The World Stadium Congress Awards, held at the Westin Doha on May 22 as part of the congress, recognized the best in the industry.

The focus of the event, which took place from May 21 to May 24 at the Westin Doha Hotel in Doha, was on the delivery of stadia and infrastructure and the legacy impact they have on the urban landscape.

This year’s judging panel included industry experts Philipp Herpel, Managing Director at HFP, Mark Fenwick, Partner at Fenwick Iribarren Architects, and Chris Dite, Associate Director, Sport Venue, Design and Major Events at Arup.

The congress began with a welcome speech from the host sponsor, Vodafone, followed by keynote presentations from local and international leaders.

The awards received nominations from over 20 organizations across six different categories with the eventual winners decided by the independent judging panel as follows:

C

onditional payment clauses or “pay when paid” clauses are a common feature of construction subcontracts in Qatar. In their most common form, they provide that a subcontractor or sub consultant will not receive payment until the main contractor or main consultant has received payment from the Employer.

Such clauses are primarily designed to avoid cash flow problems for main contractors or consultants in the event that payment from the employer or client is delayed.

In principle, pay when paid clauses are valid under local law. While other jurisdictions, such as the United Kingdom, render such clauses void, the position in Qatar is different.

In accordance with the “General Principle”, enunciated in Articles 171 and 172 of Law No 22 of 2004 (the “Civil Code”), parties are essentially able to agree the terms that govern the relationship between them unless such provisions are contrary to public morals. This is akin to the familiar common law freedom of contract principle.

Article 171(1) of the Civil Code states: “A contract is the law of the contracting parties and so cannot be revoked or modified except with the agreement of the parties or for such reasons as are prescribed by law.”

The General Principle is reiterated in Article 172 of the Civil Code which states: “(1) A contract must be executed in accordance with its contents and in a way that is consistent with the requirements of good faith.

(2) A contract will not be confined to binding a party to what is contained therein but will also include the inevitable consequences thereof, in accordance with the law, custom and justice and according to the nature of the obligation”.

Further, Article 169(1) of the Civil Code states: “If the terms of a contract are clear, it will not be permitted to deviate from them by interpreting them in order to ascertain the will of the parties”.

Generally, therefore, parties are bound, under Qatar law, by the provisions of the contracts to which they have signed, including those which act as “pay when paid” clauses.

In a manner consistent with the general approach of civil law, there are some principles of local law that have been applied in the past to mitigate the harsher effects of conditional payment clauses. Whilst we are unaware of recent Qatar court decisions directly on point, relevant Cassation Court judgment (which can be persuasive in other jurisdictions) exist which support a submission that conditional payment clauses are inconsistent with local law. The cases often relied upon in UAE law, include Cassation No. 281/1996.

The Court of Cassation, Dubai’s highest court, in Cassation No.281/1996 dealt with two principal grounds of appeal. Of relevance is the challenge made to the Court of Appeal’s interpretation of the subcontract (which was the subject of the decision).

oka, one of the leading firms in the formwork industry, has successfully concluded its eponymous Safety Day, which was held under the patronage of Waleed Al Khal Fakhroo, Health Safety, Environment and Quality (HSEQ) Director of Lusail Real Estate Development Company (LREDC) in conjunction with Doka Qatar WLL and with the concerted support of Mark Stephens, HSE advisor, Qatari Diar Real Estate Investment Company.

Held at the Al Wosail Ballroom, the Ritz-Carlton Doha, the event included a combination of speeches and presentations, along with the opportunity for some practical demonstrations which focused on the occupational health, safety, environment and fire prevention aspects of the Lusail City Development Project, one of Qatar’s most ambitious mega-projects, which will cover an area of 38 square kilometers once completed.

Speaking about the inspiration behind the event, Doka Qatar Managing Director Harald Hartung underlined the importance of safety at work. “Doka has always prioritised safety on site,” he noted. “As a company, we believe that working safely is an essential ingredient to completing the task in hand both quickly and efficiently. “Having liaised with the representatives of the LREDC HSE Forum, their team paid us a visit to our Mesaieed site in December last year, where they showed great interest in our facilities and, in particular, our safety products and systems,” he said.

“Given our time constraints on the day we were unable to provide our guests with an in-depth scope for all our safety features, so we decided to co-ordinate a specific event which would allow not only LREDC to fully understand what we offer, but also provide an opportunity for industry stakeholders to come and see first-hand how our products and systems have been designed to offer maximum protection for all site staff,” Hartung pointed out. “In brief, the inspiration behind the joint “Safety With Doka” event was to share our conviction based on decades of international experience that working in a safe site environment means working fast and efficiently and to showcase the diverse range of products and systems,” he said.

With a turnout of more than 260 participants from over 75 organizations and companies, Doka was able to showcase a number of its latest safety enhancing products and systems, including Edge Protection; a universal safety solution that is fully compatible with Doka floor formwork. Equipped with an all-in-one guardrail, the system is “hot-dip” galvanized, making it extremely sturdy. It is also EN 13374-compliant and can be used on any shell structure as well as on Doka floor formwork systems.

Construction safety is highlighted at Doha conference

W

hile significant improvements in applying and enforcing safety standards have been made since Qatar started its accelerated construction program just over 10 years ago, the way is still long for achieving total safety at construction sites in the state.

Ibrahim told the conference that these days all inspectors were qualified and well trained before they went to sites to be aware of the risks they could face and how to find violations.

“When we started here in 2006, safety requirements in Qatar were not compatible with similar requirements elsewhere. The labor law was new and most companies didn’t know its requirements,” he said.

“We had to first change the mentality of the inspectors themselves. They can’t be inspectors for safety and don’t understand the safety requirements or wear the right personal protective equipment,” he added.

Amid the construction boom that followed Doha’s hosting of the Asian Games in 2006, the country witnessed a project rush that had negative effects on quality and safety.

That’s when trained inspectors from the Ministry of Administrative Development, Labor and Social Affairs (MADLSA) undertook spot checks of construction sites and labor camps, where blue-collar workers typically live, to ensure they comply with the country’s 2004 Labor Law. “We had a challenge and it was like a mission impossible. We had to ask people daily to go to construction sites and teach others about safety,” Salahedin Ellatief Moussa Ibrahim, occupational health and safety expert at the ministry, said at Qatar’s inaugural HSE and Fire Safety Conference.

Ibrahim and his colleagues started to do site visits and organize seminars and other activities to inform contractors and other stakeholders about the safety requirements of the new law.

“Because people working in the construction sector came from different countries and backgrounds, the law stressed the importance of laborers training. The initial goal was to decrease fatalities and accidents,” he said.

Ibrahim said that as we approached the hotter months of the year, it’s important once again to highlight the Ministerial Decision 16 for the year 2007 about reducing heat stress and rules for working outdoors in the summer.

t is always critical to handle heavy machines with the highest possible care.

In recent years, multiple accidents and fatalities were reported due to lack of proper knowledge on handling heavy equipment.

For example, in 2015, one foreigner was killed and more than three others were wounded when part of a construction crane fell near the F Ring Road in the Old Airport area in Doha.

It is worth mentioning here that strong winds were blowing across the country, as forecast by the Meteorological Department earlier, while the calamity struck. Soon after the accident, many construction companies in Doha had reportedly started alerting their staff against operating cranes when the wind speed remained higher than the definite limit.

However, accidents could happen in different ways at different times. It is, therefore, a must that all operators have identifiable and verifiable training on the equipment in advance of operating them.

Here are 10 important heavy equipment safety tips to avoid accidents: 1. Know your blind spots It is very imperative to know your equipment’s blind spots; you have to make sure that no one and nothing is behind your vision. To avoid blind spots, the operator must sometimes physically get out of his machine and go to the back to look since the mirrors do not always provide a 360-degree scope of vision.

2. Maintain constant communication Always be in constant communication with the people working around you - the ground crew, and their supervisors. A two-way radio is the best form of communication at present. If that option is not available, spotters could be the alternative. Spotters should wear high-visibility clothing and stand clear of equipment so they are visible to the operator at all times.

3. Don’t forget to wear seatbelts Wearing your seatbelt in heavy equipment is just as important as in a moving motor vehicle. There is no excuse or laziness for not wearing it at all times. In case of a rollover, this can be a life saver.

4. Maintain the three-point rule According to OSHA, falls are some of the leading causes of injury. A good rule of thumb is to always maintain a three-point contact when getting on or off of your equipment and never jump. The three-point rule requires three of four points of contact to be maintained with the vehicle at all times – two hands and one foot, or both feet and one hand.

5. Loading/unloading equipment Always be sure to be on level ground when loading or unloading your equipment. It greatly reduces the risk of rollovers or sliding off the low-bed ramps. If you are unloading on a busy jobsite or high traffic area,

make sure people are clear of the unloading area and use a spotter to guide you.

6. Overhead and underground hazards Before work starts on any jobsite, all overhead obstructions such as power lines and low clearance should be identified and flagged. Underground utilities such as water, sewer, gas, and electrical need to be located by the appropriate department and marked with color-coded paint. Play it safe when getting close to the underground utility and hand dig to uncover. When leaving dugout holes that workers or the public can fall into, be sure to set up barriers.

atar is the fastest growing construction market in the Gulf region. The country’s 2017 budget has been received favorably by construction companies and

experts alike.

The construction sector in Qatar is estimated to peak in the first half of 2017. According to experts, since the fourth quarter of last year, as the private sector became more confident in investing in healthcare and education, the construction sector had begun to gain momentum.

Despite the economic crisis resulting from lower oil prices, the budget for infrastructure and construction received another increase to make sure that the projects could be completed in time. Qatar will invest up to $13 billion in major infrastructure projects next year despite a slump in oil revenues.

Increasing the investment in mega projects reiterates Qatar’s commitment to achieving its goals. Spending will be up to $13 billion on new projects in 2017. The country had already spent almost $98 billion on large-scale projects.

Most of the investment in the next few years will be in construction and transport as the country gears up to host the FIFA World Cup 2022. Construction would account for 45% of investment between 2015 and 2018, and transport almost 30%.

A new set of construction codes will be released in Qatar by 2018. The total construction industry contractor awards in Qatar are expected to increase from $18,909 million in 2016 to $26,622 million in 2017 (refer Figure 1).

As of January 10, 2017, the building construction sector registered the highest project value of 49% followed by the infrastructure construction sector (33%) and the energy construction sector (18%).

Qatar Budget 2017

On December 15, 2016, Qatar’s Ministry of Finance released its budget for 2017 wherein it outlined its fiscal outlook for the coming year.

The 2017 budget is based on an oil price assumption of $45 per barrel and efforts to boost non-oil revenues. Capital spending is expected to increase in 2017 to support Qatar’s preparation for the FIFA World Cup 2022 and economic diversification objectives.

QNV 2030 and FIFA World Cup 2022 are likely to be the key growth drivers for the construction industry in Qatar in the coming years. Qatar looks to become a developed nation by diversifying its economy achieving sustainable development

and providing a high standard of living for its population through its Vision 2030.

A number of infrastructure projects are expected to be undertaken by the government in preparation for the FIFA World Cup 2022 event, providing the necessary stimulus to the growth of the construction industry.

The event was the major reason for Qatar not suffering a severe slowdown as some of its GCC neighbors did in the wake of low oil prices.

The government has also outlined in the budget its intent to further accelerate investment and infrastructure spending in the coming years.

The main objective of the 2017 budget is to ensure that major projects in the key sectors are implemented and completed in addition to projects related to the 2022 World Cup and in line with the approved schedule.

The highlights of the budget are as follows: • Revenues estimated at $47 billion (QR170.1 billion) • Expenditure estimated at $54 billion (QR198.4 billion) • Projected revenue 9% more than 2016 revenue • Budget deficit down 39.1% from $13 billion (QR46.5 billion) in 2016 to $8 billion (QR28.3 billion) in 2017. The deficit is expected to be taken care of by the issuance of debt instruments in the local and international financial markets.

ore than 40,000 football fans attended the launch of the first proposed host venue of the 2022 FIFA World Cup in Doha last month, with HH the Emir Sheikh Tamim Bin Hamad Al Thani officially cutting the ribbon at the new Khalifa International Stadium in front of the sellout crowd.

Speaking on the launch of Qatar’s first World Cup stadium, FIFA President Gianni Infantino praised the level of World Cup preparations in the state.

“As organizers, to see a 2022 FIFA World Cup stadium already delivered and fully operational is a great joy, besides giving us confidence regarding the level of preparations in Qatar,” said Infantino.

“There is undoubtedly strong commitment from the local authorities through the Supreme Committee and although five years seems a long way off, the benefit of time will make sure Qatar delivers an amazing tournament in 2022,” the FIFA President added.

Expanded to seat more than 40,000 spectators, the stadium has undergone extensive renovation works ahead of the FIFA World Cup, when it will host matches until the quarter-finals. These include the installation of revolutionary cooling technology promised during Qatar’s successful bid, which on the inaugural night kept

the pitch at 20°C and the stands at 23°C while using 40% less energy than traditional cooling methods.

HE Hassan Al Thawadi, Secretary General of the Supreme Committee for Delivery & Legacy (SC), the organization responsible for delivering the infrastructure required to host the 2022 FIFA World Cup, described the stadium launch as a major milestone.

“The completion of our first stadium more than five years before the Qatar World Cup begins is an important milestone that reflects our determination to deliver a tournament the entire Arab world is proud to be a part of,” HE Al Thawadi said.

The entire spectator area at the stadium is covered by a new roof, with an intricate net of German and Italian-made steel tension cables weighing 4,000 tonnes having been put up to hold the 92 panels in place. The stadium will also be the first FIFA World Cup venue and the first of its kind in the region to be lit by LED lighting, which is both more sustainable and more versatile than traditional lighting.

Qatar gets serious about solar With a target of producing 20% of its electricity using solar energy by 2030, a series of public and private investments are driving new developments in Qatar’s solar energy sector.

Production begins at major solar plant At the end of March, Qatar Solar Technologies (QSTec) – a joint venture (JV) between Qatar Solar (a subsidiary of Qatar Foundation), Germany’s SolarWorld AG and Qatar Development Bank – announced that the first polysilicon had been produced at its new production plant in Ras Laffan Industrial City, 80 km north of Doha. Polysilicon is a high-purity form of silicon and a key component in a range of solar photovoltaic (PV) technologies.

The projected increase in polysilicon output over time is likely to be matched by growing demand for PV technology. According to the latest “Global Power Industry Outlook” from research consultancy Frost & Sullivan, solar photovoltaic will be the energy sector’s highest growth area this year, with investment forecast to increase by 11.5% to €141.6bn.

The MENA region is itself a strong market for PV products, where increased awareness of the need to diversify the energy mix prompted investments in solar projects to grow from $160m in 2010 to $3.5bn in 2015.

Broader vision Qatar will be looking to maintain this momentum in renewable power generation as it continues to pursue its long-term strategy plan, Qatar National Vision 2030, which aims to fill an expected growth in power demand while simultaneously increasing the sustainability of the country’s energy mix.

Between 2006 and 2016, power and water consumption recorded average growth rates of 10.4% and 7.7% a year, respectively, according to data released by Qatar Electricity and Water Company (Kahramaa), the country’s main utilities regulator.

Furthermore, research conducted last year by the Arab Petroleum Investments Corporation shows that Qatar will need to attract $9bn in its power sector between 2016 and 2020 to keep pace with electricity demands.

Power supply One upcoming project that is set to fulfil part of this need is a 200-MW solar power plant being developed by Siraj Power – a JV between Kahramaa and Qatar Petroleum, which has provided $500m in start-up capital for the project.

The factory, which is currently in the final stages of being commissioned, will have an annual production capacity of 8000 tonnes and is expected to start exporting later this year.

Construction of the facility is scheduled to start in June, with plans already in place to expand the project’s capacity to 500 MW in the future.

Continuing to attract investments of this scale should not pose too difficult an obstacle, as Qatar’s location is ideal for future solar projects. According to the Climate Technology Centre and Network, the annual solar energy potential of each square kilometer of Qatari soil is equivalent to 1.5m barrels of oil.

Multiple applications Qatar has also been encouraging the use of solar technology in the urban environment.

Several large-scale developments are deploying rooftop solar installations as part of their energy infrastructure, including Mshereib Downtown Doha, a sustainable downtown regeneration project; Lusail City, a planned city on the coast north of Doha; and Energy City, an integrated energy hub being built between Lusail City and the capital.

Five of the FIFA 2022 World Cup stadiums are also slated to use pioneering solar-powered cooling technology.

Speaking to media in July last year, Khalid Al Subai, acting executive director of the Qatar Environment and Energy Research Institute, underlined the potential for rooftop solar solutions in Qatar, with electricity demand closely tracking solar intensity during the hottest months of the year.

“Thus, rooftop solar becomes very cost effective in lowering peak electricity demand, which is very important to Qatar’s utilities,” he said.

usinesses that recruit a diverse mix of employees are more likely to be highly innovative and creative in their respective industry, new research has found.

It is crucial for successful business and entrepreneurship, strengthening a nation’s economy in the process. The more diverse a workplace is, the more it benefits from creative and innovative thinking. It is the ethos of the world’s most successful and respected companies around the world.

In a new YouGov study exclusively commissioned by DP World, 77% of respondents* from the GCC and North Africa strongly agreed that cultural diversity was key to a more innovative workplace.

A large majority of respondents (78%) said that they were more attracted to a company that employed a diverse mix of employees, rather than ones with employees who matched their own background, culture and thinking.

Other important factors linked to innovation in the workplace were a balanced mix of age groups (68%) and a balanced ratio of male-tofemale employees (61%).

The results of the study, entitled “Diversity in the Workplace”, were revealed by DP World Group Chairman and CEO, Sultan Ahmed Bin Sulayem at the 16th edition of the Arab Media Forum (AMF).

The 2017 event, which attracted prominent industry leaders and media professionals from the region and beyond, took place between

May 1-2 at Madinat Jumeirah Dubai under the theme, “Civil Dialoge”.

Sultan Ahmed Bin Sulayem said: “We talked to young people in our region and listened because they are our leaders of tomorrow. The findings highlight how cultural diversity is more important than ever to them in their workplace.

“It is crucial for successful business and entrepreneurship, strengthening a nation’s economy in the process. The more diverse a workplace is, the more it benefits from creative and innovative thinking. It is the ethos of the world’s most successful and respected companies around the world.”

While increased cultural diversity resulted in greater creativity and innovation, the research found that it also increased productivity and made for a more engaging and enjoyable working environment.

Comparatively, the majority of respondents felt that religious diversity and inclusiveness of colleagues with disabilities had a limited effect on innovation, highlighting that personal beliefs or circumstances should not influence a hiring manager’s decision in attracting the right talent.

Sultan Ahmed Bin Sulayem concluded: “Diversity and inclusion enhances our talent with different world experiences and skills, they make us an employer of choice, and they make us a sustainable company for the long term.
