Disabled camper sues Curry County

Lawsuit filed on violations of civil rights and disability law

Curry County and several of its employees could be heading to court after attorneys representing the firms of LeDuc Montgomery LLC and Albies and Stark LLC

filed a federal lawsuit regarding civil rights and disability laws. County officials attempted to remove an unhoused camper through unconventional means. The plaintiff, John Malaer, is a 65-year-old local advocate for disabled and unhoused communities who was camping in the lot near Shopping Center Ave. and Zimmerman Lane. A paraplegic with significant medical challenges, Malaer chose this location because it was near

Brookings CORE Response, a homeless services organization many rely on, and it allowed him to charge his electric wheelchair.

The Curry County Sheriff’s and Code Enforcement offices issued a trespassing notice for the public space. Dated July 11th, 2022, the notice stated that trespassing was prohibited in this area, and all persons and property must be removed by July 13th, 2022. This is in violation of an Oregon Revised Statute against unlawful camp removal policies.

According to ORS 195.505, any notice must be given 72-hours prior to any removal of homeless individuals from a camping site. This statute also provides that any personal property at the camping site left unclaimed must be delivered to an organization in the same community as the camping site, for easy retrieval. That organization and its location must be listed on the trespassing notice, which the County failed

to do in this

notice was not in compliance and therefore not valid. Code Enforcement was notified and rescinded the notice. The plaintiff and their representation provided

Chetco girls bring home championship from Medford

The Chetco Basketball Club and is comprised of 2-4 Grade girls from Brookings. The team was formed in March of this year, but are progressing rapidly. The girls have been practicing twice a week and have played 23 games since April. They have played teams from across Oregon and California. The program was started to provide a year-round, competitive basketball environment for the youth in the community. “The girls have progressed tremendously since March both on and off the court,” said coach Tyler Wood. “As coaches, we could not be prouder.” This past weekend the team competed in the coed 4th grade division of the MBA Summer Kickoff Tournament at the Rogue Credit Union Community Complex in Medford. The girls faced the MBA Girls 4th grade team from Medford in the Championship game and won by a final score of 21-6.

Cable installation to begin for OSU-led wave energy testing facility off Oregon Coast

Later this month, crews will begin installing the power and data cables that are essential to completing construction of a new wave energy testing facility off the Oregon Coast.

The cables will support Oregon State University’s PacWave South, the first prepermitted, utility-scale, gridconnected wave energy test site in the United States. When the facility is completed, wave energy developers will be able

to test different technologies for harnessing the power of ocean waves and transmitting that energy to the local electrical grid.

Huge challenge “Transmitting power from wave-energy generators to shore in a form compatible with the regional power grid is a huge challenge, and cabled connection from PacWave South provides the capability to test powerdelivery technologies,” said Burke Hales, PacWave’s chief scientist and a professor in the OSU College of Earth, Ocean, and Atmospheric Sciences.

“These cables are highly specialized and their installation and burial is a keystone of wave energy development in the U.S.”

The work includes installing four power and data cables ranging in length from about 10 to 13 continuous miles from a vault under the parking lot of Driftwood Beach State Park south of Newport out to the test site offshore.

Louisiana-based subsea cable services contractor R.T. Casey is overseeing the installation of the cables. The work will be carried out by crews aboard three vessels and will likely be visible

to beachgoers and visitors for the duration of the installation process, which is expected to take six to seven weeks, depending on ocean conditions, said Dan Hellin, deputy director of PacWave.

The cables will be anchored in an underground vault at Driftwood and will run through conduits from the shore under the beach, then come up out of the

seafloor about 1 mile out. From there to the test site, the cable will be buried about three feet under the seafloor.

The subsea cables, which were manufactured in Norway by the Paris-based firm Nexans, were transported via freighter to Louisiana and transferred to Offshore Support Vessel (OSV)

instance.

video evidence of officers acknowledging the notice was inactionable.

Too old???

There is a thread weaving its way through public talk and publications: “too old” followed by question marks and questions.

Even a New York Times video on the aging Chrysler Building in New York City, a stalwart landmark, should it be demolished? I am also aging, but more than that I notice with the discourse, basically inferring all things “old” should be discarded, what’s missing is the, what’s next.

No new ideas are coming from behind “old” institutions, no think tanks led by a new generation. These days post-pandemic did not bring with it an interest in change for the better, only more acerbic, nasty, baked and fried talk, talk talk about how to destroy, but not how to reconstruct.

If you look at it, those of us aging “boomers” wanted to change the world, we came to the fight against the Vietnam War, we showed up to bring women needed health and welfare, we got the vote for 18-year-olds drafted to a war, we built a city on rock and roll!

Now I weep at every mass shooting, how somehow, we think it will all go away, no one stands for the children. It’s not “old” that harms us, it’s our failure to imagine.

Our religions have made us fearful of our neighbor, not hopeful for each other. As old as President Biden is, he is a statesman with honor who will protect the next phase of our domestic and national interests and opportunities.

As old as Mr. Trump is, he has no interest in others and never has, he will destroy our country and celebrate creating fear and destroying hope.

This “too old” distraction diverts us from thinking clearly about what our real futures might look like. It’s not about “too old”, is it?

It is a wonderful program that teaches 5-year-olds entering Kindergarten in pedestrian and life safety. The class is 1 week long — Mon. through Fri. for 2 1/2 hours each morning. The graduates have a short but fun graduation ceremony on Sat. morning at 10 a.m.

Fatal crash on Hwy 101 near Port Orford

CURRY COUNTY, ORE.

- On Sunday, July 14, 2024, at 11:40 p.m., Oregon State Police responded to a single vehicle crash on Hwy 101, near milepost 298, in Curry County.

The preliminary investigation indicated a southbound Ford F250, operated by James Franklin Mickelson (36) of Sixes, left the roadway for unknown reasons, traveled approximately 400 feet through a field, and struck a tree. The collision caused the vehicle to become engulfed in

flames.

The operator of the vehicle (Mickelson) and passengers, Joseph Frances Kurka (20) of Sixes and Dereck Eugene Stroop (35) of Port Orford, were all declared deceased at the scene.

The highway was not impacted during the onscene investigation. The cause of the crash is under investigation.

OSP was assisted by the Port Orford Fire Department, Sixes Fire, Coos Forest Patrol, Coos Fire, the Curry County Sheriff’s Office, and ODOT.

Slow population growth, early retirements impact in Oregon

A new report from the Oregon Employment Department illustrates the impact of slow population growth and increasing retirements in the state.

The youngest members of the large Baby Boom Generation, born between 1946 and 1964, turn 60 years old in 2024.

Workers in this age group have been, and are expected to continue, shifting into retirement and taking their skills and experience with them.

In 1990, one out of 10 Oregon job holders was age 55 or older. By 2022, that share grew to 24%.

In 2023, the number of Oregonians not in the labor force due to retirement reached 786,000, an alltime high. Over the past decade, the number of Oregonians not in the labor force due to retirement grew by 160,000 or 26%.

The workforce is aging nationally as well, but Oregon has been at a workforce advantage in boosting its labor force.

Decades of population growth – driven primarily

by net in-migration –has helped fuel labor force growth, even as the workforce has aged and overall labor force participation rates have generally declined.

Oregon’s population grew by 40% between 1993 and 2023, compared with 30% for the U.S.

Oregon’s natural increase in population turned negative in 2021 and 2022, with fewer births than deaths, as the COVID-19 pandemic met the longterm trends of an aging population and lower birth rates.

In 2021, for the first time in almost four decades, population estimates showed negative net migration, and an overall decline in Oregon’s population.

The declines in natural increase, net migration, and population have contributed to slower labor force growth. Slower gains may be somewhat offset by greater labor force participation among the existing population.

Oregon’s labor force participation rate was 62.4% in 2023, the highest

in a decade. That’s still well below the peak of 68.9% in 1998.

During periods like the past couple of years, where low unemployment and relatively large numbers of job openings are paired with slow labor force growth, that creates a tighter labor market for Oregon employers. That makes it harder for employers to find enough workers to fill all their job openings.

These dynamics may have also contributed to Oregon’s slower job growth in recent years compared to the U.S. Nationally, total nonfarm payroll employment expanded by 3.4% between 2019 and 2023, while Oregon’s expanded jobs by 1.2%.

This is a change; typically, Oregon’s job (and labor force) growth exceeds the nation’s over business cycles. If recent labor force and unemployment trends continue, they might further limit Oregon’s growth potential relative to historic norms and the nation.

According to the plaintiff’s council, Rose was given a reassurance that no enforcement would take place until discussions were held with the County over legally compliant language.

Unfortunately, the County would not uphold this assurance. According to Malaer’s attorneys, on July 17th, 2022, the county proceeded to lease that property to one Dr. Ue Ching Ow for a full nominal fee of $1, a suspicious proposition. We attempted to make contact with Dr. Ow, an anesthesiologist from Northern California who already leased the adjacent property, but with no luck. It seems that little to no development has occurred on the property since the five-year lease was signed.

Under Oregon state law, leasing practices state the lessee and county must demonstrate or provide a general public benefit. The plaintiffs argue that there is not a general public

benefit in this situation, and that this lease was signed primarily, if not entirely, to turn campers into trespassers. The discussion in the County Commissioners meeting on July 6th, 2022, on this specific lease is telling. There is no discussion over what the land will be used for, or the business prospects of the lot. The entire conversation is framed around the lease as a solution to the ‘problem’ of the unhoused camping there.

Legal observers had been accompanying Malaer at the camp, when officers advised them that the property was now private. Malaer and the legal observers disputed this and despite further reassurance that officers would not act to remove the campers until a ranking officer could come explain, the deputies returned after the legal observers had left and arrested Malaer on second-degree trespassing at around 9:30 P.M. that evening.

The plaintiffs hold that this was a discriminatory act conducted by the

County, who used unlawful citations and bad faith leasing practices to remove disabled unhoused from a public lot. According to attorney Alicia LeDuc Montgomery, this is about much more than a single instance of discrimination.

“This lawsuit is not just about seeking justice for Mr. Malaer; it’s about holding Curry County accountable for its systemic disregard for the rights of disabled and unhoused individuals. The actions taken by the County were not only illegal but also morally reprehensible,” said Montgomery.

This is not the first instance of a case involving the rights of the unhoused that has hit Curry County. In January 2022, the City of Brookings was sued after they attempted to limit the amount of meal services St. Timothy’s Episcopal could provide. With the recent Supreme Court decision in Johnson vs Grants Pass, we could continue to see local governments take emboldened stances against their unhoused populations.

Once the work begins, a second vessel, the OSV Nautilus, will follow behind to bury the cable using a remotely-operated vehicle. Those two vessels are expected to work around the clock for the duration of the installation and their lights may be visible at night when they are close to shore, Hellin said.

Safe distance request

“We are asking all mariners in the area to maintain a minimum distance of 500 yards from any vessel involved in the cable installation process,” Hellin said. “While these vessels will be moving very slowly, they will be laying cables and have equipment operating on the seafloor, so they will be unable to stop operations or deviate from their planned route.”

A third vessel, the M/V Liberty, will support diving operations during the cable installation and provide other assistance as needed. That vessel will make trips back and forth from Newport while the work is underway, Hellin said.

On land, another group will be installing cables that run from the vault to a shoreside utility connection and monitoring facility on the east side of Highway 101 just south of Driftwood. Two of the three buildings at the site are nearly completed and the third is a couple of months behind them, Hellin said.

Portions of the Driftwood Beach State Recreation Site parking lot will be closed beginning July 16 to accommodate the work. Beach access and park restrooms will remain open, but parking may be limited and recreational vehicles and other large vehicles may not be able to turn around. Alternative parking and beach access is available at Governor Patterson Memorial State Recreation Site 3 miles south of Driftwood Beach.

“We will maintain some parking and access to the restrooms, beach trail and the viewing platform at the park so people can watch the action if they are interested,” Hellin said.

Access to Driftwood is expected to be limited through mid-September. Once the cables are installed, the open ocean test site will be marked with a series of buoys to alert mariners traveling in the area, Hellin said.
