuel the knowledge gap among non-English speakers, explained

Council Member Pierina Sanchez, who represents District 14 in the Bronx and is the daughter of Afro Dominican immigrants. “Our people work really hard, and they’re working grueling hours, multiple jobs often, and the traditional ways of reaching folks – they’re not going to see a Tweet or a very nicely designed graphic unless we are making sure it gets to them,” Sanchez told City & State. “I was with several other elected officials handing out test kits for COVID-19, and I can not tell you the number of conversations I had where people were like, ‘Wait, why do I need that? Is that the vaccine?’ … there isn’t widespread understanding of these things.” That dynamic has made in-person outreach all the more important, experts say. Movement for Justice in El Barrio recently hung 2,000 posters in Spanish around East Harlem urging people to get vaccinated. The organization also hosted a community meeting about COVID-19 relief services and medical care via conference call since many people in the community do not have access to reliable internet, Haro said. In addition to language barriers that prevent communities where English is not the primary language from receiving information about COVID-19 protocols, health care and the virus in general, there are additional layers of complexity that immigrant communities face that have made coping with the pandemic even more difficult. For example, non-English speakers often live in multigenerational households, making it harder to quarantine, hastening the spread of the virus. New York’s public health agencies have been criticized for failing to reach non-English speakers. The state was cited in a civil rights complaint filed by the National Health Law Program in April last year to force access to COVID-19 information in additional languages. The complaint noted that a state-run vaccination site in Manhattan’s Chinatown had no Chinese-language signs or interpreters. Since then, the city and state have made some strides in mitigating the language barriers. The New York City Department of Health and Mental Hygiene has partnered with faith and community-based organizations to conduct COVID-19 outreach in 16 languages, the agency told City & State. All health department materials posted online are available in at least 13 languages, the agency said.

“Prior to COVID, the NYC Health Department’s paid media campaigns relied on more targeted outreach to the audience that needed to be reached and planned for ad placement in the corresponding languages,” agency spokesperson Pedro Frisneda told City & State. “Given the citywide scope of the COVID-19 pandemic, we have developed citywide, multimedium, multilingual campaigns.” The city’s public hospital system, New York City Health + Hospitals, conducted a phone outreach campaign regarding the vaccine that made 19,000 calls translated into 86 languages between December 2020 and November 2021, the agency said. Health care providers also have access to translation services in over 200 languages at all New York City Health + Hospitals sites. “It is a priority of our public health system to ensure we’re reaching all patients with language-appropriate and culturally competent strategies that empowers them to make the best health decisions and feel comfortable being cared for by our staff,” the agency said in a statement. “This priority only grew more important with the COVID-19 pandemic, leading us to expand this work, including strengthening partnerships with community-based organizations.”

At the state level, staffers operating COVID-19 hotlines can provide interpretation services in over 100 languages, the state Department of Health told City & State. The state also pointed to a series of downloadable graphics and posters on its website as an example of its language-access efforts, but they are only available in English, Spanish and Chinese. The federal rollout of free at-home COVID-19 testing kits this week shows there are still serious shortfalls in government approach to language access. The Department of Health and Human Services-run website, where households can order tests, is only available in three languages. Rep. Grace Meng, who represents the 6th Congressional District, which encompasses Queens, tweeted that she is working with the federal government to expand language access on the testing kit website and ensure those who do not have internet access are able to place orders. Meng last year introduced a bill that would require the federal government to translate all COVID-19 information to the top 20 languages spoken in the U.S. “Ultimately, one’s grasp of the English language should never determine their ability and access to fighting against this pandemic,” she said in a statement.

The New York City Council announced its committee assignments, and as it turns out, it pays to support Speaker Adrienne Adams. Justin Brannan, who dropped out of the speaker race to back Adams, will chair the powerful finance committee, while Gale Brewer will head the investigations committee. But the real winner is Chi Ossé, named as the chair of the cultural affairs committee – a post that comes with a ticket to the Met Gala. If Ossé doesn’t serve a strong look at the gala, he’ll have to answer to us.
