THIS WEEK, New York City Mayor Bill de Blasio is expected to join a crowded field of Democrats seeking the White House. In a press conference last week, he said he would make a decision based on family considerations while assessing the polling that his political action committee conducted in Iowa. “It’s a family decision. It has a huge impact on the family, and as you know, I’ve always been deeply connected to my family, including in public life,” he said. “But it’s natural to take into account other factors.” Even if he’s polling poorly, it may matter little to de Blasio. In the 2009 public advocate race, a July poll showed Mark Green with 37 percent of the support among Democratic voters, while 1 in 10 backed then-City Councilman de Blasio. In 2013, a June poll of Democratic mayoral primary rivals had de Blasio fourth, trailing Christine Quinn, Bill Thompson and Anthony Weiner. Each time de Blasio came from behind to win. It’s another question entirely whether he can overtake nearly two dozen Democratic hopefuls in a nationwide campaign, but de Blasio’s certainly not afraid of being the underdog. Apart from the horse race politics, there are key policy positions to assess. This week, we feature two takes on the mayor’s record – and whether it puts him in position to have a legitimate shot.

Latest LETITIA JAMES INVESTIGATES NRA State Attorney General Letitia James opened an investigation into the finances of the National Rifle Association. Her move drew sharp criticism from President Donald Trump, who said on Twitter that Gov. Andrew Cuomo and James (without identifying her by name) are trying to “destroy” the gun rights group through illegal means. James said she will follow the facts, wherever they may lead.
CHEMICAL CRACKDOWN
Cuomo has publicly thrown his support behind Joe Biden’s presidential campaign, saying that the former vice president is the only candidate “who can actually get something done” beyond spewing rhetoric. Cuomo reportedly plans to open up his fundraising network to Biden and is expected to be far more involved in this campaign than he was in supporting either Hillary Clinton or Barack Obama.
The state Legislature passed a series of longstalled environmental bills that included a ban on products and toys that include harmful chemicals, such as arsenic, asbestos, formaldehyde, mercury and organohalogen. Environmentalists were disappointed that 1,4 dioxine, a contaminant commonly found in laundry detergent and shampoos, was excluded. Lawmakers also introduced a constitutional amendment to guarantee a person’s right to clean air, water and a healthy environment.

Back & Forth So how might 2020 compare to your last campaign? I would say that I know a lot more about the political process and what it means to be a candidate for Congress. I am even more sure than I was when I started back in 2017 that this district, the entire Central and Western New York region needs something different from their representation in Washington. Our current congressman is somebody who stands for corporate interests, the interests of his large donors. And that’s not how it should be.

You started a nonprofit, Enter the Public Square, earlier this year to promote civic engagement. What has it been up to since then? We think about civic engagement broadly, right? It’s not just about voting or being involved in electoral politics. It’s about being involved in shaping your community, right?
We have a series of workshops that we’re offering to the public. We just had our second one on April 23 about media literacy. It was called “Fighting Fake News.” The previous event was a workshop focused on the skills necessary for healthy civic engagement. Our next meeting coming up is a “Get to Know Your Government Meeting,” where we’re bringing in members of local government to talk about what it is that they do and how community members can engage with them. Will you be stepping away from the nonprofit now that you are running for Congress? Yes, I am working now to find professional staff to take over the organization so that there is no confusion for the people who want to be involved that they can do so with the full certainty that it is nonpartisan.

THEINNER CIRCLESHOW WHILE NEW YORK CITY MAYOR Bill de Blasio neither declined nor confirmed his presidential aspirations during the annual Inner Circle show, he at least gave his waffling a winking nod – comedically leaving a skit just as a character raised the question of whether he’d run for the White House. Far more laughs came during the main show, where a cast of dozens of current and former City Hall reporters sang and danced their way through the parody musical event, now in its 97th year. The gala, whose proceeds support a variety of local charities, took place on Saturday, April 27, at the New York Hilton Midtown. “This is a great tradition. Everyone makes fun of each other, and fun of themselves, more importantly,” de Blasio told PIX11. EW YORK CITY Mayor Bill de Blasio has been traipsing off to South Carolina, New Hampshire and Iowa some weekends as he considers joining the crowded presidential field, despite nearly zero interest in his potential candidacy on the part of the national voting public. For better or worse, voters crave a president with a strong, simple policy vision. Donald Trump won with a vision of retreat from poorly managed globalization and demographic change, and Barack Obama won on a promise of reforms to the health insurance, financial and energy industries that would benefit consumers. De Blasio’s record as mayor doesn’t have a policy theme. It’s just a mishmash of half-executed ideas that add up to a city little different than it was before he got here. Even his biggest accomplishments, rather than striking out in a bold new direction, are building on existing trends. Let’s start with the mayor’s two main policy accomplishments: first, pre-K for all. In 2013, de Blasio ran on universal prekindergarten for 4-year-olds, and he is now expanding it to 3-year-olds. To his credit, 70,000 children now attend pre-K, up

UNDITS HAVE REACHED a consensus regarding potential Democratic presidential primary contenders: New York City Mayor Bill de Blasio is not hot. He’s no millennial Mayor Pete Buttigieg – the fresh-faced, multilingual leader of the 102,000 residents of South Bend, Indiana. Vanity Fair once declared that de Blasio’s “style is that of a nervous suburban dad trying to be cool in front of his teenager’s pals.” Among New Yorkers, the idea of him running for president is an occasion for eye-rolling disbelief. According to news articles, even the mayor’s allies anonymously call it “f---ing insane.” Although de Blasio gets mocked by the New York media, his actual record tells a very different story. As the two-term mayor of 8.6 million extremely diverse and opinionated people, he manages more complexity in a day than Buttigieg has confronted in his entire mayoral tenure – and he’s done an excellent job of it. The two mayors’ signature initiatives reveal radically different approaches to solving problems. In South Bend, Mayor Pete, a former McKinsey & Co. consultant, chose to repair or demolish 1,000 va-

In January, The New York Times reported, “In 2018, about 94 percent of the city’s prekindergarten programs met or exceeded a threshold that predicts positive student outcomes after pre-K, according to a national evaluation system.” In 2015, only 77% of the programs were up to snuff. The mayor made a promise and kept it – and tens of thousands of working parents are better off, at the very least avoiding day care costs. Yet de Blasio’s victory here was more of an election-branding exercise than a radical turnaround for New York City. Universal pre-K first was championed by de Blasio’s predecessor, Michael Bloomberg. In 2007, Bloomberg noted that “since 2002, we’ve increased the number of available free pre-kindergarten seats by more than 9,000,” and converted slots to full-day from half-day, part of a push toward “universal pre-kindergarten.” Bloomberg focused his outreach on the poorest students, while de Blasio has created a middle-class and even upper-class entitlement. De Blasio’s own signature program was an incremental improvement on his predecessor’s work. The same is true of de Blasio’s other main achievement: the continued drop in crime. Last year, New York City had one of its lowest number of murders in the modern era: 295. The NYPD has continued to reduce the number of stop and frisks, which also began under Bloomberg. That’s good, for as long as it lasts, but it is hard to credit de Blasio for bringing to New York an epiphany about crime. New Yorkers have enjoyed nearly 30 years of violence reduction. De Blasio inherited what at one time seemed like a miracle and has maintained it – a salutary result, but hardly evi-
dence of his unique ability to lead the nation. Indeed, pre-K and crime point out the general de Blasio dilemma: At best, the mayor is a caretaker who hasn’t too thoroughly screwed up the mostly healthy city he inherited. You can see the mayor’s frustration, if you apply this logic to the issues Democratic primary voters might care about. The environment? Again, Bloomberg created “Plan NYC,” New York’s long-term environmental blueprint; de Blasio’s main contribution was to change the name to “One NYC.” The mayor has now had five years to radically remake how New Yorkers get around by providing faster, more efficient bus service, for example. He has just now finally begun to roll out policies to increase bus speeds. He has improved safety for pedestrians – although results have slipped this year – he hasn’t cut back on cars: Instead, New York has record-slow traffic and a record number of private cars. City-owned vehicles are also racking up more miles. Even redesigning streets for the benefit of bicyclists and pedestrians was started by Bloomberg. New York City Council members, not the mayor, have driven recent key environmental initiatives, including the push to tax plastic bags (which is now a statewide ban). Inequality? De Blasio keeps trying to get national attention by intoning ominously that America’s money is “in the wrong hands.” But New York City’s taxes – on the rich and middle class alike – were already sky-high when de Blasio took office. Absent far more competent management of record tax revenues, it’s going to
be hard to sell Gotham to the rest of the nation as a progressive success. Public schools, public housing and public transit are all still subpar, given the money the city and state throw at them, and the city fails to address the seriously mentally ill, all too visible on its streets. Respect for science-based regulation? The mayor has spent five years bullying horse carriage drivers on false claims of abuse and poor working conditions, with no real reason for the pressure except that key de Blasio donors dislike the horse carriage industry. One force behind the Trump victory nearly three years ago hasn’t dissipated: the desire to “drain the swamp.” Trump has left plenty of swamp to drain. But is de Blasio the person to do

it? The mayor is the consummate special-interest politician; his latest pay-to-play scandal is for the city to pay an above-market price for a portfolio of homeless hotels owned by a family with a key donor connection to the mayor. In a hypothetical debate with the current president – extremely hypothetical at this point, to be sure – de Blasio would have no moral authority to take on Trump’s own shady real estate practices. De Blasio, despite his rhetoric, has never been a good radical; he’s too beholden to the local fundraising machine. But he’s also not a good technocrat: key initiatives to turn around underperforming high schools and help people with mental illnesses have failed, with the mayor barely noticing. It’s not clear which path, ultimately, Democratic primary voters will choose, but they would seem to want one of these two choices – and the mayor fits neither bill.

Ultimately, many residents – mostly poor and people of color – were surprised to find their properties on the demolition list, forced to pay fines, make expensive renovations or lose their investments. That’s what Mayor Pete called “a classic example of data-driven management paying off.” In New York City, de Blasio campaigned on solving the problem of families scrambling to find safe, affordable, enriching educational environments for their young children. After Election Day, he rallied multiple city agencies to work together, telling them to focus on their deadline as if they were preparing for D-Day. They hit the mark, and saved New York families $1.4 billion in child care expenses by the program’s third year – while also posting consistently improving, high-quality outcomes for their children. Bloomberg made it difficult for any successor to reverse the great concentrations of wealth and poverty that de Blasio campaigned against. Even Bloomberg’s admirers bragged in the waning days of his mayoralty that Hudson Yards was “the type of big idea project that defined Bloomberg’s 12 years in office,” and that projects like it “are so far along that there is little the new administration can do to alter or reverse them.” De Blasio saw the project to completion, but skipped the ribbon-cutting. “We’ve moved away from providing discretionary incentives like the prior administration,” de Blasio said in a statement. “I believe state and local economic development programs need to be reevaluated and updated.” Of course, de Blasio should have been reevaluating and updating back in 2014 when he was sneaking past the press to get into the Real Estate Board of New York’s annual gala. This year he didn’t show up at all, a recognition that his too cozy relationship with the real estate industry could dampen enthusiasm among the progressive base before his 2020 presidential bid gets off the ground. There’s no doubt de Blasio is waist-deep in the muck of New York politics, having frequently been caught apparently doing favors for donors. He can’t play the hope-and-change game of a blank slate candidate shape-shifting into anything for anyone. But with everything on the line in 2020, Democrats need more than hope. They need a candidate who will charge through the muck to get the job done. De Blasio is battle-tested and deserves the chance to make his case.

ver since the day Donald Trump began his campaign for President, and in the over two years of his administration, he has focused on Central American immigrants. As his administration continues to ring alarm bells about immigrant caravans while calling for a pointless and expensive wall, much of the rhetoric has been disturbing. And so, New York State Comptroller Tom DiNapoli, Executive Director of Catholic Charities of the Archdiocese of New York Monsignor Kevin Sullivan, and myself decided to make a trip to see for ourselves what is creating the crisis at our southern border. The three of us travelled together once before, to Bangladesh in 2013 following the horrific collapse of the Rana Plaza building in which over 1,100 garment workers were killed. What we found in the Northern Triangle (Guatemala, Honduras, and El Salvador) was much different than what the President has been talking about. We saw a humanitarian crisis of epic proportions where violence combined with poverty

leaves many people with no choice other than trying to escape. Families there are oppressed by extreme poverty, gangs, and violence. To describe the stories we heard as heartbreaking would be an understatement; mothers spoke of daughters and sons who contracted HIV because of rapes. Mothers and fathers describe the crushing poverty they live in, and extortion by gangs that adds to their difficulty in providing their families with even the most basic of needs. One woman told us of the fear they have of even attempting to seek help from corrupt authorities who tell gangs when anybody reports crime or seeks justice. A grandmother tells us that she hasn’t seen her neighboring grandchildren in months because they live in a gang’s territory where travel is forbidden. Here in America, a callous President says “the country is full” while he leads a tide of fearmongering and xenophobia against these desperate refugees in hope of winning another election.
WHAT WAS YOUR FIRM’S BIGGEST ACHIEVEMENT IN ALBANY IN 2018? Our support and work with charities at home and abroad. Members of our team routinely participate in a Day of Simple Giving that helps provide holiday cheer for underprivileged people in our community. We also raised significant support for a charity in Guatemala that provides income‑generating opportunities for parents to better the lives of their children. WHAT WAS YOUR FIRM’S BIGGEST CHALLENGE? Growing strategically in terms of both clients and members of our team. This has meant saying no to some opportunities in favor of those that offered a better fit. Our decisions enabled us to ensure the level of service, attention to detail, informed strategy and successful representation we are committed to provide.
No parent wants to take their children on a 3,000-mile journey through gang territories where there are real threats of rape, kidnapping and human trafficking. Parents do not want to send their children – often unaccompanied – on such a dangerous journey. But for these people seeking asylum for themselves or their children, they simply see no other choice. These people are coming for survival, not to steal our jobs or mooch off of taxpayers’ money. We are being led down an immoral path of scapegoating and fear, and it’s a path we must not follow if we hope to maintain any kind of moral authority in the world. Members of my union, the RWDSU, have families in the Northern Triangle, and they are worried and scared about their well-being. At meat-processing plants in Ohio last year, RWDSU members endured the frightening spectacle of an armed ICE raid. This persecution of hard-working people trying to support their families with dangerous jobs brought with it a sense of shame and sadness; these people deserve to be treated humanely and not threatened with automatic rifles. We need to change the rhetoric and understand that just like many of our families did in the past, people are fleeing to America for refuge.

We have represented a number of advocacy organizations for many years, including the New York Immigration Coalition and Gay Men’s Health Crisis, and this year we have been able to pass a number of bills that will really make a difference in the 1/18/2019 14:53:28 lives of thousands of New Yorkers. The
Immigration Coalition has been working on the DREAM Act for years, which we saw passed in January, and we were able to secure $20 million in the budget for the census count. A
NY ARTIST WILL tell you that creating art and making ends meet in New York City is a difficult balancing act. But for many working in creative professions, finding affordable housing and studio space has never been harder than it is today. The same people that contributed so much of the city’s creative caché are in danger of being priced out. Based on the number of museums, galleries, fairs and volume of sales, New York City is the art capital of the world. But can the creative ecosystem remain robust if its grassroots artist community continues to struggle or starts to disappear? What would be the implications for the rest of the city’s economy if it lost its “cool” edge? Since 2000, the total number of artists in Manhattan declined 10%, according to the Center for an Urban Future, even as the number of artists living north of Central Park rose. transformation in Williamsburg – changing the Brooklyn neighborhood from an artist haven to a global brand and leading to the displacement of artists and longtime residents. “We continue to see a trend of more and more artists – not only artists, but just folks overall – that are being displaced from other parts of the city,” said Joanna Castro, executive director of the Northern Manhattan Arts Alliance. “We have seen this going on since the ’90s, but in the last five years or so the gentrification feels almost like a tsunami … long-standing residents can’t afford their rents, so they’re moving to the Bronx and New Jersey and to other parts of the tri-state area.” According to Dvorkin, the gap between median and asking rent has more than tripled since 2000 in neighborhoods with the fastest growing artist populations – such as Williamsburg and Bushwick in Brooklyn – which is creating enormous pressure to displace longtime residents (including artists), and making it especially difficult for emerging artists to stay afloat. Meanwhile, the downtown neighborhoods famous for being hotbeds of creativity are losing their artists at an alarming rate. Throughout the 20th century New York defined what was considered “cool” around the world – whether with doo-wop or disco, punk in the Bowery, hip-hop in Brooklyn or folk revival in Greenwich Village – cementing the city’s reputation as one of the hottest destinations in the world. But in the past few decades, dozens of classic music venues – such as CBGB, which helped launch the careers of artists like Blondie and the Ramones – have closed, with gentrification being the primary culprit. The fact that so many musicians have recently decamped to Los Angeles or smaller cities with lower costs of living reflects affordability challenges that affect not only the music industry but creative occupations as a whole. “The history behind the genius in New York City is cheap rent and an inexpensive lifestyle,” said Clayton Patterson, a photographer, folk historian and chronicler of cultural life on the Lower East Side. “The greatness of America has always been associated with creativity and opportunity, and so much of that is being closed down.” When Patterson moved to the Lower East Side in 1979, the neighborhood was associated with artists like Jean-Michel Basquiat and known for being home to squatters, bikers and junkies who lived in close proximity to the neighborhood’s poets, painters and actors. But as its real estate market has heated up in recent years, the neighborhood has

transformed into a trendy nightlife district. “You don’t have that mixing of cultures anymore, everything is too expensive,” he said. Nightlife spots have pushed out the mom and pop shops where community members used to gather. Small independent stores, where creative types once found inexpensive things, are likewise a thing of the past. “I can think of Montmartre – Pablo Picasso, (Georges) Braque – but why were they there?” Patterson asked, referring to the famous Parisian district that was home to many artists during the late 19th and early 20th centuries. “What made it so attractive that the culture developed while they were there? You needed all these other ingredients: the butcher, the baker, the candlestick maker.” Most New Yorkers, of course, were not alive during Montmartre’s cultural heyday, and have never known their hometown as anything other than the cultural capital of the world. It’s an extraordinary privilege, and one that wasn’t preordained. Back in the Gilded Age, New York City’s elite envisioned a city replete with civic and cultural institutions to rival those of the lavish European capitals. The Metropolitan Museum of Art and New York Public Library were born from these aspirations. After the 1929 stock market crash, the federal government – through the Works Progress Administration – began offering individuals an opportunity to receive a steady paycheck while creating art full-time. The program helped galvanize communities of artists in New York and across the nation.

“That was the beginning really of an American art presence – an American art movement,” said Mary Gabriel, the author of “Ninth Street Women,” a book about the role of female artists in the abstract expressionism movement. “The artists all started discovering one another, standing in line to get their checks or working together on mural projects. So this incredible community of men and women was coming together at a moment when the federal government started recognizing that there was a such thing as an American artist who deserved to be supported.” New York City’s cultural scene flourished in the years following World War I, thanks in part to the emergence of the Jazz Age of the 1920s. Harlem became the epicenter for black artistic and intellectual expression. The Harlem Renaissance
included innovations in music, dance, fashion and poetry, defined by the work of musicians like Louis Armstrong, and authors and poets like Zora Neale Hurston and Langston Hughes. “There is this tremendous cultural energy that comes from New York being at the center of African American migration – with

Harlem becoming the world capital of black arts and black culture,” said John Gennari, a cultural historian at the University of Vermont. The WPA helped sustain New York City’s artistic momentum through the Great Depression. When war broke out in Europe again in the late 1930s, many artists fled German-occupied Paris to settle in New York City. The exiled community would bolster Manhattan’s gallery scene – and although many returned to Paris after the conflict, the wartime years turned out to be a pivotal moment in the formation of a movement that came to be known as the New York School. The abstract expressionism movement, led by painters like Jackson Pollock, Willem de Kooning and Lee Krasner, not only shifted the center of Western art to New York City, but also started an avant-garde movement that reshaped the culture. “Everything had been destroyed, mankind had been reduced to its most bestial state,” said Gabriel, describing some of the ideas behind art created during this time. “And so artists started working with a blank canvas, asking, ‘Where do we go from there?’ … I think it really was a rev-

olution in the way that people not just made art, but the way they thought about and responded to art, and it created a modern interpretation of life that was then picked up by advertising, and across many other spectrums.” Soon another conflict was spreading across the globe. The Cold War spilled into the cultural arena, with the governments of the United States and Soviet Union each viewing the allure of art as a source of soft power. To support cultural diplomacy, President Dwight Eisenhower created an Emergency Fund for International Affairs in 1954. Over the next five years, around 140 groups of American performing artists and athletes traveled to scores of countries. As TV replaced radio in the American living room, pop music began migrating to Los Angeles as crossover stars like Frank Sinatra pursued careers in Hollywood. New York City became known more for its avant-garde scene. Jazz moved to Greenwich Village from midtown Manhattan, where it became associated with literature and the visual arts. The city’s downtown area was more tightly knit in those days, with bebop musicians, beat poets and abstract painters mingling in basement bars, jazz clubs and coffee shops. That cross-pollination – and collaboration – was one of the hallmarks of the New York School. It would continue into the pop art era as Andy Warhol’s studio became a popular hangout for musicians like Bob Dylan and Lou Reed, and literary figures like Truman Capote. This rich and complex artistic history has defined a notable portion of New York City’s legacy. Going all the way back to the Gilded Age, when much of the infrastructure was built that would enable New York City to become a cultural hotbed in the decades that followed, art has been an investment that has paid dividends for the city. Given New York City’s current affordability crisis, how will artists be prioritized going forward? “It was a question then of what constitutes a healthy urban culture, and that’s the same issue today,” Gennari said. “The people who have the money and run the city need to decide: What’s the cultural profile of the city going to be? What can we brag on? Obviously, we want jobs, we want rising incomes and better wages, but you’re always going to have a middle class and upper-middle class that want culture and the arts. So, what are you going to do about that?”

IKE MANY OTHER New Yorkers, artists are often burdened by the cost of rent. Although the number of artists in New York City reached an all-time high in 2015, rising rents have been driving many from Manhattan into the Bronx, Brooklyn and Queens, leading to concerns that New York’s once-thriving art communities would erode over time. To protect artists and the vibrant communities they create, in 2015 New York City Mayor Bill de Blasio announced an initiative to build 1,500 units of affordable housing and 500 units of artist workspaces by 2024. Four year later, progress on this plan has been mixed. “This administration deserves a lot of credit for investing in arts equity, for pursuing policies that will make New York City’s creative communities more inclusive and bolster artmaking and practices across all five boroughs,” said Eli Dvorkin, the editorial and policy director at the Center for an Urban Future, a think tank that has produced research about the city’s creative sector. “But I think that the 10,000-pound gorilla in the room is our affordability crisis and, on that score, I don’t think we’ve made nearly enough progress.” While many people throughout the city face this problem, artists in many cases have the added burden of having to rent not only a living space, but also a workspace like a dance or music studio. At the same time, income eligibility requirements make it difficult for artists to apply for affordable housing through the city. “Artists in particular have specific burdens for how they would qualify for either the affordable housing that’s offered from the city, for example, or more generally,” said Esther Robinson, co-executive director of ArtBuilt, which provides affordable studio space for artists. “They tend to have variable income. They tend to have 1099 freelance income, and if they are incorporated or have some business structure, it’s generally a sole proprietor business.” According to a report from the city Department of Cultural Affairs, 40% of arts and culture workers could not afford to buy art supplies and tools, and 90% said that having affordable housing and an affordable workspace was important. Building affordable housing in an expensive real estate market like New York City is always difficult, said Will Law, chief operating officer of Artspace, a nonprofit that helps preserve affordable spaces for artists. But the city faces a unique challenge in devel-

The mayor promised to build affordable housing for artists. Has he delivered? oping artist-specific housing because its housing discrimination law protects people from discrimination based on their profession, which also makes it illegal to select residents based on their profession. However, there have been legal workarounds to this rule. Artspace created one of the most recent examples of affordable live/work housing developed in the city: El Barrio’s Artspace PS109. Artspace began working on the project to turn a former school building into an artist residence in the early 2000s, and opened it to residents before de Blasio announced his initiative. Rather than restricting people by profession, Artspace requires applicants to discuss their work and their motivation for living in a community of artists during a panel interview with other artists and representatives of art organizations. “In most cases, many of the residents within our buildings are artists but they have other jobs as well. … So our preference is for people that have an artistic passion, it’s not about their job,” Law said. “It’s about – do they have an artistic passion, do they demonstrate a body of work and a commitment to an artistic pursuit?” Over 53,000 artists applied to live in one of the building’s 89 units in 2014. No other affordable housing complex designed for artists has been developed since then. One aspect that may have complicated any plans to add additional preferential housing is an ongoing federal lawsuit against the city. The lawsuit, brought by the Anti-Discrimination Center, challenges an aspect to the city’s affordable housing projects that reserves half of the available units in a particular district to neighborhood residents. “Until that lawsuit is resolved, we’re all in uncertain territory,” Law said. Elizabeth Rohlfing, a spokeswoman for the city Department of Housing Preservation and Development, said: “We are looking at how best to integrate our housing with workspace and community facilities space that serve artists and arts organizations and benefit the surrounding communities.” Although progress on the affordable housing part of the initiative has been slow, the development of workspace is expected to reach its target, said Tom Finkelpearl, commissioner of the city’s Department of Cultural Affairs. The department has given money to several organizations, such as Spaceworks NYC and the Lower Manhattan Cultural Council, to develop workspaces throughout the city, having completed 73 units so far with 479 units in the pipeline. The visual arts studios are rented for $1.50 per square foot while pricing guidelines are different for dance space. “This is definitely below market, depending on where it is in the city,” Finkelpearl said.

In their heyday, Manhattan Plaza and Westbeth Artists’ Housing were home to young artists; now they are what urban planners call “naturally occurring retirement communities.” Could their success be replicated today?

SOME OF THE COUNTRY’S brightest stars got their start in the modest confines of a 46-floor apartment complex in Hell’s Kitchen. From the outside, the buildings covering an entire city block between 42nd and 43rd streets and 9th and 10th avenues look as generic as you can imagine: rectangular brick towers with balconies jutting out wherever they can. But Manhattan Plaza’s list of former residents reads like a Hall of Fame. Larry David, Angela Lansbury, Tennessee Williams, Patrick Dempsey, Mickey Rourke, Terrence Howard and Alicia Keys all lived there in obscurity. Samuel L. Jackson was the building’s first doorman. Manhattan Plaza is an affordable housing development: its tenants’ rents are subsidized by the federal government under the Section 8 housing voucher program and by New York state under the Mitchell-Lama program. In the 1970s, when Hell’s Kitchen was a gritty, crime-ridden neighborhood frequented by prostitutes and drug dealers, developer Richard Ravitch came up with a plan to attract middle-class renters – with rents subsidized by Mitchell-Lama. But after New York City nearly went bankrupt the following year, the project sat unfinished for a couple of years and was eventually completed with subsidies from the federal Section 8 program for low-income renters. “The problem was, it was originally planned in a rising market for middle-income housing,” said Daniel Rose, a former developer and head of Rose Associates, whose firm was brought in to try to finish the project. “The only program that permitted it to be financed was the Section 8 program, which was for the poor. And people were fighting it,” said Rose, now 90 years old and living outside of Boston. “They were fearful of bringing in ‘dysfunctional, militant poor’ into the middle of Manhattan, so I came up with the idea of bringing in artists – who were ‘broke but not poor’ and would add to the (neighborhood’s) sociological wealth.” Some of Manhattan Plaza’s memorable stories – like the creation of the TV sitcom “Seinfeld” – were captured in “Miracle on

42nd Street,” a 2017 documentary about the development made by filmmaker Alice Elliott. In the film, Seinfeld writer and producer Larry David recalled his close friendship with one of his neighbors, comedian Kenny Kramer. “He was constantly coming in and out of my apartment and I was going in his apartment all the time as well, opening each other’s refrigerators, eating each other’s food,” David said. “Jerry (Seinfeld) and I wrote the pilot in my apartment. ‘Seinfeld’ was sold while I was living in Manhattan Plaza. Creativity plus affordable housing plus a dash of psychosis equals ‘Seinfeld.’”
WESTBETH ARTISTS’ HOUSING DOWN THE HUDSON RIVER in the West Village, Westbeth Artists’ Housing occupies a full city block in a building complex that formerly housed the renowned Bell Laboratories research center. After the center relocated in 1966, the campus sat unused for two years. In 1968, the National Endowment for the Arts partnered with one of New York’s top philanthropists to finance a major renovation of the site and transform it into an affordable live/work space for artists. Westbeth opened in 1970 with a mortgage from the Federal Housing Association – and the city offered a 75% tax abatement (which would increase to 100% in the 1980s). Its 384 units, several performance spaces and 100,000 square feet of commercial space turned a derelict, post-industrial campus in a rundown neighborhood into a hive of artistic activity. It would go on to house artists including Diane Arbus, Ralph Lee, Robert De Niro and Vin Diesel. “‘Hedwig and the Angry Inch’ started here. Merce Cunningham used it for training for 30 years. Keith Haring had his first exhibition here. I think it had a critical role in the development of this part of the city,” Westbeth’s executive director, Patricia Jones, said recently by phone. That cultural capital did not translate to actual capital, however. “It’s always been supported by its rental income, and in its early days it wasn’t so easy to cover costs,” Jones said of the housing complex. “It wasn’t a neighborhood where you could get many commercial tenants. I think it was a struggle, financially, for the

first 20 or 30 years.” As the area skyrocketed in desirability over the years, the commercial space it leases has helped alleviate the financial stress, Jones said. “People say, and I think it’s valid, that artists are the pioneers,” she said. “They go into the neighborhoods that are cheap and fix places up and make them interesting, and people follow them.”

THE FLIP SIDE OF SUCCESS
Both Westbeth and Manhattan Plaza have run into the same issue: tenants don’t move out. For most of the time they’ve been operating, the waiting lists for both complexes have been years or even decades long. Many tenants have been there since the buildings opened, more than 40 years ago. At Westbeth, 60% of the tenants are over the age of 70, and both Westbeth and Manhattan Plaza qualify as naturally occurring retirement communities – or communities with a growing population of seniors. “Talk about cradle to grave,” Elliott said. “It’s structured for community and, yes, there are downsides to that – in that, who would want to leave?” But that also means the places no longer exist as an option for young artists with new ideas. “It’s a challenge,” Jones said. “But we are here to support artists of whatever age.” Given that both developments seem to have achieved their objectives in fostering the arts, adding to the cultural life of the city, and helping transform rundown neighborhoods, why has no one undertaken another project of this scale in the past 40 years? “Affordable housing at the scale of Westbeth and Manhattan Plaza has become rarer across the board – not just for artists – since the 1970s, when several older subsidy programs were replaced by a patchwork of smaller programs,” Matthew Lasner, an associate professor in urban policy and planning at Hunter College, wrote in an email. That said, there have been smaller projects. El Barrio’s Artspace PS109 is a renovated school in Harlem that holds 90 affordable live/work units for artists, though it’s mostly privately funded by philanthropists. The Schermerhorn in Brooklyn also has 100 affordable units for artists, and 117 more for formerly homeless residents. It is funded in part by the Actors Fund and the nonprofit Breaking Ground. “The demolition of Pruitt-Igoe on national TV in 1972 was the death of deep federal subsidies for housing in the U.S., and the 1975 austerity measures in NYC marked the end of big local pro-
grams like Mitchell-Lama,” Lasner wrote. “Also, with the city’s decision to permit live/work occupancy in otherwise obsolete industrial loft buildings, there was much less demand for new subsidized units for artists. Put differently, with cheap lofts available for conversion to live/work in SoHo, Williamsburg, Gowanus, Sunset Park, etc., there was, for a generation or two, much less need for subsidized specialized artist housing.” SoHo, Williamsburg and Gowanus are no longer cheap places to live, it should be noted, and Sunset Park is rapidly joining them. “There’s no question in my mind that it can be and should be replicated elsewhere,” Lasner wrote. “I think it provides necessary housing for groups that benefit the city.”

URING HIS 2015 State of the City address, New York City Mayor Bill de Blasio declared affordable housing as his No. 1 priority, outlining a plan to build or preserve 200,000 housing units by 2024. The Housing New York initiative also would create 1,500 affordable units for New York City artists, along with gallery and performance spaces. Two years later, the de Blasio administration outlined a new plan – Housing New York 2.0 – to reach the original 200,000 housing units by 2022, and a new goal of creating 300,000 housing
units by 2026. The new plan focused on seniors, home ownership and underutilized space. By the end of 2018, the administration reported it had created or preserved 121,919 affordable homes. New York City’s previous efforts to create affordable housing for artists included projects like the Westbeth Artists’ Housing development, which opened in 1970 in Manhattan’s West Village, The Schermerhorn apartment complex in Brooklyn and El Barrio’s Artspace PS109 in East Harlem. But each of these projects raised its own set of questions – including determining availability of space, income eligibility for tenants and who is or is not an artist. Candidates considering a potential New York City mayoral run in 2021 will have to face the city’s affordable housing challenges, including the scarcity of spaces for artists. City & State reached

WHAT SHOULD NEW YORK CITY DO TO ENSURE ARTISTS HAVE AFFORDABLE HOUSING?
ERIC ADAMS: We face an affordable housing crisis on every front, at every income band, and artists have been one of the groups most deeply impacted. They fuel the soul and spirit of this city, and we cannot afford to see them permanently priced out. The city’s Human Rights Law prevents discrimination in housing based on occupation, which has had the unintended impact of precluding prioritization for artists and other key professions. As such, we need to be aggressive in creating and preserving affordable housing across the board, working with nonprofit organizations that educate and empower artists to navigate the lottery process, and establishing live/work spaces that create unique opportunities for artists to thrive. We should also explore working to promote backfilling affordable units with artists in need if and when units filled by the lottery process are vacated.
have real anecdotal evidence that individuals have been unable to keep up with rising rents and manage often inconsistent income streams to make them eligible for affordable housing lotteries. This has a particularly troubling impact in communities that have faced long-term cultural brain drain, including the neighborhoods of Brownsville and South Jamaica, where I grew up. Our goals have not been aggressive enough in creating live/work space, and our efforts to impact federal policy that largely determines our affordable housing agenda have been stymied by partisan gridlock.
WHAT, IF ANYTHING, HAVE YOU DONE AS AN ELECTED OFFICIAL TO PROMOTE OR SUPPORT AFFORDABLE HOUSING FOR ARTISTS?
STRINGER: The de Blasio administration has announced several initiatives recently to build affordable housing and workspaces for artists. Last year, they reformed several rules that historically made it difficult for artists to compete in traditional affordable housing lotteries. However, it is far too early to say if these reforms have been effective since the administration does not measure placement of artists or other individuals in affordable housing in a transparent manner, which is much needed to make a difference in supporting artists in the long term.
STRINGER: As Manhattan borough president, I fought alongside my fellow elected officials and community residents to keep Manhattan Plaza as an artist community, and supported the creation of Artspace at the former P.S. 109 site in East Harlem with capital grant funding. Artspace was one of the first affordable housing developments for artists built in recent memory in New York City. As comptroller, I have advocated for our city’s tenants by introducing a “Making Rent Count” opt-in program that allows residents, including artists, to make monthly rent payments count toward their credit scores, helping New Yorkers take control of their finances. The average earning for artists and related workers is $65,000 a year, which for a family of three would be classified as low income at 70% AMI (area median income). This salary would qualify for many existing affordable housing programs provided by the city. We need to increase awareness of these programs and continue supporting our city’s artists to ensure everyone has access to affordable housing.
ADAMS: While some statistics indicate that the number of artists living in our city has increased in the last couple decades, we

Artists contribute to and collaborate with inspiring innovative industries that provide jobs and cement our city’s status as a global leader in creativity. But many artists face unique challenges due to their self-employed status and variable income streams. This kind of income instability can not only affect credit history, but also disqualify an artist from the city’s affordable housing lottery system. The city needs to recognize that artists play a vital role in this new economy, and they should have access to affordable housing and workspaces that will allow them to compete and thrive.

housing lottery forums, taken on tenant harassment through free legal clinics and worked to reduce the costs that artists bear on a daily basis to produce and promote their work. I have utilized its role in the land use process to secure affordable cultural and studio spaces for artisans and artists in a number of development projects and zoning actions. I’ve worked closely with the Brooklyn Arts Council to support our artist community, including a unique mini-grant program to increase traffic to their venues and performances. Additionally, my office has explored untapped areas of our borough for new affordable housing creation, particularly through the maximization of air and development rights from our houses of worship. RUBEN DIAZ JR.: “Since taking office in 2009, Borough President Diaz has invested nearly $55 million in capital funds directly into the creation of nearly 8,500 new housing units,” said John DeSio, communications director for Bronx Borough President Ruben Diaz Jr. “This includes support for the Bronx Commons/Bronx Music Hall complex as well as for Pregones Theater’s planned expansion, which will include new artist-in-residence housing space. The borough president is willing to work with all stakeholders – developers, artists and others – to innovate and create new housing options when viable and appropriate.” COREY JOHNSON: I believe that taking actions to make our city affordable is the best thing we can do to protect artists and safeguard spaces for their spectacular creations, and this includes protecting tenants from bad landlords at all levels. The City Council is very supportive of local artists and cultural programs. An example of that commitment was the launching of SU-CASA, an initiative that provides arts programming for senior centers across the city. Additionally, we unanimously approved and allocated $500,000 for fiscal year 2019 to the Spofford Redevelopment Project in the Bronx, which brings approximately 18,000 square feet of artist space. Other initiatives that the City Council supports include the Cultural After School Adventure, providing arts enrichment for after-school programs, and the Cultural Immigrant Initiative, which offers programming on the cultural history of our immigrant communities. In my own district, Westbeth Artists’ Housing and Manhattan Plaza show that investments in artist housing result in active and engaged communities who transform the neighborhoods around them for the better.

NYC ARTISTS FIND AFFORDABLE WORKSPACES AT THE BROOKLYN ARMY TERMINAL “WHAT’S NEW YORK CITY without art?” tweeted New York City Mayor Bill de Blasio last month. “ArtBuilt at the Brooklyn Army Terminal will give our local artists the space they need in the city they love.” De Blasio was referring to a newly launched project offering artists studio space at below-market rents, which was featured in The New York Times on April 22. Funded through a collaboration among the nonprofit organization ArtBuilt, the de Blasio administration and private investors, ArtBuilt Brooklyn is the city’s largest nonprofit initiative to create artist workspaces in the past 20 years. It provides affordable studios to 100 artists in the Brooklyn Army Terminal industrial complex in Sunset Park – and talks are already underway to create a second such space in New York. “At any given time there are literally hundreds of established reputable artists who are losing their spaces or recognize that they’re about to lose their spaces,” ArtBuilt co-founder Guy Buckles told The New York Times. To make the project a reality, he and co-founder Esther Robinson worked with the New York City Economic Development Corp. to reconfigure the industrial space to create studios for artists. ArtBuilt’s rents for studios are between $13 and $24 per square foot, while the range for commercial spaces in Brooklyn is $28 to $36 per square foot. “There need to be places for artists to thrive in place, and that is extremely important to this entire enterprise,” Tom Finkelpearl, commissioner of the city’s Department of Cultural Affairs told the Times. The department oversees the Affordable Real Estate for Artists program, which supported the project. “There’s an affordability problem that’s absolutely a looming problem for artists in the city,” Finkelpearl said. ArtBuilt Brooklyn is almost fully rented, and includes tenants like multimedia artist Tomashi Jackson, whose work is part of the upcoming Whitney Biennial, and Matt Rubendall, who makes handcrafted guitars. Paul Ramirez Jonas told News 12 Brooklyn that the opportunity at ArtBuilt is better than anything he has seen in the 30 years that he’s worked as an artist. "I’m an artist who is represented by galleries, shows internationally, shows and museums as a full-time professor,” he is quoted as saying in the April 30 story. “It’s a good job and if I’m struggling, you can imagine what it’s like for the versions of me that are in their 20s that are just getting started. HE PASSAGE OF the federal Tax Cuts and Jobs Act of 2017 was anything but quiet. Yet for thousands of low-income census tracts, one provision that mostly escaped public notice may end up having the largest impact of all. A little-known provision has led to the designation of 8,761 U.S. census tracts as “opportunity zones.” Its goal: channel unrealized capital gains – estimated to be $6 trillion nationally – into underserved communities. Uneven access to capital is a factor in economic disparity, which the pro-

gram aims to redress through tax incentives that enable individuals and institutions to roll capital gains from other investments into “opportunity funds.” In high-cost cities with hot real estate markets, such as New York City, affordable apartments and workspaces can be hard to come by for artists. By providing a new source of equity to tap into, the program has the potential to help catalyze those sorts of developments, which often struggle with financing. A nonprofit organization, for instance, looking to develop affordable housing or studio space for artists, now has the ability to create an oppor-

tunity fund to attract outside investors. The degree to which the program will succeed in aligning private investment and community needs, however, remains an open question. The U.S. Treasury Department estimates that $100 billion will be invested in opportunity funds. Brooklyn Borough “If you’re relying on a private Hall, Downtown investor to make a choice beBrooklyn, has been labeled an tween affordable housing and “opportunity zone.” community development versus a project in which they will receive market-rate returns on an investment in a low-income community, I’m not sure how many will take lower returns to support a project that has better social outcomes,” said Anisha Steephen, director of real estate at Spaceworks NYC, a nonprofit community development organization that builds creative workspaces in New York City. “So I think (opportunity zones) could be a tool, but it’s not designed specifically to support community development or arts and culture, or affordable housing.” Even advocates concede that opportunity zones should not be seen as a silver bullet, and in some cases creative incentive structures will be needed to bring a complex project to fruition. “If the state of New York or the city of New York saw affordable artists space as a priority, they could use additional tax incentives, as well as subsidies and financing, for projects specifically, which not only provides investors with confidence in making those investments, but can also serve to address that gap on returns,” said Rachel Reilly, director of impact strategy at the Economic Innovation Group, a think tank that helped conceive of the tax incentive program. Under the 2017 law, governors are responsible for selecting which communities to certify as opportunity zones. New York designated 514 high-poverty census tracts – a quarter of all eligible areas, per program rules – more than 300 of which are located in New York City. Some of those zones – Downtown Brooklyn and Long Island City, for instance – have seen a recent influx of private investment, stoking fears among some civic leaders that the favorable tax treatment could overheat real estate markets in communities where gentrification is already underway, leading to additional displacement. To what extent the program manages to steer private capital toward projects with a broad social benefit could hinge on a highly anticipated second tranche of rules, which the U.S. Treasury Department is expected to release in the coming weeks. In comments submitted to the Internal Revenue Service in December, New York City wrote: “Opportunity Funds must be targeted and monitored to ensure that the investments truly provide a public benefit to low-income communities.”
