DiIorio Brothers Create Thriving Business From Humble Beginnings From storing tools and materials in the trunk of a Chevy Impala to multi-million dollar projects, Vincenzo and Giuseppe DiIorio have proved themselves in the construction industry. The brothers arrived in New England in 1968 from Ischia, Italy, with hopes of starting a construction business. A year later in 1969, they had built enough of a local reputation to found DiIorio Brothers Contracting. After 45 years in business they have continued to thrive. MassDOT Approves $197 Million Project

The Massachusetts Department of Transportation’s (MassDOT) board of directors voted to move forward with the final of five Mega Projects within the Patrick Administration’s Accelerated Bridge Program (ABP), a $197 million interchange improvement project in Fall River that increases connectivity, improves safety and removes an elevated structure that has been long seen as a barrier to waterfront development. “After years of neglect, the Accelerated Bridge Program has allowed us to dramatically improve our bridge infrastructure and stimulate economic growth all over Massachusetts,” said Gov. Deval Patrick. “The Accelerated Bridge Program is a key part of our growth strategy that is
creating jobs today while leaving a stronger Commonwealth for the next generation.” The Fall River Interchange Improvement Project is one of five Mega Projects in ABP which account for approximately one-third of the total $3 billion ABP investment in the Commonwealth’s bridges. “This project will be transformative for the city of Fall River,” said MassDOT Secretary and CEO Richard A. Davey. “Fall River will see an infusion of 300 jobs associated with this project and be in a position to capitalize on new economic development thanks to these infrastructure improvements.” see MASSDOT page 4

One day you are doing excavating, another day you are doing masonry,” said Vincenzo. “Sometimes, you have 100 yards of concrete, another day it is 1,000 yards of concrete. It is the same thing with asphalt, when you are doing commercial parking lots. They go anywhere from 400 tons of asphalt to 10,000 tons. The five Mega Projects are: • Burns Bridge Replacement $89 million, • Fall River Interchange Improvement Project $197 million, • Fore River Bridge Replacement $245 million, • Longfellow Bridge Rehabilitation $255 million, and • Whittier Bridge Replacement $292 million. Both the Burns Bridge and Fore River projects are currently under construction. Construction is scheduled to ramp up in July on the Longfellow and Whittier Bridges. In Fall River, Milliken Boulevard is currently under construction to better accommodate traffic during this interchange improvement project. The remaining structural repairs and the painting to the Braga Bridge are included in the $197 million project. “The MassDOT Highway Division is pleased to have contractor Barletta Heavy and its partner O&G onboard,” said Highway Administrator Frank DePaola. “Barletta has a long history of delivering quality projects for the Commonwealth and presented us with a superior technical proposal on this project.” The ABP program is using innovative and accelerated project development and construction techniques. As a result, projects are completed on-time, on-budget and with minimum disruption to people and to commerce. Since 2008, the number of structurally deficient bridges has dropped from 543 to 436, a decline of 19.7 percent. As of January 1, 2013 the ABP Program has completed 121 bridge projects, with another 48 bridge projects currently in construction and an additional 20 bridge projects scheduled to start construction within the next year. Over the course of the eight year program, well over 200 bridges are planned to be replaced or repaired. Connecticut Supreme Court Ruling Bolsters ASA’s Position On June 11, 2013, the Connecticut Supreme Court officially released a ruling confirming that Commercial General Liability insurance policies do insure property damage that unintentionally results from defective work. The decision supports the American Subcontractors Association’s position that insurance companies must deliver what they promise in their CGL policies. “Insurance policies … are designed to cover foreseeable risk, including negligent acts,” the Connecticut Supreme Court wrote in Capstone Building Corp. and Capstone Dev. Corp. v. American Motorists’ Insurance Companies. “For the same reason, the mere fact that defective work is in some sense volitional does not preclude it from coverage under the terms of the policy.” In the case, the contractor, Capstone Building, entered into a construction contract with the University of Connecticut for work, coordinated and supervised by Capstone Development. Under the prime contract, the university was required to purchase CGL insurance for itself, the insured contractor and “subcontractors of all tiers.” The university obtained an owner-controlled insurance program policy underwritten by American Motorists. The project was completed in 2001, but in 2004, the university discovered construction defects that caused damage and filed a claim against the contractor. The contractor tendered the claim to American Motorists, which denied the claim, and the contractor sued, asking a court to declare that the CGL policy in question provided a defense and indemnity to the contractor. In an amicus brief, filed on May 2, 2012, ASA argued that, under Connecticut law, the CGL policy provided on the construction project covered property damage to nondefective work, despite the insurer’s denial of coverage. “Insurance plays a critical role for the members of ASA in managing the serious risks inherent in the construction industry, and those members have a significant interest in being able to rely on their insurers to provide coverage for risks for which they paid substantial premiums,” ASA wrote. Further supporting ASA’s position, the Connecticut Supreme Court quoted in its decision a 2007 case, Lamar Homes Inc. v.
Mid-Continent Casualty Co., in which ASA also filed an amicus brief in support of coverage: ‘‘[A] deliberate act, performed negligently, is an accident if the effect is not the intended or expected result; that is, the result would have been different had the deliberate act been performed correctly. ... Accordingly, because negligent work is unintentional from the point of view of the insured, we

find that it may constitute the basis for an ‘accident’ or ‘occurrence’ under the plain terms of the commercial general liability policy.” The Connecticut Supreme Court decision follows the growing national trend that construction defect claims resulting in unintended property damage are a covered CGL policy occurrence. The state Supreme Court added that CGL policies do not insure claims to repair or remove the faulty workmanship itself. “If a subcontractor’s defective work unintentionally damages non-defective property, the damage can be insured by CGL policies through an exception to the ‘your work’ exclusion, though the ‘your work’ exclusion prohibits coverage of damages arising from the insured contractor’s own defective work,” explained Eric Travers of ASAmember law firm and ASA general counsel, Kegler, Brown, Hill and Ritter, Columbus, Ohio. ASA’s Subcontractors Legal Defense Fund paid the fees associated with the filing. MassDOT Begins Road Design Work for I-91 Alternative The Massachusetts Department of Transportation (MassDOT) is beginning the roadway design work on one of the alternatives that was under review as part of the I-91 Interchange 19 Study in Northampton, Mass. The alternative, referred to as Alternative 13A, includes a roundabout at the I-91 northbound exit ramp / Damon Road / Route 9 intersection. It also includes improvements at the I-91 southbound entrance intersection. These improvements include ramp widening, signal modifications and adding an additional left turn lane on Route 9 onto I-91 southbound. On Route 9, the additional left turn lane will extend under the I-91 overpass bridge, and the sidewalk on the north side of the roadway will be relocated behind the piers. Opportunities for additional traffic calming also will be considered for inclusion in the final design. The study, which began in 2009, set out to find ways to improve mobility in the I-91 Exit 19 area. The entire project includes traffic analysis, roadway design, environmental analysis, and a significant effort to seek community input. There have been more than 11 meetings with a Project Advisory Committee (PAC) and two public meetings since the inception of the project. The PAC, composed of neighborhood, city, and regional representatives has been instrumental in guiding the project and offering input on the various alternatives that were being considered. The PAC encouraged additional work in the design development to address bicycle and pedestrian accommodation. A majority of PAC members have voiced their support of Alternative 13A. When the study began in 2009, there were 12 alternatives under consideration, including alternatives for a full interchange at Exit 19 as recommended in the 2004 Connecticut River Crossing Transportation Study. The Connecticut River Crossing Transportation Study was initiated by MassDOT (formerly MassHighway) to develop a more comprehensive program of regional solutions to transportation congestion and safety problems in the area. After bringing all options to the PAC and public and conducting a traffic and environmental analysis, the study team narrowed the options to six alternatives — a No Build Alternative, four build alternatives, and one Transportation Demand Management (TDM) package alternative. The TDM alternative was intended to reduce congestion by reducing vehicular traffic volume. Elements of the TDM alternative included more frequent bus services, improved connection to the Norwottuck Rail Trail, Transit Signal Priority, and discounted bus fares through an employer based system. After more thorough review, Alternative 13A was identified as providing maximum benefits with the most cost-efficient, practical, and widely-supported approach. While Alternative 13A was identified as the preferred approach, there are elements of the TDM alternative that were noted as beneficial. Some of these elements are currently under various states of implementation while others will be incorporated into Alternative 13A.
