NYC SCHOOL BUDGET TOSSED BY JUDGE

School funding in New York City took a significant step closer to being restored when a Manhattan Supreme Court judge sided with parents on Friday in a lawsuit challenging the school budget. Partly due to decreased enrollment, the New York City Council initially passed a school budget that was reduced by about $215 million from the previous fiscal year. Parents and teachers successfully sued, arguing that the City Council didn’t have the authority to do so without approval from the Panel for Educational Policy. Adams’ administration said it would appeal the ruling.

When he was rebuffed, Abbott sent some 50 migrants by bus from Texas to New York City. “His continued use of human beings as political pawns is disgusting, and an embarrassing stain on the state of Texas,” Adams’ spokesperson told the New York Post.

MONKEYPOX IS OFFICIALLY AN EMERGENCY

Officials with New York City, the state and the federal government all declared states of emergency on the rapidly spreading monkeypox virus last week. On July 29, Hochul signed an executive order

designating the virus as a state disaster emergency, saying that doing so will allow more health care professionals to administer vaccines. On Aug. 1, Adams followed that up with a state of emergency declaration in New York City, partly in an attempt to get the federal government to fast-track the approval of vaccines. President Joe Biden’s administration didn’t immediately do that, but it declared monkeypox a national health emergency on Aug. 4, opening up more funding and resources to fight the virus, which causes painful lesions on the skin and spreads through close, usually sexual, contact. New York was once again the center of an outbreak: It had about 1,750 of the country’s 7,100 cases as of Aug. 4, according to the Centers for Disease Control and Prevention.

Fight over Hochul’s NYPA nominee Gov. Kathy Hochul’s pick to lead New York’s public power operations has drawn the ire of climate activists and progressive lawmakers for his opposition to legislation that would expand the New York Power Authority’s green energy production. Past political contributions by nominee Justin Driscoll to the Republican Party and its candidates have led to more criticisms by activists trying to keep him from becoming the permanent head of NYPA. Driscoll has served as the interim CEO of NYPA since October, when the previous head, Gil Quiniones, left for a job in the private sector. Hochul nominated him for the permanent role in July, pending state Senate confirmation. It would cap off a nearly decadelong tenure for Driscoll at NYPA. “At a time when New York is leading the fight against climate change and rapidly transitioning to clean energy, NYPA needs strong visionary leadership at the highest level,” Hochul said in a statement announcing her recommendation. Despite the vote of confidence from Hochul, a Democrat, Driscoll’s past political contributions revealed someone who was more closely aligned with Republicans in the state. tween 2009 and 2012, when Astorino was Westchester County executive. Driscoll also gave $500 to the Assembly Republican Campaign Committee in 2010. And in 2009, he donated $1,000 to then-New Jersey gubernatorial candidate Chris Christie. Each contribution came from Driscoll’s current address in Harrison, New York. Driscoll has given to some Democrats from that address, with one of his last recorded contributions coming in 2013 to Bill de Blasio. But donations to Republican candidates and causes far outweighed those to Democrats. Driscoll has attracted opponents who have said they would not vote to confirm him after the testimony he gave to the Assembly stating his opposition to the Build Public Renewables Act, which would expand NYPA’s ability to generate green energy and is considered a major climate priority by advocates. “The NY State Senate voted to pass the (Build Public Renewables Act) this session because we know how crucial it is for climate action in New York,” Salazar tweeted. “We cannot then turn around and vote to confirm a NYPA CEO who isn’t up to the task, which is why I wouldn’t be able to support Justin Driscoll’s nomination.” – Rebecca C. NEW KIDS IN TOWN These candidates didn’t live in the districts they’re running to represent – and some still don’t.

Many congressional candidates asking for your vote in 2022 can’t even vote for themselves – because they don’t live in the district where they’re running. Members of Congress are only required to live in the state, not the district, so there have always been those who don’t reside where they run. But this year’s redistricting brouhaha has led to a few carpetbaggers – and more than a dozen candidates running far away from the address they provided the Board of Elections.

You were the only candidate on a recent debate stage who said you would support a reelection bid from President Joe Biden and accused your opponents of ageism because of it. Do you see any irony in that statement considering you’re running against two longtime incumbents while accusing them of ageism? Never in my entire (campaign) – and you can go through every transcript on Earth – have I ever uttered anything about Maloney and Nadler’s age. The fundamental difference between Carolyn Maloney and Jerry Nadler and Joe Biden is that Joe Biden

has been effective. The president’s been effective. He uniquely was able to defeat Donald Trump, and it is his prerogative as a leader of our party to decide whether and when he chooses to run for reelection. Carolyn Maloney and Jerry Nadler attempted to gerrymander their own districts and use their power to further their power, to further their time in office. And so my argument against them is sheer effectiveness and lack of a plan for the future. President Biden has plans. Carolyn Maloney and Jerry Nadler don’t even have plan pages on their website. This is now your third campaign, and you

have a new opponent in Nadler. How have your past campaigns prepared you for this one and do you think it’s tougher because you’re up against two long-term incumbents instead of one? My first two campaigns prepared me from the standpoint one, learning a lot of lessons, learning some humility and then also applying some of those lessons to running a campaign more effectively and efficiently. You’ll note that there are people out there, like Ro Khanna, for example, who ran a third time after coming super close and won quite overwhelmingly the third time. You are raising name recognition

when you run these races. But fundamentally, our polling shows exactly why we’re going to win this race, which is that with Maloney and Nadler, the base of voters who prefer somebody with experience in seniority is split between two people versus the people who want new leadership – there’s only one game in town. How have you made inroads in the new parts of the district on the West Side, and even the East Side of Manhattan, since you performed better in the Queens portion of the old district? Currently, in this NY-12 as composed, we still got 20,000 to 23,000 votes

two years ago, which is not nothing at all. Which is to say that as we did in Queens and Brooklyn from a margin standpoint, the bulk of our 38,000 votes came from Manhattan just by nature of the density of that part of the district. So we’re starting from not zero at all on the East Side, in any way. And now on the West Side, we have been introducing ourselves with fervor to voters. I think reporters look at this a lot from the standpoint or lens of two chairs and seniority and incumbency and whatever. Voters don’t. Congestion pricing’ obstacle: exemption

mendation will be that no further carve-outs or a very limited number should be included. Transit advocates were also pushing for fewer exemptions, arguing that the road to carve-outs and special dispensations to forgo the congestion pricing toll was a slippery one. MTA officials have often pointed out that the more exemptions that are created, the higher the toll will be for those who have to pay it, because the program is required to fund $15 billion in capital improvements. At least a couple members of the new Traffic Mobility Review Board were well aware of the slippery slope of offering exemptions to congestion pricing. But when another round of public hearings on the program kicks off later this month, the calls for exemptions – calls Adams himself has made – will likely

only grow louder. “I think they’re going to be under tremendous political pressure,” said Nicole Gelinas, a senior fellow at the Manhattan Institute. “There’s going to be a lot of sympathetic voices. You’re going to have people say, ‘I have to drive my kids to a special school in Manhattan. I have to go get medical treatment in Manhattan. I have to drive to visit my elderly parents.’ Everybody is going to have a truly sympathetic point of view. But if you start offering these exemptions, then you basically don’t have a program.” Kathryn Wylde, the president and CEO of the Partnership for New York City and one of the members of the Traffic Mobility Review Board, told City & State that she wanted to limit exemptions, echoing advocates’ argument that including too many could defang

FTER YEARS OF moving at a tired crawl, New York’s congestion pricing program is finally picking up speed. A draft of the environmental assessment for the road tolling program in Manhattan below 60th Street is expected to be released this week, and the six members of the Traffic Mobility Review Board, which will recommend the specifics of the fee structure, have all been named. They included five business and real estate leaders approved by the Metropolitan Transportation Authority board, and Transport Workers Union International President John Samuelsen, who was named to the board by New York City Mayor Eric Adams. Congestion pricing is expected to raise $1 billion in annual revenue once it’s implemented, which will be used to finance crucial infrastructure and accessibility upgrades in the MTA’s capital plan. Few disagree that that revenue is needed by the cash-strapped MTA. But a lot of people don’t want to pay for it. Even among proponents of congestion pricing – or people who have begrudgingly accepted that the tolling program is coming to New York City – there are those who argue that certain vulnerable groups should be exempt from paying. At the 18 hours’ worth of public hearings held on the program last fall, exemptions were argued for on behalf of motorcyclists, seniors, outer borough and New Jersey residents, first responders, commercial truckers, people traveling to medical appointments and more. Those calls came from residents and lawmakers too, including New Jersey Gov. Phil Murphy, who wanted Garden State drivers credited not just for trips to Manhattan via the Hudson River tunnels but also for the George Washington Bridge to avoid “double taxation.” The law that created the program included only three exemptions – for emergency vehicles, vehicles carrying people with disabilities and for residents of the congestion zone who earn $60,000 or less annually. (The latter would be repaid for the cost of tolls in a tax credit.) The Traffic Mobility Review Board was tasked with considering any other exemptions, though it’s possible their recom-

A panel will consider who won’t have to pay the toll – an endeavor some members said could be a slippery slope. the program. “The statutory goal of the program is to be able to fund a billion dollars a year of the MTA’s capital program, which is essential for the modernization of our mass transit system,” Wylde said. “Every exemption means that those who are paying will have to pay more.” MTA officials estimated that the peak toll could range from $9 to $23 for E-ZPass users and $14 to $35 for people paying by mail. Wylde, who in a 2019 op-ed said that those clamoring for exemptions “need to chill out,” mentioned a few issues that she considered “legitimate questions,” including whether a florist from Queens who had to enter the congestion zone multiple times in a day, for example, should be charged multiple times. The congestion pricing law required that passenger vehicles will only be charged once per day for entering the zone. Wylde also mentioned taxis and forhire vehicles, which since 2019 have faced a congestion surcharge and are therefore “already taxed.” In addition to Wylde and Samuelsen, the Traffic Mobility Review Board includes Chair Carl Weisbrod, the former director of the New York City Department of City Planning; John Banks, the former president of the Real Estate Board of New York; Scott Rechler, CEO of RXR Realty; and MTA board member Elizabeth Velez. None of the members live in the congestion zone, which spans Manhattan below 60th Street. The largely real estate and business-aligned makeup of the board was quickly noted when the members were named. “There are no social justice warriors on the board, that’s for sure,” said Danny Pearlstein, policy and communications director at Riders Alliance. “But on the other hand, there’s a pervasive rightwing trope that whatever is happening in the news today is the last straw and after that everyone’s going to leave New York. Real estate isn’t leaving New York. They’re here forever, and they have our future in mind.” Samuelsen, meanwhile, remarked that while he gets along with many members of the board, he will be the only voice representing working-class New Yorkers. “Let’s

be honest, not one of them has a loyalty to blue-collar New York. I do,” Samuelsen said. “And it’s obvious now that the mayor does, as evidenced by placing me into this position.” Adams has been a proponent of congestion pricing, but during the mayoral campaign and more recently, he has revived the call to ensure that congestion pricing isn’t a burden on low-income people who have to drive into the city or people going into the zone for chemotherapy treatments, for example. A spokesperson for City Hall declined to comment further on potential exemptions. A study by the Community Service Society reported that only 4% of outer borough residents with incomes below the federal poverty level rely on a car to travel into Manhattan for work. It also found that of an estimated 481,000 low-income essential workers who commute into Manhattan from the outer boroughs for work, only 15,500 commute by vehicle. Samuelsen, Adams’ appointee to the Traffic Mobility Review Board, told City & State that it was premature to have a conversation about exemptions. (Weisbrod, who chairs the review board, said the same thing in an email.) But Samuelsen said that while he’s open to the possibility of including no further exemptions beyond what’s already laid out in the law, he would fight to include a potentially large class of workers if that conversation begins. “For me, it’s got to be all or nothing. If there’s none, there’s none. But if there’s going to be a conversation about exempting anybody, then I’m going to ensure the blue-collar workforce is included in that conversation,” Samuelsen said. “I don’t intend to proactively seek exemptions. But if others do, it’s going to be met with a response in defense of the blue-collar essential workforce that carried New York City through the pandemic.” A final decision on the environmental assessment for congestion pricing from the Federal Highway Administration is expected in January, and if it gets the green light, the Traffic Mobility Review Board could begin their proceedings to make recommendations on pricing and potential discounts or exemptions.

OYNIHAN TRAIN HALL – the soaring new extension of Penn Station officially opened in 2021 – houses more than two dozen food and retail outlets and services Amtrak and the Long Island Rail Road. Yet, most people in the hall’s glass ceiling atrium are huddled on the floor or leaning against walls and railings waiting for their trains. The problem is stark: Outside of booths in the food hall and a ticketed waiting room, seating in the $1.6 billion hall is highly limited. The lack of seating, however, is not entirely unprecedented: Some advocates said the design of Moynihan Train Hall was another part of a multipronged effort to remove homeless people from public spaces in New York City. While the train hall’s design discouraged sitting or laying down by nearly eliminating seating altogether, subtler architectural fixtures across the city also seek to discourage people from resting for extended periods. Many subway stations feature seating but with armrests segmenting the bench to discourage laying down. Embankments are often lined with thinly veiled spikes to disallow sitting. In response over the years, social media accounts and campaigns have popped up to advocate against the influx of “hostile” architecture. But recent efforts to remove homeless people from public spaces are not exclusively architectural. Earlier this year, New York City Mayor Eric Adams and Gov. Kathy Hochul announced a plan to deploy police officers and mental health workers to stop homeless people from sheltering in subway stations. “No more just doing whatever you want. No, those days are over. Swipe your MetroCard, ride the system, get off at your destination,” Adams said at a February press conference announcing the zero-tolerance policy. These efforts came as the state Legislature decided against renewing a tax abatement last month that provided incentives

PUSHED OUT OF SIGHT Jacquelyn Simone, policy director at the Coalition for the Homeless, said she first began noticing hostile architecture in subway stations near her Queens home. The Metropolitan Transportation Authority had installed sets of “leaning benches,” which are slanted planks that allowed straphangers to only partially lean against the wall. Simone said these architectural features only exist to target the visibility of homelessness. “Hostile architecture operates on the premise that homeless people should not be present in a certain area, not that homelessness should not exist,” Simone said. “So making benches and seating areas less comfortable for homeless people does not actually address the root causes of why homeless people feel the need to sleep on

these benches in the first place.” Simone said addressing the root causes would ultimately entail a comprehensive effort to expand housing options for homeless people. The city has reported about 50,000 New Yorkers sleeping in its shelter system daily, with thousands more sleeping on the streets. Under the city’s Subway Safety Plan, it plans to relocate those sheltering in the subways to “short- and longer-term destinations of care, support and housing.” Simone said she and other advocates shared these goals of providing more longterm options for people currently living on the streets – but the solutions touted in the plan do not exist right now. As part of the plan, Adams announced in March that an effort was underway to create 500 additional low-barrier shelter beds across the city. However, Simone said while the city has offered to transport homeless people to these beds, the large “dorm-style” housing option was unappealing to many. Ideally, Simone added, city workers would be able to offer homeless people longer-term options with fewer restrictions like curfews. Many people experiencing homelessness prefer to relocate to more permanent situations instead of a temporary shelter bed. “In such a wealthy city, it is completely indefensible that thousands of our neighbors feel that they have no better option than the streets,” she said. “But rather than just trying to police our way out of homelessness, we need to actually connect people to the housing and support that they need, which will actually be much more effective in the long run than just pushing people out of sight.” Adam Roberts, policy director for the American Institute of Architects New York, said the airy Moynihan Train Hall design mimics European designs: large, open spaces designed to keep people moving through the transit hub. Limited seating allows for more flow through these spaces, he said, which was likely the thought behind the Moynihan Train Hall’s design.

“People should be able to sit down, and especially people who don’t have a home, they need a place to rest. But frankly, it shouldn’t be a train station, it should be housing,” he added. “The fact that we’re even talking about benches as alternatives to housing shows how bad our policies are right now.” Beyond shelter beds, some people may also require housing with more comprehensive and regular support. The city’s 15/15 Supportive Housing Initiative – established by then-New York City Mayor Bill de Blasio – was supposed to establish 15,000 supportive housing units by 2030. Adams committed to moving that deadline up to 2028, which Simone said was a positive indicator, though she and other advocates hoped to see the timeline further accelerated. In 2019, the New York City Council passed a bill mandating that 15% of the city-funded housing be set aside for home-

less populations. Simone said that was also encouraging and likely more effective than other policies seeking to incentivize affordable housing. One such policy was the 421-a tax abatement: the city’s most lucrative tax incentive to establish affordable housing. The abatement expired last month after the state Legislature did not renew it. The newly opened Brooklyn Tower – the first supertall building outside Manhattan – obtained a sizable tax break through the program. But, like many developments supported by 421-a, Brooklyn Tower’s 120 affordable housing units were targeted toward “median-income” renters. Though the development has not yet released its rental prices, the units will almost certainly be inaccessible to the homeless population being pushed out of the subways. When it comes to supportive and widely affordable housing, Roberts added, there’s still a lack of political will.

Advocates said hostile architecture only serves to punish homeless people instead of working to solve the root causes of the problem.

“We need officials to say, ‘We need to have better designed shelters. We need to have more supportive housing. We need to have psychiatric facilities,’ and that’s what architects can do,” Roberts said. “We can design and build – we can’t provide the services themselves, but it’s impossible for the social services to be provided if we don’t have the spaces to provide them.” LESS WELCOMING Although new developments like the Moynihan Train Hall have renewed attention on hostile architecture, the pattern is not new, according to City University of New York professor Setha Low. A researcher of urban anthropology, Low is also the director of the Public Space Research Group, founded in 1995 to evaluate the accessibility and inclusion of public spaces. As early as the 1980s, urbanists like William Whyte were documenting ledges with small spikes and benches with extra

armrests across the city, Low said. “I don’t see it as something new,” Low said of hostile architecture. “I really see it as a continuation of other things that we’re seeing, which is an increase in the regulation and control of public space to make it comfortable for some people and less desirable for others.” Regulation can extend beyond tangible fixtures of hostile architecture, Low said. In addition to increased policing through measures like the Subway Safety Plan, the city has ramped up its public surveillance in recent years. The Public Space Research Group has logged how these myriad forms of hostile architecture – from heavy surveillance to spikes on surfaces – disproportionately target racial minorities. “Large numbers of regulations and lots of policing and surveillance will keep young youth of color, particularly male, out of an area,” Low said. “But that same kind of surveillance and large numbers of

rules, maybe even a guard or a gate when you walk into a public space, tend to make a tourist who is unfamiliar with a place and sometimes women, middle-aged and middle-income women, feel more comfortable.” Limited or uncomfortable seating also inconveniences people with disabilities, according to Sharon McLennon-Wier, executive director of New York’s Center for Independence of the Disabled. Under a settlement announced in June, the MTA will make 95% of its stations that do not currently have elevators or ramps accessible by 2055. Even though the settlement was a major victory for disability advocates, McLennon-Wier said significant accessibility barriers remain. McLennon-Wier, who is blind, said she has struggled with the lack of railings barring people from falling onto subway tracks as well as limited seating. Sparse seating options can also affect people who may not necessarily identify as disabled, she added – particularly pregnant people, the elderly and people using crutches or a walking aid. “To live in the New York City area, where you have a vast public transportation system, you need to also have an accessible public system,” McLennon-Wier said, “so that people regardless of their age, and how their bodies are, they will still be able to get in the subway.” Low said the pandemic changes like street restaurant seating seemed promising at first by creating a more “lively public realm” across the city. In the early months of the pandemic, the city Department of Transportation also launched an Open Streets program to open up more public spaces. Yet, Low said this progress seemed to be counteracted by increasingly hostile design in the other major developments. Beyond “leaning benches,” spaces that were clearly targeted toward a certain group of people become hostile to others, Low added. Just blocks from Moynihan Train Hall, the recently opened Hudson Yards development features a mall chock full of luxury brands and units listed at a minimum of $5 million. “You want a certain kind of person socially and economically, and I would say even racially, to feel comfortable,” Low said of the development. “And so suddenly the space is less welcoming for all.”

Big real estate wants to save Midtown with the same mistakes it made at Hudson Yards. By Maia Pandey

HE MYRIAD NETWORK of lawmakers, real estate developers, advocates and small-business owners embroiled in the Penn Station redevelopment seem to agree on one thing: The station is overdue for a face-lift. Though it remains the busiest train station in the country, the entirely underground structure sports no natural light, cramped platforms and corridors, and a plethora of confusing signage. More than a year ago, then-Gov. Andrew Cuomo took on revamping the station, and Gov. Kathy Hochul’s administration has since taken up the mantle. But as progress inches forward, criticisms of the state’s plan have only grown stronger. Last month, the state Public Authorities Control Board approved agreements between the city and state that outlined a funding model for the project. The model itself was what many advocates took issue with: The governor’s plan hinged on several skyscrapers that the state would allow commercial real estate developers to build around the station. Instead of taxes, the developers, namely Vornado Realty Trust, will make payments in lieu of taxes, or PILOT, to the state, which will help pay for the new Penn Station. The vote did not solidify any agreements with developers, which opponents counted as a victory – including state Sens. Liz Krueger, Brad Hoylman and Robert Jackson, who have criticized the funding model. “We will continue fighting alongside the commu-

nity to ensure that those deals are not just corporate welfare for developers,” the senators wrote in a statement after the vote. “That means much more guaranteed affordable housing and no unnecessary tax breaks that reward developers for building projects they wanted to build anyway.” Meanwhile, proponents of the governor’s plan hailed its potential to deliver more affordable housing units and jobs to Midtown. In statements after the vote, Carlo Scissura, president and CEO of the New York Building Congress, praised “the economic boost a reimagined Penn Station and surrounding community will deliver for the entire region,” while Vornado pledged in a statement to “deliver significant public realm and transit improvements across the district.” But advocates said the specifics of how the sprawling redevelopment will actually revitalize the station and surrounding neighborhood were murky. According to an independent review by government watchdog Reinvent Albany released last month, the PILOT revenue could cover just over half of the total project cost, meaning the state will likely need to secure anywhere from $3.4 billion to $5.9 billion – which could end up leaving taxpayers footing a significant chunk of the project. Vornado, on the other hand, will receive up to a $1.2 billion tax break from the deal. LARGER TRANSIT SYSTEM DEBATE Some transit advocates have had criticisms of the proposed changes to the station itself. Hochul’s plan would rework the mul-

tilevel platform into a larger, single-level train hall with plenty of natural light. Despite the state’s renderings of a sweeping platform under a glass skylight, advocates pointed out that the reconstruction leaves Penn Station under Madison Square Garden. With the sports arena still sitting atop it, the amount of natural light would be unlikely to measure up to the state’s images. According to the project documents, the other transportation improvements would center mostly on widening platforms and stairs, along with constructing new entrances and connectors across the station. Advocacy groups like ReThinkNYC, which proposed an alternate project plan, argued the redevelopment should be grounded in a more robust overhaul of the station. ReThinkNYC’s proposal was based on establishing a “through-running” system at Penn Station, as opposed to its current “terminal” system. The system would hinge on allowing trains to continue in one direction after unloading and loading passengers, instead of reversing direction after unloading passengers. The group said transit hubs in London, Paris and downtown Philadelphia have adopted the strategy because it maximizes efficiency by avoiding trains crossing paths. “(Through-running) is what modern international financial center cities are almost uniformly doing and have been doing for some time since the ’60s – London, Hong Kong, Tokyo, Paris and Madrid,” ReThinkNYC Chair Sam Turvey told City & State. “It’s the consensus standard, and

why they are thinking about anything else is puzzling.” Last year, an advisory committee of the Empire State Development released a report dismissing the possibility of converting Penn Station into a through-running system. “There are too many physical constraints and fatal flaws, the costs would be highly disproportionate to the limited benefits and the implications for the Moynihan Train Hall would be untenable,” the report said. But Turvey said those reasons were relatively vague. While the committee re-

ported “highly disproportionate” costs, ReThinkNYC has claimed its plan would save billions compared to the state’s current plan. To reconcile these discrepancies, Turvey said they have pushed for an independent review of a through-running proposal before the project breaks ground – and their requests have remained unmet. AFFORDABLE HOUSING VERSUS “LUXURY CITY” Alongside the station’s face-lifts, developers and lawmakers have also promised

significant economic development and new affordable housing units in the neighborhood as a result of the plan. As part of the state’s plan, there could be as many as 1,800 housing units created, including 708 new affordable and supportive housing units. But the new buildings could displace more than 400 businesses. A table of businesses potentially displaced by the project lists up to 10,000 workers who could be affected by the project. And while the largest company was an advertising firm with more than 2,000 employees, many of the businesses with fewer than five employees will almost certainly not be able to afford office spaces in the new skyscrapers. The development would also displace 206 residents in 128 apartments. While the project would likely create more affordable housing units, nonprofit community group Human-Scale NYC founding member Lynn Ellsworth said the promises of “economic development” were more complicated than the developers claimed – especially if new housing units came at the expense of a network of restaurants, retailers and a local church. “It’s cheap rent for little entrepreneurs of all kinds – theater companies, therapists, musicians, people just starting off with their new business,” Ellsworth said. “And for some reason, the city thinks we don’t need that kind of space, and (the idea that)

we can just get rid of it and replace it with Class A office space is gentrification of the small-business sector.” Ellsworth believes Vornado’s vision for the area around Penn Station contrasts with many of the businesses that currently occupy the neighborhood. The new office buildings promise to include rooftop pavilions and full-service restaurants with private dining rooms, along with the building Vornado has already redeveloped on West 34th Street. Ellsworth said these developments will benefit few of the people living and working in the area, pointing to the Molly Wee Pub as a prime example of what will be lost. Located a block from Penn Station, the pub was among businesses slated for displacement if the project breaks ground. “Go to the Molly Wee Pub diagonally across (from Moynihan Train Hall). The pub is full of a working-class population after a Rangers game having fun. They’re not the sort of high-class gentry portrayed in Vornado’s depiction of what it wants to do to the neighborhood,” Ellsworth told City & State. Ellsworth said the development was indicative of a push to build a “luxury city” chock full of Class A offices as an approach to economic development. But, she added, fostering economic growth was more complicated than building skyscrapers, and it was unclear how a Hudson Yards-esque expansion would

benefit the surrounding neighborhood. While the far West Side development took a significant hit in the months before the pandemic, the success of Hudson Yards remains uncertain more than three years after its initial launch. And even if the $25 billion development eventually delivers on its investment, it’s unclear how much value several more supertall office buildings within a couple blocks would add as only 8% of Manhattan office workers reported working in person five days a week earlier this year, according to Partnership for New York City. Ellsworth noted that while there was rarely a catch-all solution to fostering economic development, meaningful investments in transportation and education have always revamped communities. HOLDING OUT FOR A RETURN TO PENN’S ORIGINAL GRANDEUR Advocates like Turvey have pushed for a Penn Station renovation that builds on the foundation of the original station – a landmark above-ground structure that was demolished in 1963 to make room for Madison Square Garden. While relocating the arena was floated by lawmakers and advocates as part of the current Penn Station redevelopment, the idea was rejected by MSG executives. “I personally think that if you rebuild the original Penn Station and reverse the architectural crime of the century,” Turvey said, “throughout the world little kids would be reading about this … and you would probably be generating four or five generations of tourists and other interest in the city.”

It’s not just Penn Station that’s getting a major makeover. By Dan Vock

Y MOVING forward with plans to renovate Penn Station, New York joins a growing list of cities that are hoping a major rail station redevelopment can help to revitalize the surrounding area. Many of the plans share key elements: preserving and upgrading historic structures, adding better connections among different transportation modes and capitalizing on the potential in nearby real estate. The projects are notable because the country has focused so much of its resources on building infrastructure for cars, while allowing its rail system to deteriorate, said Paul Angelone, senior director of the Curtis Infrastructure Initiative at the Urban Land Institute. “As a nation, we need to regain the ability to actually think about these large, transformative projects. This used to be very common,” he said. “As you do things that are new, or just do them again for the first time in a long time, it gets a lot of attention. These (projects) are going to have a huge impact on a lot of people’s lives, so I think there’s a lot of excitement.”

DENVER AND MIAMI One of the most successful rail hub renovations came in Denver in 2014, where the decadelong refurbishment of Union Station and related improvements to nearby rail yards set off a real estate boom in the Lower Downtown area. The station is a hub for Amtrak, commuter rail, light rail and buses. Local leaders kept the century-old granite building that long served as the rail station, but, using a public-private partnership, converted most of it into a hotel, restaurants and other retail space. Next to the granite edifice, they added an open-air train hall framed by a white canopy stretched aloft on white steel girders. The stunning architecture and the reconfiguration of 50 acres of nearby real estate that made the station possible reignited interest in Denver’s downtown. The $487 million project was at the center of a neighborhood reinvention. Local transit officials said it helped spark the development of 3,000 residential units, 1.9 million square feet of office space, 250,000 square feet of retail and 750 new hotel rooms within a few blocks. In Miami, a privately built passenger rail station helped to reinvigorate a neglected part of the city’s downtown. The MiamiCentral train station and related developments span six blocks. It’s the southern end to a new passenger rail service, called Brightline, that connects to Fort Lauderdale and West Palm Beach, with extensions to Orlando and Tampa in the works. The station includes 816 rental residences, 130,000 square feet of retail space, a food hall and entertainment venues.

CHICAGO The federal infrastructure law that Congress passed last year included $66 billion in various programs to fund new passenger rail service or upgrade existing facilities. Meanwhile, Amtrak’s financial situation had improved before the pandemic, allowing it to contemplate upgrades that long seemed out of reach. (Along with New York’s Penn Station, Amtrak owns stations in Chicago, Philadelphia and Baltimore. They are some of the busiest stations in the country, and it has plans to upgrade all of them.) Officials from the Chicago area unveiled an ambitious $418 million proposal to overhaul the city’s Union Station and make related rail improvements around the rail hub. They want the federal government to pay $250 million of that total. Some of the problems they’re trying to deal with in

Denver’s Union Station reignited interest in downtown and brought more development to the area.

Chicago’s historic but overcrowded central station are all too familiar for regular users of Penn Station. For example, they’re trying to open up the concourse that passengers use to get to and from Amtrak and commuter rail lines. Currently, customers in Chicago often have to navigate a warren of cramped hallways to get to their trains. Two office buildings sit above Union Station’s tracks, limiting the options for new configurations. But Amtrak, which owns the facility, has slowly been clearing the space. It relocated ticket counters, offices and a passenger lounge from the crowded concourse to the more spacious – and iconic – adjacent building. Now, Amtrak and local agencies want to move escalators and raise ceilings in the concourse, making it more open and easier to navigate. The Chicago consortium also wants to widen platforms and

reactivate platforms once reserved for mail transport. That would increase capacity and decrease overcrowding, especially at rush hour. Beyond the station upgrades, Illinois officials are asking for track improvements that would reduce delays on trains running to Detroit and southern Illinois, and they want to add the ability for some trains to run through the station. “While these are big-ticket items, there are big needs here in Chicago,” said Amtrak CEO Stephen Gardner when the plan was announced in July. PHILADELPHIA AND WASHINGTON, D.C. In Philadelphia, officials want to make improvements to the 30th Street Station to accommodate anticipated ridership growth as well as to rejuvenate a section of the city isolated by nearby rail yards and an interstate highway. “The vibrancy found within

the walls of Gray 30th Street Station does not yet extend to the district around it,” architects from the firm SOM wrote about the plans. The first step to improve the situation in Philadelphia was a 50-year deal with an Australian infrastructure company to refurbish, improve and maintain the station. But the bigger vision, developed after two years of public input, was a $10 billion effort to make the rail station the centerpiece of a neighborhood transformation. That included $2 billion for station improvements and other public amenities, $4.5 billion in private real estate investments over 88 acres of existing rail yards and $3.5 billion for a major development from Drexel University just west of the station. Meanwhile, in Washington, D.C., the Federal Railroad Administration wants to build over the train tracks as part of an effort to improve Am-

trak’s second-busiest station. The agency and its partners, though, ran into trouble with their first plan to do so because local officials and businesses complained that the proposal for Union Station included too much space for parking, which would limit the station’s value as an intermodal hub. In June, the agency unveiled an updated plan, which would include less parking and put it underground. Other major improvements proposed included a new train hall, more tracks, better connections to buses, expanded retail and new entrances around the building. And Akridge, a development company, could add a dozen buildings over 15 acres of existing tracks, in a $3 billion project known as Burnham Place. Angelone, from the Urban Land Institute, said the changes to the Washington, D.C., plans were a “fabulous example” of how community input could improve a design. The parking garages were initially included because they would generate revenue, but the feedback helped clarify that the community had different priorities, he said. “Is your goal to move a lot of people and build a stronger community or is it just to drive revenue?” he said. Many of the plans for improving rail stations also demonstrated the importance of connecting them to neighborhoods, Angelone added. “It’s not just an open rail yard. It’s a continuation of the city. I think that’s a powerful and important thing. Building those spaces is important, even if they don’t pay for themselves,” he said. “There’s a lot of value beyond just the dollars and cents of how you structure these things.” Dan Vock is a reporter for Route Fifty.

Last year, Goldstein partnered with Nexar to install vehicle cameras to protect drivers from attacks. Families for Safe Streets New York City has an outspoken advocacy community pushing for safer streets, and one of the most vocal among them is Debbie Marks Kahn. Kahn, who co-founded Families for Safe Streets after her son was killed in a bus collision in 2009, has lobbied for improved street designs and a crackdown on speeding. Having your bike stolen is an expensive inconvenience for most people, but for Shabazz Stuart it launched a new career. In 2017, the Brooklyn native created a company that made modular parking pods that could store scores of bikes and protect them from theft.
