Losing Control with Joint Ownership
W
hen it comes to estate planning, one should always be aware of the possibility of losing control with joint ownership. At Reinfeld & Cabrera, P.A. we want you to understand that while joint ownership may have some important benefits, there are some aspects that can cause a lot of problems later on.
exceptions may apply. But when the second or last owner dies the property will then be inherited by her family. Scenarios like this can happen to any family (even blended families with children from separate marriages for example) and are becoming an ever-increasing problem.
Joint ownership, also known as joint tenancy with right of survivorship, is the most common form of joint ownership. For example, in most marriages most assets are jointly owned. Joint ownership with the right of survivorship is different than other types of joint ownership with one important defining feature – if one partner in the joint ownership dies, ownership is automatically transferred to the other partner(s). This can be seen as both a blessing and a curse. It is a blessing because property shared through joint ownership does not undergo the probate process, thus eliminating some major expenses. The only exception is if there is no other partner for the property to go to (if, for example, both die at the same time or if the last owner does not declare another joint owner before their death) in which case the property will be subject to the probate process.
Some other problems that may occur with joint ownership include gift and income tax, the increased risk of being named in a lawsuit, of a person who owns the property with you being named in a lawsuit, losing the asset to a creditor, limiting your tax planning options, the difficulty of removing unwanted co-owners, and the court possibly becoming a “new” co-owner if your partner becomes incapacitated etc. While the benefit of avoiding probate may be a big draw card to many people, an experienced attorney will always make you aware of any potential dangers and how you can avoid them with proper estate planning. The real problem comes in with the fact that property transferred through joint ownership to any remaining partners is not controlled by any wills because transfer of property takes place immediately upon death. It passes outside the probate process, and therefore is not considered an assets for the purpose of Probate. The asset is now completely under the control of the surviving owner(s) and they can do whatever they please with it. This could result in you unintentionally disinheriting your own family. This happens most often when siblings are in joint ownership. If one dies, the property will not be inherited by his family regardless of what his will may say,

The Snowbirds Are Coming!! It’s that time of year again. The traffic is more congested, lines are longer at grocery stores, restaurants are packed by 6pm… The winter visitors, aka “snowbirds”, are arriving in full force! This happens every year in Florida and who could blame them? If I lived up north, I would also make the trip down here to beat the cold. The winter visitors bring a lot of business with them. One business in particular that seems to stay busy during the season is the emergency restoration business. Every year during this season, our mold remediation workload seems to double for the months of November and December. This is due to a number of things. I would say the majority of our mold remediation work is related to the A/C unit. Proper maintenance of an A/C unit is very important, especially in Florida where they run all year long. Here are some tips to save you money and help prevent any damage to your property: - Make sure you have someone physically checking on your property at least once a month. A good property manager or a friend can do this. Some of the best property managers will go as far as to send you updated pictures of your property.
- You can prevent mold from developing on your property by using a programmable thermostat. Have it programmed to run your AC at 72° for two hours in the morning and 85° the rest of the time. This will prevent mold by removing moisture from the air during cooler hours. - Use portable dehumidifiers. Be sure you do your research on them and buy the correct number of dehumidifiers you would need to dehumidify your entire house/condo. - One of the best investments I made was a NEST Thermostat. It is referred to as a “learning thermostat” because it can create a schedule, its proven to save energy, and you can control it from a smart phone. I highly suggest investing in the NEST thermostat or one similar to it. - Flush out you’re A/C drain line before you leave for an extended period of time. This will save you a lot of heart ache in the long run. Nothing worse than arriving at your home, A/C is working properly, but you have water damage due to a clogged drain line. - I always suggest having you’re A/C coils cleaned. Your A/C has been running all year long and probably hasn’t had the filter changed. If your filter hasn’t been changed
all year, the coils start to act like a filter attracting dirt, mold, and other contaminants. These are just suggestions, as I am not a licensed A/C technician. These are tips that I have picked up over my tenure and tips I’ve utilize. If you have any questions concerning air conditioning, I recommend you talk to a reputable A/C company. During the month of October Margate Police Officers were trained by Margate Resident Victoria McHale and her son on Autism Training and Advocacy. This valuable training teaches officers about autism spectrum disorder from a parent’s perspective and through the eyes of an autistic child. This training was invaluable to these officers. The Margate Police Department played an active role in the City’s Annual Student Government Day, which was held on October 18th. Students from Margate STEM Magnet Middle School’s Student Council spent the day learning about the day-to-day operations of the City, touring various City departments and getting an upclose view of police units, vehicles and equipment. Here, the students learned about the Special Response Team, toured the Chief’s Office and learned about criminal investigations. Back To School-2 Last month’s column addressed the American Opportunity and Lifetime Learning Credits available for taxpayers who pay qualified education expenses. While credits are generally more favorable than deductions, there are numerous tax provisions that grant tax deductions or other benefits for education related expenses. In most cases, taxpayers cannot utilize both credits and deductions in the same tax year. In addition, the various deductions have different phase-outs based on modified adjusted gross income. The deductions themselves may apply to different types of expenditures. Below is a quick summary of some of the available education expense deductions and other benefits that may be useful. Coordinating the use of credits, deductions and other tax benefits can be a complex matter. It is important to consult your tax advisor to maximize your benefits. 1. Student Loan Interest Deduction: Interest expense paid on student loans for dependents is deductible up to $2,500 of interest per year on qualifying student loans. Married filing joint phase out begins at $130,000 of gross income, with full phase out after $160,000 of gross income. 2. Use of Retirement Funds For Qualifying Education: IRA funds can be accessed to pay qualifying education expenses on a penalty free basis for taxpayers under age 59 ½. The 10% early distribution penalty will not apply, to the extent funds are used for qualified education expenses. 3. U.S. Savings Bond Series EE and I: Interest income can be excluded to the extent funds are used for qualified tuition and fees. These funds must be used for the taxpayer, the spouse, or dependents. Married taxpayers must file a joint return to secure the exclusion. A phase out applies to married filing joint taxpayers, with adjusted gross income starting at $116,300, with full phase out at $146,300.

income (“MAGI”) up to $130,000. If MAGI is between $130,000 and $160,000, the maximum deduction is $2,000. Over $160,000 of MAGI, no deduction is permitted. 5. Qualified Tuition Plans (Section 529): States sponsor Section 529 Plans. Each State has its own rules and regulations. Generally, all income grows tax free with distributions for qualifying education expenses non-taxable as well. There are no Federal deductions upon contribution, but many states do provide meaningful deductions. 6. Education Expenses Incurred as Part of a Trade or Business: Enhancing one’s skills in a current trade or business can result in an important tax deduction. So long as the education enhances skills, rather than enables one to enter a new trade or business, the expenses may be deductible. If expenses are deductible, all related expenditures, such as travel, over-night stays, and related meals, might also be deductible. These expenses would qualify as excess itemized deductions reportable on Schedule A. Despite all this complexity in determining which education credits and deductions provide the best results, meaningful tax savings can be achieved. Because each of the above-noted provisions have their own separate rules and regulations, it is important all taxpayers incurring education expenses become familiar with the provisions, so they can maximize their benefits as they incur today’s high cost of education. Vice Mayor Joyce W. Bryan, the City of Margate’s first African-American elected official, was named Mayor for two weeks. After unsuccessfully running for office four times, Bryan was elected to the Margate City Commission in a 2014 special election. Bryan’s name is etched in Margate’s history as the City’s first black Commissioner, Vice Mayor and Mayor. “I am humbled by this very kind gesture by Mayor Ruzzano and my fellow commissioners,” Bryan said. “I hold this position with the highest esteem, just like my other positions, but being Mayor is something I never thought I’d have the opportunity to do since I am leaving the dais.” Bryan, who is originally from New Jersey, has called Margate home for nearly two decades. She is a certified teacher’s assistant with the School Board of Broward County and currently serves on several Boards and Committees including the Margate Community Redevelopment Agency, Northwest Focal Point Senior Center District, Margate Parks and Recreation Trust Board and the Margate Initiative for Community Action and Hope (M.I.C.A.H.) of which she is a founding member. She is a member of the Relay for Life Team and enjoys spending time with her family and being an active member of her church. She is a wife, a mother and a grandmother. Bryan says although she will miss being in office, she looks forward to spending more time with her loved ones and having more time to travel. “I will continue to do the best that I can for the residents of Margate,” she said. “Although I will not be an elected official after November, you’ll see me around. I will still serve my community that I love so much.” Mayor Joyce W. Bryan will run the next City Commission Meeting on Wednesday, October 5th beginning at 7 p.m. at Margate City Hall. Nutrition And Plastic Surgery When discussing cosmetic enhancements of the face and body, patients often focus on the procedures and products available and ignore the significance of nutrition. At the cellular level, the aging process is characterized by mitochondrial damage, inflammation and glycation. Plastic surgery addresses the external signs of aging. Proper nutrition, including diet and supplements, can not only slow the aging process, but also ensure that the patient heals properly after surgery. Adequate Vitamin C is necessary for collagen production which strengthens a wound and fights free radical damage. Other less often mentioned antioxidants which are more potent are resveratrol (found in red wine) and pycnogenol (pine bark extract). Both have demonstrated clinical efficacy in reducing inflammation in the body and reversing the signs of aging. Patients often prefer nonfat supplements, which at times are actually higher in sugar and more damaging to the body. Too much sugar in your diet leads to increased levels of insulin and can progress to fat infiltration in the liver. Unsaturated fatty acids such as Omega-3 and Omega-6 are essential fatty acids that are good for the body. They are often found in plant foods such as vegetable oils, nuts (almonds, walnuts) and seeds (flax) and in fish such as salmon. It is the saturated fats and trans fats that should be avoided as much as possible. These are found in butter, red meat, and high fat dairy products. Recently, scientists have presented conflicting evidence as to the benefits of Omega-7 fatty acids. Palmitoleic acid is not an essential fatty acid, meaning our bodies can manufacture it from other nutrients and we don’t need to get it from food. Experimental studies have shown it to be beneficial in reducing heart disease and triglyceride levels. More controlled clinical trials are necessary to determine the health benefits of this omega. As we age, our metabolism changes and hormone levels decrease, and the effects of years of cellular damage from poor dietary habits and lack of proper nutrition become more evident. Conjugated linoleic acid (CLA) has been shown in studies to reduce fat and preserve muscle tissue. CLA helps you lose weight faster by reducing fat storage introduced by your daily diet and accelerating fat metabolism within the existing adipose (fat) tissue. Similarly, L-carnitine is a naturally occurring amino acid which plays a vital role in the metabolism of fat. It functions as a transporter of fatty acids into the mitochondria-the metabolic furnace of the cell. Carnitine boosts energy by stimulating the body’s burning of triglycerides as fuel. L-carnitine allows the body to burn more fat. No pill or supplement is a substitute for a balanced healthy diet, including some degree of calorie restriction, low-glycemic foods, coupled with both cardiovascular and weight-bearing exercise. Patients should know that not all supplements affect each individual in the same manner. If you are uncertain whether you should be taking a specific supplement because of health conditions or medications you are taking, consult with your physician first. O
bstructive Sleep Apnea is a common disorder. If you have OSA, it means that your airways collapse partly or all of the way while you are sleeping. Muscles of upper airway relax when you fall asleep. If you sleep on your back, gravity can cause tongue to fall back. This narrows the airway and can reduce the amount of air getting in the lungs. Narrowed airways causes snoring by making tissue in the back of throat vibrate. Apnea is when the airway is completely closed, so breathing temporarily stops. The airway can collapse repeatedly during the night. Air cannot get in to your lungs, resulting in lack of oxygen. You wake up so you can start breathing again. Frequent awakenings at night can cause sleepiness during the day. Lack of oxygen and frequent nighttime awakenings have negative consequences for your health.
Signs of Obstructive Sleep Apnea 1. Loud or frequent snoring. 2. Choking or gasping while you sleep. 3. Morning headaches. 4. Daytime sleepiness or tiredness. 5. Trouble concentrating.
Who is at risk for OSA?
You are at increased risk if you are: 1. Overweight. 2. Hypertension. 3. Male with a neck size of 17 inches or more. 4. Female with a neck size of 16 inches or more. 5. Male over the age of 40. 6. Female over the age of 50.

Asian Chicken Lettuce Wraps
Total time: 15 minutes Servings: 1 1/2 cup refrigerated cooked chicken breast strips 2 Bibb or Boston lettuce leaves 1/2 cup Dole Mandarin Oranges, drained 2 teaspoons slivered almonds 1 tablespoon light Asian salad dressing Divide chicken equally inside two lettuce leaves, making two wraps. Add 1/4 cup of Dole Mandarin Oranges and 1 teaspoon slivered almonds into each wrap. Serve lettuce wraps with light Asian salad dressing for dipping.
Orange Chipotle Avocado Toast
Total time: 10 minutes Servings: 1 1 slice whole wheat bread 1/2 avocado, diced or smashed salt pepper 1/3 cup Dole Mandarin Oranges, drained 1/2 teaspoon chipotle peppers in adobo sauce, finely chopped 1/4 lime Lightly toast whole-wheat bread and top with diced avocado. Season with salt and pepper, to taste. In medium bowl, toss oranges with chipotle peppers. Spoon oranges over avocado toast and finish with a squeeze of lime. Listening Works! I dedicate this article to my unparalleled mother, Toby Litt. Her work as a communication specialist and spiritual guide continues to power and inspire me every day. The name of her company was Listening Works. Few of us have been taught to listen because so few of us have been listened to. First as children, then as adults… we live in a society of impatience, distraction, of multi-tasking and self-serving agendas. We are in such need to be heard, to share what we have to say, to explain our side of the argument-- to show what we know. We enter conversations with our point or angle in mind. Sometimes it’s as if you let the other person speak just so you can get your turn to say what you need to say. To be right or to win. When we don’t listen, we all lose. Did you know that most conflicts and challenges we experience are caused by ineffective listening which translates into miscommunication? Yup, it’s true! So how do you know what kind of listener you are? Let’s take a look at the three levels of listening: 1. Subjective Listening: Also known as “selfish listening” because the listening is based on the agenda and needs of the listener. Whatever is said is heard through the experience of the listener. This type of listening rarely satisfies the person who is speaking. Speaker: I’m so upset that I missed my son’s soccer game. Listener: Yeah, I missed my daughter’s play once and I felt awful. 2. Objective Listening: Also known as “selfless listening” because the listening is completely focused on the speaker. There are no thoughts about how it relates personally to the listener and can be very effective. It allows the speaker to feel heard.

Intuitive Listening: Also known as “powerful listening” because the listener is hearing all components and intuitively connecting with the speaker’s real message. The listener is not only paying attention to the words, but also tone, emotion, and energy, as well as what is not being said. This level of listening creates the deepest connection with the speaker. Speaker: I’m so upset that I missed my son’s soccer game. Listener: Being so upset is totally understandable. It seems like like you’re feeling really down on yourself about it and what it may mean about everything you are trying to balance right now. In life, we all listen at all the levels. After all, you’re human. But by being more aware, you can take steps to reach for those deeper levels. I will say this, to powerfully listen is to hear with the intention to understand. To powerfully listen we must be silent, we must be present in the moment, we must pay attention, we must be curious, we must be open-minded and vulnerable. roward County Public Schools (BCPS) strategic focus on early learning and literacy is getting national support. Today, BCPS and the non-profit organization Children’s Literacy Initiative (CLI) announced an exciting partnership and grant funding to support early literacy development in kindergarten through third grade students. The announcement and kickoff celebration at Plantation Elementary School included School Board members, Superintendent Robert W. Runcie, CLI representatives, District staff and local community leaders, as well as reading activities by students. Children’s Literacy Initiative (CLI) is a non-profit organization focused on strengthening education in the United States by ensuring students can read by the end of third grade. In November 2015, CLI was awarded $19.5 million from the 2015 Investing in Innovation (i3 grant) competition from the U.S. Department of Education. CLI is using this funding to expand its program into four school districts across the nation, including Broward County Public Schools – the only school district in Florida chosen to participate. As part of the CLI partnership, seven BCPS schools are receiving personalized, one-on-one teacher coaching, research-based literacy training, small group coaching, books and materials. The seven schools are: Charles Drew Elementary School, Forest Hills Elementary School, Palmview Elementary School, Pines Lakes Elementary School, Plantation Elementary School, Sanders Park Elementary School and Stirling Elementary School. The Children’s Services Council of Broward County and the United Way of Broward County were also recognized during today’s ceremony for their financial support of this important initiative, through a matching funds requirement in the grant. “Ensuring our students have the skills they need to be independent readers by third grade is vital to their overall educational success. Creating a strong reading foundation starts with providing our students high-quality early learning and literacy experiences,” said BCPS Superintendent Robert W.

Penny Sales Tax Hike On Broward, PB County Ballots By Dale King While voters across the nation are gearing up for the long-awaited nov. 8 election that will decide the U.S. presidency for at least the next four years along with a bevy of state and federal contests, those who cast ballots in Broward and Palm Beach counties face an even more personal issue - a financial one – when they go to the polls. The electorate in the two massive South Florida counties will decide whether to tack another penny on every dollar they spend on items covered by the current 6 percent state sales tax. actually, the ballot questions are different in each county, but the net result is the same – an increase from 6 to 7 percent. and the destination for the cash raised – if voters choose to add another copper Lincoln coin to what they are already paying for their taxable goods – is virtually the same, though Palm Beach County is earmarking 50 percent of total revenue raised to schools. Voters in Broward face a pair of ballot questions which will each add a half-cent to the sales tax. Official estimates say the additional penny will add up to $12.6 billion over the 30 life of the increased tax and will be spent mainly on infrastructure, in particular, transportation-related projects. Broward residents who cast ballots on election Day will have to adopt both measures to make the effort work. if one question fails, the other does, too. Meanwhile, in communities from Boca Raton north to the Martin County line, the electorate will be asked to hike the sales tax from 6 to 7 percent for the next decade. The temporary penny-added tax is expected to generate $2.7 billion in new revenue. Half the money will be paid out for improvements to school buildings, general infrastructure such as roads, bridges and drainage and amenities such as parks and fire stations, said Todd Bonlarron, assistant Palm Beach County administrator. Florida allows its 67 counties to add to the base 6 percent sales tax figure. Bonlarron said Broward and Palm Beach are two of only nine counties that have not puffed up the bottom line. The county official did note that Palm Beach added a half-cent to the sales tax a few years ago. But that, he noted, was “a good example of government putting a tax on the table and having it expire.” it also shows how the county can put a plan in place, execute it and monitor it until it fades into the sunset. Both Bonlarron and gretchen Cassini, assistant to Broward County administrator Bertha Henry, said no organized opposition has emerged to the measures

in either county. The Broward official said the two ballot questions came about through a “very difficult process.” For nine months, Broward was unable to reach an accord with the 31 cities on a plan to increase the sales tax. Finally, she said, “we negotiated with all the communities” to create ballot language they could support. Cassini said she didn’t want to speculate on whether the ballot question will pass, she did say, “it was polling more than 50 percent [favorable] before we did our outreach.” Realtors, she said, have expressed concerns about the entire initiative. Some residents as well as the federal government are also griping about using the sales tax instead of the property tax to rebuild, restructure and revamp the counties’ innards. in Broward County, every level gets a piece of the pie. The county will get 50 percent of the revenue for the life of the penny sales tax for transportation purposes that include light rail expansion and traffic light synchronization. in addition, unincorporated Broward and the 31 municipalities will get the rest of the cash for projects like road repairs, for 20 years. During the final 10 years of the three-decade assessment hike, 60 percent of revenue will be turned over to Broward’s communities for infrastructure work. The other 40 percent will be shuttled off to the county for regional projects. in Palm Beach County, government leaders say the tax is need to fix a backlog of problems that began to pile
up during the Recession of 2007-2008 and beyond. The 50 percent chunk in PBC goes to the school district to repair and upgrade schools and their campuses. Bonlarron said Boca Raton education facilities are in line for some cash; specifically, J.C. Mitchell elementary School, due to get $1 million, and Boca Raton elementary School. The other half of the money would be split between the county government and the county’s 39 cities and towns. PBC will take 30 percent and the municipalities split the other 20 percent based on their respective populations. The county government plans to spend its share — $810 million – largely to repair roads, bridges, government buildings and other facilities. like the school district, county government plans to spend a large portion – at least 12 percent – on new projects, including new parks, buildings, streetlights, sidewalks, sheriff’s office substations and a homeless shelter. Bridge replacement and resurfacing of roads are in order in Boca Raton, Bonlarron said, including lyons Road and Military Trail, SW 18th Street and Palmetto Park Road. Park improvements will include work at the South County Regional Park in West Boca, including several new features. if the Broward questions fail, said Cassini, “things won’t get any better. There will be no rail beyond the street and no ability to create east-west express buses.” if Palm Beach County turns thumbs down, Bonlarron said officials will have to “look at alternatives – ad valorem taxes, bonding, and service cuts.
