As one of Seattle’s busiest arterials, with an average daily traffic count of 30,000, Holman Road NW was showing noticeable signs of wear. “[It’s] is in need of maintenance repairs,” said Seattle Department of Transportation (SDOT) spokesperson Maribel Cruz. “There was a great need for maintenance on the roadway and as SDOT evaluated the scope of work through its Complete Streets program, it was determined that several additional improvements could be made to benefit all forms of

As of early September, crews had completed major sidewalk repairs, new ramps, bus shelter improvements, landscaping and paving work on Holman Road NW between 7th Avenue NW and Greenwood Avenue N. During the project, temporary wheel stops were installed to provide safer passage for pedestrians and bicyclists along Mary Avenue NW and NW 92nd Street. This improvement will be in effect until a new sidewalk is built as part of a Safe Routes to School project in 2016.

Construction Employers Add 12,000 Jobs in Oct. ’14 Construction employers added 12,000 jobs in October and the sector’s unemployment rate fell to 6.4 percent, the lowest rate for October since 2006, according to an analysis released Nov. 7 by the Associated General Contractors of America. Association officials said the construction employment gains, along with rising wages and weekly hours, are consistent with survey results showing more firms having a hard time finding enough qualified workers to fill available

positions. Construction employment totaled 6 million in October, the highest total since May 2009, with a 12-month gain of 231,000 jobs or 3.9 percent, Ken Simonson, the association's chief economist, noted. Residential building and specialty trade contractors added a combined 8,000 employees since September and 130,600 (6.0 percent) over 12 months. Nonresidential contractors — building, see AGC page 66

(2.1 km) of Holman Road and make pedestrian safety improvements from Greenwood Ave. N. to NW 87th Street. Additional work includes sidewalk spot repairs, curb ramp installations, bus zone and bus shelter improvements and bridge expansion joint replacement. U.S. Appeals Court Grants Rehearing in Texas CGL Case After the American Subcontractors Association and others in the construction industry argued that an appeals court opinion called into question whether subcontractors can depend on their commercial general liability insurance policies for coverage — coverage previously upheld by other courts — a U.S. appeals court on Oct. 29, 2014, withdrew its prior opinion and granted a rehearing, saying the contractual liability exclusion does not exclude coverage for property damage arising out of breach of a contractor’s duty to repair. In the U.S. Court of Appeals for the 5th Circuit’s Opinion on Rehearing in the case of Doug Crownover and Karen Crownover v. Mid-Continent Casualty Company, the court essentially equated it to the same type of liability for breach of the implied warranty of performance of the work in a good and workmanlike see ASA page 68

The Ecco Equipment Corporation may not be the biggest equipment rental business out there, but they can claim a distinction that is perhaps even better. The company recently earned the right to call itself the largest equipment rental company to be certified green by the Association of Equipment Management Professionals. It’s the second time Ecco has achieved the status, but this time they moved up a level, earning silver over the previous bronze. It’s exactly what AEMP hoped might happen. “By aiming for higher, clearly defined levels, the AEMP green fleet can give a company a solid goal to attain,” said Sara Sanderman, AEMP vice president of education and certification. “They’ll say, ‘Ok, we’re bronze. Here’s what our fleet looks like. Let’s see if we can get silver in two years.’ Ecco is a great example of that.” Ecco President David Schmid agreed the program was a great motivation. “When we first qualified, we were at the bronze level and we had set a goal to reach the silver level in two years,” he said. “The program worked as intended where it did motivate us to reach certain milestones in terms of our fleet composition. We had to turn over more of our older fleet and replace it with newer machines so we could reach that goal.” The certification program is used to recognize green fleets and the fleet managers who actively pursue a greener fleet, and to highlight the fact that they have gone above and beyond current regulations to reduce emissions, Sanderman said. The AEMP requirements for the 4 Green Levels for Off Road 2014 Certification the four green levels are: • 2014 Bronze Status: 50 percent of Fleet Tier II and a Written Idle Policy • 2014 Silver Status: 50 percent Tier II and 25 percent Tier III and a Written Idle Policy • 2014 Gold Status: 75 percent Tier II and 50 percent Tier III and a Written Idle Policy 2014 Platinum Status: 75 percent Tier II and 50 percent Tier III and 25 percent Tier IV OR Equivalent After Treatment Devices or Hybrid and a Written Idle Policy AEMP began the program in 2010 and has certified 15 different entities as green. “We have everything from

waste management companies, city fleets, large construction companies and even some military fleets,” Sanderman said. Not only does a green fleet lead to a cleaner environment, it is something of a public relations boon to the whole industry. “The construction industry and heavy equipment industries are often

perceived as unclean and major contributors to emissions,” she said. “We’re trying to create a more accurate impression of how fleets really are.” Ecco never made a sudden decision to go green, Schmid said. “It was just an evolution. We could do this and reduce our footprint and promote ourselves as being a little more responsible. Where we saw opportunities to do that we did.” When they first learned of the certification program, they already had the written anti-idle policy in place. “We thought, well we’re already half way there. It was not quite that easy. It’s quite a chore to submit your fleet and documentation to determine if you qualify. Now every time we make a change in our fleet, we update on line.” It can also be costly. “We’ve got older machines that are at a tier one level and we are trying to

sell those for $140,000. The replacement machine which would be tier four, that’s going to run you $700,000, but they push the same amount of dirt. We have to do a certain amount of this to stay competitive. People don’t want to rent old tired equipment. Even without the green aspect, we would have a certain amount of upgrade we would need to do. To do it at the pace we do it definitely adds a lot of expense.” But despite the extra work and cost, Schmid believes it is well worth it. He promotes his green certification in advertisements and when people don’t know what it is, his staff takes the time to engage them in a conversation about it. “If you are outside of the construction industry and you are looking at all these big machines, it’s pretty easy to think these guys are raping the environment,” he said. “If you are an environmentalist, you might have a natural animosity for people in our industry. By being as environmentally conscious as we can, it might help soften that animosity and help people to see we are responsible members of the community. “It’s something we’re proud of, that we’ve gone to the trouble to do it and nobody else does, so we stand out in that way. DALLAS (AP) State transportation officials are pushing for construction of a toll road in North Texas even though many towns near the planned route are condemning the project. The Northeast Gateway is part of the state’s 10-year plan for transportation projects. It would extend from the Dallas suburb of Garland northeast to Greenville. The Dallas Morning News reported that state Rep. Cindy Burkett, R-Garland, sent a letter to the Texas Transportation Commission arguing it hadn’t taken “into account public involvement.” Towns such as Fate, Rockwall and Wylie have criticized the project. The North Central Texas Council of Governments reversed an earlier recommendation to include the road in the region’s transportation plans. The gateway is being developed by private company Texas Turnpike Corp., which has authority to use eminent domain. ore than 700 exhibitors displayed their equipment at the 2014 GIE+Expo, which was held at the Kentucky Exposition Center in Louisville on Oct. 23 and 24. The event also featured a Dealer Preview Day on Oct. 22nd. Kenworth T880 Transports U.S. Capitol Christmas Tree More than 300 people joined the U.S. Forest Service, the Leech Lake Band of Ojibwe, and federal, state and local representatives Oct. 29 to celebrate the harvesting of the 2014 U.S. Capitol Christmas Tree near Cass Lake, Minn. After the ceremony, the special 75-ft. white spruce from the Chippewa National Forest and the Leech Lake Band of Ojibwe was loaded onto a heavy duty trailer — expandable to 80 feet — and coupled to a Kenworth T880, Kenworth’s flagship heavy haul vocational truck. The official U.S. Capitol Christmas Tree tour truck is equipped with the powerful and fuel-efficient 500-hp PACCAR MX-13 engine with 1,850 lb.-ft. of torque, reliable Eaton Fuller 13speed transmission, and comfortable 52-in. mid-roof sleeper. The T880 was made available to Kenworth for the tour by PacLease, which provides customized full-service lease, rental and contract maintenance programs featuring Kenworth trucks.

The special T880’s distinctive design incorporates a U.S. Capitol night image, brightly lit and decorated Christmas tree, 2014 Capitol Christmas Tree official seal and logo of Wille Transport, a longtime Kenworth customer based in Cohasset, Minn. An owner-operator and a company driver with Wille Transport will pilot the Kenworth T880 — and a Kenworth T680 Advantage with 76-in. sleeper, respectively — during the more than 30-stop tour. The T680 Advantage will transport 70 smaller Christmas trees donated by the Minnesota Tree Growers Association. Those trees will decorate the inside of the U.S. Capitol building and other federal sites throughout Washington, D.C. The T680 Advantage also will bring 10,000 ornaments created by children and others from Minnesota communities to adorn the Capitol Christmas Tree and the smaller trees. Temporary pedestrian safety improvements also will be implemented on Mary Avenue NW and NW 92nd Street. Funding for this project includes a Federal Surface Transportation Program preservation grant of $1.1 million and Bridging the Gap funding of $2.7 million. Paving the Way Lakeside, the paving subcontractor, oversees a substantial portion of the project that involves equipment such as an EX-75 Hitachi excavator, an asphalt paver, an asphalt grinder, a concrete grinder, a 580 Case backhoe with breaker and numerous dump trucks. That equipment is being used to place 5,000 tons (4,536 t) of asphalt to create 2,000 sq. yds. (1,672 sq m) of sidewalk, 1,500 LF of curb and 60 ADA ramps. “Paving is weather-dependent, but under the guidance of general contractor Westwater Construction, work remains on schedule.” Cruz said, “We’ve communicated that the project would wrap up by the end of summer, which still looks to be the case. There are a few more milestones that need to be reached, but so far the weather has been a big help in keeping this project on

schedule. The project has [had] surprisingly great weather. There [have] been a couple of weather days, but considering it’s Seattle, that’s a pretty good statistic.” Work Schedule Work began the week of April 14, 2014. Normal work hours will be 7 a.m. to 5 p.m., Monday through Friday, with some weekend and weeknight work. project on Holman Road NW between NW 87th Street and 7th Avenue NW began the week of May 19. This phase will include replacing bridge expansion joints, which will require full weekend night closures in both directions. Working mostly 7 a.m. to 5 p.m., a crew of 8-15 has been keeping the project on schedule, but some nighttime and weekend work has contributed to maintaining the timeline. Late night and early morning grinding is allowed under the conditions of a city noise variance. “Residents have had several nights of grinding and paving throughout the project, which has been kept to a minimum as possi-

ble,” said Cruz. The project has even been lucky in regards to unforeseen issues that can often adversely affect a schedule. “We had one issue when a utility line broke underneath a newly paved surface,” Cruz said, “but it was not the fault of our project and our inspectors quickly contacted Seattle Public Utilities, who came out quickly to address the issue.” Getting Around One of the more challenging aspects has been traffic control. “The most challenging part has been maintaining traffic control and keeping traffic moving in the area,” Cruz said. “Holman Road is

a popular commute route for many drivers from different parts of Seattle. The most important part was communicating to that audience. We have maintained at least one lane of traffic in each direction at all times except for one 24-hour closure to make bridge repairs.” Some local bus routes were rerouted during these closures. Drivers have had to contend with occasional driveway and intersection closures, parking and loading restrictions near work zones, temporary bus stop relocations or closures and detours for pedestrians and cyclists. During the project, temporary wheel stops were installed to provide safer passage for pedestrians and bicyclists along Mary Avenue NW and NW 92nd Street. This improvement will be in effect until a new sidewalk is built as part of a Safe Routes to School project in 2016. “Drivers have had delays in their commutes or they have found alternate routes,” Cruz added. “Since we don’t know exactly where many of the drivers are coming from or going to, portable message signs in the roadway and getting the word out to local media to publish was important. We set up our messaging early and sent traffic advisories to local media outlets with personal follow up to make sure the news was shared.” A good community outreach program has kept complaints to a minimum. see SDOT page 44

“Businesses have seen a fluctuation in traffic, but no complaints have been filed for loss of business due to the construction work,” Cruz said. “We have maintained communication throughout the project, including preconstruction outreach,” Cruz continued. “We’ve done quite a bit of outreach to the community, from mass mailers, to door-to-door outreach, to visiting schools. Generally, people in

the neighborhood support the project. Some, however, have felt [that] the medians are not enough to protect pedestrians and would like to see more done. Due to budget constraints, however, that is not feasible at this time.” Local residents are vocal about the project. Cruz said that the community is highly sensitive to how work affects Piper’s Creek, which runs along the project area.

Update As of early September, crews had completed major sidewalk repairs, new ramps, bus shelter improvements, landscaping and paving work on Holman Road NW between 7th Avenue NW and Greenwood Avenue N. Wirtgen W 220: Big Power in Lighter-Weight Cold Mill The new W 220 cold milling machine from Wirtgen America Inc. rounds out the lineup of highperformance large cold mills from Wirtgen Group, providing the capabilities of Wirtgen’s largest machine in a lighter-weight machine that can be readily transported. The W 220 provides the milling width and depth of the heavier W 250i — Wirtgen’s biggest and most powerful mill — but with a lower weight that enables it to more easily meet legal weight load limits. The W 220 — like the W 250i — will mill up to 14 in. (35.5 cm) deep, at a nominal milling width of 87 in. (221 cm). Its power plant provides 766 hp, with an operating weight of 80,160 lb. (136,360 kg). The W 220 can produce up to 900 tons (816 t) per hour of reclaimed asphalt pavement (RAP). The Wirtgen W 220 can remove asphalt layers more than 1 ft. (.3 m) deep — and tough portland cement concrete pavements as well — at a high advance rate. Three different milling drum speeds can be adjusted from the operator’s platform: high speed for large-scale milling of thin lifts, medium for standard surface courses and low speed for optimized fuel consumption and low cutting tool wear. While the W 220 comes with a standard 87 in. milling drum width, via the optional FCS Light system, a 98-in. (249 cm) drum can be fitted. FCS Light also permits easy exchange of drums with standard tool spacing with those of wider or tighter tool spacings. The standard milling width of the W 220 can be extended with additional milling drum units for working widths of 8.2 ft. (2.50 m), 10.2 ft. (3.10 m), 11.5 ft. (3.50 m), 12.5 ft. (3.80 m), up to a maximum 14.4 ft. (4.40 m). In addition to removing com-

plete pavement sections in a single pass, the W 220 permits individual layers to be removed very economically. The intelligent WIDRIVE machine management system and the three selectable milling drum speeds keep operating costs very low for a cold milling machine in this performance class. The W 220 operating platform provides the operator with an optimal work environment, which speeds productivity and provides an abundance of operating information. Part of this intuitive operating environment — a multifunctional control display — operates as a practical information hub. It can be swung to the left or right of the operator — together with the Level Pro control panel — and dis-

plays operating status and servicing data in an easily comprehensible way. The control display provides user-friendly diagnostic options with clear graphics for identifying the source of any problem. Another handy function is the logging of job data: at the end of the day, the log can show how many trucks have been loaded and the overall tonnage achieved. The new W 220’s parallel-tosurface (PTS) system automatically aligns the cold mill parallel to the road surface. The system ensures simple, accurate operation of the machine in demanding profiling jobs. PTS also assists the operator with positioning the machine in the milled cut to initiate

the milling process. In automatic mode, the system takes care of all the steps that the operator would otherwise need to select manually one after another; the need for repetitious manual correction is eliminated. The operator activates the integral Level Pro control system at the flick of a switch, and all four crawler track units of the large milling machine are lowered simultaneously at high speed. When the milling drum unit reaches the surface to be milled, the lowering speed is reduced and the milling drum slowly penetrates the material down to the set depth. The automatic process helps to prevent excessive cutting tool wear or even tool failure when commencing the

milling operation. The same applies when the W 220 is aligned transverse to the direction of travel. In many cases, cold milling machines need to overcome significant differences in height when being moved into or out of the milled cut. The integrated four-fold, full-floating axle balances out all four track units quickly and reliably to reduce the machine’s lateral inclination to a minimum. This lends a high degree of stability to the large milling machine, according to the manufacturer. The W 220’s intelligent speed control (ISC) system ensures maximum traction. The ISC system is particularly useful for highly demanding milling jobs. Just like the traction control system of a car, ISC prevents crawler track slip and ensures perfect traction of all track units to achieve maximum milling performance, reducing track pad wear. When negotiating turns, the ISC system automatically increases the speed of the outer crawler tracks, depending on the steering angle. As a result, even extremely tight turns can be milled using the alltrack drive. Automatic adjustment of the advance rate to match the diesel engine load always ensures maximum performance yet quiet operation of the machine. An optional vacuum cutting system will remove dust, fines and smoke from the cutter chamber and extract it out of the conveyor, keeping the machine cleaner and prolonging component life. Crawler Concrete Pump Offers Easy Wear Part Access The crawler concrete pump THS 110 D-K with a concrete output of 133 cu. yds./h (102 cu m/h) and equipped with a six-cylinder engine, was unveiled by Liebherr. The series of Liebherr crawler concrete pumps encompasses three different models — the THS 80 D-K, the THS 110 D-K and the THS 140 DK providing maximum concrete outputs of 85 cu. yds./h (65 cu m/h) to 177 cu. yds./h (135 cu m/h). Smooth running and outstanding suction performance are the hallmarks of a powerful pump unit in the crawler concrete pump THS 110 D-K, while an open hydraulic circuit guarantees reduced system maintenance requirements. Additional structural details also contribute to optimum serviceability. Utmost importance was afforded during the design phase to ensure that wear parts could be replaced quickly and easily. The smooth surfaces of the pump housing are easy to clean and the shape of the concrete hopper, devoid of edges and projections, minimizes the accumulation of concrete residue and soiling. Bidders Brave Frigid Temperatures for Roller Auctions Sale in Denver

A

fair amount of snow blanketed the equipment on site at Roller Auctions’s heavy construction and contracting equipment sale, which was held on Nov. 6 and 7 in Denver, Colo. Bidders braved the frigid weather to check out wheel loaders, crawlers, motorgraders, hydraulic excavators, loaders/backhoes, skid steer loaders, bucket trucks, truck tractors, telescopic forklifts, dump trucks, pickups, flatbed trucks, trailers, utility trucks, storage containers, compaction equipment, street sweepers, attachments and much more.

More Than 2,500 Participate in Ritchie Bros. Phoenix Sale

M

ore than 2,550 bidders participated online and in person at Ritchie Bros.’s unreserved public auction at its Phoenix site. Bidders came from 44 countries, including 48 U.S. states. More than 69 percent of the equipment was sold to outof-state buyers, from as far away as Guatemala, Poland and Vietnam. Online bidders purchased 39 percent of the

equipment sold (by dollar value). In total, more than 1,700 equipment items were sold in the auction, including 90 plus scissorlifts, 70 plus truck tractors, 70 plus pickup trucks, 30 plus compactors and more. “We are very pleased with the participation and results from our November auction here in Phoenix,” said Chris Holmberg, regional sales manager,

Ritchie Bros. Auctioneers. “The 2006 CON-E-CO concrete batch plant which sold for $270,000 to an on-site bidder from Texas was one of the main highlights of the auction. specialty trades, and heavy and civil engineering — experienced an overall gain of 3,600 employees for the month and 99,800 (2.7 percent) over 12 months. “For the past several months, the construction industry has added jobs at double the all-industry rate of 1.9 percent rate,” Simonson said. “Construction wages, which were already higher than the private-sector average, rose 2.6 percent in the last year — the fastest rate since early 2010 — as contractors ramped up their search for qualified workers.” Simonson added, “There were fewer unemployed, experienced construction workers last month than at any time in the past eight years. Meanwhile, all construction employees worked an average of 39.2 hours per week, tying the highest mark since that series began in March 2006. Together, these indicators — high weekly hours, low unemployment and accelerating wage gains — point to an industry that may be on the verge of acute difficulty filling key positions.”

manner under Texas law. That liability does not impose extra liability beyond general law. The opinion amounts to another limitation of the attempt to improperly apply the contractual liability exclusion in the construction context. It includes a discussion of other issues, all of which were resolved in favor of coverage for the insured contractor. “This case will have big picture significance because it sets out another example of a court beating down the effort to extend the contractual liability exclusion to general breaches of contract,” said Patrick J. Wielinski, an attorney with Cokinos, Bosien & Young in Irving, Texas, who prepared an ASA amici brief. “In addition, it also clarifies the scope of the ‘your work’ exclusion to explicitly include damage to the named insured’s defective work and preserving coverage if it was performed by a subcontractor.” Wielinski noted that the opinion indicates that the amount of property damage need not be excessive. “This could open up coverage where a relatively small amount of property damage can give rise to significant consequential damages such as delay,” he said. “All in all, it was a good case for construction policyholders, and it may serve to cause the insurance industry to think twice about pursuing this line of argument, particularly since it lost again in the state where it had gained the most traction in the Gilbert case.” In the amici curiae brief filed on July 18, 2014, ASA, the Texas Building Branch of the Associated General Contractors of America, and the Texas Association of Builders asked the U.S. appeals court for a panel rehearing to decide whether damages for warranty claims due to an “occurrence” are covered under a standard CGL policy or are excluded from coverage by the “contractual liability” exclusion. “This Court’s opinion … denying coverage for defects in the construction of the Crownover home will have a profoundly negative effect, not only upon the construction industry and the insurance brokers and agents that service it, but also upon the ‘consumer’ side of the industry, that is, owners of projects, whether commercial, public or residential,” ASA, AGC-TBB and TAB wrote in the brief. “Amici curiae respectfully submit that the Court’s opinion misapprehends the scope of the coverage available to a contractor or builder for completed operations losses under its CGL policy. In applying the Contractual Liability Exclusion to the express warranty context before it, the Court over-extended the exclusion’s scope far beyond the Texas Supreme Court’s opinion in Gilbert …, as clarified and limited by Ewing …. Read together, those two opinions establish that the ‘assumption of liability’ that is excluded must exceed the insured contractor’s liability under general law [Gilbert] and that the implied warranty against defects, equivalent to the implied warranty of good workmanship, does not constitute such an assumption in excess of general law [Ewing].” For more information, visit www.asaonline.com.
