The moratorium affects the following zip codes within the Smith River Complex and include 95531, 95532, 95568, 95546, 95548, 95556, 95567, 95568 and 96039.
The moratorium also includes all residential properties within the Happy Camp Complex Fire

The rim-to-rim-to rim hike
(R3) in Arizona’s Grand Canyon is well- known to seasoned outdoor adventurers as a meaningful achievement. The beautiful vistas of this natural wonder attract nearly 5 million tourists, annually but only about one percent
hike to the bottom. Of those, upwards of 250 require rescue mid-hike and the Grand Canyon claims an average of 12 lives per year. Those who achieve a successful R3 and live to tell about it can take home more than bragging rights. Some find greater meaning and purpose through the monumental effort. Crescent
City’s David Lee Hatton II didn’t finish the R3 on his first attempt this past March, but he did come away from the experience with a fantastic story and indelible connection with a new band of brothers.
“I prayed for my life to be saved and this group of men found me out of nowhere. It was like divine intervention,” says
David.
Last winter, the now 19-yearold had started the R3 (down the South Rim) with a friend, only to face the hike alone after the friend turned back. Determined to complete the task, Hatton forged ahead. He was caught by the frigid weather and soaked

At Harbor, lack of disclosure raises more questions than answers

At the Tuesday Crescent City Harbor Commission meeting, Comptroller Thomas Zickergraf conducted his periodic presentation on Harbor finances. Zickergraf shared the current balance of the combined harbor balances is $509,118 as of mid-September. The figure represents an $111,000 decrease from last year. Zickergraf reported $324,000 is enroute to the CCHD from various grants but the CCHD is still missing the $252,000 from Renewable Energy Capital and principal Alex Lemus from income derived from the ground-lease on the two closed harbor RV parks.
Understandably, the financial figures can be easily misunderstood but the failure to explain the problem to the public is troubling. The Harbor District is a public agency and it obligated to keep the public well-informed.
The Lemus group and the CCHD are apparently in a legal squabble on who pays who and how much.
When it came time for public questions and comments, The Triplicate editor asked relevant questions about the status of this closed session item, and it took a little more than the three minute per questioner time frame. Commissioner Brian Stone interrupted the editor’s public inquiry and complained the questioning exceeded the 180-second discourse and was delaying the meeting’s agenda. The Triplicate editor asked the following questions before the Stone interruption:
• When does the commission plan to discuss the nature of the misunderstanding with Renewable Energy Capital? Harbormaster Tim Petrick attempted to answer this question but was cut off by Stone’s interruption.
The Del Norte High School football team cruised to a 48-18 win over McKinleyville on Friday to improve to 2-2 on the season. The Warriors jumped out to a 21-0 lead after one quarter and never looked back while taking the victory.

Gavin Newsom’s August 29 emergency fire declarations, issued a mandate that no insurer shall issue a notice of cancellation or non-renewal due to wildfire risk. while stranded in the canyon snow with his body temperature falling rapidly. The clock ticking as he braved the elements, he reached the Manzanita rest area only to find the Park Service Ranger residence was only seasonably staffed and not yet open. Hatton found a bathroom and wisely stripped off his wet cotton clothing. As far as David knew, no help was coming.
Luckily for David, another group was out on the frosty trails. A band of 13 men was attempting the R3 at that moment. The group was led by three founders of Man Made, former Colorado Rockies pitcher Josh Kalinowski, U.S. Army Lt. Colonel Jimmy Kleager and retired U.S. Navy SEAL and Sniper School instructor William Branum. The three leaders and their clients had been training for this adventure for weeks-yet everyone was caught off-guard when they heard cries for help in the dark as they reached Manzanita.
That’s when they found Hatton, dangerously cold, shivering in his underwear in the rest-station bathroom. According to Man Made’s Kleager, Hatton was wise to strip down after his cotton gear got soaked.
“In the adventure world, there’s a saying, ‘cotton kills’ because as soon as it gets wet, it wicks the heat from the body. Wearing wool or other technical clothing is preferable, but for David it was too late. Even in underwear, a person is in a better situation than they’d be with wet clothes sucking out body heat. I’m just glad we could help him in time,” Kleager said.
The group of heroes (via radio) contacted park rangers and saved David Hatton’s life escorting him back to the Ranger Station at Phantom Ranch.
David has completely recovered and is eager to return to the canyon that nearly claimed his life. On October 2 he rejoined his rescuers turned mentors and began an attempt to conquer the R3 once and for all. The hike is expected to take 16 hours to complete.
David has been humbled by this ordeal. One might say it’s a hike to redemption.
“Exposure is no joke,” he said. “The situation could have gone so much worse. Another couple of hours and I wouldn’t have made it. I feel so incredibly lucky.”
David did not mince words about his excitement to return to the Grand Canyon with Man Made.
“You can say the R3 and I have unfinished business. Only this time, I’m not going it alone,” he said.
David Hatton’s closing comment on this experience, “Don’t accept failure as the enemy. Never give up. Never!”

McGuire’s ‘Keep the Firehawks Flying Act’ heads to governor’s desk
Year after year, California’s firefighters battle wildfires that have grown larger, hotter and more extreme.
To battle these mega-fires, CAL FIRE planes and helicopters (the largest aerial firefighting fleet in the nation) need a quick supply of fuel to stay in the air and protect communities, suppress blazes and support firefighting crews on the ground.
Senate President Designee Mike McGuire’s critical legislation, SB 68, will ensure that CAL FIRE aircraft keeps flying by permitting aviation
remain hidden in the dark corners of the long-standing item within the closed session closet. Questions include:
• Will the Harbor fix the substandard Fashion Blacksmith building?
Arbitrators ordered repairs on the building by September 30. No work has been conducted by the CCHD, to date and the seven percent penalty will now begin. The public has no knowledge on the harbor’s intent.
• Will the Harbor continue its unsuccessful efforts to dredge the inner Harbor by October 31, as ordered by the arbitration panel? Again, the public has
fuel transport to continue beyond standard hours of operation during a declared state of emergency.
“Having enough aviation fuel for fire suppression aircraft is a critical part of California’s coordinated response to battling these ever growing massive mega-fires. But current state law makes it challenging for truck drivers to consistently transport aviation fuel when and where it’s needed most. If this legislation is signed, the California Highway Patrol through the development of new rules and
regulations, will make sure hardworking truckers keep hauling aviation fuel during state emergencies around the clock. We desperately need to keep Firehawks flying, protecting communities during our greatest times of need,” said Senator McGuire.
California currently relies on a patchwork of emergency waivers in order to keep these aviation fuel trucks rolling during disasters, but this legislation would automatically allow truck drivers to continue the delivery of this important resource - aviation fuel.

Laura Lee Throop was born in Crescent City, CA. on August 28, 1954, and passed away peacefully on August 23, 2023, surrounded by those who loved her dearly. Laura was 68 years old, and 5 days shy of her 69th birthday.
Laura was more fondly known by her loved ones as Schnookums, Mamacita, and Nannie. She was an extraordinary woman who was adored by everyone who knew her. She recently became a great grandmother and was extremely proud of the title. She poured her heart into her family and made sure those around her felt loved. She will be remembered for many wonderful things, but especially her gentle and loving soul.

Follow the trash trail to the county land next to Walmart

A county-owned land parcel next to the Walmart continues to be a magnet for trash. All one has to do is follow the trail of discarded chips packets, expended food and gum wrappers, plastic utensils, drink cups and shopping carts to recognize laws prohibiting trespassing and littering are not working and human disregard for these offenses continues to fester.
Over the years, volunteers have steadfastly cleaned up scores of tons
of trash several times only to see the property, hidden by lots of green growth, continue to be assaulted. Simply stated, there are no consequences for irresponsible folks who foul the community. The crimes are low level misdemeanors and rarely, if ever, are prosecuted.
2nd District Supervisor Valerie Starkey organized yet another clean-up several weeks back. As part of the Clean California program, Starkey brought together volunteers from Mission Possible Women led by Daphne Cortez, removed a dozen aban-
doned shopping carts from down in the ravine. Other volunteers included Rory McDonald, Mike Richter, Michael Duval and many Walmart employees, on and off-duty. Walmart provided refreshments. Recology Del Norte donated a large trash bin and hauled away the most recent dump of garbage. More than 1660 pounds of trash were removed. Starkey provided gift cards to all the hero volunteers. Regrettably, the vacant land has been trashed again.

a convenient walkway paralleling the 101 on-ramp at Washington Boulevard. The agency also added a safety crosswalk over Washington for pedestrians to access Walmart. From there, one simply follows the trash trail to the store.
Starkey asked her colleagues on the board to clear-cut the growth in an effort to remove the hiding spots for folks who are living within and creating these messes. Due to staff shortages, the cutting back of brush has yet to start.
Sheriff Garrett Scott,
whose job it is to enforce the no trespass ordinance, is unable to do so.
“We simply do not have the staff to maintain the property and provide law enforcement for the rest of the county,” Scott said.
Scott wants the area properly controlled and those who trespass should be fully prosecuted. The sheriff also reports his department is down 11 deputies.
“Larger counties and cities attract our law enforcement with big signing bonuses and higher
salaries. We lose good deputies because we cannot compete,” he said. The sheriff stated the department needs to up its salary schedules and be competitive.
Cutting back the heavy brush for open view helped the Department of Fish and Wildlife deter transients from occupying and trashing its property along South 101 over four years ago. The cutback has worked well.

Minges hired as city building inspector

What started as a search for warmer weather during one frozen Detroit winter turned into a nice career on the northern California coast.
Dan Minges started his construction career on a framing crew in Detroit, taking the harsh Michigan winters off.
He finally had enough and decided to make his way west, living a stint in Los Angeles before making his way up the coast to Crescent City.
Getting out of the construction side, he landed a job as the Del Norte County building inspector for 25 years. He had teachers and mentors along the way, guys like county inspector Stan Morris and Director of Public Works Ernie Perry, helping him hone his skills.
“I got a lot out of those guys. They didn’t just have one job,” Minges said with a laugh. “Stan taught me how to deal with the public.
“As building inspector, they either love you or they hate you. He guided me on how to be congenial, treat people with respect and not try and be a Mr. Know-It-All. I try to pass that along to the next guy. I tried to pass that along to one guy and he didn’t pay attention, and he’s not there
anymore.”
When he retired with the county, he had a chance to go to work as an interim building inspector with the city and the temporary job took on an extended stay through the COVID-19 pandemic.
Now Minges will have that same opportunity to share the ins and outs of the trade with part-time building official Sean Rosenthal, who will start with the city on Oct. 2.
On Sept. 18, the Crescent City City Council approved and adopted Resolution No. 2023-67, authorizing the appointment of Minges to the Retired Annuitant Position of Building Inspector –Extra Help.
The title basically translates into Minges will transition from his temporary appointment as building inspector to the “Extra Help” retired annuitant position and help Rosenthal settle in.

“Sean doesn’t have the on-the-job experience, so he’ll be able to work under the tutelage of Dan until he gets required experience.
The first calls for development are starting to come in wanting to do something, so engaging with the current building inspector on what they need to submit, some of the rules and regulations on the building side - those two people are going to be key to our long-term development.”
The anticipated workload, Wier said, involves large multi-family construction projects, including the 27-unit new construction, 160-unit new construction, a 56-unit new construction, and 45-unit rehabilitation project, all of which are expected to be built in the next two years.

Regarding the Electoral College, Patricia J. Estlund of Crescent City went right to “the source,” the Philadelphia Constitutional Convention of 1787. She cites two arguments entered into the record on July 19. But on July 16, after much debate and deliberation, the delegates took action on a more foundational issue: they approved The Great Compromise, giving every state, large and small, an equal number of senators. This put into operation the principle that states are sovereign and have an equal place at the table in governance.
We don’t have a “Peoples’ President.” POTUS stands for “President of the United STATES.” The delegates were intent upon preserving the Union. I submit there has never been a greater need to do so than in 2021.

We must fund the government

Funding the government is one of the most basic responsibilities we have in Congress. However, as we approach the September 30th deadline for passing a government funding package, the most extreme faction of the House Republican Majority is sowing chaos. There is real, pressing work to do to make life better and more affordable for people in America, but instead, the majority is wasting time with political stunts and partisan games. Once again, MAGA Members of Congress are holding the government hostage with outlandish demands and a radical agenda. Essential services including health care, childcare, education, food assistance, and public safety need funding- not harsh cuts.
My Democratic colleagues and I want to keep the government open and pass a budget that puts people over politics. The American people will pay the price of a government shutdown. It would disrupt the livelihoods of hard-working families, interrupt critical government services, hurt small business, and endanger our national security. It’s simple: We cannot afford an extreme MAGA Republican shutdown. It’s time for Speaker McCarthy to get serious about governing, and I hope to see him start working across the aisle to get a budget passed for the American people.
Other Priorities I’m Working On:
• Protecting America’s Endangered Species: We recently celebrated the 50th anniversary of one of our country’s most successful environmental laws – the Endangered Species Act (ESA). As part of the festivities, I was honored with an award recognizing my efforts to protect the ESA. It was especially meaningful to have the Yurok Tribe celebrated among my fellow honorees for their incredible work to support our region’s iconic wildlife.
• Supporting the Shasta-Trinity National Forest: I have been championing legislation to help Shasta-Trinity National Recreation Area managers get the consistent funding they need to improve outdoor recreation, boost the local economy, and maintain this regional treasure. I’m excited to share that it just passed out of the House by a unanimous vote. I’m looking forward to seeing my bill pass the Senate and head to President Biden’s desk for final passage.
• Advocating for Tribal Support: The Department of Justice recently launched a program across ten states to address the crisis of Missing or Murdered Indigenous Women and People (MMIP), and while this program is a critical step, I’m disappointed that California was excluded from the list of states receiving assistance. Senator Alex Padilla and I led a letter to Attorney General Merrick Garland requesting that the DOJ rectify this grave mistake and provide our Tribes with the support –and justice – they deserve.
• Restoring our Kelp Forests: Senator Jeff Merkley, Senator Angus King, and I introduced the Help Our Kelp Act to support and uplift the recovery of our kelp forests.

Good government requires transparency
There is a stark difference between local government agencies in the way they manage and record public meetings.
City Council and Board of Supervisor meetings are run with professionalism. Agendas are posted in a timely manner and minutes are published promptly.
Smaller agencies may find it harder to meet all the requirements in scheduling legitimate public meetings, but the same rules apply regarding the rights of the public to be informed and involved with government decision making.
Good government requires open debate and transparent processes. Facilitating public involvement before decisions are made will often result in a better outcome. Elected officials and staff do not know everything and outside perspectives can be helpful. Through debate and discussion, the best ideas often will emerge.
It’s The Law
Not only are open meetings good policy, but it is also the law.
The Ralph M. Brown Act is the California law that requires open meetings for local legislative bodies. The ultimate purpose of the Act is to provide the public with an opportunity to monitor and participate in the decision-making process of local boards and commissions.
State law requires notification to inform the public in advance of any decision through a published meeting agenda. The proposed action needs to be described in enough detail that the average person can understand what decision might be made.

Dozens of TVs, refrigerators, stoves, washers, dryers and abandoned cars had either been gunshot, torched or both.
This place of destruction was what some locals called “Carnage Canyon,” roughly 30 acres off Lefthand Canyon in Boulder County, Colorado.
It was a shocking sight, but was it unique? Think about your own nearby public lands.
This canyon’s history began with mountain biking. Sometime in early 2000, a mountain biker discovered the canyon and developed a trail through it. Then, more bikers came in droves and “motocrossers” also loved it, particularly because nobody was around making rules or telling them what to do.
Nobody complained to the Forest Service, the managing federal agency.
After them came people in Jeeps who liked to plow through mud, crawl over big rocks and climb up the sides of the canyon. They also widened the trail into a one-lane, eroded dirt road.
Still other folks figured the canyon was a great place to dispose of junk
to speak on any subject on the agenda. Each agency can set its own rules but it is standard practice to allow 3 minutes per agenda item. These rules should be applied equally to everyone. For regular meetings, the agenda must be posted 72 hours in advance of the meeting, listing the time and location. This is to allow the elected officials and the public sufficient time to review and research a topic that is scheduled to be discussed and voted on.
Under special circumstances the presiding officer or a majority of the Board may call a “special” meeting with 24-hour notice. However, if these short notice meetings are employed too often, this can deprive the public of the opportunity to prepare and participate in the debate.
Real Life Issues
This is more than an academic discussion of the rights and responsibilities of public participation. At a recent Harbor Commission meeting (9/19) I wanted to comment on a pending decision to have a “burnout” competition. I first heard about this at their September 5th meeting.
The proposal was to host an event where cars spin their tires on a fixed metal plate. I am not entirely sure how someone wins such a burnout competition, but I am guessing that whoever burns the most rubber, wins.
I was not sure how they voted at the September 5th meeting, so I looked for the minutes, but they were not published on the next agenda as is the norm. Without minutes of the prior meeting, I wasn’t sure if they voted to approve this event.
cars and appliances until the place began to resemble an open landfill. Target practice came next. Still, no one complained.
What else happened to this much-abused canyon? A murder and manhunt followed by a homeless people whose encampments were not healthy for what was left of the woods. Yet none of this was the cause for restoring the canyon to its original state.
Hey, there were no complaints! But here’s how erosion changed things. It brought water carrying large amounts of silt down past the canyon’s mouth and into Lefthand Creek. After the silt killed all the aquatic insects, the trout left. It was people who liked fishing for trout who demanded that the steam be fixed, and that meant the canyon had to be restored.
The Forest Service invited two nonprofit groups — Wild Lands Restoration Volunteers and Trail Ridge Road Runners — and Walsh Environmental Services to restore the canyon. Over seven years, bullet-ridden debris was hauled away and the squatters discouraged. But it took hundreds of volunteers to dam the erosion channels — one
What Did They Do?
This burnout competition was not on the agenda for the September 19th meeting so no further votes could be taken that day. I shared my concerns anyway. I alerted them to recent scientific studies that show that toxic chemicals, deposited by tires on our roads, run off into our watersheds and kill fish.
I reasoned that it makes no sense for the Harbor District to sponsor an event that might deposit tire waste into our harbor. The Harbor should be taking steps to protect fish, not harm them.
In response to my comment, one commissioner said that he was aware of these studies but that he “approved” this event because the organizers promised to contain the tire debris. Staff explained that this event was approved in concept but did not have final approval from the Commission. There is no record of this action.
Missing Minutes
Minutes should be kept recording the actions and votes at every government meeting. It is the best practice to publish these minutes at the next meeting so they can be approved or amended by the board. When minutes are published everyone can review actions that were taken. Without approved minutes there is no public record.
While I was objecting to the plan to burn rubber in the harbor, I also pointed out that the Harbor District was missing minutes from eight different meetings dating back to July. These minutes were never posted on a public agenda and have not been reviewed or approved by the Harbor Commission.
When the Harbor
President asked why these minutes had not been completed, staff explained that they were busy doing other things. This is unacceptable. Whether due to understaffing, incompetence or willful obfuscation, there is no excuse for not keeping the public record up to date.
Tune In Next week
I am not alleging that the Harbor District has violated any laws. What I am suggesting is that they should do better in keeping the public informed and involved. I recommend that the Harbor District commit to more open and accessible deliberations. Good government requires transparency.
In my next column I will have more to say about the happenings at the Harbor. I will describe other consequential actions that were taken at “special” meetings with only 24-hour notice. I will tell you the story about the Harbor lease approval that was rushed through at five separate meetings in sixteen days, including three “special” meetings with 24-hour notice. 20 feet deep — and replant grass, shrubs and trees in the trashed roads and open areas.
Some areas had eroded so steeply that a person could stand upright, reach out and touch the ground. Hay bales used to mulch grass seeds would tumble down the slope like bison stampeding over a cliff.
But one problem remained and it was a big one: target shooting. A number of “near misses” made many shooters uneasy. There were also five documented shootings involving Forest Service employees and 10 complaints from area residents about flying bullets too close for comfort.
When the Forest Service erected signs closing the area to recreational shooting, their signs became targets riddled with bullet holes. But after the canyon was damaged by flooding in 2013, motorized access became blocked and target shooting was phased out.
These days, the canyon no longer looks lunar, fish are finally back and silt traps at the bottom of the canyon are almost empty. Mountain bikers are welcome on designated trails.
Locals liked to blame tourists, newcomers and outsiders for the illegal
dumping, vandalism and unregulated shooting in the mountains. But Carnage Canyon’s problem areas were not tourist destinations, and most of the broken appliances and shot-out signs were problems well before the surge of newcomers.
The truth is that when damage occurs over the decades, it is usually done by people who live in the area. We have to put the blame where it belongs, and that’s on us. We are the yahoos who do this, not Californians or Texans.
It’s also true that no government agency will act unless we complain. So when there’s an opportunity to participate in planning for what the agency calls “travel management,” we need to get involved.
Federal agencies need to be better protectors of the public lands they manage for us. And when we see rampant abuse, we need to blow the whistle to protect the lands we all own.

Plaintiff alleges: I. THE PARTIES
1. Tolowa Dee-ni’ Nation (“TDN” or “plaintiff”), a federally recognized tribe, is the owner of Xaa-wan’k’wvt Village and Resort (“XVR”), a mobile home and recreational vehicle park operating under the laws of the State of California, and permitted by the California Department of Housing and Community Development (“HCD”), located at 12400 Highway 101 North, Smith River, California, 95567.
2. Defendant John Enos is the registered owner of a mobile home, decal number AAU5340, located at XVR (“the mobile home”). The situs address of the mobile hone is 12400 Highway 101 North, Space 964, Smith River, California 95567. The address of record for defendant John Enos is the same as the situs address of the mobile home.
II. JURISDICTION AND VENUE
3. Venue is proper in this County because both plaintiff and defendant either reside or do business in Del Norte County, and the mobile home that is the subject of this petition is located in Del Norte County.
III. FACTUAL AND PROCEDURAL BACKGROUND
4. Tolowa Dee-ni’ Nation purchased and took over management of XVR on or about December 1, 2016. When the Tolowa Dee-ni’ Nation took ownership, not all of the park records were transferred to the plaintiff from the previous owner, and more records dating back to 2001 or older were destroyed.
5. The mobile home was located in XVR, in the same space that it occupies now, Space 964, when plaintiff took over management on or about December 1, 2016.
6. On or about January 1, 2021, XVR staff became aware that the rent of the mobile home space had not been paid in two months, and the mobile home appeared to be unoccupied. John Enos’ daughter, Samantha, had paid the rent on the mobile home through November 2020. Plaintiff has had no contact with Samantha since that time and has no current address for her.
7. On 8/16/2023, plaintiff conducted a title search through HCD, which revealed the names and address of the defendant. A true and correct copy of that title search is attached to this petition as Exhibit A.
8. The title search revealed that defendant was residing in the mobile home since approximately February 5, 2001. The title search also lists the situs address as 12400 Highway 101 North, Space 956, but plaintiff states that this is outdated information, as defendant resided in Space 964 when plaintiff took over park ownership.
9. On October 20, 2022 plaintiff caused to be posted a Notice of Belief of Abandonment (“Notice”) on the mobile home. A true and correct copy of that Notice is attached to this petition as Exhibit B.
10. On October 20, 2022 plaintiff’s park manager, Julie McHenry, caused a copy of the Notice of Belief of Abandonment to be mailed to defendant’s address as listed on the title search.
A true and correct copy of the proof of posting and the proof of mailing is attached to this petition as Exhibit C.
11. On or about October 25, 2022, park manager, Julie McHenry received the mailed notice to John Enos, marked “Return to Sender, Undeliverable as Addressed, Unable to Forward.” Photocopies of the
certified mailing and returned notice are attached as Exhibits D and E, respectively.
12. On August 16, 2023 attorney for plaintiff obtained the informational death certificate for defendant John Enos from Del Norte County Recorder’s Office. The informational death certificate is attached hereto as Exhibit F.
13. As of the date of the filling of this petition, plaintiff has not heard from the registered owner, John Enos, or anyone else claiming an ownership interest in the mobile home in response to the posting and mailing of the Notice of Belief of Abandonment.
IV. ABANDONMENT AND DISPOSAL
14. Plaintiff seeks a declaration from the Court that the mobile home has been abandoned as defined by Civil Code section 798.61.
15. Plaintiff intends to either dispose of or sell the abandoned mobile home, depending on the condition of the mobile home once the Court declares it abandoned and plaintiff can gain entry and male an assessment.
16. If plaintiff finds that the mobile home is not in condition to be sold, it will dispose of the mobile home and do all of the following pursuant to 798.61(c)(2)(A-D):
a. Not seek a tax clearance certificate as set forth in Section 5832 of the Revenue and Taxation Code; and
b. Not sell the contents of the mobile home before its disposal; and
c. Notify the Del Norte County tax collector that plaintiff will dispose of the mobile home by sending a copy of this petition to the tax collector by first class mail; and
d. File a notice of disposal with HCD ad complete the disposal process consistent with the requirements of subdivision (f) of 798.61.
PRAYER FOR RELIEF
WHEREFORE, Tolowa Dee’ni Nation prays for judgment against defendant and DOES 1 through 5, inclusive, and each of them, on all causes of action as follows:
1. For judgment in the amount of space rent and other reasonable utility and related charges owing and due through the date of judgment, according to proof.
2. For a declaration of abandonment pursuant to Civil Code section 798.61.
3. For authorization to sell or dispose of the abandoned mobile home, according to the condition of the mobile home at the time that it is declared abandoned and after an assessment, pursuant to Civil Code section 798.61.
4. For an award of costs and attorneys’ fees, including the cost of public sale or of disposal, associated with this action, to be deducted from the amount of any sale of the abandoned mobile home or added to the judgment against the defendants.
5. For such other and further relief as the Court may deem necessary and proper in this action.

Description of Project: This project will use grant funds approved by the California Legislature to initiate activities that are designed to restore salmon and steelhead habitat in coastal streams and watersheds that historically produced large populations of salmon and steelhead. The replacement of barrier culverts with bridges or natural stream bottom culverts will allow adult and juvenile salmonids access to additional spawning and rearing habitat. The installation of instream structures will recruit and sort spawning gravel for adult salmon and steelhead and create summer rearing pools and over-wintering habitat for juveniles. CDFW seeks artists for California Upland Game Bird Stamp Art Contest
The California Department of Fish and Wildlife (CDFW) is conducting its annual art contest to select the design for the state’s 2023-2024 upland game bird stamp. The California Upland Game Bird Stamp Art Contest is open to all U.S. residents ages 18 and older, excluding current and former CDFW employees. Entries will be accepted from Oct. 30 through Dec. 1. This year’s stamp will feature the wild turkey.
First introduced to California in the early 1900s, the wild turkey is native to the central and eastern United States and parts of Mexico. Wild turkeys are the largest North American gamebird with males weighing an average of 20 pounds. Turkeys are social animals, intelligent with a detailed understanding of their surroundings and able to recognize each other by voice. Males puff their feathers and spread their wings and tails to appear larger to attract a mate. The head, neck and surrounding fleshy area can range from white to blue to red with increasing attraction, aggression or fear. Males have feathers that are red, green, purple, copper, bronze and gold while the females have softer shades of brown and grey. Their engaging behavior, accessibility on public lands and delicious taste make them one of the most popular
hunted species in North America. Entries must include at least one wild turkey, preferably in a habitat or setting representative of California. Entries will be judged on originality, artistic composition, anatomical accuracy, and suitability for reproduction as a stamp and print.
The contest will be judged by a panel of experts in the fields of ornithology, conservation, art and printing. The winning artist will be selected in December.
An upland game bird validation is required for hunting migratory and resident upland game birds in California. The money generated from stamp sales is dedicated to upland game bird-related conservation projects, education, hunting opportunities and outreach.
CDFW sells more than 150,000 upland game bird validations annually. Any individual who purchases an upland game bird validation may request their free collectible stamp by visiting wildlife.ca.gov/ licensing/collector-stamps. For collectors who do not purchase a hunting license or upland game bird validation or for hunters who wish to purchase additional stamps, an order form is available on the website. acid and recommended a delayed opening of the recreational and commercial fishery in the area. Following this recommendation, California Department of Fish and Wildlife (CDFW) Director Charlton H. Bonham enacted a delay to the start of the recreational and commercial spiny lobster fisheries within specific areas of Los Angeles and Orange counties. Areas immediately surrounding the recreational delay area will be open to recreational take under an advisory issued by the California Department of Public Health (CDPH) to avoid consuming the viscera (tomalley) and roe (eggs) of spiny lobster. Cooking lobsters neither decreases nor destroys the toxin, so consumers are advised to discard the viscera, roe and cooking liquids.
The delay areas shall remain in effect until OEHHA, in consultation with the State Public Health Officer of CDPH, determines that domoic acid no longer poses a significant risk to public health. Both delays are contingent upon additional sampling, planned for next week. Samples from Sept. 18 were below the health hazard threshold. If next week’s samples are also below the threshold, the delays may be lifted. Results are not anticipated until late next week, so the earliest the delays could be removed would be Friday, Sept. 29, just before the recreational season opens. CDFW will post notices on their website and in the media as soon as any changes are made.
The recreational delay area is defined as state waters between the following landmarks: the northern boundary of the Point Vicente SMCA and the westernmost point of the Long Beach Breakwater. The area is bounded by straight lines connecting the following points in the order listed except where noted: 33° 44.800′ N. lat.

The commercial fishery is delayed in state wa-
ters off Palos Verdes, Los Angeles County to Huntington Beach, Orange County within the following coordinates: between 118° 0.00’ W longitude and 118° 30.00’ W longitude, and between 33° 40.00’ N. latitude and 33° 50.00’ N latitude. When the commercial season opens on Oct. 4, take of spiny lobster will be prohibited in this area. Please see the Director’s Declaration regarding allowances for commercial lobster trap deployment and for transiting and possessing lobster in the area.
Pursuant to Fish and Game Code, section 5523, the Director of CDFW will notify the Fish and Game Commission of the delay and request that the Commission schedule a public discussion at its next scheduled meeting.
Domoic acid is a potent neurotoxin produced by Pseudo-nitzschia, a naturally occurring single-celled, marine alga, under certain ocean conditions. Domoic acid can accumulate in shellfish, other invertebrates and sometimes fish without the organism becoming ill themselves.
At low levels, domoic acid exposure can cause nausea, diarrhea and dizziness in humans. At higher levels, it can cause persistent short-term memory loss, seizures and can in some cases be fatal. State and federal laws prohibit the commercial distribution of seafood products that contain domoic acid levels above the federal action level, which is 20 parts per million in the viscera of spiny lobster. Information will be updated on CDFW’s fishery closure information and health advisories website.

Sea Cruise Car Show returns this weekend
Crescent City/Del Norte Chamber of Commerce and the Northern Knights Car Club bring the Sea Cruise Car Show to Del Norte County once again. Sea Cruise’s Show and Shine will be downtown Crescent City on 3rd Street on Friday, October 6, from 4 to 6 p.m., followed by the sanctioned cruise through downtown.

Notice of Pacific Power’s Request to Increase Your Rates for the Energy Cost Adjustment Clause and Greenhouse Gas Allowance Costs and Revenues for 2024 Application (A.23-09-008)
WHY AM I RECEIVING THIS NOTICE?
On September 15, 2023, Pacific Power filed an application with the California Public Utilities Commission (CPUC) requesting an overall increase to electric rates. This application addressed the Energy Cost Adjustment Clause (ECAC), greenhouse gas (GHG) allowance costs, and the California Climate Credit. If this application is approved, this would result in a rate increase of $30.3 million or 25%, effective March 1, 2024. This will impact your monthly bill.
WHY IS PACIFIC POWER REQUESTING THIS RATE INCREASE?
• Annually, Pacific Power compares actual and forecast costs of providing electricity to customers (ECAC rate) and the costs of purchasing GHG allowances to comply with the California Cap and Trade program, established as part of the state’s Global Warming Solutions Act (GHG rate).
• The ECAC rate allows Pacific Power to recover costs related to producing electricity such as fuel expenses, power purchased from third parties, and energy transmission expenses. This application requests an ECAC rate increase of $12.6 million due to power costs being more than the amount of revenue collected in current rates to cover those costs.
• The GHG rate allows Pacific Power the opportunity to recover costs related to purchasing allowances to comply with the state’s Cap and Trade program. This application requests a GHG rate decrease of $5.6 million due to actual allowance costs being higher than previously forecasted.
• This application also requests approval for Pacific Power customers to receive the California Climate Credit on their bills, resulting from the sale of greenhouse gas allowances. If approved, residential and small business customers will receive a credit of $174.25, in April and October 2024. This application will be reviewed by the CPUC to determine if the costs are reasonable and eligible for recovery from customers before any rate increase is potentially approved.
HOW COULD THIS AFFECT MY MONTHLY ELECTRIC RATES?
If Pacific Power’s rate request is approved by the CPUC, the average residential monthly bill using 850 kWh per month would increase by approximately $34.19 or 23.3% per month in 2024. A summary of the estimated rate impact is provided below. This table does not include the Climate Credit which will be provided to customers.
HOW DOES THE REST OF THIS PROCESS WORK?
This application will be assigned to a CPUC Administrative Law Judge who will consider proposals and evidence presented during the formal hearing process. The Administrative Law Judge will issue a proposed decision that may adopt Pacific Power’s application, modify it, or deny it. Any CPUC Commissioner may sponsor an alternate decision with a different outcome. The proposed decision, and any alternate decisions, will be discussed and voted upon by the CPUC Commissioners at a public CPUC Voting Meeting.
Parties to the proceeding may review Pacific Power’s application, including the Public Advocates Office. The Public Advocates Office is an independent consumer advocate within the CPUC that represents customers to obtain the lowest possible rate for service consistent with reliable and safe service levels.
