CHIEF EXECUTIVE’S COMMENT |

Growing future

champions

Working out where our economy is at right now is a question that continues to divide even the most experienced and prominent of economists. Undoubtedly the recent first estimate for Q2 GDP was not the news that many businesses wanted to hear. Yet for many, it remains difficult to reconcile the very positive recent labour market figures published by the Office for National Statistics with the continued declines reported in GDP. Increases in employment, and in the average numbers of hours worked, at a time when output is falling, suggest implausible falls in productivity. Questions remain about the accuracy of the figures which are, at best, confusing and at worst downright detrimental to the confidence that businesses so desperately need to thrive in today’s economy. Ultimately these confusingly disappointing GDP figures have been slightly revised up, but it is clear that Britain is in the midst of the most prolonged period of stagnation it has faced in decades. Investment in infrastructure and meaningful deregulation are just two priorities that continue to be laid firmly at the door of the government. Businesspeople continue to call on the country’s leaders to be bold, show leadership, and spearhead a long-term strategy for growth that will create a truly enterprise-friendly government. Meanwhile many more, perhaps those who are already disillusioned with the lack of progress being made by the government, are looking closer home to discover new means to stimulate growth within their medium-sized companies. Spearheaded by accomplished academic and entrepreneur Professor Roger Mumby-Croft of the Lord Ashcroft International Business School and Professor Walter Herriot OBE, a new business growth programme has been devised in response to research that identified specific barriers to growth within established businesses. The CBI’s report ‘Future champions – unlocking growth in the UK’s medium-sized businesses’ found that mid-market businesses were more occupied with minimising loss than going for growth, and that generating confidence and ambition, building skills and plugging the finance gap were essential to realise their potential. As a result, a dynamic new course for all business owners is being run by Professor Roger Mumby-Croft and Professor Walter Herriot OBE in partnership with Anglia Ruskin University to help stimulate the essential needed growth within medium-sized companies.

‘Growing Future Champions’ is a 10 month, interactive programme that is aimed at developing the skills of owner managers and managing directors to help them realise their company’s potential to grow. By stepping outside the day-to-day management of the company it is anticipated that delegates will develop a greater understanding and control of key business disciplines before creating their own growth plan, drawing on the support of specialist mentors. I whole-heartedly support this scheme which promises to really get to the bottom of some of the factors hindering growth. Most importantly it will equip experienced business leaders with comprehensive strategic insight and many of the skills that are needed to take their enterprises to the next level. Download info at www.tinyurl.com/growingfuturechampions or you can contact Roger Mumby-Croft personally on 07795 427982 or e-mail roger.mumby-croft@anglia.ac.uk It is a great example of businesses taking the lead in ensuring that they are in the best possible place to realise their potential. The rest, we will have to leave to the government.

Engineering your future Cambridge News has launched a new job site targeting technology minded individuals. The city, which is internationally renowned for its contributions to the technology industry, is a hotspot for talent. The site, sponsored by Cambridge Consultants, is already host to a great number of opportunities from top companies within the area. Patrick White, Project Manager for the site, said: “These types of role can take a long time to fill and we wanted to create somewhere that can help speed the process up. With the audience reach Cambridge News has, the site will have no problem achieving page views. But what we want are the right individuals

viewing it and that takes time and work. “With the top companies we have on there at the moment, and with Cambridge Consultants behind us, I do not think it will be long before it becomes the primary source for all local vacancies. “The direction and success of this site is completely determined by the quality of roles we have and the audience we have looking at it.” n

Exclusive business savings account launched The Cambridge Building Society launched its first business savings account for Chambers of Commerce members in September. This competitive business savings account is aimed at local SMEs. It is available to all Cambridgeshire Chambers of Commerce members and was also promoted to those local businesses that attended the B2B exhibition at Newmarket Races on 18 September. The Cambridge Building Society sponsored the recent business exhibition, and had a team of Society staff on hand to discuss the new account. With a minimum balance of £1,000 and a maximum balance of £1,000,000 the

account is ideal for business owners who want to open a business savings account but have struggled in the past because of higher balance requirements. The 30-day notice account allows better access for business owners and the account is tiered to ensure that business savers receive the most competitive interest rates. Sue Higginson, Corporate Manager at The Cambridge says: “As the only truly local building society in the area we can identify and understand the needs of local businesses and work with them in a way that best suits them.” n

Double nomination joy for Wine School Cambridgeshire Wine School has reached the finals for ‘Wine Educator of the Year 2012’. The school, which offers Wine Tasting events for both public and business, is part of a network of wine education centres operating from 13 locations around the country. They have been collectively nominated for ‘Wine Educator of the Year’ at the International Wine Challenge 2012. Head tutor Mark Anstead says the group faces stiff competition from wine suppliers

Bibendum and Majestic: “It’s been a great year for us - in May we were shortlisted by the prestigious Harpers Wine & Spirits magazine as being among the UK’s top three companies for Wine Education. “It’s great to be officially recognised and praised by the wine industry, but we are also getting good feedback from customers for our team building events, client entertainment and staff socials so we know we must be doing something right.” n

AWARDS October 2012 Chilford Hall winning streak Chilford Hall Vineyard has been awarded the prestigious East Anglian Wine of the Year 2012 award by six judges from the East Anglian Wine Growers Association, along with four other trophies and four medals. Corporate focus for therapy centre Cambridge Therapy Centre won first prize in Method’s social media competition, which included rebrand consultancy and professional design services. One major part of the strategic exercise was for the brand identity to better reflect the services for companies. Christine Schneider said: “I already provide a significant amount of corporate services by offering workplace counselling and mediation, taking part in EAP programmes and working closely with occupational health providers.

“Yet, I kept noticing that very often companies weren’t quite sure how to book these services for their employees. My intention was to make access to support services, workshops and training days much easier with set corporate packages, fixed fee personal therapy, CBT, and executive coaching. “I have also developed a series of open training and personal development days, the first of which will be a half day workshop on assertiveness skills.” Cambridge Therapy Centre’s new corporatefriendly brand image was unveiled at the Cambridge B2B exhibition in September. n

The De Vere University Arms Hotel, Cambridge, has been awarded a top nationwide customer service award. This accreditation, which covers the calendar year July 2011 – June 2012, was awarded by BDRC Continental and is based on a measure of customer service performance which acknowledges excellent service provided in the meetings and events market. “All of the team deserve this prestigious pat on the back,” said Paul Wilkes, General Manager at the hotel.

Chamber NEWS Chamber NEWS A round-up of news and events from across Cambridge

Support fund for SMEs in South Cambs South Cambs District Council has announced extra funding to provide a series of free practical workshops and business support. The Council’s support fund was set up two years ago to offer eligible businesses up to £1,000 towards the cost of training and other business support. Due to the success of the scheme they have committed

a further £20,000 so more companies can be protected and even help them grow to create more new jobs. To be eligible, businesses must be based in the district, qualify as an SME (small or medium sized enterprise) and be able to show that they have suffered financial hardship as a result of the recession. Eligible firms will be given a ‘health check’ and help to create an action plan. Grants will then be awarded to help businesses to source the specific support they need. On top of the funding available to support businesses, there will be a series of 16 workshops across the district to give practical advice on a range of topics that will help firms. The workshops will run until March.

Cllr Nick Wright, South Cambridgeshire District Council’s cabinet member for economic development, said: “The economic downturn has hit firms hard across the entire country and although this area has weathered the storm better than most we know our business community still needs extra specific support. Supporting the local economy so our local businesses can be successful is one of our top priorities and in all the work we do we are trying to take a very business friendly approach. We are very aware other organisations, such as Business Link, no longer offer services to support firms and local initiatives such as the practical workshops we are stepping in to launch should help fill the gap that has been left behind.” n

Wyboston Lakes launch annual golf tournament

We know that one size doesn’t fit all when it comes to finding the right staff.

Wyboston Lakes conference and leisure centre has announced that a recent corporate golf day will mark the start of a new annual Wyboston Lakes Corporate Challenge Trophy. More than 50 golfers from around the country took part in the recent tournament at the picturesque 18 hole course, located between Cambridge and Milton Keynes. The course is benefiting from a £30,000 investment made over recent years to enhance the quality of the greens. The event was won by a team from Coca Cola, with the Football Association achieving the runners-up position. A trophy was awarded to the winners, with prizes also being provided for nearest the pin – and for most balls in the nearby lakes! n

| CHAMBER POLICY UPDATE

Policy UPDATE Keeping you informed, representing local business

This month we make a pledge to face our digital demons as part of a Chamber initiative.

Speak Digital? Do you speak digital? If you’re under 35 the answer is probably yes; you’ve grown up digital. But if, like me, you are over 35 you are less likely to be aware of the potential that the digital world has to drive business growth. Worse than that, you may be fearful of using social media networks feeling they will take up too much time or worried your staff might say something inappropriate and land you in court or you may simply consider that the digital world is irrelevant to your business. However, many large and progressive businesses like Procter and Gamble, IBM and Nestlé understand the value of the digital world and are using social media to grow their business whilst many small and medium size businesses, particularly those with owner managers older than 35, are losing out because they don’t speak digital.

You may be fearful of using social media or consider the digital world irrelevant Therefore, over the next few months the Chamber will be working with partners from the Local Enterprise Partnership and Opportunity Peterborough to urge you to find out how speaking digital could help you to grow your business. You may recall in a previous article I referred to the Growth and Innovation Fund (GIF). GIF is government funding for the establishment of employer-led, innovative and sustainable projects that have the potential to drive economic growth. We believe that encouraging local businesses to speak digital is an ideal project for a GIF bid.

10

| CONNECTED OCTOBER 2012

To qualify for GIF funding, we have to develop a business case and this will include utilising Chamber networks to establish current confidence levels and demonstrate how speaking digital helps companies succeed. At the Riverboat Georgina event I talked to a number of Chamber members. One employee of a large construction company sends out informative blogs and tweets with the help of his colleagues. Kenny Davidson, of Fenland Solar, told me he owed the phenomenal growth of his business to his Facebook page. Of course, Kenny is a child of the digital age so he didn’t have the same learning curve as some of us. As the GIF project gets underway we’ll be looking for case studies to inspire and reassure others. We plan to hold various focus groups to identify the best ways of building confidence and raising awareness of the business benefits of speaking digital. If you’d like to be involved please get in touch: g.prangnell@cambscci.co.uk I look forward to hearing from you. n

| CHAMBER CHARITY OF THE YEAR

Your

Chamber Chops invitation ACT, the dedicated charity for Addenbrooke’s and the Rosie hospitals, invite you to take part in Chamber Chops this November to raise money for the Addenbrooke’s Robot Appeal, which is helping to save lives from prostate cancer. Chamber Chops takes its inspiration from the national fundraising appeal for prostate cancer, Movember, and invites men to raise funds by being sponsored for growing a moustache for the month of November. By taking part in Chamber Chops for the Addenbrooke’s Robot Appeal, your fundraising will directly benefit prostate cancer patients in your local area as well as supporting world-class research into the disease undertaken in Cambridge. Cambridgeshire Chambers of Commerce Chief Executive, John Bridge, was treated for prostate cancer at Addenbrooke’s and benefited from state-of-the-art robotic surgery available at the hospital. John said: “The Robot Appeal really is a wonderful cause. It is so important to have this technology available for patients in Cambridgeshire and the wider region. As a former prostate cancer patient, it made all the difference to my care and minimised the impact on my family. The operation was straightforward and my recovery time was very quick – I was working again the next week much to the amazement (and frustration!) of my Chamber team and flying to Spain after four weeks. I am delighted that the Cambridgeshire Chambers of Commerce can support this appeal. “I encourage you to take part in Chamber Chops – a very easy way to raise funds to say thank you and to help benefit future patients like myself. I will be wearing my moustache with pride.” n

HOW TO TAKE PART • Encourage all men in your organisation to stop shaving from 1 November 2012 • Set up a team or individual JustGiving page at www.justgiving.com/act and write in the text on your page that you are taking part in Chamber Chops and raising funds for the Addenbrooke’s Robot Appeal • Post pictures of your moustaches on Facebook and Twitter or email them to act@addenbrookes.nhs.uk and encourage family, friends and clients to sponsor you • Keep us informed about your progress and final fundraising total – with photos please!

LADIES! don’t forget to support the men in your life by sponsoring their moustaches – you could even take part in fundraising yourselves, why not get sponsored for wearing a joke moustache for a day?

We look forward to seeing your results!”

Andrew explained that it pays to be clear with the TV production companies from the start to maximise returns: “Rules have tightened up in terms of blatant plugs and logo inclusions and not all TV production companies are clear about what’s on offer. “We negotiate links on the programme’s websites in terms of PR and for our acts the rates paid by the BBC are still very good. Work in motion IT’S said a picture is worth a thousand words. Statistically however, according to Dr James McQuiver of American company Forrester Research, a minute of video is worth 1.8 million words. Video is a tool you need to get working for your company and it’s not expensive. A short simple good quality video can be put together for as little as the cost of the top of the range iPad. The secret of producing a good video is preparation and planning, know what you want to say and how you want to say it. Know what you want to show and how you want to show it. Plan your ideas in advance and on the day you will save your time and money. It will be easier to film and easier to edit. A video on your website can increase your rankings on search engines by over 50 times. Ashley Law has adopted the foundation as its charity of the year to mark the 25th anniversary of practice principal Joe Jennings. For every new investment or

pension arranged by them during 2012, Ashley Law will donate £25 to the local branch of the BHF. Joe handed over an interim donation of £500, accepted by outgoing branch chairman Brian Crack. “We’ve had support from clients, friends and the wider business community with pledges of almost £1,000, an amazing response in today’s difficult economic conditions,” said Joe. Andy Brooks Chartered Financial Planner at Ashley Law and fund raising committee member for the BHF commented: “We had an exceptional day and the money raised was very pleasing.” n

Interactive careers fair Peterborough Skills Service worked with the Voyager Academy in Walton to facilitate an all day careers fair for their 250 Year 10 students on Tuesday 10 July. A diverse range of over 25 local employers and work-based training providers took part, including Coca Cola, Kier Construction and the College of Animal Welfare. Members of Peterborough’s Youth Council also attended to give an inspiring motivational talk. This was a careers fair with a difference – employers and education providers each prepared an interactive activity or resource to encourage student engagement. Sadie Gray, Careers Lead at the Voyager Academy, said: “We are keen to extend our students’ careers knowledge and to develop their work related skills by challenging them to work with employers and training providers. “The careers fair was such a valuable opportunity for students and it was encouraging to see so many of our Year 10 grow in confidence and ambition as they engaged with exhibitors.” n

Larkfleet Homes wins national accolade

Larkfleet Managing Director Karl Hick (centre) and his wife Helen Hick collect the HAPPI Award

Stanza Consulting design new £1.2m development Stanza Consulting has completed structural engineering design services for a new £1.2million development in Peterborough. Heltwate Court in Bretton comprises 13 houses, 26 apartments and a retail unit after a block of flats was demolished at the site. Bruce Edward, Managing Director of Stanza Consulting, said: “This was a great project to be involved with but was not without its challenges. The ground conditions and the presence of mature trees led to a sub-structure solution adopting piled foundations supporting a cast-in-situ reinforced concrete ground slab.” n

The Croft, an age-exclusive retirement development by Larkfleet Homes and Keystone Developments, has won a national housing award. The development, located in Bourne, won a HAPPI (Housing our Aging Population Panel for Innovation) Award at the national Housing Design Awards. The HAPPI award celebrates the innovative approach to the design of older people’s housing with a specific focus on the users’ living experience. The judges believed the development met the government’s objectives in helping the older population live a longer and happier life. By attracting the older generation to new exclusive retirement developments such as The Croft, the current housing crisis is also helped as larger houses are made available for growing families.

We have worked hard to provide an outstanding environment for retirement living Larkfleet’s Managing Director Karl Hick was present at the awards ceremony to collect the winners’ certificate. He said: “Larkfleet and Keystone have worked hard to ensure that The Croft provides an outstanding environment for retirement living. It is the perfect place to live for people who prefer enjoying life rather than having the worries associated with managing a home." n

‘The Apprentice’ The Lilac James Co. has launched a search for ‘the apprentice’. This is an opportunity for a young person to compete for an apprentice position within the rapidly expanding St Neots based marketing company. Karen James, Director, explains the concept and outlines how aspiring young marketers can apply for the position; “I am a great believer in training within the workplace, no amount of academic qualifications can guarantee that a young person will have the creativity, drive and dedication to achieve within a professional business environment. This has been proven by Alan Sugar on the reality TV show – The Apprentice. “The apprentice route provides a viable and cost effective alternative to university and I hope this individual will become a long-term member of our team. We are asking applicants to apply by submitting a marketing plan for another St Neots Company, BrightVisions. The application process is an opportunity for a young person to demonstrate their natural and creative approach to marketing. Successful applicants will be asked to come in and informally present their marketing proposal to the Lilac team.” The successful candidate will be awarded an Advanced Level Apprenticeship and will study both within the business and via Cambridge Regional College for a Marketing qualification. | SECTOR FOCUS SOCIAL ENTERPRISE AND CHARITY

Get involved! Top tips for SMEs to get involved in supporting charities Beth Walthew is the Marketing Director at Prospect Research, a B2B telemarketing company based in Cambridge, and believes that all companies have a part to play in supporting charities. Prospect Research don’t raise thousands and thousands for charity. Far from it. In four years, we have raised £6,500 for East Anglia’s Children’s Hospices. Many more companies would have raised much more than us, but that’s not the point. We’ve been able to donate something towards the hard work of an amazing charity, had a great time fundraising, and it’s brought us together as a team to have some fun. Here are our five top tips for SMEs who want to get involved with raising money for charities:

1

Get your team’s feedback about who you should support. Come up with a shortlist and get a couple to come in and talk about the work they do. Then your team can choose who they want to support. This will get their buy-in when they come to asking others for donations, and give a purpose to your charity work.

4

Utilise the PR opportunities. This is a somewhat un-talked about part of CSR. How uncouth to speak about PR when you’re raising money for a good cause. But charities know that this is a part of a company’s involvement and they are more than happy to provide quotes for you to include in press releases.

5

Have fun! Choose events that your team enjoy. CSR is a great way to achieve something together as a team. n

2

Be realistic about what you can achieve each year. If you only have the resources to support/organise one event a year, just do that. Don’t stretch yourself. Put everything into that one event.

3

Get all of the team involved. Divvy up jobs. Ensure that everyone’s on task at the event to network and provide event support.

COMMUNICATIONS

Communications Sector launches

Georgette Louis, HR and Recruitment Sector

Preparing to engage your workforce 1. Be clear about responsibilities: Give employees more than just a list of objectives. Provide them with an understanding of how their work makes the organisation function and succeed. People need to know exactly how they can improve their performance in order to have an impact on that of the organisation. 2. Give good feedback: Don’t use appraisals as opportunities to unload your frustrations about the employee’s work habits. Instead, use them as a chance to demonstrate a real interest in how the employee can improve. This positive approach makes all the difference in how the employee experiences the appraisal and their subsequent performance. 3. Care... really care: Show that you’re genuinely concerned about employees’ opinions. People respond to management’s ‘willingness to listen’ and they do so on an emotional level which is where all real effort and productivity springs from. Remember: distant leaders have distant employees. 4. Paint the big picture: Make sure the employee understands how the unit they work in contributes to the overall success of the organisation. Expand their awareness beyond their own performance and extend it out into their team.

Cambridgeshire Chambers of Commerce is launching a new Sector group following a decision to embrace a new direction in strategic marketing. The Communications Sector will provide a regular forum for members to share ideas and lead on best practice guidelines and will be particularly relevant for those who are responsible for communicating from a sales or marketing perspective.

The world has changed and people no longer want to be sold to. Deeper engagment requires a new approach Communication is a defining element in any marketing activity, whether it’s in person, print or using the more up to date methods of social media to keep in touch with existing clients or to approach new prospects. The Sector group will have a column in the members’ magazine CONNECTED and a page on the Chamber website. The group will be chaired by Method Creative founder and

basis, be kept informed of information and events. If you’re interested in contributing to the new Sector, please register your interest with Helen Bosett, Sector Co-ordinator, h.bosett@cambscci.co.uk n

What’s HOT

in communication At a glance guide to the future of effective engagement activities:

Content marketing Value on credibility

5. Firm it up: When times are tough, employee perception of ‘woolly’ talk about vision, mission and values breeds cynicism. Firm up how you communicate your organisation’s ideals and aspirations. Give employees substance, not ‘feel good’ waffle. 6. Power to the employee! By the end of this process your employees should have a better picture of their role in the organisation, a feeling that they can talk to their managers and the reassurance that they will be listened to. This creates self-aware and self-motivated employees, who not only know what they’re doing, but why they’re doing it. That’s engagement. n

Caroline Robinson runs Sandler Training in Cambridge, a business development and management training business. She provides world-class personal and professional development training to help businesses across East Anglia grow and be more successful. Caroline’s clients are business owners/MDs that have good businesses but are frustrated by certain business development challenges that are slowing their revenue growth and making it harder to take the business forward. Some of their common challenges are: • Can’t get in front of enough of the right prospects • Prospecting not working – hate cold calling/networking • Worried about hiring/managing a sales person, can’t afford it not to work • Want to avoid being seen as a ‘typical sales person’, but still be effective • Fed up with prospects focusing on price, rather than value • Frustrated that you have to give away a lot of free knowledge without getting the business.

www.thebpgroup.co.uk The Business Performance Group (the BP Group) is a business services provider, focusing specifically on winning new business and growing margin for their clients and ultimately to make more profit. The company was founded in 2008 by MD Luke Chapman after he spent over 15 years in senior sales roles and was frustrated by his employer’s lack of investment in business development. “Whilst we offer on site business reviews, strategic planning and longer term partnerships to execute these plans, our core business is hands-on business creation. We are proud to have won ‘Entrepreneur of the Year Award’ in October 2010 at an event in London which recognised the innovative approach we take.” The BP Group does this through a number of different programmes: • Telemarketing and Research. • Data Sourcing • Marketing All of the programmes are designed to supplement a customer’s existing set-up, allowing them to outsource time-consuming projects or activities.

Trailblazers www.trailblazersmentoring.org.uk Trailblazers is a mentoring charity that works with young offenders in five Youth Offending Institutes including HMPYOI Littlehey near Huntingdon. Many young offenders have lacked a positive role model and this can be a key to them reoffending. We have two projects at Littlehey: 1:1 Mentoring Trained volunteers deliver a structured mentoring programme to young offenders during the last six-eight months of their sentence. Therapeutic Garden Mentoring The benefits of therapeutic gardening are well documented: improved concentration, emotional wellbeing and valuable team work. Contact with trained mentors helps reduce young offenders’ feelings of isolation and exclusion, whilst learning new skills leads to improved chances of employment on release. Currently volunteers are working with young offenders to design a show garden which can be used for therapeutic mentoring sessions.

Ask the expert... Have you got a query about export? Margaret Chadwick answers your questions.

Q

We were planning on exporting a consignment by sea freight and we already have the Letter of Credit in place. Now our customer is asking us to urgently airfreight part of the consignment, can we just proceed? Our customer has assured us that he will accept the documents?

A

Our advice would be to ensure that the Letter of Credit is amended to allow you to present documents to the bank that you consider to be fully compliant. If your L/c only permits sea freight, then presenting documents showing that the goods have been sent by air would cause the presentation to be discrepant. You only

have your buyer’s word that he will accept the discrepant documents because you have lost the security guarantee of L/c payment where documents are not compliant. In addition there will be higher bank charges as you will be charged a discrepancy fee and it is likely that the funds may be delayed.

Q

We have to despatch a quantity of credit cards to our distributor in UAE, how would we find out the commodity code to use?

A

There are a variety of ways you can research a commodity code. If you subscribe to the Integrated Tariff of

How can I fly personal effects? This is often perceived as a minefield, as the airlines offer hugely expensive excess baggage charges and there is a genuine need for a dedicated and economic specialist service. Now goods from the UK can be shipped with both door to door and airport to airport services and will incorporate every airline servicing the UK. The service will handle small luggage to oversize boxes and from general household goods to pets. Cargo can be shipped on the same flight as the passenger or sender, or held at a London Heathrow warehouse to be sent to arrive on specific dates. All documentation and customs clearance can be handled in house. For further information visit GOfers Logistics at www.goferslogistics.com n

Tribunal reforms ‘good news for employers’ Proposed reforms to the Employment Tribunal system are good news for local employers according to Peterborough-based Roythornes Solicitors. The news comes as former president of the Employment Appeal Tribunal, Mr Justice Underhill, published his report on the tribunal process. Amongst his recommendations for streamlining the system is a ’sifting’ stage, where employment judges would look at cases and strike out any which had no reasonable prospect of success. Speaking about the measure, Phil Cookson of Roythornes said: “If implemented, this will be good news for employers. There are cases where ex-employees will take a case

to a tribunal which has no real chance of success. Tribunals are expensive to defend and employers sometimes have no option but to spend time and money even if it is a ‘nuisance’ claim. No one wants to remove the rights of employees to seek justice through the tribunal system, but a rule to remove the threat of this type of claim would be very good news.” The proposals will be put out to wider consultation later in the year. n

Cambs jobs outlook looking positive A recent survey by the Recruitment and Employment Confederation (REC) and KPMG has indicated that prospects for jobseekers are looking bleak, with a decrease in permanent and temporary job vacancies across the UK and ‘a high degree of uncertainty’ from employers. Cambridgeshire based LabourTech Recruitment Ltd disagrees and reports that in the region the situation is less pessimistic than the national picture with a 20 per cent rise on permanent vacancies since January and approx 30 per cent increase in temporary work. “We’re experiencing a rise in skilled jobs in the hi-tech sectors and unskilled short term contracts in manufacturing,” says Ian Bisset, Head of Recruitment. n

Immigration Status Kurumuth v NHS Trust North Middlesex University Hospital The Employment Appeal Tribunal held in Kurumuth (Mrs K) v NHS Trust that it is reasonable for an employer to dismiss an employee if unable to confirm the employee’s legal right to work in the UK, provided a fair dismissal procedure is followed. Mrs K entered the UK on a valid work permit. Following a refusal of her application to extend her stay, she lodged an appeal. This protected her entitlement to work in the UK during or until the appeal was determined [confirmed in writing by the Home Office]. It was never determined and 11 years later Mrs K’s employer contacted the UK Border Agency seeking confirmation of her immigration status. The Trust’s decision to confirm her status followed the introduction of the points based system. It was no longer happy to rely on the letter from the Home Office as proof she had leave to remain in the

UK. The UK Border Agency was unable to provide definitive confirmation. Mrs K was suspended and subsequently dismissed. The Trust believed she didn’t have the right to work in the UK and she conceded this belief was genuine. The Employment Tribunal found the dismissal unfair but for procedural reasons. On appeal, Mrs K argued the Tribunal should have decided her immigration status. If it had done so, the only conclusion would be that she was permitted to work in the UK, thus her dismissal must have been unfair. It would have given her an argument for re-instatement. The EAT agreed that Mrs K appeared to have the right to work in the UK but said this is not a matter for Employment Tribunals and is a decision for the Immigration and Asylum Tribunal. The EAT held that it was not for the Tribunal to determine an employee’s immigration

status and Mrs K’s employer had shown a fair reason for dismissal. The EAT also stressed that an employer must take all reasonable steps to investigate the truth of the situation and the level of investigation. Each investigation would depend on the circumstances but in any event the EAT considered that the Trust had satisfied this requirement. This is of course good news for employers, but caution should still be exercised in circumstances such as these as they are likely to turn on the individual facts. For example, how much enquiry did the employer make before dismissal and did they give the employee every opportunity to show its belief was wrong? What is also important to remember is that even in such circumstances procedures must still be followed. Source: Andrew Southwell, The AP Partnership Ltd
