MESSAGE FROM TMA PRESIDENT DON YOUNG, ADT

TMA Standards The Monitoring Association has a long history of involvement with American National Standards (ANS.) Our participation is necessitated by the considerable influence ANS standards have on the products and services we provide to our customers. Product standards enable equipment from innumerable manufacturers to interoperate. Procedural standards assure consistency in how security and life safety services are delivered. Having witnessed the value of standards throughout my career, growing TMA’s participation in all relevant standards activity is a prime focus of my TMA presidency. TMA, as an accredited Standards Development Organization (SDO), manages several ANS standards. Under Lou Fiore’s chairmanship, we received, in 2020, ANSI accreditation for the update of our “TMA CS-V-01-2020, Alarm Confirmation, Verification, and Notification Procedures” standard. CS-V-01, as it is commonly referred to, defines methods used by monitoring centers to reduce false alarm notifications to public safety. The specified methods include procedures to

confirm alarm activity with the alarm user, as well as verification of alarms through audio or video technologies. Confirmation methods were updated in the latest version to include contacting alarm users using technologies other than a voice phone call, such as through smart phone applications. Audio and video verification workflows were enhanced to define levels of verification based on human activity observed or heard through video and audio technologies. With the onset of the COVID-19 pandemic early in the year, it became readily apparent that TMA members were entering unknown territory. TMA’s Executive Director Celia Besore began receiving urgent calls from anxious members seeking guidance as federal, state, and local authorities called on citizens to quarantine in their homes. These restrictive policies challenged our ability to follow Underwriters Laboratory (UL) standards that define monitoring center operations. TMA initiated dialogue with UL to determine appropriate messaging and guidelines for our member companies. Within a short time, TMA collaborated with UL

to present informational webinars to provide much needed interim advice. Under chair Anita Ostrowski, the TMA UL standards work-group worked closely with UL to establish UL 827 Virtual Workplace Guidelines for Monitoring Centers. The UL work-group took an active role in identifying critical points of operation to ensure consistent, uninterrupted service for our customers. The guidelines that standardize emergency virtual monitoring are currently going through the process of being fully incorporated into UL 827. As the saying goes, it takes a village! We came together as a community, each member giving and sharing their knowledge and experience so that as an industry we were prepared to move forward safely and securely. Given the success of the emergency guidelines, we have established a workgroup to investigate Work From Home monitoring on a permanent basis. The work-group is reviewing the procedural and technological requirements necessary to make Work From Home monitoring an accepted practice. I close with the exciting news of our newest standards initiative, TMAAVS-01, the Alarm Validation Scoring Standard. TMA-AVS-01 will define a process that evaluates data from an alarm event that results in an alarm validation metric. The resulting metric will enable public safety to establish response policies that enhance the services we provide. The committee began its work in August and is chaired by Stanley Security’s Mark McCall. Mark is assisted by Lower Allen Township ECC/PSAP Director David Holl, and, I-View Now’s Larry Folsom, who serve as co-chairs. Larry Dischert, a long-time industry standards expert, serves as recording secretary. The response for committee participation was outstanding, as the committee has forty-six members. Innovation, Failure and Persistence What do Thomas Edison, James Dyson, and Steve Jobs have in common? Innovation, failure, and perseverance.

Thomas Edison, the American inventor with the most patents to date, was an innovator who persisted through many failures. A long-time associate of Edison’s, Walter S. Mallory, remembered finding Edison working on a bench covered with hundreds of little test cells as he sought to engineer a new type of storage battery. Edison admitted that while he had done over nine thousand experiments in trying to devise this new battery, none had worked. When Mallory commiserated with the failure, Edison replied “‘Results! Why, man, I have gotten a lot of results! I know several thousand things that won’t work;” and eleven years later he told a reporter, “I never allow myself to become discouraged under any circumstances … We sometimes learn a lot from our failures if we have put into the effort the best thought and work (that) we are capable of.” Sir James Dyson worked for 15 years, used all his savings, and produced 5,127 [6]

prototypes of the iconic DC01 vacuum before it was launched in 1993. Since then, the product has gone thorough more than 50 updates. Jobs said in 1995 interview, two years before his return to Apple and the creation of the “iEverything” (iPods, iPads, iPhone, etc.), “what separates the successful entrepreneurs from the nonsuccessful ones is pure perseverance.” In today’s uncertain business climate, the cycle of innovation, failure, and perseverance can be the secret sauce to thriving and succeeding. What are some principles on innovation and perseverance we can learn from Edison, Dyson, Jobs, and others? • Innovation is the result of a strong desire to solve a problem. • Innovation takes a combination of curiosity and problem-solving methodology. While we all know of inventions that were the result of serendipity, such as the creation of post-it notes, those “eureka” moments are not typical of the process of

innovation. Innovation is the result of spending time in an organized fashion to solve a problem. Professor Barry Kauffman, scientific director of the Positive Psychology Center at the University of Pennsylvania, believes there are four stages in the process of creativity: preparation, incubation, illumination, and verification. It requires time and patience. • It is important to look at problems with “new eyes,” casting aside preconceived ideas or old solutions. Two powerful words that can spur innovation are how and why. • Innovation is the result of thinking long-term. • Innovation takes hard work. • Innovation is the result of embracing and encouraging failure and taking risks. Dyson claimed that each failure brought him closer to solving a problem. Perseverance will pay off, but sometimes the payoff may not be what you were expecting. Unfortunately, there are cases where timing can make a difference. Sometimes, innovative ideas occur at the wrong time. Edison had made inroads with battery technology and started offering nickel-iron batteries for several uses, including cars. For a while, Edison and Henry Ford worked on the development of an affordable electric car. But as you know, it did not happen-compelling reasons for an electric car would not arrive for another 100 years. However, his batteries went on to many other uses. Innovation takes persistence and the will to never give up. There are many other stories of innovators that won by trying, failing, adapting, and refining their solutions; by persisting. As my favorite quotable historical figure, Winston Churchill, said, “Success consists of going from failure to failure without loss of enthusiasm.” Celia T. Leading Women A profile of four women leaders in TMA membership By Leigh A. McGuire, Director of Marketing and Communciations, TMA

This story has been on my list to write for some time. One may question its timing, as both mainstream media and our own industry press have been giving the topic significant coverage. So, we’ll ride the wave and share some powerful insights from four of our own strong, talented, and respected female leaders. In researching for this story, I came across a quote from Geraldine Ferraro who summed it up nicely, saying, “Some leaders are born women.” Today, women can be found in leadership positions in nearly every industry and in both the public and private sector. From Fortune’s top 500 businesses, where there are 37 women at the top, to your local, independent female-owned businesses, women are successfully leading. As we look at our own professional community, TMA itself is led by an extraordinarily talented and tenacious woman, Celia T. Besore. Our Board of Directors currently has four women, two of which we’ll profile in this feature. We were fortunate to have the opportunity to interview four women leaders who are members of TMA. Each one shares her professional journey and offers inspiration through the stories of the proudest achievements and challenges faced and overcome. You’ll read about those who most influenced their rise to leadership and, lastly, what words of wisdom they chose to share with rising female leaders in our industry.

EVP and Chief Customer Officer ADT 1.When and where did you begin your career in security and/or monitoring? I started as a receptionist for National Guardian within their dealer division. I quickly moved into vendor purchasing and then led a new international startup where I was responsible for sales, marketing and technical training in about nine countries. I then went with the management team to Holmes Protection in NYC, where I

led marketing and helped to integrate over 30 companies that we acquired and merged with, turning them into a national company. We sold this company to ADT and I joined as Director of Commercial Marketing, later becoming a Vice President where I went on to hold responsibilities including commercial sales, product, business development, international marketing and residential marketing. After a stint outside the industry at Vonage, I returned with a small group to take Protection 1 private in 2010, where I oversaw sales, marketing and call center operations. In 2016, together with Apollo, we acquired ADT where I have had responsibilities in marketing, communications, sales and call center operations. Today, I am responsible for designing the customer experience and overseeing our contact and monitoring centers. 2. Have you encountered any obstacles? How have you overcome them? In my nearly 30 years, I have certainly encountered obstacles. I believe that in overcoming them, some common themes have been hard work, perseverance, seeking wise counsel and being true to who I am.

I have mentored people during my career, including many women. In our industry, there are not a lot of women in senior roles and I enjoying spotting great and eager talent and helping them on their career journey. Often the mentoring is informal, but I try to be very intentional. Shannon Hendrickson is one such young woman that I had the pleasure of working with when she was an intern at Vonage. I convinced her to stay on – instead of moving back to Arizona. Today, she is the Vice President of Marketing for ADT and is incredibly accomplished. There are people I give coaching to on how they present themselves, asking questions to help them work things through, helping them understand how to appreciate and leverage the differences they have to offer as women. 5. What advice would you give to another woman who aspires to rise to upper level management in the monitoring industry? The advice I would give women is the advice I would give anyone looking to move up in any industry: • Add value to the company. Don’t just think about you or your career – think about the company. I first got noticed when I was a receptionist who had an idea on how to save $250k in vendor management. It landed me my next job. • Seek out feedback. Honest critical feedback can be hard, but it will make you better. Seek it from your critics equally as you do from your supporters. • Don’t be afraid to fail. Step into bigger shoes that you might be comfortable with. Staying comfortable does not produce growth. For women, I would encourage them to raise their hands for things that may seem bigger than what they are qualified

for. There is an interesting Harvard study showing how men often apply for jobs they are only 60% qualified for and women wait until they are 100% qualified. For women in the monitoring industry, I recommend keeping sharp on technology, other industries and out-of-the-box thinking. The alarm industry can often feel like ground hog day which can put thinking into “the way it’s always been done” place. We need women leaders – and men leaders – that are helping to innovate in our industry, particularly in monitoring.

Asset Protection Manager – Security Operations Center, Wegmans Food Markets, Inc. 1. When and where did you begin your career in security and/or monitoring? I started as the Security Operations Center Manager in March 2016. Prior to that, I worked in Asset Protection as a Manager leading the Special Systems (AP Technology), Risk Assessment, and Fraud Analysis teams. I’ve been in Asset Protection for a little over 10 years. I’ve been with Wegmans for almost 30 years, holding positions in Store Operations, Finance, and Information Technology. During my last 10 years in Asset Protection, I’ve been involved with ASIS Rochester, and active member of TMA’s Proprietary Committee, and have networked with many companies to improve our Operation. I’ve found that leaders in this industry are open and willing to share ideas and successes in their own Operations. 2. Have you encountered any obstacles? How have you overcome them? California’s Sweeping New Data Privacy Businesses urged to implement new practices By Kelly Bastide, Venable LLP

The CCPA tasked the California Office of the Attorney General (OAG) with the responsibility for promulgating regulations to implement the law. After an extensive notice-and-comment period, the OAG finalized the regulations in time for the July 1 enforcement date. Under the law, California AG Xavier Becerra may seek an injunction and civil penalties of $2,500 for each violation and $7,500 for each intentional violation. It has been widely reported that the AG sent Notices of Violations to certain companies allegedly in violation of the CCPA on or shortly after the July 1 enforcement date. The law gives companies a 30-day period to cure any such alleged violations.

On July 1, 2020, enforcement of the most sweeping U.S. data privacy law began. Known as the California Consumer Privacy Act of 2018 (“CCPA”), the law was enacted by the California legislature in response to a ballot initiative that would have created a different consumer privacy law that many in the industry viewed as more burdensome. The law applies to companies doing business in California that collect personal information from California residents and satisfy certain thresholds for company revenue or amount of data. Among the most notable aspects of the law is that it contains the broadest definition of “personal information” of any private law to date. The CCPA defines personal information to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a specific [16]

consumer or household—a definition that sweeps in data elements that are not associated with a single individual. The CCPA also creates new rights for consumers with respect to their personal information, including the right to know about, access, delete, and opt-out of the sharing or selling of the personal information businesses collect about them. In addition to creating these rights for consumers, the CCPA imposes obligations on businesses to provide detailed notices about data practices, refrain from “discriminating” against consumers, train employees to comply with the law’s terms, and keep records in relation to consumer requests, among other requirements. Companies engaged in “sales” as defined under the CCPA must add a “Do Not Sell My Personal Information” button to their homepages and implement other changes to respond to consumer requests.

The CCPA also contains a private right of action that permits consumers to obtain statutory damages—the greater of damages in the amount of $100 - $750 per consumer per incident or actual damages—and injunctive relief if their personal information becomes subject to unauthorized access and exfiltration, theft, or disclosure as a result of the business’s failure to implement and maintain reasonable security procedures and practices. Companies subject to the CCPA likely need to make significant changes to their business practices in order to comply with the law. With CCPA enforcement in full swing, companies should ensure they are taking steps to implement any necessary changes as soon as practicable. For many people, digital communication is their primary form of communication. Across every industry, including the security industry, the digital component has continued to grow, thrive, and ultimately take over. It’s no longer that

A Look Ahead: The Future Will Be Monitored Are you prepared? By Matt Narowski, President, Bold Group

now own a smartphone, and it’s possible to leverage location data and artificial intelligence (AI) to track where people may have had first contact with the virus, as well as notify others who may have been exposed.

The act of monitoring and alerting has evolved throughout our history. It used to be that we monitored and notified about fairly straightforward events: when a fire broke out, we alerted the fire department; if a tornado was coming, we sounded the siren. Today, there is a proliferation of smartphones. IoT devices are connected to everything. Our thermostats, refrigerators, and more – all monitor different types of events and produce an amazing amount of data. Social media and an “always-on” society produce massive amounts of content. We are also dealing with a global pandemic, the likes of which we haven’t seen in more than 100 years. With the technology we have available today, we are able to monitor most anything. Any action that creates an event can be monitored, and we can collect data, alert someone about it [18]

and track a response. This is all still very fragmented, however, as legacy and modern systems need some way to talk to each other, and the technology continues to advance quickly. All of this expansion in systems, devices and data creates significant opportunity for integrators to find new, innovative ways to help customers monitor and track data for health management, personal safety and property protection. In the short term, monitoring will be incredibly helpful as we continue to navigate COVID-19. Advancements in this area are already evolving very quickly. The ability to monitor crowds with temperature-sensing cameras as people enter a public space, create an event when someone has a high temperature, and then dispatch responders accordingly will help to keep the general public safe. Add to that the fact that more than 80% of Americans

On the property protection and personal safety side of things, as the world becomes more and more wireless, we are able to monitor more devices such as vehicles and home monitoring devices that we couldn’t monitor before because we would have needed a hardwire connection. For instance, if we were to monitor vehicles using GPS sensors, we would be able to find the perpetrator in a hit-and-run situation. In homes, we previously only had wired alarm devices, whereas now we are able to place wireless sensors and video cameras throughout a home that sense movements and send an alert to a homeowner’s smartphone. Video monitoring in and of itself is evolving and providing additional opportunity for integrators. Proactive monitoring combines traditional video monitoring with AI to analyze motion and determine threats and deter a crime from happening by sending an alert to not only a live operator, but it can also sound an alarm at the scene, warning the intruder and likely sending them away. In addition, now that there is so much data we can collect through monitoring, rather than focusing only on monitoring for events and delivering notifications, we’ll be monitoring data in order to make important decisions. versus a monitored system. Consumers identify security systems as providing the strongest sense of “safe enough” security, but these systems are the least appealing when price is considered. Additionally, as more players from the CE industry enter the DIY security space, they bring an expertise in product design that improves ease-of-use and attractiveness in smart home products. This emphasis on user experience puts pressure on legacy security manufacturers and service providers to deliver solutions and systems that meet or exceed this higher bar, adding new value propositions, while still keeping costs low. Security systems with monitoring are and remain the platinum standard for delivering safety and security at home, but with more alternatives available to consumers, they have multiple factors to balance when deciding what to buy to feel safe at home. New research from Parks Associates finds 60% percent of US broadband households feel safe enough with a professionally monitored home security system, but 55% feel “safe enough” with a selfmonitored home security system. Additionally, 4652% of US broadband households feel “safe enough” with just one security-focused smart home device, such as a smart door lock or smart doorbell. as more devices are added to the bundle, with a bundle including an all-in-one camera and an outdoor light fixture with a camera as the most appealing. This finding creates a serious challenge to the traditional home security industry because consumers can weigh the value of safety and security with the cost savings of these smart home devices

A key benefit that security providers can deliver is centralized control and a unified experience. That would also open new opportunities to sell and service home control systems and interactive services. Currently, 18% of US broadband households have a home control system, and the majority are integrated into a home security system, which highlights the success of the security channel in promoting the value proposition of home systems. A lot of this monitoring technology and AI capability is in place today and is being leveraged on a small scale. But there is software today that is capable of monitoring any kind of event, so as we see technology continue to improve and the associated costs of creating monitoring programs come down, we’ll see greater adoption among organizations of all sizes. Of course, there is the danger in the misuse of these technologies, and personal freedom and privacy laws will be part of the navigation process. And that’s where integrators come in. It’s now up to the industry to stay ahead of the advancements, understand the trends and deliver the best possible solutions to ensure that event monitoring is seamless and effective, and provides value to both the organization and the end customer. How can we help different industries protect their assets? How can we help integrate AI into video in different ways to respond to threats even more quickly? What data do our customers have available that we can monitor to help predict changes that affect manufacturing? There are so many possibilities and it’s up to us to get creative in finding ways to identify events, monitor for them and deliver meaningful notifications that protect the valuable assets of people and property.

When I first entered the security industry in 1973, alarm communications was mainly performed by Direct Wire, McCulloh and some high security applications using voicegrade telephone lines configured in “open window” and later “closed window” bridges. What followed those early days was an endless and accelerating stream of newer technologies. Cellular technologies such as AMPS, 2G, 3G, 4G, now 5G and soon we will be speaking of 6G, as 5G will eventually either sunset or perhaps [22]

co-exist. In the middle of it all entered TCP/IP and the Internet. As 6G moves up higher in frequency, what might be the next leap? What might 7G look like? Perhaps the next generation will be a combination of the integration of smaller and faster computer chips with innovative software and the practical limit of the radio spectrum. Applications now only dreamt about or not even imagined will begin to emerge in that new world. AICC was involved throughout, helping to make sense of it and helping to guide the FCC and Congress and also working with the carriers to a more favorable outcome for the alarm industry, including influencing the Telecommunications Act of 1996. Our efforts even reach out to dealing with the International Telecommunications Union in Geneva, Switzerland regarding satellite interference. If and when there is a new Telecommunications Act, we will be there! Perhaps after reading what AICC is about, if you are not a member you might consider joining AICC. If you are an installing company or a monitoring company, you should be aware how the FCC and Congress can affect your use of communication technology. If you are a manufacturer, you should be aware of what technologies are around the corner. In either case, you owe it to yourself, your company and your stockholders to stay abreast of communication technology and whatever pitfalls the FCC and Congress may put in your way and what new opportunities are available. These days we meet virtually. But, when we meet again in person, our meetings are also a wonderful networking event.

AICC Calls for Support As many of you know, AT&T and Verizon have announced sunsets for their 3G networks. AT&T is calling for a sunset date of Februar y 22, 2022 and Verizon is calling for a sunset of December of 2022—10 months later. Due to the Coronavirus many of our customers have been reluctant to have alarm technicians enter their homes and businesses so that we can upgrade their equipment to make them compatible with newer networks.

On September 29, AICC filed reply comments on the FCC’s Fourth Further Notice of Proposed Rulemaking in CG Docket No. 17-59, in which the FCC seeks further comment on call blocking and call mislabeling procedures to further implement the Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (TRACED Act). Specifically, AICC discussed its members’ ongoing issues with call blocking and mislabeling, and their struggles with getting those issues resolved in a smooth and timely fashion. To this end, AICC supported the expansion of redress options for

both blocked and mislabeled calls, advocating for concrete timelines for redress, notifications for callers when calls are blocked or labeled fraud, and also the availability of blocked call lists for consumers. AICC opposed the authorization of blocking based solely on call ID authentication, which AICC believes would lead to an increase in blocked alarm calls, and also the extension of safe harbors to so-called network-based call blocking programs, which would encourage carriers to expand blocking programs that customers may not know about and cannot opt out of.

FCC Allows Alarm Companies, Others to Use 4.9 GHz Spectrum – But With a Catch In 2018, AICC filed both comments and reply comments in WP Docket No. 07-100, suggesting that allowing alarm operations to have limited access to the Public Safety 4.9 GHz spectrum would be useful to both alarm companies and public safety, as a way to allow alarm companies to participate in FirstNet as quasi-safety support entities, and to facilitate giving public safety access to, e.g., security video that can enhance first responders’ ability to safely assess and respond to an incident scene. To address public safety’s concerns about allowing any non-public safety use of the band, AICC proposed several safeguards, and opposed open access to the 4.9 GHz band to commercial radio operations due to concern that the band would be dominated by for profit operations that may hinder public safety use. In its draft 6th Report and Order and 7th NPRM in WP Docket No. 07-100 TMA Dispatch | Fall 2020

approved on September 30, the Federal Communications Commission chose not to allow commercial entities to apply directly for use of the Public Safety 4.9 GHz spectrum. The FCC cited AICC’s comments among others in declining to open the 4.9 band for commercial operations generally: “While several commenters note the continued need for spectrum to support public safety operations, most commenters recognize the need to allow non-public safety operations in the band to maximize use of this spectrum. At the same time, commenters overwhelmingly oppose giving non-public safety entities access by redesignating the band for commercial use.” Instead, the FCC has chosen to allow each State’s public safety community the opportunity to lease their 4.9 GHz spectrum to commercial entities and other potential users if the State determines it can benefit from this arrangement without jeopardizing its use for public safety operations. The decision by a State licensee to lease some

States can continue to use the spectrum for their own public safety network operations; they can enter into one or more commercial arrangements for commercial deployment of publicsafety communications services; they can lease the spectrum to a commercial service provider for deployment of mobile or fixed wireless Internet service, private land mobile radio service or critical infrastructure connectivity; or they can pursue a combination of any of these scenarios (or any other arrangement that is allowed for pursuant to the service rules for the band and our Secondary Markets rules). The rule changes we adopt here will reverse the effects of the 4.9 GHz band’s antiquated licensing framework that have led to its underuse.” Thus, alarm companies will now be able to access 4.9 GHz spectrum, but will have to do so by leasing it from a statewide public safety licensee. This arrangement may not be as difficult for alarm service providers to enter into, given their history of working with and supporting public safety. APCO, the International Association of Chiefs of Police, the National Sheriffs Association, the Metropolitan Fire Chiefs Association and other groups earlier this month opposed the plan, citing concerns about losing access to this spectrum.

Year End Reminder: Ownership Changes/Restructuring May Require FCC Approval Alarm companies that hold FCC radio licenses in connection with their business must keep in mind that many types of reorganizations, estate planning and tax savings activities and other transactions require prior FCC approval; and given the frequent need to implement such transactions by the end of the year, companies engaging in such transactions should immediately determine whether they must file an application for FCC approval, and obtain a grant, before closing on a year-end deal. Transactions requiring prior FCC approval include (but are not limited to):

extraordinary voting rights or powers through officer or board positions). n The conversion of a corporate entity or partnership into another form of organization under state law e.g., from corporation to LLC or partnership to LLP and vice versa.

announcement in the Federal Register that it had received approval from the Office of Management and Budget (OMB) for the information collection required under the new rules. These rules were originally adopted in August 2017, but were delayed due to delays in obtaining OMB approval. Discontinuance of Operation The FCC’s rules concerning permanent discontinuances of operation remain largely unchanged for private internal radio operations. For site-based licenses (which are the vast majority of the licenses held by our clients), a licensed facility will be deemed to have permanently discontinued operation if it has not operated a transmitter for a period of 365 consecutive days. For those alarm companies that operate under geographic area licenses (rare), the time period is 180 days. It is important to note that the operation of a “Channel Keeper” (a device which transmits test signals, tones, color bars or some combination) does not constitute station operation and will therefore not stop a discontinuance of operation clock. For those licensees who provide commercial (i.e., for profit) service, such as SMR or private carrier paging, the standard is more stringent. In order to be considered operational, they must be providing commercial service to at least one unaffiliated subscriber. Thus, the FCC could conclude that such commercial station had permanently discontinued operation if it had no customers, even though the station was fully operational and the licensee was were ready, willing and able to provide service if requested. License Renewal As described in previous updates, the FCC has adopted a license renewal standard which is designed to ensure standardized review of license renewal applications. licensees which will require certifications regarding license operations over the prior license term: Site Based (Most Alarm Radio Systems) n Licensee must certify that it is continuing to operate consistent with its most recently filed construction notification (or most recent license authorization if a construction notification was not filed); and n Licensee must certify that no permanent discontinuance of service occurred during the license term Geographic Area (Private Systems) n For a licensee in its initial term with an interim performance requirement, the applicant must certify as follows: u

It has met its interim construction performance requirement and that over the portion of the license term following the interim construction performance requirement, it continued to use its facilities to further its private internal communications needs or public safety needs; and

u It has met its final construction performance requirement and continues to use its facilities to provide the minimum level of operation required by its final construction performance requirement through the end of the license term. n For a licensee in any subsequent license term, the licensee must certify as follows: u It continues to use its facilities to further its private business or public safety needs at or above the level required TMA Dispatch | Fall 2020

to meet its final construction performance requirement, and u No permanent discontinuance of operation occurred during the license term. Regulatory Compliance Certification In addition to certifications concerning the physical operation of the license to be renewed, the FCC is also requiring each license renewal applicant to certify that it has “substantially” complied with all applicable FCC rules, policies and the Communications Act of 1934, as amended. What Happens if I Cannot Make a Certification? The FCC will require a demonstration if a licensee cannot make an appropriate safe-harbor showing or the regulatory compliance showing. Any licensee that is unable to make the appropriate showing can contact our office so that we can work with you to develop the necessary information. In this regard, the FCC’s staff has informally indicated that special showings should be the exception to the rule and that most license renewal applications should be covered by safeharbor certifications. FCC Adopts Final Steps for AllElectronic Wireless Filings; Sets Six Month Transition Deadline On September 18, the FCC issued a Report and Order taking the final steps to transition to an electroniconly submission of all filings in the Universal Licensing System (“ULS”) and related systems (e.g., Antenna Structure Registration System (“ASR”), Tower Construction Notification System (“TCNS”) and Electronic Section 106 (“E-106”) System. Once this Report and Order is published in the Federal Register, the FCC will no longer print and mail paper authorizations, reminder letters and other important correspondence to licensees and

applicants, making it critical that license holders carefully maintain their contact information (including email addresses) in the FCC’s ULS database. If the FCC sends correspondence about, e.g., a proposed modification or termination of your license, and it goes to an expired email address of someone no longer with the company, you may suffer a loss of your license rights. Licensees may also want to establish a separate email address such as “FCCcompliance@ acmewireless.com” to use as the contact email they provide to the FCC, which email will go to multiple persons at the company, so that it is less likely an important communication from the FCC will be missed because the recipient is retired, terminated, on vacation or suffering computer problems. The FCC adopted the all-electronic requirement over the objection of BloostonLaw and others, who had pointed out that failure to send a paper copy will mean that important communications may be missed. Even if steps are taken to address retirements, firings, etc. as described above, licensees may miss FCC communications due to, e.g., denial of service attacks over which they have no control. The transition to all-electronic filing will be required six months after Federal Register publication. House of Representatives Passes Legislation to Repeal T-Band Spectrum Auction After almost two years of languishing in the House of Representatives, the House passed the Don’t Break Up the T-Band Act of 2020 (H.R. 451) by a vote of 4105. This legislation, introduced by Rep. Eliot Engle (D-NY), would eliminate the upcoming auction of the T-Band (470512 MHz), which is currently used by both public safety and industrial landmobile licensees in order to meet critical internal communications needs. [27]


This vote is significant due to its wholehearted support on both sides of the isle. The legislation has now been passed on to the Senate and referred to the Committee on Commerce, Science and Transportation for action. While the Senate has not provided a timeline to consider this legislation, hopefully there will be sufficient support for this legislation to pass before this session of Congress adjourns. In this regard, there is significant support for a repeal of the T-Band auction requirement – first established in the Middle Class Tax Relief and Job Creation Act of 2012 – at the FCC, the Government Accounting Office (GAO) and among public safety and industrial business users. While it appears that few if any alarm companies still operate in the T-Band, the alarm industry has been supportive of this effort because of its importance to the public safety community with which alarm companies work. NSMA Seeks Reconsideration of RF Radiation Rules The National Spectrum Managers Association (“NSMA”) is requesting reconsideration of several elements of the FCC’s December 4, 2019 Resolution of Notice of Inquiry, Second Report and Order, Notice of Proposed Rulemaking, and Memorandum Opinion and Order in ET Docket Nos.03-137, 13-84 and 19226 (the “MO&O”), in which it decided to retain its current RF exposure limits but modify how compliance is assessed. NSMA has asserted that there are three areas in the FCC’s MO&O that require attention: The two-year timetable for implementation of site-by-site RF exposure evaluations is not realistic or practical. u NMSA notes that most non- broadcast facilities and sites (such as those used by alarm companies) were previously classified as “categorically exempt” from the requirement to complete an RF radiation [28]

analysis. Under the new requirements, a licensee would be required to evaluate its effective radiated power (ERP) and determine a worst-case distance between the center of the antenna and a possible human bypasser. This evaluation would require a determination of the precise specifications and characteristics of the licensee’s transmitters, as well as nearby transmitters operated by other licensees for which the required information may not be available. This evaluation will most likely require site visits as well as significant financial outlays and the hiring of personnel. To provide context to the timeline, NMSA has estimated that there are at least 100,000 microwave transmitters that would be affected, and that it would take anywhere from 2 hours to two days per site to perform the necessary evaluations. Further compounding the issue is the fact that this evaluation would also be occurring during the 5-G rollout.

u NMSA points out that the FCC’s new rules appear to require evaluations of all transmitters at a particular location without regard to whether or not the signal is directionalized or omni directional. In this regard, NMSA notes that the calculation would require including the combined ERP calculation transmissions from different fixed wireless antennas whose highly focused beams would virtually never converge on the same spot or person. As a result, NMSA contends that simply adding the energy of all antennas to the overall energy levels of other sources transmitting from that location would create an inaccurate profile for any actual hazard. As a result, NMSA urges the commission to exclude multiple fixed point-to-point transmitters/ different antennas at a given location from the summation of energy calculation described in new Rule Section 1.1131(b)(3)(ii)(B).

TMA Presents Annual Awards

President Don Young honors two TMA members who have made significant contribution to TMA and the industr y. On Wed., October 21, 2020, in the course of TMA’s General Membership Meeting, TMA President Don Young had the honor of presenting TMA’s two highest awards - Stanley C. Lott Award for Exemplary Service and the Mel Mahler Award for Outstanding Service to the Monitoring Industry. The 2020 Stanley C. Lott Award for Exemplary Service was presented to former TMA President Ivan Spector, President, Sentinelle Alarms. In presenting the award, President Young stated, “This year the award is given to a man who has not only served TMA through many leadership positions on committees and the TMA Board, but who was a founding member and longtime board member of the Security Industry Alarm Coalition (SIAC). In addition, he has been a leader in advancing alarm management in both Canada and the United States. For CANASA, he served on the Board of Directors, was national president, and chair of the Response Committee. In that role he proved instrumental in driving many false dispatch reduction initiatives. He is also a Superior Court of Canada-acknowledged and accepted expert witness. This year’s winner is a graduate of McGill University in Montreal and is the TMA Dispatch | Fall 2020

owner of Sentinel Alarm in Montreal, Canada.” Young then presented the 2020 Mel Mahler Award for Outstanding Service to the Monitoring Industry to Steve A. Schmit, Senior Staff Engineer, UL. In presenting the award, President Young commented, “When deciding on a recipient for this year’s Award, one name came immediately to mind. He is an individual who has served our industry for more than 39 years, but with the onset of Covid 19 earlier this year, he worked tirelessly on behalf of the TMA membership to develop work at home standards that would allow our industry to continue to operate under safe conditions. This year’s winner is an experienced Engineering Manager with a history of working in the public safety industry. He holds a BS in Electrical and Electronics Engineering from the University of Wisconsin-Madison and serves as Senior Staff Engineer for Underwriters Laboratories. I am very grateful for all of the help and guidance this year’s recipient provided on the establishment of the new standard.” Please congratulate our award winners, Ivan and Steve for their extraordinary contribution to our industry.

New Committee Chairs Appointed The Associate Members’ Liaison Committee and the Proprietar y Council both welcomed new chairs in October. Jennifer Holloway, CIBC Bank USA, is joining DMP Vice President of Marketing Mark Hillenburg, as co-chair of the Associate Members’ Liaison Committee, which represents suppliers and Associate Members to the TMA Board of Directors. “As a long-time member of the Associate Members’ Liaison Committee, I look forward to par tnering with Mark Hillenburg to represent my fellow associate members’ needs and concerns to the TMA Board and with general membership,” Holloway stated. “Ever y member plays a role in reaching TMA’s goals, and I am grateful to have this new oppor tunity as co-chair.” With the recent resignation of TMA’s longtime Proprietar y Council Chair Dan Jackman, The Church of Jesus Christ of Latter-day Saints, President Don Young appointed Michele Levcik, Wegmans Food Markets, Inc., to the position of Council chairman. “I am ver y excited and honored for the oppor tunity to serve on the TMA board. My goals are to increase proprietar y par ticipation and retention and continue to build relationships and knowledge in the industr y,” commented Levcik. Richard Flores, Puget Sound Energy, will support Levcik on the Proprietary Council as its new vice chair. Flores has served as the Council’s Secretary since 2017. [31]

Asset Protection is a male dominated industry. So, I would have learned the most from our VP of Asset Protection. He is always accessible, very caring, a people-first kind of person. And whether you’re a man or a woman, I think that is the best approach to making your operation a success. I have unofficially mentored women in our department by showing them how to be tenacious, gracious, driven, and have fun!

I started my career with Westec Security of Pittsburgh, which was purchased by PC Security, then ultimately became Vector security. I had just graduated college and was looking for employment until I found a job related to my degree in Computer Science. I just needed a job until that point. My aunt happened to be working for Westec and was moving to another position outside the company. She called me incessantly to apply for her position, so I did. I went for an interview on Saturday and was offered the position by the end of the interview. I started the following Monday. I walked into the Central Station and all the receivers were beeping. 2. Please briefly describe your experience working in the security industry. I had never heard of the alarm industry prior to applying for the operator position. I have been in the industry and with one company, Vector Security, for 35 years. Over the years I have participated as a presenter for CSAA/TMA training sessions for both ESX and Fall Ops. I have worked with CSAA/TMA on many of the wiki page topics. I worked directly with CSAA on the development of the APCO (now ASAP to PSAP) development. I am the CSAA/TMA chair for the UL standards committee. Most recently, I participated in the Virtual Operator (Work from Home) section of the UL827 Standard. I also participated in the TMA-AVS-01 standard committee. I also was awarded the CSAA Excellence Award for the Central Station Manager of the year in 2008.

5. What do you consider your greatest career achievement, to date? Why? I believe my greatest career achievement is the design and implementation of two fully-redundant Central Stations. This was way before current technology of today. This continues to change daily as technology changes. 6. What advice would you give to another woman who aspires to rise to upper level management in the monitoring industry? Be a leader in your organization. Don’t wait for someone to ask you to do something. Identify things within the organization that you can help with to move the business forward (efficiency, new services, customer experience, new RMR etc.). Also, participate where you can in industry committees and training sessions such as ESX and Fall Ops. I take a good idea back to the office every year. Many others are out there doing the same thing so use their experience. Don’t reinvent the wheel if someone already has.

I spent my early 20’s after university searching for my place, at Kimberlite and through security I found my passion and my mission. 2. Please briefly describe your experience working in the security industry. I’ve worked in all facets of the business but spent most of my time in system design and sales. I am passionate about solving people’s security challenges. I work mostly in the commercial space and enjoyed helping my clients develop effective loss prevention strategies to protect their business and team. 3. Have you encountered any obstacles? How have you overcome them? One of the hardest obstacles I had was overcoming the perception that I was not knowledgeable about system design and the construction process. When I started 19 years ago, women were not typically members of the technical staff. I worked hard to be the most knowledgeable in the room and ensure my designs and installations were on point. I hold many

One of my greatest achievements is the work I have done within the industry to help standardize verification practices while working with law enforcement. Helping to improve our practices to provide a better product to Law Enforcement and our subscribers. 6. What advice would you give to another woman who aspires to rise to upper level management in the monitoring industry? Be fearless. I find many women I have mentored wait until they feel they are ready to apply for the job or to ask for more responsibility. You will never have an opportunity you don’t apply for. I also recommend to schedule time with leaders in your organization or ones you have admired. Our industry is amazing and giving. Most leaders will give you some time. Ask what is necessary for the next steps and what you can do to be considered. [43]

Making a Difference...Why We Do What We Do Monitored protection helps save family dog in Mississippi fire By Bob Tucker, Chief Storyteller, ADT

Home alone, Bob, a 12-year-old German Shepherd, nearly died in a fast-moving electrical fire. The dramatic rescue happened one Saturday afternoon in Ocean Springs, MS where Samantha Betterton was running errands with her daughter. “My monitoring company called to say a smoke alarm was activated,” said Samantha. “Thinking my husband was still home, I connected with him, but he had already left. That’s when my stomach dropped, knowing our beloved Bob was trapped inside.” Samantha feared the worst because earlier in the year, the family had already lost two other pets, plus Bob is older and moves slowly. Rushing home, Samantha found her husband kicking in the front door as smoke was spewing out the windows. He ran inside and pulled out Bob as flames consumed the house. Firefighters arrived a few minutes later and saved the structure from burning to the ground. Samantha credits her security company for alerting her to the fire so she could call her [44]

husband to quickly return home. While all that was happening, the monitoring center dispatcher was calling the local fire department. “Without everyone working together, we would have come home to ashes and our fur baby would be gone,” said Samantha. A few weeks after the fire, Samantha had an opportunity to meet and thank Katie Whaley, the dispatcher who handled the alarm signal. “Knowing that my work made a difference for this family and their precious pet, makes me very happy,” said Katie. The National Fire Protection Association (NFPA) estimates about 40,000 pets die in fires each year, and most happen inside homes without monitored security protection.
