OSHA Violations On the Rise This Year Fall Protection Continues to Top Agency’s Most-Cited List For 13 years running now, fall protection has hamstrung contractors and their safety directors. During that time, it has become OSHA’s most frequently cited infraction. It remains the most cited this year. During the National Safety Council’s (NSC) Safety Congress and Expo held this fall, OSHA’s Eric Harbin gave preliminary stats on the top 10 most cited standards. Threefold Services LLC Celebrates 10 Years of Success This year marks Threefold Services LLC’s 10th anniversary. And while Rob Beauchamp and his son, Ty, continue to maintain the roots on which they formed the business, they also have made a major change in the last few years. “We got tired of the rat race of bidding hundreds of jobs to only end up with one, so we decided to shift to mainly doing our own projects,” explained Rob. “We had the opportunity to buy some property and develop it. That went well, so we continued down that road. I’d say that makes up about 75 percent of our workload now.” Between the two of them, the Beauchamp’s have plenty of experience in land development. Rob has been in the earthmoving industry for more than 30 years and previously owned multiple excavation businesses. Ty grew up in the industry, helping his dad and running equipment whenever he could. After Ty graduated from college with an emphasis on business management, he teamed up with his father to form Threefold Services. “We were both on projects all the time, but as our emphasis shifted, now I’m working more toward taking care of the field and Dad is taking more time to find new pieces of land for us to acquire and develop or focusing on putting together the quotes and bids that we still want to go after,” Ty said.

Loyal to KSM, Komatsu For many years, the Beauchamp’s primarily rented equipment because Threefold Services’ projects varied so much in size and location. Now that they are doing more of their own work locally, Rob and Ty decided that buying machines would be a good move. Whether purchasing or renting, they work with Kirby-Smith Machinery Inc. (KSM) Rental Territory Manager Jacky Miller and KSM Territory Manager Keelan Crosby. “Jacky helped us pick and choose the size of equipment we needed for each job, so that made renting advantageous for us,” said Rob. “Once we got to the point where we were doing so much more of our own stuff and using the same Rob (L) and Ty Beauchamp own and operate Threefold equipment over and over, it made sense to purchase.” Threefold Services’ first Komatsu purchase was a Services, which offers a variety of earthwork services to customers and does its own land development. Wirtgen Introduces New WRC 240(i) Rock Crusher The Wirtgen WRC 240(i) breaks coarse rocks in-situ, as found in hand-packed pavement layers (e.g. Telford bases) or stony soils, and produces a homogeneous mix in a continuous process. The working width of 91 in. and a working depth of up to 20 in. enables an output of up to 600 tons per hour. The market launch of the rock crusher will take place in November 2023. Sustainable Processing of Stony Ground The WRC 240(i) expands the portfolio of wheeled soil stabilizers designed especially for the processing of stony ground. In addition to the crushing of rocks and stones with an edge length of up to 11.8 in. and a compressive strength of up to 200 MPa, the machine can add cement and water in the same pass, for instance in the preparation of base layers. Here, the cement is prespread with a binding agent spreader and the water required is sprayed into the mixing chamber of the rock crusher via the machine’s Varioinjection bar. The machine also can be used for soil stabilization. For this application, the prespread binding agents such as lime or cement are mixed into the existing soil with insufficient bearing capacity, transform it in-situ into a high-grade construction material, and deposit it evenly behind the machine. The main task of the WRC is the granulation and mixing of a variety of soils, courses and layers to produce a homogeneous final product in a continuous process. As opposed to the removal and replacement of material, the processes here are characterized by shorter construction times, conservation of resources and lower CO2 emissions. These guarantee a longer service life and increase the overall stability of the housing. The entire mixing chamber is lined with these extremely hard-wearing plates, which can be individually replaced if and when required.

Digital Assistance Systems Improve Process Quality By enabling precise, automatic steering, the satellite-based AutoTrac system helps the WRC to achieve greater process efficiency and, as a result of this, a high degree of environmental compatibility. It steers the machine accurately within tolerances of a few centimeters on the basis of a previously calculated reference strip and a specified overlap of adjacent strips, thus enabling consistent utilization of the machine’s ideal working width. Construction Adds 2,000 Jobs in Nov., Up 200K From 2022 The construction industry added 2,000 jobs on net in November, according to an Associated Builders and Contractors analysis of data released by the U.S. Bureau of Labor Statistics. On a year-over-year basis, industry employment has increased by 200,000 jobs, an increase of 2.6 percent. Nonresidential construction employment increased by 1,400 positions on net in November, with growth concentrated in one subcategory. Heavy and civil engineering added 3,300 positions, while nonresidential building and nonresidential specialty trade lost 1,100 and 800 jobs, respectively. The construction unemployment rate rose to 4.8 percent in November. Unemployment across all industries decreased from 3.9 percent in October to 3.7 percent in November. “U.S. employers once again added jobs at a faster pace than expected in November,” said ABC Chief Economist Anirban Basu. “While construction added only 2,000 jobs for the month, the industry has added jobs at a significantly faster pace than the broader economy over the past year. That’s especially true for the nonresidential sector, in which employment has increased by an impressive 3.2 percent over the past year. Peterson-Chase Replacing 200 Slabs of Concrete On I-5 SURFACE from page 1

quickly make repairs to road surfaces where they are specifically needed, minimizing costs and delays, according to Allison Colburn, a Caltrans District 7 public information officer of Los Angeles and Ventura counties. The project will replace broken concrete slabs and pave the surface with asphalt concrete, providing motorists with a smoother ride. It will impede roadway deterioration and improve the ride quality for motorists traveling on I-5. “It also benefits those who walk and bike, with upgrades to pedestrian signals and curb ramps,” she said. “Additionally, freshly painted highway dividing lines, highway sign replacement, median barrier upgrades and bridge rehabilitation work on the overpass at Garfield Avenue will provide motorists with greater visibility and increased safety.” Anticipated to be completed in early 2025, the project is funded with $25.7 million from the federal Infrastructure Investment and Jobs Act (IIJA) and more than $2.4 million from Senate Bill (SB) 1, the Road Repair and Accountability Act of 2017. The work zone covers 6.5 mi. between the I-605 interchange and Atlantic Boulevard. The work includes preventative maintenance and minor rehabilitation of 38 lane mi. of the interstate and treating the roadway with an asphalt concrete overlay to help preserve its surface. Caltrans Director Tony Tavares stressed the importance of the work. “Investment from our state and federal partners allows Caltrans to continue prioritizing projects that improve the safety and long-term reliability of the state’s roadways,” he said. “Once this project is completed, thousands of people who commute to downtown Los Angeles every day will benefit from a smoother, safer ride.” “The I-5 corridor is an essential economic fixture in Southern California,” said Caltrans District 7 Director Gloria Roberts. “As this particular stretch of I-5 sees more than 200,000 vehicles on a daily basis, the improvements made here will help keep the region moving for many years to come.” Approximately 200 slabs will be replaced for the project, which was designed by Caltrans. “We started in November 2023 with sawcutting and slab

replacement,” said Dick Vogels, a Peterson-Chase vice president. “Slab replacement will continue through March 2024, barring any unanticipated delays. Then we will move on to drainage and median barrier replacement through June 2024 — and finally — we’ll work on the HMA asphalt overlay of the freeway from about June 2024 through December 2024. Winter weather may slow down the slab replacement work if it gets too cold - below 50 degrees Fahrenheit. “Slab replacement work is all on weekends, so the major holidays in November and December had an impact, he added. “We have also had low temperature issues. As things warm up in March and April, the work will accelerate.” Asked how the company is maximizing night work operations, Vogels replied, “We prioritize clear communication with the traffic control crews and our foreman to ensure that the work starts as soon as the lanes are closed and that the last cones are picked up by the closure time deadline, each and every night.” Work space is not an issue for crews, nor are there any soil, water and utility issues. “Caltrans has been very responsive and cooperative to RFI’s and resolving day-to-day issues that normally arise,” said Vogels. “We established a formal partnering program,

and we also have established a Disputes Resolution Board.” “The plan is to remove/replace a variable number of slabs per shift and ensure slabs are cured to achieve the opening age strength for traffic. The challenge is always to pick the lanes up on time,” Vogels added. The slabs being replaced are sawcut, removed by backhoes and taken to a dump site. “[We fill] up the removed area with Rapid Strength Concrete capable of achieving cure time within two hours of being placed by volumetric mobile mixer trucks,” said Vogels. “We have a staging area for cement and aggregates near the job site. The old concrete pavement is recycled into base material.” Peterson-Chase is subcontracting the work for the asphalt, pedestrian signals, curb ramps, painting of the dividing lines and sign replacement. The major subcontractors are Calmex Engineering (asphalt); Cal Stripe (striping); and G&G Electric (signals, lighting and metering). The amounts of materials to be excavated and demolished and new materials to be brought in have not been finalized. Peterson-Chase purchases and rents equipment from regional and local dealerships. “This type of project is fairly common at Caltrans District 7, as we maintain several major interstates within Los Angeles county alone,” said Colburn. “Designing this project was a straightforward process and we didn’t run into any significant challenges. The lifespan for the new AC pavement is seven to 10 years and the other improvements 10 to 15 years.” Night work is crucial to a quick delivery. During construction, there are nighttime lane closures within the project limits as well as minimal full freeway closures between the hours of midnight and 4 a.m, along with closures of I-5 ramps and connectors. “Occasional daytime ramp and connector closures may occur between the hours of 9 a.m. and 3 p.m. on weekdays,” stated a Caltrans press release. “No two consecutive ramps will close at the same time.” Caltrans is utilizing social media to keep motorists up-dodate on closures and construction activities. Biz Builds Success Via Unique Purpose-Built Attachments A & D Equipment is often referred to by its customers as “the real deal,” “top notch” and “a true customer’s dealer.” That’s because the company sets out to learn just what its customers need. “We have a great offering of unique purpose-built attachments, but what really sets A & D Equipment apart from its competition is its heritage,” said Donna LaFata, president of the company. “My husband, Anthony, and I are second-generation excavating contractors. His dad was an Italian immigrant who started the company from very humble beginnings, who ultimately turned his thriving excavation business [today known as LaFata & Son Excavation Inc.] over to my husband, and it was taken to the next level. “Every product we sell is a product that we use just about every day on the job site, so when we recommend an attachment for a specific application, we already know how it’s going to perform,” she added. “Everything we sell has been field tested here in Connecticut on some of the toughest job sites you can find.” Anthony LaFata has always had a passion for attachments. “With the amount of money that you spend for an excavator, to reach that investment’s full potential, using attachments to expand the machine’s capabilities just makes sense,” he said. Anthony LaFata likes to tell the story of the first attachment that A & D Equipment took on as a dealership. “As a contractor in the 1990s, we started to look for new technologies that would help us process aggregate materials on site,” he said. “New England contractors led the industry in that technology. Typically, we would bring a crushing or screening plant on site to process materials. But what we could not do was move that plant to process small amounts of material; it just wasn’t cost effective. “We experimented with a couple of different screening attachments, but they were really not all that productive; that is until we came across a manufacturer in Europe making an excavator attachment called Rotastar,” he added. “This product turned out to be an amazing piece of technology that allowed us to screen all types of materials, wet or dry, in significant volume, and transportation and setup time were no longer an issue. The Rotastar is durable, productive and affordable. After using the product for a significant amount of time, the thought occurred to us that perhaps we could sell this attachment and that’s essentially how A & D Equipment got its start.” The Rotastar screening bucket comes in a variety of sizes from skid steers up to 34-ton machines and uses lightweight pliable polyurethane stars that rotate and separate materials without crushing, allowing for an uncontaminated, usable product.

The LaFata’s knew from their experience with Rotastar that selling products which had already been tested by their construction company was a successful formula. It stood reason that if screening buckets were in demand and productive for the end user, a crushing bucket would be a logical next step. After Anthony used several different crushing buckets on job sites, they made the decision to add the Xcentric crushing bucket to their product offerings. Xcentric is designed to be a very high-volume crusher bucket. “You would put it in the category of being the Cadillac of crusher buckets,” Anthony said. “It’s going to out-produce any other bucket on the market using some advanced technology. But with that higher production comes a premium price.” The next product added to the A & D Equipment product offering was Indeco, a leader in the hydraulic attachment market that has been selling hammers in the United States for more than 30 years and has its U.S. headquarters in Connecticut. Again, Indeco was a product that had been time tested by LaFata & Son Excavation Inc. Anthony’s father had purchased their first Indeco back in the early 1990s. “We were so impressed with the Indeco product we were interviewed for a testimonial video for Indeco that was fea-

tured at ConExpo, so putting the A & D Equipment name behind the Indeco product was an easy move,” said Anthony. “The company’s manufacturing is done both in Italy and the United States, and besides the hammers, Indeco makes high quality hydraulic pulverizers, shears and grapples.” Anthony’s passion for attachments led him to tiltrotators. But his introduction to Steelwrist, the tiltrotator manufacturer that A & D Equipment represents, came in a roundabout way. “I had no idea who Steelwrist was at the time, but they were rebranding a relatively simple screening bucket that processed material through a set of bars that vibrated, and I felt that it would work well for certain applications,” he said. “I found the product on the Internet. The company was overseas. I called them and a man named Stefan answered the phone. We went back and forth a little bit and when it was all said and done, I purchased a container load of these buckets. “A few months went by, and I got a phone call from Stefan,” he added. “He was in Connecticut and wanted to meet us and it turned out he is the CEO of Steelwrist. We spent quite a bit of time together and we actually became their U.S. warehouse temporarily while they established their U.S. headquarters here in Connecticut. Ever since that time, we have had a very close working relationship with Steelwrist, including working with them at major events like ConExpo. The tiltrotator market is beginning to explode in the United States. Younger owner-operators are embracing the technology, and it has become a very important part of our business.” Anthony said at first, he struggled with the operation of the tiltrotator until he became involved in the production of an HDTV pilot episode involving the building of a house and he had to force himself to operate the tiltrotator setup. “It was a lot of pressure and I hated it,” he said. “But by the time we were done, I had fully embraced it, and today I don’t know what I would do without it.” A & D Equipment has successfully marketed its attachments not only in New England, but also across the United States. Most attachments are not particularly complex, so supporting attachment sales a thousand miles away is something that can typically be handled via a phone conversation. A & D recently achieved Women Owned Small Business status, which has put it in a very competitive position when bidding on government contracts. The foundation of the company is nonetheless strongly built on passion for and expertise with attachments. The new year will bring big changes to Dawes Rigging & Crane Rental, a member of the ALL Family of Companies, as it will be the first time in more than three decades that Steve Freckmann isn’t its general manager. Freckmann is retiring at the end of 2023 after 34 years as GM and 45 total years with Dawes. Freckmann is a crane business lifer, starting out part-time in the shop and yard as a preteen. In fact, it was Freckmann’s father, Thomas, who was a part owner of Dawes before selling to the ALL Family in the late 1970s. Steve Freckmann succeeded his dad as general manager in 1989. Steve Freckmann has been active and highly visible in the local and national business communities. “I’m proud of my involvement serving on the board of directors of the Association of General Contractors of Greater Milwaukee as well as various committees,” said Freckmann. “Also, I’m grateful for the time I’ve spent serving on the various committees of the Specialized Carriers & Rigging Association.” Freckmann is a longtime believer in the value of SC&RA, including a decade and a

OSHA Puts Major Emphasis On Mitigating Fall Hazards OSHA from page 1

“Incredible” advancements are made in safety each year, said Lorraine Martin, NSC president and CEO. But “we continue to see many of the same types of violations appear on OSHA’s Top 10 list,” she added. Mitigating Risk OSHA put a major emphasis on its fall hazards program this year as a way to help mitigate the safety risks to both workers and employers. The national emphasis program (NEP) has no expiration date, said employment attorneys of Ogletree Deakins. According to the NSC, 136 workers died and nearly 128,000 were injured in same-level falls. Bureau of Labor Statistics data shows that of the 5,190 fatal workplace injuries in 2021, 680 were associated with falls from elevations. That equates to approximately 13 percent of all deaths, reported Ogletree Deakins, noting that the NEP should come as no surprise to contractors. “Particularly those in the construction industry,” said John D. Surma, a Houston, Texas, shareholder, and Jaslyn Johnson, an associate, Atlanta, Ga. “BLS data shows that ‘fatalities caused by falls continue to be a leading cause of death for all workers.’” The number of violations is more than double the next most frequently cited standard, hazard communication. The NEP combines enforcement through hazard-based inspection targeting and locally generated programmed targeting in construction. The goal is to significantly reduce or eliminate unprotected worker exposures to fallrelated hazards that can result in serious injuries and deaths. “Interestingly, locally generated programmed targeting in construction under the NEP is optional,” said Surma and Johnson. “The NEP only encourages OSHA regional and area offices to develop targeting methods that effectively reach industry sectors where fall protection is often lacking. Ultimately, the NEP gives regional and area offices considerable discretion in how much effort, if any, to devote to programmed enforcement.” The two from Ogletree Deakins noted nearly 31 percent of OSHA’s inspections from 2014 through 2021 were related to falls. “And from 2017 through the present, the most common standard for which OSHA conducted inspections, issued citations and imposed penalties, has been fall protection in residential construction.” The law firm said with inspections opened upon infraction observation, employers could expect to see increased inspections related to falls in 2023. Statistics Pile Up OSHA’s fall protection standard guides contractors in where fall protection is required, which systems are appropriate given the situation. It also outlines proper construction and installation of safety systems and the proper prevention supervision, according to Safety and Health Magazine. S&H noted the standard is designed to protect employees on walking-working surfaces with an unprotected side or edge above 6 ft. There were more than 5,000 violations of the standard’s section related to residential construction at 6 ft. or more above lower levels. These workers are to be protected by guardrails, safety

nets or personal fall arrest systems “unless another provision … provides for an alternative measure.” The section related to walking-working surfaces with an unprotected edge at 6 ft. or higher saw 931 violations. According to OSHA, workers in this situation also must be protected by a guardrail, safety net or fall-arrest system. OSHA’s second most cited standard, that of hazard communication, applies to chemical hazards, both those produced in the workplace and those imported. “It also governs the communication of those hazards to workers,” reported S&H, adding that this standard had 2,683 violations in 2022. The number one section related to written hazard communication covering labels and other forms of writing had 1,136 violations. Employers must develop, implement and maintain a written program that at least describes how the criteria specified in this section for labels, Safety Data Sheets (SDS) and employee information and training will be met. The next highest number of hazard communication violations had to do with effective information and training on hazardous chemicals. “Employers shall provide … effective information and training on hazardous chemicals in their work area at the time of their initial assignment.” The standard also requires employers to provide info and training whenever a chemical hazard new to employees is introduced into their work area. “Information and training may be designed to cover categories of hazards or specific chemicals,” said OSHA. “Chemical-specific information must always be available through labels and SDS.” Maintaining workplace copies of SDS for each hazardous chemical was the next highest number of logged infractions at 363. This section requires employers to ensure these SDS “are readily accessible during each work shift to workers in their work areas.” Workplace labeling came up next with 315 infractions. “The employer shall ensure each container of hazardous chemicals … is labeled, tagged or marked.” Finally, OSHA requires chemical manufacturers and importers to obtain or develop an SDS for each hazardous chemical they produce or import. “Employers shall have a Safety Data Sheet in the workplace for each hazardous chemical which they use.” This infraction was cited 252 times. Violations to the OSHA standard applicable to powered industrial trucks was among the top 10. The agency logged 2,561 violations of this standard. The rule covers the design, maintenance and operation of powered industrial trucks, including forklifts and motorized hand trucks and their operator training. There were 606 violations to the section on safe operation; 336 on refresher training and evaluation; and 309 having to do with certification. “The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l),” stated OSHA. The certification must include the name of the operator, date of training, date of evaluation and identity of the person(s) performing training or evaluation. “Industrial trucks shall be examined before being placed in service,” according to the standard. The machines “shall not be placed in service if the exam-

ination shows any condition adversely affecting the safety of the vehicle.” The agency requires that such an examination be made at least daily. For round-the-clock usage, the trucks must be examined after each shift. “Defects when found shall be immediately reported and corrected,” according to OSHA, which logged 178 violations to this rule. “If at any time a powered industrial truck is found to be in need of repair, defective or in any way unsafe, the truck shall be taken out of service,” stated OSHA. It is out of service, “until it has been restored to safe operating condition.” That violation was logged 173 times. There were 2,554 violations to OSHA’s lockout/tagout standard this year. In 2022, violations numbered 2,175. Minimum performance standards for the control of hazardous energy during machine servicing and maintenance are outlined in this standard. Energy control procedure saw 730 violations; training and communication, 491 violations; and periodic inspection, 362. The section related to establishment of a program for energy control procedures, training and inspections had 265 infractions. It is meant to ensure before any employee performs any servicing or maintenance that the machine or equipment is isolated from the energy source. OSHA also logged infractions of eye and face protection rules under personal protective and lifesaving equipment. The agency noted that there were 2,074 violations in 2023, compared with 1,582 last year. It came in ninth on the top 10 list. The standard addresses “appropriate personal protective equipment for workers exposed to eye and face hazards.” These hazards include flying particles and chemical gases or vapors encountered on the job. Most often cited was the section related to employer assurance each worker uses appropriate eye or face protection with 2,034 violations. Flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation are listed. The second most common infraction, with 32 citations, regards side protection for the eyes when there is a hazard from flying objects. “Detachable side protectors (e.g., clip-on or slide-on side shields) meeting the pertinent requirements of this section are acceptable,” stated OSHA. The standard section on contractor compliance with consensus standards was violated six times. Finally, the use of prescription lenses, as prescribed, in operations involving eye hazards was cited twice this year. OSHA requires that the employer ensure each affected employee who wears prescription lenses actually wears said eye protection. The user must wear lenses or protection can be worn over lenses without disturbing the position of the prescription or protective lenses. Machine guarding infractions were logged by OSHA 1,644 times this year. There were 1,488 violations in 2022. This standard protects employees “from hazards, including those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.” “We must come together to acknowledge these persistent trends and identify solutions to better protect workers.”  CEG
