The City of Coconut Creek Parks and Recreation Department is hosting its 15th Annual 5K Butterfly Run, a USA Track & Field largescale certified race. A portion of the proceeds will benefit the National Wildlife Federation. Race starts at 7 a.m. at Tradewinds Park, 3600 W Sample Rd, Coconut Creek. The race is open to all ages, and awards will be presented to winners in each age category. All race participants will receive a medal commemorating the 15th annual run. VALENTINE’S DAY AND ENGAGEMENT RINGS Februar y is of ten c onsidered a month of love bec ause Valentine’s Day falls on the 14th. That is the day when many couples are engaged to marr y, of ten symbolized by the presentation of an engagement ring. No mat ter the size or value of the engagement ring, it is an impor tant symbol of love bet ween the par ties. It can also be the most expensive piece of tangible personal proper t y a couple might own. Unfor tunately, many marriages do not last. In fact, many engagements do not result in weddings as many engagements are broken of f. This raises the question, “ Who gets the ring? ” when the marriage terminates or if a marriage never occurs. The law in this area is ver y State and fact specif ic. Some States base their law under a c ontract theor y, requiring consideration on the par t of the receiving par t y. Other States utilize a conditional gif t theor y, wherein the recipient is required to fulf il the terms necessar y to complete the gif t. For marriages that occur, States are generally uniform in f inding that the recipient of the engagement ring is entitled to keep it. This result follows bec ause the c ontract terms or the gif t requirements have all been met. Nonetheless, in the event of marital dissolution, it is impor tant to review State specif ic rules with respect to division of proper t y and the marital estate. But what about requiring a recipient to return an engagement ring when marriage never occurs? Here too, the States are split on the adoption of the c onditional gif t or c ontract theories. Florida has adopted the c onditional gif t theor y in the f irst impor tant case covering this circumstance, Gill v Shively, decided in 1975. Here the Cour t held that a donor may recover an engagement ring if the engagement was terminated by the donee or by mutual c onsent of the par ties. The rationale is that in these circumstances, there was an implied condition that a marriage be consummated with such c ondition not having been satisf ied. While one could argue, that this simple, easy to understand rule makes sense, it may prove troublesome if one enters into the engagement with a sinister intent to cause the f iancé to engage in a more intimate relationship, and the donee calls of f the engagement for a seemingly good reason. But for now, the general rule in Florida is that the ring is returned to the donor, unless that par t y terminated the engagement or other wise acted in a fraudulent manner. During this month of love, let ’s all hope for good things for ourselves and our families. Margate Middle School Mentoring Program

Officer of the Month Detective Shapira was honored as Officer of the Month for November 2016. Detective Shapira is an Economic Crimes Detective assigned to the Criminal Investigations Unit. He was instrumental in uncovering a fraudulent tax ring operating out of the City of Margate. The tax ring was responsible for filing 1,354 fraudulent tax returns resulting in 1.8 million dollars in fraudulent returns. The Margate Police department commends Detective Shapira for his hard work and dedication.

After A Collision, Can Your Statements To The Police Be Used Against You? Did you know that Florida law considers communications between police officers and parties involved in motor vehicle accidents to be privileged? In other words, statements made to the police cannot be used against you. This is called the Accident Report Privilege. Under Florida Statute 316.066(4), accident reports are not admissible as evidence in any trial, civil or criminal nor are any statements made by the participants in the accident to the police officer investigating the accident. This subsection states: “Each accident repor t made by a person involved in an accident and any statement made by such person to a law enforcement officer for the purpose of completing an accident repor t required by this section shall be without prejudice to the individual so repor ting. No such repor t or statement shall be used as evidence in any trial, civil or criminal. The result of breath, urine, and blood tests administered as provided in §316.1932 or §316.1933 are not confidential and shall be admissible into evidence in accordance with the provisions of §316.1934.” The reason behind this privilege is to allow for candid reporting about an automobile crash to the investigating officer. This helps the investigating officer determine who is at fault for the accident. The idea behind the privilege is to allow for the reporting person to feel free to speak to the officer without worrying that their words will later be used against them in a civil or criminal trial. The accident report privilege covers any communication made to the police officer by anyone involved in a motor vehicle accident. This includes the driver, the owner of the vehicle, and the occupants of the vehicle at the time of the accident. The privilege applies even if someone listening in as the officer takes the information tries to testify about what that person told the officer. Be aware though that not all statements made to the officer are privileged, nor are all facts that are ultimately put in the accident report. The privilege does not cover conversations with eyewitnesses who were not in the accident, like bystanders. It also doesn’t protect against the revelation of “factual findings” made by the officer investigating the crash such as the results of field sobriety tests, breath tests, and blood tests. So, the results of these tests are not confidential communications and can be used against you as evidence in civil and criminal cases. The police officer’s own observations at the scene of the physical evidence or non-communication related evidence are also not protected by privilege. So, the recording of measurements, any road or skid marks caused by the vehicles, final rest places of the vehicles, road debris or persons involved, and other physical findings, are not privileged under the statute and the officer can testify about those findings. Lipo Abdominoplasty for Body Sculpting

There are a number of important variables that determine whether a patient is a candidate for a lipoabdominoplasty. For any plastic surgical procedure to be a complete success, medical and psychological fitness for surgery is a prerequisite. The appropriate patient typically is close to their ideal body weight with anatomic features that may be improved surgically, including loose skin, excess fat, and weakened abdominal muscles. The distribution of fat is one determinant of the improvement a patient will have from a tummy tuck. Fat in the superficial tissue is the type that is possible to pinch. This superficial fat may be removed through excision (tummy tuck) or aspiration (liposuction). If skin laxity or looseness is significant, the skin and fat should be removed with a tummy tuck. If the skin elasticity is adequate; however, the superficial fat may be removed through liposuction alone. Liposuction may flatten www.CityNewsMagaziNe.CoM

When patients have excess skin that extends to the lateral hips and lower back or buttocks, an extended or circumferential abdominoplasty may be necessary. For most patients the resultant incision is well hidden within underwear and bathing suit lines. The procedure usually takes 2 – 3 hours. Patients should prepare to rest for a minimum of one to two weeks after their procedure.
