A

s we celebrate American Independence Day, it is important to consider what it means to be an American.

If we are born in this country, we are Americans from birth. We may not have made a conscious choice about our nationality and people at birth, but as we mature, we make a choice to continue to live as Americans. We can question why we are Americans or we can stand up and proudly proclaim, “We are Americans!” As an adult, I have done many things to actively choose to be an American. When I voluntarily served nine years in the U.S. Navy Reserve, I wore the uniform as an American officer with great pride. I chose to serve my country, just as my father had made a conscious decision to serve. The “Old Navy” store each year markets a Fourth of July American T-shirt. Each year, as I wear my American shirt on Independence Day, I become very much aware of what it means to be an American. I actively choose to be an American as I look at myself in the mirror with the American flag across my chest. I choose to be an American because this country welcomed my grandparents as immigrants in search of a safe place to raise their children. I am a proud American because I know the first President of the United States, George Washington, went out of his way to travel to the small synagogue in Newport, Rhode Island, to proclaim that Jews will forever be welcome, and protected, as citizens. I am an American because President Abraham Lincoln, with all of the things that were on his mind and schedule, took time out to make special provisions for Rabbis to serve as Chaplains comforting those who wore the blue in the Civil War. Jews would have the same benefits and services that all other Americans have. I am an American because this nation chose the words of a Jewish poetess to be posted at the base of the Statue of Liberty to actively grant refuge to all in need. (By the way, the words of Emma Lazarus would be moving and special even if she had not been a Jew.) I am an American because we are a nation of many minorities brought together with common aspirations. To be an American means to be hopeful and optimistic. These are the characteristics that I want as my own. I am an American because the two greatest basketball coaches in professional basketball through the 1970’s, Red Auerbach and Red Holtzman, were proud Jews. This was a country were the best basketball dynasty ever could be

led by decades by a Jew without any show of prejudice or hatred. I am an American because this is a nation where instead of locking Jews up or pursuing Jews in pogroms, American soldiers freed Jewish inmates from concentration camps. Our country lost many thousands of soldiers to ensure a Holocaust would stop and that one cannot happen again. I am an American because this is a land where a Jew can serve as Mayor not only in New York where there is a large Jewish population, but also in cities like Las Vegas where the Jews are a rather small minority. I am an American because this is a country in which the greatest pitcher of his day can be applauded for not pitching on Yom Kippur. This is a country where you are admired for standing up for values and heritage. I am an American because only in America could the Navy bend the rules to ensure that the Father of the Nuclear Navy, a proud Jew, could continue to serve his country in uniform well into his nineties. This is a country in which talent and skill matters more than ancestry. I am an American because this is a country that does not care whether your grave is marked with a cross or a Magen David, you are remembered as an American hero. I am an American, part of a country were all three of my representatives in Congress, including both Senators and my Congressman are Jews who proudly support Israel and the Jewish people both within and beyond the walls of the Capitol Building. I am proud to live as an American in a country where a person of color can be elected President without respect to his skin color. I am a citizen of a nation that protects those with handicaps, that provides special education, and that gives opportunity to those with need. While I was born an American citizen, I now actively choose to be an American. I do this with pride of history. I do this for my children. I do this because I truly believe that America has made the world a better place. I do this because I honestly believe that through America, our world will increasingly become a better place. I

n the last post, we mentioned that we fast on the 17th of Tamuz because the Luchos, the tablets containing the Ten Commandments, were broken on this day. In the Jerusalem Talmud (Ta'anis 4:5) there is a discussion of the events leading up to the breaking of the Luchos. Moshe ascended Mt. Sinai to receive the Torah, and told the nation that he would be there for 40 days. After what the nation erroneously assessed to be 40 days, Moshe had not reappeared, and the nation began to fear that Moshe would not return. People approached Aharon, Moshe's brother, asking him to "create" a new leader, which was the Golden Calf. As they were creating and then worshiping the Golden Calf, Moshe was still receiving the Torah from G-d. G-d informed Moshe to descend the mountain, as "your nation has become corrupt." Moshe went down, and met Yehoshua, Moshe's devoted student and assistant, who had been waiting for Moshe. Both heard sounds coming from the camp. Yehoshua thought the sounds might be those of battle. Moshe responded that the sounds were not the sounds of war, but rather the sounds of song. Moshe then continued down the mountain, and when he saw the nation engaged in the worship of the Golden Calf, he broke the Luchos. The Talmud tells us that we learn an important rule from an aspect of Moshe's behavior. From the fact that we see Moshe did not break the Luchos until he saw the nation engaged in idol worship, we learn that a person cannot judge based on an estimation. Though Moshe heard the nation's celebratory noises and had a clear picture of what was occurring, he did not break the Luchos until he saw with his own eyes that the nation was not deserving of the Luchos. The Chasam Sofer, in explaining this Gemora, notes that G-d informed Moshe that nation had become corrupt even before he descended the mountain. In fact, Moshe asked for forgiveness for the nation before he descended. So why then did he wait before breaking the Luchos? The Gemora explains that Moshe broke the Luchos because of a judgement he made: If, by the Pesach offering, we find that a male who is uncircumcised, lacking in only one respect in his observance, cannot take part, a fortiori the nation, who were denying G-d's providence by worshiping the Golden Calf, could not take part in receiving the Torah and the Luchos, upon which were engraved the Ten Commandments. For this reason, G-d did not want Moshe to bring the Luchos down to the people. However, Moshe felt that perhaps the people had some explanation behind their actions. Perhaps they were not really denying

G-d's providence. Our Sages explain that Satan fooled the nation into thinking Moshe had died by placing a vision of Moshe lying on his deathbed into the heavens. Moshe thought that perhaps this was why the nation took the action that they did. He gave the people the benefit of the doubt. However, G-d, who knows what is in the heart of man, knew that from the time the nation heard the Ten Commandments, there were nonbelievers. Now that they thought that Moshe was dead, they had a seemingly valid pretense for idol worship and their true colors came out. Moshe did not know that this was the case when Hashem told them the nation was corrupt. Only when he heard the songs of the people was he able to detect that something was amiss. Moshe detected an element of joy in those songs that was not present when the nation received the Torah. He knew that the people did not deserve the Luchos. Hashem's statement was confirmed. The small doubt that Moshe previously had vanished. So why did Moshe wait before breaking the Luchos? Moshe had to see that the Jews were engaged in this behavior before he rendered judgement. Being almost sure was not enough. Moshe could not take any action until he knew with absolute certainty that the nation was acting improperly. Moshe achieved that degree of certainty only upon seeing the Jews dancing and singing around the Golden Calf with his own eyes. Consequently, Moshe broke the Luchos only upon seeing the nation worshiping the Golden Calf. And from here we learn that we cannot judge based on an estimation. The 17th day of Tamuz marks the beginning of the end of the Holy Temples. The Temple was destroyed, our Sages tell us, because of baseless hatred. Because people did not treat each other properly, the Temple was destroyed, and the Jewish nation was sent into an exile which has not yet ended. In Pirkei Avos (The Ethics of Our Fathers) our Sages tell us that we should always be careful to give everyone the benefit of the doubt. If Moshe, who was told information by G-d about the Jewish nation, still gave the people the benefit of the doubt and did not act until he knew the circumstances with certainty, we, who usually do not have a source as reliable as G-d for our information, should certainly give others the benefit of the doubt and not jump to conclusions. It is fitting that on the day we begin to mourn a destruction that occurred because of our interpersonal relations, we learn an important lesson about these relations from another tragedy that occurred many years before on the same day. May we all merit to see the Temple rebuilt speedily, in our days. •

rime and Punishment. In a corporeal world, the correlation of a jail sentence to a crime does not symbolize a cogent philosophical message. Of course, it may tell us that crime does not pay. Unfortunately, that comprehensive message does not differentiate between one who steals to sustain his family, and the greedy scam-artist who bilks widows out of their life's savings. The two felons may sit only a few cells apart from each other, with an arsonist or barroom brawler separating them, but the crimes that sent them to their dismal abodes are so very different in intent.

Divine justice does better. Every aveirah generates a punishment specifically designed to send a distinct Heavenly message to the afflicted. Of course, it may take an otherwise perspicacious mind to correlate what life is handing to him and how it relates to his mortal misdeeds. We do not always relate events that occur to the acts we have perpetrated. Sometimes it is too much for us to bear, and sometimes our ideas may lead us to wrongful conclusions, harming both our psyche and morale.

Out of nowhere, a man charges forward, dives into the ocean and swims valiantly toward the helpless child. Moments later he is holding the gasping child aloft, while his weeping grandmother dashes toward them. She whisks the child from the man, and looks over the child making sure he is still in one piece.

But when the Torah teaches us about crime and punishment we are more fortunate. The lessons of our past are now devoid of the guilt-ridden, depressive response we may have currently; rather they are moral springboard from which to bound to greater heights. And thus, when the Torah tells us of a clear crime and an immediate response, we have to transpose the relationship between the two to attain another moral lesson.

In Gan Eden, the Garden of Eden, life was blissful. Adam and Chava had all they could have wanted, except for one type of fruit -- The Eitz Hada'as, The Fruit of Knowledge. It was the snake that taught his human cohort, the concept of total self-indulgence, rendering them powerless to say, "No!"

The people spoke against G-d and Moshe - "Why did you bring us up from Egypt to die in this wilderness, for there is no food and no water, and our soul is disgusted with the insubstantial food [Manna]?" G-d sent the fiery serpents against the people and they bit the people. A large multitude of Israel died. The people came to Moshe and said, "We have sinned, for we have spoken against Hashem and against you! Pray to Hashem that He remove from us the serpent" (Numbers,21:5-7). The people complained about their fare, and were punished with snakes. If Divine retribution is corollary to the crime, how do snakes correspond to kvetching? Rashi quotes the Midrash Tanchuma. "Hashem said as it were - let the serpent which was punished for slanderous statements come and exact punishment from those who utter slander; Let the serpent to which all kinds of food have one taste [that of earth; cf (Gen:3:14) and (Yoma: 75a)] come and exact punishment from these ingrates to whom one thing (the manna) had the taste of many dif-

What was the slander of the snake? Didn't he just convince Chava to take a bite of the fruit? What connection is there with the Manna? The old Jewish yarn has a Bubby (grandmother) taking her grandchild, little Irving, to the beach toward the end of spring. There is hardly anyone around as the child, dressed in a spring suit, plays innocently on the shore. Suddenly a wave breaks and sweeps him into the vast ocean. The grandmother, who cannot swim, yells toward the deserted beach, "Someone! Please save my Irving! Please! Anybody!"

Then she turns to the man, nods her head slightly and parts her otherwise pursed lips. "He was wearing a hat."

The desert dwellers did not fare much differently. Their celestial fare adapted to almost any flavor in the world. Water flowed freely from the rock. But they were not content. They wanted more. The unfulfilled flavors that the Manna refused to replicate were on their minds. They felt that Manna was only a mere simulacrum of the luscious cuisine that they desired. Their craving for everything, manifested itself in punishment through the animal that has his most favored fare, anytime anywhere -- the snake. To a snake, all dust is desirous! When the Jewish nation were both led and fed, through a hostile environment, yet complained that their miraculous bread is insubstantial, then the only correlation, powerful enough to make them mend their thoughtless ways was the bite of the very being who gains no enjoyment from what he bites, while having all he desires. Our goal in life is to revel in the blessing, rejoice in all the good that we have, despite the shortcomings of a limited world, and the trivial amenities we may lack. One must learn to appreciate his head, even if he is missing his hat.•

his was an intense week. Last Sunday, I hung out with a mom struggling with the disappointment and frustration of a series of failed fertility treatments. On Monday, I met with a young mother who was still reeling from a stillbirth right before Passover. On Wednesday, I visited a mother whose teenage daughter hates her and has rejected everything this devoted and amazing mother holds sacred. And last night I spoke with an old friend who shared that the final months of her most recent pregnancy were an extended nightmare of frequent panic attacks and debilitating anxiety. We tend to think of being a mom as something so natural, so cheerful, so rosy-cheeked…"As American as motherhood and Apple Pie." But as I get older, and experience more experiences and meet and speak with more moms, I am struck more and more by the occupational hazards of motherhood. A professional choice as dangerous, as disaster-prone (at least on an emotional level) as coalmining or car-racing or sky-scraper window washing. At the finale of this week spent ruminating upon the riskiness of my chosen lifepath, I was reading (for the umpteenth time) Rabbi Noach Weinberg zt"l brilliant "48 Ways to Wisdom" and came across the following quotation: "If you spend your life avoiding pain, you will also avoid its deepest pleasures." Which reminded me of a very emotional event I'd attended a few hours before. My dear friend, who has struggled for years and years and years with infertility, who has endured thousands of shots and hundreds of painful treatments and the ongoing kind of searing disappointment that only a woman who yearns to hold a child in her arms can fathom, watched as her newborn son was passed over to the prayer-shawled mohel at his brit. After the brit, when I wished the father "Mazal Tov!" I looked into his flushed face and realized that until that moment I had never in my life been a witness to true happiness. A life without the responsibilities and risks and struggles of motherhood is probably a much easier life. But a life devoid of pain is also a life chronically, tragically, profoundly devoid of true joy. •

henever we express our gratitude - especially with song and joy – we work miracles and invoke phenomenal Divine compassion. The entire task of a Jew is to give thanks, for the Hebrew word for Jew, Yehudi, means “one who gives thanks.” If you thank Hashem for everything, you won’t have to run after rebbes and Kabbalists to ask for blessings because you’ll be blessed in every single way. On the other hand, if a person persists in crying and complaining, no blessing will help him. One young woman told me that she began writing down the miracles and the big blessings that Hashem does for her in a little notebook that she keeps in her purse. Ever since, she’s always happy because she’s always thanking Hashem. Her life has turned into paradise on earth. Another young man in our Yeshiva was sued for money that he never owed. The company that was suing him had an entire staff of lawyers who had all kinds of circumstantial evidence against him. The young man went up in the hills north of Jerusalem, and thanked Hashem for two hours, telling Hashem how much he appreciates the wakeup call and making a firm resolution to appreciate Hashem’s

many favors and to strengthen his prayer and his gratitude. Within 48 hours, he received a letter from the lawyer apologizing for the mistake and misunderstanding. Who knows how many thousands of dollars in legal fees and hours of court battles would have been required for him to prove his innocence. Who says the court wouldn’t have ruled against him? We have all kinds of stories like this, about how personal-prayer sessions of gratitude – literally thanking Hashem for their troubles - saved people from severe and harsh judgments. Hashem has given me the privilege to see with my own eyes how people in Israel and abroad have made comebacks from even terminal illnesses when the doctors had already given up all hope. How! They simply took my advice and started to thank Hashem for the terminal disease! They thank Hashem for the fact that there’s no one left to depend on but him! There are dozens of people that we know about who were smart enough to do so. Many people have written us that the doctors gave them a few weeks or months to live, and they’re still with us a year or two later. Some people have seen malignant growths disappear altogether.

Emuna teaches us that there’s no such thing as bad in the world. If a person thinks that there’s a concept of bad in the world, it’s simply because he hasn’t yet learned a book by the name of The Garden of Emuna. No two people have the same mission in the world; therefore, everything Hashem does is for the very best, to guide each individual along his or her unique path and ultimate soul correction.

Any person that makes expressions of gratitude a daily part of his or her life – for everything Hashem does, the good and the seemingly otherwise – will see tremendous miracles and solutions to problems that he never dreamed could be solved.

Are you having a tough time in life? Maybe it’s because Hashem wants you to make a right turn instead of a left. Do you have a so-called friend that’s giving you a hard time? Maybe Hashem wants you to associate with other people. Have you lost your job? Maybe Hashem wants you to learn to appreciate what you have, and maybe Hashem has a better job in store for you? So without losing your job, you may have stagnated for years in the same place. We all have to open our eyes and observe how every single thing that happens to us in life is for our ultimate benefit. Once we start thanking Hashem, all stern judgments are totally mitigated, what the Zohar calls “sweetened at the source.”

First, we should devote half of our daily hitbodedut – 30 minutes a day – to asking Hashem to help us overcome the terrible trait of ingratitude, until we really feel the change within us and we start thanking Hashem for every single blessing in life, the good and the seemingly opposite.

Our expressions of gratitude to Hashem have the unequivocal power to convert harsh judgments into total compassion and loving-kindness. How can Rebbe Nachman say that there’s no bad in the world at all? Simple – since Hashem does everything for the best, then everything Hashem does is good, and we should thank Him for it! From the standpoint of emuna, complaining that something is bad is the worst form of heresy. No wonder crying and complaining cause calamity. A person’s notion of bad is when his desires are different than Hashem’s desires for him. As such, a person that encounters difficulties when he’s not doing what Hashem wants him to do is liable to think of a situation as bad. Let’s see a few examples: suppose you dream of landing a certain soulmate, but he or she rejects you. Now you become depressed and broken-hearted because you didn’t get your way. Instead of crying and complaining, you should be thanking Hashem, because that person was not your soulmate! He or she would have made a terrible partner for you in marriage. Let’s take another example: you’re devastated because you weren’t accepted into medical school. Maybe your soul correction is to be a teacher? Maybe Hashem wants you to be a spiritual leader, a doctor of souls instead of a doctor of bodies? So stop crying and thank Hashem – everything He’s doing is for your very best! People think that thanking Hashem for everything – for the good and the seemingly opposite – is some kind of Breslever nonsense. Sorry – it’s an absolute obligation mentiond in the Gemara and codified in Jewish law (see Shulchan Aruch, Orach Chaim 222:3).

So, what can we do to rectify the terrible trait of ingratitude, crying, and complaining? Two things:

Second, our sages say that whoever lacks gratitude to his fellow man will certainly lack gratitude to Hashem. Therefore, we should make a special effort to say thank you to anyone that does a favor for us, especially to our parents and our spouses. By the way, if you have a problem with marital strife, you can solve it in a minute: just buy a little pocket notebook and jot down all the favors that your spouse does for you every single day. 99% of shalom-bayit problems stem from ingratitude. Rebbe Natan said that nothing will help us until we learn to say “Thank you” to Hashem. If you lack something, whether it be a soulmate, a job, or children of your own, thank Hashem for an hour a day for your deficiency and you’ll see major miracles. Rebbe Nachman says that when humility spreads in the world, Moshiach will come. Gratitude is in effect humility, when a person expects nothing and appreciates everything Hashem gives him. On the other hand, ingratitude goes hand-in-hand with arrogance, when a person has a sense of entitlement and thinks he the whole world owes him; he’s then upset with Hashem when he doesn’t get what he wants. So, the more people thank Hashem, the sooner Moshiach will come! The more a person internalizes the principles of emuna, the more he or she will realize that everything is for the best. I urge everybody to walk around with a little notebook in their pocket, to pay attention to life’s miracles – both big and small – write them down, and thank Hashem for them every day during your personal prayer session. This little notepad will save your life. When you begin thanking Hashem for everything, then Hashem will give you many more reasons to thank Him. Not only will you see miracles, but solutions and salvations to the terrible problems and predicaments that you never dreamed of successfully overcoming.•

MOSHE'S LAST STAND

T

his week the most illustrious career in Biblical history begins its final chapters. Moshe is officially informed that he will pass on and is told who his successor would be. But in informing Moshe of the transition, Hashem repeats both here in the Book of Bamidbar (27:12) and again in the Book of Devorim (32:51) the reason that Moshe will not lead the B'nai Yisrael into the Land of Israel. It is because he hit the water producing rock instead of speaking to it. Why does Hashem seem to stress Moshe's sin? Rashi, the classic medieval commentator, explains that Moshe asked Hashem to publicly declare his sin in order to declare that this sin was his only flaw. He was afraid lest some would say that he, too, was amongst those who were destroyed for rebellion in the desert. He was afraid that he would be equated with the rebels and sinners. Thus, he asked Hashem to emphasize that the only flaw he committed was that of the rock. It is very difficult to understand. How could Moshe even suspect that anyone would place him on that level? How could one even imagine that he was excluded from entering Israel for an act of treason that led to the demise of others? Why was it so important to Moshe that the Torah reiterates that the incident at the rock was his only transgression? Radio commentator Paul Harvey once presented a piece of American history in the following manner: George Armstrong was appointed to the United States Military Academy in

1857. After graduating and commissioned in the cavalry, he quickly established a reputation for daring and brilliance in battle. His reputation was so well acclaimed that at the age of twenty-three, he was made the youngest brigadier general in United States history. George's energy and cunning paralleled the other great Georges who left their mark on military history -Generals George Washington and George S. Patton. In fact, George Armstrong was so successful, that by the end of the Civil War he became of the one of the most celebrated commanders. His pursuit of Lee's army from Richmond in April 1865 destroyed the confederate lines of defense and captured prisoners, wagons, and guns - until, on the morning of April 9 he had totally defeated the enemy. It was to no one other than General George Armstrong that the Confederate flag of defeat was first presented. After the Civil War, his career continued to flourish. He was assigned to the newly formed seventh Cavalry, Fort Riley, Kansas, and was promoted to the rank of Lieutenant Colonel. In the fall of 1868 he won a brilliant victory over Black Kettle's band of Cheyenne Indians in the battle of the Washita and took part in many successful engagements over the next eight years. But history has almost no recollection of the illustrious career of General George Armstrong. On June 22, 1876, General George Armstrong and his regiment, a force of about 655 men, set out for Little Bighorn. He encountered an overwhelming force of at least 4,000 well-

armed Sioux warriors and was killed together with his entire regiment. No longer were the Civil War successes the hallmark of General George Armstrong's career. Only remembered is the great defeat at Little Bighorn led by General George Armstrong - did I mention his last name -- Custer - General George Armstrong Custer at his last stand. People often tend to forget the illustrious careers of great people because of a flaw that ended it. Moshe was punished for an infraction that is difficult to comprehend in mortal terms. He hit a rock, and produced water -- one of history's greatest miracles -- for a thirsting nation. Yet something was wrong. He was supposed to speak to the rock and instead he hit it. And between him and his Creator, there was a price to pay. We however must realize that a mistake, as great as its consequences were, cannot mar the illustrious career of the man who led us out of Egypt and developed us into the nation that we are today. In no way can that punishment diminish any regard that we have for Moshe. At Moshe's departure, that point was to be reiterated repeatedly. It is only because of the rock that he did not enter. How often does a man who works tirelessly for years and who errs in his last stand, go down in disgrace for the act that terminated his career? How many people's last stand becomes their most notorious if not their only stand? Perhaps Hashem's reiteration vis-a-vis Moshe are a lesson to all of us. There are no first stands and there are no last stands. If we stand for something worthy, then we stand forever! •
