Spring is nearly here I, like many of you, returned to the office in the New Year full of enthusiasm and expectation for 2016.

It would be wrong to say that the difficulties of the past few years are behind us, but the message from Chamber’s members over the last quarter of 2015 was generally positive with businesses anticipating growth in both revenue and profits for 2016.

Elsewhere Richard Digard sheds some light on the new States Trading Supervisory Board and looks at its role, what it encompasses and the possible direction of travel in the future.

Yet, as I write this, the global stock markets are doing their best to dampen our enthusiasm. At times it is difficult to connect the dots. Clearly China’s growth has been curtailed, but we should never forget the fact that it is still growing at a far faster rate than most Western economies and we are operating in an age of low oil prices - so low energy costs, low interest rates and low inflation. There will be Chamber members who look at this and say “exactly”, and we know how to take advantage of this market turmoil for the benefit of our businesses and Guernsey. This month our feature interview is with Richard Le Tocq, the recently appointed head of Locate Guernsey. Richard has a huge task on his hands, not just in terms of scope, but also conceptually, changing the mind-set of this island from its traditional quiet and understated position to understanding that in today’s modern and fast moving world we need to actively promote and advertise our island, its business skills and the vast

As I sign this off, the in/out campaign for Europe intensifies. The next few months will be fascinating I am sure. Of course we hope that Europe does not overshadow our own April elections. Significant expansion for TravelSolutions One of Guernsey’s leading travel agencies, TravelSolutions, has started 2016 with a bang. The company has taken on the lease of the offices next door to its current location at 1 The Albany and, following a comprehensive refurbishment programme to combine both sites, has in effect doubled the size of its premises. In addition, the team has expanded significantly, with five of the former Hot Mango Travel staff having joined TravelSolutions this month. This takes the

We took on the Uniglobe franchise in 1992 and, from 1995 we were actually based in the premises that we have just taken over – 2 The Albany. So in some ways we are almost back where we started – but with a very different and much larger business.’

‘The travel industry has changed considerably since we started out and clients now require a far more bespoke tailored service, which we are very happy to be able to provide. Aladdin’s Cave named Independent Toy Retailer of the Year Leading local retailer, Aladdin’s Cave, has been voted 2016 Independent Toy Retailer of the Year at the 51st Toy Industry Awards. Organised jointly by the British Toy & Hobby and Toy Retailers Associations, the Toy Industry Awards were presented following the first day of the 63rd Annual Toy Fair which recently took place at Olympia in West London. ‘Toy of the Year’ was awarded

Startup Guernsey celebrates its move to the Digital Greenhouse

Jennifer Strachan, CEO of Startup Guernsey also thanked the Commerce and Employment department and the Digital Greenhouse team for their work on the launch of the new facility and said how the Digital Greenhouse was already proving to be a fantastic working and training space for Startup Guernsey.

Startup Guernsey hosted its first alumni and supporters to mark its recent move to the Digital Greenhouse.

Given that the Digital Greenhouse offers a great space to support co-working for start-ups in the digital and creative sectors, Jennifer hopes the Digital Greenhouse will become a single place to come to find out about new ideas, innovation and inspiration for both entrepreneurs, as well as for “intrapreneurs”. In other words, spreading the innovation to the many thriving businesses here in Guernsey.

Guernsey hits insurance milestone Guernsey ended 2015 with more than 800 international insurers – the first time annual figures have recorded the island being above the 800 threshold. The figures show that there were a total of 804 international insurers licensed in Guernsey at the end of 2015, comprising 242 limited companies, 64 Protected Cell Companies (PCCs), 444 PCC cells, 13 Incorporated Cell Companies (ICCs) and 41 ICC cells. This compares to a total of 797 international insurers being licensed by the GFSC at the end of December 2014,

Skipton International named Guernsey Business of the Year

The nine from Guernsey and two from Jersey are a year through their two-year, part-time course which is run by the GTA University Centre in association with the University of Southampton. They joined a team of international students from China, America, Turkey, Argentina, Japan, Indonesia, Taiwanand South Korea for the week-long visit which aims to provide an international context to the skills and knowledge gained during the first part of the course.

The Guernsey Awards for Achievement Gala Dinner in February celebrated the successes of companies from across the Guernsey business sector with Skipton being presented with the Commerce and Employment Business of the Year Award.

The group attended a series of morning lectures in the Dutch city followed by visits to companies where they were exposed to real life issues and tasked to find solutions as part of a mixed international team. The group also visited the European Commission in Brussels to gain a policy perspective on issues surrounding global and European business.

Guernsey may be small but the island is packed full of creative problem solvers. Like sardines in a tin or like cars on our roads there is no shortage of talent and experience especially in the field of architecture.

This year, in addition to the awards presentation there is a celebratory black tie dinner organised by the Guernsey Society of Architects on Friday 1st April at the OGH.

The organisers of the Guernsey Design Awards have announced the shortlist for this year’s event reducing 37 entries down to 17. The biennial competition, which is developed by Norman Piette, the Guernsey Society of Architects and the Environment Department has been established to honour distinctive, original, inspirational and sustainable building design within the local environment.

The competition also features awards for Residential New Build, Residential Renovation/Extension, Non-residential and a Small Projects Award. The popular ‘People’s Choice’ award category, where the winner is chosen by the general public from the short-list remains along with the Norman Piette Contractor’s Award, presented to the contractors of the winners in each category. In addition, this year sees the introduction of a new heritage category. This will cover works to conserve or enhance historic properties. Allowing the judges to recognise the difficulties and the different approaches required for the very important job of conserving and refurbishing our historic buildings.

CHAMBER NEWS Contact spoke to Martyn Dorey, Chamber’s vice president about what he considers to be the key issues facing the island and how he wants to see a more collaborative approach between business and government in tackling them.

‘In order to build a sustainable future for the island, the community, business and government must work hand-in-hand. We all have our own strengths, and by working together we will ensure the future success of Guernsey. ‘I think the community and business need an opportunity to consider government decisions with all the facts to hand considering fully the social implications of them and contributing towards finding the right solution. Building a more in-depth understanding of all of the facts and taking time to reflect before responding is a good approach. ‘We are facing a number of issues that we need to address together. For example, we have a challenge in matching our tax structure to our demographic changes, and we need a working population that is resilient and independent of the state, which is why the optional secondary pension proposals will help. ‘The way we do business is undergoing tremendous change, and the island with its unique position and ability to adapt is well placed to be at the forefront of that change. The impact of technology on the lives of us all has only just begun. Our government working in harmony with the business community will be able to capitalise on the unique advantages Guernsey has.’ Martyn would like to see the island take a much more visionary approach by government and industry alike.

‘We need to work together to develop a vision for our island, a vision that appeals to our horticultural heritage, our maritime ancestry and our future as an outward looking jurisdiction. Previous generations developed a beautiful harbour and then stuck a car park on it – we can do so much better! The built environment has an effect on our behaviour and our culture. Many within the business community recognise the importance of making the east coast a leisure destination with a beautiful, inspiring environment. Something bolder and something that gives us pride in our seafront.’

Acknowledging the need for economic diversification, Martyn has reflected that in his own business model. He spends around half his time working within the finance sector and the other half in software development, currently involved with a major project which involves the same technology that Google’s driverless cars use to identify stop signs.

‘It does make you ask why can’t we have a ‘Garden Harbour’? We need people to think outside the box. There are some incredible ‘ideas generators’ both on and off the island and we need to capture, nurture and promote those ideas and be daring about what we do.’ Having spent most of his career in London, Martyn returned to Guernsey a few years ago and now runs his own business. ‘Guernsey is still a great place to bring up a family. But when I returned to the island it felt quite different to when I left 20 years ago. In some areas we need to tackle complacency that has crept in after years of economic abundance. We have to revive the growth mentality. Guernsey is a great place to live and for our children to grow up in. We need to focus on making it a great place to work too – not just for our generation but for future generations too. As part of this, business needs to work with government to ensure the island is able to attract and retain the best talent to our shores. ‘There is absolutely no reason why Guernsey can’t be a global exemplar in so many ways by taking bold decisions to create a living and working environment that people want to share and that the next generation is proud of - even if some of them leave and return at a later stage in their life. I would love to see a greater spirit of

The justice system is also an area where Martyn would like to see some reform. ‘98% of the local population can’t afford access to the law, I don’t mean commoditised functions like conveyancing, but significant commercial and family law legal support. The challenge is going to be about what we need to do to solve the legal access problem in a financially sustainable way. The justice system should be an enabler not a tax.’

‘This makes the business more resilient and sustainable in the longer term. We must embrace technology and not see the things like the internet as a threat but an opportunity. I would love to see driverless shuttles used along the seafront, initially to Admiral Park and then eventually to the Bridge area – the technology already exists so why isn’t Guernsey one of the early adopters? To ensure a successful future we need to encourage more progressive thinking.’ For Martyn, engaging with the younger generation and getting them immersed in the decision-making process is essential. ‘Young people need to be given a voice – that’s where the new visions and ideas will come from. I would like more young people involved with Chamber and give them the support they need. If we are trying to attract a younger workforce, we need to involve the younger generation in the process at an early stage. ‘Guernsey has the capacity to be an amazing place to live and work and we need to have more vision to create the environment in which future generations will thrive.’

Guernsey’s States itself is embarking on its public service reform programme, with both the political and operational arms of government being restructured. Even Treasury and Resources, which assesses and comments upon all proposed States programmes for financial and resource implications, disappears after the April general election with the Policy

A Guernsey health and social care revolution to retain all of the best parts of the existing hybrid model but to remodel HSSD fit for purpose and sustainable over then next few decades.

Coach or consultant? Alan Chapman of ActionCOACH and Greenlight Consulting takes a look at the key differences between these two areas of professional service and outlines how a business might identify which will suit its particular needs ‘Coaching’ and ‘consultancy’ are terms often confused, regularly misused and sometimes erroneously considered synonymous. There are some clear distinctions between the two and understanding these differences will help a business select which is appropriate to the particular situation or to tackle a specific issue for which it requires external assistance and support. Relationships A coach will assume that the company principal or senior team has the appropriate knowledge and experience to solve the issue or resolve the situation the business is facing. However, he needs the support of the coach in bringing out the skills required to facilitate a transition, reach his own career goals or to develop a required solution for himself. A consultant will work directly on an issue, sometimes bringing an additional set of skills or particular expertise to the problem. This could be in areas such as strategy planning, digital marketing techniques or transformational change. The consultant will then recommend a solution or a plan of action and will often be required to assist with its implementation. The focus of consulting is to get projects and tasks done that will enhance your business. A management consultancy often has its own team, and works with the client's management team to achieve whatever business objectives it was brought in to achieve. Whereas coaches typically - though not exclusively - work on a one-on-one basis with a client to help him increase his own potential or tackle a particular situation. Methodology Generally speaking a coach will: •

use coaching techniques to work on the problem through the principal in one-to-one sessions, encouraging the principal to develop action plans to solve the problem.

The principal is responsible for the action plans • act as the principal’s ‘friend’ • focus on the individual and ask questions whereas a consultant will generally • work with and for the principal • work with the principal and undertake research in order to understand the problem and where its root cause lies. The consultant then proposes a solution and completes other work needed to determine if the initial hypothesis is correct, making the required modifications until a solution is clear • act as an agent for the principal • focus on the task

Coaching and consultancy are two distinct approaches to addressing a business need. Inevitably there will be some overlap between the two disciplines and some professionals can successfully fulfil both roles. Which one is for you? This is all very well, but how do you, as a business owner, identify which approach is better for you? There is often no clear-cut answer but start with considering these questions: • What are your personal needs? • What are you trying to accomplish? • What stage is you business in?

• What specialist knowledge do you need from a coach or consultant? A coach is the right choice If you want support to keep yourself accountable and on the right track to achieve certain objectives; or if you seek objective advice or even need someone to push you outside your comfort zone. However if you have a particular project you want completed or if you are looking to introduce transformational change across the orgnisationor in specific areas (IT, HR) or right across the business, then a consultant will be a better fit. Competence The experience and skills of the coach or consultant are evidently key factors in the decision-making process. You would expect a coach to have had the relevant coaching training and to be generally competent in business. He will often have held senior posts but this is not necessarily essential. He will be specifically skilled in working with senior professionals to awaken inner strengths and developing their competences and confidence. A consultant will have held senior posts and will normally hold an academic business and professional project management qualification. He will bring specific expertise in one or several areas of management. Conclusion Coaching and consultancy are two distinct approaches to addressing a business need. Inevitably there will be some overlap between the two disciplines and some professionals can successfully fulfil both roles. Asking yourself the right questions with regard to your business’s specific situation and needs will help you make the right choice. Most importantly neither is a better approach than the other. Both can deliver tangible benefits to a business and make a positive impact on a company’s bottom line.

The Locate Guernsey initiative seems to have been a long time in the making but the support for its establishment as a means of creating economic growth for Guernsey is unquestioned. Contact spoke to Richard Le Tocq, recently appointed as head of Locate Guernsey, who explained how his feet haven’t touched the ground during the first few weeks in the role ‘The last couple of months have been about building the foundations. ‘Relationships are going to be key to the success of the initiative and so I have been meeting stakeholders, making presentations, speaking to prospective ‘re-locators’ and attending conferences. In the first four weeks alone I had five meetings with prospects, attended four conferences and held over 40 stakeholder meetings. ‘We have since held stakeholder presentations – all to ensure that people are aware of what we are doing, how we can work together and to make sure that the Guernsey message is consistent. The presentations had an extremely good take up and attracted a wide range of senior professionals from across the island’s business sectors. One of our challenges is to reach all of our stakeholder groups effectively since they represent a very wide spectrum of professions – from lawyers to estate agencies, from tax advisors to relocation consultants.’ Locate Guernsey comes under the remit

of the Commerce and Employment Department and Richard, working with two other members of staff, is responsible for a budget of £1.2 million over a three-year period – funding that was agreed last year by the Policy Council and Treasury and Resources. ‘We have to be smart about how we spend our budget. Working with the local business community will be key to our success. One of our ‘routes to market’ will be through professional advisors and intermediaries – much as it is for say the local fiduciary sector. They will have clients seeking to relocate themselves or looking for a jurisdiction for the migration of a business. We want Guernsey to be high up on the list of options. ‘I have a strong network of contacts in the island who in turn have their own databases of business associates in the City and beyond. We can plug straight into these networks and therefore we are knocking on an open door.’ There has been a slight shift in emphasis for Locate Guernsey since the initiative was first

under discussion as Richard explained: ‘Originally when the project was first debated, the focus was almost exclusively around attracting HNW individuals to relocate here through purchasing an open market property. The remit has widened since then and we are looking to stimulate real inward investment by attracting businesses to relocate to the island. Some individual relocations will inevitably also follow as a direct consequence.’ More specifically, Locate Guernsey’s plan involves four distinct strands of business and target markets. ‘We clearly need to ensure that there is cohesion between Locate Guernsey’s objectives and those of the States’ overall economic strategy. The latter seeks to support both existing business sectors as well as seeking opportunities to diversify the economy and our plan reflects that bilateral approach.’ Richard outlined the four campaign areas on which he and his team are concentrating.

Insurance sector Attracting re-insurance companies to the island. This plays on one of Guernsey’s recognised strengths as a jurisdiction with a worldwide reputation as a centre of expertise in the insurance industry. There have been two relatively high-profile re-insurance companies that have recently re-domiciled to Guernsey and the plan is to build on this initial success. Fund sector Encouraging fund managers to relocate to Guernsey. This might involve the relocation of the principal of the business or just the fund management company itself. This in turn may create employment opportunities within the island established fund sector. UK Resident non-domiciled taxation With the forthcoming changes to the UK ‘res-non-dom’ taxation regime, there is an opportunity for HNW individuals to relocate from the UK to avoid becoming UKdomiciled under the new rulings. Many may be seeking to move away from the UK for a specific period of time but Richard believes

that some who relocate to Guernsey may choose to stay longer term and become economically active, either through a business interest, through local investment or even philanthropy. Digital Richard admits the digital arena is an extremely broad and fast-moving environment and can encompass everything from software development to fintech. He explained that working closely with local experts and seeking their views on how best to manage a campaign aimed at these businesses, will be essential to maximise return on any activity the team undertakes. Richard describes Locate Guernsey as a true private/public sector partnership and he sees it working in a similar way to Guernsey Finance. ‘The Guernsey Finance structure has been extremely successful and its team has achieved some real successes through the strength of the relationships with and involvement of the local business community. Business leaders and sector

experts are always willing to participate in an event and whilst they no doubt have an eye on the potential commercial gain, they are also considering the ‘greater good’ of the island. This is a model I would like Locate Guernsey to replicate. ‘Industry leaders will be our ambassadors. Many of them are already out there ‘flying the flag’ for the island. It’s just a question of everyone communicating the same message - that our local government is open to new business; that the relocation process doesn’t have to be administratively onerous; and that we can offer a great way of life. ‘We are already including the private sector in our own activity. Some of the meetings we have held have involved industry representation including say, a tax advisor or a fund administrator depending on whom the meeting is with. This multidisciplinary approach means we can cover most of the questions that arise in one go, drawing upon the appropriate areas of expertise. ‘Equally there may be other ways industry

can get involved either by sponsoring an event or one of the other initiatives we are introducing.’

fundamental differences in our legal structures that precludes us from emulating their business model in its entirety.

As the ‘public’ side of the private/public partnership, Richard’s role includes liaising with a number of States departments – from regulators to housing, immigration to income tax – to ensure the process is as smooth as possible.

‘There is an approval process which every new arrival in Jersey must follow. Whereas in Guernsey there is a fast track option – buying an open market property. This means that Locate Guernsey won’t necessarily come into contact with everyone coming into the island but we are working with the estate agencies to be ‘kept in the loop’ and assist and provide 'after care' if needed. There may well be the case where someone just buys an open market property and moves here; but at a later stage wishes to become more integrated into our society and that’s where we might be able to help.’

‘We are the ‘one-stop-shop if you like for all the government aspects of relocation. We can smooth some of the bumps along the way and we minimise the bureaucratic burden where we can. Individual States departments are actively trying to improve their own processes where necessary but it’s a relatively slow process. The public sector reform programme won’t (and shouldn’t) happen overnight so we are there to ‘grease the wheel.’

One area of States activity that Richard has drawn into the dialogue is planning. ‘Planning’s involvement early in any relocation process is vital. There may be change of use issues to discuss for any business migration or start-up; and for residential property it’s essential to manage the expectations of any potential purchaser right from the start. Planning forms a key part of the jigsaw.’

Everyone without exception has been extremely supportive and positive about what we are doing. We have a strong pipeline already and Guernsey offers such a great way of life that I am sure we will succeed

‘Seeing Jersey as our main competition I think is a little naïve. There are jurisdictions across the world seeking to do a similar thing to Locate Guernsey. I aim to work closely with Jersey and I have already met with the team there. There are certain things that I think we could learn from how they operate although there are

‘I would also like to develop that network for work placements for our local youngsters. This would give them invaluable off-island experience and skills development that they can then bring back to benefit the local economy.’ Locate Guernsey has specific goals and objectives to meet which range from ‘soft’ targets such as the number of meetings held or conferences attended to more accountable achievements such as the number of businesses attracted to the island, their sectors and economic contribution. Richard is confident that the project will succeed: ‘Everyone without exception has been extremely supportive and positive about what we are doing. We have a strong pipeline already and Guernsey offers such a great way of life that I am sure we will succeed.’

Richard admits that there are certain departments where administrative improvements could be made to ease the process. ‘We are working closely with immigration and there is some productive work going on to improve policy to ensure we are on a level playing field with Jersey. We operate within the same legislative framework but we interpret it quite differently so I am expecting some improvements in that area in the very near future. I don't underestimate how important it is for the various departments to work cohesively in order for us to maximise the success of the Locate Guernsey initiative.’

Having worked in the finance sector throughout his career, this new role is quite a change for Richard but his enthusiasm is clear. ‘I am a Guernseyman through and through. I want the island to continue to prosper and I hope to be able to contribute to that on-going prosperity in this role. When Jersey first introduced its Department for Economic Development, I was working for a firm wanting to open a Jersey office. So I experienced that department’s (now Locate Jersey) support first hand as a client. I was convinced then that Guernsey needed to do something similar. Richard’s role as chairman of the local branch of the Institute of Directors has undoubtedly developed his local network, something that will be incredibly useful in the post. Alongside this he has also held a number of non-executive directorships across a range of sectors, and involvment in the third sector. With an extremely busy work life plus two teenage children, he doesn’t have much time for much else but does do a bit of cycling and running (he claims his triathlon days have been and gone). And overall he seems to be relishing in his new role. ‘I know it’s early days but I am thoroughly enjoying the job; I genuinely can’t wait to get to work in the morning.’

VIEWPOINT WITH RICHARD DIGARD

Revealed: the secret department for reform headed by an oil man Fresh from being a member of the independent panel that made recommendations on States members’ remuneration, Richard Digard believes he’s now able to work out what government’s mystery committee – the States Trading Supervisory Board – is really up to It was, in fairness, something that the panel agonised over: should non-States members sitting on the supervisory board be paid more or the same as other unelected participants on government departments? The answer, using our adopted ’test’ of

whether the body appeared to have responsibility for policy formulation and in the absence of any meaningful response to our request for information about what the board would actually do, was clear. No. Yet the mandate of the board, introduced as part of the wide-ranging changes to the

machinery of government that come in this May, hinted at a body that could have significant influence. Confirmation that the power-meisters have aspirations for the board was quick to follow publication of the remuneration report which, for the first time, links the amount


deputies receive to the performance of the island’s economy. It came in the form of an amendment from Treasury and Resources to increase our proposed £2,000 payment to £8,000, making it more in line with the amount received by non-executive directors on businesses like Aurigny or Guernsey Electricity. The other pointer is the man they’ve got to run it: ex-oil man and straight-talking Simon Elliott, the States chief corporate resources officer, but who was brought in six years ago to shake up HR and organisational development within government and who walked into the airport fire fighter dispute just two weeks into his new job.

lifeline links to Alderney, but no one would say the introduction of Dornier aircraft to that island had gone smoothly and the airline certainly hasn’t kept northern islanders on board with its plans. In addition, and whatever the reality, the ending of the codeshare with Blue Islands and that rival’s decision to cut a franchise deal with Flybe doesn’t leave Aurigny looking like it’s got its finger on the pulse for all the skill and speed with which it rescued Gatwick from Flybe’s pull-out and introduced the new jet. That said, the STSB won’t be hands on with the traders – it’s saving that for what’s left, the unincorporated trading concerns and commercial interests owned by the States.

I don’t want to stretch this too far but he’s also been appointed MD of the board, making him – as far as I can tell – unique among local civil servants and, more importantly, indicating how personally responsible he will be for delivering on the board’s agenda.

You’d think, given that each of these has its own professional board, that the States Trading Supervisory Board (STSB) wouldn’t feel the need to get much involved, but I’m not so sure. Jamesco’s fine and Guernsey Post Ltd is (sorry about this) the poster boy among the traders for the way it handled the overnight loss of around 50% of its income when the bulk mail business collapsed, brought staff with it in introducing reforms and in seeking new income streams. By contrast, Treasury and Resources last year told Guernsey Electricity to bring its prices (17.6815p per unit) within 6% of Jersey’s (14.5p per unit), which tends to confirm the sometimes heard criticism that despite being commercialised, GEL still thinks and acts like a States department. Aurigny is less easy to benchmark, and has the added complication of loss-making but

Look back, if you will, to the comments the Treasury and Resources minister made to Chamber last November, when he said: ‘The piggy bank is now officially empty. There is no option left to us but to live within our means. The net effect is that from here on, we are going to need to relentlessly focus on our priorities. This will become the recurring theme of 2016 and beyond.’ So, no money, a property portfolio of 2,600 units over 1,700 acres valued (rebuild) at £2.2bn, a chief executive actively reforming the civil service, a whole load of unfinished business left over from FTP and BDO identifying efficiencies that simply haven’t been acted on… Call me cynical, but how much better to make progress than spin off a ‘supervisory’ board headed by a known axeman with a majority of non-States members on it and with a brief to sweat some assets.

And what that might be is reasonably easy to divine by reading the entrails (strictly, haruspication, but let’s not go there). The supervisory board’s headline duty is to carry out the States’ role as shareholder of any government-owned incorporated companies, which currently consist of Aurigny, Guernsey Electricity, Guernsey Post and Jamesco 750, the entity which owns and operates the tankships bringing oil to the island.

As things stand, the STSB is mandated ‘to ensure the efficient management, operation and maintenance’ of these bodies, but what does that actually mean?

Call me cynical, but how much better to make progress than spin off a ‘supervisory’ board headed by a known axeman with a majority of nonStates members on it and with a brief to sweat some assets. That includes all the ports, including Alderney Airport, the Dairy, Guernsey Water, States Works, all property and real estate owned or leased by government and the corporate engineering and architectural services. I’d include legal services in that, but let’s assume for the time being that it will form phase two of the supervisory sweep.

If you recall the pre-privatisation report commissioned by Bernard Flouquet on the harbours, that uncovered all manner of sweetheart deals which remain unresolved, and there’s still been no progress on merging, as a minimum, the payroll and billing functions of Guernsey Water and Electricity. Yet my reading of something called Annex Two, buried in various Billets, transfers management of all States-owned and leased property and real estate, including advice to the States on property matters and corporate engineering and architectural services, to the supervisory board. It also assumes management of Guernsey Dairy, including liaison with its stakeholders, and the administration and promotion of the Channel Islands’ lottery while Public Services loses control of the ports (and all that follows from running them), solid waste, water and States Works to the STSB. Not to put too fine a point on it, the States has created a mechanism for revolution within the commercial areas of government and given it to a man whose frustration at the lack of progress on meaningful civil service reform in those areas has been legendary over the last six years. Time to break out the hard hats, I’d say.

Of all Guernsey’s memorable personalities, past and present, there are few more interesting and characterful than Bill Green.

Prominent businessman, States member, president of the Chamber of Commerce, enthusiastic motorcyclist and outdoor swimmer, Bill was a much loved and well recognised presence in the island throughout his long life. Born in 1909 in a house in Fountain Street, St Peter Port, Bill remembered a Guernsey of cobbled streets, horse drawn carriages and conversations in patois. He witnessed the German Occupation, and Guernsey’s gradual change from an island economically dependent on granite export and greenhouse growing of tomatoes, flowers and other crops to an international finance centre. In fact Bill spotted one of his first business opportunities during the Occupation. At that time the bicycle was the primary form of transport on Guernsey, since the island’s cars and motorbikes had been requisitioned by the Germans. As bicycles became very precious possessions, Bill developed a successful bicycle business. Among other things, he realised that a shortage of locks meant that people would need somewhere to store their bikes safely, so he devised a useful side line providing this service at his shop in Smith Street. For a small charge, people could leave their bikes there while they went about their business. The occupying forces only permitted Guernsey’s Chamber of Commerce sporadic meetings during the Second World War, and Chamber members used those meetings to arrange what foreign trade they could to help sustain the island. After the war, Chamber joined the general effort to rebuild Guernsey. A subscriber member since 1954, Bill was elected junior vice-president of Chamber and then senior vice president, before being voted president in 1963. As president, he knew traditional methods of

commerce were changing in the aftermath of the Occupation, and that traders would need to move with the times. Today, Bill Green’s enterprising spirit is commemorated in an award which bears his name, given each year by YBG to a pioneering business in the island. The Bill Green Award for Entrepreneurial Spirit, run by YBG on behalf of the Guernsey Chamber of Commerce, is for new or established businesses which are making their mark on the local business scene with a fresh direction or project. This year's judges include Carl Symes of Startup Guernsey; Fionnuala Carvill, Chamber council member; Wing Lai, president of YBG; Lindsey Dean, vice president of YBG; and YBG council member Stephen Rouxel. Previous winners include Pet Technology Store, IBZ.TV, Fusion Leisure Limited, The Learning Company and Living Room Estate Agents. Lindsey said: ‘Once again, the judging panel is very much looking forward to receiving applications from local businesses who can demonstrate a desire to succeed and show the ambition, vision and drive to turn ideas into a successful business. Entrants must clearly demonstrate their business idea and start-up process, showing evidence of a well-researched business plan and forecasts for business performance.’

Entries opened on 18 February 2016 and will close on 31 March. Short-listed entrants will be notified on 14 April 2016 and will be invited to an informal interview with members of the judging panel. Each finalist will receive a pair of tickets for the YBG summer ball on 17 June 2016, where the winner and runner-up will be announced after a series of short videos introducing the finalists. The changing face of IT departments Jason Connolly of Next Generation IT explores the changing dynamic between companies’ IT departments and business teams There has always been a love-hate relationship between businesses and their ‘geeky’ IT departments. In the past IT staff have been treated with a fair degree of suspicion and contempt by the business teams. IT staff in return could come across as aloof and unhelpful. But recently that dynamic has changed with leaner, customer-focused IT support teams, often much more integrated into a business’s operations. Demise of the empire Leaner times have spelled an end to monolithic IT empires, which used to exist with inwardly focused technical agendas seemingly very distinct from the host organisation. IT teams have evolved to be leaner, service-focused, reactive and share the aims of the business to which they belong. In the current, more competitive business environment, IT teams need to earn their keep by enabling the business to work as efficiently as possible, incorporating technologies to drive the business forward. But more than this, IT needs to provide value by enabling businesses to gain competitive advantage, utilising technology to improve customer service and responsiveness, high levels of security, more accurate decision making from analytics and reporting, plus finding innovative ways to connect and communicate with potential and current clients, for instance personalised web portals and custom built apps. The make up of IT teams has changed too; technology is so complex and far reaching that no one person can know everything. IT professionals have needed to specialise meaning that an internal IT department would have to be very large to be able to employ all the skills they need in-house. To overcome this issue most businesses have evolved a small, business focused IT team that is tightly integrated with the rest of

the organisation and then partner with third party IT service providers to buy-in the additional technical expertise they need to fill the gaps. Other businesses decide to entirely outsource IT to the experts, freeing up their own resources to focus on their core business, reducing costs and increasing productivity. An awakening In the face of increasing competition, regulation and pressure on budgets; local organisations are striving to become more streamlined in order to survive and ultimately grow their business. Many successful businesses have embraced outsourcing and have partnered with local IT companies to buy-in services that enable them to focus on their core business. Globally, IT outsourcing is set to grow 5.9% a year from 2013 when it reached $288bn, according to American research company Gartner. Closer to home, this year’s UK IT outsourcing study, which looked at more than 800 IT outsourcing contracts held by 160 organisations, highlighted just how important outsourcing has become. IT outsourcing in the UK is now estimated to be worth around £20bn and it is set to continue growing, with 40% saying they will outsource more. Business benefits The ability to focus on core business activity is the main driver for companies wanting to outsource. With sustained downward pressure on the economy, we have seen Guernsey companies striving to become more efficient and effective in order to survive and ultimately grow their business, despite limited headcount and available finance. Benefits include cost savings through economies of scale and flexibility with the ability to grow and shrink the service. Minimising costs in austerity and

providing the capacity to grow resources rapidly, when growth returns. Risk is mitigated, as IT providers employ a pool of people to call on, with experience of supporting similar organisations. Next Generation IT offers a comprehensive range of IT services to a diverse mix of clients, but we continue to see a rise in the number of companies seeking help in managing their IT requirements. This does not mean we always provide a full-time on-site engineer, but often provide a mixture of proactive weekly site visits, health checks and reactive support. Outsourcing can also include the hosting of a client’s IT environment through cloud services, which enables and organisation to buy-in IT systems, without needing to invest in costly IT infrastructure. Conclusion Forward-looking businesses are using outsourcing and cloud services to ensure that day-to-day basics are taken care of, freeing up their organisation’s staff to drive the business forward. Good IT is so critical to business success in the current environment and having the right IT team composed of passionate, hard working and knowledgeable staff is crucial. Technology moves so quickly it is a challenge for businesses to keep up. Key to this is the humble IT team, composed of the best staff from inside and outside the organisation all working together to drive the business forward. Many of our clients outsource the provision of their IT systems and support for those very reasons, and rely entirely on us to meet their current and future IT needs and challenges. Henry V was a great proponent of outsourcing. Many of the ‘specialists’ he recruited for his long campaign against the French were brought (and bought) in from parts of the British Isles not actually under his rule, to fight alongside his standing army of English cavalry and archers. And at the end of the campaign, with a French crown on his head and a princess in his bed, he paid them their fee and sent them back to whence they came with a cheery wave and all obligations ended. Henry, one of the greatest military strategists of his day, knew that to get the job done quickly and efficiently, you have to bring in the right skills to plug the gaps in your own resources. Now he could have spent years and lots of money training up good English yeomen to do these jobs in the off-chance he might want to start a war, but then what use would he have had for them when he was done with them? It’s no different today. When your resources are stretched but there’s a campaign to deliver, it is good business practice to bring in additional manpower and specialist skills to get the job done efficiently and cost effectively. And just like Henry on the field of Agincourt, it’s better to have that support embedded within your team, working shoulder to shoulder with your own professionals, than advising them from a hilltop far away. In marketing and communications it makes absolute sense to use external support, either on a retained or on a project-byproject basis. Every business needs marketing to build awareness and generate income. But not every business needs (or can afford) a permanent marketing manager or a

large marketing department covering all the different communications disciplines. So what do you do when you have a specific need that is outside the remit or capacity of your in-house resource?

Business continuity planning Simon Golland of BCP CI explains how business continuity planning is becoming a business imperative We, at BCP CI, formerly MSD International, are often asked:

Today, businesses and clients are increasingly recognising the importance of BCP within their investment and partnership decisions. Whether they are business partners or service providers, the interconnected nature of business in the 21st century is such that our own brand value and bottom line are intrinsically linked to the success and failure of counterparts and partners like never before and many business owners are becoming ever more aware of their own personal financial exposure.

Whilst there is clearly a cost to such strategies, when ‘stress-tested’ by a disruptive event the benefits, financial and otherwise, become apparent. At the same time as giving comfort both to clients and regulators, effective BCP can also reduce insured risk and we encourage businesses to talk with their agents in this regard. A robust BCP will reduce the post event cost of recovery and the process of preparing your BCP will require a procedural assessment that can often highlight areas of the business with the potential for operational cost savings.

'What is business continuity?' Effective business continuity planning (BCP) is best described as being the processes and procedures that are carried out by an organisation to ensure that essential business functions continue to operate during and after a disruptive event. In short, it is planning for business survival. To some, this will seem a little strong or perhaps scaremongering to generate business by business continuity consultants. Unfortunately, the financial reality for business owners is worse than the statistics suggest: “75% of companies without a business continuity plan fail within three years of a serious disruptive event” (FEMA). The Insurers AXA are less upbeat saying: “80% of businesses affected by a major incident either never re-open or close within 18 months”. In most cases, this failure to recover is as a result of reputational impact following an event. Either by virtue of a specific missed deadline with wide market impact or more likely, market place perception of the business’s ability to plan and prepare; the impact to brand value can often be cataclysmic. Whilst every business will have its own unique risk profile and requirements, the underlying need is to plan for the recovery of the organisation’s data, and prepare the business to re-establish its service provision. Effective BCP moves immediately from triage to recovery and avoids the ICU by knowing in advance the ‘where, who and

Whilst ineffective BCP is cheap and easy to achieve, implementing an effective business continuity management programme is a complex exercise well worth the investment of time and energy especially when considering that the cost of failure is so high. With the cost/benefit of business continuity becoming more visible, customers, investors and regulators are placing a greater requirement upon businesses to evidence effective BCP strategies right alongside robust KYC and comprehensive AML policies, protecting clients across the risk spectrum. Whilst regulators such as the GFSC and JFSC do not require that regulated entities achieve the ISO standard certification, it is considered as the template for best practice with regulated entities expected to prepare and maintain an effective business continuity programme. One that would not only meet the appetite and need of their own business model but also meets the expectations of,

Contact So let’s get straight to it. What is management consultancy and how does that fit within an outsourcing model? AJ Well, simplistically put, management consultants provide support. Sometimes as an unbiased pair of eyes to evaluate a strategic decision; delivering a single project or simply to supply a specific skill set such as analysis, IT or marketing to name a few. The key criteria is that they should add value and not simply cost you money. For example, many businesses simply don’t have payroll capacity for a full time manager or director of IT. Yet in today’s tech heavy environment, you need someone close to your business to keep an eye on these opportunities; or simply to help you embrace existing technology that may have passed you by. It’s not all about efficiency savings, client retention or service development but if your competitors are taking advantage of these opportunities then so should you. With effective outsourcing you gain a new member of staff with the skills you need at a fraction of the cost of a permanent full-time employee. They become part of your team; getting involved in the day-to-day of your business, developing relationships with your staff, understanding your company culture and, if there is one, its appetite and need for change. Developing a utopian vision for your client is one thing, but it needs to be affordable, deliverable and cost effective. Most importantly, it must be what the business wants! AJ You are right to catch me there, we consultants can often speak with sweeping generalisations. I’m afraid that you have now sent me scurrying for my soapbox.

AJ Sort of, when delivering a project, a consultant’s job is to make the best use of our clients’ staff and resources to achieve their goals.

Contact Surely it costs what it costs. We all know about the size of consultants’ invoices and their expense claims.

For me, many consultancy firms are simply too rigid, or should I be more polite and say “specialised” to accept that there is rarely a ‘one size fits all’ solution. And in that, I don’t mean offering two slightly different products to meet different price points. To put it another way. If I ask the ‘carpenter consultant’ to build a fire surround he will do it with wood and the ‘stone mason consultant’, well, you get the picture… So often, firms have a bag of tried and tested solutions and the client's need becomes secondary. The business ends up adapting to receive the solution rather than the other way around. Bottom line - you cannot fix everything with a new computer system any more than you can solve every problem by simply hiring more staff. This is why we at Veneti favour our ‘many heads’ approach. It’s cheaper for the client and much more effective. Often, the right solutions have multiple elements that impact on staffing, marketing, IT, public relations, operations, logistics and a whole lot more. Navigating Spaghetti Junction Haley Camp, of Centillion Consulting Limited, considers the changing face of regulation both locally and globally and the value a proactive outsourcing partner can bring.

I remember those conversations as a little girl with my dad where he would point out a building and tell me that he "remembered when that was all fields". In my lifetime, though, those “fields” have only ever been filled with big buildings with roadways carved through them, each with their own restrictions as to speed and direction. Nowadays, of course, I find myself pointing out a building and telling my son how I “remember when that was all fields”. As change is inevitable, what future changes will cause my son to say to his offspring one day, “I remember when that was all fields”? Guernsey’s changing physical landscape very much mirrors what is happening in our finance industry locally. Change might not happen overnight but we would all agree that gone are the simpler days of uninterrupted views and wide, green expanses free to be traversed at leisure. Our current environment consists of structures requiring rules, maps and codes to help us navigate them successfully: the 1987 POI Law, the 2000 Fiduciary Law, the 2007 AML Handbook and the 2011 Code of Corporate Governance all spring to mind. What does this tell us? That we can be sure that yet more change will occur; updates to the AML Handbook, revisions of the fiduciary and investment laws etc. And then there are the, as yet, “unknown-unknowns”… It’s beginning to look a bit like “Spaghetti Junction” out there. In the wake of the Moneyval report, Guernsey businesses will see changes to the way they demonstrate compliance with

anti-money laundering practices. Already the States of Guernsey has approved upping the maximum fine available to £4,000,000 (previously £200,000) and we can be fairly certain that future regulatory updates will be crafted with a nod to the Moneyval findings and recommendations. But it’s not only Guernsey where the landscape for doing business is getting more complicated. As a destination for global business, we now have rules and regulations piling in from all over the world, meaning that we not only have our own highway code to navigate, but also those of the US, Europe and elsewhere. This year local Reporting Financial Institutions will see the first “FATCA” reporting to the United Kingdom. Whilst US reporting came online last year, the United Kingdom reporting is likely to result in significantly greater volumes and thus more work for many. Guernsey is also readying itself for the day that Europe grants the first AIFMD third-country passports. With a favourable ESMA opinion on our side, the industry is quietly confident that Guernsey will be in the first wave of passporting. But questions remain. When might we get it? Will National Private Placement disappear? How will Guernsey AIFMs handle the new responsibilities? How will this change the way local businesses do things? Not wishing to labour an analogy, but if you imagine that Guernsey businesses now need a pretty high-tech Sat Nav to plot out their journeys through a complex network of rules and regulation, local businesses will find

themselves needing to frequently modify their Sat Navs. Together with Jo Carre, I established Centillion Consulting Limited in November 2015 to provide outsourced regulatory compliance, corporate secretarial and governance services. Our combined experiences, Jo’s with the fiduciary division of the Guernsey Financial Services Commission and more recently with The Active Group and my own working with administrators, FTSE 250 and other investment funds and on AIFMD and FATCA/CRS, make us well-placed to add that vital value. There are some out there who warn against outsourcing as a solution. The reality is that, whilst driverless cars may be the future of vehicular travel, for Guernsey financial services businesses, it remains vital that those at the helm are actually driving the car. But that doesn’t mean that the driver shouldn’t equip himself with intuitive driving enhancements to ensure safe arrival at his destination. Used wisely, an outsourcing partner can serve as a valuable add-on to a business’ satnav, assisting it to successfully navigate the “Spaghetti Junction” of law, rule and regulation. And a final thought. Just as the satnav works best when it’s fixed safely in the car, to ensure precisely tailored solutions, local businesses should ensure that their outsourcing provider is working with them, is visible at all times and is with them for the journey.

The value of an MBA In a complex and changing world, an internationally recognisable management qualification is an increasingly important asset. Chris Edwards from the GTA University Centre looks at how, in a competitive employment market, having the right one opens up global opportunities The prosperity of the islands relies on us looking outwards, and understanding and engaging with customers, suppliers, governments and other stakeholders in international markets. To succeed we need to equip and train our leaders and key managers with the right skills and knowledge. One way of doing this, both affordably and on-island, is through the GTA University Centre’s MBA (Masters in Business Administration) programme delivered by the University of Southampton, which is consistently ranked in the UK top 20 and in the top 100 in the world. More than 80 Channel Islanders so far have completed the course, which is one of only 300 to be accredited by the highly regarded AMBA (Association of MBAs), delivering benefits to their companies and the wider business community. MBA graduates working in the public sector doubled with almost one in 10 MBA graduates now working in this sector, whilst 15% were working in consulting, 11% in finance, 10% in industry, 9% in healthcare, 5%

The concrete block – a Guernsey perspective Ronez’s Steve Roussel gives a behind the scenes insight into the creation of an every-day building material. Most of us take our built environment for granted, but have you ever wondered where the materials used to build our homes, offices and infrastructure, come from? Take for example the humble concrete block – an essential building product, but often covered up behind insulation, plaster, or cladding. In 2015 however, over 1.5 million blocks were manufactured right here in Guernsey by Ronez, at its Monmains production facility in St Sampsons. As Ronez has been manufacturing concrete blocks at its site since 1961, who better to provide a brief explanation as to how these products come to feature in all of our island's buildings? The constituent parts of our standard blocks are twofold. Firstly, various grades of crushed Guernsey stone, usually in three different sizes including granite sand, are required. Secondly, cement, water and an ‘admixture’ that aids compaction are added. All of the stone and granite dust required are responsibly extracted from the Ronez Les Vardes quarry. The granite is blasted, crushed, screened into different sizes and then the material for block manufacture is taken by tipper lorry to the block production site at Monmains yard. In a continual process during the day, the product is loaded into a hopper and conveyed to storage bins holding up to 200 tonnes. Here, the product sits high above the manufacturing plant (as a large part of the process is gravity fed) until the operator is ready to make a new batch of concrete blocks. Cement, the most expensive part of the block, arrives in Guernsey via our own ship, the MV Ronez. The cement Ronez uses is one of the highest quality versions around,

manufactured at a plant near Lagerdorf in the Schleswig-Holstein region of Germany and loaded onto the MV Ronez at the port of Brunsbuttel on the river Elbe. At the busiest times, Ronez imports one boatload or 950 tonnes, per week of this material and the four storage silos visible on the south side of St. Sampson Harbour, hold 2,300 tonnes collectively. Another component of our concrete block is ground granulated blast furnace slag or GGBS, a by-product of steel-making. Its use here as a cement replacement reduces the overall material costs and CO2 embedded in the manufacture of this product. This is again shipped to Guernsey in bulk by the MV Ronez, but from the port of Bremen, Germany. The final ingredient, liquid admixture, is combined with water before being pumped into process and is supplied from a specialist company in Bradford. The mix ratio or recipe In total, Ronez manufactures over 30 concrete block types, each with tailored characteristics for different uses. This requires each type to have a different recipe, which begin with industry standard specifications to guarantee quality, and then enhanced for use with local Guernsey stone and its particular shape, water absorbency and chemical and physical properties. The manufacturing process The ingredients are mixed together in a pan mixer, two tonnes at a time and typically a very dry (or stiff ) mix. The mix is then transported to a holding hopper, eventually feeding block moulds

which are then compressed and vibrated, making between six and 12 blocks depending on the block size. The moulds are then elevated to leave a row of blocks on a wooden board. It’s a process not too dissimilar to making a cake mix, selecting and filling the correctly sized tin, but then emptying the mix out again before it has gone into the oven! The block making process is slightly different to our baking process because each set are conveyed by crane (carrying up to 3.1 tonnes at a time) to a pre-designated stack. Here, our blocks stay, drying for up to three days, before being transported to a stacking system. This crane transports both freshly made blocks and cured blocks simultaneously, in different directions. Dried blocks are then stacked, bound and ready for transport to our stocking area by forklift. The Ronez plant can produce up to 10,000 blocks per day! The testing process Our blocks are tested to ensure that they achieve a pre-designated compressive strength and tight dimensional control. A host of factors are considered including stone shape, water absorption, sand content to name a few. All factors have a bearing on the final compressive strength of each block, hence the need for a strict testing regime to ensure variations in raw products do not lead to changes in the performance of each finished block. And there we have it! Next time you see a humble grey block, think of all the operations, materials and people involved to produce a trustworthy, home grown Guernsey product.

When the Alderney Gambling Control Commission (AGCC) was established 16 years ago, it was with a view to bringing much-needed regulation to the then fledgling on-line gaming sector and establishing a Bailiwick presence in a rapidly expanding market. Since then, ‘internet gambling’ has changed out of all recognition into eGaming and that pace of evolution is set to continue as technology improves the immersive experience of taking part and innovation greatly increases the types of games on offer. Typically these include poker, casinos, sports betting and bingo but with many variants developing and offering differing degrees of player involvement, often based on a common, licensed software platform. As the industry develops – estimates put the global value this year at over £30 billion – so too have government attitudes towards it. In the US, for example, only three states, Nevada, Delaware and New Jersey, have legalised online gambling while elsewhere other more supportive jurisdictions have looked to introduce their own regulation, effectively in opposition to that provided by offshore authorities like Alderney.

An example of this is point of consumption regulation in the United Kingdom. ‘While Alderney accepts the UK’s right to make these changes, and for that reason did not oppose them, we have made clear that they are bound to have an impact on the commission. ‘However, we have decided to exclude revenue subject to taxation elsewhere from being used to calculate licence fees, and this benefits those licensees wishing to maintain operations in the Bailiwick. Alderney and Guernsey continue to offer eGambling licensees a cost-effective place in which to establish and do business,’ he said. Robin Le Prevost, until recently Alderney’s director of eCommerce before starting his own consultancy, puts it more directly. ‘Make no mistake, the UK’s licensing requirements represent the biggest threat Alderney has ever had to face.’

AGCC chairman Lord Faulkner puts it this way:

The reason is that being regulated by the UK – which largely adopted Alderney’s regulatory approach as its own – calls into question the value and cost of being licensed by the Bailiwick.

to be facing a substantial drop in licence fee income.’ Confronted with that, however, he and the commission redesigned its entire fee structure with a view to remaining competitive and at the same time making the Alderney regime more attractive for new entrants to market. The AGCC has yet to release updated figures but Robin is very hopeful that the island will at least have maintained its fee income - which totalled £4.6 million in 2014 - while other regulators, like the Isle of Man and Malta, have seen sharp falls in the number of licences they have issued as a result of national licensing schemes. Susan O’Leary, the new Alderney director of eCommerce, said that the cost of B2C and B2B licences for start-up and new operators moving to the jurisdiction had been reduced from £35,000 to £17,500 for the first 12 months. Such changes and other innovation means that developers wanting to become platform providers, with all the benefits that brings in terms of swifter and cheaper integration costs, can now do so at a substantially lower cost. ‘This, in conjunction with the recently approved Cloud technology, provides developers and start-ups with a highly

attractive environment from which to base their business,’ she said. The rise in national regulation is helping to level the playing field for all operators with a qualitative approach being taken to regulation rather than the geographical location being important. As a result of these changes, Susan said Alderney had a clear strategy for its future role – building relationships that help licensees develop their business. ‘Our team of hugely experienced regulators has an innate understanding of the risks to players and the requirements of operators and our unrivalled reputation among authorities around the world enables licensees based here to operate legally within different regulated markets.’ Alderney has more online regulatory agreements in place than any other jurisdiction in the world, with many more in train, and that should reap significant benefits as the industry seeks ways to pool player liquidity and introduce other features such as cross-border jackpots. However, the main thrust of Alderney’s eGambling industry revolves around platform operators who provide services to either their own B2C businesses or to third parties. ‘During the past four years this activity has driven the growth in Alderney and we host most of the major operators and service providers from Europe and the UK as well as US operators looking to service their international clients,’ she said. As well as responding to external events, the commission has also had changes of its own, with Jorn Starck taking over as executive director from the highly regarded André Wilsenach, who now heads the new International Centre for Gaming Regulation (ICGR) at the University of Nevada in Las Vegas after 14 years with the commission. ‘Obviously I am very keen to ensure that there is stability and continuity so I do not want to change too much; my personal style is probably more analytical and more focused on the legislative and regulatory environment,’ said Mr Starck, adding that

regulatory changes are starting to impact on the operators in the industry quite significantly. ‘Offshore jurisdictions will always have their role to play but there is also a need to recognise that the operators need different solutions for their products and services. ‘There are still a large number of jurisdictions that haven’t implemented their own online gambling legislation. With our experience we are very confident that Alderney can also contribute to the development of the industry in those jurisdictions across the world: Eastern Europe, the diverse Asian markets and South America.’ The quality of Alderney’s regulation was also recognised by Moneyval, the Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism, which had hardly any recommendations to make about how its regime could be improved. Alderney’s pragmatic and open-minded approach to regulation extends to technology and this was underlined by teleco JT’s cloud platform becoming the first of its kind in the world to receive regulator (AGCC) approval. Robin Le Prevost, who was closely involved with the project, described it as a seminal moment for Alderney and JT. ‘While there may be cloud technology deployed in a few other jurisdictions, none have been certified to specific gambling regulations. Cloud has enormous potential to deliver cost-effective solutions to gambling operators, but there were specific challenges in ensuring that the data and functionality are secure and free from external threats. ‘The AGCC worked closely with JT to bring about this innovation and I have no doubt this will deliver extraordinary capability and commercial benefit to licensees while maintaining the integrity and reputation of the jurisdiction.’ JT invested more than £40 million in its CI-based data centre facilities and off-island fibre connectivity and invested heavily in getting its first mover advantage. Through its membership of Dimension Data’s One Cloud

Alliance, JT had already proved its capability to deliver a highly scalable, pan-island global cloud service through their access to the technical capabilities of Dimension Data’s Global Cloud Exchange. To gain regulator approval, JT’s team worked closely with the commission over a number of months to navigate the rigorous process to reach cloud approval. That effort, which was far more onerous than anticipated, has paid off with JT ‘on-boarding’ one new e-Gaming customer a month last year and it now has 14. Stafford Hunt, head of commercial development at JT, said the process to approval required a significant contribution from its experts, some investment at a local level and relied heavily upon close collaboration between JT, the AGCC and independent third-party security firm, NMi. JT’s Glyn Harris leads the global eGaming team and explained how JT is now working on and investing in a ‘game content-as-aservice’ product which will deliver a casino portfolio to new start-ups, allowing for cost effective entry into the market. This is particularly important for Alderney as it evolves in a changing marketplace and one in which mergers and acquisitions in particular are affecting regulators as operators consolidate to gain scale, reducing the number of individual licence holders. ‘Alderney has been remarkably resilient,’ said Robin, who now heads Le Prevost Consultancy, ‘but we are in for a sustained period of slower growth as even UK high street names become too small to survive on their own. That will have an impact, but what it is remains to be seen.’ Innovation and growth in areas like South America, Africa, India and Asia provide massive opportunities but also specific problems for regulators. While there may be flexibility for country-specific attitudes to risk, there are also minimum standards when it comes to things like crime, anti-money laundering and fairness and honesty. Nevertheless, the eGaming sector is worth an estimated £50 million to the Bailiwick, directly employs around 300 people and

also uses other services and businesses in the islands. As the sector matures, JT this year is continuing to promote its cloud capability and hybrid hosting; meaning the provision of blended telco, data centre and security to provide cost effective entry to the market. It is also developing an eGaming ecosystem with several of its customers also doing business with each other and it is this sort of development that Robin believes will stand the sector in good stead. The collaborative approach is one reason why Team Alderney has been created with Sure International, C5 Alliance Group, JT Group and the Long Port Group providing hosting, telecommunications and technical expertise and Carey Olsen and the Fort Group offering legal, fiduciary, relocation and consultancy services under the ‘team’ banner. That ecosystem is one of the reasons why the Bailiwick is the largest supplier in the world of wholesale casino and bingo games and its B2B presence is very strong. Something like 300 operators are supplied via Guernsey data centres and, by being regulated in Alderney, they have access to what Susan describes as the largest technical infrastructure in the offshore world, with multiple data centres offering virtually unrestricted capacity, with the highest levels of performance, resilience and security. With more than £400 million of further investment in the pipeline to build further facilities, provide green power from carbon-free sources and additional telecommunication networks, she said that Alderney and Guernsey intended to stretch their existing lead in this field during the months ahead. Why choose Alderney? For online operator Genting, the choice of Alderney was obvious. Its product range includes live online casino, casino games, sports betting and poker, available via web, mobile and tablet devices, and reputation and brand were important to it.

‘It was essential, when choosing a jurisdiction, that we are licensed by a regulator of the highest standards. AGCC is arguably one of the world’s most prestigious regulators,’ said Emma Greathead, Genting’s head of finance.

It also has a B2B platform in Guernsey and is looking to expand into different markets and new games. ‘There is plenty going on and it is an exciting time for us,’ said Mr Munro, who added that Alderney and Guernsey were excellent places from which to do business.

‘In addition to this, the Channel Islands are close to the UK, with excellent transport links to most major UK cities. Operational infrastructure was also key, and the islands had a robust telecommunications network, alongside top quality commercial space.

Regulatory innovation for Asia

‘There were multiple service providers to choose from when it came to hosting and system managed services. We found those providers really knew what they were doing with regards to online gaming, and that support is business critical,’ she said. Bear Group, part of Gaming Realms plc, has recently moved into new offices in Guernsey and is a real-money gambling company which owns and operates a number of gambling products powered by its proprietary gambling platform. It says being based and regulated in the Bailiwick makes it ideally positioned to take the group’s gambling products both to the UK and other regulated markets. Director of operations Paul Munro says it is very different from archetypal betting and casino operations. ‘We have a next generation, mobile device philosophy. We developed our own platform and software so we are unique in that we develop games, plus we market and retain our own site. Most big brands feel comfortable with what they already have and do not want to take on the added pressure and resource required to develop their own platform games,’ he said. ‘It takes time and effort to develop these products and businesses generally want to get to market as quickly as they can so they outsource this to third parties. We believe that this gives us an advantage as our games are bespoke, unique and very different to many used by a number of different companies. It means we have to be innovative and think outside the box, but that is a good thing.’

As it works to remain relevant and competitive in a fast-changing global market, the Alderney Gambling Control Commission has launched a new ‘product’ for Asia. Its agency model, which is already being used by major eGaming operators, was developed to provide robust and compliant, international-standard regulation in the Far East while recognising that the Western approach was not appropriate. The reason for that is many Asian countries do not have the same credit and payment card systems that can be found in the West. In addition, in a typical Far Eastern extended social structure, bets on popular sporting events may be placed by one person on behalf of all the others, and credit may also be extended by ‘agents’ to linked sub-accounts, where individuals can place their own bets. ‘This is a cultural issue that is fraught with challenges for the gaming companies who wish to operate, and be seen to operate to the highest regulatory standards,’ says the AGCC. As a result, it embarked on a wide-ranging review of the market, regulatory and market requirements and came up with its agency model, which meets AML/CFT standards and is fully FATF compliant. ‘The AGCC understands operators’ businesses and in that process we have helped many operators who started small but have grown to be large, successful operators who have moved on to target customers in other jurisdictions,’ it said.

What price an image? It may seem like something intangible, but for anyone with a public profile, image is an asset which can be well worth protecting. Elaine Gray pictured and Fay Warrilow from Carey Olsen explain.

For sports personalities and celebrities, endorsement of products and services by means of their image can be of huge value. And Guernsey has something unique to offer in terms of protection of these images and personas. We'll return to that shortly - first, it's worth thinking about what a public 'image' actually is and how people have sought to protect it in the past. It might be thought that fascination with celebrities and their image is a wholly modern phenomenon, but in fact it has been around since Victorian times. In 1849 Prince Albert, most definitely a 'celebrity' of his day, succeeded in obtaining an injunction in the English courts preventing printer William Strange from publishing private family portraits and drawings without his consent. A common law principle which Prince Albert used to win his case, breach of confidence, was used 145 years later by Naomi Campbell to sue the Daily Mirror (through its parent company, Mirror Group Newspapers) when it published a photograph of the model leaving a Narcotics Anonymous meeting. The case went all the way up to the House of Lords, at which point the Mirror lost and had to pay damages. However, even where an image is used in a positive way that use may still infringe the celebrity's rights. Topshop was recently ordered to pay Rihanna damages for the unauthorised use of her image on t-shirts. Rihanna sued in 'passing off', which allowed the English courts to find that she had certain common law rights over aspects of her image in the nature of an unregistered trade mark. This belonged to her (and not Topshop)

and damages, albeit of a very limited amount in relative terms, were awarded. The case helped to show the inadequacies of passing off as a means to protect images. There are many cases of celebrities being unsuccessful in attempts to protect their image because the existing legal framework simply isn't geared up to protect images from unfair commercial exploitation. Thus the Spice Girls found themselves on the losing side when they claimed damages in misrepresentation and breach of contract against scooter manufacturers Aprilia in 2002. Aprilia had displayed the band's images on their scooters without their permission.

The registrations include personalities from Guernsey and wider afield. As an example, at Carey Olsen we recently registered the image of Nik Kalethes, a high profile Greek-American basketball player. Around the world, people and organisations with a public profile are increasingly recognising the benefit of registering an image in Guernsey. The benefits include direct protection of the image rights themselves, but also the opportunity to take advantage of a secure, stable environment for the management of those rights, including licensing and assigning them to other parties.

The Spice Girls lost. What these examples show is that there is relatively limited protection for famous people over their images in the UK and indeed further afield. In a nutshell, there is no dedicated protection for images, so anyone seeking to enforce their rights has to rely on cobbling together possible remedies from the existing (and inadequate) law. At least, that used to be the case, but in 2012 Guernsey took the step of creating a statutory regime to create a system of registration to protect images, becoming the very first jurisdiction in the world to do so. The Image Rights (Bailiwick of Guernsey) Ordinance, 2012 created an Image Rights Register, enabling a personality to register that personality and any images associated with it. Since then, we've seen a steady stream of images being registered from a wide range of public persons, ranging from politicians, musicians, business people and a good number of sports personalities.

And that's not all - the registration of a Guernsey image right could help to support the other intellectual property (IP) rights which celebrities will often seek to register such as trade marks and design rights. Registering a collection of associated IP rights will often lend support to each of the individual rights. If nothing else, it will provide important collateral evidence of the intent of the personality to protect their image. Under the Guernsey regime, images must be 'distinctive' to be registrable, but don't think that only an actual, visual image can be registered. An image includes much, much more and is essentially anything which identifies a person. An image can be a person's name, voice, signature, photograph, slogan, gesture, character or likeness anything which identifies that person uniquely. And uniqueness should be celebrated. Or, in the immortal words of Andre Agassi, 'Image is everything'.

Making sure large and valuable assets are adequately insured is vital, yet many trustees are not taking the appropriate measures to guarantee that an asset’s true worth is accurately reflected in the insurance policy.

on a recommended three to five-year basis, to reflect fluctuations in the marketplace and to avoid pitfalls that will potentially devalue a trust portfolio. Insurance brokers can often assist in obtaining a cost-effective valuation solution.

Property Estates risk significant financial loss if properties are under valued and trustees could be held accountable.

Jewellery Experts believe the need for accurate jewellery valuations is greater than ever. Trust advisors must consider that, in the event of a lost item of jewellery or watch, the insurance value on a policy must be accurate. Arranging a professional valuation of items every three to five years will help to prevent the owners from losing value. This valuation will take into account any special features that the item has, for example its carat, purity, grading and if it is from a particular jewellery house.

A detailed property valuation should always be obtained. This valuation would be different to the one employed for standard open market sales. It would consider improvements that may have increased the rebuild value of the property so that, in any event of damage, the property can be reinstated to its true value and original state. One of the most common discrepancies in insurance valuations is between the market value of the property and the reinstatement cost. Reinstatement must encompass site clearance, architect and surveyor fees and the inflationary costs during the insurance period and rebuild. Failure to insure a property on the correct basis could have serious repercussions for the trustee. It may reduce claim settlements, meaning that funds will not be available immediately to allow properties to be reinstated. In some circumstances, this can result in uninsured loss of rental income. Ultimately, a trustee does not want to be exposed for the failure in its duty to insure a property on the correct basis. Therefore, while the cost of insurance is an important consideration, it should not be the primary focus. A rebuilding valuation should be established

A valuation is an estimate based on the professional valuer’s knowledge and expertise. The valuer will research current market trends and recent sales results in order to form a comparable. As a valuation is often an expression of an opinion as to how much an item is worth, occasionally there may be a difference of opinion from one valuation to another. But all are legitimate as long as it is transparent as to how the valuation was reached. Fine art Valuations for fine art may be carried out for a number of different purposes and the monetary value credited to the item varies according to the type of valuation provided: Auction estimate valuation These offer an estimate of the fair market value for an item. Usually the valuer would provide a low and high estimate of the item’s value and this would reflect the price that

might be achieved if the item were placed in an appropriate auction. The low estimate normally equates to a reserve price or minimum selling price. These valuations should be reviewed every three to five years. Probate valuation These are carried out to ascertain the monetary value of the asset at the time of a person’s death and should reflect the midpoint of the low and high auction estimate. Insurance valuation Insurance valuations reflect an opinion of retail replacement values. This would be the price that would be paid for the item if purchased from a gallery or art dealer. These are usually the highest valuations and as a general rule are based on double low auction estimates, or more, and will include an allowance for transport, cleaning, reframing or any other associated fees as well as an inflation barrier. These valuations should be reviewed every five years or so. Asset valuation ‘cost price’ This is the original purchase price, which can be used as a basis of valuation with reference to purchase receipts. Naturally, over time, this cost price might be low against a rising market, but allows the client to protect their initial investment. Conclusion It is already the trustee’s duty to ensure assets are protected and insured adequately. Arranging basic insurance may not go far enough to discharge that duty. Trustees should seek professional advice to ensure that the insurance policy is appropriate and that the insured values are adequate in the event of a claim.

Trustees: banking on the value of partnerships As the financial landscape becomes increasingly complex, Lisa Norman of Investec Bank (Channel Islands) Ltd says it is essential for trustees to partner with banks and, just as importantly, for bankers to equip themselves with the right knowledge and people to add value to the business relationship. With the constant introduction of new tax rules and the challenges of understanding and entering new jurisdictions, many of which are emerging territories, trustees have to manage more risks than ever as they seek out new business opportunities. Coupled with this is the increasing complication of being able to ‘bank’ new clients. The trust world continues to evolve and on-going change is the norm. With these challenges comes a greater need for the trust and banking sector to work closer together and for specialist bankers to acquire knowledge to support their clients. At Investec Bank (Channel Islands) Ltd we are seeing increased trends towards new business flows from Asia, Latin America, Eastern Europe, the Middle East and Africa. Trust companies are looking for partners who understand their business strategies for these jurisdictions as well as the potential risks associated with the countries from which new trade flows are being sourced, coupled with an ability to mitigate those risks if benefits and commerciality are to be equally realised. Guernsey, Jersey and the Isle of Man are, understandably, all seeking a “level playing field” to ensure our jurisdictions remain competitive globally, and we believe that the quality tax neutral jurisdictions really are setting the benchmark. That has been recognised by the international Monetary Fund, which has complimented the Crown Dependencies on meeting international standards on anti-money laundering and success in complying with Financial Action Task Force.

However, a tight-knit team of 10 at one of Guernsey’s recruitment agencies appeared on the Guernsey Community Awards shortlist last year for a second time, and they continue to set a superb example of how a smaller business can make a huge difference.

‘As a company we have always had a good CSR philosophy that has encompassed a lot of different things, big and small,’ explained Belinda Windsor from OSA Recruitment, who takes responsibility of the company’s community efforts alongside her role as a recruitment manager. ‘In my opinion, it is an excellent way of showing all stakeholders that you are looking outwards and around you, and it also encourages kindness, helpfulness and teamwork among your workforce. Giving back to the community also helps a company to hold a strong profile within the market, which is important in a place like Guernsey. ‘We are only a small company of 10 people, but we have managed to achieve a lot for our community, and that feels good!’ Belinda and her colleagues run the OSA Pop Up Shop in Smith Street, which hosts local charities, organisations and small businesses, typically for a week at a time. They have been able to help over 100 residents since 2012, and the shop is now booked up for over half of 2016 already as Belinda explained: ‘All who use the shop can do so free of charge, but they need to either raise awareness or donate a percentage of their sales to a community cause or charity. We give them as much of the media support and awareness as possible, through local media as well as our own online channels.’

Although juggling daily work and Pop Up Shop duties can be a tough task, Belinda relishes the challenge: ‘Managing the CSR for OSA Recruitment is something I really enjoy - it uses a variety of skills including creativity and organisation, and I love seeing the rewards. The people I meet through the OSA Pop Up Shop are nothing but appreciative, inspirational and interesting. It is a busy role on top of my daily work, but it’s definitely worth it.’

Bailiwick Ambassador Scheme Guernsey’s cruise ship ‘meeters and greeters’ are some of the latest local tourism staff to complete the training under the Bailiwick Ambassador Scheme. The training programme was launched last year with the objective of ensuring a high standard of customer service and island knowledge amongst all visitor-facing individuals. Following the success of the initial phase, the scheme is now expanding and, in addition to hotel staff with whom island visitors come into regular contact, additional sectors within the island’s tourism industry have completed the programme, including taxi drivers and those who form the welcome team to all cruise boat visitors in St Peter Port.

Chamber’s tourism and hospitality sub-group head, Luke Wheadon, has been involved with the scheme since its inception. He is keen that anyone working within the industry who has a visitor-facing role should take part.

‘It’s fantastic that the scheme is broadening out beyond the hotel sector. Anyone who is in contact with visitors as part of their day-to-day job should get involved.’ The Bailiwick Ambassador Scheme is endorsed and fully supported by VisitGuernsey. Director of marketing and tourism, Mike Hopkins, said he was delighted that more industry members were taking up

the opportunity to receive the training. ‘It’s very important that Guernsey makes a great first impression to all its visitors. ‘Delivering an exceptional visitor experience’, is one of the Guernsey Tourism Strategy’s five key strategic aims. The Bailiwick Ambassador Scheme is an important initiative which was launched to help ensure all visitors have the best possible time when they are here, that they tell their friends and family about their wonderful experience, and to help ensure they return for a longer stay.’ The course is split into sections, including ‘classroom-based’ training as well as visits to key places of interest – the latter being of particular importance to non-local seasonal staff. The course ensures a full and thorough understanding of the islands and what they can offer, as well as highlighting the importance of delivering first class service. Conducted by local accredited tour guides and customer service trainers, the aim of the scheme is to give all visitors to Guernsey the best possible experience, whether they come for one week or one day.

Herm began 2016 with a welcome boost in publicity when, together with Jethou and The Humps (a collection of sandbanks off Herm’s north-east corner), the island was designated a ‘Ramsar site’ under The Convention on Wetlands. This accolade was welcomed by Herm’s CEO, Jonathan Watson and by the island’s small community 58

‘We are fortunate to have a real treasure trove of wildlife and flora and to be recognised at an international level in this way is great news for the island,’ he said. When Contact spoke to him, Jonathan was busy preparing for the 2016 season, with the island opening in time for Easter and the first of its events taking place in April. ‘We have a full calendar of events and festivals. Wine tastings in April and September; real ale and cider festivals in June and September; and other regulars like our gourmet weekends. These are always popular and a great way of encouraging people to stay a few days in Herm and experience the island to its full.’ Whilst part of Herm’s charm is the fact that it hardly changes from year-to-year, Jonathan manages a rolling programme of re-investment as he explained: ‘This winter the Ship Inn has been completely refurbished – the whole place has been ripped out and re-fitted. For me it’s one of Herm’s hidden gems and is constantly busy serving breakfast, lunch

and dinner throughout the season. We have also renovated the upper floor of Belvoir Cottage (Upper Belvoir) which is located five minutes from Belvoir Bay; and the shower/toilet facilities on the campsite have been upgraded.’ Much of Jonathan’s time is taken up with recruitment and training – particularly in the first few months of the year. ‘The recruitment process begins in January and runs through until around June. We are lucky that we have a number of staff who return to us each year. This helps from a continuity point of view and also they can support the training process and help new staff get used to island life.’ Overall Jonathan is upbeat about the coming season. ‘We are anticipating a good year with regard to staying visitors – whether that’s in the hotel, cottages or on the campsite. We are also seeing a growth in popularity for corporate events. Herm is perfect for things such as off-site meetings or team-building days. ‘The leisure day trip

In particular, designation lays the foundation to develop a management plan, in full consultation with those who manage, live and use the area, to ensure the conservation of key species and habitats. Ramsar designation has as its core principles the wise and

The White House Conservatory Restaurant (under chef Karl Ginnever) has maintained its Two AA Rosette status for over two years and this improved transport service will hopefully mean even more people can enjoy it.’

Boulangerie Victor Hugo re-opens its doors Walk along the Longstore in the early hours of the morning and you will be met with that delectable scent of freshly baking bread. A smell that has been absent for the past few months whilst Boulangerie Victor Hugo closed its doors and underwent a complete refurbishment. The kitchens have been entirely upgraded, the café given a new lease of life and the menu a fresh new look. At the end of January, the boulangerie re-opened its doors and welcomed customers old and new. Boulangerie Victor Hugo is owned and managed by businessman Reda Karim, who came to Guernsey in 1986. Reda, a hotelier, always dreamt of opening an authentic French boulangerie and in 2003, whilst visiting a friend in Paris, his dreams started to develop into something a bit more. Taking a stroll along Avenue Victor Hugo in search of a place to buy some cakes for his friend, Reda stumbled across a very pretty boulangerie/patisserie and bought a box of their cakes. After returning to the island, Reda set about turning his dream into reality and shortly afterwards, Boulangerie Victor Hugo opened in the first outlet. 12 years later, Boulangerie Victor Hugo is still as strong as ever, has relocated to larger premises and the passion Reda had all those years ago has not diminished in the slightest. If anything, it’s even stronger, and it’s a passion he shares with the entire boulangerie team - all having been handpicked by Reda himself for their reputation and passion.

Melissa is as close to the antithesis of grumpy as you will ever find. Having attracted the nickname Pollyanna amongst her friends and colleagues for her tireless positivity and optimistic outlook, even considering featuring her in this column was arguably a non-starter. But even Melissa’s Pollyannaism is challenged occasionally and we found out how. ‘Car drivers who don’t bother to indicate – and it’s astounding how many times I see this. Traffic would flow so much better if people would just indicate which way they are going. So many times I have been sitting waiting to pull out of a junction or onto a roundabout and then realise that there would have been plenty of time had a driver coming towards me bothered to indicate that he was turning off! I realise it would only save seconds of time probably but when you are trying to get to work ‘every

second counts’ as the saying goes. ‘ I have even found myself getting irritated by a friend when I have been sitting in the passenger seat and they haven’t indicated properly – I have had to make huge efforts not to become a back seat driver on occasion. It drives (no pun intended) me up the wall. ‘And apart from anything else it’s pretty dangerous.’ When it comes to queuing – whether in a car or elsewhere, Melissa yearns for a bit of Star Trek magic. ‘I think I am a little impatient by nature. The concept of ‘beaming me up’, so that I could arrive somewhere without all the travel hassle is quite appealing. I could never live anywhere with a significant commute – I don’t know how people do it. Vazon to St Peter Port via Rainbow Nursery is enough for me.’

Melissa balances a nearly full time job as director of Situations Recruitment with looking after her daughter and a busy home life, so it’s unsurprising that time is precious. Which brings us on to her other pet hate – also related to spending unnecessary time in queues. ‘Slow checkouts! Irrespective of whether there is a long queue or not, I can’t bear it when checkout staff seem to be in slow motion mode. It’s not right across the board but sometimes in supermarkets there have been times when checkout staff have needed to change gear – or warp speed. All these small things that waste precious minutes in my day can set me behind schedule.’ Teleporting might be light years away but if anyone does manage to re-invent Mr Scott’s transporter, Melissa will be at the front of the queue.
