it is often said that boca raton is a world-class city but what exactly does that mean? we certainly can boast being an employment center with fully half of the 61-corporate headquarters located within Palm beach county selecting boca raton as their venue of choice.

we can boast about a vibrant downtown, recreated over the past 25 years, attracting wonderful restaurants, small and large businesses and soon to be one of the few us cities to have a Mandarin oriental to attract foreign and domestic travelers.

For a municipality, self–actualization takes many forms but a key indicator for any community is the growth and support of arts and culture by its residents, including performing, visual, and fine arts, as well as architecture, crafts, historic preservation, literature and other creative activities.

opera, “for the 99 percent,” will be offered when Puccini’s La bohème is semi staged with the symphonia boca raton conducted by constantine Kitsopoulos (Sat March 4th). The night before (Fri March 3rd), Branford Marsalis will join the Symphonia to perform the music of John Williams (including scores from Star Wars and Harry Potter). Thirteen year-old piano prodigy Joey Alexander returns after a triumphant performance last year, joined by Daniela Liebman (accompanied by the Symphonia on Sunday March 5th) and how about the World Premiere of Blake Edward’s The Pink Panther (1964) with the Henry Mancini Institute orchestra under the direction of Maestro Kitsopoulos performing the iconic musical score, live and on stage as the movie is presented on a large screen. the Festival culminates with legendary musician sergio Mendes & brasil 2017, in concert (Sun March 12th). this is but a snapshot of the cultural activities available for our community. the boca raton Historical Museum, wick theatre and costume Museum, Mizner Park Cultural Arts Center, Mizner Park Amphitheater, Boca Ballet theatre, Lynn university, Fau and the boca raton Museum of art (to name but a few of the more notable venues) can be counted on for a constantly changing array of cultural offerings. clearly, boca raton can be proud of the growth and diversity of cultural offerings in our city and take pride in truly being a world-class city!

MEN’S CUT & STYLE

Deducting Medical Costs For An Elderly Parent

25

$

M

any baby boomers are now faced with assisting an elderly parent with medical and longterm care expenses. if you are in this position, can you deduct the costs you pay for your elderly parent?

FIRST TIMERS ONLY

the short answer is often yes, but it depends. there are numerous tax hurdles to overcome. even then a deduction may provide limited or no tax savings.

The rules are: if a taxpayer provides more than 50% of a parent’s support they can deduct the medical costs paid on their behalf. this is the case even if the parent cannot be claimed as a dependent for purposes of the dependent exemption. if the parent is a dependent for medical purposes then:

Medical expenses paid directly by the child are deducted on their return as if they incurred the expenses.

MARCH 2017

Medical expenses are subject to a 10% reduction, or a 7.5% reduction (for 2016) if you were born before January 2, 1951. there is an addback for alternative minimum tax of the full amount allowed, or if you or your spouse is 65 or older, 2.5% of adjusted gross income if less.

So what does all this mean? First, all expenses paid must be analyzed to determine how much is medical and how much is maintenance. Mere in home assistance may not be deductible. Payments for medical care are deductible, along with certain expenses paid for a person who is “chronically ill”. Chronically ill means the person needs to be protected due to cognitive impairment, or because they are unable to perform at least two activities of daily living (eating, toilet, bathing, dressing, continence).

question? ContACt LuCy@boCAsbestMAgAzine.CoM oR CALL 1.561.244.9912

Assuming you meet all these tests and have a meaningful deduction, do you get a benefit? since the expenses are treated as if incurred by the payor, limitations on deducting medical costs must be exceeded. examine schedule A of Form 1040 to determine if the medical deduction exceeds the phase out based upon Agi. if this hurdle is passed, look at the alternative minimum tax (“AMt”) calculation to insure a benefit remains available. the combination of the deduction phase out and AMt may result in no net benefit. if the child payor gets no tax benefit, determine if there is a way for the elderly parent to recognize taxable income, to secure some tax benefit for expenses paid. to make this happen, the parent would need to pay their own medical expenses. gifts could cover expenses. if the parent has retirement plans, consider withdrawing funds in excess of the required amount to generate taxable income. bottom line, if the payor has significant taxable income, paying an elderly parent’s medical expenses may generate little or no tax benefit. in this case, review the elderly parent’s tax return and financial wherewithal to create some measure of tax savings. this article provides generalized tax and financial information for educational purposes only. it does not provide any personalized tax, investment, legal, or other business or professional advice. before taking any action with respect to the matters addressed, you should seek assistance of a professional who is familiar with your particular situation. the author and publisher accept no responsibility for any actions taken, or not taken, by any reader of this article.

BLU-PAC Backs Haynie, Singer, Thomson in March 14 Boca Election A BY DaLE KINg

fter a year without a city election, boca Raton has a three-race ticket on the municipal ballot will face local voters when they go to the BYLINEthat HERE polls on March 14.

The electorate will be asked either to re-elect firstterm incumbent Mayor susan Haynie or choose challenger Al zucaro for the position of city executive. seat A City Council incumbent scott singer, who is also finishing his first term, faces newcomer Patti Dervishi in his bid for a second term. For seat b, where incumbent Councilman and Deputy Mayor Mike Mullaugh is term-limited and must leave the city’s legislative panel, according to the city charter, three citizens are in the running: Andy thomson, emily gentile and Andrea o’Rourke. while voters have until election Day to decide which candidates to select, BLU-PAC (Business Leaders United for Boca Raton - PC, Inc.), the political action committee of the greater boca Raton Chamber of Commerce, has already issued its endorsements. the organization has thrown its support behind incumbents Haynie and singer and is also backing thomson from the list seeking Mullaugh’s vacant seat.

susan Haynie

BLU-PAC was created in 2006 to help members of the boca Chamber to better support local and state candidates who share the same views on various issues. In its statement, the PAC advises members that “your basic economic right is to have the freedom to run your business without unwarranted government interference.”

“BLU-PAC exists to endorse and fund candidates that are in alignment with the boca Chamber’s views and priorities regarding business and maintaining a successful and vibrant community,” says a statement from Chamber President and CEO Troy McLellan and BLU-PAC Chairman George Sigalos. they said the endorsements were issued after “a complete vetting and interview process” with the candidates running for the three offices. In the statement, they said, “BLU-PAC knows Susan Haynie and scott singer will continue to bring the right business experience, innovative thinking and dedication for our great city. More importantly, they will provide the leadership needed to keep boca Raton moving forward.” As to Thomson’s candidacy, BLU-PAC says it believes “Andy will bring the right business experience, innovative thinking and passion for our great city.” Thomson is senior counsel at Baritz & Colman LLP in boca Raton and works in the area of business litigation and dispute resolution. He currently serves on the board of directors of the greater boca Raton Chamber of Commerce’s golden bell education Foundation, Children’s Home society of Florida’s Palm Beach Division and on the advisory councils

in preparation for the city election, a candidate gathering was held on Feb. 6. it was taped and is being rebroadcast every Monday and Friday at 7 p.m. through March 13. it can be seen on Comcast Channel 20 in boca Raton and on u-verse Channel 99 and Hotwire Channel 395 in Palm Beach County. Candidates Haynie and zucaro will square off in a candidate debate March 3 at 6:30 p.m. at the wayne barton study Center, 269 ne 14th st., boca Raton. the candidates will take questions from the audience and also from a moderator. boca Raton has a city election two out of every three years. About a decade ago, voters adopted amendments to the city charter that changed the terms and limits for elected officials. The former system of three two-year terms was changed to two, three-year terms. the charter change also took place around the time of the recession and was seen as a way to save the cost of conducting a city election every year.

Ramp Up Breakfast with Morning Protein Add milk for simple, high-quality protein to help start your day right

(Family Features) Families across america want to make sure that they’re starting the day strong, and getting enough high-quality protein in the morning is a simple way to do so. a breakfast with protein is a great way to energize the morning, and adding it to your family’s routine doesn’t have to be complicated. simply add an 8-ounce glass of milk with 8 grams of natural protein plus other essential nutrients to your favorite breakfast foods for an easy, delicious way to help meet your morning protein goals. Kids already love milk and it’s a naturally nutrient-rich, wholesome food that moms can feel good about pairing with breakfast. Plus, experts recommend 25-30 grams of protein for adults at every meal – so getting a high-protein breakfast, including milk, gives moms the energy they need to cross everything off their to-do lists. Parenting expert, pediatrician and mom of three, Dr. tanya altmann, recommends serving milk at breakfast for a source of highquality protein in the morning. “the morning is a great time to bring the family together and start the day off with a tasty breakfast. as a mom of three, i need breakfast options that are quick and easy but also nutritious,” Dr. altmann said. “serving my children whole-grain cereal and milk, healthy oatmeal with fruit or a smoothie made with milk guarantees that my family will get high-quality protein and other essential nutrients to start their day off strong.” bring a smile to your child’s face with this charming twist on a breakfast standard. simply make instant oats with familiar flavors – cinnamon, vanilla and brown sugar – and top the bowl with a friendly bunny face. DON’T DROP THE BALL ON EDUCATION

President Ava Parker

Palm Beach State College

ven as 2017 begins, Rosemary Krieger of boca Raton is still in shock, she admits, from an event that took place in late 2016.

From left, Sarah Doyle, Woman Volunteer of the Year Luncheon chair; Kirstin Stanley, Junior League of Boca Raton president; Lifetime Achievement Award winner Rosemary Krieger; Mindy Shikiar, vice president of Oncology and Ambulatory Services and Business Development at Boca Raton Regional Hospital and Dr. Kathy Schilling, medical director at the Christine E. Lynn Women’s Health & Wellness Institute. (Photo by Dale King)

when a shaky, stunned and teary-eyed Rosemary reached the podium, she thanked the nearly 1,000 people in the audience at the 29thAnnual woman Volunteer of the Year Luncheon & Fashion show at the boca Raton Resort & club. she had particularly kind words for her husband, ben, longtime partner in giving, and her three children who flew in from around the country: sons Kenneth, from New York and gregory, from Delaware, and daughter, catherine Krieger-Nelson, from Dallas. “I’ve gotten flowers, emails and calls,” said Rosemary in a recent interview, her smiling face still beaming with excitement. “i didn’t expect to get the award. i am still in shock.” many in the audience were themselves in tears as they stood and applauded Rosemary, whose beneficence has helped dozens of nonprofits, from AVDA (Aid to Victims of Domestic Abuse), the YmcA, march of Dimes, george snow scholarship Fund, wayne barton center, st. Jude church, boca Helping Hands and Florence Fuller child Development center, to name a few. Education and Arts Leadership

Among those at her table was AVDA executive Director Pam o’brien, who nominated Rosemary for the award. “she is a true giver who thinks of others before herself,” said O’Brien. “She wants to make sure that women and children in need have a safe place to go.”

the generous lady from boca has a simple philosophy about giving. “You don’t think about it, you just do it. I has to come from the heart.” coincidentally, barely a month after receiving the honor, Rosemary has jumped back into an AVDA cause. she is on the committee planning the Feb. 21 “Heart of a Woman” luncheon fundraiser at the Boca Resort. The speaker will be Michelle Knight, one of the three women abducted, imprisoned and repeatedly raped by Ariel castro at his home in cleveland. Nabbed by the suspect between 2002 and 2004 were Knight (who has changed her name legally to Lilly Rose Lee), Georgina DeJesus and Amanda Berry. They finally escaped in 2013 when Castro was captured, tried and sentenced to life plus 1,000 years in prison. He committed suicide behind bars.

while a rash or other skin irritation can be an obvious sign that your pet has sensitive skin, other behaviors such as excessive scratching, biting and licking can also signal a problem. identifying the cause is essential to bringing your pet comfort. skin irritation among pets is generally caused by something in their environment, such as an allergy, a parasitic infection or in more extreme cases, a neurogenic or infectious condition. skin problems can also arise from poor nutrition.

LEGALLY SPEAKING BY ALAN J. REINDFELD, ESQ

The Main Terms of Estate Planning this month i am giving a simple overview of the documents and terms i use daily. •

Durable Power of Attorney – this is a document that allows someone to make financial and other decisions for you. As long as it is properly prepared, the document can be used for anything. For example, when a person gets older and they are not able to manage their affairs due to a number of reasons(i.e. old age, dementia, etc..), the durable power of attorney allows someone to manage their affairs. Healthcare surrogate - this is a document that allows someone to make medical decisions for you in the event that you are incapable of managing your own medical affairs. this document also allows for your Healthcare surrogate to talk to your doctors without any HiPAA violations occurring.

Last will & testament - this is a document that allows a person to state their wishes in the event of their death. this document will list who will be in charge of a person’s assets and who those assets should be distributed to.

Living will - A Living will is a written statement detailing a person’s desires regarding their end of life medical treatment. this document becomes extremely important in circumstances in which a person is no longer able to give their consent. this “terry schiavo” document is designed to make sure your family knows your wishes regarding end of life procedures.

Revocable Trust - This document, when all assets are properly titled, allows a person to avoid probate. This document works in cases of incapacity, like Donald

Sterling and the sale of the LA Clippers. You can choose who will be in charge, as well as how your beneficiaries are allowed to use anything left to them. •

Probate - Probate, the last term I usually use, is a court process that distributes a deceased person’s assets. if the deceased person leaves a will directing how his or her property should be distributed after death, the probate court must determine if it should be admitted to probate and given legal effect, choosing if it is valid or not. if a person dies intestate—without leaving a will - the court appoints a Personal Representative to distribute the deceased person’s property according to the laws of Florida.

The above basic terms, among others, are used by members of my firm as well as myself on a daily basis. I hope the above provided some clarification for all the readers out there. However, please note that these terms are sometimes used interchangeably by people and their legal significance can vary depending on the circumstances involved. Let the attorneys at the Law Offices of Reinfeld & Cabrera, P.A. help guide you through the estate planning process and answer any questions you may have.

The Law Office of Reinfeld & Cabrera, P.A. is conveniently located at 10235 W Sample Rd # 207, Coral Springs, FL. The law firm is bilingual and offers a free initial consultation by phone or in person. To speak with an attorney, call 954-334-1520 or 1-855-LAWS-123.
