IN THE 1990s, my father discovered he was HIV-positive and had unintentionally infected my mother. This is the first time I’ve ever written about this. My dad didn’t want the news to get out about his HIV status because of the stigma at the time. He and my mom kept it a secret, even from me. It wasn’t until my mother was suffering complications from the infection six months before her death on Mother’s Day in 1999, that I would come to learn what had happened. It broke my heart. My dad was devastated, because not only did he have that reality to live with, he outlived her by another five years. I wish my parents had survived to see a day when the stigma of getting infected with HIV was diminished. It’s much easier now because of today’s antiretroviral drugs, especially for people who once had to suffer a stigma for catching such a disease. That’s why my father struggled with admitting that he was bisexual. While we didn’t always see eye to eye, I felt horrible that he couldn’t be himself. June is a month when I’m celebrated as a father by four beautiful, grown children. It’s also Pride Month, a time I celebrate with my daughter Abigail, who is queer. And I’m grateful for how much she is aware of her grandparents’ story. City & State’s latest issue marks the breakthrough in LGBTQ rights made by the repeal of the “walking while trans” law. It means so much for a new generation. Hopefully it also gives peace to those who aren’t with us anymore to know that we’ve come this far.

NEW YORK HITS VACCINATION BENCHMARK

Gov. Andrew Cuomo announced that 70% of New York adults have received at least one dose of the COVID-19 vaccine, a benchmark he had set for the lifting of most remaining pandemic restrictions.

In a celebratory press conference, Cuomo all but announced “mission accomplished” with regard to overcoming the coronavirus pandemic. Even with the relaxed restrictions that remove social distancing requirements and capacity limits, Cuomo said the state

A RETURN TO HOMELESS NORMAL

With restrictions lifting and vaccination rates up, New York City Mayor Bill de Blasio announced that the 8,000 homeless people who had been living in individual hotel rooms during the pandemic will be transferred back to congregate shelters. They had originally been moved to avoid living in close quarters that would lead to COVID-19 outbreaks, but the decision had been met with backlash from some people who lived near the hotels they had been relocated to. De Blasio’s new decision to place them back into congregate shelters was met with resistance from advocates for homeless people, as well as from the people who had been living in the hotels.

Former top Cuomo aide who was sent to prison for taking bribes, Joe Percoco, was in the news again thanks to new reporting about who has been paying the tab for his lawyers. Turns out, Cuomo’s sister Madeline had been raising money for his defense and appeal, as well as for his children, before the pandemic from close friends and allies of the governor and the Cuomo family. For years, questions have swirled about who has been footing the bill for Percoco’s many courtrelated fees, especially since his lawyers said he had been on the verge of bankruptcy. The governor denied having any knowledge of Madeline Cuomo’s support of Percoco.

First elected in 1991 and then again in 2009, New York City Council Member Karen Koslowitz has had quite the career representing District 29 in Central Queens. For 12 years in office, the incumbent had a mostly inoffensive record, but her constituents won’t forget one vote: when she supported a plan to build a new Kew Gardens jail in District 29. Koslowitz called the vote the hardest of her career, but defended herself. In a press conference she said, “I go to sleep at night and I sleep very well. The people who say ‘no’ have no solutions. They just say ‘no.’” As is the case with most City Council seats, District 29 will soon be represented by someone new, and that person will need to contend with the “no’s” and with the solutions. Koslowitz previously ran unopposed when she won a new term in 2017. With the incumbent term-limited out of her seat this year, 10 candidates aim to replace her. Due to the heavily Democratic population in the district, the Democratic primary, with nine candidates, is likely to decide who will represent the district next year. The winner of the Democratic primary will face Michael Conigliario, the sole

Absentee ballots and ranked-choice voting mean it’ll likely take three weeks to know who’ll win New York City’s Democratic mayoral primary.

Republican candidate, in the general election. Several Democrats have raised the maximum public funds and have gained significant momentum. Lynn Schulman, who is running for the third time to represent the district and is a former opponent of Koslowitz in her 2009 race, is in the fundraising lead with private funds upward of $80,000. First-time candidate David Aronov follows her with about $65,000. Avi Cyperstein, the Democrat with the most conservative platform, is pitching himself as a first responder and has reached almost $50,000 in private fundraising. Also notable is Aleda Gagarin, billing herself as the most progressive candidate, with around $35,000. Most of the candidates are united on one front: stopping the jail. Koslowitz’s reputation was scarred after voting for the city’s plan to close Rikers Island and build four new borough jails. Her vote came with a lengthy list of conditions, including the hiring of additional police officers to the New York City Police Department’s 102nd precinct, and the installation of new security cameras in nearby public schools. – Maryam Rahaman

Transportation and infrastructure isn’t just roads, bridges and tunnels, right? It’s also broadband.

A Q&A with Rep.

ADRIANO ESPAILLAT

With all the going back and forth over an infrastructure plan, what’s left for New York in all the latest dealmaking? We’re still trying to get this done, so everything that we’ve been pushing for is still on the table. Including, for example, U.S. Sen. (Chuck) Schumer and myself have been pushing for an increase in funding for NYCHA to $80 billion for capital funding. There’s broadband in there. There’s also a bunch of initiatives that will help transportation infrastructure across the nation, including in New York. We’re trying to get this to be a bipartisan

effort in the Senate, and we’re trying to get the other side to agree to a number and to agree to the project, but everything that was originally there, is still there. So, there’s no drawback, at least not yet. What key initiatives do you want to see preserved in this process? I certainly would like to see the $80 billion-plus for NYCHA because I think that addresses a critical issue. Transportation and infrastructure isn’t just roads, bridges and tunnels, right? It’s also broadband; it’s also NYCHA; it’s also schools and hospitals. And so

when you expand the meaning of transportation and infrastructure to include that, I think it has a bigger impact for communities and it has a bigger impact for job creation. Now, you know, we fought hard during the pandemic to keep the funding for the MTA. We felt that it was important that we kept the funding for the MTA, and I believe it was $14.5 billion that eventually we were able to keep on the table for the MTA, because had we not done (that), we would probably would have lost the state funding that has been allocated for the second phase of the Second

Avenue subway. Certainly the money that we’ve allocated now would not have been enough. We have kept up the pace. In fact, the Federal Transit Administration gave the project what they call a “mediumhigh rating,” which is what it needs to move forward into engineering and eventually into construction. Now we want it to go to the full funding grant level, which is when all the wheels start turning, and I’m working at that as well. So if you come to an agreement with the White House, what will that greenlight?

We’ll have the funding available for thousands of bridges to be rebuilt across the country. We will have funding for the Gateway Program. You will have funding for the Second Avenue subway, a $7 billion project, and broadband, which is not just needed in rural areas, but also as the pandemic revealed, is needed also in urban areas. And so these are all major projects that will put people to work. And yes, $1.7 trillion I think is a good amount of money that would accomplish a lot and create a lot of jobs, but I’m sure that there could be a middle ground that the senators could agree on. – Ralph R. SCOTT STRINGER Two allegations of sexual assault leave this experienced progressive with little chance of becoming mayor. By Gabe Ponce de León

T

HOUGH THE OFFICE wields considerable influence, the work of the New York City comptroller is followed most closely by fiscal policy wonks, which could explain why almost 50 years have passed since the city’s chief fiscal officer was elected to be its chief executive. It so happens that Ronald Stringer, the father of the current comptroller, Scott Stringer, served as counsel to former Mayor Abe Beame, the last person to fill those roles consecutively when he entered City Hall in 1974. Before his campaign was rocked by two accusations of sexual assault, New York City Comptroller Scott Stringer was a top-tier mayoral contender who could plausibly claim to be the most qualified candidate. Stringer was born into politics on both sides. His mother Arlene Stringer-Cuevas served as a City Council member from Washington Heights in Upper Manhattan, and his stepfather Carlos Cuevas was deputy borough president of the Bronx. Stringer got his own start in politics as a kid when he volunteered on a congressional campaign of his cousin, former Rep. Bella Abzug. Stringer entered the Assembly in 1993, filling the Upper West Side seat vacated by his mentor Rep. Jerry Nadler, and remained in Albany until winning the Manhattan borough president race in 2005. That year, The New York Times lauded Stringer’s “commitment to the principles of good government” in its endorsement of him. “It was Mr. Stringer who pushed hard to change the ossified rules in Albany, and stood up to angry colleagues on behalf of a reform requiring them to actually be present in the chamber to be recorded as voting.” Stringer has been an early adopter of some progressive causes. He called for the closure of Rikers Island before other top city officials, for example. But he’s not one to stray too far from the Democratic establishment either. “He’s not rigid in a policy sense or in a political sense,” said George Arzt, a political consultant who was a spokesperson for Stringer’s successful 2013 comptroller campaign. Harold Holzer first met Stringer, whom he recalled as “this young eager kid with a very loud foghorn voice,” when he was a reporter covering Abzug’s 1972 congressional primary. Holzer, who is now director of the Hunter College Public Policy Institute’s Roosevelt House, later worked with Stringer during his days as an Albany legislator and Manhattan borough president, and he described him as a “practical innovator.” The comptroller’s office is not generally viewed as a platform for formulating public policy. Reviewing city contracts, auditing the

spending and performance of agencies, and overseeing the city’s pension funds are its primary functions. But the comptroller also has a policy office, which Stringer has used to advance a range of proposals. In the wake of Superstorm Sandy, for instance, the comptroller came up with a plan to increase the height of the city’s shoreline, particularly from the Lower East Side to the Battery in Manhattan. “One of the things that I have been impressed with is he put out a proposal on how the city could address the child care problem for the 0-3 age group, and it dealt in a very smart and effective way with the affordability, accessibility and quality problems,” said James Parrott, the director of economic and fiscal policies at The New School’s Center for New York City Affairs. Parrott also pointed to the comptroller’s ongoing efforts to create a retirement fund for workers who don’t have an employer-provided pension fund. Some budget hawks give Stringer’s tenure as comptroller less enthusiastic reviews. In 2014, the year both Stringer and New York City Mayor Bill de Blasio entered their current offices, every municipal contract had expired, and teachers union leaders were demanding retroactive pay increases to match raises that other city unions received during the Bloomberg administration. As New York City’s budget watchdog, left has shifted. Stringer had to sign off on the deal. “The city is not supposed to owe people for current and past obligations – only for long-term debt or for capital projects – so this is the comptroller’s main role: Does this pass the balanced budget requirements that the city has under its charter and under state law?” said Nicole Gelinas, a senior fellow at the Manhattan Institute, a conservative think tank. “The comptroller was very nice to the teachers union in all of this: He just asked for a very small superficial tweak, but mostly let the deal go through.” Gelinas added, however, that Stringer was “certainly engaged in the job” of comptroller, and praised some reports that the office has released under his watch, including a 2018 examination of the impact of Airbnb on city rents. She described his tenure overall as “basically a competent management of the status quo.” One of Stringer’s most-cited achievements has been his role in the 2018 decision for the city’s pension funds to divest from fossil fuel companies, which made it the first major pension system to do so. Stringer’s mayoral campaign touts his efforts to boost city spending on minority- and women-owned businesses. The comptroller’s office, according to the campaign, increased its own share from 13% to 50% of contracts awarded. But Bertha Lewis, president of The Black Institute, told City & State that she was “disappointed” in the comptroller’s record in that area. According to Lewis, she approached Stringer’s office about an initiative to set aside 1% of the city’s pension fund for investments in MWBEs, but the comptroller “never took

(her proposal) seriously.” She also criticized Stringer for not ensuring that some portion of the billions of dollars in COVID‑19 relief funds for the city was allocated toward MWBEs.

C

ONTRARY TO THE perception of Stringer as having

recently moved left, former Assembly colleagues say he was always a staunch progressive, so much so that he stood out in even the overwhelmingly Democratic chamber. “When he was in Albany, we treated him like he was from another planet,” said Mark Weprin, a former Assembly member who served with Stringer. “He was further left than anybody. He was the most liberal member of the state Assembly! Manhattan had completely different views than the rest of the state.” As Manhattan borough president, an office he held from 2006 through 2013, one of Stringer’s signature issues was working on community board reform, including the appointment process, recruitment, funding and how conflict of interests were dealt with. Ruth Messinger, a former Manhattan borough president, said that Stringer saw the office, which is largely ceremonial, as a legitimate platform from which to influence policy, including around land use and development. “He was early on questioning the value of huge tax breaks to developers who were only developing luxury housing, and that would become a key issue of his policy concern

both as city comptroller and now as candidate for mayor,” Messinger said. In January 2020, Stringer released an affordable housing proposal that would end the 421‑a tax subsidy to developers. But Tenants PAC Treasurer Michael McKee criticized the comptroller for previously taking campaign donations from the real estate industry. When Stringer was a district leader in the 1980s, McKee told City & State, “I heard him make the following speech time and time again on the Upper West Side: ‘We have to make sure that these politicians know that if they take landlord money, they are not going to get the tenant vote.’ That is verbatim. And then, of course, when he ran for borough president in 2005 that all changed.” In 2019, Stringer swore off donations from real estate developers. The recent disavowal of real estate contributions by many Democratic politicians has coincided with the ascendance of the party’s progressive wing, a shift in which Stringer has stayed ahead of the curve. In the past few years, Stringer broke with his party’s establishment in endorsing the progressive campaigns of a number of young women, including Tiffany Cabán for Queens district attorney as well as state Sens. Alessandra Biaggi, Jessica Ramos and Julia Salazar. Going into the 2021 Democratic mayoral primary, Stringer was seen as a leading contender because he was unquestionably qualified and aligned with the ascendant progressive movement. But in April a sexual assault accusation, dating back to Stringer’s 2001 campaign for public advocate, wounded his candidacy. Though Stringer denied the allegation, many of the young progressives rescinded their endorsements of him. Earlier this month, Teresa Logan, a Manhattan woman, told The New York Times that she had worked at a bar Stringer co‑owned in 1992 and that he had groped her and kissed her at the time. Stringer told the newspaper that he had no recollection of Logan but that he apologized if any of his behavior had made her uncomfortable. When City & State interviewed 16 former Stringer staffers for a May story, none knew of any alleged sexual misconduct, but many said he was a demanding and sometimes mercurial boss. Being demanding may come hand‑in‑hand with being intensely ambitious and hardworking. Over the course of their relationship, Holzer said that he has spoken to Stringer at 6 in the morning and 11 at night, and characterized his work ethic as “extraordinary.” Holzer, who was in charge of government relations at The Metropolitan Museum of Art during Stringer’s tenure as borough president, said that much of the collaboration between his office and cultural institutions flew under the radar. LED lighting, Holzer said, “sounds boring but saves millions and millions of dollars” in energy. “He believes in justice, and he believes in picking up the garbage as well,” Holzer said. – With reporting by Jeff Coltin

The right to walk Kiara St. James and other activists worked for years to end police harassment of transgender people.

OY IS IMPORTANT TO KIARA ST. JAMES. She is the co-founder and executive director of New York Transgender Advocacy Group, a trans-led organization that advocates for inclusive gender-based policies. During a video interview from Prospect Park in Brooklyn, she told City & State that much of her work has been focused on ensuring that happiness is accessible to people, particularly those who have been marginalized. “This is really about making sure that all human beings are able to bask in the sunshine that we fall into,” St. James said, regarding her advocacy work. As a Black woman of “trans experience,” St. James knows what it’s like to have her contentment interfered with based solely on how she is perceived. As she walks through the park, occasionally sharing views of its ponds and foliage on a hot June day, she recounts the multiple times that police were called on her and her friends when they attempted to have fun in Manhattan, like friends do. “It was very common for me and my girlfriends, who were all Black women, to be asked to leave establishments,” St. James recalled. “The folks that just didn’t like us and wanted to get us removed, all they had to do was say, ‘those men over there’ – no matter how female presenting we were, we were still misgendered and called men, and management would side with the other patrons who were not trans. And so oftentimes cops will be called in to remove us all because we’re convening and ordered food just like everyone else.” Like many other trans women, St. James was subject to discriminatory policing due to what was known as the “walking while trans” law. The statute, Section 240.37 of the state penal law, which outlawed “loitering for the purpose of engaging in prostitution” was introduced in 1976. The loitering law led to the disproportionate harassment and arrests of trans women and women of color. Since 1999, at least some version of a bill to overturn the law has been introduced in the state Legislature. And for years activists have been pushing to get the law repealed by suing New York City, organizing protests and marches. But nothing seemed to get them closer to eradicating the law. It wasn’t until a few months ago that it was finally overturned. On Feb. 2, Gov. Andrew Cuomo signed a bill, sponsored by state

Sen. Brad Hoylman and Assembly Member Amy Paulin to repeal the statute. “That specter of arrest hung over their every move, like on a weekend night when they would go out to have fun,” Hoylman said of what St. James had related to him. “And she said that feeling of constant prosecution for crimes you didn’t commit, or nobody believing you, led to this malaise of hopelessness.” Those closely involved with the bill’s passage say a confluence of many factors helped to repeal the statute. There was the recent change in the state Legislature’s composition, giving Democrats a supermajority in both the Assembly and the state Senate. Activists like St. James formed a coalition with advocacy groups, lawmakers and lawyers over the past several years. Many district attorneys refused to prosecute loitering cases, and the social justice movements that occurred last summer brought more visibility to the issue. “The morning that the legislation passed, I spoke to Kiara, and she reminded me that, up until that day, her community had felt like second-class citizens,” Hoylman told City & State.

HE STATE LEGISLATURE went blue in 2018 after being controlled by a Republican majority for about a decade, which had a major impact on the passage of bills related to LGBTQ rights. “Up until two years ago, we were unable to pass any bills with letters LGBTQ in the title,” Hoylman said, adding that he believed the Republicans were being obstinate in response to the federal Defense of Marriage Act, which made same-sex marriage legal in all 50 states, following a Supreme Court ruling in 2015. “They wouldn’t consider the Gender Expression Non Discrimination Act, (which prohibits discrimination based on gender identity and passed in 2019) they wouldn’t ban so-called gay conversion therapy. … Those were some lonely years between marriage equality,” he continued. Jared Trujillo, policy counsel at the New York Civil Liberties Union who worked with Paulin on the bill to repeal “walking while trans,” told City & State that the state has “repealed more anti-trans laws in the past few months than we’ve passed in the past decade.” When St. James came to New York in the mid-1990s with her partner, trans women had “no rights.”

Despite being known for its Democratic politics, she, like many trans women, found the city to be an unsafe place that lacked any protections for its trans or gender-nonconforming residents. She was routinely harassed, stigmatized and misgendered. “New York City had a Democratic mayor, and it had a predominantly Democratic City Council. So it speaks to the fact that even when the city is blue, a lot of those elected officials still hold on to very archaic mindsets in regards to LGBTQ issues, but especially when it comes to transgender, gender-nonconforming and gender nonbinary issues,” St. James said.

ATE MOGULESCU led the effort in 2016 to sue the New York City Police Department for using the loitering statute to illegally profile trans women. Mogulescu had created The Exploitation Intervention Project at The Legal Aid Society, which aims to end “systemic criminalization of victims of trafficking and sexual exploitation.”

Leigh Latimer, a supervising attorney for the project who worked alongside Mogulescu, credits her work with being the catalyst in reviving the mission to eradicate the “walking while trans” law. “She challenged the constitutionality of the statute,” Latimer told City & State. “And my understanding is that, as a result of that lawsuit, Amy Paulin became interested in introducing the bill to repeal the statute.” Mogulescu did not respond to an interview request for this story.

In 2019, the NYPD settled the lawsuit and agreed to revise its patrol guide to no longer allow officers to make arrests based solely on gender and appearances. “The changes reflected in this settlement are changes that have been well underway in the NYPD,” Sgt. Jessica McRorie, a spokesperson for the department, told the Daily News at the time. “The NYPD is committed to providing clarity to our officers on loitering enforcement, and did so through a combination of amplifications to the patrol guide and

enhanced training to ensure compliance.” Paulin, who has been involved in efforts to combat sex trafficking and wrote and sponsored the Trafficking Victims Protection and Justice Act, told City & State that she learned about “walking while trans” through her ties to women’s groups that she has worked with previously. The Assembly member then took on the bill to repeal the law, along with Hoylman, and began working with The Legal Aid Society and the New York Civil Liberties Union on the legislation. And as time went on, an even broader coalition of activists, attorneys and lawmakers formed, and the campaign to pass the bill began. Activists, in particular, were central to getting Albany on board with overturning the law by meeting directly with elected officials and taking on the responsibility of educating them about the ways in which trans women and nonbinary people have been discriminated against, as many lawmakers remained uneasy about supporting the campaign. “I would say one of the biggest tools we had in the campaign was having people to go and meet directly with our elected officials, and to put a human face behind the violence that people were subjected to under this law,” Richard Saenz, a criminal justice and police misconduct strategist at Lambda Legal, told City & State. “It made it that much more difficult for someone to not be in support of repealing the law. It also helped elected officials see that this was an issue that was important to their constituents. LGBTQ people, trans people, we vote.”

N 2019, those involved in the coalition were certain that the bill to overturn “walking while trans” would pass, considering Gender Expression Non-Discrimination Act – which St. James played a pivotal role in helping get passed – had been passed in the Legislature and signed into law. However, the campaign to decriminalize sex work was also in full force around the same time, and Paulin and Latimer said

that confused things for some lawmakers who mixed up the decriminalization movement with the “walking while trans” ban. “The advocates that were the most visible were the advocates that wanted to legalize prostitution,” Paulin said. “They were the most visible, and I had to talk to them about stepping back from that position for the time being for the sake of this bill because that position was harmful to the bill.” Advocates for decriminalizing sex work say doing so will benefit both people who are coerced into sex work and people who choose to do sex work. Paulin said Brooklyn District Attorney Eric Gonzalez’s and Nassau District Attorney Madeline Singas’ decisions to no longer process loitering charges was far more pivotal to the passing of the bill, though she credits activists and advocates with making strides through their lobbying efforts. When Gonzalez took office in 2018, he put together a commission to assess and produce a report on the justice system. The commission was made up of about 75 people, including academics, clergy members, defense attorneys and formerly incarcerated people. The commission would result in the office’s Justice 2020 report. It was through compiling this report that Gonzalez was able to meet with members of the city’s trans community who had been affected by the state’s “walking while trans” statute. “I had my eyes opened to some of the issues that trans women who were sex workers faced, such as the constant harassment from police, even when they were not engaged in sex work,” Gonzalez told City & State. “I really had my eyes opened to new approaches by the advocates, of how to better serve and protect this vulnerable community. And also, quite frankly, after sitting down with some trans individuals, learned about the trauma of arrest and incarceration in their lives and how that impacted them quite differently than other communities. ” In 2019, Gonzalez announced that the Brooklyn district attorney’s office would no longer prosecute charges under the loitering law, as he viewed it as discriminatory and out of date. Soon after, other district attorneys, such as Singas, began to follow suit. In 2020, Gonzalez also announced that prostitution charges would no longer be prosecuted against sex workers and in 2021 dropped 250 open prostitution-related warrants. Gonzalez said that refusing to prosecute such charges is actually beneficial to indi-

viduals involved in sex trafficking. “It’s so important for sex workers to have protections,” St. James said. “They don’t need rescuing. They need protection.” Many trans women, particularly trans women of color or trans immigrants, tend to turn to sex work as a means of supporting themselves, as they are often discriminated against when looking for other types of work. And many trans women are accused of engaging in sex work, when they are not, based solely on their appearance. “LGBTQ, Black and brown, immigrant and disabled communities engage in sex work at higher rates because they are locked out of jobs in the formal economy,” state Sens. Jessica Ramos and Julia Salazar wrote in an op-ed for the Daily News last year.

T’S BEEN AN uphill battle for decades to get the (repeal of the) “walking while trans” ban legislated into law, and it really has to do with galvanizing community,” St. James said about recognizing the need to create greater levels of involvement to advocate for the legislation. After the repeal of the “walking while trans” ban failed in 2019, the movement adjusted strategy. “One beautiful thing about this, the recent campaign and the successful campaign, was that it really centered and was led by people most impacted (by the statute): trans people and trans women of color specifically,” Saenz said. “I think that is a model that other places, including other campaigns in New York, should really adopt.” Trujillo also expressed that the greater inclusion of activists in the latest campaign made a significant difference. “It became a much richer campaign than it was two years ago, when it was mostly public defenders,” he said. “This time on the campaign, you had, of course, the public defenders but you also have (immigrant and worker advocacy organization) Make the Road – they were super active in this – you had every LGBTQ group in the city that was super active and so many people that recognize this is a trans rights issue.” Those involved in the effort to overturn “walking while trans’’ also credit the wave of social justice movements and demonstrations that occurred in the wake of George Floyd’s death during the summer of 2020 for finally putting the pressure needed on Albany to get the law overturned.

“I think that Black Lives Matter created space for people to reevaluate. Do we want to repeat criminalizing people for crime that is literally defined as loitering?” said David Brown, the legal director at the Transgender Legal Defense & Education Fund. And in June, 2020, trans activists mobilized and organized a march to speak out against the continued violence against trans women. An estimated 15,000 people showed up. “Midway through Pride Month, a loosely knit group of advocates organized a march of New Yorkers outside the Brook-

lyn Museum, which grew to 15,000 people, all dressed in white,” Hoylman said. “It took place adjacent to the murder of George Floyd and Breonna Taylor and I think it was a realization on the part of the public and legislators that this issue is really multifaceted and involves more people. And that I think really kind of created headwinds as we went into the session.”

HEN BIANEY GARCIA, a member of Make the Road New York who had been key in lobbying efforts to repeal “walking while trans,” heard that the law had finally been overturned, she wept. “It was an amazing day for me, to realize that a law that criminalized my community for 44 years was repealed in New York state,” Garcia told City & State. “I cried so much because it was a long fight, not only for me but also my community.” However, not all activists were overcome with joy. Tahtianna Fermin is

founder and CEO of Bridges4Life, which seeks to help trans and gender-nonconforming young people become confident, independent and educated. She told City & State that the news of the legislation being signed into law made her feel happy initially, but she wondered what the law’s repeal would really mean for trans women. “I teared up because it was exciting and we’re happy to hear that (the law was overturned) but at the same time, the real reality is that policing has always been against us,” Fermin said. “They have always found ways to manipulate the laws and the bills that are being passed to still find ways to get us arrested.” St. James agrees that there’s still much more to be done to protect trans women and nonbinary people, as discrimination against trans women has continued. “What we have learned, even with GENDA, is that we have legislative law that says that was illegal to discriminate on the basis of gender identity, but during COVID-19 we got a lot of folks reaching out to NYTAG, and to me individually, talking about how they were discriminated in a shelter,” St. James said. “You know, trans women who are legally allowed to be in women’s shelters, were being told by the staff, not so much the other women, but by the staff, that they couldn’t be there in the space, that they had to show proof that they had gender affirming surgery.” Advocates, attorneys and lawmakers are divided on what needs to be prioritized next, now that “walking while trans” has been repealed. While some feel that decriminalizing sex work should be prioritized, others feel that the NYPD needs to be disbanded or completely reformed – but nearly all agree that trans women need greater protections. For St. James, there’s a long list of things that need to occur to give trans women of color, and all marginalized people, the ability to live their lives to the fullest, including the creation of universal basic income, decriminalizing sex work and ending qualified immunity for police officers. But for right now, St. James is hopeful that more people continue to use their voices to speak up. “When a call (to action) goes out, we need for people to hear it and to come out and support,” St. James said. “That’s how we start to amplify our voices. You don’t have to be trans, you don’t have to be Black, but you have to be someone who believes that every human being should have the right to have a multifaceted existence.”

D E C A D E A G O New York legalized same-sex marriage. More recently, state lawmakers passed measures protecting transgender, gender-nonconforming and nonbinary New Yorkers, barring so-called conversion therapy and repealing the “walking while trans” ban. Meanwhile, LGBTQ elected officials hold influential posts. In the past year, voters elected the first two openly gay Black men – Reps. Ritchie Torres and Mondaire Jones – to serve in Congress and New York City’s first two transgender district leaders. And while the four openly gay men in the City Council are termlimited, a larger and more diverse cohort of LGBTQ candidates are well positioned to potentially win their Democratic primary

races this month. Of course, plenty of political and policy battles remain. New York leaders are battling back against anti-trans bills passed in state legislatures around the country while pushing for further protections here at home. While gay and lesbian individuals enjoy growing acceptance, transgender New Yorkers, including those of color, still confront prejudice and discrimination in their everyday lives. To mark Pride Month, City & State’s 2021 Pride Power 100 – which was researched and written in partnership with freelance journalist Gabriel Arana – recognizes the LGBTQ leaders who are still striving for full equality.

1 COREY JOHNSON NEW YORK CITY COUNCIL SPEAKER Corey Johnson continues to be one of New York’s most prominent LGBTQ politicians, and a counterweight to Mayor Bill de Blasio. Johnson’s mayoral hopes were dashed by battles over police funding – and his struggles with depression – but he has since thrown his hat into the ring in the race for city comptroller, promising stricter

oversight of agencies like the Department of Homeless Services, the Department of Housing Preservation and Development and the Department of Education.

3 BRAD HOYLMAN STATE SENATOR In his bid for Manhattan borough president, state Sen. Brad Hoylman has collected major endorsements from unions including the Retail, Wholesale and Department Store Union, the United Federation of Teachers and the Uniformed Firefighters

Association. All the while, he has remained an active and outspoken progressive in the state Senate, where in the past year he proposed legislation curbing the use of handguns and requiring students to receive the COVID-19 vaccine.

Randi Weingarten has used her pulpit to advocate for economic and racial justice as well as the safe reopening of schools post-pandemic. She went head-to-head with the Trump administration, threatening “safety strikes” if schools opened against the advice of public-health officials. She has advocated for teachers to get priority among the COVID-19 vaccination drive, but stopped short of endorsing the vaccines to be mandatory for teachers and students to return to school.

JABARI BRISPORT STATE SENATOR Over a decade ago, Jabari Brisport joined the push to legalize same-sex marriage in the state. He later embraced the Black Lives Matter movement and, as a schoolteacher, became active in New York City’s teachers union. After a New York City Council campaign fell short in 2017, he was elected to the state Senate last year, becoming the first openly gay Black man to serve in the state Legislature. He’s also one of a handful of socialist members pulling the Democratic Party to the left in Albany.

An activist for decades, Kiara St. James began her advocacy in New York with Housing Works in the 1990s. Today, as head of the New York Transgender Advocacy Group, she has pushed successfully for the passage of major LGBTQ legislation. This includes New York state’s Gender Expression NonDistrimination Act, or GENDA, which passed in 2019, and a recent measure to eliminate the state’s “walking while trans” law – an anti-loitering statute that has been used to target transgender people.

New York City Council Member Daniel Dromm of Queens is set to leave the limelight after using his post to press the New York City Police Department on overspending, and its aggressive handling of protesters during the 2020 George Floyd protests. He sponsored and helped pass the city’s intersex education bill, which includes money for public outreach to discourage unnecessary medical treatments for intersex individuals. Dromm has also sponsored legislation to ban the use of solitary confinement in New York City jails. Having withdrawn a previous bid for Queens borough president on account of his mother’s failing health,

New York City Council Member Jimmy Van Bramer is once again a contender for the post. Facing now-incumbent Borough President Donovan Richards and former Council Member Elizabeth Crowley in the June Democratic primary, Van Bramer has focused his progressive bid on housing and transportation — areas of focus he says were made especially salient by COVID-19. Meanwhile, New York City Council Member Carlos Menchaca of Brooklyn mounted a short-lived campaign for mayor, dropping out in March. Menchaca, a Mexican American who last year helped block a proposed Industry City rezoning, was one of the council’s more progressive members. However, after exiting the mayoral race, Menchaca endorsed the relatively moderate Andrew Yang, one of the frontrunners in the contest.

13 DARREN WALKER PRESIDENT FORD FOUNDATION Since becoming the Ford Foundation’s first openly gay leader in 2013, Darren Walker has administered the organization’s $14 billion endowment – with yearly grants around $500 million – keeping an eye toward racial justice and inequality. term-limited out of office at the end of this year. “We have really viable, top-notch candidates running. There’s a lot of good people in a lot of races, hopefully we’ll be enlarging our caucus,” said Allen Roskoff, president of the Jim Owles Liberal Democratic Club, a progressive, LGBTQ focused political club. Surpassing the high watermark of seven LGBTQ members could be a challenge, but it’s a goal for some members of the community in this June election. “Everybody’s got pride on their mind, so maybe we’ll surprise everyone,” Roskoff said. Erik Bottcher is hoping to be the fourth openly gay candidate in a row to

represent District 3 on the west side of Manhattan, following Johnson, Quinn and Duane. Amit Bagga is hoping to succeed the openly gay Council Member Jimmy Van Bramer in District 26 in western Queens, and Alfonso Quiroz is running to replace the openly gay Danny Dromm in District 25 in western Queens. FTER DECADES OF holding New York City primaries in September, the contest is in June this year, and this Pride Month primary could result in the most LGBTQ council members of all time. At least nine candidates who are members of the community are widely considered to be among the leading contenders in their races, and many more are running viable campaigns. “To be elected as the first gay Black woman during Pride Month would be unprecedented, obviously,” said Crystal Hudson, who is running in District 35 in Brooklyn, where Majority Leader Laurie Cumbo currently represents Fort Greene, Prospect Heights and Crown Heights. The timing of the race “gives us an opportunity to really talk about pride and what it means to have pride in oneself, whether you identify as LGBTQ or not.” The first two openly gay council members, Thomas Duane and Antonio Pagán, were elected in 1991. In 2010, there were four openly gay members, including the City Council speaker at the time, Christine Quinn. By 2016, when longtime member Jimmy Vacca came out, there were seven members in the council’s LGBT Caucus. That fell to five members in 2018, including City Council Speaker Corey Johnson, and is now down to four, after Rep. Ritchie Torres left the council following his election to Congress. That’s 8% of the 51-member council who are LGBT, which is actually more than the approximately 7% of New York City residents who self-identify as lesbian, gay, bisexual, other sexual orientation or transgender, according to 2014 to 2016 survey results from the state Department of Health. That percentage may have grown, as homophobia and transphobia decline and the LGBT Caucus may grow too, even though all four of its current members are

District 7 in Upper Manhattan, is hoping to be the first out nonbinary council member ever. Other LGBTQ candidates running include Wilfredo Florentino in District 42 in the East New York section of Brooklyn, Aleda Gagarin in District 29 in central Queens, Billy Freeland in District 5 on the Upper East Side of Manhattan, Jeffrey Omura in District 6 on Manhattan’s Upper West Side and Kristin Richardson Jordan in District 9 in Central Harlem, also in Manhattan. All of the LGBTQ candidates, like all previous LGBTQ members of the council, are Democrats. In a sign of growing LGBTQ visibility, Hudson and Chi Ossé, who is running in District 36 in Brooklyn, witnessed history in the midst of their own runs for office. State Sen. Jabari Brisport, who represents a district that overlaps with the council districts that Hudson and Ossé are running in, became the first

openly gay person of color in the state Senate when he took office in January. The council races are also increasing representation of queer New Yorkers of color. Cabán is Latina, Ossé is Black and 23 years old and Bagga would also be the first South Asian American to serve on the City Council. Many of the LGBTQ candidates have been talking and messaging amongst each other, sharing stories, advice and support. Cabán, who ran for Queens district attorney in 2019, said she has “the weird experience of being the seasoned veteran,” of some of the queer candidates. “My role has been to say, ‘What you’re feeling is entirely normal. You’re not crazy.’” Cabán wants the camaraderie to continue in the council, with the next iteration of the LGBT Caucus. “I think we’re having more intentional conversations about what a quoteunquote queer agenda looks like,” she said. In Cabán’s eyes, that agenda is a progressive, intersectional one that considers bigger issues like housing “because queer youths are exponentially more likely to experience homelessness” and expanding employment rights. But she’ll need allies on the council to work with her. “The same reason we talk about how we can’t have these tables full of white, cisgendered straight men being in charge of legislating around our reproductive rights,” Cabán said. “We have to make sure there are enough of our experiences at the table to be able to effectively push an agenda.” But first, successful candidates will get to take pride in making history. “I can’t wait to be victorious on June 22 and have the biggest, gayest, celebratory party,” Hudson said.

Vulnerable patients. Vulnerable communities. Vulnerable hospitals. It’s time to protect them all. When vulnerable communities across New York need medical care, they rely on their local hospitals. These “safety net” hospitals serve the most vulnerable New Yorkers, who mostly rely on Medicaid and Medicare. Despite being a lifeline for low-income communities, these freestanding hospitals receive little outside funding and are underpaid by Medicaid and Medicare — making it difficult for them to make ends meet.
