IN 1866, New York became the first state to pass a law against animal cruelty. Legislation a year later tasked the American Society for the Prevention of Cruelty to Animals with enforcement, which it did until January 2014, when the New York City Police Department took over the job of responding to reports of animal abuse. The ASPCA still partners with the NYPD to care for mistreated animals and find them homes, but it has been freed up to address other matters. It championed a recent New York City Council law requiring full-service animal shelters in each borough. The ASPCA supports proposed city bans on fur sales and foie gras and a state bill to block pet stores from selling dogs, cats and rabbits. But its primary focus is more basic: keeping people and pets together. And while cynics may complain that animal issues shouldn’t overshadow more pressing matters – like crime or homelessness – the ASPCA says it’s not an either/or proposition. “We find that in many places, where human beings are lacking or suffering are the same places where animals are suffering,” said Michelle Villagomez, the ASPCA’s New York City senior legislative director. “So we’re trying to figure out how to help people and their pets.” In this week’s magazine, we assess where New York is today in terms of animal policy – and what’s coming up next.

In over three decades as the borough’s top prosecutor, Morgenthau took on mobsters, corrupt politicians and Wall Street greed, and is remembered as a crusader for justice. How would you rate Cuomo’s performance in taking control of the MTA today? It changes month by month, and it changes year by year. The issue of the governor not being fully accountable for the transit system long predated Gov. Cuomo. And the challenge of holding the governor accountable will outlast Gov.

Cuomo. But, that said, in politics, if something is not a personal problem for somebody, it is not a problem that gets resolved. Community organizing 101: If the governor can solve the problem and he’s not doing it, you need to focus attention on the governor. Some would argue that Cuomo may have overstepped his authority on certain MTA issues, such as his move to cancel the full shutdown of the L train earlier this year. To succeed at running the MTA, the governor has to play an active enough role that he is overseeing the agency and taking charge, but also play a supportive enough role that he can attract and retain top talent to do day-to-day management. I think that the governor has to be careful when he gets too into the weeds, because the governor of the state is not always in the best position to make technical decisions about what’s best for transit.

AFTER TROTTING ALONG for years, animal welfare legislation seems to have broken out into a run. Here are some of the recent bills that have been introduced or enacted, both statewide and in New York City.

tral Park’s carriage horses into the park – a small, but significant win in that ongoing regulatory battle. “There’s a lot of animal rights legislation that’s finally making progress after years of not a lot of progress on that front,” said Edita Birnkrant, executive director of New Yorkers for Clean, Livable and Safe Streets, or NYCLASS, an organization that lobbies for animal welfare. But why now, in 2019? Animal welfare legislation is nothing new. Rosenthal has passed at least one animal welfare law each year since taking office in 2006. The measures have ranged from banning the tattooing and piercing of pets to allowing cities to better regulate so-called puppy mills. In the days of divided government, Rosenthal, a Democrat, would often pass bills working with Republican legislators. “Caring about animals is not a partisan issue,” she said. But in recent years, Rosenthal said, her animal welfare bills have been getting more support. For that, she credits

the “years of education and effort and advocacy” by animal welfare groups – but also their pull at the polls. “I always get pushback when one of my bills is going forward, and the animal advocates send out email blasts to everyone,” Rosenthal told City & State. Lawmakers complain to her, “‘My whole inbox is full of people advocating for your bill!’ So I think legislators are realizing this is an important constituency.” This dynamic has come into sharper focus at the city level. NYCLASS has just lobbied extensively, spending $156,000 lobbying for animal welfare legislation in the first six months of 2019 alone, but the organization has also been quite generous to politicians that agree with them. NYCLASS and its main backers, real estate executives Stephen Nislick and Wendy Neu, were major donors to New York City Is Not For Sale, a political action committee that spent more than $1 million ahead of the 2013 mayoral race. NIMALS WILL NEVER decide an election in New York. Yes, New York City Mayor Bill de Blasio’s 2014 run-in with a groundhog – which later died – may not exactly be helping his presidential campaign. But the proud horses, cats, beavers and geese of the state of New York simply aren’t allowed to vote. The people who love animals, though – that’s a different story. “Many constituents are one-issue voters. And their one issue is animals,” said Manhattan Assemblywoman Linda Rosenthal, who is likely New York’s most prolific legislator on animal welfare issues. And that is one of the reasons why New York City – and to an extent, the state as a whole – is caught up in an animal welfare stampede. In June, the state Legislature passed a bill to make New York the first state to ban the declawing of cats. Weeks later, the New York City Council held a hearing on a package of 16 animal welfare bills and resolutions, running the gamut from banning the sale of the French delicacy foie gras to establishing a city department of animal welfare. Additionally, the city is considering following Los Angeles and San Francisco in banning the sale of fur. Already, the City Council passed a bill to build new full-service animal shelters in Queens and the Bronx, and the de Blasio administration managed to move pickups for Cen-

seeing progress happen,” Birnkrant told City & State. “And by the way, the fur ban proposed by Corey Johnson actually took animal advocates by surprise. We weren’t even pushing for a fur ban bill! He did that on his own.” If Johnson is after animal welfare voters’ support, he’s making a strong case. He’s the lead sponsor of the fur ban bill, and he’s a driving force behind the animal rights package of 16 bills being considered. A spokesman for Johnson, Juan Soto, told City & State in an email that this isn’t anything new: “The Speaker has always been an animal lover and protecting their welfare is a priority.” Johnson said as much himself, speaking at a regularly scheduled City Hall press conference on June 18. “I always try to lean in the direction of being humane and treating animals with respect. I’m a big animal lover,” he said, adding that he himself has a rescue cat. and animal welfare advocates, such as serving only plant-based meals in New York City schools on “meatless Mondays.” Brannan said he and Johnson first talked about introducing a big animal welfare legislative package in April 2018 on a trip to Israel. Brannan had just been elected, and Johnson was the newly elected speaker and wasn’t yet considering a mayoral run. Brannan knew Johnson would be receptive, since he had sponsored animal welfare legislation in his first term. So far, none of the city’s major animal welfare bills introduced this year have passed. The two marquee proposals, the foie gras ban and the fur ban, are facing staunch opposition from some business interests in the city. “What they would do is wipe out my industry and put me out of business. They’d have more empty stores and more loss of these jobs,” said Nick Pologeorgis, the owner of Manhattan-based Pologeorgis Furs, which has around 20 employees. “I feel now that the City Council understands a little bit better of what is involved here, and I’m sure they don’t want to see 7,500 jobs lost in New York City.” Opponents of the fur ban launched an aggressive campaign and enlisted black churchgoers to stress fur clothing’s importance in their community. One activist, the Rev. Johnnie Green, told The New York Times that Johnson’s support for a fur ban may cost him votes among black New Yorkers. Johnson’s spokesman said the animal welfare package is still going through the legislative process, and Brannan thinks the speaker and his staff are letting the issue cool down a bit before moving on the bills. “I think Corey has the stomach to want to push this forward. The fur stuff was super polarizing, but he stuck to his guns,” Brannan said. “That’s the kind of leadership we need to get some of this stuff done.” And even if the bills pass into law, animal welfare activists won’t sit, stay and lie down for long – especially when it comes to one of New York’s most politically charged battles. “While there’s been a rapid advance of other animal rights issues,” Birnkrant said, “carriage horses are still way behind in what we can do to make their lives better.”

portation this year than at this point last year – 55 so far in 2019 versus 37 in the first six months of 2018 – that may just reflect the happenstance of what cops see. MTA rules state that pets are not allowed at MTA facilities “unless enclosed in a container and carried in a manner which would not annoy other passengers.” In comparison to other large metropolitan transportation systems, the MTA language is vaguer than other cities, which generally have more specific requirements for what qualifies as a carrier. The MTA’s website has more specific information about what kind of pets are allowed on public transportation and what constitutes a carrier. It reiterates that small domestic pets are allowed only when they are in carriers. Most importantly, it says that no part of the ani-

mal may stick out of the container. A spokesperson for the agency said that, similar to their guidance against taking up multiple seats with luggage or large bags, the carrier must not inhibit other riders’ ability to access seating or handrails. People with disabilities who require assistance from a service animal are the exception to the carrier requirement, but the animal must still have a harness. The Americans with Disabilities Act protects those requiring a service animal from discrimination in public places. Law enforcement may ask if the animal is required for a disability and what tasks it is trained to perform, but they are not permitted to ask to see a license. The MTA also issued applications for voluntary licenses for service dogs to avoid confusion amid the rise in

HE NEW YORK CITY subway is home to a host of bizarre sights, be it Jimmy Fallon and Miley Cyrus performing at a station in disguise or someone lugging around a Saint Bernard in an Ikea bag. In recent years, the latter seems like a much more frequent sight. There are countless pictures on social media of four-legged commuters with the hashtag #subwaypets or #subwaydogs. The pets are the subjects of dedicated social media pages like @NYCsubwaydogs on Instagram and are included in accounts that document strange subway sights, like @subwaycreatures. The majority of pets on the subway are dogs, with some notable exceptions, like a huge iguana. Online rundowns of pups on the subway have compiled photos and videos showing dogs of all sizes peeking out of bags that range from backpacks to duffle bags. But, to the consternation of some, they aren’t always in bags – or anything at all. In 2018, a Twitter video of a dog just on a lease on the subway prompted the official New York City subway Twitter account to direct the passenger to call 911. They later walked that recommendation back, saying that dogs are great, but they have to be in carriers. So, what are the Metropolitan Transportation Authority’s rules about commuting with pets? And are there actually more pets on the subways these days, or do they just have a larger social media following? There are no hard numbers on how many pets are taken on the subway in general, as there’s no pet fare. Over the past 12 months, the MTA received 109 complaints about animals not properly contained in carriers, and they receive thousands of other complaints every year, according to an MTA spokeswoman. While there have been more NYPD summonses issued for unauthorized animals on public trans-

popularity of emotional support animals. Emotional support animals are defined as pets soothing to those with a variety of mental illnesses, but they lack the formal training of service dogs. There’s no accepted science to back up the necessity of emotional support animals. Most of the criticism of emotional support animals in public areas comes from stories about people attempting to fly with their emotional support turkeys or peacocks. The New York chapter of the Center for Independence of the Disabled told City & State that, while the people they represent do have serious concerns about the accessibility of public transportation in New York, people exploiting the use of emotional support animals to travel with their pets is not one of them. The MTA is clear that emotional support animals are not exempt from the rules requiring pets be inside carriers. Because the carrier must contain the animal and prevent them from bothering and impeding other commuters, the large dogs in oversized duffle bags don’t exactly fall within the MTA’s rules, which are enforced by the New York City Police Department. If an animal is outside of a container or in an insufficient carrier, officers may ask the owner to leave the subway or issue them a ticket, which could cost a commuter $25. Fines may be disputed with the Transit Adjudication Bureau within 30 days of the violation. Police officers don’t issue fines for unauthorized animals on public transportation very often, compared to other common infractions like fare evasion. It is unclear if that’s because improperly transported animals aren’t prevalent, or if perpetrators are simply asked to exit the subway. It’s also possible that police officers don’t always notice or sometimes determine that the pet isn’t bothering anyone and they have higher enforcement priorities. Pets deemed too large or not properly restrained can be barred from a subway car, as seen in a viral video from April of a big dog in a minimal burlap sack being refused access by the train conductor. An NYPD spokeswoman would not speak generally about how they theoretically handle improperly restrained animals on public transportation, noting that officers have discretion and each case is different. Domestic animals on the subway are a pretty low-level concern for most commuters and law enforcement alike. Plus, New Yorkers with pets seem to mostly follow the rules. At worst, they are a mild annoyance during rush hour. At best, they are a fun interlude on a monotonous commute, like a talented busker. As long as they’re in a carrier, the MTA is not planning on cracking down on the furry fare evaders anytime soon.

De Blasio rode the horse carriage issue to City Hall, but his proposed ban crashed. So what’s next for New York’s equine advocates?

I

N THE 2013 New York City mayoral race, Bill de Blasio was trailing the pack when he made a campaign promise to ban the horse carriages in Central Park on “day one.” De Blasio’s pledge brought in support from the animal welfare group New Yorkers for Clean, Livable and Safe Streets, or NYCLASS, whose aggressive attack ads against Christine Quinn were widely believed to help de Blasio overtake the early front-runner and secure the Democratic nomination. Halfway through his second term in office, however, de Blasio hasn’t delivered. He did seek a range of restrictions on the horse carriage industry, most of which fell short, succeeding only in limiting pickups to inside the park. And with de Blasio now running for president and dealing with more pressing local issues, advocates have sought other incremental changes to protect horses while shifting their focus to other animal welfare issues, such as proposed citywide bans on foie gras and fur sales. De Blasio last year directed the city Department of Transportation to issue a rule that requires all horse carriage pickup stations to be moved into the park, in order to protect the horses from car traffic. There’s also a City Council bill pending that would prevent the carriage horses from working when the heat index reaches or exceeds 90 degrees.

But after making a ban on horse carriages a central part of his 2013 campaign, de Blasio didn’t move quickly. Animal welfare activist Donny Moss, who wants to ban horse carriages entirely in midtown Manhattan, thinks de Blasio would’ve succeeded if he had acted immediately. “I’m disappointed that he waited until it became politically infeasible to fulfill his promise,” Moss told City & State. It wasn’t until December 2014, nearly a year after he took office, that de Blasio introduced legislation in the City Council that would have reduced the number of licenses for carriage horses and moved the stables into Central Park. But this bill floundered and never came up for a vote. “They had the most powerful elected official in New York City stating that, ‘Hey, watch me do this on day one,’” Moss said. “And then he didn’t do it. And then the opposition mobilized.” In 2016, de Blasio tried to put a deal together with the carriage industry, which would’ve significantly reduced the number of carriages and moved all horses inside of Central Park. But due to pushback from park conservationists, the Transport Workers Union, the Teamsters and others, the City Council canceled its scheduled vote on the deal. Then, in 2017, NYCLASS announced that it would no longer pursue the elimination of carriage horses from

Central Park and would try to protect the animals through other means. “He had a bill in the City Council that he fought pretty hard for. It didn’t end up happening,” NYCLASS spokesman Chris Coffey said of de Blasio. “But that wasn’t his fault. That was the City Council.” Last year, the mayor used his executive powers to move all horse carriage pickup stations inside of Central Park, a rule that started being enforced in February. The new pickup locations are spread around the perimeter of the park, positioned close to highly trafficked exits. This is a big change, considering carriage drivers have been picking up fares on Central Park South for years. De Blasio’s rule, however, doesn’t move the stables inside of the park, and horses will still be allowed to walk on city streets. While some advocates grumble that little has been done to improve conditions for the horses, the new rule “was a big victory for the horses and for activists,” Edita Birnkrant, the executive director of NYCLASS, told City & State. “It’s definitely a big improvement for the horses to not have to be standing and maneuvering in all of that heavy traffic 10 hours a day.” While NYCLASS is no longer pursuing a ban on carriage horses, it is invested in passing a series of measures to protect the four-legged animals. “Like temperature

work on other issues.” Yet there’s still a chance that a full ban could gallop back into the spotlight – especially if Quinn, who was trampled by animal welfare activists in 2013, follows through on a rumored comeback bid for City Hall in 2021. NYCLASS played an important role in sinking Quinn’s 2013 candidacy, said political consultant George Arzt. “There’s no doubt that it had a big impact,” Arzt said. “Because they have so much money behind them, it was a very potent force in the election.” Much of the organization’s money has come from Stephen Nislick, a real estate executive. It was also reported that Nislick’s interest in banning horse carriages might have been motivated more by his desire to build affordable housing on prime real estate currently occupied by the stables on West 38th Street than to protect the animals, although Nislick denied the allegation. Mike Morey, Quinn’s former campaign manager and a managing director of SKDKnickerbocker, said the money that flowed into NYCLASS’ independent expenditure committee in 2013 was “certainly instrumental in knocking her

down.” But Morey contends that if Quinn had been pro-horse carriage, de Blasio allies would’ve just found another issue to raise money on. “I’m not so sure that de Blasio backers wouldn’t have found another venue by which to drop off cash to go after her on the IE side,” Morey told City & State. “The only relevance that NYCLASS would have (in 2021) in terms of being an issue is whether it just allows itself to once again become a repository for campaign cash to attack a front-runner – and back whoever their preferred candidate is in the race.” Regardless, NYCLASS could still play a key role in 2021. “I think it will be repeated,” Arzt said. “Nislick has a lot of money. And I think that where there’s money and the ability to spend it, they’re going to spend it.” For her part, NYCLASS’ Birnkrant said she hopes Quinn’s views on horse carriages have changed. “We can only hope that if she reenters public service, she will have learned the importance of fighting for animals,” Birnkrant said. If Quinn has met this standard, NYCLASS would be happy to work with her in the future, she added. “But if she hasn’t, we won’t work with her.”

Building on the momentum of de Blasio’s decision to move horse pickups inside the park, the heat index bill was discussed at a City Council hearing on June 18 and currently has 19 co-sponsors, shy of the 26 votes needed for a majority in the 51-member council. Allie Feldman Taylor, the director of NYCLASS before founding another organization, Voters for Animals Rights, in 2016, said that the shift in focus has helped the movement find success on other matters, including banning cat declawing and elephants in circuses, and building support for New York City’s proposed bans on fur sales and foie gras. “For a long time, (the) carriage horse (issue) was taking up most of the oxygen – and it’s an incredibly important issue and this community is never going to stop fighting until carriage horses are banned,” she said. “But through our energy and seeing how much society had grown in their compassion to animals, I knew that we could get a lot done by turning our attention away from the horses and starting to

The feud between New York City Mayor Bill de Blasio and Gov. Andrew Cuomo inadvertently killed Lefty, the Harlem deer, but his kind still have a chance elsewhere in the city – especially in the Bronx and southern Staten Island. They have gotten so numerous in these areas that the city came up with a plan to sterilize many of them. If a proposed bow hunt on Staten Island ever happens, then residents of the “Forgotten Borough” can finally feel that they really are more like middle America than midtown.

Despite urban legends about a self-sufficient population of sewer alligators, the only way alligator mississippiensis get into the Big Apple is likely because someone brought them here as a pet. What is surprising, then, is how generation after generation of New Yorkers still think buying alligators is a good idea. And while it might end up badly for the human, it usually ends up even worse for the alligator. One unlucky beast roaming the sewers was beaten to death in 1935 by people wielding snow shovels. In recent years, alligators have tended to pop up in Queens, with sightings in Fort Tilden, Flushing Meadows and under a car in Astoria. They even appear to be spreading out into Long Island.

The high-flying raptors are thriving in Manhattan, in part thanks to a seemingly never-ending supply of rats and pigeons. These efforts have not gone unnoticed by the people of Gotham, some of whom follow the lives of redtailed hawks with the fervor of celebrity groupies. But living in the city isn’t all fun and games for the hawks, who face significant dangers from ingesting poisoned vermin and the perils of flying around a city filled with glass buildings. Luckily, they’ve got at least one state senator on their side.

“Looney Toons” drastically understates just how wily coyotes are. Originally from the Great Plains, coyotes have taken over the ecological niche left by the virtual extinction of wolves, which once roamed most of the U.S., including New York City. Now coyotes are permanent residents of the Bronx and have been seen hitting the bar scene in Long Island City, Queens. The omnivorous canine loves to munch on garbage and has a unique ability to adapt to its surroundings – whether that means hunting for rats in Harlem or finding a sweet nook to sleep along the Hudson. They are not looking for trouble, but they have been known to attack small children and animals.

Cornell University. “But these are wild animals and we’ve got to respect that.” That means recognizing that New York City is no longer just a place for people and their pampered pets. Here are the species surviving among the skyscrapers.

OPOSSUMS

BLACK BEARS

North America’s only marsupial began moving into the city about 100 years ago as its range expanded with human settlement. Opossums look like an ill-fated cross between a rat and a kangaroo, and have the street smarts and punch to match. They will gnash their teeth and claws, play dead or even give off a stinky mucus to dissuade predators from attacking. The results are clear. No New Yorker in their right mind wants a taste of an opossum – literally or otherwise – so we leave them to the garbage with minimal screaming.

GRAY SQUIRRELS While native to the area, deforestation virtually wiped out the native squirrel populations of New York City by the mid-1800s. Luckily, Victorian-era parkgoers wanted to see the critters roam around the newly created Central Park. You could say that the city was a victim of its own success. Millions of the little critters now live throughout the city, and while humans and squirrels have learned to mostly coexist, there have been occasional purges to lower the population of the rodents. Every now and again, squirrels find their own ways to fight back, like the two occasions when they messed with power lines and shut down the Nasdaq Stock Market.

SASQUATCH There is no guarantee that the Prospect Park Bigfoot will reappear anytime soon – the bipedal cryptid might not even exist. However, assuming that the Brooklyn Paper has its facts in order, the next snowstorm could allow Brooklyn to become a top destination once more for America’s top Bigfoot hunters. Some wild animals may be too dangerous to take in, but the experience of the Henderson family suggests otherwise.

If you are afraid of bears, now might be the time to move away from New York City. Bears are moving through the Hudson Valley and showing up in New Jersey, just miles away from Manhattan. The bottom line is that the bear population is growing, and when they cannot get enough food in the forest, they will go elsewhere. A dead cub was even found in Central Park in 2014, and there could be more coming in his wake, so watch out for any angry mama bears.

WEED-EATING GOATS

Gotham means “goat town” in Old English, after all. In May, New York City’s Riverside Park welcomed a team of 24 hungry goats – as a part of its “Goatham” restoration project – to eat poisonous and invasive plants, such as poison ivy and mugwort, in the park. Goats were similarly used to weed Prospect Park in 2016. “For them it’s an all-you-can-eat buffet,” Riverside Park Conservancy President and CEO Dan Garodnick told NY1. “For us, it is critical horticultural care that we need in a part of the park that has proved challenging.”

THE CANINE UNIT

Since the state police created its Canine Unit in 1975, dogs have remained important companions and employees on the force. The state’s Canine Unit is comprised of 29 explosive detection teams, 57 narcotic detection teams (20 of which have dogs trained in cadaver detection) and four teams of bloodhounds used exclusively for tracking. Typically,

Belgian Malinois, German shepherds, bloodhounds and Dutch shepherds are popular breeds on any police force, but in 2016 a pitbull became a police dog for the first time in New York. New York City has its own crop of canine officers serving the NYPD, divided into five separate K-9 units with roughly 100 dogs in total, as of 2016.

THE MOUNTED UNIT

Scoring a spot on the NYPD’s coveted Mounted Unit is surprisingly hard to do. In 2018, 40 officers applied for positions on the Bronx’s Troop D mounted unit (one of four mounted units in the city) to work alongside the NYPD’s equestrian officers, but only nine made the cut. The Mounted Unit, which began in 1858, currently has 55 horses, and its efforts are focused mainly on crowd control, counterterrorism, traffic control, curtailing street crime and public relations. “When someone needs something, a lost child, a crime’s committed, they come up to us because they can see us in the crowd,” Jason Bernfeld, a Mounted Unit officer, told CBS New York.

THERAPY DONKEYS

At SUNY Plattsburgh, a small herd of therapy donkeys were hired in May for Mental Health Awareness Month to help its students cope with end-of-term anxiety brought on by final exams and term papers. The donkeys came from the New York nonprofit Thera-Pets, which uses farm animals to help people quell their anxiety and depression. The animals were brought to SUNY Plattsburgh’s wellness fair as a treat for overwhelmed students. “We thought donkeys and a wellness fair would be a fun and creative

way to discuss mental health and help our students de-stress,” Ashley Durocher, associate director of student support services and student accessibility services at the university, told the school’s paper.

TWENTY THE DALMATIAN

The days when Dalmatians used to clear the streets for firefighters headed toward burning buildings have long since passed. But after 9/11, one New York City firehouse welcomed a Dalmatian onto its team. Ladder Company 20 – which lost seven firefighters when the twin towers collapsed – was gifted Twenty the Dalmatian from the Monroe County Sheriff’s Office a few weeks after the attacks. Twenty became a beloved part of the team almost immediately. Twenty accompanied the firefighters of Ladder 20 on all of their runs and even made appearances at events held for fallen firefighters to bring some much-needed comfort and levity to mourners. Twenty, a symbol of healing and hope, died in 2016, at the ripe old age of 14, surrounded by the firefighters who cared most for her.
