Other Routes to Registration

Since 1839 the RIAI has been committed to upholding the highest standards in architecture and has provided impartial and authoritative advice and information on issues affecting architecture and the built environment. Until recently the title ‘architect’ was not legally protected and anybody could use the title; this has changed with the enactment of the Building Control Act 2007 and commencement in 2009.

The RIAI has been designated as the Competent Authority in the State in respect of architects for the purposes of EU Directive 2005/36/EC on the Recognition of Professional Qualifications.

As well as National and EU qualifications listed in the Act, there is provision for the registration of people without qualifications in architecture through Technical Assessment, which requires evidence of experience in the field of architecture and assessment for compliance with Article 46 of the Professional Qualifications Directive.

Part 3 of the Building Control Act 2007, provides for the protection of the title ‘architect’. The title ‘architect’ can only be used by a person who is on the RIAI Register for Architects and who has the relevant education, training and experience in accordance with the provisions of the Act. The Act also provides for architects, practices and partnerships to use the term ‘architect’ in their business title if an architect on the register is in direct control and management of the business as is related to architecture. The Act regulates use of the title ‘architect’ but does not control or regulate functions in the field of architecture.

Registration Body The RIAI has been designated as the Registration Body for the purposes of the section of the Act dealing with the registration of architects.

The RIAI is the only organisation in the State holding a Register for Architects under the Building Control Act 2007. The Register can be checked on the RIAI website: www.riai.ie

Transitional Arrangements The Online Register was launched in November 2009. Although there are upwards of 2,700 architects on the Register, during the implementation phase of the Act not every person meeting the standards in the legislation will be on the Register. Some may still be in the process of completing necessary formalities and documentation checks. If a person is not listed on the Online Register queries as to whether a person has the necessary qualifications should be made directly to the person concerned. The RIAI can also assist with queries.

Professional Standards Architects on the Register must work to the RIAI Code of Professional Conduct which sets out standards of good practice.

This route is available only to people who have had 10 years of experience in the field of architecture prior to the commencement of the Act in May 2008. For people without the required qualifications there is also a provision for a Register Admission Examination. This is being administered by ARAE a UCD campus company. www.arae.ie

Sanctions As provided for in the Act, a person who not being registered uses the title ‘architect’, either alone or in combination with any other words or letters, or name, or title, or description implying the person is so registered, or who practices or carries on business under any name, title, not in accordance with relevant RIAI Rules, on summary conviction, shall be liable to a fine not exceeding €5,000 or imprisonment for a term not exceeding 12 months or both.

Independence and Government Oversight Independence and Government oversight is provided by the Admissions Board, the Technical Assessment Board, the Appeals Board and the Professional Conduct Committee having a majority of non-architects nominated by the State and Chairpersons with a legal background.

STANDARDS

• Validation of architectural and technician courses by RIAI Visiting Boards. • Requiring every applicant for Registered Membership of the RIAI to pass, or demonstrate that they are qualified for exemption from, the RIAI Examination in Professional Practice, which requires a minimum of two years of post-graduate experience, completion of a case study of an actual building project, the completion of a course of lectures and written and oral examinations in Professional Practice. These standards also apply to the Building Control Act 2007. • Requiring a stated annual level of Continuing Professional Development activity of its members. • Requiring a specific annual level of continued professional development activity of its Members which will be logged and monitored on an individual basis. • Provision to every member of the RIAI Member’s Manual containing the entire range of RIAI Practice Notes, Information Papers and Standard Documentation in the “Members Only” area of the RIAI website. • Provision of a Good Practice Guide which defines appropriate standards for all the various stages of a project • Updating Members every month with information Emails • Updating Practices every two weeks with information Emails

Services To Clients And Consumers The RIAI provides a range of services to Clients and Consumers, including: • An online searchable database of registered architects so clients can check if an architect is on the RIAI Register. • RIAI Standard Documentation, listed on page 130, which provides a framework for construction in Ireland and is accepted as the standard industry documentation. • A range of standard agreements for use between the Client and the Architect. • The definitive guide to building contracts in Ireland, RIAI Contracts-Working Guide by David Keane, published by the RIAI. • General information and advice on architectural practice and industry matters. • RIAI website. www.riai.ie with information on architecture and a searchable data-base of RIAI Practices, and on all RIAI documentation and the RIAI Bookshop, which holds the largest stock of architecture books in Ireland. • Nomination services to assist in the selection of architects and to help clients select architects or practices appropriate for their projects. • A range of procedures for the resolution of disputes between architects and their clients, and between clients and contractors, conciliation, and/or the Professional Conduct Committee. • Advice, information and rulings arising out of the RIAI standard Client/Architect Agreements. • Consumer guides, including Working with your Architect. • A range of support services for architectural competitions, full details of which are given on page 7 of this Directory. • Information on Practices Accredited in Conservation Work • Information on architects and architectural technologist’s who are accredited as Project Supervisor Design Process.

The architect works with you to define your building needs. Your Architect will, in discussion with you, establish your intentions, requirements and budget. They will then clarify the project parameters and define what needs to be built, often presenting you with alternative solutions that you may not have considered. In arriving at a design solution the architect takes a broad view, looking at the impact of the building on its owner, its users, the surrounding area and the natural environment. The result is the creation of homes that are a pleasure to live in; office spaces that make interaction between departments move smoothly; retail areas that display your products in the best light and encourage customers to buy; working conditions that enhance employee productivity and satisfaction.

As is the case with the Architect’s Opinion on Compliance in respect of Planning Permission, the Law Society has advised that Architects’ Opinions on Compliance in respect of the Building Regulations and fire safety certificates should be furnished by the vendors’ architects when property changes hands. The RIAI and the Incorporated Law Society have agreed standard formats for such opinions, dealing with the regulatory framework. This is not a statutory requirement and neither is any such arrangement required under the Building Control Act, but such measures are necessary in order to protect clients’ interests.

Project Management

The design and construction of energy efficient buildings play an important part in reducing energy demand and meeting Ireland’s climate change emissions targets.

From conception to occupation the architect will protect your interests and help to ensure that the design and construction process goes as smoothly as possible. The architect will advise on the selection of contractors and, during construction, will visit the site at intervals to monitor compliance with the Contract Documentation. If engineering or other consultants are required the architect can co-ordinate this group of experts.

Regulatory Framework The architect will deal with the complex legal framework of Building Regulations, safety regulations and planning laws.

Sustainability And Climate Change

Significant changes to Building Standards are taking place between 2010 -2013, with improved targets for energy reduction. • From 2010/2011, all new dwellings will be required to reduce energy consumption (from the 2005 standard) by 60%. • From 2013, new dwellings will be “near zero carbon”. • Similar improved standards for other building types will follow. • Ventilation standards for buildings have recently been upgraded. • All buildings are required to be assessed under the Building Energy Rating System (BER). An RIAI registered architect has the necessary skills to integrate these new and complex requirements into a building project.


WHY USE AN RIAI REGISTERED PRACTICE?

• An RIAI registered practice is obliged to carry out work on behalf of the client honourably, independently and competently, and is required to declare any interest which might conflict with the interests of the client. • RIAI registered practice follow standard procedures set out in the RIAI Conditions of Appointment. Such procedures provide a client with an established framework. In addition to meeting the rigorous entry requirements, RIAI registered practice are updated through regular bulletins, seminars etc. The RIAI Practice Directory lists over 622 practices. Each firm brings a different combination of skills and expertise to its projects, and they all offer a professional and personal service to suit their clients’ needs. Choosing the right firm to carry out your project is crucial to success in realising your expectations and creating a building of lasting quality and worth. The design and construction of a building is a complex process, and the seven years of architectural training in schools recognised by the institute, leading to membership of the RIAI and/or registration is one of the longest among all the professions in Ireland. Within the building industry only an architect’s training is so comprehensive. This reflects society’s concern that building, one of Ireland’s largest investments, should be directed by properly trained professionals.

Building Regulations Professionally qualified RIAI registered practices provide a wide range of services in relation to the Building Regulations, including: • Advice on building design options, layout, construction cost options, etc. • Advice on the impact of the Building Regulations. • Preparation of applications for fire safety certificates. • Preparation of record sets of drawings showing compliance with the Building Regulations. • Preparation of Architect’s Opinions on Planning, Building Regulations and fire safety certificates. • Co-ordination and management of the building and design process, incorporating the requirements of the Building Regulations in anything from a house extension to a major urban development.

Skills An RIAI registered architect can draw on a unique range of skills needed during the design process, including: • Conceptual design • Feasibility studies • Detailed design • Contract administration • Project management and control • Performance analysis • Technical expertise • Research • Interior design • Conservation • Space utilisation • Furniture and lighting design • Urban design The architect is a professional trained to deal with all aspects of building, and is familiar with all building types from the simple factory shed to complex developments such as hospitals and universities. No building type is outside the architect’s range and these services can be as valuable in a small house extension as in larger schemes. No building problem is beyond the architect’s capacity: problems of dry-rot and drains, planning appeals and regulatory requirements, housing estate lay-outs and large urban developments are all within the architect’s expertise, although RIAI Practices do have different areas of interest as can be seen in the practice profiles in the Directory.

• A RIAI registered practice has to conform to the standards established by the Institute both in professional conduct and the manner in which commissions are executed for clients.

SAFETY, HEALTH AND WELFARE AT WORK

• The client must get confirmation of the appointment of project supervisor for design process (PSDP) and project supervisor for construction stage (PSCS) in writing and this appointments must also be accepted in writing. • The client must be reasonably satisfied zqa ewq.>..’09 carry out reasonable checks to ensure that the intended, designer contractor, PSDP and PSCS are competent to carry out their various tasks and will allocate th e necessary resources to enable performance of their roles under the regulations. • The client must co-operate with the PSDP and PSCS including providing relevant information, e.g. an existing safety file.

Safety and Health Plan A Safety and Health Plan has to be prepared by the Project Supervisor (Construction Stage) for all notifiable sites and sites where there are particular risks The Project Supervisor (Construction Stage) will update this Plan to ensure that all the potential safety and health hazards on site are included. This Plan will form part of the Contractor’s Safety Statement.

Project Supervisor (Design Process) The Project Supervisor Design Process (PSDP) must see that safety and health are taken into account in the design of a building and its subsequent maintenance. The PSDP may give reasonable directions to designers and contractors, and as a last resort, the PSDP can notify the Health and Safety authority of any failure to comply with reasonable directions. The DSDP must: • Prepare a preliminary safety plan which must include the base in which time the project was established, risk assessments by other designers, location of electricity, water and sewage connections, where appropriate for adequate welfare facilities. • Retain Preliminary SHW Plan for five years. • Prepare the Safety File on completion of the project and deliver to the client. The PSCS is required to provide all necessary information to PSDP for purposes of the safety file. • RIAI provides an accreditation process for those wishing to act as a PS(DP) and a listing of those accredited is available on the RIAI website.

Project Supervisor (Construction Stage) The Project Supervisor (CS) must co-ordinate the safety and health aspects of the construction stage and: • Before construction work starts, prepare the Safety and Health Plan. During construction update it as necessary. • Notify the Health and Safety Authority, before work starts, for all projects where work lasts longer than 30 working days or over 500 person days (Notifiable Sites). • Prepare and update the Safety File during the construction stage and deliver it to the client on completion of the project. • Co-ordinate safety and health, especially where more than one contractor is employed and, in particular, make sure that: · Safety and health are included in all organisational and technical decisions (including time scheduling) · Contractors comply with the Safety and Health Plan and avoid risks to others. · General site safety obtains. · Accident records are kept. The PSCS may give reasonable directions to the contractor, designers etc and may notify the Health and Safety authority of any failure to comply.

Contractors Contractors are responsible for the safety and health of employees and others on site and must: • Comply with any reasonable rules relevant to the contractor in the Safety Plan and ensure as far as reasonably practical that his employees comply with such rules. • Provide site specific safety statement to the PSCS • Provide the PSCS with a copy of the report of any report on accidents/incidents • Provide relevant information with the Safety File • Bring to the attention of employees an recent rules in the Safety Statement and ensure compliance of those rules applies to employees.

ARCHITECTURAL COMPETITIONS

As the representative body for architects in Ireland, the RIAI has a responsibility for architectural competitions nationally, for architectural competitions in the EU in accordance with the regulations of the Architects Council of Europe, and internationally in accordance with the regulations of the International Union of Architects. For an architectural competition to be successful it should meet the following criteria: • the project should be of importance to the community; • the competition should comply with national and international standards; the documentation should provide the best possible level of information and briefing to the competitors; • there should be experienced architectural assessors of standing; • entries should be anonymous; • the competition should result in a commission to the winner. RIAI Competition Services

Invited Design Competition

The RIAI provides a full range of services to assist clients who wish to commission an architectural competition. It will monitor competition regulations, advise on the appointment of assessors, handle notifications to competitors, registration, competitors questions about the brief, assessment, publicity, exhibitions and the announcement of results. As can be seen from the listing RIAI has managed a wide range of competitions for private sector clients, Government Departments and Agencies and Local Authorities.

This type of competition is similar to the open design competition, but there is a limited number of invited participants and an honourarium is payable to each competitor.

Open Design Competition There is a formal procedure for the conduct of open design competitions, covering the announcement of the competition, the selection, qualifications and number of assessors, the handling of queries on the brief, the exhibition of competition entries and the publication of results. Because of this procedure, selection of an architect may take slightly longer than by other competitions, but it has considerable advantages for the promoters. Competitions are a challenge to the architects, so the results are likely to be stimulating and exciting. An open competition provides creative, practical and cost-effective solutions to building needs. It can generate considerable publicity and demonstrate a client’s commitment to design quality. An open design competition will take no longer than standard commissioning procedures, particularly for state funded projects, as the process of brief preparation is accredited.

Concept/Architect Selection Competition This procedure was evolved for clients who wish to have an indication of how particular practices may approach the design problem in question, and to select the firm which they feel is most appropriate in their case. The amount of work to be submitted by competitors should be limited, because the client does not have an opportunity to develop a brief with the architect. A premium is awarded to each entrant (xiii)

Uniquely among the professions, architects, through the medium of architectural competitions, provide and fund a vast quantity of work at virtually no cost to the community. Such competitions represent a considerable investment in terms of time and overhead costs and, in return for this investment, architects ask that architectural competitions be held in accordance with recognised norms.

Should you wish to select an architect, the RIAI provides help. The following are the principal methods used for the selection of an architect.

You can use this Practice Directory to identify firms practicing in your own geographic area or possessing the particular skills needed for the project in hand. The RIAI website “Arch Search” facility can also be used.

The RIAI Website From April 2009, the RIAI website will provide a unique range of information on architectural practices under ‘Find an Architect, with links to individual practices web sites where their work can be viewed.

Personal Recommendations You may already know an RIAI Registered architect. Alternatively, an acquaintance who has had experience of building work may be able to recommend one. In either circumstance, you should visit the architect in question and ensure that you and the architect are compatible, and that she/he has the correct approach for your project. (xiv)

The Interview System The interview system is often appropriate for projects of a kind in which a small number of practices have experience and the client wishes to meet the architects concerned, see their previous work, and take advantage of professional guidance in making an assessment. The RIAI will help with compiling a list of suitable practices, help prepare the invitation to practices, and will recommend an architect assessor to assist with shortlisting and to sit on the interview board. There is a charge for the assessor’s time, and a small administrative charge which depends on the complexity of the shortlist

RIAI Practice Nomination On request the RIAI will recommend specific practices for a project, bearing in mind track record, suitability, geographic location, etc. Usually this service is provided free of charge, but in the case of large or complex projects requiring considerable research the Institute may charge the client a nominal fee to cover administrative costs.
