During this City & State New York legislative forum sponsored by AARP New York, we will delve into key subjects including how lawmakers can strengthen nursing home oversight, including bolstering the Long Term Care Ombudsman Program and ensuring a strong healthcare and homecare workforce to serve older New Yorkers. We will also discuss ways to support unpaid family caregivers – who play a vital role in New York’s long-term care system – and the loved ones for whom they care, such as a caregiver tax credit and ensuring availability of home-and community-based services that allow New Yorkers to remain in their own homes.

ANYONE RIDING THE NEW YORK CITY SUBWAYS is all too familiar with the people who are homeless who have sought refuge underground and the risks those with mental illness pose to riders and themselves. One only needs to point to the tragic story of activist and homeless advocate Michelle Alyssa Go, who died after she was pushed onto the tracks and into the path of an oncoming train by a deranged man professing later he was “God.” Go’s death came less than two weeks after Adams and Gov. Kathy Hochul declared it was a “new day” for New York when they both announced on Jan. 6 they would collaborate and send more cops and social and medical service workers to address homelessness in the subways. In addition to Go’s slaying, New Yorkers like myself continue witnessing people engaging in harmful activities, and not just to riders. I stood on the downtown No. 1 subway platform at Columbus Circle about three weeks ago waiting for a train and saw someone on the uptown side jump into the tracks. The person searched around his feet and returned to the platform before the next train arrived. No one intervened. This wasn’t another attack on a subway rider, but it was still frightening thinking how this person had placed themselves in such danger, especially coming close to the electrified third rail and rats. It’s not the first time, nor will it be the last time people enter the tracks. But this sort of activity must finally stop before another person gets hurt. Adams’ and Hochul’s partnering on this crisis needs to move with greater urgency.

President Joe Biden visited New York City last week to discuss federal measures to combat gun violence with Mayor Eric Adams.

THE BIDEN OF BROOKLYN

New York City Mayor Eric Adams welcomed President Joe Biden to the Big Apple to talk about crime and gun violence. The visit came in the wake of several highprofile deadly shootings, including one that left

two police officers dead. With the president’s visit, Adams called for a “9/11-type response” to gun violence in the city. This comes after the mayor’s reintroduction of the controversial anticrime unit disbanded under his predecessor, given the task of targeting

gun crimes. Biden, meanwhile, used the opportunity to praise Adams’ response to crime in New York so far and to announce a new initiative from the federal government to investigate and prosecute crimes involving so-called ghost guns.

ASTHMA ALLEY Rep. Carolyn Maloney was the latest to draw attention to the harmful emissions created by the Ravenswood Generating Station – a fixture of Northeast Queens that has helped earn the area the nickname “Asthma Alley.” Maloney held a press conference outside Queensbridge Houses last week to rally support for federal legislation that would limit the permitting of other fossil fuelpowered plants.

The state Legislature has approved new district lines for congressional seats as well as for the state Senate and Assembly. With the maps getting the thumbs up, candidates and incumbents are beginning to evaluate where they should run – and if they even should – given the new district boundaries. State Sen. Alessandra Biaggi has floated the idea of running for the new 3rd Congressional District, which now includes parts of the Bronx and Westchester along with Long Island and Queens. Upstate, Rep. Claudia Tenney has been redistricted out of her seat, so rather than face off in a primary against Dutchess County Executive Marc Molinaro for the 19th Congressional District, she has opted to run for the seat neighboring her own. She technically lives outside the mostly Southern Tier district, but that’s not stopping her. Meanwhile, Rep. Chris Jacobs is reportedly planning to run for a district that stretches from Western New York to the North Country – which he also technically doesn’t live in. Plus, former New York CIty Mayor Bill de Blasio is reportedly eyeing a run for Congress against Rep. Nicole Malliotakis, whose Staten Island district now includes Park Slope in Brooklyn.

CUOMO FALLOUT EXPANDS

The sexual harassment allegations against former Gov. Andrew Cuomo have led to yet another casualty. This time, it’s now former CNN President Jeff Zucker, who resigned from his position after his failure to disclose a romantic relationship with a top executive came to light. How did this happen? The details arose as part of an investigation into Chris Cuomo, recently fired from the news network, and his role in counseling his brother on how to

handle the allegations. But Andrew Cuomo is still trying to maintain his influence outside of indirectly leading to others’ downfalls. The disgraced ex-gov – whom most have seen hide nor hair of for months – met with Adams to offer some “creative advice” for the new mayor. And the Oswego district attorney has dropped the last potential criminal case against Cuomo related to the alleged harassment, so he might be feeling like a comeback is in the cards as those around him continue to fall.

The company Eric Adams keeps New York City Mayor Eric Adams will meet with anybody – and we mean anybody. Even people most public relations consultants would probably rather have their clients avoid. Would Adams meet with disgraced former Gov. Andrew Cuomo, who resigned rather than face impeachment over multiple sexual harassment allegations, among other potential scandals, for a two-hour dinner in midtown Manhattan? Yes he would. Gang members who have murdered people? Yep. Republican billionaire John Catsimatidis the very week that Adams won the Democratic primary? Sure. Self-styled leaders of the Black Lives Matter movement who threatened “riots,” “fire” and “bloodshed” if Adams brought back the New York City Police Department’s plainclothes anti-crime unit? Why not? Bitcoin billionaire and independent presidential candidate Brock Pierce? Yes, Adams was with him on primary night. While Adams has had many eyebrow-raising meetings, none stack up to the time when Adams invited representatives of a raucous, angry, anti-vaccine mandate protest into Brooklyn Borough Hall for an audience with him. presumably, were vaccinated against COVID-19. A remarkable video shows the mayor-elect wading through the raucous crowd on Nov. 3, 2021. They lead a chant of “Fuck Eric Adams!” and “you are a puppet.” In the middle of that mess, Adams took the microphone: “I walked out of Borough Hall because I wanted to sit down with your coalition and hear you. There’s back entries of Borough Hall. There’s side entries to Borough Hall. I didn’t have to walk out the front door. I am the incoming mayor of the city. The first place we go is to sit down. And I’m saying to you, if you’re willing to have a small coalition come in and sit down, I’m willing to do that. If you don’t, then that’s up to you.” They took him up on the offer. Why does he take these meetings? “I rode a subway system in the mid-80s where the radio didn’t work, by myself, from 8 at night to 4 in the morning. There are not too many things that intimidate me or scare me,” Adams told City & State in November. “So when people see me walking inside a large crowd of people yelling and screaming and I’m drinking my smoothie unfazed because I’ve seen all that before.” – Jeff Coltin

Districts? Or Art? By Zach Williams

The congressional maps unveiled by Albany Democrats outlined new districts in the tradition of past masterpieces like the “Abraham Lincoln riding on a vacuum cleaner” across upstate. One proposed district resembles a giant outboard motor dropped into the Hudson Valley while another evoked a gigantic Pomeranian puppy. You be the judge in this intersection of the topographic and political dark arts. There are 26 new congressional districts remaining following the U.S. census that took one seat from New York. Here are four of them that look particularly inspired when it comes to their shapes on the new map approved by state lawmakers last week.

One of the three Magi might determine the political future of Rep. Jamaal Bowman, whose new district includes what appears to be a bulging, bearded head resting in Putnam County. Or, maybe it is the latest Suzuki outboard motor? Either way, the first-term lawmaker must come to terms with some type of power in his reelection race before he can pass the electoral finish line.

Democrats took a bite out of Republican congressional territory by creating a doggyshaped district that rips apart the current Central New York district represented by Republican Rep. Claudia Tenney. This is arguably the most adorable way that Democrats have inflicted potentially big scars on the GOP congressional delegation this year – and it’s particularly sweet for incumbent Democratic Rep. Antonio Delgado.

A humongous llama might be riding along Lake Ontario – and the Democrats are in the saddle! Just look at the sprawling district that runs from Western New York to the North Country. A solid blue district in Monroe County allows the Democrats to protect their own while making sure that incumbent GOP Rep. Chris Jacobs faces an extra long journey on the campaign trail compared to a current district centered much more on the Erie County side of things.

3RD CONGRESSIONAL DISTRICT

What is this? A shark heading east? A wooden Dutch shoe? Whatever Democrats are doing with joining parts of the North Shore of Long Island (currently represented by outgoing Rep. Tom Suozzi) with a slice of the Bronx and Westchester County, this Long Island Sound district might be the ultimate redistricting Rorschach test. Offers voters something to think about besides how this district best serves the public interest.

When there is an emergency, the MWBE rules are thrown to the side, and you award contracts on an emergency basis. But we agreed early on here at the MTA that we would not do that.

A Q&A with MTA Chief Diversity Officer

First off, how did the MTA award so many MWBE contracts in fiscal year 2021? The reason why we were able to do that is that our diversity and MWBE programs are aligned with the governor’s program. The MTA acting chairman and soonto-be chairman Janno Lieber, and the MTA board, holds my staff of 80 people accountable for not only assisting the MTA in awarding contracts in a costeffective manner because it’s taxpayers money being spent, but in an inclusive manner. And that means that if there are any impediments in the process, that is incumbent upon me and my staff to identify

them, come up with solutions so we can once again award contracts and spend dollars in an inclusive manner. We’re focused on solutions and not blinded by problems. How did you approach the coronavirus pandemic? How did it impact your contract awards? Anytime under ordinary circumstances, when there is an emergency or pandemic, the MWBE rules are thrown to the side, and you award contracts on an emergency basis. But we agreed early on here at the MTA that we would not do that, that we would go out into the marketplace and find the most qualified businesses, find the most qualified New

York state certified MWBEs and MTA certified DBEs (disadvantaged business enterprises), and we would afford them an opportunity. And so for an eight-month period, we were able to identify and spend money and contracts with New York state MWBEs totaling over $100 million. Every day, we shut down the system for three hours, and we disinfected all of our trains and subway stations. Some of those companies that had that responsibility, they were certified MWBEs who were disinfecting our subway stations and trains. And we bought a whole lot of COVID-19 products from certified MWBEs. And so the message that we sent, although it is an emergency and MWBEs need not to apply, that’s a myth. We

went out and we secured the services of a record number of MWBEs and totaling over $100 million in contract awards during COVID-19. When you say emergencies, what were some of those past emergencies that diverted that funding? Hurricane Sandy, getting our system back up and operating. Fixing subway stations that were flooded by Sandy. It is regular standard operating procedure that when there is an emergency, that the MWBE and other procurement rules go out the window and they’re thrown to the side. But during COVID-19, we dispelled that myth, and we went out and actively

sought minority- and women-owned businesses. Do you expect to meet your MWBE goals in this current fiscal year? We are on track. We are entering the fourth quarter of the New York state fiscal year, which ends on March 31. We are at 29.6% MWBE inclusion. So I anticipate that at the end of the day, that the MTA will remain the leader in this region with affording opportunities to New York state certified MWBE firms, MTA certified DBE firms and there will be a lot of payments made to these firms during this current fiscal year. – Ralph R. Party of the decade

D

lyn has been replaced by lines that now stretch into more Democratic areas like Brooklyn Heights. The addition of blue areas to the southern side of the Long Island district held by James Gaughran, one of eight Democrats who flipped GOP state Senate seats in 2018, was another example of changes aimed at helping Democrats avoid tough reelection fights in the future. The proposed state Senate map could help Democrats expand their 44-seat supermajority in the upper chamber. Republican state Sen. Sue Serino might have to run in a redrawn district whose voters favored President Joe Biden in the 2020 cycle. It also remained unclear which Republican might run in a new district that included upstate Democratic bastions like Saratoga Springs and Troy. Other proposed districts that went big for Biden over Donald Trump in 2020 included a seat based in the Southern Tier and another in Suffolk County. The 2021 election results included some big wins for Republicans, but none of them made any difference in a state Senate where they will have to defend more historical turf later this year. There are not quite enough Democrats from New York

City and its suburbs to maintain Democrats’ longtime supermajority in the Assembly, so they will once again have to defend upstate seats to keep at least 100 seats in the 150-member lower chamber. Assembly Member Jennifer Lunsford could run for reelection in a district that went overwhelmingly for Biden in 2020 while she narrowly beat a Republican incumbent. Democrat Monica Wallace is losing some Republican areas in the outskirts of Buffalo while Democrat Al Stirpe of the Finger Lakes will be getting a few more Democratic enclaves. The Democrats, however, are not making life more difficult for every Republican. The only Re-

EMOCRATIC DOMINANCE in state politics is about to reach a whole new level as the decennial redistricting process approaches its conclusion. Albany Democrats are expected to approve new legislative lines for the state Senate and Assembly that benefit their incumbents while making it harder than ever for Republicans to regain any of the electoral ground they have lost in recent years. Call redistricting the latest step in a multiyear process that is now making one-party rule by Democrats a permanent fact of political life three years after the party won control of the state Senate for the first time in a decade. “It’s a generational shift,” said Basil Smikle Jr., a political consultant and former executive director of the state Democratic Party. Many of the changes included in the proposed map for the 63-seat state Senate appeared to be aimed at helping Democrats keep more than a dozen seats that Republicans have historically controlled. Rochester and Syracuse are being split to help Democratic incumbents. The district gerrymandered a decade ago to help former GOP state Sen. Marty Golden win reelection in southern Brook-

publican to beat an incumbent Democrat in the Assembly in 2020 – Michael Lawler of the Hudson Valley – for example, gets to run for reelection in a district that appears more favorable two years later. Democrats have been accused of using redistricting to strengthen their position in the state Legislature despite criticizing gerrymandering in the past. “As we unravel the gerrymanders of the past, it doesn’t make it a gerrymander of today,” state Senate Deputy Majority Leader Michael Gianaris, who chaired the legislative task force that oversaw redistricting along with Assembly Member Ken-

neth Zebrowski from the Hudson Valley, said on “The Brian Lehrer Show.” “These are districts that are drawn fairly,” Gianaris added. Whether or not Gianaris’ rationale rings true despite the proposed Democratic-friendly lines, Republicans did use methods other than line-drawing to help them maintain their state Senate majority in the past. Packing more people in Democratic districts versus GOP areas was one strategy. Republicans could defy expectations and somehow win back control of the state Senate despite all the ways that Democrats are making that more difficult through redistricting. The

GOP could better mobilize their base or figure out ways to appeal more to voters. The Democrats, after all, won control of a gerrymandered state Senate in 2018, but it won’t be easy for the Republicans to do this time. One-party rule is here to stay in New York thanks to a redistricting process that comes down to which party holds power at just the right time despite highly publicized reforms. “It’s pretty much what the Republicans would have done if they had the pencil,” political consultant Hank Sheinkopf said in an interview of the proposed maps. “But Democrats have the majority, so they have the pencil.”

For Black political power, take the A train – to Brooklyn Last year’s election successes showed the might of the brough’s African American and African Caribbean voters. By Clem Richardson

HE NOVEMBER elections in New York City made one thing clear: Brooklyn has usurped Harlem as the city’s seat of Black political power. Mayor Eric Adams and Public Advocate Jumaane Williams, who each handily won citywide office, are from the “Borough of Churches.” They join a powerful roster of Democratic incumbents from Brooklyn now in city, state and federal offices, including state Attorney General Letitia James, Rep. Hakeem Jeffries, who is considered a leading candidate to replace House Speaker Nancy Pelosi if she steps down, and Assembly Member Rodneyse Bichotte Hermelyn, who is the first woman and first Black woman to lead the Brooklyn Democratic Party, which is one of the largest party organizations in the country. Adams, Gov. Kathy Hochul and Williams, who is running against Hochul in the Democratic gubernatorial primary, were there on Dec. 9 as Bichotte Hermelyn

presided over the party’s Democratic Blue holiday fundraiser and toy drive at the Broadway Stages in Williamsburg. James, who announced earlier that day that she was abandoning her run for governor, did not attend. Adams made note of the party’s citywide election successes. “Look what you have done in Brooklyn,” he said. “You have a public advocate from Brooklyn. You have an AG from Brooklyn. You have a comptroller from Brooklyn. You have the mayor, from Brooklyn.” “Brooklyn!” the crowd yelled gleefully back. “Clearly the center of gravity of where the Black electorate is has shifted,” said John Flateau, executive director of the DuBois Bunche Center for Public Policy at Medgar Evers College and author of “Black Brooklyn: The Politics of Ethnicity, Class and Gender.” “We have such a larger base in Brooklyn, Queens and the Bronx than in Harlem. That’s a fact.” Flateau, a veteran political strategist, worked on the presidential campaigns of Jesse Jackson, Michael Dukakis, Hillary Clinton and Barack Obama. He also worked on the mayoral campaign of David Dinkins, New York’s first African American mayor, helping to map strategy with the legendary operative Bill Lynch. Harlem’s “Gang of Four,” under the tutelage of patriarch J. Raymond Jones, used their political acumen, organizational skills and the communal need, primed by the ’60s era civil rights struggle then rocking the nation, to bring services to their community to rally voter support. Each of the Gang of Four – Dinkins, Basil Paterson, Charles Rangel and Percy Sutton – would go on to break new political ground for African Americans in the city and state. Dinkins would be an Assembly member, president of the Board of Elections, city clerk and Manhattan borough president before being elected mayor in 1989. Paterson was elected to the state Senate and was a deputy mayor before serving as then-Gov. Hugh Car-

ey’s secretary of state. Rangel was first elected to the Assembly in 1966 and to Congress in 1971, where he served until 2017. Sutton was elected to the Assembly before serving as Manhattan borough president from 1966 to 1977. The four brought enormous resources and political clout to Harlem and the city, including helping to elect protégé H. Carl McCall as the first Black state comptroller, and selecting Paterson’s son, David, as then-Gov. Eliot Spitzer’s lieutenant governor, unknowingly placing him in line to become the state’s first Black governor when Spitzer was forced to resign in March 2008. But their long political careers – which spanned from 1966 to 2017 – and their reluctance to step aside or anoint successors have been often cited as reasons for Harlem’s political waning, epitomized by the 2016 loss of the 13th Congressional District seat to then state Sen. Adriano Espaillat after Rangel’s retirement. Yet, Brooklyn’s ascent has less to do with Harlem’s inability to hold on to power or any organized, long-term political strategy played out through the years, and more to do with an alignment and exploitation of the traditional elements of successful political campaigns everywhere: favorable demographics, organized voter education and turnout, homeownership, activist and progressive “anti-machine” politics, access to money through traditional channels as well as grassroots and independent fundraising, and an informed electorate, Flateau said. Brooklyn also has a legacy of powerful Black politicians – before there was Rep. Shirley Chisholm there was Bertram Baker, “The Boss of Black Brooklyn,” whose 1948 election made him the first Black person to be elected to the Assembly, and Wesley McDonald “Mac” Holder, who in 1953 got Brooklyn’s first Black municipal court judge elected and was a behind-the-scenes force in the borough until his death in 1993 at 95 years old. Holder, a native of Guyana, had long contended that Black people could control Brooklyn politics if they could get past their differences. Yet, unlike in Harlem, some pre-

scient longtime Brooklyn officeholders set up dynasties of their own, particularly Rep. Edolphus Towns, in office from 1983 to 2013, and Rep. Major Owens, in office from 1983 to 2017, so that younger politicians, in these cases Jeffries and Yvette Clarke, respectively, could take their places. “A coalition of politicos and organized labor nudged a leadership transition,” Flateau said of the behind-the-scenes discussions various Black Brooklyn organizations held with Owens and Towns. “There were truth-telling sit-downs with them that concluded that it was time to usher in new blood.” Flateau worked as Clarke’s 2016 campaign manager when she succeeded Owens in Congress. Jeffries, with the support of several Black political organizations, won Towns’ vacated seat in 2012. “People are always talking about empowering the community for the future, but a lot of what happened in Brooklyn is that people had to stop being selfish with their power,” said Ernest Logan, a longtime Brooklyn resident and former president of the Council of School Supervisors & Administrators, the union that represents the city’s public school principals. Logan and his political director Herman Merritt would meet with candidates running for various offices to decide whom the council would support. Harlem, just north of Manhattan’s pricey Upper East Side and Upper West Side neighborhoods, was an early target of gentrification by young, mostly white professionals looking for affordable homes, and of developers eager to exploit that emerging market. Crime dropped citywide in the early ’90s, increasing Harlem’s salability. Gentrification further eroded Harlem’s vaunted Black electoral base, Flateau said, by driving up prices beyond the reach of many young, Black professionals who might otherwise have bought homes vacated by their parents and other retiring Black baby boomers. Many of Harlem’s older residents sold their homes, using the profits to move to less costly parts of the state and country. According to statistics from New York University’s Furman Center, Central Harlem was 54.3% Black in 2019, a sharp drop from 77.3% in 2000. Shirley Chisholm Cultural Institute, which works to keep Chisholm’s legacy alive. “We began to see the same thing in Brooklyn, especially as Spike Lee brought Brooklyn culture to the masses and young, Black and white, educated people started to want to move here.” Chisholm was the first African American woman elected to Congress in 1968 and the first to seek the Democratic presidential nomination in 1972. Many of her Brooklyn political successors see her as a role model. “Mrs. Chisholm is our idol,” Bichotte Hermelyn said. “Her ‘unbought and unbossed’ leadership style inspired so many politicians from this generation.” Brooklyn’s African American politicians have also benefited from a large, politically active Caribbean immigrant population. New York City is home to the largest Caribbean community in the U.S., many of them in Brooklyn and Queens. Immigrants tend to settle near other immigrants and create communities, which led to organizing around political issues affecting them. Former New York City Council Member Una Clarke, mother of Rep. Yvette Clarke, said long before she ran for office,

she and other Caribbean community members would go to Washington, D.C., to lobby members of Congress about issues affecting their native countries. “We had no Caribbean American congressman from New York,” she said. “We would go there and see what our ambassadors were doing and saying in Washington and try to help them to drive a fair-trade agreement with the U.S.” The Capitol trips also pressed home the need to become U.S. citizens. “The best way to empower one’s community is to run for public office, and that is no different for Blacks, Asians or whites or anyone else,” Clarke said. “When you go to the White House and you’re a citizen, it is different than when you go as a noncitizen because you can’t hurt anybody if you can’t vote.” “In Harlem and the South Bronx, you have large, noncitizen immigrant populations,” Flateau said. “Brooklyn and Southeast Queens have large Afro Caribbean populations, but citizenship rates have been growing in this group, which converts to Black voters and electorates.” Brooklyn also benefited from the slower, still ongoing gentrification that swept through neighborhoods closer to Manhattan – Fort Greene, Cobble Hill, parts of Bedford-Stuyvesant, and Crown Heights –

but has yet to gut homeownership among the working, middle and professional classes of African Americans and African Caribbeans in central Brooklyn neighborhoods like Flatbush and East Flatbush, which are also seeing a racial shift. According to the Furman Center, Bedford-Stuyvesant was 74% Black in 2000 and 54% Black in 2019; Flatbush and Midwood were 37.4% Black in 2000 and 33.6% Black in 2019; East Flatbush was 88.7% Black in 2000 and 85.8% Black in 2019; and Brownsville was 75.9% Black in 2000 and 68.4% Black in 2019. Black residency increased in Brooklyn neighborhoods further from Manhattan. Flatlands and Canarsie were 51% Black in 2000 and 62.1% Black in 2019, and East New York and Starrett City’s Black residents climbed from 45.7% in 2000 to 55.4% in 2019. “There are fewer Black homeowners in Harlem than in central Brooklyn, where you have these huge swaths of brownstones, some now owned for two or three generations,” Flateau said. “We’re starting to lose some of that homeownership, but many middle-class, young Black professionals are still in these neighborhoods, and some are even moving back.”

When organized and motivated, this translates to political power. Last year, Brooklyn had eight Black representatives in the Assembly, four state senators and two representatives in Congress, making it one of the largest concentrations of African American elected officials in the country. “I always knew Brooklyn had the potential (to be the center of Black political power in the city), just based on the population, once people have the desire to offer themselves for public service,” Una Clarke said. “Public service is always desirable for those who are giving and who want to help other people.” “It’s one thing to have the numbers, but you also have to have the brainpower and strategic voter mobilization,” Flateau said. “Just because you can count heads and have the numbers doesn’t mean that politicians know what to do. The people will choose their leaders in that zeitgeist and their agenda for the promise land.” “It’s no surprise that our borough is home to so many dynamic Black politicians and will continue to be so,” Bichotte Hermelyn said. “Brooklyn is a gorgeous mosaic of diversity filled with Democrats of all ideologies, from nearly every background, ethnicity, religion and race. Despite their differences, they are

all leaders who reflect, understand and are devoted to uplifting and uniting all Brooklynites.” How long Brooklyn’s Black politicians can wield the crown is anyone’s guess. While political power may have hopped the A train from Harlem to Brooklyn, crowns tend to fit any head with the organization, money and numbers to grab it. And as Bichotte Hermelyn said, some very smart and ambitious people of all races are Brooklyn Democrats. But those seen as out-of-step with the party can feel its wrath. Bichotte Hermelyn has already clashed with younger Democrats who see her as part of the old party machine. “I know I won’t be Brooklyn county leader forever,” Bichotte Hermelyn said. “Young people are our future, and I fully believe in our youth to lead the party forward. Our party’s youth arm, the Brooklyn Young Democrats, serves as a great incubator for the next generation to carry on the torch.” Adams may have foretold the future as he exhorted the party crowd to continue to work together. “Everyone knows that working with Democrats is like herding cats,” he said. “It is going to take time.”

Alvin Bragg’s rough and tumble first month as Manhattan district attorney.

M

ANHATTAN DISTRICT ATTORNEY Alvin Bragg has learned some hard lessons about New York politics during his first month in office. In the first memo to his staff, he laid out the progressive vision for the office that he campaigned on, which included reduced charging guidelines for certain crimes. The political backlash was immediate. The cover of the New York Post proclaimed, “Happy 2022, criminals!” While the Daily News said, “Small-time crimes get a pass.” “So yeah, the rollout was bumpy,” Bragg said in an interview with City & State. Since those first days in office, the borough’s top prosecutor has taken a more measured approach to his public-facing persona and made strides to smooth over the criticisms. He took responsibility for the ill-timed memo, which was released amid a series of horrific crimes, including the subway-shoving death of Michelle Go, and he has met with some of his toughest critics. On Feb. 4, he issued another memo to staff, which clarified some of the positions he outlined in January. While Bragg and New York City Mayor Eric Adams have

largely kept the peace in the press, the new mayor, a former cop, has introduced his own policies on policing and criminal justice, many of which involve tactics Bragg has called problematic. Adams said the NYPD will reinstate a disbanded plainclothes police unit to address gun violence, hire more cops and deploy additional officers to the subways. Adams called for judges to be allowed to consider “dangerousness” in making bail and sentencing decisions, advocated for bringing back the selective use of stop-and-frisk policing and prosecuting 16- and 17-year-olds caught with guns as adults. Although Bragg has worked to reform many of these policies throughout his career, he remained steadfast in presenting a united front with the mayor and steered clear of criticizing his plans. “What I’ll say is, I look forward to talking with the mayor about it. The mayor and I have talked … to each other about policies and not policymaking through the press,” Bragg told City & State on Jan. 25, days before he met with Adams and the city’s four other district attorneys to review the mayor’s gun violence plan. “Obviously there was a speech and there was a program put out, but (I’m) really looking forward to engaging more and talking.”

A RECORD OF REFORM Bragg has both personal and professional experience with the policing style Adams has committed to restoring. He has spoken openly about regular encounters with police while growing up in Harlem during the crack epidemic. He recalled having a gun pointed at him six times during his childhood, including three times by police. He said the experiences of people close to him in the criminal justice system have also weighed heavily on his perspective. For example, in laying out plans to be more selective in prosecuting gun possession cases, Bragg referenced his brother-in-law, who he said was wrongfully convicted of gun possession. “He was in a schoolyard fistfight. One of the kids – they were in college – who was arrested had a gun on him, and they were all charged with gun possession. So he went to jail for more than a year for a gun that he never touched and didn’t know anything about. That kind of case is not one that’s worth prioritizing,” Bragg said. On the return of stop and frisk, Bragg has been outspoken about its history of ineffectiveness and bias, and it’s a topic he probed as the state’s executive deputy attorney general for social justice under then-Attorney General Eric Schneiderman. Bragg led an investigation that concluded just 3% of stop-and-frisk interactions by the NYPD between 2009 and 2012 resulted in convictions and 0.1% of the stops resulted in convictions for a violent crime, according to his campaign website. And while Adams has pushed for the

rollback of the Raise the Age law that prohibited 16- and 17-year-old from being prosecuted as adults for most crimes, Bragg said he “wholeheartedly agree(s)” with the legislation and will ask attorneys to apply “a stringent standard” when requesting teens be processed as adults. “I will not hesitate to overturn the decision of an ADA if we are overusing the ‘exception’ here,” according to his campaign materials. Bragg’s chief of staff, Jordan Stockdale, helped implement the Raise the Age legislation while working at the Mayor’s Office of Criminal Justice as deputy executive director of the Close Rikers initiative. As for the plainclothes unit, Bragg said there were merits to undercover police work, which he had leaned on in certain long-term investigations in his previous roles as a federal and state prosecutor. At the same time, he acknowledged the fraught history of the NYPD’s plainclothes unit and its history of racial profiling. “I’m well aware, and I’ve been outspoken about them,” Bragg said of the previ-

ous issues with the unit. “I approach a lot of issues through a racial justice lens … but as I understand the mayor has a new version of this, and I want to engage with him and talk about how that plays out on the ground.” A graduate of Harvard Law School, Bragg most recently served as co-director of the Racial Justice Project at New York Law School, where he is still an adjunct professor. The project is aimed at advocating for reduced prison time for people who were sentenced under outdated laws, and works on discrimination and civil rights cases, among other initiatives. While working under Schneiderman, Bragg was appointed in 2015 to lead a Special Investigations and Prosecutions Unit to examine the deaths of unarmed people killed by the police. He spent the days before the November election questioning members of the New York City Police Department in a judicial inquiry into the 2014 police killing of Eric Garner, whose family was represented by Bragg. Garner was killed during an arrest

The recent political attacks have been a sharp turn of events for Bragg, 48, who made history as Manhattan’s first Black district attorney and was widely viewed as a fresh face coming into a role long held by members of New York’s political dynasties. He was well-liked in the legal community and earned endorsements from his former boss, Preet Bharara, Rep. Jerrold Nadler and The New York Times. Having worked on criminal justice reform issues throughout his career, Bragg’s election was seen as symbolic of New Yorkers’ appetite for change. But in the face of increasing crime in certain categories, including rising gun violence during the pandemic, and wounded morale among the police after two officers were killed in Harlem, Bragg has the unenviable task of figuring out how to make the city safer and the criminal justice system fairer at the same time.

for selling loose cigarettes on Staten Island by a former member of the NYPD plainclothes unit, Daniel Pantaleo. “I’m a prosecutor who’s prosecuted people who have done assault, done armed robbery, done gun violence. I’m also a prosecutor who prosecuted law enforcement, and public officials who’ve committed misconduct,” he said. CRIMINAL JUSTICE MESSAGING Considering Bragg’s perspectives were well known and publicly documented before he took office, observers said the backlash to his memo was in some ways more reflective of the political climate, Bragg’s greenness as a first-time elected official and a product of ill-fated timing, more so than with the policies themselves. “I have felt really compelled to defend Alvin, because so many of these criticisms have been just so outrageous, unfair, and really, intellectually dishonest,” Eliza Orlins, a public defender who ran to the left of Bragg in the Democratic district attorney primary before campaigning on his behalf in the November general election, told City & State. “So many of the things in his memo –

which, you know, not to say it was the best PR decision in the world – but so many of these things weren’t even being prosecuted by the Manhattan district attorney’s office over the last handful of years,” Orlins said. Indeed, Bragg’s predecessor Cyrus Vance Jr. had already stopped prosecuting numerous crimes listed in Bragg’s memo, including marijuana possession, prostitution and fare evasion. In responding to criticisms, Bragg clarified that his assistant district attorneys have discretion in making charging decisions and that his policies were meant to be a framework, rather than an edict. “Look, it’s a legalistic memo with statutory (citations). It’s dense. Its primary audience was career, experienced, great lawyers in the office. And, you know, putting that out in the public domain without appropriate context led, understandably, to some people being confused about how we would carry out our mission of public safety,” Bragg said. The memo was published on the district attorney office’s website without any sort of accompanying press conference or public explanation, a PR bungle that was not lost on Bragg.

“The big lesson to me was providing context and having a conversation, and not sort of putting out a static document,” Bragg said. PARTY HEADACHES Bragg’s memo, and new policies, has become the latest talking point in conservative media, including in the New York Post and on Fox News. “We do have a problem with our narrative,” state Democratic Party Chair Jay Jacobs told City & State. “We have to work to make sure that our message does not aid the Republicans who are trying to politicize public safety rather than deal with it.” Jacobs said the criticisms of Bragg were “too early” and “unfair,” but emphasized the importance of Bragg “explaining and selling ideas to the public so they understand what the objective is and what the benefits are.” “I think we ought to give the district attorney a little bit of latitude. He just started. He’s got a big job ahead of him, and I think he’s doing the best that he can to balance all the ideas that need to be considered to achieve his goal,” Jacobs said. At the same time, political observers said Democrats have bowed to pressure from the right to tone down the talk of criminal justice reform. “Equally to blame is the amateurish way Democrats have allowed the GOP to drive messaging around criminal justice reform in what amounts to Demo-

DONALD TRUMP By far the most watched case on Bragg’s plate is the office’s potentially history-making investigation of Trump’s business practices. If Bragg decides to indict Trump, he will be the first former president ever charged with a crime. Prosecutors are probing whether Trump defrauded lenders by inflating the value of his assets. As part of the

Philadelphia District Attorney Larry Krasner, like Bragg, spent much of his career probing law enforcement and also promised to stop prosecuting certain low-level offenses, faced calls for impeachment from Republicans but won reelection last year. And in Nassau County, a debate over the merits of bail reform imperiled Democrats in the November election, when voters chose Republicans Bruce Blakeman and

inquiry, Vance battled Trump for years to obtain his tax records and finally secured them in February last year following a U.S. Supreme Court ruling. The investigation led to charges against the Trump Organization and its chief financial officer, Allen Weisselberg, who was indicted on 15 tax-related counts in July last year. Bragg has said he will keep the prosecutors who are currently leading the Trump probe in place and give the investigation his own personal attention. “We’re gonna follow the facts as I’ve done for the last 20-plus years in complex white collar cases and in all cases,” Bragg told City & State. “So we have the team leadership,

which provides continuity, and we’ve got some people coming in … to the office with fresh eyes, and I think that’s a good partnership.” MARTIAL SIMON In another horrific, high-profile killing last month, Simon is accused of pushing subway rider Michelle Go to her death on the tracks. Go was at a Times Square subway station on Jan. 15 when Simon allegedly shoved her into the path of an oncoming R train just after 9:30 a.m. The two did not know each other, authorities have said. The case has brought more attention to crime, homelessness and mental health – issues that

Anne Donnelly to be their new county executive and district attorney, respectively. The criminal justice tug-of-war was reflected in other responses to Bragg’s memo. Gov. Kathy Hochul issued a veiled threat on Jan. 26, following a call from Republican gubernatorial candidate Rep. Lee Zeldin to remove him from office and a commitment from Rep. Tom Suozzi, one of her challengers in the Democratic primary, to oust him if he was elected governor. “I know full well the powers that the governor has,” said Hochul, who met with Bragg on Jan. 28 and had what she called a “productive conversation.” She later urged the public to “cut him some slack.” Bragg’s office said in a statement the two discussed “the importance of accountability, preventing shoplifting by breaking up burglary rings, keeping the trains safe, deterring brazen conduct and reducing gun violence.” While Bragg has spent large swaths of his career investigating police misconduct, he now finds himself in a position where he must partner with a police department whose unions and brass have scared many progressives into silence with their sharp criticisms of reform. Those dynamics weighed heavily on the tail-end of former New York City Mayor Bill de Blasio’s tenure, to the point where he refused to criticize blatant unnecessary uses of force. Police blamed his reform rhetoric

have received renewed focus as the city urges passengers to return to the trains following plummeting ridership during the pandemic. Simon, 61, is homeless and has a long history of mental illness. He turned himself in to police minutes after the attack and is being held at Bellevue Hospital in Manhattan while a judge awaits a psychiatric evaluation in the case. WINSTON GLYNN Glynn is facing charges of first-degree robbery and murder in the Jan. 9 shooting death of Kristal BayronNieves. Bayron-Nieves, 19, was working at an East Harlem Burger King when

for anti-police sentiments that played out in the form of mass protests last summer in the wake of the police killing of George Floyd in Minneapolis. So it’s no surprise that Adams, a former police captain, has called for the reversal of reforms that the police hate. Newly appointed NYPD Commissioner Keechant Sewell, who also met with Bragg since his memo was released, has been outspoken about her concerns regarding his policies. In a powerful rebuke, the widow of police Officer Jason Rivera, who was killed while responding to a domestic violence call in Harlem on Jan. 21, spoke directly to Bragg while eulogizing her late husband during his funeral at St. Patrick’s Cathedral. “The system continues to fail us. We are not safe anymore, not even the members of the service. I know you were tired of these laws, especially the ones from the new DA,” Dominique Luzuriaga said to applause as Bragg sat just a few pews away. “I hope he’s watching you speak through me right now.” Following Luzuriaga’s comments, Bragg issued a statement that “violence against police officers will never be tolerated. My office will vigorously prosecute cases of violence against police and work to prevent senseless acts like this from ever happening again.”

Glynn came in around 1 a.m. demanding cash from the register, police said. Before shooting Bayron-Nieves, he allegedly punched the restaurant manager and pistol-whipped another customer. Glynn fled the scene with just $100 cash and was arrested five days later in Brooklyn, authorities said. At his initial hearing, which Bragg attended, a judge granted the office’s request to hold Glynn without bail. Authorities are also probing whether Glynn, 30, and another man whose most recent address was a homeless shelter had a history of mental illness. He is due back in court on Feb. 14.

A FRESH FACE Bragg was elected on a promise of rebuilding trust in the criminal justice system by reducing the use of pretrial detention in favor of rehabilitation and diversion, sending fewer people to jail and limiting prosecution of low-level crimes that disproportionately target Black and Latino New Yorkers, among other measures. He defeated seven candidates to win the June primary with 34% of the vote, edging out his closest competitor, Tali Farhadian Weinstein, by 4 percentage points. Farhadian Weinstein, also a former prosecutor who is married to hedge fund manager Boaz Weinstein, poured $8.2 million into her own campaign, which was backed by prominent Wall Street and real estate executives. She was more reminiscent of the office’s predecessors than Bragg. Before Bragg, Manhattan had had just four district attorneys since the 1930s, the most recent of whom – Vance and Robert Morgenthau – came from powerful families with long histories in public service. Bragg, meanwhile, pledged not to take any donations from corporations or lobbyists. But that doesn’t mean he can steer free of the business community now that he’s in office. In the wake of his memo, he met virtually with a group of about 75 business leaders, including retailers and executives, to address their concerns over crime in the city.

CUBA GOODING JR. The Oscar winner is facing sex abuse charges related to three separate incidents at Manhattan nightclubs. After he was arrested in June 2019 and charged with groping a 28-year-old woman while at the Magic Hour bar in Midtown, two additional women came forward alleging he grabbed them in 2018 in separate incidents at Lavo and Tao nightclubs. Both the Tao and Magic Hour encounters were caught on surveillance footage and aired in media reports. Gooding, 54, is charged with six counts of misdemeanor forcible touching and sex abuse. He has pleaded not guilty. A trial date has not been set.

ROBERT CARMONA One of four individuals accused in a 141-count, multistate gun bust, Carmona is charged with selling weapons in front of the West 55th Street building where he worked as a doorman. Authorities also allege he stored ammunition in his work locker and sold additional firearms out of his home in Morningside Heights. Within a six-month period last year, he sold a total of 80 weapons, most of which were purchased in Tennessee and obtained by Carmona through a middle man, officials have said. Carmona has been jailed at Rikers Island since he was ordered held without bail following his October arrest. – Sara Dorn

“He reaffirmed his steadfast commitment to public safety and quality of life in Manhattan, and he reaffirmed he intends to take the steps required to keep the city safe and secure,” attorney Brad Karp, chair of the firm Paul, Weiss, told City & State about the meeting. Karp, who donated $1,000 to Bragg’s campaign, is also a board member of the Partnership for New York City, which hosted the virtual sit-down. “I fully expect that he meant what he said. I do have great confidence in his judgment,” Karp said. “He was a very tough prosecutor, and I believe he’ll be relentless in pursuing justice, but he also recognizes, appropriately, there is room for improvement in our current criminal justice system to be fair and measured in appropriate circumstances.” Bragg also announced the formation of an alliance of small business organizations, owners and criminal justice experts to find solutions to shoplifting and robberies. The alliance is co-chaired by Ken Giddon, owner of Rothmans, a men’s clothing store. Giddon, in a New York Post column earlier this month, called Bragg’s memo a “punch in the gut” after he said his store was robbed twice by the same group of men in late December. Of particular concern to retailers is Bragg’s directive to downgrade felony robbery charges to misdemeanor petit larceny if “the force or threat of force consists of displaying a dangerous instrument or similar behavior but does not create a genuine risk of physical harm.” At the core of that policy was Bragg’s desire to address underlying drug use that drives some users to steal. The intent of his memo in general, and this provision specifically, was to ensure prosecutors were examining each case on an individual basis, rather than applying a single standard, he said. “You go in with a bat, and you’re waving it around while robbing a store, that’s a violent felony, that’s going to be treated as such,” Bragg said. “There are subcategories where it is, you know, fueled by an addiction, and I think that needs to be treated differently.” Bragg hoped that doing so would help close what reformists often refer to as the “revolving prison door.” “The person goes to Rikers, they stay there for 60 days, and they come right back, and they do it again, right? And so I don’t know anyone who thinks that’s good, or that’s working … and that’s what peo-

ple want to stop. By connecting that person with services, it’s going to stop,” he said. SIGNATURE POLICIES Bragg laid out a gun violence strategy that included targeting the “small number of people who are responsible for a devastating amount of the violence,” along with gun traffickers and domestic violence offenders. The issue has been at the heart of the city’s public safety debate as gun violence climbed last summer to levels not seen since the late ’90s. ample, Bragg said he will look to the office to “take a case that’s really about one gun and turn into a case that’s about 20, 30, 40 or 50 guns.” Part of that model hinges on community intervention and advocating for gun control legislation, among other measures. Bragg also said he will do away with low-level gun possession cases. “Targeted enforcement means … that we will do away with the most common outcome in current gun prosecutions: 1-3 year jail or prison sentences for the possession of a firearm,” Bragg wrote on his campaign website. “These cases do not meaningfully incapacitate those who truly drive gun violence, but they force those who are not drivers of violence onto a path that almost inexorably leads to recidivism.” Bragg said he was concerned that his gun possession charging guidelines were “lost in translation” and emphasized that cases in which charges will be reduced “are pret-

ty exceptional matters,” like his brotherin-law’s case. In a Feb. 4 memo to his staff, Bragg clarified his previous statements and said people carrying guns on the streets will be prosecuted. “The default in gun cases is a felony prosecution,” he wrote, which can typically be up to four years in prison. He also took heat for saying he will not prosecute certain minor crimes, including fare evasion, prostitution, marijuana possession and trespassing. He pointed to statistics that showed misdemeanors account for 82% of cases in the city, with Manhattan having the highest misdemeanor prosecution rate, by far, of any borough. Instead, he wanted the office to focus on sexual assault, gun violence, public corruption, major economic crimes and white-collar crimes, the latter of which he said was part of an effort to close the gaps in racial and economic disparities within the criminal justice system. People arrested for selling drugs while “acting as a low-level agent of a seller” will not be charged with a felony, but instead be charged with misdemeanor possession of a controlled substance. Among Bragg’s other major tasks will be to reform the office’s handling of sex crimes, an issue Vance came under fire for and was a frequent topic during the campaign. Vance famously dropped sex abuse cases against former International Monetary Fund chief Dominique Strauss-Kahn and movie producer Harvey Weinstein. He also dropped a case against Ivanka Trump and Donald Trump Jr. in spite of mounting evidence they misled condo buyers at Trump SoHo by claiming the units were selling faster than they actually were. These moves were widely seen as catering to the elitist class in Manhattan. Bragg’s election was seen as a referendum on the good old boys’ club that critics said had dominated the Manhattan DA’s office for centuries. But now his promises to address the concerns of minority communities are being tested during his first weeks in office. “We’re really at a crisis point with 15 people dying on Rikers Island last year. And amidst this backdrop, voters in Manhattan cast their ballots for Alvin Bragg,” said Lauren-Brooke Eisen, director of the Brennan Center’s Justice Program and co-chair of Bragg’s transition committee. “And he campaigned on this platform that he could deliver both fairness and justice to New Yorkers. And that’s a really important promise, because we know so much about how the criminal legal system is unjust.”
