IF GOV. KATHY HOCHUL wants to hold on to her lead over Rep. Lee Zeldin in this year’s gubernatorial contest, all she needs to do is look across state lines at Oprah Winfrey’s surprise endorsement of Pennsylvania Lt. Gov. John Fetterman’s run for the U.S. Senate last week.

The star-powered endorsement was covered by multiple news outlets, created buzz on social media and showed how attention-grabbing the support from a celebrity can be. In this case, the endorsement came after Fetterman’s lead over GOP candidate Mehmet Oz, the celebrity known as Dr. Oz, had dwindled.

Hochul has found herself in a similar spot with Zeldin narrowing her once-commanding lead over him, although she did regain some ground last week in the latest Emerson College poll that showed the governor ahead by 8 percentage points. A Marist College poll released Thursday had her leading by 10 points. This came as Hochul was calling out Democratic heavyweights to help with get-out-the-vote rallies in New York City.

Fortunately for the governor, she’s already got endorsements from actors Mark Ruffalo and Leonardo DiCaprio, as well as stand-up comic Amy Schumer, that she may want to tout to further improve on her lead over Zeldin. The Republican sort of has a similar option. He did win the endorsement of former President Donald Trump, who probably still considers himself a celebrity from his early days in the spotlight and as host of “The Apprentice.”

There’s also a popular local celebrity who threw his support behind the GOP candidate: The Naked Cowboy. That even caught the attention of the celebrity-chasing New York Post.

As the New York gubernatorial race officially hit the final stretch, Gov. Kathy Hochul and Rep. Lee Zeldin’s campaigning efforts intensified. In the final week and a half, both candidates traversed across the state,

held rally after rally where they urged New Yorkers to hit the ballot box and attempted to enlist allies behind the scenes. While Hochul made appearances at events like the Brooklyn Democratic Party Gala and rallied with Reps. Jamaal Bowman and Adriano

Espaillat in an attempt to increase Black and Latino enthusiasm, Zeldin drummed up support from several Brooklyn-based Orthodox Jewish groups, which could lead to thousands of additional votes.

The criminal tax fraud trial of former President Donald Trump’s family business began last week. Prosecutors cast the case against Trump’s companies as one of “greed and cheating” – terms that could probably apply to Trump’s other legal woes too.

Big news for literally anyone applying for a job in New York City: Employers are now legally required to include job postings under a new law that took effect Nov. 1. That means advertisements for jobs that are “publicized to a pool of potential applicants” must now include both the minimum and maximum amounts that employers are allowed to pay. City officials have touted the law as something that’ll bolster pay equity, thus correcting long-standing inequalities and discrimination – at least in theory.

making it impossible to glean information on other employees’ salaries. While the law requires businesses to post “a good faith salary range” that an employer “honestly believes” they are willing to pay, enforcement will likely be tricky, and whether or not the city will crack down on the broad ranges remains to be seen.

TRUMP SUES AG

In an attempt to shield records from the trust that owns The Trump Organization, former President Donald Trump filed a lawsuit against state Attorney General Letitia James, alleging that she’s engaging in a “war of intimidation and harassment” and that she’s abusing her power by investigating him. The lawsuit, which was filed in a Florida court on Nov. 2, follows James’ decision to file a $250 million civil lawsuit against Trump in September, which claimed

that the former president falsely inflated his net worth to obtain loans for his family organization.

ABSENTEE VOTING LIVES ON

With early voting already underway and thousands of absentee ballots already distributed, a state appeals court sided with Democrats in two cases to uphold New York’s absentee voting ballot laws for the coming general election. In both cases – the first involving New York Republican and Conservative parties suing the state for “unconstitutional measures’’ on how the state validates ballots, the second centering on whether people should continue to be allowed to vote with an absentee ballot if they are afraid of contradicting COVID-19 or other illness – the court unanimously shut them down due to the lawsuits’ timing.

New York City to open migrant center in Midtown hotel With the number of newly arrived asylum-seekers now stretching past an estimated 22,000 people, a third emergency relief center will soon open at a Midtown hotel – this time for single women and adult families, according to New York City Mayor Eric Adams.

News of the Humanitarian Emergency Response and Relief Center came after reports from the city that the rate of new arrivals had slowed significantly since President Joe Biden’s administration implemented a set of policies intended to manage the swell of Venezuelan migrants entering the country. But while the tent complex on Randall’s Island for single men has remained far below its capacity of 1,000 beds, Adams said in a statement that “a steady stream of single adult women and adult families” have continued to arrive in New York.

Like the other emergency relief centers, the new center will be a first point of contact for asylum-seeking women and adult familes.

There, city officials said, they’ll receive services like food, medical care, case work and help charting their next steps. The center, which will be located at the Hotel Wolcott, will include 175 rooms.

“We’re actually glad to see this approach being taken,” she told reporters. “We think it’s an effective one, a good way to use our hotels.”

As to whether she felt like the Randall’s Island center was still a prudent use of resources given how few new arrivals have utilized it so far, she said the council was going to look at it and potentially assess whether it’s worth it to continue operations. But the speaker – who passes the city budget in conjunction with the mayor – said she wasn’t aware of how much the city had spent on that Randall’s Island setup so far.

New York City Council Member Keith Powers, whose Manhattan district includes Hotel Wolcott, said the city was trying to address the rapidly changing need for housing.

“Ultimately we want to find long-term permanent housing for everyone that’s coming here, but right now, we need to, most importantly, stabilize them and make sure they have a place to stay and resources,” he said.

How did you think you performed in your debate against Chuck Schumer?

The important part of that process was to be able to tell the untold story of New York, much of which we didn’t get to discuss – which was disappointing.

But we did discuss enough of the issues that are impacting people all across the state: the porous southern border that has now careened into our life here in New York City in real time, talking about the educational crisis that is gripping our state and our nation, the civil rights issue of our time where children are receiving less than they deserve, the issues on a foreign policy standpoint

and the Ukrainian debacle that in many ways was invited by Sen. Schumer.

So I believe that we got to touch on all those issues.

I believe people got a true side-by-side comparison.

From my perspective, Sen. Schumer continued to lean on pieces of legislation that didn’t solve the problems that he in many ways helped to create.

You used to work as an anchor for the conservative cable news channel Newsmax. How has that experience shaped your political career and your politics?

It was the opportunity of a lifetime. Every single week, I sat down with no less

than four active members of Congress and most likely one senator. I’ve had the opportunity week by week to analyze the issues that are facing our country and talk to policymakers and get their feedback on why they’re doing things and why they think things haven’t been occurring in a timely manner. I think that certainly informs my politics and my race against Chuck Schumer.

You’re the first Black man to be nominated by either party for the Senate in New York.

From your perspective, how do you fit within the Republican Party?

My political philosophy is quite simple. It is

the founding mission statement of the Black Congressional Caucus and is one of the first things my father had me memorize when I was young: Black people have no permanent friends and no permanent enemies, only permanent interests.

I believe we have made a permanent enemy of the Republican Party, I believe we’ve made a permanent trend toward the Democratic Party.

As a result, both parties have decided to push our permanent interests to the back burner. I think my perspective as it pertains to my choice to run as Republican and to be Republican is clear that political parties are

A big test for New York City schools

IKE MANY PEOPLE who have stood in the Port Authority bus terminal to welcome newly arrived asylum-seekers over the past couple of months, New York City Council Member Shahana Hanif recalled seeing many school-age children who were “terrified, without shoes and in need of tremendous hope, care and compassion.”

Calling for additional money to support these children, Hanif recently underscored a sentiment that has circulating since it became apparent just how many kids were among the influx of new arrivals: “For every classroom that they enter we must assure them that they will be healed of their trauma of having walked terrible violent terrain to then be welcomed at the southern border with violence,” she said, standing beside immigrant advocates during a rally on Oct. 31.

As the nation’s largest public school system continues to integrate more than 7,000 students from migrant families into classrooms this school year, educators, city officials and nonprofits have grappled with finding the best ways to support the influx of children.

That means enlisting additional hands – volunteers and bilingual professionals – as well as having sensitivity and compassion in creating plans to ensure they have clothes, food and other vital supplies. Over the past few months, community members, educators and elected officials have mobilized through the formation of volunteer “borough response teams” as well as a host of other grassroots efforts that have gathered donations and shouldered additional work to wrap asylum-seeking families into school communities. In addition to a sweeping multiagency effort called Project Open Arms to enroll school-age children and provide them and their families with resources, the city also recently announced that it will send an additional $2,000 for every homeless student that has been enrolled since July 2 to schools with at least six children living in temporary housing. According to the city, the funding is

intended to go toward additional tutoring, after-school programs, personal items, and bilingual support – though it can’t be used to hire full-time staff, according to budget documents obtained by Chalkbeat New York.

The New York City school system is facing a significant challenge: Migrant children, the vast majority of whom are believed to be seeking asylum from Latin America, have limited English proficiency and come with varying degrees of educational experience. Even getting to the southern border of the U.S. is dangerous – both physically and emotionally – and children are particularly vulnerable along the route. Many are now living in transitional housing after surviving significant trauma from before and during their journey to New York City. And while the city’s schools have long served immigrant children and those living in shelters, the sheer number of new arrivals this year is unprecedented, and many schools are struggling to hire enough bilingual teachers and social workers.

While 369 schools will benefit from the city’s plan to send an additional $2,000 per student, with schools receiving an average budget boost of $31,713, according to Chalkbeat, many immigrant advocates said it wasn’t enough to fully support migrant children.

“I really do appreciate the welcoming tone that the Department of Education has set and has said we are going to welcome all of these kids into our schools and see them as fellow classmates,” New York City Comptroller Brad Lander said at a rally Monday morning. “That is good, but it must go along with the resources necessary to help schools meet these kids’ needs.”

In a budget analysis published Oct. 18, Lander said schools should receive at least an additional $34 million to support migrant students based on the Fair Student Funding formula, which provides schools with the bulk of their yearly budget. The formula allocates a baseline amount to every school based on enrollment and then adds dollars for each student with additional needs, such as a disability or if they are learning English as a second language. Overall enrollment in public schools has gone down, and those schools saw their budgets reduced as a result. But with the enrollment of migrant students, ad-

vocates argued that those schools need more money now – and according to city officials, schools are getting an additional $25 million through Fair Student Funding. Unlike the formula, which is typically finalized at the end of October, the additional $2,000 for eligible students is separate, meaning schools can receive that sum even if their enrollment grows later in the school year.

Schools have been affected by the influx of students in a variety of ways. Brooklyn’s P.S. 124, which had budgeted for 215 total students, gained over 35 migrant children as of October given its close proximity to two family shelters. (Children living in shelters are assigned to schools nearby, meaning only some of the schools have taken in migrant students.) According to Lander, P.S. 124 school leaders hired a temporary guidance

counselor but had yet to receive additional funding or hire bilingual support.

Having bilingual staff in place to support migrant children is important beyond the obvious academic repercussions. Win, New York City’s largest provider of family shelters, has scrambled to hire Spanish-speaking staff to adequately meet the need, according to the organization’s president and CEO, Christine Quinn. Last month, she said she’s worried that families won’t be comfortable speaking about the traumas they’ve endured.

“If we don’t know what the traumas are, then we won’t know how to pull a team together,” she said. “These refugees are going to need more than basic (mental health) services. Many of them may have seen family members killed right in front of them, many of them may be survivors of multiple sexual

assaults – that worries me. We have to make sure that the city responds in a way that goes beyond just the basics which we don’t even have.”

Given the isolation that comes with not being native English speakers, advocates have fought to ensure migrant students are placed in schools with bilingual instructors. These schools, they argued, were the best place for these children because they’ll be able to become friends with one another, learn better and be with educators equipped to assess their social and emotional needs.

At P.S. 145 on the Upper West Side, the school has taken in 45 Spanish-speaking migrant students and 10-12 Russian-speaking children displaced from the war in Ukraine, according to Naveed Hasan, a parent and chair of the multilingual committee for the

school district’s local education council.

He told City & State there was a coalition of school administrators, teachers and parents – many of whom are immigrants themselves – supporting these students. Still, only so much can be done without more money.

“We don’t forget so easily because it was our personal experience. We want to pay it forward and do what we can, but there’s only so much you can do with volunteer energy,” Hasan said. “Because the need and the demands are so great, that’s where resources like financial and staffing resources can really help. And we need them to be permanent.”

When Lauren Balaban, a school parent and PTA vice president of fundraising, learned that the principal had volunteered P.S. 145 to open its doors to migrant students this year, she and others on the PTA put out a call for donations. Within a few days, they had to stop to streamline things as the sheer volume of clothing and supplies had filled the school’s atrium. She said that sort of mobilization has continued: When teachers learned some of their students have struggled to do their laundry because they don’t have access to a machine, they started doing it for families on the weekends. When the school year started and they didn’t have a Spanish-speaking social worker, school volunteers knocked on doors to try and find one, succeeding after six weeks of outreach. “We are just trying to do as much as we can while they are with us,” Balaban said.

Stuck in limbo

An immigration case is started by a notice to appear in court. Immigration attorneys said that in order to be paroled into the United States, the recently arrived asylum-seekers are being told at the border to appear for a check-in with ICE soon after arriving at their final destination and that notices to appear are being filed with the court after those check-ins. Alexia Schapira, a supervising attorney at The Legal Aid Society, said asylum-seekers were not usually required to check in with ICE before a notice to appear is filed.

Because of the inordinately large number of people showing up at the building that houses both immigration court and ICE’s field office, attorneys and advocates said people were arriving for ICE check-ins as early as 2 a.m. or 3 a.m. in the hopes of just getting into the building. “The guards at some point just cut off the line and don’t allow all of the people into the building, even though they do have ICE appointments that day,” Lauren Wyatt, managing attorney with Catholic Charities of the Archdiocese of New York, said in a press briefing hosted by New York Immigration Coalition last month.

But there aren’t any appointments until mid-2024.

OLLOWING MONTHS of a rapid influx of asylum-seekers to New York City – many fleeing political persecution in Venezuela, and many bused here from Texas and Arizona – the inflow of people at the southern border appears to be slowing under policy changes by the Biden administration.

But with more than 21,000 new arrivals in New York since the spring, the stream of migrants seeking asylum status at New York City’s immigration courts is as heavy as it has been for months.

Last week, hundreds of recent migrants lined up outside lower Manhattan’s 26 Federal Plaza, which houses the largest of New York City’s three immigration courts. Some of the migrants were there to check in with U.S. Immigration and Customs Enforcement, while others had been called for their first hearings in their deportation proceedings.

Applying for and receiving asylum is a process that can take years, and the status is only granted to those who can prove that they have reason to fear persecution because of their race, religion, nationality, political opinion or membership in a particular social group. Asylum-seekers have one year after arriving in the United States to submit their asylum application, and they have to wait another five months after submitting that application to even apply for a permit to work in the United States.

For the thousands of migrants who have arrived in the past few months, the process of obtaining asylum status is a confusing and bureaucratic maze, exacerbated by an overwhelmed court system and a shortage of legal services for immigrants. For many, the maze begins outside 26 Federal Plaza at the crack of dawn. “It took me an hour to get here from the Bronx, and I’ve been here since 5 a.m.,” said Miguel, an asylum-seeker from Venezuela waiting outside the immigration court who declined to give his last name for fear it might affect his

since the influx at the border has slowed.

“The system is simply at capacity – or beyond capacity. It’s overloaded,” she said.

“Because of that, the government isn’t able to process people, despite giving them requirements for processing.”

Immigration advocates are warning that the overloaded system is leaving applicants in a paradoxical situation in which they face a one-year deadline to apply for asylum but are unable or confused about how to take the initial steps to jump-start their application in time to meet that deadline.

People who are turned away from checking in with ICE because the building is over capacity have been instructed to schedule appointments over email. But those ap-

pointments have been scheduled as far out as mid-2024, far past the one-year deadline for recently arrived asylum-seekers.

Delays in starting the asylum application process also pushes back the process of obtaining temporary legal work authorization, which people can apply for 150 days after submitting their asylum application.

“If the earliest they can submit that asylum application is sometime in 2024, that puts them at the earliest they can apply for their work permit at late 2024, which means that they will be here over two years without being able to work lawfully,” Wyatt said. “So people are really in an impossible position.”

Asked about the long timelines for ICE check-ins and confusion about how asylum-seekers can start their applications in a timely way, a spokesperson for the U.S. Department of Justice’s Executive Office for Immigration Review – which has jurisdiction over the immigration court at 26 Federal Plaza – said it has been in contact with the Department of Homeland Security. “Our immigration judges are aware of the issue and remain cognizant of it when adjudicating motions to reopen or continue cases,” a department spokesperson wrote in an email.

The punishing maze that asylum-seekers face is one that could be at least clarified by immigration attorneys and legal aid

organizations in the city. “Access to legal representation is one of the biggest single factors that can change the outcome of a case and that can help somebody navigate the legal system, and hopefully obtain the status or relief that they’re eligible for under current existing laws,” Camille Mackler, founder of the Immigrant Advocates Response Collaborative, said at a press briefing last month.

But advocates said there weren’t enough legal resources to meet the demand. Catholic Charities runs programs to assist people who do not have immigration attorneys and provides walk-in services at the city’s immigration courts. “Our program is in one of the courts almost every day, but there’s no way we can possibly see everybody,” Wyatt said. “Last Friday, our attorney was able to see eight people, and we turned away 50 people.” Wyatt and Mackler have asked for new city and state investments in immigration legal services and legal rapid response to help meet the moment.

Several people in line at 26 Federal Plaza on Nov. 1, including a couple staying in a city shelter in Queens, said they hadn’t been in touch with any lawyers or received legal guidance. New York City has put up humanitarian emergency response and relief centers – one for families in the Row NYC hotel, and a tent city for single men on Randall’s Island – and opened more than 50 emergency centers in hotels around the city for temporary housing for the new arrivals.

A City Hall spokesperson said that asylum-seekers can access legal information at the Randall’s Island and Row hotel shelters, and that staff at those locations can make appointments with legal providers through the city’s Asylum Seeker Resources Navigation Center. Mayor Eric Adams’ administration has also asked for state and federal investment and called for the federal government to expedite work permits for asylum-seekers.

UST A FEW weeks after taking office, Gov. Kathy Hochul pledged her full commitment to helping Puerto Rico while commemorating the fourth anniversary of Hurricane Maria in September 2021. The newly elected governor delivered a speech rooted in resiliency and comradery at the Hurricane Maria memorial in Rockefeller Park in Manhattan.

Hochul declared that she wanted a diverse Cabinet that included Latinos and vowed to support Puerto Rico in future times of need – with or without federal support. “Puerto Ricans are part of our family. And if you ever dispute that, you have to go through me because I will say you are wrong, my friend, you are absolutely wrong,” Hochul said. “New York state is with you now, later and forever.”

After being thrust into the governor’s position, Hochul had large shoes to fill.

Former Gov. Andrew Cuomo, although controversial, had a strong relationship with Puerto Rico throughout his tenure.

During a busy first year that included learning the ropes of her new role, passing her first state budget and gearing up for reelection, there have been limited opportunities for Hochul to deepen her relationship with the island, but the governor has taken steps to maintain a good relationship with Puerto Rico.

“Hochul has been doing the work whether it’s been quietly or in your face, there is work being done,” said Assembly Member Nathalia Fernandez, who represents a Bronx district home to many Puerto Ricans.

For decades, New York state has held the largest population of Puerto Rican residents on the mainland U.S. Although there’s been a decline in recent years, New York still has a high concentration of Puerto Ricans, at over 1 million. “It’s almost an unwritten rule that the relationship must exist by virtue of the size of the Puerto Rican population in New York,” said Eli Valentin, political adviser and professor at the Hispanic Theological Initiative. “Because of that, governors have always been intentional about their relationship with the island.”

An influential portion of New York’s political class is also of Puerto Rican descent, from Reps. Nydia Velázquez and Alexandria Ocasio-Cortez, to state Sens.

The Legislature’s Puerto Rican/Hispanic Task Force has focused on addressing the needs of the Latino community partly through organizing the annual Somos conference in San Juan. While the conference has been known to provide a space for lobbyists, elected officials, political consultants and media to bring awareness to the long-standing issues of the island, it’s also ripe with opportunities to network (and campaign) for personal political gain.

LESS LIKELY TO “JUMP IN FRONT OF THE CAMERA” As governor, Cuomo prioritized his relationship with the island – a relationship that started even before his time at the state Capitol. Valentin explained that Puerto Ricans can remember the days when Cuomo’s father, the late former Gov. Mario Cuomo, was making trips to the island. That name recognition also helped to foster a relationship during his son’s tenure. “There’s been decades of Cuomo at the helm of New York state and assisting Puerto Ricans,” Valentin said.

Cuomo’s relationship with Puerto Rico was consistent throughout his administration and, as a result, Hochul’s relationship with Puerto Rico can be traced back to her tenure as lieutenant governor. In 2015, Cuomo selected Hochul to lead a state delegation to the island to provide help with the island’s debt and health care issues. Then again in 2020, Hochul led another delegation of bilingual mental health professionals and building inspectors to the island to provide help following an earthquake.

While Rivera admitted to being one of Cuomo’s most passionate critics, the senator said he “had to give credit where credit was due.” The senator recalled traveling with a delegation to Puerto Rico after Hurricane Maria and the extensive relief efforts that the former governor, who recently wrote an op-ed in the Daily News claiming that New York and the federal government “owed Puerto Rico,” provided to the island.

Rivera explained the new governor is not as flashy. “She is much less likely than him to jump in front of the camera and make it a show,” he said.

Since becoming governor following Cuomo’s resignation, Hochul visited the island for the annual Somos celebration in November 2021 and is expected to return for the conference this year. With just one year under her belt as governor, Rivera, who is Puerto Rican, said the governor hasn’t had much time to work on her relationship with the island because of her busy year.

One opportunity came in the form of tragedy. Days after the fifth anniversary of Hurricane Maria, Hurricane Fiona hit the island with 100-mile-per-hour winds causing immediate devastation – including power blackouts, downpours, mudslides and major flooding. Lawmakers who spoke with City & State agreed that though she didn’t visit the island after the most recent hurricane, Hochul stepped up to provide aid. A few days after the hurricane hit the island, Hochul deployed 100 state troopers to help with response efforts. A week later, the governor announced four members of her administration traveled to the island to review the damage caused by the hurricane. The governor also sent multiagency response personnel and donated food, water supplies and issued guidance to banks in the state to ease fees for those affected by the hurricane.

Asked about measures taken beyond hurricane response, Hochul’s office pointed to a partnership to address climate change by expanding job training for the solar energy industries in Puerto Rico and the U.S. Virgin Islands. Hochul also established a partnership – with her administration, schools in New York and the University of Puerto Rico – to help train mental health workers for times of natural disaster for the state and island.

Fernandez, a member of the Puerto Rican/ Hispanic Task Force, noted that Hochul was “making the right steps to build a strong relationship” with the island by making sure the path of communication is clear and constant, especially in times of need. Fernandez highlighted the Puerto Rican officials in the governor’s administration who have long-standing relationships with the island already, such as Hochul’s Secretary of State Robert Rodriguez and Director of Latino Affairs Sophia Zayas.

together in Congress from 2011 to 2013, and he described her as an ally in securing FEMA funding. “We appreciate the Governor’s support and look forward to keep working together to serve Puerto Ricans on the Island and the mainland,” he wrote.

Rodriguez, who was part of the delegation that traveled to the island in September, said Hochul understood the long-standing relationship between the state and Puerto Rico as well as the lessons learned during Hurricane Maria. “(Hochul) recognizes that that love connection is there. When there’s a need, the state is in a position to offer support. We certainly did that with Maria and we were able to rely on some of that experience to mobilize for Fiona.

LOOKING AHEAD Not everyone is a fan of Hochul’s relationship with Puerto Rico since taking office.

Valentin said Hochul has done what her predecessors have always done to help the island during times of need. “I would say two words: status quo,” Valentin said to describe the governor’s relationship with the island. “There is visibly more that she could do which would distinguish her

and set her apart from the conventional work that her predecessors have done.”

Camille Rivera, a political consultant and partner at New Deal Strategies, agreed there was more that could be done. “Hochul has a real opportunity to really dig into some real serious issues about Puerto Rico and the economy itself,” Rivera said.

For years, Puerto Rico has been facing a debt crisis. In 2017, the island declared bankruptcy after failing to make payments on its $123 billion debt and pension obligations. Natural disasters, such as hurricanes and earthquakes, only strain the island’s economy further. New York has been instrumental in improving the island’s power grid since Hurricane Maria devastated the island years ago. In 2017, the New York Power Authority and Con Edison also studied additional ways to protect the island from future storms. However, several experts point to things the governor could do to directly help the economy.

The Jones Act is a federal law that all shipping between U.S. ports be conducted by ships built, owned and operated in the U.S. Because Puerto Rico imports a lot of goods – including food, oil, electronic appliances and cars – the Jones Act costs the residents substantially more compared to using other ships. This increases the cost of living for residents in Puerto Rico and has contributed to the territory’s economic crisis. Presidents have the authority to suspend the act. Many Puerto Rico advocates and New York lawmakers have called for Washington to waive the Jones Act during times of need and as a longterm measure. Valentin said the economic situation of the island would not improve until the Jones Act was eliminated.

Because this is a federal law, there’s little Hochul can do using her state executive powers. While in office, Cuomo called for an extension of waivers to the Jones Act during times of need. But, Valentin said Hochul could distinguish herself as a long-term supporter of the island, and stand out among her predecessors, by advocating for the permanent suspension of the act. “The bully pulpit that she has, by virtue of her position, could help when it comes to the Jones Act,” Valentin said.

Several experts also pointed to state Sen. Gustavo Rivera’s Model Law bill as a way to help the island’s economy. The

legislation would establish a fair process for debt negotiation for governments, such as Puerto Rico, that deal with New York-based financial institutions. Rivera said the bill is one of his legislative priorities heading into the 2023 session, and he’s hoping to garner support from lawmakers.

When asked by City & State, Hochul’s press team did not answer directly on whether the governor supports waiving the Jones Act or passing the Model Law. In a statement to City & State, a spokesperson for her administration said Hochul will review “all legislation that passes both houses of the legislature.” The statement also said, “Hochul is focused on actions she can make at the state level to support the people of Puerto Rico and will continue to work with the Governor of Puerto Rico and federal partners to ensure the Puerto Ricans have the resources they need.”

As the gubernatorial election looms, Valentin said Hochul hasn’t done a great job connecting with the Latino community, a base that could further help her efforts to secure a win against Republican challenger Rep. Lee Zeldin. Valentin pointed to a recent Siena College poll that showed Hochul leading Zeldin among Latinos with just 56% of the support – well below the 76% of Latino voters who told Siena they would vote for Cuomo a month ahead of his last reelection in 2018.

“I haven’t seen an aggressive effort by Hochul to go after Latinos. She’s taking the Rose Garden strategy in her reelection efforts,” Valentin said. “She’s really staying away from the grassroots kind of politics that really works in Latino communities.”

At the Somos conference in Puerto Rico, the heart of the New York political world takes a break.

FTER HURRICANE Fiona hit, knocking out power to the entirety of Puerto Rico and killing at least 25 people, the organizers of the Somos Puerto Rico conference made a big decision: The show must go on. Cruise ships don’t turn on a dime, and neither does the New York political world’s equivalent – 1,500 people on a tropical beach, talking, drinking and sometimes gambling.

It’s not all a party. There is a day of policy panels. And in response to the storm, Somos Inc. and the Assembly Puerto Rican/Hispanic Task Force added more community service to the conference schedule and cut some of the more festive events. “We did scale down on the partying. Somos is not having parties,” explained Assembly Member Maritza Davila, chair of the task force and the de facto host of the five-day event. “I take this very seriously.

Somos takes it very seriously.”

But you can’t transplant half of New York’s political community to a beachside resort and expect them to treat it like a courtroom. The parties will

still happen – they’re just not an official part of the conference. “Hey, you’re adults, you do what you’ve got to do. We’ve got to be honest about things,” Davila said. “People that go there, they have their own receptions. We don’t have control over that.”

The social aspect is what gets so many New York politicos to fly south.

“I spent an hour in the ocean talking to (Brooklyn District Attorney) Eric Gonzalez. An hour, just the two of us. You can’t do that anywhere else,” said Allen Roskoff, a progressive advocate and president of the Jim Owles Liberal Democratic Club. They talked about “clemency, pardons, criminal justice and his lesbian aunt. … That discussion never would have taken place outside of Somos.”

The conference has exploded in popularity. Organizers sold out in September with 1,500 registrations – and even more people are expected to come down to schmooze on the sidelines.

“It’s an absolute must-go,” political consultant Jordan Barowitz told City & State. “Ev-

erybody in New York government, politics, civic life.”

Somos is an annual conference, centered at the Royal Sonesta hotel in Carolina, Puerto Rico, just outside the capital of San Juan, that will be held from Nov. 9-13. Officially, it’s a forum for policymakers to learn about and discuss issues affecting Puerto Ricans and the Latino community at large. For many politicians, it’s an essential pilgrimage, a way to show respect and appreciation for New York’s Latinos and particularly the more than 1 million Puerto Ricans that call the state home – and can vote.

There are two sets of workshops on Nov. 10 where attendees can listen to legislators and experts on various topics, including renewable energy in Puerto Rico and New York state, or the impact of cannabis legalization. Nov. 11 has seven hours devoted to a day of service and informational tours

where New Yorkers will spread out across the island for projects like cleaning and painting a school in San Juan or transplanting and composting at a farm in Toa Baja. On Nov. 12, attendees were asked to give some time to sorting packages with food and household items for Puerto Ricans facing food insecurity after the storm. It’s hard to measure the impact, since Somos never releases public reports.

But Somos Inc., the nonprofit organization that administers the conference, typically gives modest grants to service providers in Puerto Rico from a portion of the conference revenue. It also funds scholarships for young Latino New Yorkers to attend a spring political conference in Albany: the Angelo Del Toro Puerto Rican/Hispanic Youth Leadership Institute.

But there’s another service that attendees are providing: spending money.

“I see the suffering,” said Davila, who was born in Puerto Rico.

“And Puerto Rico needs the revenue to be able to move forward.

Those hotel workers need the money. Cab drivers over there need the money. The restaurants need the money. People need the money over there.”

There will be a lot of people at Somos eager to hear that message. Politicians drain their campaign accounts to buy flights and hotel rooms, while lobbyists pull out their company credit cards at the Fairmont El San Juan Hotel lobby bar. More than a work conference, Somos is the place to see and be seen in politics. The organizers have realized it and sold dozens of sponsorships to just about everyone looking to do business in Albany and at City Hall. Private

companies like Uber, Meta and Coca-Cola. Gambling companies like Caesars, FanDuel and Resorts World. Labor unions like 1199SEIU, District Council 37 and the Building & Construction Trades Council of Greater New York. And lobbying firms like Brown & Weinraub, Actum and TBA. All contribute to Somos, and all get their names, their issues and employees in front of the political power players in attendance.

“I have a long history of hearing about Somos and how it was basically a place where people would go to talk to lobbyists and get drunk. And I found that very much to be true,” said City Council Member Alexa Avilés, who was born in Puerto Rico and attended the conference for the first time last year. She had a policy: “I was not going to meet with any lobbyists. My time was not for them there. If they want to meet with me, they will meet with me here on business hours.”

Avilés is attending again this year, and the democratic socialist legislator is planning to cohost a couple events, including a “resistance tour” highlighting Puerto Ricans fighting against “colonialization and all of its impacts.”

While Avilés thinks the conference misses the mark regarding engaging with Puerto Ricans, she appreciated its importance as a time for connecting with colleagues.

And there’s a lot to talk about around the pool. Somos’ timing, in the days immediately after the November general election, means political players are primed for Monday morning quarterbacking – and to plan for the next election.

New York’s purplest suburb is home to multiple competitive state Senate races.

URING A RECENT WEEKEND, Long Island played host to national bigwigs from both parties. Florida Gov. Ron DeSantis rallied with Republican gubernatorial candidate Rep. Lee Zeldin in Suffolk County, while first lady Jill Biden phone-banked with Gov. Kathy Hochul on the island. Their presence was unusual – it’s not every day that New York elections garner national attention, let alone the happenings in New York City’s suburbs.

DeSantis and Biden have not been the only national figures to wade into New York elections, with appearances from the likes of former President Bill Clinton in Westchester, and former Secretary of State Hillary Clinton and Vice President Kamala Harris in Manhattan. But Long Island still holds a unique place within the New York election ecosystem this election, making it one of the most-watched areas of the state and the whole country. The region remains a crucial swing area that both Hochul and Zeldin find themselves fiercely competing for as the polls in their race tighten. What’s more, three of the four congressional districts on Long Island have no incumbent, open races that could tip the balance of Congress.

More locally though, Long Island also has some of the most competitive down-ballot races in the state. Though they have not received the kind of attention the congressional and gubernatorial races have received, a large number of the island’s nine state Senate seats are once again in play just two cycles after a blue wave flipped many of those seats Democratic. Coming off a landmark 2021 election cycle that turned nearly every county-level office on Long Island red, Republicans may have the opportunity to win enough seats to recreate the once formidable GOP voting bloc that controlled the area – and with it, influence in the state Legislature, which they have lost since 2019.

THE LONG ISLAND NINE Long Island has long been a battleground up and down the ballot. Its voting trends shift depending on the year and who holds power at every level of government, from president

By Rebecca C. Lewis to town councils. This year is no different as congressional candidates duke it out for newly redistricted seats and gubernatorial candidates trade barbs in the suburbs.

The state Senate is not much different, although up until recently, the Long Island Nine, as political observers had dubbed the voting bloc, remained a stronghold for Republicans, with just the odd Democrat breaking through for short periods. That changed in 2018, when Democrats won back control of the upper chamber, thanks in no small part to seats flipped on the island. The Democrats became their own voting bloc, with former state Sen. Todd Kaminsky the unofficial dean of the delegation as the most senior member at the time.

When Democrats won a supermajority in the state Senate in 2020, the death knell that many observers believed tolled for Republicans in 2018 simply got louder. GOP power in New York had dwindled to such an extent that it seemed like a comeback would take a miracle. Things have changed a lot since 2020.

The shift in thinking arguably began just last year, when Republicans dominated local elections on Long Island. Running heavily on fears of crime, the GOP picked up both the Nassau and Suffolk County district attorney’s offices, unseated the Democratic Nassau County executive incumbent, flipped the Suffolk County Legislature red and expanded its majority in the Nassau County Legislature. It was a veritable bloodbath for Democrats. “Democrats are really concerned that the waves that washed out their candidates last year at local elections are still as high – or even rising higher – this year,” Larry Levy, executive dean of the National Center for Suburban Studies at Hofstra University, told City & State. “Particularly in the power of fear of crime.”

THE ABORTION VARIABLE Conventional political wisdom would suggest that a midterm election like 2022 would favor Republicans thanks to a Democratic president in office with lagging favorability. That changed when the U.S. Supreme Court overturned Roe v. Wade,

suddenly making abortion rights into a national rallying cry for Democrats. It seemed to turn the tides very quickly, leading to a handful of surprise election results before November, including the special election for the 19th Congressional District upstate. And polling several months ago indicated that Republicans perhaps had reason to worry.

In one of the most competitive state Senate races on Long Island, state Sen. Anna Kaplan has focused heavily on abortion and women’s rights as part of her campaign against former state Sen. Jack Martins, a Republican looking to win back a version of his old seat. “(Women) see for themselves how this Supreme Court literally has taken their rights away,” Kaplan told City & State. “Women, at this point, I don’t think trust Republicans.” She dismissed concerns about the 2021 election results, pointing to the conservative Supreme Court decision revoking the federal right to an abortion creating an entirely new atmosphere.

She’s not alone in her campaign strategy.

Hochul focused heavily on abortion rights

earlier in the campaign, Rep. Pat Ryan suggested that women enraged by the Supreme Court ruling helped propel him to victory, and other Democrats have made protecting women’s rights a cornerstone of their campaigns. But polling has shown that abortion rights don’t top the list of voters’ concerns – the economy and crime consistently hold the top places. And Republicans have campaigned on those two issues heavily since the beginning. “People are afraid,” Martins told City & State.

“They’re concerned about the future, they’re concerned about … their ability to stay in New York state.” He added that criminal justice reforms passed in recent years, bail reform the most prominent, have come back to negatively affect Democrats in areas of the state like Long Island.

“Because you only need one or two rogue Democrats to say ‘I’ll vote this with the Republicans,’ it puts everything in play.”

Hochul’s recent campaign shift to focus more heavily on public safety issues rather than abortion or Zeldin’s ties to Donald Trump speaks volumes about the truth behind Martins’ words.

A SHIFT IN POWER The race between Kaplan and Martins for the 7th state Senate District is hardly the only competitive race on Long Island, though it serves as a poignant microcosm for the partisan divides prevalent in many of the other races. The vacancy left by Kaminsky could well flip Republican, and Democratic state Sen. John Brooks’ hold of his seat is tenuous at best. With the decision of state Sen. James Gaughran to retire because of redistricting, Democrats have already lost at least one Long Island member.

Republicans enter the election with two incumbents and one candidate expected to win an open seat. By the end of election night, it’s entirely possible the party has picked up three or even four more seats, shifting the balance of power on the island back to the GOP. While victories there alone would not win back the state Senate as a whole, it could

give Republicans back some of the leverage they have lost. “Because you only need one or two rogue Democrats to say ‘I’ll vote this with the Republicans,’” Mike Dawidziak, a Long Island pollster and political commentator, told City & State. “It puts everything in play, really, is what it does.”

The tides may be just right for Republicans to win big on Long Island, in no small part because of the attention at the top of the ticket. “The other problem for Long Island (Democratic) Senate candidates … is that the top of the ticket doesn’t look as strong as it did some months ago,” Levy said, referencing Hochul’s lagging poll numbers that have put Zeldin within striking distance in recent weeks. “Kathy Hochul’s coattails are almost nonexistent in Suffolk and not nearly as long as they had been in Nassau.” Following the Dobbs decision on abortion, reproductive freedom seemed like it would serve as a golden ticket for Democrats, with Hochul as the first female governor of the state uniquely poised to take advantage of the national tail winds. “I’m surprised the fervor isn’t as as much on the other side, quite honestly, because I did think that women would would

kind of band together on the abortion rights issue,” Dawidziak said, comparing Republican passion on crime and the economy to the Democratic rallying cry. “But that doesn’t seem to be happening in New York.”

But the tides have changed quickly throughout the election cycle, and time still remains for them to change again. At the same time, both sides attempt to make claims of inaccurate polling in their favor.

Kaplan spoke about a fundraising event she attended with many women who told her they did not answer pollsters who try to get in touch. “And they absolutely are in our camp,” Kaplan said. “They absolutely understand what’s at stake and what they need to do.” Republicans, meanwhile, have long held that polls understate the strength of their candidates and enthusiasm of its voters.

In a region like Long Island, such claims – if true – could have significant impacts on the outcome of the elections taking place there in spite of what polling may have predicted.

For a battleground like Long Island, a few percentage points could very well redefine the balance of power at nearly every level of government.

1 STEVE BELLONE SUFFOLK COUNTY EXECUTIVE Steve Bellone has had his hands full this year as executive of one the most populous counties in the state, most recently navigating a cyber incident affecting Suffolk’s computer systems.

He is also awarding grants to battle the opioid crisis using the $25 million the county received in settlements.

Bellone cemented his own fate this summer by helping to strengthen term limits.

After his third and final term as executive, he won’t be making a long-rumored

run for the state’s top seat just yet; he recently gave his endorsement to fellow Democrat Gov. Kathy Hochul.

But the avid marathoner – who is frequently seen at races across the county – is keeping his options open.

2 BRUCE BLAKEMAN NASSAU COUNTY EXECUTIVE Leaning on his experience in homeland security as commissioner for the Port Authority of New York and New Jersey after 9/11 and his term as a Hempstead council member, Nassau County Executive Bruce Blakeman

Rep. Lee Zeldin has climbed the political ladder from state Senate to the U.S. House of Representatives, and he has his sights set on Albany again, this time on the governor’s chair, running as the Republican candidate against Democratic Gov. Kathy Hochul. Zeldin will not be mistaken for a centrist in this race. One of New York’s most prominent supporters of Donald Trump, Zeldin objected to certifying the election of President Joe Biden in 2020.

In his campaign, Zeldin highlights taking a stance against rising crime, rolling back bail reforms, enacting tax cuts and reversing the ban on natural gas extraction – and in recent weeks polling has shown him closing in on the incumbent.

Dowling focuses on the future of medical care not just in New York but globally: Northwell Health joined forces with the Ukrainian military on a telemedicine platform this spring. Nominated during one of the most fraught times for law enforcement in recent memory, Breon Peace took the role of U.S. attorney for the Eastern District of New York late last year. Tasked with reining in rising crime, many hope Peace can also restore the faith of those skeptical of prosecutors and the justice system. This year, his office oversaw some high-profile cases on Long Island, including a conviction for the drug-related death of a Massapequa woman and the sentencing of a man in an $8.9 million mortgage fraud scheme.

Long Islander Thomas DiNapoli is running for the state comptroller position again this year against Republican Paul Rodriguez, a former Wall Street analyst.

The job is a big one, including managing the state's pension fund valued at over $246 billion. DiNapoli has been the state’s chief fiscal officer for 15 years and is looking to keep his duties, which this year included pleading with the governor to restore oversight of certain state contracts to his office and advising the state to sock away billions to weather the turbulent economic storm ahead.

STATE SENATORS Democratic state Sens. Anna Kaplan and Kevin Thomas have neighboring districts in Nassau County. They both immigrated to the United States when they were young, and both are defending their seats in the upcoming election, hoping to turn back the red wave that swept across Long Island last year.

Kaplan, who represents the 7th District, is running for her third term this November. A Jewish Iranian refugee who immigrated when she was just a teenager, Kaplan has taken up passing gun safety laws, protecting reproductive rights and making Long Island more affordable as her key stances. Thomas, who became the first Indian American to serve in the state Senate in

Last year’s results across Long Island didn’t go how Democrats expected or wanted. As chair of the state Democratic Party, Jay Jacobs is responsible for helping to craft the strategy of state Democrats to bolster their chances. He has spent the year trying to unify the disparate parts of the party, encouraging a more moderate (and supposedly winnable) stance and combating the message coming out of the Republican Party. Especially pressing for Democrats are issues such as rising crime, which many have blamed on bail reform, and abortion rights.

She wants to roll back bail reform laws and has thrown her support behind automobile alcohol impairment detection systems technology to curb drunk driving. Recently, her office was involved in the bust of two men who transported illegal handguns from Georgia to Long Island.

After serving four consecutive terms in New York’s 4th Congressional District, Rep. Kathleen Rice surprised Democrats when she decided not to seek reelection this year – setting up what looks to be a tight race between Democrat Laura Gillen and Republican Anthony D’Esposito. The former district attorney, who prosecuted some large corruption cases, including one where she exposed a bribery scheme involving former Nassau County legislators, has not given a definitive reason for stepping out of the race – or any hint of what she’s got cooking now.

Tierney unseated Democrat Timothy Sini as Suffolk County district attorney, riding a wave of Republican victories in last year’s election season with a stance of being tougher on crime, especially gang violence, and rolling back bail reform laws. Since then, he has proposed reimplementing ShotSpotter tech to alert law enforcement to gunfire.

Tierney also oversaw the creation of a combined unit to try animal abuse and environmental cases.

12 MATTHEW COHEN PRESIDENT AND CEO Long Island Association Over a year into his tenure as the youngest CEO of the Long Island Association in the business organization’s history, Matthew Cohen’s top priorities have been investing in infrastructure, promoting diversity in the business sector, creating more affordable places to live and stemming the flow of brain

15 JOHN DURSO PRESIDENT Long Island Federation of Labor For almost 20 years John Durso has been leading the charge of organized workers as president of the 250,000-member Long Island Federation of Labor. He’s also been at the helm of Local 338 since 1999, representing 16,000 agricultural, health care and supermarket workers.

Union membership is gaining ground locally, with recent successes including workers at four Starbucks locations on Long Island voting to unionize, so that influence is only going to get bigger. More than 26% of workers on Long Island are unionized, a number that has grown over the past three years, according to a study by Hofstra University.

16 TRACEY EDWARDS LONG ISLAND REGIONAL DIRECTOR NAACP New York State Conference Having started her career in telecommunications as an operator for the New York Telephone Company, which became Verizon in 2000, Tracey Edwards retired as a regional president after 37 years with the company. As regional director of the NAACP on Long Island, Edwards oversees 10 local branches of the civil rights organization. Edwards is also a commissioner with the state Public Service Commission, which regulates the state’s utilities. She was previously a member of the Huntington Town Council and a member of the Long Island Regional Economic Development Council.

But after 12 years, the Long Island Builders Institute will look for a new leader, now that Pally has said he will retire at the end of the year. This year he supported expanding sewers in Suffolk County and opposed a plan by Gov. Kathy Hochul to create an all-electric grid in New York by 2027.

When you’re running the thirdlargest publicly owned electric utility in the country, you have to expect some static. Long Island Power Authority CEO Thomas Falcone started the year by defending himself against a report that said highly paid LIPA execs didn’t live on Long Island: Although LIPA rules don’t stipulate that they do, Falcone admitted it was a bad look. Then, former U.S. Sen. Al D’Amato called for him to be fired in an editorial.

On the bright side, Fitch Ratings gave an “A” rating to LIPA bonds, and the project to deliver wind power to Long Island kicked off this year.

Herbst is fighting to use federal funding for new infrastructure construction on Long Island, instead of siphoning off those dollars to help pay for already completed projects. A report recently released in partnership with

the association proposed a special toll lane to pay for improvements to the Southern State Parkway, especially a dangerous section dubbed “Blood Alley” due to its high number of fatal crashes.

The department donated bulletproof vests to fighters in Ukraine and launched a database to register and locate missing pets in the county.

The former chair of the state Senate Environmental Conservation Committee, Kaminsky will focus on advising clients on environmental, social and governance issues.

Another key Long Islander at Greenberg Traurig is Mark Lesko, who like Kaminsky has a background in elected office and as a former prosecutor.

Lesko served as acting assistant attorney general for the U.S. Department of Justice’s National Security Division and also served as supervisor of the town of Brookhaven.

55 WAYLYN HOBBS JR. MAYOR Hempstead Village Waylyn Hobbs had served in a number of different roles for Hempstead Village before

winning a four-way race for the mayor’s office last year.

Hobbs has already had his share of adversity to deal with as mayor, including when a teenager was fatally shot in the village in September. He said that pending mixed-use development projects will help fix antiquated infrastructure and revitalize the downtown, and has floated the idea of turning Hempstead into a city – a move that he said would divert more taxes back to the community.

The hospital won its fifth Magnet designation from the American Nurses Credentialing Center for excellence in nursing – a first for a Long Island institution – and accreditations for stroke and cancer care. A newly built caregiver center will offer respite and resources, and the hospital is moving its Family Health Center to a renovated space closer to the patients it serves.

Richard Margulis has been with Long Island Community Hospital (previously Brookhaven Memorial Hospital) since 1982, when he started as an X-ray tech before getting a series of promotions that culminated in his being named CEO in 2013. The 306-bed medical center stood out as the last independent hospital on Long Island until this year, when it made its

affiliation with NYU Langone Health official. NYU Langone is now planning $100 million in upgrades.

NIFA was embroiled in union contract negotiations with county workers this year due to a dispute over whether the county owed workers millions in back pay. In April, the state expanded NIFA’s authority to oversee the Nassau Regional Off-Track Betting Corp., Nassau University Medical Center and the Nassau County Industrial Development Agency. The county recently received an improved bond rating from S&P Global, which credited NIFA oversight for the change.

While a narrowly averted nationwide freight railroad strike this year did not directly affect Long Island Rail Road, Anthony Simon, general chairperson of the local division of SMART, the commuter railroad’s largest union, said his members stood in solidarity with their fellow workers. The event showed the vital role railroads still play in America’s transportation system. In his role representing the workers who keep the trains running in one of the largest commuter rail systems in the Northeast, Simon oversees the board, handles employee trials and arbitration, and helps negotiate contracts.

LETITIA JAMES If state Attorney General Letitia James was looking for a shot of adrenaline into her campaign before Election Day, she may have gotten it.

She announced a huge $30.5 million settlement with CBS and its former CEO Les Moonves in her sexual harassment and insider trading investigations. Moonves resigned in disgrace in 2018 when multiple women accused him of harassment and sexual assault.
