The reconstruction of the Ashton Dam was a unique project in the history of PacifiCorp, which operates as Rocky Mountain Power in Idaho, Utah and Wyoming. The project required historical research into the original construction of the nearly 100-year-old dam, careful construction techniques and a three-year phased construction schedule. The utility worked with federal and state officials and interested stakeholders for a number of years on this project. Detailed planning and coordination with numerous groups was required to meet the needs of state and federal water quality requirements, farmers who use the Ashton reservoir for irrigation and sport fishing groups concerned about the impact of the project on a world-famous fishing area. “We extend our special thanks to the nearby property owners and farmers who use Ashton reservoir for irrigation and recreation, together with the community of Ashton,” said Troy Stout, project manager, PacifiCorp. “We appreciate their patience see DAM page 34

ASA to File Amicus Brief in Jobless Rate Fall Support of Subcontractor Below 10 Percent On Aug. 23, 2013, the American Subcontractors Association will urge the U.S. Supreme Court to affirm an appeals court’s decision in a case concerning whether construction disputes should be resolved in a local forum or, instead, subcontractors can be forced to take their claims to a far off jurisdiction. ASA will file an amicus curiae brief in Atlantic Marine Constr. Co. v. JCrew Management, Inc.,
supporting the subcontractor, J-Crew, in a case in which the country’s highest court will determine whether federal courts are required to enforce contractual forum-selection clauses or whether judges have the right to consider other factors, such as the overall convenience of the parties and witnesses and the interests of justice when deciding if venue is proper. In the construction industry, out-of-state gen-
eral contractors commonly require their subcontractors to sign forum-selection and choice of law clauses, arguing that it’s more convenient and less expensive for them to resolve disputes in a jurisdiction of their choice. “The general contractor’s expediency comes at the detriment of its subcontractors, whose places of business, records, and personnel generally are close to the location of the see ASA page 60
The unemployment rate for construction workers fell below double digits in June for the first time since 2008 as every segment of the industry added employees, according to an analysis of new government data by the Associated General Contractors of America. Association officials said the relatively positive jobs report for the sector highlights the need to address potential shortages of skilled and entry-level workers. “Construction employment in June was the highest since August 2009,” said Ken Simonson, the association's chief economist. “But employment is still down by one-quarter from the peak more than seven years ago. Many of those laid-off workers have left the industry — whether for employment elsewhere, more education or retirement — and construction companies face a looming worker shortage.” see EMPLOYMENT page 58

Holt CAT Breaks Ground for New Edinburg Facility Holt CAT, the Caterpillar Equipment and Engine dealer of south, central, north and north east Texas, recently held a groundbreaking ceremony for its new full service facility at 110701 U.S. 281 North in Edinburg, Hidalgo County, Texas. This facility will help Holt continue its strong commitment in serving the communi-

Bay Bridge East Span Designed to Withstand Mother Nature By Lori Lovely CEG CORRESPONDENT
During the 1989 Loma Prieta earthquake, a 50-ft. (15 m) section of the upper deck on the eastern span of the San FranciscoOakland Bay Bridge east of Yerba Buena Island collapsed. An interim retrofit was performed to shore up the bridge while the state government made the decision whether to do a complete retrofit or build a new bridge. Analysis determined that the damage could have been much worse, in part because of poor soil conditions under the eastern end of the bridge. Because the bridge sits between two fault lines — the San Andreas and the Hayward — and is vulnerable to a major event, and because the Army Corps of Engineers warned that a retrofit would require extensive ongoing maintenance, it was determined to build an all-new bridge north of the original structure. Earth-Shaking Design Several alternatives were considered, but the Engineering and Design Advisory Panel of the Metropolitan Transportation Commission ultimately chose a design by Caltrans and T.Y. Lin International. The rising cost of materials — particularly steel and concrete — contributed to the high price tag. “Upward revisions in the early days of planning contributed to raising the cost,” said John Goodwin, public information officer with the Metropolitan Transportation Commission in Oakland. Insurance costs became increasingly pricey as well. In addition, because the primary structure of the signature self-anchored span cannot be self-supporting until complete, it required the building of a temporary bridge to support the final span, adding to costs. The project, which is the largest public works project in California to date, has a forecast budget of $6.4 billion. The primary source of funding is tolls on state-owned toll bridges in the Bay area, with 60 percent of funds coming from tolls, 5 percent ($323 million) from federal funds and the rest from state funds. “The onus is on tolls,” Goodwin said, noting that California implemented a
toll increase in 1998 and again in 2007. The new east span will feature a pair of side-by-side, five-lane concrete viaducts that connect to a single-towered, self-anchored suspension span. A transition structure links the SAS to the existing double-deck tunnel. “The tunnel has no additional capacity,” Goodwin said, “so we can’t create a bigger bridge.” However, full-size shoulders will be

The project is so big it is divided into 16 major contracts and four major sections: the Yerba Buena Island Transition Structure (YBITS), the all-steel self-anchored suspension (SAS bridge), the Skyway and the Oakland Touchdown. the SAS project is ABF, a joint venture between Pennsylvania-based American Bridge Co. and Fluor Corporation of Irving, Texas. Innovative energy-absorbing techniques were incorporated for state-of-the-art safety, according to Goodwin. The steel and concrete replacement span is engineered to withstand ground motion forecasts over a 1500-year period and is expected to last at least 150 years with proper maintenance. Designed to absorb energy, sections move independently with critical components designed to deform so they can be removed and replaced if necessary. Due to 20 hinge pipe beams and sacrificial tubular end keys, the flexible structure should be able to survive a Maximum creditable earthquake, estimated at 8.5 moment magnitude. The tower consists of four columns joined horizontally by sacrificial box structures, known as shear link beams, designed to absorb earthquake-induced motion that will allow the tower to sway without incident. To build the tower, columns were lifted and bolted into place before being topped with a cap that carries the cable saddle. After being floated in from China, the columns were lifted onto a temporary scaffold for placement. A second set of columns was erected by a gantry on top of the scaffold and placed over the first four columns, to which they were bolted. An even larger crane lifted this set into place over the previous set. The final set of columns was set in 2011, extending the height of the tower to 480 ft. (146 m). Once the cable saddle was placed, the tower was complete, at a final height of 525 ft. (160 m). Spanning the Bay Moving east to west from Oakland to San Francisco, the bridge begins with the Oakland Touchdown, an elevated road that leads from the shore to the skyway, curving to align with the existing ground-level approach road. Next is the longest section of the new bridge, the 1.2-mi. (1.9 km) Skyway. Sweeping parallel decks arc out over the bay, see BRIDGE page 18

providing both a stunning view and a graceful image. It is composed of 452 pre-cast concrete segments that stand three stories high, 90 ft. (27 m) wide and 25 ft. (6.6 m) long. The deck surface is paved with durable, weather-resistant highstrength polyester concrete fabricated in Stockton and transported by barge. The largest segments of their kind ever cast, they were lifted into place by custom-made winches. Similarly, two of the heaviest lifts in California history placed the two 2,000-ton (1,814 t) steel transition segments on the western end. These segments will connect the Skyway with the SAS. Fourteen sets of piers ranging in height from 45 to 115 ft. (14 to 35 m) support the Skyway sections. They were constructed of 160 rebar and concrete-filled steel piles 8.5 ft. (2.6 m) in diameter. The piles were welded into pile caps underneath the columns and were driven as deep as 300 ft. (91 m) to anchor in stable soils. Prime contractor Kiewit/FCI/Manson — a joint venture — completed construction in 2008. The main SAS span is not only unusual for being rarely built, but also unique because of its single tower and asymmetrical design. A two-tower cable-stayed design would require deep footings in bedrock and a conventional twotower suspension bridge would require a massive anchor to be built in deep bay mud. The tower east of the island is on bedrock, Goodwin said. However, because the soil conditions under the eastern end of the bridge prohibit setting the Skyway pilings in bedrock, they are set in the firm archaic mud found below the soft muds deposited by distant placer mining in the late 19th century. Large-diameter tubular piles were driven inside cofferdams at angles to form a splayed footing. Next, a reinforced concrete pad was poured at the bottom of the cofferdam to create a footing for the column. Anchored into the bridge superstructure on the east side of the SAS, the single cable rises to the tower and then descends to wrap around the west side of the SAS before climbing to the top of the tower again and then descending
back to the east anchorage to form the main cable. The shorter western side of the SAS is pulled down against the forces imposed by the longer eastern span. To avoid uplift in the supporting columns, the span is terminated with a massive concrete end weight that carries the turning saddles for the main cables. In November 2011 there was concern about the potential of falsified inspection reports, particularly in regards to foundation testing practices. A report from a panel of independent experts in March 2012 confirmed the integrity of the tower foundation. Challenge Accepted Welding was difficult. “The superstructure is composed of 28 separate orthotropic box girders (14 in each direction),” Goodwin explained. “Those at the eastern end contain the anchoring system contain 137 separate cable strands.” Workmanship was a challenge complicated by difficult access, which subsequently added to the cost and the timeline. “Minimizing disruption was a huge challenge when you’re working on a bridge that sees 250,000 vehicles a day,” Goodwin said. The SAS tower was completed in 2011 and the entire SAS superstructure was finished by summer 2012. Load transfer was completed on Nov. 20, 2012, officially making the 2,047-ft. (624 m) span the largest self-anchored suspension bridge in the world. The entire roadway of the bridge is now largely complete. The bridge is now self-supporting so temporary scaffolding is being removed. All that’s left is paving, painting, a lot of punch-list items and resolution of the problems with the high-strength steel rods. JCB has launched two new compact wheel loaders — the 411 and 417. The machines will be powered by the highlyefficient, low-emission JCB Ecomax diesel engine, delivering lower fuel consumption, less noise and greater productivity. The two machines, which share the same chassis and cab structures, will use the EPA Tier IV Interim (TierIVi) standard 4.4-L Ecomax engine offering 125 hp (93 kW) in the 417 and 91 hp (68 kW) in the 411. Features of the new machines include: • Low-emission Ecomax diesel engines • Larger operator’s cab with improved ergonomics • New high-lift arm option on the 417 for increased versatility • Improved lift capacity • Clutch disconnect on service brake pedal for lower fuel consumption Next Generation Wheeled Loaders The 417 (which replaces the previous 416) and the revised 411 adopt the new generation appearance, with a new singlepiece hood for service access and visibility. Other improvements include a completely redesigned cab with a new fullcolor LCD monitor and an intuitive menu system that provides a wide range of real-time information for the operator. Fuel consumption and cycle time data can be displayed, allowing operators to adapt their driving style to optimize machine productivity and efficiency. The cab benefits from reduced noise levels, and for the first time on machines of this size, JCB will offer full climate control air conditioning as an option. Ecomax Low-Emission Performance The 417 will use a 125 hp version of JCB’s Ecomax Tier IV Interim engine. This drives through a ZF four-speed
transmission to JCB axles front and rear, with a transmission disconnect feature incorporated into the service brake pedal delivering further fuel-saving benefits. The engine gains 15 percent greater fuel efficiency compared with the previous Dieselmax engine without any loss of digging and loading performance, lowering operating costs for customers. The 411 also will benefit from improved fuel efficiency with the 91 hp version of JCB’s Ecomax Tier IVi engine. The most significant customer benefit is the fact that the Ecomax engine achieves Tier IVi requirements without the need for any form of exhaust after-treatment. There is no need for a costly diesel particulate filter (DPF), diesel oxidation catalyst (DOC) or exhaust fluid or selective catalytic reduction (SCR). This allows JCB to install the Tier IVi engine in a compact loader design with no negative effect on visibility from the cab and no requirement for larger cooling packs or expensive additional maintenance. Operating weights have been increased slightly to 21,100 lbs. (9,571 kg) for the 417 and 18,000 lbs. (8,164 kg) for the 411 to cope with increased digging forces and lifting performance. The 417 will be available with a high-lift-arm loader configuration, joining the existing standard and superhigh-lift arms available on the previous machine and on the 411. This third loader arm option offers a pin height of 12.5ft. (3.8 m) with a dump height of 9.6-ft. (2.9 m), compared with the standard lift arm pin height of 12-ft. (3.6 m) and the dump height of 9-ft. (2.7 m) when equipped with a 2.1 cu. yds. (1.6 cu m) bucket. The 411 is available with both standard and super-high-lift loader configurations, with the standard arms offering a pin height of 11.4-ft. (3.5 m) and a dump height of 8.4-ft. Terex TL120 Offers Higher Production, Lower Emissions The latest Terex TL120 compact wheel loader comes with far more than just a more powerful Tier IV interim 4-cylinder turbo diesel engine with intercooler; it has a new Terex smart control operating system, a quieter cab offering a better view to the ground for the operator and a new cooling system. The 101 hp (75.3 kW) Tier IVi Deutz engine provides the 16,653-lb. (7,553 kg) operating weight TL120 with approximately 16 percent more power and 90 percent lower exhaust emissions than its predecessor, according to the manufacturer. Further efficiency gains come from the new operating concept, which makes it much easier for the operator to configure the machine precisely to an application. Similar to menu guides on smart phones, operating the Terex smart control is very intuitive. Within the cab a new dashboard display provides a better at-a-glance of machine operation information, while the multi-function joystick comes with an electro-proportional control circuit and a slow/fast key for precise handling. The keypad has extra-large keys for easy operation and all the fuses and relays are now mounted inside the cab for additional protection. Noise levels in the two-door cab have

been cut from 76dB(A) to 71dB(A). The lock switch for the quick-attach system is mounted by the steering column and the Tier IVi TL120 provides the operator with an enhanced view of the attachment coupling process.
A new Tier IVi engine cooling system uses a hydraulically operated and temperature-controlled fan, which starts automatically when required to help reduce fuel consumption. Using parasitic reduction, the hydraulically driven fan can be adjusted
down to compensate for cool climates. A reverse function is available for machines working in dusty environments to push debris from the radiator in turn reducing service and associated downtime. The combination of the new cooling package and the revised rear hood cuts exterior noise levels from 102dB(A) to 99dB(A) — effectively reducing noise pollution and making the Tier IVi TL120 ideal for use in urban areas or sites with strict decibel-level requirements. Other changes include a three-part counterweight, which provides easier service access to the engine, the battery isolator is now adjacent to the cab, and beneath the redesigned engine hood are new jump start terminals. A revised steering system reduces the effort needed to turn the wheel while retaining its 15-ft. 4-in. (4.7 m) turning radius. Other features carried over from the previous model are the 1.57 to 2.35 cu. yds. (1.2 to 1.8 cu m) bucket capacity, parallel kinematics, self-locking differentials and an oscillating rear axle. Hyundai Introduces Interim Tier IV JRB Multi-Pick-Up HL760-9A as Part of 9A Series Loaders Coupler Designed for Efficiency
Hyundai’s HL760-9A wheel loader is set to provide end-users with many improvements from previous models including a certified Interim Tier IV engine upgrade, improved durability and enhanced operator comfort, according to the manufacturer. The HL760-9A is part of Hyundai’s new line of 9A series wheel loaders, all of which meet Tier IV Interim standards. Equipped with a low emission, low noise, 222 hp (165 kW) Cummins Interim Tier IV/Stage IIIB, QSB6.7 engine, the HL760-9A provides optimum power while remaining fuel efficient. Operators can choose between three unique engine modes, power, standard and economy, which enable the machine to switch between full power and reduced fuel consumption according to the user’s preference. In order to provide maximum flexibility, the HL760-9A’s fully automatic transmission features four step shift modes: manual, light, normal and heavy, making it well-suited for any type of working condition. The loader has an operating weight of 40,450 lbs. (18,348 kg), a 4.3 cu. yd. (3.3 cu m) bucket capacity and a bucket breakout force of 35,780 lbs. The HL760-9A also is available in an extended reach (XTD) model for jobs where a higher dump height is a necessity such as loading high sided trucks and hoppers, stock piling material and for agricultural applications such as stocking feed lots on dairy farms. Hyundai’s HL760-9A was built with operators in mind, featuring a larger, redesigned cab for additional comfort and usability. The HL760-9A has been enhanced with rounded front glass and larger door glass, giving users improved visibility from all angles. Other amenities include an increased cooling and heating capacity with fully automatic climate control, tilting and telescopic steering, an adjustable wrist rest for reduced operating stress and an improved ladder with 20 degree incline and large, deep tread, aluminum cast steps making entering and exiting the cab safer and easier. The LCD monitor also is functional as a rearview backup camera providing improved safety and convenience on any job site. With a focus on improving durability, Hyundai has upgraded its HL7609A model with a long-life cooling system and a relocated cooling fan and radiator, designed for additional durability and resistance to thermal shock, impulse and vibration. PacifiCorp Provides All Funding for $25 Million Project DAM from page 1
and understanding during the course of this project. We are also grateful for the work of state and federal agencies, sport fishermen and the Henry’s Fork Foundation, who assisted us with the planning and execution of the reconstruction. It has been a very productive partnership.” The project was closely coordinated with environmental, federal, state regulatory and permitting agencies who have authority over hydroelectric projects. Extensive consultation and planning for the safety of workers and the public — as well as water quality and fishery considerations — have been a priority in this process. The project featured extensive preparatory steps, including explorations and design that began in 2003. Jack Kolkman, hydro operations manager, said a number of alternatives for dam reconstruction were considered. The company sought the least disruptive options for water quality and consideration for those who use the reservoir for agriculture and recreation. The company decided that complete restoration was the best option, rather than lesser measures that might have solved the problems of the aging structure, but were less-certain. Permitting for the project began in 2007. PacifiCorp worked with the Federal Energy Regulatory Commission and the Idaho Department of Water Resources Dam Safety since 2004 to evaluate the structural conditions of the dam and determine scope of work required to upgrade the structure to modern standards. The utility consulted with qualified structural engineers and engineering geologists, all with extensive experience with the design and construction of embankment dams like Ashton. The construction method chosen was an industry standard, but because of the age of the dam, its interior structure was not completely known. This required a series of core samples to be taken to determine the materials and conditions in the interior of the dam. The level of the reservoir was carefully managed during the evaluation and construction process. Residents near the area and farmers who use the reservoir for irrigation were contacted directly to inform them in advance when the reservoir was lowered or raised to
allow for evaluation and construction activities to proceed. The first step was construction of a diversion tunnel around the dam beginning in July 2010. This provided a way to redirect, yet maintain stream flow and allow the dam reconstruction to proceed. Preparation continued in 2011 and early 2012 with connection of the tunnel to the reservoir and construction of cofferdams both downstream and upstream of the dam to allow the work to proceed. In January, March and April of 2012, replacement and repair of concrete supporting structures was completed on the downstream side of the power house. Continuing work through summer and fall of 2012 included excavation and reconstruction of the earthen and rock-fill portion of the dam on the upstream side and replacement of the dam’s concrete crest. “This has been a career project for me; and I’ve been here 30 years. There has been nothing really like it in my experience,” Jack Kolkman, director of hydro plant operations for PacifiCorp Energy, said. To completely rebuild Ashton Dam has been extremely challenging, but also fascinating and rewarding, according to Roger Raeburn, environmental manager for PacifiCorp Energy. “This kind of work had no modern precedent at PacifiCorp. After all, there are no new dams being constructed. The coordination that was required among state and federal agencies, property owners, farmers and recreational users was extensive. We are grateful for the cooperation and input of these organizations, which greatly contributed to the project’s success.” Project cost is approximately $25 million. PacifiCorp provided all funding. A number of contractors and consultants were involved in the project. W. W. Clyde & Company of Springville, Utah, was the principal contractor for construction services. URS Corporation, headquartered in San Francisco, Calif., served as project engineer, designer, and construction manager, while Cirrus Ecological Solutions, LC, of Logan, Utah, was principal environmental consultant for sediment, water quality, and spawning gravel assessments. Phoenix, Ariz., also participated in the job, as did Cornforth Consultants, Inc., of Portland, Ore., which handled ongoing dam instrumentation data collection and reporting. Bear River Electric of San Mateo, Calif., was responsible for installation of the instrumentation. The first major challenge was evaluating the condition of the dam and evaluating all options, according to Kolkman. When reconstruction was selected as the most prudent option for the utility’s customers, a detailed evaluation was conducted, including core samples to determine the internal conditions of the dam. The level of the reservoir needed to be coordinated with the needs of farmers who use the water for irrigation and the requirements of the reconstruction project. A detailed schedule of reservoir level changes was developed and shared with stakeholders to accommodate both the needs of agriculture and the construction project. During the construction phases it was necessary to relocate fish as water was diverted from areas near the dam during the work. This work was accomplished in cooperation with the Idaho Department of Fish and Game using specialized equipment to stun the fish with electric shocks, net them and relocate them unharmed outside the work area. Three relocation efforts were needed and were judged highly successful. One of the largest concerns of residents and recreational users in the area was about potential negative impact of sediment that might be introduced during reconstruction. Both state agencies and fishing enthusiasts were wary because of
sediment problems that occurred in 1992 with work on the Island Park Dam, upstream of Ashton. PacifiCorp project managers conducted and participated in many extra meetings to explain all they were doing to control sediment into the river and minimize environmental impacts of the reconstruction. The results were impressive, even to skeptics. “I’m pretty happy with the way things have turned out,” said Dan Garren, Fish and Game’s fisheries manager in the Upper Snake Region. “They avoided a large-scale sediment event and, when you think about the scope of the project up there, that’s pretty amazing.” Garren believes the power utility’s communication and outreach to anglers was “awesome. PacifiCorp listened and I really think they stepped up their efforts,” Garren said. Brandon Hoffner, executive director of the Henry’s Fork Foundation, said the utility was great to work with. “They have been very responsive to our concerns,” he said. “We are very happy with the fact they were able to get the project done with what looks like minimal effects to the river.” The project involved a large selection of equipment. The fleet at work included: • Caterpillar articulating 730 and 740 dump trucks (with and without ejector), used to transport existing dam material waste and import new material. • Caterpillar 375, 330BL, 330CL, 325C, 345B, and 304D trackhoes, which handled dam excavation, material placement, and loading trucks with new dam material.
• Caterpillar 623F paddle-wheel scraper, used for new core material excavation. • Putzmeister Telescopic TB 130 belt conveyor, which carried out material placement in the reservoir, new embankment filter, and material placement. • Caterpillar TH-6 and TH-560B telehandlers, utilized for miscellaneous site work. • Caterpillar 988B and 950G front end loaders, for material loading and stockpiling. • Grove RT855B and 890E cranes, used for concrete placement and formwork, scaffolding construction, and material placement in otherwise unreachable locations. Employee staffing was between 25 and 75 depending on the nature of construction activity. Subcontractors and consultants employed by principal contractor W. W. Clyde & Company included CDM-Smith, of Cambridge, Mass., subconsultant for the Phase 2 cofferdam and dewatering design. Butte, Mont.-based O'Keefe Drilling Company, constructed the upstream dewatering wells, and Portadam, Inc., headquartered in Williamstown, N.J., served as supplier and constructor of the downstream cofferdam. Other W. W. Clyde & Company subcontractors included Rain-forRent (dewatering) and A-Core, Inc. (concrete demolition), both of Idaho Falls, Idaho, Independent Drilling, based in Blackfoot, Idaho (downstream dewatering wells), Swiss Precision of Ashton, Idaho (labor and fencing), Harris Rebar (rebar supplier and installer), and Nicholson Construction (drilling and grouting for left-abutment grout curtain) both headquartered in Salt Lake City, Utah, as well as Walters Ready Mix, of Rexburg, Idaho (concrete supplier), Superior Blasting, Inc. based in Nampa, Idaho (blasting), and Potable Divers, Inc, in Vernal, Utah (cofferdam inspection). URS Corporation also engaged subcontractors for the project. Materials, Testing, and Inspection (MTI), based in Ontario, Ore., handled third-party quality control testing for them, while third-party quality control laboratory TerraSense, LLC, located in Totowa, N.J., was responsible for select soil testing. As a primary sponsor of the June Elko Mine Expo for the sixth consecutive year, Cashman Equipment celebrated both the mining industry and its continued growth on June 28 in Las Vegas. This year, the 82-year old company focused on the new legacy Bucyrus product line and technology demonstrations. After becoming a legacy Bucyrus dealer earlier this year, Cashman prominently featured the new Cat-branded hydraulic shovels, electric rope shovels, and drills. The company’s 60 ft. (18 m) tent at the main entrance of the Mine Expo featured a wide range of Cat products and was staffed with knowledgeable sales representatives who answered questions and provided product demonstrations. Mine Expo attendees enjoyed interactive displays and also were excited to see a rare 2 ft. (.6 in.) machine replica of the 7495 Electric Rope Shovel. In fact, there were more than 10 requests to purchase the replica model by Caterpillar enthusiasts. “This is an important addition to our offer-
ings,” said Chris Wolford, Elko sales manager. “Caterpillar’s acquisition of Bucyrus in 2011 and the resulting integration into Cashman’s operations means we’re now providing our mining customers the broadest product line in the mining industry.” With more than 6,000 Elko Mine Expo attendees gathered for the show, Cashman and the Elko Convention and Visitors Authority hosted a kickoff reception at the Flying Fish in downtown Elko. Approximately 400 people began their Expo experience with this revitalized event, which focused on industry networking rather than a formal speaker as in previous years. In addition, 800 people also visited Cashman’s event booths at the Elko Convention Center where they featured Cat Underground loaders, wheel loaders, backhoes, vocational trucks, engines, generators, and skid steers, as well as a motorgrader simulator, a Cat Global Mining Touchpoint learning center, and Cat gear merchandise. Wirtgen W 210i, W 200i Comply With Tier IVi Standards The Wirtgen W 210i and W 200i cold mills — introduced in 2013 — offer the same advanced-design cold-milling performance as their established W 210 and W 200 predecessors, but are compliant with U.S. Tier IVi emissions requirements. Like their predecessors, the W 210i and W 200i feature a standard milling width of 79 in. (200 cm), but can be fitted with optional 59 in. (150 cm) or 87 in. (221 cm) cutting units. Three selectable engine speeds enable a broad range of applications, such as large-scale surface course rehabilitation, complete pavement removal at full depth, and fine milling, and have a milling depth of 0 to 13 in. (0 to 33 cm). The W 200i is powered by a single engine generating 535 hp. Its
operating weight is 59,922 lbs. (27,180 kg) with half-full water tank, half-full fuel tank, a 165-lb. driver, and tools. The W 210i has nearly all of the same features as the W 200i, except for added power in cutting applications, features a fuel-saving drive concept utilizing two diesel engines, generating a total 680 hp with both engines engaged. Its operating weight is 63,670 lb. (28,880 kg). The W 200i and same-sized, but more powerful W 210i incorporate a number of new technologies for cold mills that are exclusive to Wirtgen Group.
Their parallel-to-surface (PTS) technology automatically keeps the cutter housing level as the W 200 and W 210 move into a cut, accelerating production, and their “smart” WIDRIVE technology offers new microprocessor-controlled enhancements to machine control systems, tying all main
functions to a single source to manage fuel costs, tooth costs and other variables. Their intelligent speed control system incorporates an electronic flow divider that makes the four tracks work in harmony when turning a radius. Skipping and notching are eliminated, track wear is minimized, and the machine operates smoother. They incorporate the level pro system, Wirtgen’s existing automatic leveling system, which is highly user-friendly and regulates the pre-set milling depth and actual readout electronically. ments for any machine, but their new vacuum cutting system option will remove dust, fines and smoke from the cutter chamber and extract it out the conveyor, keeping the machine cleaner and prolonging component life. Highly versatile and capable of tackling a variety of applications, Volvo heavyweight double-drum asphalt compactors, the DD110B, DD120B and DD140B, can manage the industry’s biggest tasks — from major highway work to airport runways. High centrifugal force, powerful frequency and optimal drum weight combine to produce optimum energy output for excellent compaction and high machine productivity, according to the manufacturer. The DD110B, DD120B and DD140B offer dual amplitude settings, allowing operators to quickly and easily adjust drum forces when material depth changes. For even greater versatility, eight amplitude settings are available, allowing operators to adjust amplitude as circumstances vary with a hand wheel conveniently located inside the

When an operator selects the automatic operational mode, eccentric rotation is matched to the direction of travel, helping eliminate the possibility operators will forget to adjust the setting. Simply fold the conveyor and drive the GT3200 onto the trailer for transport. It features the latest in GOMACO machine control with the exclusive G+ system with a new full color screen. G+ is a powerful controller for paving accuracy and electronic monitoring of steering and grade. G+, combined with the GT-3200’s C4.4T Caterpillar engine with 91 hp (67.9 kW), provides plenty of power for sidewalk paving, according to the manufacturer. June Employment Totals 5.8M EMPLOYMENT from page 1
The unemployment rate for workers who last worked in construction declined to 9.8 percent from 12.8 percent in June 2012, not seasonally adjusted, and the number of unemployed construction workers dropped by 214,000 to 825,000. The latest numbers were the best June figures for each series since 2008, Simonson noted. Construction employment in June totaled 5.8 million, an increase of 190,000 or 3.4 percent over the past year. Aggregate weekly hours of all new and existing construction employees expanded by an even larger 4.7 percent, as companies put more workers on overtime. “The number of unemployed workers with construction experience has fallen to low enough levels that firms in a growing number of locations and segments are having trouble finding people with the needed skills,” Simonson said. “Contractors have filled the gap so far by adding to workers’ hours but this ‘solution’ may be reaching its limit.” Residential and nonresidential contractors have added workers in nearly equal numbers, Simonson observed. Residential building and specialty trade contractors added 5,200 in June and 90,200 (4.4 percent) over 12 months. Nonresidential building, special-
ty trade and heavy and civil engineering construction firms grew by 8,400 workers in June and 99,800 (2.8 percent) from a year earlier. In a favorable sign for future construction growth, architectural and engineering services employment rose by 2.6 percent over the year. Association officials said some of the future worker shortages that will come if the industry continues to add jobs over the coming months might still be averted. They urged education officials to rebuild skillsbased, or vocational, educational programs designed to help prepare students for careers in construction and manufacturing. And they urged Congress and the administration to reject the arbitrary caps on construction workers that are currently included in the Senate’s immigration legislation. “Now that demand for construction is finally picking up, it is vital to ensure that the industry can find enough qualified workers,” said Stephen E. Sigalarm Unveils New Range Control Warning System Sigalarm has unveiled a new range control warning system. Design for the system originated in England and later came to Orlando, Fla. Units were out in the field for two years for testing with the wireless units. Sigalarm has combined GPS and E-field detection technology. This has reduced site hazards associated with working near power lines. Many utility companies map line locations. Combining this information with GPS enables a three-dimensional look at equipment location in relation to power lines. “This is the only product that has E-field sensing combined with GPS to keep track of power lines. Combined technology gives better technology,” said President of Sigalarm, Lance Burney. With Sigalarm’s new system the X Y and Z positions allow the location of the boom to be continually mapped in relation to the power lines. The data can be sent to anyone who needs to see it in addition to the equipment operator. construction project,” said ASA Chief Advocacy Officer E. Colette Nelson. “Forum-selection clauses can chill a subcontractor’s ability to recover claims by imposing significant and unnecessary impediments and financial costs to the recovery of amounts due.” If the Supreme Court were to require strict enforcement of such clauses, it would undermine subcontractors’ ability to point to state law voiding or making voidable forum-selection clauses in construction contracts that mandate litigation or arbitration in a state other than the state where the project is located. “Twenty-two states have enacted laws that void, or make voidable, forum-selection clauses in construction contracts that attempt to require litigation outside the state where the work was performed,” Nelson noted. In the underlying case, the general contractor, Atlantic Marine, hired J-Crew as a subcontractor to work on a construction project to build a child care facility at a military base in Fort Hood, Texas. The

subcontract contained a forumselection clause requiring that all disputes “shall be litigated in the Circuit Court for the City of Norfolk, Virginia, or the United States District Court for the Eastern District of Virginia, Norfolk division.” J-Crew subcontracted much of its work to predominantly local subcontractors and suppliers, almost all of which were located in the Western District of Texas in or around Killeen, Texas, and near the project. All of the subcontract work was performed in Texas. When the project was completed, almost $160,000 remained unpaid to JCrew, even though it had timely completed its work. J-Crew ignored the forum-selection clause and sued in Texas, in the federal district where the proj-
ect was located. Atlantic Marine moved to dismiss or transfer the case to federal court in the Eastern District of Virginia, relying on the forum-selection clause in the subcontract. J-Crew argued that the U.S. Code provides that if a lawsuit is filed in a proper venue, the court may transfer it to another venue “for the convenience of the parties and witnesses, in the interest of justice.” J-Crew asserted that the trial court had to consider interests of justice and the convenience of the parties and witnesses when resolving disputes over venue, and cited case law that courts must weigh in the decision to transfer “according to the individualized, case-by-case consideration for convenience and fairness.” In this case, the project, the subcontractor, the subcontractor’s
office, project records, personnel, and all of the second-tier subcontractors and non-party witnesses who performed the work were located in Texas. J-Crew argued that convenience and fairness supported litigation in Texas instead of Virginia. In addition, there were at least seven non-party witnesses who were beyond the subpoena power of the Virginia Court and could not be compelled to testify in Virginia. Moreover, because project records were in Texas, there were costs and efficiencies from having discovery in the state where the project and principal witnesses were located. Finally, J-Crew argued that litigating the dispute in the Western District of Texas was important from a policy standpoint, citing Texas law making voidable any
forum-selection clause in a construction contract that provided for venue outside of the state. The trial court agreed with JCrew and refused to dismiss the case or transfer venue to Virginia. Atlantic Marine called on the 5th Circuit Court of Appeals to enforce the forum-selection clause, but the appeals court agreed with the trial court’s reasoning. Atlantic Marine appealed to the U.S. Supreme Court, which has granted review. ASA has retained Kegler, Brown, Hill & Ritter, Columbus, Ohio, to prepare its brief. Firm attorneys Don Gregory and Eric Travers will lead the effort. ASA’s Subcontractors Legal Defense Fund will finance the brief in this case. The SLDF supports ASA’s critical legal activities in precedent-setting cases to protect the interests of all subcontractors. ASA taps the SLDF to fund amicus briefs in appellate-level cases that would have a significant impact on subcontractor rights.
